31 December with the following document. To the Honorable, Worshipful Mr. Isaac Titsingh, Director over the Honorable Company's Interests in Bengal, together with the Members of the Honorable Council of Policy. Right Honorable, Worshipful Sir and Esteemed Councilors. Your Honors having ordered Messrs. Perette and Hamilton, as plaintiffs before Your Worshipful Assembly concerning the Bengalis Goluktsjend and Ramkanto Mitter, to submit such considerations as they might think fit to make upon the incoming reports of the five arbitrators appointed in that matter, the undersigned have the honor to comply therewith on behalf of their principals by this present document. The arbitrators jointly state that the commission given to them entailed: that, whereas Goluktsjend Mitter showed that Ramkanto had taken the debts he had upon his own account, under the condition that he, Goluk, would receive nothing else from his father's estate than a portion of the furniture, clothes, etc., they should therefore investigate whether, according to the customs of this country, the debts contracted prior to the making of this agreement with the aforesaid English gentlemen or others, were for the sole account of Ramkanto Mitter, or for the responsibility of both. In general, one might observe concerning this commission that its origin lies merely in an evasive scheme of the actual, original debtor Goluktsjend; for, strictly speaking, it matters not in the least to the actual case whether they are separated or combined, seeing that Goluk is the principal debtor, for whom Ramkanto bound himself as co-principal debtor, whereby they became liable in solidum for the claim of the Gentlemen Plaintiffs; without it being of any consideration whether they are combined in their affairs or separated from one another. However, if one wished to reflect on the nature and merits of that so-called separation, made on the one hand by a person who was imprisoned for debt, and on the other hand by a cunning deceiver, without the consent of any of the creditors, thus in a clandestine manner, and signed by suspect witnesses, then the same must be regarded as nothing other than a suspicious compromise, devised from both sides in fraudem creditorum, and executed in an illicit, nay, punishable manner; and thus in no way admissible. The arbitrators themselves seem to have been unable to come to an agreement; for after having been busy therewith from the month of April until October, or about six months, they have finally come forward with two separate reports, which clearly indicate that the matter appeared suspicious to them; at least, a fierce mutual dispute arose from their differing opinions. For according to their reports, three of the five, namely Peddonaat Moekerdja, Bersjkinerboos, and Bhouaneepersaat Sourom, skimmed over it superficially, and the other two, namely Bankbeherie and Paarbottytjeen, tried to conduct the investigation as was proper, which is how these separate reports came into being. That of the first-mentioned three at least contains little other than the insertion of some papers; they undertook to examine much, but executed little or nothing thereof, and end their report with just as great uncertainty as it began with confusion; they do not even mention a single word about the nomination of superarbitrators to bring them all, if possible, to an agreement in understanding; whereas the report of Bankbeherie and Parbottytjeen nevertheless clearly says that Kooidepersaat, Rentjemend Raay, and Baboe Beherrie Laal were nominated and authorized on the back of the warrant issued to the five by the Zemindar for that purpose; although in the report of the other three the names of two of them are only casually mentioned, and neither of the two reports is signed by these superarbitrators; which likewise provides no small suspicion for objection. These two separate reports of the five arbitrators were subsequently submitted for the decision of four appointed commissioners to judge which of the two was to be held acceptable, and these have declared themselves in favor of the three; without, as it seems, paying any heed to the aforesaid notable defects, to which all that difference of opinions and the leaving of the reports unsigned by the superarbitrators must be attributed. They simply declare the paper signed by three of the five to be acceptable, but sound reason declares itself for that of the two; at least, if Your Honors would please take the trouble to read both with attention and confront the one against the other, Your Worships will perceive that that of the two is a more or less reasoned document, and that the three others ran over it like a hen over hot coals, which is the most accurate idea one can form of this trio in this matter. The only thing upon which all five of them agree is with respect to certain circumstances which Goluktsjend Mitter adduced in a delivered answer, consisting in this: that, after his release from the jail, he was present in Calcutta for a long time, that he was in conversation with the Gentlemen Plaintiffs several times without them having called upon him to co-sign the bonds, nor having shown any intention to complain about him, which circumstances, according to the statement of all five, if they were proven to be the truth, would release him, Goluk Mitter, from accountability; but regarding the proof itself, all five of them leave it in equally great uncertainty and confusion, and the solution

Thus leaving the reports of these arbitrators, although the undersigned attach the greatest value to that of Bankbeharie and Parbotty, to the judgment of Your Honorable Worships, they only request permission to draw Your Worships' attention for a little while to the fraud committed in this matter by both the Mitters; namely, by placating their creditors with so-called Company's Bonds, which they both knew were of not the slightest value; nay, which they seem to have taken rather to make them serve in their intended bad conduct than to make any delivery upon them, seeing that nothing has been fulfilled on them: intrigues for which they ought to be punished exemplarily, as constituting a double crime; namely, on the one hand, deceiving strangers with papers which they gave the name of being Bonds, while knowing very well all the while that they were no bonds, and on the other hand, in furtherance of this roguery, making a mockery of and injuring the credit of their old protector and generous master, the Company, under whose protection Golek himself confesses that his ancestors enjoyed so much good. It is for all these reasons, and by virtue of what the gentlemen plaintiffs have demonstrated in their advice to Your Honorable Worships yourselves, that the undersigned must continue to hold both Mitters liable; requesting, in their principal's name, that provisionally all their houses, goods, and effects shall be declared encumbered and executable for their debt, and that, having forfeited the ordinary consideration usually shown to Company's merchants through the aforementioned criminal fraud, they may both continue strictly confined in future in one of the Cutcherries and not in the Company's Lodge until they shall have paid in full, which they are very well able to do according to their own papers; the one in the capacity of original debtor and the other as having made himself co-principal debtor, thus both liable in solidum; with condemnation in the expenses already incurred and still to be incurred. As regards the first part of his defense, the same was completely refuted by the very letters of Goluk Chunder, which clearly prove that the entire debt was his own, and that he himself and his property are bound to satisfy it. And as for the last part, since the first must fall, it naturally follows that the conclusions drawn from it are likewise of no validity, insofar as the person and property of Ramcanto Mitter are equally answerable for the entire claim, by virtue of the execution of the two bonds in favor of Mr. Tiretta and me, so that the properties, whether they are possessed by both of them together or each separately, and whether or not they have been divided between them, always remain liable. And if there is anything that can serve further to demonstrate the impudence and roguery of the persons who would set up such a defense, as well as the security itself, all of which I have accepted, as I have already stated in my previous address, all of which is capable of the fullest proof; wherefore I rested fully assured in myself that the consequences of the hearing and adjudication of this matter would be the obtaining of a judgment against the persons and properties of Goluck Chunder Mitter and Ramcanto Mitter for the full amount of our respective claims. It was with no small degree of astonishment that I received information that Goluk Chunder had, by way of defense against these claims, represented them as debts of his uncle Ramcanto Mitter, and had submitted a deed or written instrument said to have been executed between the two of them, whereby their estates were separated and they were mutually declared not answerable for each other's debts.
