423 I have the honor to acquaint you that the complaint preferred by the agents from Chinsura against Mr. Charles Grant, Commercial Resident on the part of the English Company at Malda, and transmitted with your letter to the Honorable the Governor General and Council of 15 August, was referred to the Board of Trade, and by them transmitted to Mr. Grant for his reply to it, but that the illness of that gentleman does not admit of his entering into an immediate justification of his conduct. The Board are assured of Mr. Grant's reply to the complaint as soon as his improved health shall enable him to make one, and the same will be communicated to you. The Honorable the Governor General and Council having renewed their inquiries and taken considerable pains to ascertain Gentlemen. To the Honorable Jacob Eilbracht Cornelis van Citters, deputies from the Council at Chinsura Gentlemen. No. 47 the custom which prevailed at the Buxbunder in respect to the collection of the government duties on the foreign trade before the commencement of the late war, and having obtained new light on the subject, an amended code of regulations has been prepared to be substituted in lieu of those which accompanied the Board's letter to you of the 8th ultimo. I have the honor to transmit to you a copy. The Board trust that these new regulations will be satisfactory to the Director and Council at Chinsura. That all ships belonging to the French, Dutch, and Danes be permitted to proceed to Chandernagore, Chinsura, and Serampore, having undergone the usual inquiry at Fort William or Budge Budge on their passage up the river, but upon the arrival of the ships at the foreign settlements, there is to be delivered to the Buxbunder, before any goods can be landed, an authentic manifest of the ships' lading, whereupon the Collector of the Buxbunder will give the necessary orders for the cargoes being landed. Article 2. That the French, Dutch, and Danes be permitted to dispose of any part of their cargoes at Calcutta, paying the established duties there agreeably to custom. Article 3. That the French, Dutch, and Danes be likewise permitted to land the cargoes of their ships free of duties at Chandernagore, Chinsura, and Serampore.

425 Article 4: That when the French, Dutch, and Danes wish to export any part of the said cargoes, they shall pay a government duty of 2½ per cent under the head of merchandise. Article 5: That the Chiefs of the French, Dutch, and Danes be permitted to issue their own dastaks, whether for the goods of the Company or those of individuals, provided that the quantity, quality, and price of the goods be specified on each dastak. That these dastaks shall upon all occasions be accompanied by an invoice, on which the goods mentioned in the dastak are specified, showing the quantity, quality, and price; further, the date and number of the dastak and the invoice must correspond, and both must be signed by the Chief. Article 6: Upon the export of goods from Chandernagore, Chinsurah, and Serampore, or upon the import of inland goods into those colonies, the vessels shall be stopped at the Buxbunder, and the dastak, on which the quantity, quality, and price of the goods are stated, must be shown. An invoice must also be delivered, which shall remain in the office of the Buxbunder and be registered in the English, Persian, and Bengali languages, namely: the date, the number, the name, the goods, whence exported, and whither destined. Whereupon the laden vessels may pursue their voyage with the dastaks, which shall be endorsed on the back by the Collector of the Buxbunder, while the seal of the officer appointed by the Nawab shall also be affixed thereto. But if the Collector should, in his judgment, have reliable information that the vessels contained more goods than are specified on the dastak or invoice, he shall immediately make this known to the Chief, who will send one of his own officers to the Buxbunder to examine the goods jointly with the Collector of Customs. The surplus shall be confiscated, and double duty shall be levied on the amount of the goods specified on the dastak or invoice. Article 7.

426 That chokies or security guards shall be placed within the limits of the government, and outside the gates of Chandernagore, Chinsura, and Serampore, to prevent the import or export of goods going and coming by land that are not properly provided with a signed dustuk or invoice, according to the manner prescribed by these regulations. That only the Chiefs of Chandernagore, Chinsura, and Serampore shall be permitted to issue dustuks. That the Chiefs of the various Aurungs in Bengal, Behar, and Orixa shall be permitted to draw up the invoices that must accompany the dustuks. That all goods brought by ships belonging to the French, Dutch, and Danes shall pay an export duty of 2½ percent to the government, and that for all goods coming from the Aurungs and other places into the settlements of the foreign nations, an import duty of 2½ percent shall be demanded. At the expiration of every three months, the Collector of the Buxbunder will draw up an account with the French, Dutch, and Danes according to the invoices registered at his office. The duty must then be paid to the Phousdar on behalf of the Nawab by the respective Chiefs, and those Chiefs are accountable for the amount of duties calculated at 2½ percent on the amount of each invoice. That all goods imported or exported at Chandernagore, Chinsura, and Serampore that are not provided with a dustuk or invoice, approaching a custom house or authorized guard post or station of inquiry, shall be confiscated. That no goods imported from the various Aurungs etc. shall be transported without a dustuk and invoice, as mentioned in the 7th Article. That the natives of Hoogly and other districts shall be obliged to take out rowanahs from the Buxbunder, according to former uses and customs. Article 15. However, to prevent vexations that might arise from providing false information, it is understood that if it should appear that groundless reports have been made, the vessels shall then pass free of duty, and the informer shall be punished and compelled to pay the duty owed to the government. To Edward Hay, Secretary to the Supreme Council of Fort William. Honourable Sir, The letter with which you were pleased to honor us by order of His Excellency the Governor General and the Gentlemen of the Supreme Council, dated the 10th of this current month, together with the further regulations annexed thereto concerning the accountability of the customs at Buxbunder by the other European nations in this country, was yesterday the subject of the deliberations of the Director and Council, to whom we communicated the same, and by whom we have been furnished with orders to reply thereto. We are actively engaged in carrying their orders into execution, and it will be our principal endeavor, as we hope, to be able to bring an end to our commission in the coming week. The reply not yet received from Mr. Grant will delay us less than the requested accounts of Captain Geddes, which are all necessary to be able to judge the balance offered in payment, and why we take the liberty of addressing you once again in this regard. On the other hand, we beg pardon and excuse for the extensiveness of our representations and that we have thereby perhaps drawn the attention of Your Excellencies away from weightier subjects. However, the importance of the matter and Your Excellencies' own favorable reflection that it required clarity and emphasis encourage us to hope for a favorable indulgence, even if we might now be too detailed in our reply, which we shall nevertheless curtail to the best of our ability. Section 4. The objection as if several of our claims were of an ancient date, indeed already presented before the war and submitted for the decision of our mutual principals, does not, subject to favorable correction, invalidate the right to revive them and therefore to insist upon them until right or wrong is decided. At least the convention of 21 April 1780 held out to us, between His Excellency the former Governor-General Hastings and our then Director Mr. Ross, suffers from more than one defect. Furthermore, it was accepted by the Council in the trust that the Noble High Indian Government at Batavia would be pleased to confirm it. This did not happen; on the contrary, those Gentlemen completely disapproved of it in their respected letter of 20 July 1781, which on account of the inconvenience of the war was not received at Chinsura until October 1784. Their orders expressly direct us to work out a more lawful and equitable agreement, and it was thus on the foundation of those orders, especially regarding the need for opium and saltpeter, and since the re-establishment of the Company's trade in this country in general, that our employers understood and considered it necessary to employ the most efficacious means toward a free, undisturbed, and extensive exercise thereof, and by a concise representation of the right thereto, to see to make such an arrangement as could prevent all complaints and representations in the future. has been stipulated. By the second Article respecting the dignity of the Netherlands Company and their right to a free, uninterrupted, and extensive trade equal to that of the English Company. 11. These two Articles having previously been acknowledged, the others may be said to follow of themselves. Thereby, on the one hand, will be secured to the Netherlands Company that safety necessary for the carrying on of their trade in Bengal, and on the other hand it will remove all suspicions about a clandestine trade, which seem to hinder the progress of our affairs this year. The eighth and ninth Articles settle the annual delivery of opium and saltpetre at Patna, the first to the amount of 800 chests, and the last to 36000 instead of the usual 23000 maunds, and the tenth Article speaks of a condition which needs must follow, namely, the abolition of the Peshkash at Patna, which has been introduced on the free trade of Bihar, and of course ought to be discontinued as soon as that freedom is disputed. In support of this claim, the Director and Council have now moreover recourse to the Convention made with the Nabob on the 23rd August 1760 under the guarantee of your Government, it appearing by the reply to the eighth Article thereof, written by the Nabob's own hand, that the Netherlands Company shall not only not be troubled with unusual claims concerning duties or otherwise, but also that on account of the annihilated saltpetre trade, no Peshkash shall any more be demanded thereon. 12. Company's ships never come higher than Culpee, and therefore can not be subject to an examination such as those that must pass Fort William or Budge Budge. Our private shipping is of so little importance that for the present we do not yet foresee an influx of private ships; should these, however, be comprehended under the general terms of the examination, we are ready to make a separate article thereof in our regulations, allowing it to influence the 14th article concerning private trade in order to prevent all misunderstanding and trouble. Provision has also been made in the second article of our regulations against the detention of vessels sent up with goods unloaded from the Company's ships or craft, after the general cargo has been customed according to the 1st article. The third and fourth articles of our regulations serve as a precaution so that, when the accounts of the customs due are drawn up, the Company shall not be demanded anything other than the payment of toll for what is intended for trade, which indeed seems to be the intention of the fourth article of the Calcutta list. Yet, the lack of a specific determination might occasionally cause disputes as to which goods are suitable for trade and which for use or consumption, whereas, in case of an agreement, it can be proved by distinctly specifying the one and the other. Extract of a letter from Mr. Dorrien to the Earl of Sandwich, dated in the East India House the 3rd of November 1763. I had your Lordship's favor enclosing the note delivered to your Lordship by Count Welderen, both which I have communicated to our Secret Committee, who agree with me in thinking it very extraordinary that the Dutch Company should desire us to send further orders to prevent acts of violence in the East Indies, knowing the orders we have already sent to that end, which were approved by the King's Ministers at the time, and communicated to the then Dutch Ambassador. An extract of our general letter of the 2nd of April 1762 containing those orders we take the liberty to enclose for your Lordship's perusal. Nothing is more certain than that we desire to be on good terms with the Dutch Company, that we have no intention to commit hostilities against them, to violate any of their just privileges with violence, or do them any injury whatsoever. These our dispositions your Lordship will find expressed in the orders I have mentioned; we know not how to express it more forcibly. Translated by Gregorius Herklots, Sworn Clerk. Extract from the Company's general letter to Bengal of the 2nd of April 1762. The Right Honorable the Earl of Bute, one of His Majesty's principal Secretaries of State, having signified to us etc. We, in obedience to His Majesty's commands as well as being desirous to do everything in our power to facilitate an accommodation between the two Companies, do therefore hereby positively order and direct that you do not commit any hostility or act of violence against the Dutch Company's ministers or agents; on the contrary, you are to use your best endeavors to cultivate by all sorts of good offices a reciprocal friendship and good understanding with them, and in particular if the Nabob shall unjustly attempt to molest the Dutch Company in Bengal or in any way prejudice them in their trade, privileges, or property, you are to interpose your good offices in order to procure them redress and satisfaction, and if those should prove ineffectual, you are to aid and defend them to the utmost of your power, it being our sincere desire and intention that the Dutch Company shall enjoy freedom of trade, safety, and protection equally with ourselves. Whereas representations have been made by the Director and Council of the Dutch East India Company at Chinsurah, that their gomastahs have suffered and still suffer great hindrances and vexations in the collection of linens for the said Company, and whereas a proclamation was made under the seal and orders of the Dewan in the month of [illegible] that the weavers in the provinces of Bengal and Bihar should enjoy a perfect and complete freedom to trade with whomsoever they pleased; and that no person should make use of force of any kind to compel the weavers or other manufacturers to receive advances of money, or to bind themselves by contracts to deliveries of linens against their will, and that all such persons as might offend against these orders should be severely punished: Notice is hereby given to all gomastahs, dalals, paikars, and others acting under the authority of the English Company, or engaged in the service of persons belonging to its jurisdiction, that if any of them shall commit any act of violence against the weavers or other manufacturers of cloths and raw silk, to compel them to enter into their service or to receive money by advance, or if they should by any unlawful means disturb or hinder the lawful trade of the Dutch Company or of any other merchants of whatever nation they may be, they shall be punished in a severe and exemplary manner; and to that end, orders have been issued to the Chiefs and Councils of all the Provincial Factories to receive and immediately investigate all complaints that shall be brought before them concerning such abuses, and to punish the authors of the same. a respectable privileged trading Company, lawfully authorized by firmans, Nisans and Senneds to carry on a free, uninterrupted and unlimited trade in the Hindostan Empire equal to that of the English Comp. In order to prevent all complaints about clandestine trade, the Netherland Comp. will send every year in the month of Jan. to each Aureng a Gomastah, provided with a passport from the Director of Chinsura, as proof that he has been appointed and has arrived there to contract with the weavers and suppliers for the collection of piece goods. Private merchants being subjects of the Netherlands Company intending to make any agreements for the manufacturing of cloths in the Aurungs, are to apply for permission to the Director at Chinsurah or to the Chiefs of the subordinate factories, and to stipulate the sum which they wish to employ for the purpose, which amount is to be mentioned on the passports, and they are then to be provided for according to what the circumstances of time and trade will allow of. Article 7. As no agreements can be made respecting the liberty of collecting our own opium and saltpetre, and as the Netherlands Company has since several years bought and received those articles from the agents of the English Company at Patna, it has been agreed to continue by this maxim till the decision thereabout shall be received from Europe. The English Company therefore engages annually to provide the Dutch Company at Patna with 800 chests of opium and 36000 Maunds of saltpetre. Article 8.
