7 August the fifteen thousand Maunds of saltpetre which they applied for in completion of the stipulated quantity for the year 1786, on the principle that you are indebted to the Company on a former account the sum of S.r R.s 102117: 10: 3, we have authorized them to deliver this quantity to your agents, taking their promissory note for the price of it, which will be received together with the former balance. The letter of 20 July 1787, according to the contents of which Their Honours seem to assume that this refining takes place on behalf of the Dutch Company, on which grounds its incompatibility is asserted with the exclusive privilege of collection granted to the English Government and the annual allocation made to us from it; besides which Their Honours even state that their claim to the saltpetre in question is founded on principles no less equitable, since it was produced by the money of their Company through their servants who happen to reside within the village of Doulatganj, and who bring that salt, bought up in its raw state, thither purely for the convenience of refining it in the vicinity of their dwellings. Thus, having considered this matter, and seeing that the Company derives no advantage whatsoever from these refineries, nor is our annually allocated share from the harvest in any way increased or enlarged thereby, but that the request made on that account was solely intended to maintain the inhabitants of that place in their right to a benefit deemed to belong to them from their own land; it is resolved to reply accordingly to those Gentlemen, and also that, in order to prevent all difficulties and cavillations, our servants at Patna shall be ordered to desist from these refineries; and consequently to write to the said servants at Patna at the earliest opportunity regarding this last point, and for the rest to leave unanswered the reports given in their separate letters of 30 June and 5 July concerning their negotiations with the English Chief of Commerce on this matter, as it is hereby brought to an end. The aforementioned Patna servants having transmitted, alongside a further separate letter of 19 July, copies of the discovered proofs of ownership of Doulatganj, authenticated with the seal of the Mufti or ecclesiastical judge, of which the translations read as follows: Copy Parwana granted as an established sanad or proof by Baaz Khan and under his seal, Naib of Sadik Khan Bangash, Jagirdar and Landholder. Be it known to all present and future officials in the Pargana of Manjhi, under the district of Saran, situated in the Subah of Bihar, pertaining to the estate of the great and excellent Sadik Khan Bangash: Whereas the place Zorawarpur, belonging under the said Pargana, has from ancestral times belonged under and to the Dutch Company, which has its workshop and lodge there, and in which the servants of the lodge reside, and which is not found suitable for cultivation or sowing, and the annual revenues of which have amounted to fifty Sicca rupees and four annas; So it is that you are ordered to collect the aforesaid amount annually from the virtuous Captain Jacob, Naib of the Dutch Company, reckoning from the harvest of 1122, so that their dependents and subordinates may reside there in peace, without demanding or claiming a single penny above the same, which serves for your information. And he, Zorawer Chan, declared, both for himself and as the aforementioned attorney, to have sold and ceded in full ownership to Kaal Kotapel, aforementioned, the piece of land belonging in ownership to him and as attorney, called Zorawerpoer alias Doulet kgends, with everything situated and belonging thereon and thereto, dependent on the Pergennah Makjie under the jurisdiction of Saren, situated in the Subah of Behaar; bordering to the west on the place Fettekpoer, subordinate to the aforesaid Pergennah, and likewise belonging to the said Zorawer Chan and Gemierie; to the east on the place Reinpoer, belonging under the said Pergennah and also belonging to both the said sellers; to the south on the side of the Ganges; and to the north on the garden situated in Fettehpoer, belonging under the said Pergennah, and being possessed in ownership by Naankommel, the son of Jsterdaas, the son of [illegible]; and this for a sum of seven hundred current 7 August current rupees Allahie of the weight of ten Malsa, of which he, the seller, testified to have been satisfied, and consequently to renounce, for the benefit of the said buyer Kaal Kolapel, all right and property that pertained to him both for himself and as attorney on the said piece of land; under the condition, however, that the said Kaal Kotapel shall be deprived of the purchase, and Zorawerchan shall re-enter into the ownership, if he, within four consecutive lunar years, calculated from the 15th of the month of Remzaan 1099 of the Hijerie to the 14th of Remzaam 1103 of the Hyerie, shall restitute the purchase money of 700 rupees, on account of himself and the aforementioned Gemarie, to the said Kaal Kotapel; however, if during the aforesaid stipulated time, the aforesaid moneys of this conditional sale should not be restituted to the buyer, then after that time the sale and cession shall proceed and be held as valid. 7 August 21 which has been delivered to Your Honour, dated 2 December 1785, serving in answer to ours of the 7th of November prior, concerning the disputes with the English Government regarding the Toll to the Country's government, placed us under a particular obligation, being so convincing of Your Honour's goodwill and inclination to employ all possible efforts toward achieving this objective, that we still, particularly with regard to what we take the liberty herewith to submit to Your Honour, request to make use of that same kindness. Since the aforementioned time, we have endeavoured, both through Commissioners at Calcutta and through our correspondence, to persuade the English Government to make an alteration concerning the aforesaid Toll and to restore our ancient trading privileges, which we formerly enjoyed just like the other Nations; however, our continued efforts in that regard have all been fruitless, and we have now finally been notified by the English government that no alteration regarding the Tolls can take place before and until matters in Europe between the English and French Court are settled, on account of a certain Convention which the former entered into with the representatives of the latter in the 7 August the previous Year, which we now understand has been disapproved in England. This places us in very unpleasant embarrassments, for in the first place, not only has the trade of our Inhabitants already suffered considerable hindrances and damage through the procuring of rowannahs at Hooghly and Calcutta, but one must also at the same time fear that the same will have to cease altogether under such compulsion; and secondly, we do not dare in any way on our own authority to accept such regulations of the English Government that are not fully consistent with our privileges, lest this might later serve them as a pretext to refuse us compensation for damages suffered at the proper place and time, and thus bring upon ourselves an accountability that could in no way be made good. We therefore take the liberty of sending Your Honour a Copy of the regulation made by the English Government in October 1785, which they have delivered to us with the desire that we should conform thereto until further orders from our High superiors, and we most kindly request Your Honour 7 August how to answer. 109 most kindly to please inform us whether these aforementioned Toll regulations are the same as those which Your Honour has accepted under such conditions and which at present serve for the trade of Your Honour's inhabitants at Chinsurah. 24th August ours of the 16th preceding We did not intend, by our representation regarding the obstructions in the refining of saltpetre in Doulat Ganj, to somewhat increase or enlarge, through the removal thereof, the annual share that the Honourable English Company allocates to us from the harvest, but solely and exclusively to preserve for the inhabitants of that place, whom we have always considered and still consider to be under our protection according to the enclosed proof, the only one that could be found in the decayed papers and documents received back from the English Commissioner at Patna, their right to a benefit which we judged pertained to them from their own land; but since Your Excellency and the Honourable Gentlemen differ in opinion on this matter, and our Company itself derives not the least benefit from Doulat Ganj, we shall order our servants to desist from the saltpetre refinery in order to prevent all difficulties and cavils. Right Honourable and Well-Born Lord Director, together with the Right Honourable and Right Prudent Lords of the Dutch Council. By the Highly Honoured General College of National Economy and Commerce in Copenhagen, we were addressed under date of 22 April 1786 that the Royal Department of Foreign Affairs informed the said College that one Pieter Frantzen of Neukirck in Angelen passed away on 16 September 1776, and on 16 March of the said year bequeathed by testament to his sisters Anna Catharina in Hattlund 1000 rupees and to Anna Maria in Nieby 500 rupees, as well as to Minister Oest in Neukirch 1000 rupees and to the poor of the same place 500 rupees. But since his testamentary executor Pieter Hoff, residing in Chinsura, has remained in default all this time of rendering a proper account thereof, the said Department of Foreign Affairs has, through the Royal Envoy in The Hague, obtained from the Government there an order to the said executor to pay the aforementioned inheritance, with its interest, to us or to our order. On which grounds the aforementioned College has instructed us to collect the same and to receive it into the Royal 24th August Royal Treasury here, and has furthermore authorized us to grant a proper receipt on behalf of the legatees for the receipt thereof. We therefore take the liberty to send enclosed herewith to Your Honours a copy of the said letter from the aforementioned College, and request Your Honours' friendly assistance towards the payment of the aforementioned bequeathed sums with their interest since the year 1776 by the said Mr. Hoff, not doubting that Your Honours' order to him to that end will have the required effect. We do not know whether the sum of 1015 Sicca rupees, which Mr. Pieter Hoff paid a short time ago to the attorney of the Commercial Councillor, Mr. Junghans, on account of the sisters of the late aforementioned Pieter Frantzen, namely Dorothea Maria and Catharina Maria Frantzen, constitutes a part of the aforementioned inheritance. One should indeed believe that they must be different persons on account of the difference in names. After this, the Director informed the meeting that he had this morning received from Calcutta the most unpleasant news by a letter which his Honor produced for insertion herewith, and which, with its translation, reads as follows: Honorable Sir. I had the favor of your letter of the 23rd. By the Minerva we have received letters which will be very unfavorable to the credit of your Company's assignments. All those which are referred to the Chamber of Zeeland have been returned to Amsterdam under protest, and suits are commenced for their recovery from the Dutch India Company. This is said to be in consequence of jealousies betwixt the different parties in Holland, not from any want of funds in Zeeland, but whatever may be the cause, the effect is the same, and I apprehend nobody will pay money into your treasury this season without having it stipulated that the assignments shall be paid in Amsterdam, and a penalty engagement to the effect. This is not one of those ill-natured surmises that many people are so fond of propagating; we have it in letters from people who actually have commenced actions in Holland for the recovery of assignments returned under protest from the Chamber of Zeeland. 12 October We have the honor to address Your Honor on the subject of what the Company holds in Dowld Gends. From this we find that Zeranipoer or Dowlel gends was the property of the ancestors of Mhason chan, formerly Zemindar of Bierhampoer in the Purgunnak Manga, and that the same was leased by them to the Dutch upon receiving a peshkash or advance payment of 700 rupees. At that time, that village was a Jagir of Sadachan, to whom the rent was paid. The proof which Your Honor has been pleased to send us is an authentic copy of a deed of grant issued under the seal of Baghan, Naib or deputy of the Jagirdar Sadachan. From this it appears that the right is founded on the deed of grant of a person holding a Jagir, a tenure which in itself, according to the fundamental laws of the Empire, is only conditional and subject to resumption upon the death of the temporary possessor. We have accordingly found that the Jagir was in fact resumed, and that instead of 50 Rupees Sicca 4, the original rent levied from Dowlel Gends, it was considerably increased and brought up to 236 r:o 9: 3, which is now paid. The investigation we have conducted provides us with not the least reason to admit this immunity in Your Honor's favor. The tenure of this village is precisely the same as that of others in the district of sircar Sarum, and we can affirm on good grounds that never before last year was the jurisdiction of the civil and criminal courts of revenue obstructed in Dowlet Gends, and that the Dutch exercised no greater authority there than what usually takes place regarding the other Zemindars and land renters. Our efforts to trace your right to that village were not undertaken with the intention of discovering exceptions regarding the legality of your tenure to it, nor is it our intention to raise any objection, however slight, against Your Honor continuing to remain possessors of it at the established rent; we merely wished to learn upon what ground it was judged to be exempted from, or not subject to, the jurisdiction of the established courts of justice.

13 December: Government was at that time still deprived of our dispatches sent along with it, in which an urgent request had been made for the necessary cash for the opium, so that it was not to be doubted that one would be provided with it upon the arrival of the ship expected from there, and that, the time of its arrival being uncertain, it was requested that the same might in the meantime be delivered; that in the unlikely event that no cash should arrive, he undertook to grant bills of exchange on Batavia for the amount thereof, which he could assure would be paid immediately; and finally, that it was also requested that his Lordship would likewise be pleased to accept such bills of exchange for the lakh of rupees lent to us and the debt for the saltpetre, 13 December: since they had had no opportunity to inform the Supreme Government of our commitment in that regard, whereby it might happen that the bills of exchange to be granted on China for that purpose, for lack of the necessary funds, might not be paid in due time. As you have not informed us that you have authority from the Government at Batavia to draw bills on them for the amount now owing to the English Company on account of opium and saltpetre already delivered, our duty compels us to decline the acceptance of your offer, and to express our hope that it will be convenient to you to advance the sum in cash before a supply is set apart for your use of either of these articles on account of the present year. We cannot help at the same time assuring you that we should have had no hesitation in complying with your request had it depended on yourself to ensure the acceptance of the bills which might be granted to us on the Governor-General and Council at Batavia, and to make the necessary provision for their discharge when due. 30 December: resolutions dated 19 earlier, received by His Honour yesterday evening, also intimating how he, the Director, after returning from Calcutta, in his letter of the 14th to the Governor General, communicated the non-dispatch of cash with the ship recently arrived from the Netherlands, and at the same time his well-founded hope that upon the appearance of the second ship, which is expected from Batavia towards the middle of next month, he will obtain the necessary funds for paying off the 500 chests of opium assigned to us, with an earnest request that, in the event it should happen contrary to all expectation that the High Indian Government might have deemed its dispatch with that ship unnecessary, which surely could only arise from confidence that the funds for payment would indeed be found here, to accept bills of exchange drawn by this Council upon the Governor and Council at Batavia for the amount of the saltpetre, opium, and the lac rupees granted to us on loan in our urgent need in such an obliging manner. Since it appears to us from Your Lordship and Honours' esteemed missive that, because the Director has not reported being authorised by the Batavian Government to draw upon the same for the amount presently due to the English Company in payment of the opium and already delivered saltpetre, the duty of Your Lordship and Honours requires 30 December requires you to refuse acceptance of the aforesaid offer; may we be permitted to submit these two considerations to Your Honours in this regard: That we, upon our repeated requests to the Gentlemen Directors to provide us with the necessary funds to carry on trade, were in the certain confidence of obtaining them upon the appearance of the ship from the Netherlands, and thus there was no doubt regarding the settlement of our debt for the saltpetre, much less did we deem it necessary to request authorisation from the High Government at Batavia to draw bills of exchange upon them for that purpose. And that the High Government, due to the fatal disasters which prevented the sailing of our ship until 4 May—with which we communicated the quantity of 500 chests of opium allotted to us for this year and its delivery at Calcutta, requesting the dispatch of the necessary funds for payment—was uninformed due to the non-arrival of that ship at the time of the dispatch of the ship Sparen on 10 August (though it was however met on the 13th thereafter, three days' sail from Batavia, by the Britannia). Since we thus, through one thing and another, find ourselves in the unpleasant circumstance of being unable to meet the expressed hope 30 December: of Your Lordship and Honours to furnish those sums in cash before the quantity of each of those articles was set aside for us from this year's stock, with an assurance to the Director that Your Lordship and Honours would have made no objection to fulfilling his request had it depended on him to ensure the acceptance of the bills of exchange that might be granted upon the Governor General and Council at Batavia, and to make the necessary arrangements that they would be paid at maturity, we take the liberty, in our capacity as directors of the trade of the Dutch Company in these regions, and on that account authorised to engage in all such transactions as are to its advantage, reasonable, and compatible with our duty, most earnestly to request Your Lordship and Honours to allow us the delivery of the promised 500 chests of opium for this year, deferring payment until the arrival of the ship, expected towards the middle of next month. If we consider the good harmony constantly cultivated between our Nations and the reciprocal obligation to assist one another in unforeseen circumstances, and take note of such events that have occurred from time to time—among which we shall only mention the Letter sent by the said Governor General and Council to the High Council of Fort William in answer to Their Honors' esteemed Letter of 13 December 1783, and the immediate promise of One Thousand Lasts of rice, despite the precarious circumstances in which, for the reasons detailed therein, Batavia itself was situated—we congratulate ourselves on the pleasure of having met with such an obliging willingness on the part of your Lordship and Honors in the month of July, during our pressing need for specie. Far be it from us, Gentlemen, to intend any unpleasant reflections by this citation; it merely serves as evidence of the mutual inclination to oblige. The reasons that gave rise to the request in the aforementioned letter may, however unexpected, recur, and what an unfavorable influence might the refusal of our present request and a mistrust of the approval of our actions by the Governor General and Council not have upon Their Honors' deliberations. In our letter of the 19th of April of this year, 30 December: when we had the honor to make the proposal to Your Excellency and the Honorable Council to enter into the aforementioned agreement, we also took the liberty of presenting to Your Excellency and the Honorable Council our request for the removal of the tavern-keepers and punch-house keepers who have settled at Fulta and in this neighborhood since the late war, for the reason that the meetings of sailors of both nations in those establishments too often give rise to acts of violence, and possibly also to desertion. Apart Monday the 21st of January Anno 1788 In the morning; absent the Master of the Equipage Fredriks and Fiscal Krayenhoff, both having gone to the anchorage of the ships. Upon the requests and representations made to the Gentlemen of the English Government at Calcutta on the 30th of the recently passed month of December concerning the opium and the settlement thereof, as well as the saltpetre still in debit and the borrowed lac of rupees with bills of exchange on Batavia, an answer dated the 9th instant was received on the 13th following, according to which Their Honours state they are prepared to grant us the quantity of 500 chests of opium and to accept the offered bills of exchange to be paid at Batavia to the order of their supercargoes at Canton, mentioning, however, that although the desire to accommodate the Dutch Company as much as possible has induced Their Honours in the present case to depart from their already adopted resolution, they expect in future cash payment for the opium and saltpetre that shall be set apart for the Dutch Company, as appears more circumstantially from the said letter itself, which, with its translation, reads as follows: To the Honourable Isaac Titsingh Esquire, Director and Council at Chinsurah Honourable Sir and Gentlemen! We have the honour to acknowledge the receipt of your letters of the 28th and 30th ultimo. In consideration of the circumstances therein mentioned, we agree to allow you a supply of five hundred chests of opium on account of the present year, and we shall accept your bills for the price of it on the Governor General and Council at Batavia, payable at that place to the order of our supercargoes at Canton. Tuesday the 5th of February Anno 1788, in the morning; absent, the Junior Merchant Heijning. The matters described by joint resolution of today having been dealt with, the Merchant Jacob Eilbracht handed to the Director a written petition with the request that it might be acted upon, which, after his Honour had given leave to the assembly, was found to be of the following content: To the Right Worshipful Director Mr. Isaac Titsingh, together with the Members of the Council of Policy. Right Worshipful Sir and Esteemed Council! Whereas by the 12th article of the esteemed Secret Letter from the Honourable High Indian Government dated 2 October 1787 (from which an extract was handed to the undersigned at the session of the 26th past), an order was given to conduct a precise and strict inquiry into the circumstances reported to Their High Honours between the former Director Ross and Mr. Halsey, and to afford me every facility and freedom in that inquiry to discover the true and essential state of affairs, in order to supply further all possible clarification regarding it; so I take the liberty to submit for consideration whether that affair ought not to be brought before the General English Government at Calcutta; demonstrating to the same how the Honourable High Indian Government, taking an interest therein, would gladly wish to be informed of the actual nature of the proceedings against Henry Halsey Esqr. concerning and on account of the engagements that took place between him and the former Dutch Director Johannes Matthias Ross for the delivery of linens to our Company, initiated upon the difficulty shown by Mr. Halsey to account for the moneys or advances for delivery received in hand in Anno 1781, before the outbreak of the war, without an act of discharge against claims and demands by the Dutch Company; likewise, according to a copy to be sent over of the extract sent back here by Their High Honours from the Calcutta newspapers, whether the proceeds of the property placed in consignment, as well as sold on 9 July 1784 by the sheriff on account of a lawsuit of Johannes Matthias Ross Esqr. versus Henry Halsey Esqr., consisting of a house and grounds, as well as thirty English Company bonds to the amount of two lakh two thousand five hundred current rupees, have been accounted for to the Government, or rather to whom it was actually paid; and what may be the reason that, in the name of the said Mr. Ross, the action against Mr. Halsey was instituted, prosecuted, and executed nearly thirteen months after the announcement of the settlement and ratification of the preliminary articles toward the definitive peace with Great Britain of the same year 1784. I further take the liberty to request inspection of the commissarial report submitted in Anno 1785 with regard to the affair concerning the creditors of the shroff Bindabon, his nephew Sam Ady, and all those who are involved therein, since that has been kept so strictly secret from me that the late Secretary Guerin, upon my request for a reading at the secretariat, politely refused me that; thinking myself able, from that and what is known to me regarding this family, to prove and demonstrate to the full satisfaction of the Honourable High Indian Government that what was cited in that regard in my petition of 6 July 1786 did not originate from the least passion, nor is grounded on any malice. I have the Honor to remain with the most complete Respect, was written below, Honorable and esteemed Council, lower, Your Honorable’s Very humble and very obedient servant, signed, Jacob Eilbracht, in the margin, Hooghly the 5th of February 1788 request to bring the matter of Halsey before the English government Upon deliberation regarding the first point appearing therein, namely the proposal made to bring the affair between the former Director Ross and Mr. Halsey before the English Government at Calcutta, it was declared by His Honor that inspection of the Committee report with the remark, granted the same could not take place for the present for very weighty reasons, of which, on account of the great importance of the matter, he could not as yet make any disclosure to the Assembly, other than that which is to be submitted in the letter first to be dispatched to the Honorable High Indian Government, when at the same time he will transmit such authentic documents and evidence regarding the aforesaid affair of Mr. Ross and Mr. Halsey as fully demonstrate the course thereof and will give Their High Noble Mightinesses all the elucidation required by Them in this matter; on account of which declaration, the assembly being unable to take any resolution in this matter, it was resolved solely to make this note regarding it. inspection of the Committee report in the matter of the Adis, requested Thereupon, decision having been made upon the second point, namely the request made for inspection of the Committee report received in the year 1785 regarding the investigation conducted at that time into the matter of the Adis, it was resolved 5 February there 5 February authorization for the clerks refused to consent thereto and thus to grant that inspection to the merchant Eilbracht, whenever he shall desire such, although the assembly must declare that it judges such to be superfluous and unnecessary, since Their High Noble Mightinesses in the 5th article of the Secret letter of 2 October 1787, dealing with this point, require nothing further in this regard from him, Eilbracht, but have been pleased to order the Council to give further account thereof, which should then also have been left to Them; while the requested authorization for the clerks at the Secretariat was refused Upon deliberation on the third point, namely the requested authorization directed to the Clerks at the secretariat for the delivery of such papers, whether in Copy or Extract, as he, merchant Eilbracht, should find to be required for his defense, it being taken into consideration with the Director what the aforementioned Their High Noble Mightinesses were pleased to say in article 185 of the said Secret letter, namely: while we have already too long and needlessly been troubled and he is ordered to specify which papers are required troubled with a lot of papers breathing a fair amount of passion and prejudice, which for a large part consist of recapitulations and unproven assertions and presumptions, we therefore order the said Eilbracht not to meddle further with what happened in the year 1781, or to set himself up in the case of his mother as Accuser, especially as a party, which contains an explicit prohibition against making any further stir regarding the aforesaid matters, and on which account the Assembly considers itself obliged, as far as lies within It, to take care that this is not acted against, and therefore can even less lend the means thereto, as it is to be feared would happen if this so broad and extensive an authorization requested were granted; so it was, by ruling hereon, in conformity with His Honor's proposal made to that end, resolved to have the said Merchant Eilbracht specify in a Note for his defense which papers 5 February papers he desires to have, in order to be able to judge whether he requires the same for what is demanded of him or not, in which first case the necessary orders will be given for their delivery. below: Done Hooghly in Bengal, date as above. signed: I: Titsingh.
