21 12 February. Deliberation on a letter received from Calcutta and an Account Current, and a request for bills of exchange on Batavia for the amount due from us to the English Company, payable in Spanish dollars. As seen by today's joint Resolution, upon the proposal of the Director, deliberation was resumed regarding matters to be dealt with separately. To this end, the contents of a letter from the Gentlemen of the English Government at Calcutta, dated the 7th of this month and received here on the 9th thereafter, were reread. In it, those Gentlemen, while transmitting an Account Current between the two Companies, closed on the last day of January past, showing a balance in Their Honors' favor of Current rupees 370475:4:2, request to have the promised bills of exchange on Batavia for an amount of 360,000 Current rupees, payable in silver Spanish Dollars, as they state they are informed that there is no other Current Specie in that place that can be exported except at a heavy loss; while Their Honors further insist that they be informed of the most favorable Exchange rate at which those bills can be granted, and whether the word of the Dutch Government can be pledged for the exportation of the amount thereof, as appears more fully from the letter itself, which, together with the aforementioned account and its translations, is recorded here. We have the honor to transmit to you an Account Current between the English and Dutch East India Companies, the Balance of which in our favor appears to have amounted on the 31st January 1788 to Current rupees 370475:4:2. Although we are persuaded that you will not find this Account Current to differ materially from the credit which we presume must have been given upon the Books of your Factory to the English East India Company for the transactions which it comprehends, we do not wish you to grant Bills upon the Government of Batavia for the full and exact amount of the Balance of that account Current, but think that if for the present we accept Bills to the Amount of Current rupees 360000:— we shall leave more than an ample allowance for any adjustment which may hereafter be proposed to us on your parts. We request that the Bills may be drawn for silver Spanish Dollars, as we are informed that Bills drawn in any other mode suffer a considerable Loss by the Exchange, and that no other specie of Money Current at Batavia will bear exportation but at a very heavy discount. We must also request that you will inform us what may be the most favorable rate of Exchange at which you can grant those Bills, and whether the faith of the Dutch Government can well be pledged for the exportation of them to the amount of the Bills that may be drawn, of which we shall want four sets in Quadruplicate made payable to our own Order. Difficulty concerning the method of calculation. 12 February. After which rereading His Honorable declared his opinion that no difficulty could or should be made regarding the granting of the requested bills of exchange for the said sum, on the grounds that the assembly had committed itself thereto by letter of 30 December last, and the small difference in the amount of the rice credited in that account with what was charged for it from Batavia can always be settled in due time, while he also believed that with respect to the export of the money one might give assurance that no obstruction will be caused therein by Their High Mightinesses, so far as this transaction is concerned, since the Director is not aware that any other prohibition applies in this respect other than concerning the Chinese junks; but that it was of greater concern how to make the calculation of the aforesaid currency in this matter, since the ordinary method of calculating in the Company's books in Dutch money creates a notable difference with that of private individuals, which the English gentlemen follow with respect to the rice in that account, by setting the Spanish Dollar at two Sicca Rupees or 60 Stivers, the price for which that specie is current among the public in Batavia, and why Their Honors will not accept our calculation in Dutch money, as being notably to their disadvantage, because the 360000 Current Rupees, after deduction of the Batta of 16 per cent amounting to Sicca Rupees 310344.13.0 or 387931 guilders Dutch, would only amount to Spanish Dollars 143678 1/27 calculated at 2 guilders 14 stivers Dutch each, whereas the aforementioned sum of Sicca Rupees, according to their calculation of two pieces for one Spanish Dollar, would mount to 155172 and a half of those Dollars, thus a difference of over 11494 Dollars. 12 February.

Honorable Sirs, in full, which loss, arising from our method of calculation, Your Honors will certainly not wish to bear, that he, the Lord Director, having given thought to how best to arrange this matter in order to get out of this perplexity, believed that one could not do more safely than to take as an example and basis the aforementioned charging of the rice which was relinquished to the English Government in the year 1784 and in the invoice whereof, now recently received with the Castor from Batavia, ƒ30179:- Netherlands money was calculated at 15241 4/40 Rix-dollars, since according to that calculation the aforementioned ƒ387931 Netherlands amount to 195924:32:- Rix-dollars and these, making 48 stuivers according to the ordinary rate at Batavia and the new Spanish Dollars making 60 stuivers, the same would mount to 156739 17/15 of those Dollars, so that if according to the private calculation only 155172½ dollars needed to be paid, a difference to the good would be produced of fully 1567 Spanish Dollars, wherefore His Honor also judged that this calculation ought to be followed, all the more so since the English gentlemen are content with the exchange rate of two Sicca rupees for the Spanish Dollar, as he has been assured thereof by the bearer of Your Honors' letter, Mr. Joseph Price, who is to take over that bill of exchange from the Government, all of which having been heard thus and understood with His Honor, and it having also appeared that the proposed manner of calculation is the safest upon which one can proceed and also turns out the most advantageous for the Company, it has been, pursuant to the proposal made thereto by him, the Lord Director, approved and agreed to grant the requested bill of exchange, to give the assurance regarding the export of the money in the manner prescribed above, and to set the calculation of two Sicca rupees for one Spanish Dollar as the most advantageous for both parties and the least troublesome, and consequently to set 155172½ Spanish Dollars for the 360000 Current or 310344 13/16 Sicca rupees, and to have the said bill of exchange, after the request made, drawn up in quadruplicate to that sum alongside proper letters of advice yet today and dispatched, in the hope of having hereby also looked after the interest of the Company according to the intention, or if by a misunderstanding anything might have been wrongly ordered therein, that Their High Mightinesses will favorably please to excuse such, just as thereto, with the letter to be sent with Hinloopen, under communication of everything that pertains to this bill of exchange, respectful request will be made, and also that it may please Their High Mightinesses to prescribe how one will have to behave in the future if similar transactions should occur again. Under the aforementioned deliberation it being also understood how it might happen that upon the arrival of the bill of exchange at Batavia there might not be on hand as many new Spanish Dollars in specie as the same dictates, from which sometimes one or another unpleasantness might result, it has, in order to prevent that, further been approved and agreed upon the proposal of His Honor to state in the bill of exchange that, in such a case, payment of what is lacking therein may be made in other coarse silver coin according to current value, and to give notice thereof in the rescript to be dispatched to the English gentlemen, with the addition that the Lord Director, according to his communication made in that regard, has agreed with the aforementioned Mr. Price that the bill of exchange will not be presented for payment until after the arrival of Hinloopen at Batavia, in order that the Honorable High Indian Government may have prior knowledge of the negotiations regarding this, for which reason also no time of payment is to be expressed in the bill of exchange. With the ship that most recently arrived from that place, we received qualification from our High Superiors there to receive the funds that were offered on behalf of Captain Robert Geddes as compensation for the damages of the sloop the Constantia and Pantjalling the Gedeelt taken by him, provided that guarantee is retained on the remainder upon the return of said Geddes to these regions; the sum offered for this amounts, according to the copy of the account of said Geddes sent to us, dated 22 October 1784, to Current rupees 13673: 1:8. We therefore request that these monies, under the said reservation, be paid out and may serve in reduction of the aforementioned debt to the Honorable English Company. We were honored to receive Your Excellency's and Honorable sirs' letter of the 7th of this month, accompanied by the current account between 41 15 February the English and Dutch Companies, according to which the balance in favor of Your Excellency and Honorable sirs, as of the end of January last, amounts to Current Rupees 370475: 4: 2. In the same we have discovered a small difference in the price of the rice delivered at Batavia, as will have already appeared to Your Excellency and Honorable sirs from the account thereof sent with our letter of the 8th of this month; however, as this, as well as the item of Captain Geddes, about which we had the honor to confer with Your Excellency and Honorable sirs in that letter, can be settled in the future, we have decided to grant the requested bill of exchange for Current Rupees 360000., as the same is then offered in quadruplicate to Your Excellency and Honorable sirs alongside the letters of advice; we have, in accordance with Your Excellency's and Honorable sirs' request, arranged the same in Spanish Dollars, being one of the principal current coins at Batavia, and made the calculation at two Sicca rupees for one Spanish Dollar, as is the usual exchange rate thereof here; we do not doubt that Your Excellency and Honorable sirs will also be satisfied with this, as this calculation is the most advantageous and least troublesome for both parties. According to the same, the aforementioned 360000 Current rupees, after deduction of 16 percent batta, 15 February make Sicca rupees 310344: 13 1/25, amounting to 155172 1/8 Spanish Dollars, for which amount the bill of exchange has been drawn; however, as it might happen that so many Spanish Dollars in specie are not on hand upon the arrival of the bill of exchange at Batavia, we have requested that the payment of the deficiency thereof may take place in other large silver coin circulating there, and such according to the usual exchange rate, from which we believe that absolutely no loss is to be expected for the receiver of the money, the Ducatoons being employed by the Chinese for transport in preference over the new Spanish Dollars. Although a prohibition on the export of cash concerning the Chinese junks at Batavia is indeed in place, we dare assure, however, that no hindrance in this shall be brought about on behalf of the High Government, as far as these transactions are concerned. Mr. Joseph Price, who brought us Your Excellency's and Honorable sirs' letter, has agreed with our Director that the bill of exchange will not be presented for payment until after the arrival of the ship that we are to send to Batavia in the next few days, in order to give our superiors there prior notice of our negotiations hereon with Your Excellency and Honorable sirs. Concerning the further accounting demanded by Their High Honors in paragraph 15 regarding the proceedings against Bindabon Ady, which Their High Honors based on a report that differs greatly from what the merchant Eilbracht cites from a postscript of a letter from the senior merchant Brueijs dated 21 December 1782, as if the former Director Ross, in order to indemnify himself alongside the Cashier for what was deficient upon the handover of the Company's treasury, had divided the proceeds of Bindabon's counting-house and his remaining effects to the sum of 32000 rupees between himself and three banyans to the prejudice of all the other creditors: it was, upon the proposal of the Director, approved and agreed, in respectful answer to that requisition, to demonstrate that the investigation of the matter of the Adys, and thus also what relates to the aforementioned accusation, by the commission appointed for that purpose in the spring of 1785, was conducted, in the opinion of this assembly, with as much precision and impartiality as was possible, since 22 February all 22 February. all transactions and proceedings in the successive sessions took place in the presence of two of the principal creditors, namely Francois Lamij and Alexander du Bordieux, who were chosen for that purpose by the rest, and, in token of approval, signed all the minutes kept thereof, and thus also those of 4 and 9 March 1785, in the first of which were treated the extracted points to serve for the report to be submitted to this Council, which report was resumed and approved in the other, and concerning this matter verbatim contains: and it appeared to us most clearly, both from the declarations of the natives heard thereon and the testimonies of the Europeans recorded in the minutes of 12, 25, and 27 January, item 3 and 19 February, that Mr. Ross did not cause the least thing belonging to Bindabon Ady to be seized or sold on 3 July 1781 or thereafter, but rather that His Honor, 22 February. upon receiving further information of the shortfall in the treasury, after the bankruptcy became public, had the property that Sam Ady declared to be his own attached at his own request and offer, and had it publicly auctioned, according to the custom of the country, to the shroffs of the Great Bazaar, in order to satisfy therewith the deficit in the Company's treasury, etc., it being further stated at the end of that section: it having appeared to us, during the investigation, that Mr. Ross, due to the circumstances of the time, may have acted irregularly, but never in bad faith in this matter or with the intention of benefiting himself to the prejudice of the creditors; that furthermore, in the minutes, and first in those of 25 January, there appears a petition presented to the Commission by Sam Ady, the actual cash-banyan, wherein he, among the complaints brought forward by him against the Director concerning the injustice of having been implicated by His Honor in the bankruptcy of Bindabon Ady, cites that among the goods seized from him to satisfy his debit to the treasury, there were none that belonged to the said Bindabon Ady, just as the latter had also testified when his creditors complained about this seizure and alleged such; that in another petition submitted by the said Bindabon Ady to the Commission and dealt with in the minutes of 27 January 1785, this was also expressly stated in these words: when all the goods of Sam had been sold by Mr. Ross, His Honor had me summoned and questioned before two or three gentlemen whether there was anything among those goods belonging to me, which I answered by declaring that none of mine was among them, and 22 February. that

that his affairs did not concern me; that in the minute of 3 February 1785 there appears a declaration from the collective Native Creditors, upon the inquiry made to them on that account, that Mr. Ross had not enjoyed the least thing from their debtors for himself, with the express addition that his Honour had never laid hand upon any properties of Bindabon, but rather upon the goods of Sam, which was sold publicly, according to the custom of the land; and finally that in that of the 19th of the said month of February it becomes evident that the European Creditors who appeared then, upon the question put to them whether it was also known to them that the shop of Bindabon was demolished by Mr. Ross on 3 July 1781, the day before the taking of the Colony, and the cash, gold, and silverware taken out of it to settle the debit of Sam Ady to the Company's treasury, etc., declared unanimously never to have heard that Mr. Ross had caused the shop of the Adijs to be demolished, or had taken anything for himself; and the meeting hoping that Their High Excellencies, after consideration of all this, will be pleased to allow the Report brought out by that Committee and the testimony of so many persons who constituted the same, and who signed the papers from which that document is formed—among whom are the representatives of the creditors and fellow participants in the sustained loss themselves—to prevail over the mere statement of Mr. Brueys, and to accept this extensive representation for the required further accounting, since one must declare seeing no chance of placing that matter in an even clearer light. Concerning the order given under Section 10 by Their High Excellencies to conduct a precise and strict investigation into what the merchant Eilbracht alleges regarding the affairs and the circumstances thereof between Director Ross and Mr. Halsey, it having already been declared by the Director, according to the note in the secret Resolution of the 5th of this month, that this, for very weighty reasons, could not take place for the present, to which His Honour referred herewith, it was resolved to record it as such. Whereas the aforementioned Their High Excellencies ordered under Section 11 that a solemn oath be taken by the attorneys of Director Ross regarding the administration and accounting of his surviving affairs, and especially concerning the aforementioned affair of Mr. Halsey, under special declaration that the Company's interest was not compromised or neglected thereby, and the said persons having been summoned into the meeting to that end, and the aforementioned desire of the Honourable High Indian Government having been presented to them, they previously submitted the following writing below: We can take the oath required of us with the greatest ease of mind, and thus submit ourselves with the utmost readiness to the orders of our lawful superiors; we nevertheless request permission to assure Your Honour and Worships that it grieves us to the utmost that our repeated protestations have been able to find so little acceptance, that nothing but a solemn oath can free us from the suspicion as though we had in a deceitful manner sought to conceal the property of our late principal, Mr. Ross, in order to disadvantage the Company; we are men of honour, our character can bear scrutiny, and it can therefore only be very painful to us that we have been presented in such an unfavourable light to the Honourable High Indian Government; we are completely convinced that it will appear most clearly to Their High Excellencies that we have been made suspect in an unreasonable manner, and thus trust in Their High Justice that we will obtain satisfaction against those who have slandered us; this, Right Honourable Sirs, we request may be submitted to Their High Excellencies. 22 February Their High Noblenesses, offended by your punishable conduct and in order to protect everyone in what is theirs against such far-reaching contempt as you have shown toward your lawful authorities, by calling the conditions under which the Fort was surrendered to the English during the late war ridiculous and absurd, have ordered the Council to cause you to appear in their Assembly and to reproach you seriously for such improper and injurious expressions, with the recommendation that you carefully guard yourself against similar or other insults, under penalty of correction. Furthermore, as it appears how you have accused the former Director Ross in the most improper manner, both concerning the matter of the treasury and concerning other matters, and have presented palpable untruths to your Lords and Masters, the Council was ordered to reproach you seriously for such accusations in matters that you only have or can have from hearsay, and which, on account of their gravity, you ought to have investigated better before making them public. We expect that this particular moderation and forbearance of the High Government will bring you to repentance and that in the future you will never again make yourself guilty of such actions, that you, observing the duty of a subordinate servant, will no longer assault those who are placed over you with your slander and thus disturb the peace of the community, if you do not wish to expose yourself to more severe correction. Finally, the High Government, since you have again troubled them with your writing via the ship Rotterdams Welvaaren, orders you to refrain from all direct and indirect correspondence with them, under penalty of correction. After hearing which, he, Eilbracht, desiring to speak, was informed by the said Honorable that he had solely been summoned to have the aforementioned held before him. Of all of which it is understood to keep this note as well. Among the annexes of the aforementioned secret missive having been found an extract from the secret minutes of the resolution passed in the Council of the Indies on 14 August 1787, containing the renewal of the prohibition against the engaging in private trade by certain servants already established by resolution of 2 March 1784: it was thus resolved to remain bound to observe this, it having already been recorded among the standing orders in the general resolution of 26 November 1784. 4 March In the Account Current which accompanied ours of the 7th, the cost of the 500 Chests of Opium delivered this year to your Deputies in Calcutta was accurately stated. We cannot consider this Government as at all concerned in the adjustment of your Claim upon Captain Geddes on account of the two vessels captured by him in the year 1783, but as you have agreed to accept the amount admitted by him to be due on this account, we cannot suppose that you will find any difficulty in the recovery of it. Your application should be made to Captain Geddes's Attorney, who will probably be able to acquaint you from whom the amount is to be received. Mr. Philip Da Cruz, who is Captain Geddes's Attorney, acquainted this Government on the 11th of October 1785 that the Balance due on account of the Constantia and Geduld had been paid by him to Colonel Henry Watson, the Owner of the Ship Nonsuch by which they were captured. We have directed our Accountant General to give the Dutch Company Credit for Sicca rupees 24,143: 3: 2 for 945000 lb of Rice, which in 1784 was laden at Batavia on the Vansittart, Captain Agnew. This has consequently reduced the Balance owing by the Dutch to the English East India Company from Current rupees 370,475: 4: 2 to Current Rupees 367,353: 5: 3, agreeable to the accompanying Account Current prepared in conformity to your Letters of the 8th and 12th Instant. We rely implicitly upon the assurances you have given to us that your Bills on the Governor General and Council of Batavia will be discharged in Specie, and we are persuaded that the Municipal Laws of that Settlement relative to the Exportation of Specie from it will not be enforced to the detriment of the English East India Company in regard to a Transaction which has subjected our Company to some inconvenience for your accommodation. 14 March will no longer trouble Their High Excellencies with writings concerning the conduct maintained by the former Director Johannes Matthias Ross before and at the outbreak of the latest war of England with the Republic; but since the judgment of my opinion in previous writings contains implications, not to speak of the painfulness thereof, regarding which I cannot conceal my objection, I take the liberty humbly to request Your Worships respectfully to present on my behalf to Their High Excellencies, as follows: 1 That my stepping aside from the Committee concerning the Memoir of my brother, in March 1785, was protected by proper reservation clauses, which seem not to have been taken into consideration at the time and now free me from accountability for not having come forward against the administration of that time earlier than in 1786. 2 That I have brought no accusation against the members of this assembly regarding the surrender of our posts and assets to the English on 4 July 1781, but indeed in so far as those members, in the spring of 1785, burdened my brother, exonerated Mr. Ross, and in a word failed to inform Their High Excellencies of public circumstances and reports that no one can ignore: namely that the war which finally broke out 14 March had already been known very long beforehand as very probable and even very well-founded, yet was not accepted or believed by those gentlemen because Ross led them into that belief and maintained a familiar intercourse with the enemy, practically up to the moment of the surrender of the Company's possessions. 3 That, besides the proofs already submitted of this, there also currently accompanies this an insinuation answered under offer of oath on the 2nd past by the Commandant of the Militia von Amelungxen, showing that Ross only returned from Calcutta between 2 and 3 July, at one o'clock in the night; that on the same day, at half past ten in the evening, he was summoned in the name of His Britannic Majesty to surrender the Fort on account of the war declared against the State; and that an hour and a half thereafter, the Factory and our village were occupied by two battalions of English Company Sepoys, under the command of Major Chatfield; that this Major, knocking at the garden gate, which had been closed along with the other gates until daylight on account of the announcement of war made just before and the prevention of troubles, without any prior question as to whether he came as friend or enemy, but because he had himself announced in the name of the Governor-General Hastings, was let inside; which is even more remarkable when one considers the rejection of the King's Officer because he had no demand, while the said Major Chatfield brought with him such a demand for the surrender of the Fort by Governor-General Hastings as he, during that night visit, first read aloud to Mr. Ross and thereafter handed over, upon which demand dated in Fort William, 3 July 1781, the following morning the Factory, and subsequently the Company's assets, were surrendered without the slightest counter-representation, and without any discussion appearing regarding the word previously given to the King's officer, not even whether the latter pressed his summons further and yielded with good or bad grace. 4 That in the letter from Their High Excellencies mention is made of a sum of 32000 rupees which was allegedly distributed to the prejudice of the creditors of Bindabon Ady, whereas my submitted evidence mentions only 23000, which comes very close according to the information I gathered, which I cannot, however, provide without a further description of the injustice that this family suffered through the conduct of Mr. Ross. 14 March 5 That my opinion regarding the taking of sides will be better understood by Their High Excellencies by adding thereto, as I do, that in my humble opinion, when a dispute arises in an assembly concerning the proper or improper execution of orders or entrusted matters, he who comes with reasons of objection against others who have neglected their duty or violated orders is not, nor does he become, a party; but that the Principal, especially in matters like these directly concerning him, if possible decides it himself and otherwise, placing himself as a party, effects or allows a decision to be made. 6 That it was never my intention to enter into a separate correspondence with the Honorable High Indian Government; and that what Their High Excellencies are pleased to call a letter was considered by me as an address or recourse to the same regarding the sustained injustice on 10 August 1786, which appeared to me to require no other judgment than that of Their High Excellencies. 7 That the matters alleged therein with respect to the affair of Mr. Halsey are facts directly concerning no one other than the former Director Johannes Matthias Ross; The insinuate says, having been summoned to the meeting and asked by the Council whether he found himself in a position to defend the Fort, whereupon he answered to be unable to defend himself against the troops already present here, and much less if 10,000 men from Calcutta joined them, yet submitting himself to execute the orders of the Council in this matter. 27. At what time the garrison marched out, and in what manner, in parade order with beating drums, or in confusion. The insinuate says he does not know this. 29. What circumstances the Lord insinuate knows to give regarding this. Reply of the Director thereto The members of the ministry of 1785 submitting an accountability to the Right Honourable High Government Annotation of the merchant Eilbracht regarding his writing, submitted to the meeting on the 14th of this month. Hereupon it was replied by the Director that this annotation had been omitted for no other reasons than that His Honour on the aforementioned day had declared he considered the same incompetent, as this would again give occasion to new animosities; but since the merchant Eilbracht insisted so strongly that the same should be recorded, he, the Director, also desired a record of that declaration. All of which was subsequently understood to be noted down in this manner, and the aforementioned resolution of 22 February to be left unaltered. The members Bogaardt, van Haugwitz, Krayenhoff, and de Bas, having drafted their accountability to the Right Honourable High Government of the Indies pursuant to the aforementioned resolution of 22 February, which was submitted in the meeting today and subsequently reviewed, the merchant Eilbracht requested, after the reading thereof, that it might on his behalf be noted down 25 March that the prohibition of Their High Honours to meddle any further with what occurred in 1781 or to trouble Their High Honours with any writings on that account, compelled him to remain silent on the contents thereof, as he also, according to duty, is bound to do, although he otherwise still has objections against it, which however must cease and can find no reception in such terms as matters have now come to, and that he thus merely requested a copy thereof; upon deliberation thereon, it was approved and understood to allow the requested annotation to proceed as such, but to defer the request for a copy to the Right Honourable High Government of the Indies, since the meeting does not consider itself competent to issue copies of writings that are addressed to Their High Honours.
