Circular Whereas complaints have been brought before our Council of Justice concerning a murder committed at Fulta, one of the usual anchorages of our ships in this River, on an English innkeeper there by name John Reed, and from the investigation made into the perpe„ „trators of that crime it has appeared that the head cooper of our ship Straalen arrived here from Europe, named Ernst Daniel Luder, was the instigator of the dispute in which this manslaughter was committed, and by his subsequent flight has made himself suspect of being guilty of that crime, so we politely request of Your Honors, as an act tending to the maintenance of good justice and general peace and safety, to cause an investigation to be made after this person and upon discovery to 12 Janr 3 have him handed over to us, in order that, if found guilty of that villainous deed, he may be brought to justice in such manner as according to the circum„ „stances of the case will be found to be pro„ „per. We have the honor to acknowledge the receipt of Your Honors' letters of the 24th and 30th ultimo. We are much obliged by the orders you gave for making strict enquiry for the man named La Cosse, who stands charged with having murdered a Native. A letter which the Governor General has received from Captain Frimont at Chandernagore affords us reason to believe that the man, who being found at that place, was put into confinement & afterwards escaped from it, had proceeded to Chinsura in order to embark for Batavia. We are much obliged to Your Honors for the orders that were issued by you for a strict enquiry into the person named La Cosse, who is accused of having murdered a native; from a letter that the Governor General has received from Captain Frimont at Chandernagore, we have reasons to believe that this man, who, having been found at that place and taken into custody, escaped from there, has proceeded to Chinsura with the intention of going to Batavia. In consequence of the representation made in your letter of the 30th December, we have given orders for a strict enquiry to be made not only in Calcutta but throughout the Provinces for Ernst Daniel Luder and to seize his person if it shall be found. Heijning. Wednesday the 24th of January Anno 1787 In the morning, absent the merchants Krayenhoff and de Bas, who have gone downriver for the dispatch of the return ships. After concluding what was recorded in today's general resolution, the Director communicated that the person named La Cosse, who was accused of manslaughter and on that ground claimed by the English gentlemen in their letter of 11 December last, was discovered on board the hooker ship De Standvastigheid and brought hither this morning; that His Honor, considering the crime of which this man made himself guilty, would not hesitate to hand him over to the English; but that Mr. Dangereux, Commandant at Chandernagore, in a private note to him, the Director, had also claimed the same man as a deserter of the French nation, who by virtue of the existing cartel ought to be returned; His Honor requesting hereupon the opinion of the meeting. Upon deliberation concerning which, it was taken into consideration that, as the crime had been committed among the English nation and they had also been the first to claim the perpetrator, it seemed natural that he ought to be handed over to them to receive his punishment, all the more so since it was known that he had already been in custody with the French, but that they had let him slip away again; that meanwhile, in order not to appear to show any partiality in this case or make any breaches in the cartel that exists with the French, representations could also be made to Mr. Dangereux in private regarding the reasons one believes to have for handing him over to the English rather than to the French, with the request to let them prevail in this case; and the Director having been pleased to take this latter task upon himself; thus it was approved and resolved to hand the said arrestee over to the English gentlemen in case Mr. Dangereux should waive his claim to him, and then by a note to the

Whereupon it was remarked at the Meeting on the one hand, how the Patna factory becomes useless for the Company by an allocation at Calcutta, which was also to be expected with a Demand for Saltpeter; that the opium prepared by our Servants is always of better quality and therefore the orders for that own preparation were repeatedly and most emphatically enjoined upon us by Their High Honors, because of the considerable Profit that the same yielded upon sale at Batavia: that one was thus as it were bound to continue insisting upon the maintenance of the old custom, were it not that against these considerations, on the other hand, it ought to be weighed how this offer was to the highest degree advantageous for our Company, because by receiving it at Calcutta not only were many transport expenses and the risk saved, but because one is informed that the prices which the English Company pays to the Opium Contractor for that juice differed considerably from what is spent for it by our Company at Patna; that although it is to be expected that this Opium to be received at Calcutta will not be of equal quality as that prepared, according to the order, by our own servants, this lesser quality is however amply compensated by its lower price; that besides, being obliged to pay the cost after receipt, thereby ceased the anxious

17 April having been transmitted to the servants, with orders to report in detail how the matter stands with that case, adding everything that can serve for elucidation and, if necessary, transmitting proofs to substantiate what might be brought forward by them in their complaint regarding this; and in answer to this it being communicated by them, in their separate letter of the 3rd of this month, that they never interfered with the affairs of the Dewany Adalat at Sjoppra nor ever gave any encouragement to people who came to take refuge in Doolit Gends, but that they have solely sought to prevent the introduction of innovations and infringement upon the ancient customs by preventing the English at Sjoppra from violently taking the inhabitants of Doulet gends from their houses and making them appear before their court; that since the Dutch Company has been in possession of that district until the recent war, its servants had always exercised the right to decide all disputes of the inhabitants, while all complaints against them were left to their decision, without any of the rulers ever having usurped any territorial or legal jurisdiction over the place, or command over the inhabitants, and that after the peace the village was taken into possession again without any prior conditions or new obligations; that upon the repeated complaints and representations of those inhabitants about how they, in the place itself, were molested by English sepoys and how people wished to compel them to appear before the Dewany Adalat, which had never before been customary, the chief Van Citters had ordered them, according to the customs of the country, to submit their grievances in writing, as they had also done, by two arzies, or petitions, which he sent to Mr. Montgomerie with a letter of this content: Dear Sir, The daily complaints of the inhabitants of Doulet Gends, the district of the Dutch Company at Sjoppra, make me take the liberty to send you two arzies in which their grievances are stated. I request that you will take the trouble to examine them, and if you find that they are well-founded, that you will kindly provide them with satisfaction in that regard. The only thing I desire is that our business be conducted on the same footing as before the war, and that no innovations be introduced in that regard. I have the honour to be, Dear Sir, your most obedient humble servant, signed, Cornelis van Citters Aarnoutsz. At the side: Patna, the 29th of August 1786. Below that: Archibald Montgomerie, Collector. To which an answer was received from that gentleman, reading as follows: Dear Sir, I am favoured with your letter relating to complaints laid before you by the ryots of Dowlet gunge. I can assure you, so far from making any innovation, I have in more than one instance granted indulgence; the present case concerns a tax ever received by the zemindar of Burrampore and till now met with no opposition. I wrote to Mr. Baumgardt on the subject, having been led to suppose that Dowlet Gunge was immediately under him. Mr. B. answered me by ordering his agent to throw no more impediment in the collecting that tax; notwithstanding, the zemindar has not yet received a rupee. As to any oppressions, not one has been mentioned, nor does the acting person represent any such. Permit me now to request you will issue the necessary orders for the enabling the zemindar to collect the tax, for it forms a part of his revenues; and further must beg you will cause a reprimand to be given to the head man for insolent behaviour to me in person, and for taking on himself to hold an adawlat even so far as to confine a gentleman's servant, wishing ever to avoid disputes.

17 April Proofs in evidence of the Company's ownership of that village. Further representation of the employees. being so, the employees had thought the matter was concluded herewith. Furthermore, that in order to refute the assertion of the English Gentlemen in the said Calcutta missive, as if Dowlet Genasj were leased by the Dutch chief for a fixed price and thus had to be regarded as being in the hands of a private individual who could not exercise the aforesaid right, and to demonstrate that that place actually belongs to the Dutch Company, the necessary written proofs would have to be produced. The employees, however, testify that they are unable to do so, because the former chief Radermacher, after the capture of the factory by the English, handed over the papers of ownership thereof that had existed to their commissioner, which were not returned upon the restitution of our places, under the pretext that everything had been destroyed by the people of a certain Raja, who during the war had been assigned the lodge for his residence; that the employees could therefore only adduce as proof of that ownership the oral testimony of the inhabitants, namely that Dowret Gends has belonged to the lodge at Sjoppra for a hundred years, having been ceded to one of the Dutch chiefs by the owner of that land, Surawer Chan, for a sum of money enjoyed by him as a loan, on the condition that if that amount were not paid off at a certain time, the same piece of land would be declared forfeited, provided that the chazannah (ground rent) was paid annually for it to the landlord; and that thereupon the same was transferred to the name of the Dutch Company, which has since then paid the ground rent every year to the rightful claimants; thus this village cannot be regarded as leased by the Dutch chief, and the English themselves must not have understood it that way either, since during the recent war that district, alongside the lodge, was taken into possession by them, which would not have happened had it been private, as private property was left untouched; and upon the restitution of the Dutch possessions, that village was surrendered again at the same time with that factory; and finally, that this is all that the employees are able to report regarding this matter. Deliberation taken upon the foregoing. Decision regarding this. After resumption and consideration of all of which, it being judged that to this elucidation and representation of the employees nothing could be added on the part of the assembly to prove further the right of ownership to a village that is not known in the Company's papers to belong among its possessions, and most members testified never to have heard of it and thus not to have known that it belongs under the lodge at Sjoppra; it is, on the proposal of the Director, approved and resolved to answer the letter of the Calcutta Gentlemen according to the contents of the aforementioned Patna writing, with the addition of the correspondence mentioned therein, and the request that the possession of Dowlel Genas, with jurisdiction over its inhabitants, may be left to us as has been the case until now, under the assurance that the strictest orders will be sent to the Dutch employees at Patna not to interfere with persons who do not belong to that village, and to render swift and proper justice in case of complaints about one of the residents; which latter is furthermore understood to be strictly recommended accordingly to the Patna employees. Some English deserters who are on Rotterdams Welvaaren are reclaimed by the Governor-General from the Director. Reasons why His Honour consented thereto. Hereafter the Director communicated that on the first of this month, in the morning after the papers of the vessel Rotterdams Welvaaren, then dispatched to Batavia, had already been sent off the night before, an English officer had brought to His Honour a letter from His Excellency the English Governor-General Lord Cornwallis, in which His Lordship gave notice that he had undoubted information that a considerable number of deserters of the English troops were on the named ship, with the request that the bearer of the letter might be granted the freedom to search that vessel and to remove from it all such deserters as were British subjects, under the promise that those of other nations would be left behind; that he, the Director, aware that there were actually some English deserters on the said ship and that they were about to cross over to Batavia, having considered how a complete refusal to His Lordship's request, at least so far as it concerned the handing back of those persons, could have disadvantageous consequences

17 April consequences might be, since they had the power in hand to compel us to it, even if it were only by detaining that ship and preventing it from proceeding on its voyage, and thus obliging us to do that which, being done of our own free will, would have an appearance of politeness and compliance, for which, when occasion arose, a return of service could be expected; for these reasons he had judged it best to proceed willingly to the surrender of those men; that, consequently, in reply to his Lordship's letter, he had politely declined the permission requested for the officer to search the ship as being contrary to custom, the more so as the vessel had already been dispatched, and had made it known that the only thing he could do in this matter was to send his Lordship an order to the Captain and officers of that vessel to muster the ship's company and immediately 17 April and at the same time proposed the conclusion of a cartel which was accepted by the Calcutta Government. immediately dismiss or hand over every one of the runaways who was found to be of the English nation, without any pretext whatsoever; at the same time, at the conclusion of this reply, as the best means to avoid all disputes in this regard for the future, proposing the conclusion of a Cartel between both nations for the mutual surrender of deserters. 49 17 April Remarks thereupon. should be made of the English toward entering into that cartel, as being in accordance with the intention and orders of the Honorable High Indian Government conveyed in the honored separate letter of 28 July of the previous year, namely, to proceed, when an opportunity presents itself, to the concluding thereof on the footing of the year 1781; proposing, accordingly, to suggest to Their Honors in that regard the renewal of the convention just as it was concluded in the last-mentioned year with the government at Calcutta, since this will be fully sufficient and of the same force and value as if a new cartel were entered into. All of which having been heard, and upon deliberation on what was proposed by His Honorable Worship, it was remarked that a small difference was found between the aforementioned copy of the convention sent with the Danes and that concluded by us, consisting in the 17 April mutually promised exemption from punishment for the persons who are handed over, and the exclusion of such deserters as might be native-born subjects of the party to whom they desert; and it being judged that both these points, appearing necessary and useful, ought also to have a place in the renewal of this agreement, which for the rest did not need to undergo any alteration: it was therefore, in conformity with the proposal of the Lord Director, resolved and agreed to propose to the said gentlemen the renewal of the cartel previously concluded, with the addition of the aforementioned two articles, and to that end to prepare and transmit to Their Honors a draft of the deed just as it is understood that it ought to be arranged, with the request, if it should meet with their approval, to be pleased to communicate this hither in order subsequently to be brought about directly. Geelvinck 17 April Proposal of the Council of Justice regarding the necessity that certain taverns at Fulta be removed from there. On this occasion, His Honorable Worship considered that, at the same time, letters could be written and the necessary representations made to the English gentlemen concerning the punch-houses and taverns that have been established since the late war at Fulta and in its neighborhood, whereby, since the usual anchorage of the ships is there, cause is frequently given both for desertion and the commission of many disorders between the crews of both nations; regarding which latter, a case occurred recently in December in which it was said that one of the tavern keepers lost his life; a proposal to this effect having been made by the Honorable Council of Justice of this factory in a minute of the 21st of the previous month, reading as follows: Wednesday the 21st of March 1787. In the morning: all present. Upon resumption of the report submitted this day by the merchant and fiscal of this directorate, the Honorable Adrianus Gerardus Kraijenhoff, regarding the investigation conducted by him into the perpetrators of the murder and theft said to have been committed on the night between the 3rd and 4th of December last on the person and dwelling of a certain Englishman keeping an inn at Fulta, named John Reed; and it having been observed that the cause of the brutalities committed on that night must principally be attributed to the taverns established for some time at Fulta, which give occasion to the seamen of both the English and our nation to indulge excessively in drink together, and thus unreservedly give themselves over to all kinds of irregularities, from which the gravest accidents are to be feared, which sometimes might even give rise to national dissensions, which ought, as much as possible, to be prevented and countered; that no better means seems conceivable for this purpose than the eradication of the primary cause of the evil, which must be sought in the toleration of the aforesaid taverns; 17 April which, according to the reports received, seem to have settled there on their own authority during the late war, although they make bold to fly English flags from their respective dwellings, and perhaps also, when occasion arises, would not fail to claim a right of jurisdiction by granting protection or otherwise to our sailors or subordinates: wherefore it appears to this Council to be of the utmost importance that all this be presented to the Honorable Worshipful Lord Director and Council of Policy, suggesting for Their Worships' consideration whether it would not be expedient to make representations in that regard to the High Government at Calcutta, with the request that those taverns, whether privileged by the English government or not, may be removed from there, in order to prevent all bad consequences to be feared from serving liquor to the common people of both nations, pointing out that, in the contrary case, the same cannot otherwise be placed to the account of the Dutch nation; after deliberation on all of which, it was agreed to let all this take its course accordingly, and for the rest to keep this record thereof. In accordance with what was resolved by separate resolution of the 17th of this month, a letter having been written to the English Governor-General and the Gentlemen of the Supreme Council of Fort William in Calcutta concerning various matters treated therein, in the following words: Calcutta To His Excellency The Most Noble Honorable Lord Charles, Earl of Cornwallis Governor-General along with The Right Honorable Gentlemen Members of the Supreme Council of Fort William. Most Noble Honorable Lord and Right Honorable Gentlemen! We have the honor at present to reply to Your Excellency and Honors' letter of the 28th of February last, containing complaints regarding the impediments which the Sjoppra Dewanny Adawlut encounters in its administration of justice against the inhabitants of Dowlet Gends. Upon the elucidation requested regarding this from our servants at Patna, they inform us that they have never interfered with the affairs of that court of justice, nor ever given any encouragement to persons belonging under it to take their refuge in Dowlet Gends, but that they have attempted to prevent the introduction of novelties and infringement upon ancient customs, so as to prevent the inhabitants of that village from being violently taken from their houses and brought before the said tribunal; that since the Dutch Company has been in possession of that village up until the late war, the disputes with and among the inhabitants of the same have always been left to the decision of our servants, without any of the rulers ever having presumed any territorial or legal jurisdiction over the place or its inhabitants; and that after the peace, that village, along with the further properties of the Dutch Company, was restored and taken into possession by us without any prior conditions or new obligations; that the cause of the present complaints originates from English Sepoys molesting the inhabitants in the village itself and attempting to compel them to appear before the Dewanny Adawlut, about which those inhabitants, as it had never been customary, submitted their grievances in two arzees to our Chief Van Citters, who entered into such correspondence with Mr. Montgomerie on that account, as appears by the copy thereof which we have the honor to enclose herewith. The village of Doulet Gends itself, according to the testimony of the inhabitants, has already belonged to our lodge at Sjoppra for more than a hundred years, and was ceded to our Company by the owner of the land thereof, named Jurawer Chan, provided that the customary annual khazana or ground rent was paid to the lord of the land for it, as has also always been done since. The proper conveyance to the Dutch Company also truly existed, and was handed over to the English Commissioner along with all other papers upon the capture of the lodge at Patna; but upon the restitution of our possessions there, no papers having been received back, as all the same have perished and been destroyed in that intervening time, we cannot supply the same at present. However, as proof that this village was regarded as property of the Dutch Company and not as rented by the Chief, it may serve that the same, along with the other properties of our Company, was taken into possession by the English gentlemen at Patna at the outbreak of the late war, and was also restored again at the peace. We hope that these particulars will convince Your Excellency and Honors of the groundlessness of the complaints submitted on behalf of the Dewanny Adawlut at Sjoppra, and we request that the possession of the village of Dowlet Gends, with jurisdiction over its inhabitants, may be left to us, just as has taken place until now, under the assurance that we will give our servants at Patna the strictest orders not to meddle with persons who do not belong to that village, and to administer summary and proper justice in case of complaints concerning any of the same. The only change that we judge could and ought to take place therein is the immunity from punishment of the persons who are handed over, and the exclusion of such deserters as are found to be natural-born subjects of the party to which they cross over; and it is for this reason that we propose to Your Excellency and Honorable sirs to make that alteration and amplification in the said Contract, which for the rest may remain in force in every part. In hope of Your Excellency and Honorable sirs' consent herein, we have drawn up a draft act of renewal of that Cartel with the addition of those two Articles, of which we have the honor to subjoin a copy herewith, politely requesting, if the same should meet with Your Excellency and Honorable sirs' approbation, to inform us thereof in order that it may be brought about directly. On this occasion we also take the liberty of bringing to the knowledge of Your Excellency and Honorable sirs that since the recent war, some English punch houses have been established at Foltha and in its neighborhood, which, as it is the customary anchorage of our ships, often give rise both to desertion and to the committing of many irregularities between the crews of both nations; concerning which latter, a case occurred recently in December in which it was said that one of those tavern keepers lost his life, but of which the suspected perpetrator has not yet been apprehended. Whereas such houses were never there before and these tavern keepers have probably established themselves there without the prior knowledge of Your Excellency and Honorable sirs, notwithstanding their presuming to fly the English flag, we very politely request that Your Excellency and Honorable sirs may be pleased to give the necessary orders to dislodge those persons from there, and thereby prevent as much as possible the outrages to which the gatherings of sailors of both nations in those houses give all too much occasion and cause. In reply to the dispatch sent on the 19th of the previous month, April, to His Excellency the Most Noble and Right Honorable Lord Charles, Earl Cornwallis, Governor-General, and the Gentlemen of the Supreme Council of Fort William in Calcutta, the following letter dated the 25th thereof has been received: To the Honorable Isaac Titsingh Esquire, Director and the Council, Chinsura. Honorable Sir and Sirs, We have been honored with your letter of the 19th instant. The desire you have expressed in regard to Dowlet Gunge shall receive our early consideration. With respect to the Articles of Convention you propose for the mutual surrender of deserters, we have the pleasure to inform you of our concurrence in them, and that the agreement shall be sent to you for your execution of it, as soon as it has received ours. We have directed an enquiry to be made what unlicensed punch-houses there are within the Company's jurisdiction in the neighborhood of Fulta, and shall consider the propriety of removing them. 69 29 May With a copy of the proceedings against Ensign Morris et al. investigation of the complaints preferred against them by Mr. Verspyck, but the evidence adduced against Ensign Morris being trivial and his defence very strong, and no evidence whatever having been produced against Lieutenant Aird, we are confident that you will agree in opinion with us that the acquittal of both those gentlemen was just and proper. Finally received, being the elucidation requested from time to time and most recently under 2 March last concerning the outcome of the proceedings instituted against Ensign Morris et al. over the assault and mistreatment of the merchant Verspyck on the public highway, consisting of a copy of the trial conducted before the court martial at Berhampore in the year 1785 over this case, according to which the accused persons were acquitted, and regarding which their Honours say they trust that, because the evidence brought against those accused was of little consequence and the defence of the said Morris on the contrary very strong, people will agree with them that this acquittal was just and proper; so it is, considering that this matter was already concluded as final before that court martial such a long time ago, and the injured party, the merchant Verspyck, likewise departed from here long since, and thus can provide no elucidation or answer to what appears in his regard in the defence of Ensign Morris mentioned therein, and all the more since those gentlemen in their letter wish this to be regarded as full proof that on the part of the government nothing was neglected to have the complaints preferred fully investigated, all of which therefore does not allow one to expect that making remarks in this regard or insisting upon further satisfaction will be of any use. Upon the proposal of the Director, it is approved and resolved to let this matter rest herewith and to leave the aforementioned letter unanswered; and in due time to offer a copy of the received proceedings, properly translated, to the Honourable High Indian Government at Batavia, for their discretionary examination. 29 May Copies of the proof of ownership of Dowlet Gendj found at Patna to be demanded from the administrators. The Patna administrators having notified in their separate letter of the 3rd of this month, the portion of which relating to the receipt of saltpetre was dealt with by the joint resolution of today, that the papers of ownership of the village of Dowlet Gendj were found among a lot of old junk and are now in their keeping, it is resolved to order them to send authentic copies thereof hither, as they might occasionally come in useful in the further correspondence with the English gentlemen concerning the aforementioned village. After concluding the business described in the joint resolution of today, the discourse having again, as already repeatedly occurred, fallen upon the immense financial distress in which one finds oneself and which has now become so urgent and reached such an extremity that it is a total impossibility to keep matters going any longer unless one expedient or another can be devised to obtain at least as much cash as is required for meeting the daily expenses needed in the household, since all administrators and others who have daily expenses on behalf of the Company have advanced all they had for that purpose and are now no longer able, nor capable of finding credit for it, make the most urgent and persistent requests to the Director to be allowed to obtain at least something in repayment, such as among others the Master of the Equippage, who is already out of pocket by circa 20000 rupees, and to furnish the same has from time to time liquidated everything he could possibly spare, but now declares himself unable to contribute anything further and thus sees no chance of finding what is necessary for outfitting the sloops, which ought already to have been dispatched, both to survey the fairway and to cruise for the expected ships, besides which he has also made no payments for three months

From the Director can be made of the monthly allowances and board, as well as the house rent of the European as well as native servants, which causes a general despondency and distress among them, which is so great that many do not know how to provide themselves with the necessities of life, and through all of which these debts, or the warrants issued on the treasury and remaining unpaid, among which some are even from the month of October of the previous year, have accumulated to around 70000 rupees, a sum the lack of which is most oppressive and keenly felt by all the servants collectively, in particular for the administrators, who, in order to make good the necessary expenses, have had to take recourse to money loans, of which the heavy interest runs at their expense; to provide wherein, the Director declared to have employed all means and efforts, though fruitlessly, since he has not been able to obtain any money either from natives or from foreigners, however advantageous the conditions he offered to obtain the same were; 29 June His Honorable proposes to request assistance from the Calcutta government by means of a loan of one lakh rupees, for which he has already drafted the following letter. and that at present he knew no other way out than to address the English government at Calcutta and request their assistance in this matter, being the only thing that he believed could still be undertaken with hope of a good outcome to rescue us from the present embarrassment, which it is to be feared will have the most detrimental consequences for the service if this last remedy should unexpectedly also fail; His Honorable therefore proposing to make the necessary request to those Gentlemen for one lakh rupees, which according to an estimate made will be required to cover the most essential expenses until the end of August next, before which time it is not to be expected that one will be able to obtain any relief from abroad or properly from Europe; and to that end to dispatch a letter already drafted in advance, which he at the same time produced for 29 June reading, and which runs as follows: To His Excellency The Most Noble and Right Honorable Lord Charles Earl of Cornwallis Governor-General and The Gentlemen Members of the Supreme Council of Fort William Most Noble and Right Honorable Lord and Honorable Gentlemen! The great embarrassment in which we find ourselves regarding the general lack of money and the impossibility of remedying the same in any manner whatsoever, obliges us in this distress to take our recourse to Your Excellency and Honors, humbly requesting to come to our aid in this and to favor us with your assistance, not knowing how we shall otherwise keep things going until the arrival of our ships and even cover such small expenses as the payment of monthly allowances and board to some of the Company's servants, who have absolutely no other means of subsistence. For all this, or the covering of 47 47 29 June the Company's expenses in general, we find after an estimate made thereof that we require at least one lakh rupees; we make bold politely to request Your Excellency and Honors to grant our Company and us the special favor of furnishing such an amount upon a valid bond, whereby we shall bind ourselves, upon receipt of silver or money, to discharge the same immediately with the interest of 9 percent per year, either in whole or so far as the supply shall permit; and otherwise, or if we should not be in a state to do so by the end of October next, in exchange for the bond, for its wholly or partially unpaid amount, to issue a bill of exchange upon the Honorable Directors of our Company at the Chamber of Amsterdam, to be paid immediately after the conclusion of the autumn sale of 1788, with preference above all others, to whomsoever Your Excellency and Honors shall be pleased to specify to us. 29 June The present members carefully deliberated on that proposal, and the advice of two absent members being requested, the assembled members, having full knowledge of the inconvenience in which everyone finds themselves, together with the Director, fully comprehend the absolute necessity of having to take recourse in this matter even to extraordinary measures; all the more so since with the arrival of the ships the embarrassment will increase considerably due to the greater expenditures one will then have to make, and no other way out remains. It is therefore resolved and agreed to conform to the proposal made by the Director and to dispatch the aforesaid missive accordingly, in the firm trust that our High Authorities will kindly deign to honor this extraordinary step, which has only been taken under the pressure of extreme necessity, with their honored approval. And whereas it was deemed necessary also to know the sentiments of the absent members van Haugwitz and Krayenhoff on this matter, and at the same time to inform them of this resolution, the First Clerk was sent to their honors while the meeting was in session, with the proposal of the Director and the aforementioned draft letter for that purpose, who returned shortly thereafter with the following written advice. How much soever van Haugwitz is convinced of the pressing emergency in which we find ourselves and the necessity in which we are placed to devise means for the improvement of our much-decayed monetary finances, he states that he is nevertheless of the opinion that the address to the English gentlemen will bring about little improvement there, because it is feared that the Government of Calcutta will not grant our request by reason of the well-known Act of Parliament prohibiting the lending of money to all foreign nations without distinction, and that which has been made public in that regard in the English newspapers. We have been informed by our servants at Patna that Mr. Pote, the head of the Honorable English East India Company there, has delivered to them an extract from the regulations established by the President and Members of the Board of Trade regarding the collection of saltpeter, containing that foreign nations, to whom a certain quantity of that salt is annually delivered, shall not be permitted to operate any refineries for themselves, and that on account thereof, the said Mr. Pote is not only actively attempting to prevent the inhabitants of our village of Daulatganj, who have always gained their livelihood by this refining, from delivering their prepared saltpeter to whomsoever they see fit, but also requires that they shall cease these refinings in the future. We take the liberty of addressing Your Excellency and Honors on this matter, respectfully representing how hard it is for the inhabitants of that place, who gain their livelihood by these refineries, to be forced to relinquish them and thus be deprived of a means by which they have found their subsistence and livelihood since time immemorial; requesting that Your Excellency and Honors be pleased to take this into consideration and leave the inhabitants of that village the liberty they have always had to continue refining saltpeter and to dispose of their production to their best advantage. Director and Council at Chinsura Gentlemen We have been favored with your letter of the 16th Instant on the Subject of the manufacture of saltpetre in the village of Dowlet Gunge. You are well informed, Gentlemen, that the manufacture of Saltpetre from the year 1758 to the present time has been carried on by the English Government by exclusive privilege, in virtue of a grant conferred upon them in that year by the Nabob of Bengal, and a proportion of this article has since been allowed to you; we presume that your claim to manufacture saltpetre in Dowlet gunge is entirely contrary to the exclusive privilege of the English and incompatible with it, as well as with the allowance of saltpetre annually made to you; such a claim would indeed afford an opportunity for abuses subversive of the Monopoly, not so much with respect to the quantity which may be manufactured in Dowlet gunge, but because any quantity however made, might be passed or disposed of under the denomination of saltpetre manufactured in this gunge. These arguments are suggested upon a supposition that the village in question is the property of the Dutch; before however we can admit this Point, we must request you will communicate to us the Deeds and authorities on which your Claim to the Property of that village is founded. Supposing however for a moment that we were induced to wave our rights to the sole manufacture of Saltpetre, on the principles we have already stated; our claim to that in question is supported on other Principles equally Just, as it is in fact produced with the Company's money and manufactured by their servants residing accidentally within the Village of Dowlet gunge; who purchase it in its Kutcha and Dooka State and carry it thither merely for the convenience of manufacturing it in the neighbourhood of their own habitations. For these reasons we must request that you will instruct your Commercial agents at Patna not to interfere in future in the manufacture of Saltpetre.
