Patna factory in due time. Medio [illegible], and the last at the latest concerning the payment of toll for it before the end of the year, and as far as the opium is concerned, the juice in its raw state, sufficient to fill 800 chests, is likewise, according to the sums advanced, to be delivered in the Dutch lodge at Patna in strict adherence to the time and in proportion to the advances. The 2½ per cent duty due for the coining of money will be regularly paid to the king's officers, who are to grant receipts thereof, and strict adherence will be had about other duties which the Company and individuals are to pay for their merchandises at the Buxbandar at Patna, according to the stipulations made by the separate regulations on the subject, and the agreement entered into and the mutually signed regulation will be sacredly observed and fulfilled. Henceforth the Company at Patna shall no longer pay the peshkash that has hitherto been exacted and extorted from it for the freedom of trade in Bihar. At the re-establishing of the mint at Murshidabad, 2 or 2½ per cent will be annually paid to the Dutch Company in diminution of their claims to the former arrears, and the English Company will engage as Diwan to see this article performed, and proper care will be taken to that end. The Dutch Company, having according to its privileges the right to a free coinage of silver and other money into sicca rupees in the king's mint, and in a word to have money struck, so as soon as bullion or coinable specie is brought on its behalf, the Nawab will be desired to grant freedom and give the Dutch Company again free admittance to the mint at Murshidabad. Lastly, it is agreed that this convention, having been drawn up in the English and Dutch languages, mutually signed by the Governor General and members of the Supreme Council of Fort William on the one part, and by the deputies on behalf of the Director and Council at Chinsurah on the other part, will be immediately ratified by the said Director and Council. A copy will subsequently be delivered to each of the contracting parties, and after it has been translated into the Persian language, an authentic copy will be sent to the Nawab, requesting him to examine it and confirm his approbation with his seal. J. van Nierop, First Clerk Separate Article The English East India Company, and in this country on its behalf the Governor General and the Supreme Council of Fort William in Bengal, in their capacity as Diwan of the Emperor of Hindustan, guarantee to the Dutch East India Company in Bengal, Bihar, and Orissa, in any rupture, all safety and security against invasion and attack upon its possessions, whether by the Crown of England or any other power; so that in case it should unfortunately and contrary to hope happen, which God forbid, that the Republic of the United Netherlands Provinces should again be involved in a war with His Majesty of Great Britain, the English East India Company or the said Governor General and Council, by virtue of the right to the co-government of the country, shall leave the possessions and settlements of the Dutch Company in the above-mentioned provinces of Bengal, Bihar, and Orissa, and the effects to be found therein, entirely unmolested, and if required, will take upon themselves the care of devising arrangements which, on the one hand, protect the Dutch Company from harm, and on the other hand, can and must give security to the party acting or seeking to act offensively. Clerk Report concerning the experiences of the Junior Merchant and Provisional Secunde Willem Jan van Middlum, on the 9th of this month, pursuant to orders from the Honorable Lord President & Council at Hoegly, having been on a mission to their Excellencies the Lords Great & Little Nawab, to present two arzidasts sent hither from Hoegly. No. 55. The secunde of Middlum departed from here with the courtier Sheikh Babula, and paid his visit at the hours appointed by their Excellencies, namely at 9 o'clock to the Great Nawab and at eleven o'clock to the Little Nawab. Having arrived at the Great Nawab, he presented, after some compliments, the arzidast sent hither by the Lord President and Council at Hoegly, with the request that his Excellency might be pleased to give a favorable consideration to it and grant a speedy reply. The Lord Nawab having accepted and read the arzi, handed it over to his Diwan, adding to the secunde that it was certainly true that the Dutch Company had suffered great losses for about four years, that his Excellency was himself surprised that they had not come forward regarding this before, but since they were now making a claim, there might be an opportunity to remedy it. That his Excellency was well aware that the Dutch Company had always enjoyed great privileges for conducting their trade, but that it was a matter on which a proper answer could not be given except after careful deliberation; meanwhile his Excellency assured that he would do everything to be of service to the Honorable Dutch Company. Whereupon, after repeating the request for a speedy reply, the secunde took his leave with the customary compliments, and proceeded to his Excellency the Little Nawab. Having arrived at the Little Nawab, the secunde presented the arzi sent to this Excellency, and likewise requested in terms that the request made therein might be taken into careful consideration, and that a speedy answer might be granted to it. That his Excellency, having read the arzi, replied that this was no small matter, but of such weight that it could not be answered in two or three days; that it was also not entirely within his department, but that consultation had to be held with the Great Nawab about it; that he would speak with his Excellency about it, and send an answer in four to five days; whereupon the secunde, with another request for a speedy reply, took his leave, having nonetheless been able to observe from the friendly reception and entertainment of both the Nawabs that their Excellencies were well inclined to be of service to the Honorable Dutch Company to restore them to their ancient privileges, and to do their best in that regard. No. 56. Choice of Merchants, Gregorius Herklots, Director of the Dutch Company, live in peace. Your petition has come before our eyes, and that which you report concerning the repossession of the places and factories of the Dutch Company has been understood; we are very pleased about it, and concerning your request regarding the continuation of commerce, etc., have been in deliberation, as well as having ordered the Great and Beloved Khan Jahan Khan Bahadur Teffaretjenk, Faujdar of the customs house at Hoegly, to proceed with demanding the revenues and the course of the service and trade of the Dutch and French Companies as was anciently customary, which has thus been confirmed on behalf of the Nizamath; and whereas it is trusted that on the part of the said Company no oppressions, acts of violence, or hardships will take place in commerce, and that the accounts will be rendered completely, and the dustucks for the respective travelers will be granted as of old custom; so there has been appointed on behalf of the English, in the name of Mr. Kinloch, at the said customs house. To the Honorable Jacob Eilbracht and Cornelis van Citters, Esquires, Members of the Council at Chinsura. Gentlemen, We have the honor to acknowledge the receipt of your letter of the 31st ultimo, together with the papers transmitted with it. Being solicitous to comply with the wishes and requests of the Director and Council at Chinsura, as far as we deem ourselves at liberty so to do, we have desired the Board of Trade to take such measures as may appear to them most proper and effectual for facilitating the provision of the Dutch Company's investments. We have directed our secretary to obtain copies of the accounts and papers which you have asked for in relation to the capture of the Bark Constantia and the Pantzjalling Het Geduld, and to transmit them to you as soon as he receives them. We have the honor to enclose the answer which has been made by the Commercial Resident at Malda to your second complaint against his conduct, transmitted with your letter of the 13th of August. In respect to the several other matters and propositions which you have been pleased to lay before us in your 5th memorandum, we have the honor to observe to you that our letters of the 30th of August and 8th of September were full and explicit on all the points which you submitted to us; and that, although we do not deem ourselves at liberty to deviate therefrom, or to accede to the conventions which you have proposed to us, we shall nevertheless transmit copies thereof to our superiors in Europe by the next dispatch, and request their orders and determinations on the several subjects. Our assurances have been so amply given that the trade of the Dutch Company and of individuals under their government should receive every protection and support to be expected from us, that we trust any further assurances on this subject will appear to you, as they do to us, to be unnecessary. Under the supposition, Gentlemen, that the objects of your deputation to this government may not require your further residence here, and as we wish to show every honor and mark of our attention to your rank and the commission on which you are deputed, we have given the necessary directions that these may be shown to you on your departure from Calcutta. To William Barton Esqr., President, and the Members of the Board of Trade. Gentlemen! I have been favoured with your letter of the 20th ultimo, conveying a second complaint made by the Gomastahs providing the Dutch investment. Sickness has hitherto prevented me from giving an answer to that complaint, and still obliges me to aim at a concise one; but I trust that it will be sufficient. In the letter which I had the honour to address to you on the 29th August, I stated what that act of mine had been from which the Gomastahs took occasion to make their former complaint, as well as gave some account of their views, conduct, and character; and I flatter myself I made it abundantly apparent that I had done only what the public regulations, the interest of the Company, and general justice rendered natural, proper, and indispensable; and that on the other hand both the intention and practice of the Gomastahs directly violated all these considerations. The present complaint serves greatly to confirm all I then advanced. It proceeds entirely upon that gross fallacy which I before exposed, of representing an adherence to the Government's necessary prohibition of traffic with the Company's weavers as a total prohibition of all trade whatever in the country. This last is the sole idea suggested by the present complaint. It does not from thence appear that the Gomastahs at all know of any publication of that prohibition of Government, or have any consciousness that such a prohibition exists. It is a fact however, of which this whole country is witness, and of which any required demonstration may be given, that the general orders of Government containing that prohibition were the orders which No. 58.

It by no means appears from this that the Gomastahs have the least knowledge of any publication of that Government prohibition, or that they know anything of the existence of such a prohibition; nevertheless, it is a true fact, to which the entire country can bear witness and which can at all times be demonstrated, that the General Government orders containing that prohibition were the orders which I published upon the arrival of the Dutch Gomastahs in these quarters, and that these are the only orders to which I have had recourse on this or any other occasion of a similar nature. To prove this, I need go no further than to all such letters of mine to the Comp's Gomastah at Baddaal as the complainants claim to have seen. According to their own reports, everything about which they make representations occurred with him; however, in order to bring the charge home to me personally, they cite that my letters give countenance to the acts of violence they describe. I am pleased to be able to put this to the test. The enclosed paper contains Bengali copies of all the letters written by me to the Baddaal Gomastah or by him to me, in relation to the Dutch trade, from the first rumor of its commencement up to the receipt of the complaint which is now being investigated, and I request leave to lay before Your Honors herewith translations of those letters in the order in which they were exchanged. First, however, I must make it known here that on account of a report which was given to me early on, namely that some of my own servants had entered into secret engagements with the Dutch suppliers at Chinsurah (a matter which notably aggravated the intrusion of their people), I was obliged, for fear that this would also have influence upon the Comp's Gomastahs, to observe all strictness toward them, and particularly toward the one at Baddaal, who was the farthest removed from under my own supervision; and this circumstance, added to the abovementioned report, will give sufficient reason why use was made of some stronger expressions in the following letters. From the Resident to the Gomastah at Baddaal, the 9th of June 1785. I learn that persons on behalf of the Dutch have arrived in your quarter to purchase cloths. I charge you to take care that they may not obtain any of the Company's assortments, nor any cloths from the Company's Rootbandy weavers. In the year 1782 I sent you a copy of the Perwannah of the Governor General and Council dated the 19th of Bysack concerning the private purchasers of cloths; also their order of 1775 regarding the Company's weavers. It is my desire that these several orders now be published, and that copies thereof be posted on the doors of the factories of your quarter, and, to make them more generally known, you must proclaim them by beat of drum in the villages of the weavers. the same to the factory immediately after the letters which prove to be conclusive evidence against them. Gentlemen, that I need say no more to demonstrate that I am clear, both in intention and in deed, of those practices at Baddaal attributed to me by the Dutch Agents, who, however eager they may otherwise appear regarding this point, have nevertheless not been able to support their attempt otherwise than by letters which now turn out to deliver incontrovertible proof against them. This is the first and most material part of my answer. The first of the above orders, given by me to the Gomastah on the 9th June, which serves as the foundation of the others, clearly confines itself to the Company's weavers; the words are few and plain, such as are commonly used to forbid an illicit trade with these weavers; they could not be understood to extend to all weavers, for never has such an order been given, nor has the Gomastah had any power to enforce such an order, for the transmission of the public regulation alongside the letter took away all possibility of misconstruction, and the general publication thereof contained in itself the clearest determination of what was intended, while at the same time it thwarted attempting anything more than what was permitted by those regulations. That the Gomastah understood that my orders related solely to the Company's weavers appears unfailingly certain from his answer of the 11th June, and that same order, and that alone, is either positively expressed or implied in all my subsequent letters, which, although not many, would have been still fewer had I not received intelligence from him that the Company's Dalals intended to transact the business of the Dutch, and to have consented to this would have been tantamount to tacitly surrendering all the Company's weavers to that business, which I must either have chosen or refused, seeing the point was brought before me; and further because of the reasonable suspicion above intimated that the Gomastah himself might be secretly assisting in the provision. I flatter myself, Gentlemen, I need say nothing more to evince that I am clear, both in intention and in deed, of those transactions at Baddaal attributed to me by the Dutch Agents. As to what actually occurred at Baddaal, of all that the Dutch Agents allege, I am not yet fully informed in that regard. I have sent a copy of their charges to the Company's Gomastah and directed him to give his particular answer thereto with precision, together with all information relating to it. The time required for these purposes, as well as that which is necessary in the present season for the conveyance of letters, hardly permits of my having received a reply from him yet, but upon comparing his letter to me of the 30th July with the report of the Agents concerning what occurred on the 18th Srawbun, which is the same day, I cannot doubt that it is the same matter referred to in both; and from the report of the Gomastah it appears that only the Company's weavers and cloths were in question, and that the object of his endeavours was to secure these against alienation. I cannot but suppose that this must be the truth, and that the Dutch Agents, who never once advert to the distinction between Company's and other weavers, have willfully sought to represent the prohibition as universal. I shall, however, transmit the Gomastah's own account when it arrives, and in the meantime beg leave to add a few concluding remarks.

I had to note, as soon as the matter was brought before me and if no further place had been given, the well-founded suspicion cited above, that the Gomastah himself could secretly advance the Dutch procurement. I flatter myself that everything is ready, and I will nevertheless transmit the report of the Gomastah himself as soon as it arrives, and meanwhile request permission to add a few remarks here in conclusion. The Dutch Agents were ordered by their principals at Chinsura to send a suitable man regarding their affairs to the English Resident. In reply they say, twelve days after the receipt of that order, that they have not been able to find such a man, nor that they will be able to send such a person within two or three days later; and instead of taking that easy course, if they had any grievances to present, they send an inflammatory report to be submitted at Calcutta. One of them, or any person endowed with natural judgment, would have been completely sufficient; and if they pretend that there was no hope of redress from the Resident, well then they had every reason to send someone, as this would have given their representations all the more force. Up to this very day, about two months after their complaints, no one has been near me. Indisposition has delayed the transmission of the answer of the Gomastha at Buddaul to the second Dutch complaint; I now have the honour to present it to you, in the original Bengali and translated into English. In them the following facts are stated or implied: 1st. That the Company's Dallals themselves acknowledge that their dependants carry on the Dutch business. 2nd. That they moreover agree that the Dutch linens are procured from the Company's weavers; in palliation of which they allege that there are no other than the Company's weavers in that quarter; a matter which I have never supposed, and cannot admit without further investigation, knowing that to the westward it is otherwise. 3rd. That from these weavers the Dutch Agents had received in 4 months nearly as many linens as I had collected in proportion to the time throughout the whole season. 4th. That the dispute between the people sent by the Company's Gomastha to Buddaul Gutchie and the Dutch Agents there, who are said to have been accommodated within the dwelling of the Company's Dallals, related to the Company's weavers and the carrying away of so many of their linens by these newcomers. 5th. From the most important of these matters, which are said to proceed from the Dallals themselves, who covertly favoured the Dutch trade, it follows that the clamorous complaint of the Agents for that trade merely amounted to this: that they were questioned in doing as they pleased, without regard to the established privileges and prior advances of the Company; while they, not content with proceeding on such a principle, have likewise represented their trade as obstructed and their advances as being in the utmost hazard, when they had the support of the Zamindars, the help of the Company's Dallals, the labour of their weavers, and the regular return of the linens. 464 No. 61. From the Baddal Gomastah, October 1785. On behalf of the Dutch Company, three gomastahs have arrived at Baddal Gassie, who have established a factory there and are busy purchasing linens. I am doing my utmost with the Company's weavers to have them carry out their business; what have I to do with others? In order that the Company's linens that are being manufactured around Baddal Gassie may be taken care of as well as possible, I sent people thither to have certainty regarding the good behavior of the weavers and dallals. The naib and others belonging under the zemindar of Baddal Gassie have had some quarrel with the people whom I had dispatched on this affair. The naib and others have gone to their own dwellings; when the cause of the dispute comes to my knowledge, I shall inform your honors of its particulars. 465. worked; they answered me that besides the Company's weavers there were none, but that the Dallaals in Dutch service gave advances to all these on cloths of the coarse sort, and that in that manner they obtained small quantities. 2. I have sent a serear to put a mark upon the Company's cloths which are now on the loom at Baddaal Gassie, and since the returns from there are now diminished, I have likewise sent a havildaar thither with orders to do his utmost with the Company's Dallaals to the end that the cloths may be sent hither as speedily as possible. The havildaar upon his arrival told the Dallaals that the deliveries of their cloths were much diminished, and that notwithstanding the large balances that were in their hands no returns came in; he at the same time asked them whose Gomastahs these were who had come to buy up cloths. They answered, these people belong to the Dutch. The havildaar then said, if these people really belonged to the Dutch Company, they would certainly have brought a Perwanah with them and also would have given my master notice of their permission. 3. The Dallaals of Baddaal Gassie have within their dwelling place given a place for the Dutch Company's factory. The havildaar met in the said houses the Naibs of the Zemindar and told them that in the Aurungs there was much of the Company's money outstanding on advances, which being the case, he desired to know to whom these other buyers belonged. The Naibs answered: we are the Zemindars, the ground is ours; in the Zemindari are to be found both honest people and rogues; if you have force enough, you can drive these people away. The havildaar answered: if I receive orders thereto from my master, then I will certainly do it. Baddaal Gassie belongs to Hissinaat Raaij and others, Zemindar of Schangerkoer, and lies in the pergannah of Senderpar. The names of the above-mentioned Naibs are Tarinielhier or Buncheraud and Kirperam. From information upon which I could depend, it appears that the purchases of the Dutch Gomastahs down to the 15th of 8br amount to 4000 pieces; of this number they say that eleven hundred pieces are at the washing place, six hundred of which were already prepared and dressed, but none have yet been dispatched to Chinsura. No. 62. 466. Honourable Sir and Gentlemen. I am exceedingly sorry to find that our representations have not met with better success. The length of time required both for referring the same to the decision of our mutual superiors in Europe and for receiving their determination thereof, does certainly leave the concerns of the Netherlands Company in a doubtful situation, and besides this, even supposing that their possessions in this country were guaranteed to them from Europe, or that some arrangements might be made thereabout which may prove satisfactory to both parties, what are the benefits to be reaped therefrom, if a full liberty of trade is not to be obtained, since the one ought to remain inseparable from the other. And since matters can no further be discussed here upon these subjects and the object of my commission is ended, I have the honour to take my leave of this honourable assembly, intending to proceed to Chinsura and report to the Director and Council on the outcome of the matters. I also request permission to express to His Honour the Governor-General and the Gentlemen of the Council my gratitude for the personal attention shown to me during my stay in Calcutta. Statement of the expenses incurred during the commission dispatched to Calcutta, comprising the undersigned with the Patna Chief van Citters and assisted by the First Clerk van den Broeck, since the 1st of August to the 21st of November 1785. House rent, as shown by two receipts from James Resiott annexed hereto, paid: Sicca Rupees 1272:10:— Expenses both for the household and incurred during the journey back and forth, beverages as well as otherwise included therein: Sicca Rupees 2168:5½ Peons, bearers, massalchees, and other necessary servants for the three of us: Sicca Rupees 874:3½ A writer for 3½ months: Sicca Rupees 200:—:— Sum: Sicca Rupees 4515:2½. Comparison In the year 1760, the commission, which then lasted only a few days longer than this one, cost Sicca Rupees 6699:15:— or 50552 guilders and 3 stivers Indian money; so that the present one, mainly under the head of higher house rent, as one then paid up to 150 guilders per month, but for which it is presently utterly impossible to obtain any habitable house, amounts to 2184 Rupees and 12¼ annas less: arising mainly from a retired and economical way of living, whereby the domestic monthly expenses, which in the year 1760 amounted to 4747 guilders and 10 stivers, have now turned out so moderate, besides the fact that, in connection with the same, 1500 guilders was paid separately for a banquet to the Governor and Council in Calcutta, which has not taken place now, however much, just as then, the renewal of friendship could have provided a sufficient reason, although nothing could be objected to omitting such, especially in order not to burden the Company therewith, for which reason also our servant wages, with the utmost management, are not reckoned higher than 874 Rupees and 3½ annas, whereas in 1760, with the hire of two palanquins not brought up by us, they cost 2524 guilders and 10 stivers Indian money. Thus, in general, the expenses are much less now than in 1760, because for the sake of economizing on them, two days after our arrival in Calcutta, two budgerows and all the small vessels were sent back here, and there remained with us only one budgerow and two panshways.
