also permit me to request that, in case there might be any other gentlemen who were present at the surrender of Chinsura, or can provide any information in this regard, they may likewise come to Calcutta. To His Excellency The High and Well-Born Gentleman Carel Earl of Cornwallis Governor General etc. Fort William My Lord, I was honored yesterday with your Lordship's respected letter of the 2nd of this month communicating that the judges of the High Court of Justice in Calcutta had received a commission from the High Court of Admiralty in England to hear witnesses in a lawsuit relating to the taking possession of Chinsura with its dependencies in the year 1781. That the testimony of some gentlemen in this colony being required thereto, your Lordship insisted that those gentlemen, mentioned by name, along with all such who were present at the capture of Chinsura or could give any information in that respect, might come over to Calcutta to be heard before that court of justice. However much it will always be an object of my highest endeavor to give satisfaction to your Lordship, in gratitude for all tokens of affection, both in the post which I have the honor to hold in the service of the Company and in my private capacity according to my ability, may it be permitted to me to remark on this subject, That since there is a Council in this colony charged in the name of the Sovereign with maintaining law and justice, I would have found myself highly honored if the High Court of Justice in Calcutta had pleased to provide such points concerning which it desired declarations and testimonies, in order that they might be properly proceeded with by this Council of Justice, which would be more compatible both with practice and with customs than their request that virtually an entire colony, competent to provide testimony, should proceed to Calcutta in order to subject themselves there to the jurisdiction of a foreign court of justice. That however much one might also incline to comply with the aforementioned request, the present circumstances make this impossible, due to the late arrival of the Dutch and Batavian ship, both of which are to be dispatched in this month, which provides so much business in the various services that it will be difficult to accomplish even the most necessary tasks, whereby none of the employees can be spared. Flattering myself for the aforementioned reasons to find an excuse for not complying with your Lordship's desire, 116. Chinsura the 4th of March 1790. I shall consider myself particularly fortunate to be honored with a distinct specification of such points concerning which the High Court of Justice in Calcutta might require testimonies and declarations from gentlemen of this colony who were present here at the taking possession of Chinsura, while I take the liberty to assure your Lordship that this matter will be handled by the Council of Justice with the utmost accuracy and circumspection in an affair of so much importance. I take the liberty to enclose herewith for the consideration of your Lordship a copy of a memorandum by the then Director, Ross, regarding the facts of this matter, and have the honor to be with the greatest respect, Your Lordship's Obedient and Humble Servant, [was signed] I. I am honored with your Honour's letter of the 4th of this month in reply to my request that your Honour might be pleased to allow certain gentlemen belonging to your colony to come to Calcutta to give testimony before the judges of the High Court of Justice regarding the circumstances that took place in the year 1781 at the capture of Chinsura. I am very sensible of the good disposition which your Honour has always shown to comply with the requests of this government and ask leave to assure your Honour that I would never have formed the least idea of abusing the friendship of your nation to such an extent as to desire that these witnesses should take the slightest step that could give the appearance of subjecting themselves to a foreign jurisdiction. Fort William 10th of March 1790 Here enclosed I send your Honour a copy of a letter from our Advocate General, from which your Honour will perceive that the judges do not act in this matter in their judicial capacity, but solely as commissioners authorized by the High Court of Admiralty in England to examine witnesses in a lawsuit pending before that Court concerning a disputed claim to prize money. Since the judges of the High Court of Justice are not able to delegate this power to another, the examination of the witnesses at Chinsura would be of no value, and as I am convinced of your Honour's disposition to help maintain justice, I take the liberty to request as a favor that your Honour will require three or four gentlemen who were present at the capture of Chinsura and are in a position to give testimony on the state of affairs on that occasion between the officers and men of the naval force, the military officers of the Company, and Mr. Ross, at that time in the administration of affairs over your colony, to proceed to Calcutta. N 6. To Earl Cornwallis Knight of the Garter Governor General in Council of Fort William My Lord Enclosed here I have the honor to return to your Lordship the letter that the Noble Lord Titsingh wrote to your Lordship on the 4th of this month, with its cover, which your Lordship was pleased to send to me for perusal. I perceive from that letter that Lord Titsingh is of the opinion that the gentlemen of Chinsurah, by going to Calcutta to give testimony, would submit themselves to a foreign court of justice, and that his Honor would therefore have liked the High Court of Justice to have had the points and articles drawn up concerning which they wished to obtain testimony, in order to enable the Council of Justice at Chinsurah to give proper effect thereto. Lord Titsingh likewise shows the inconvenience that must be caused if virtually the entire colony of Chinsurah were to come to Calcutta at a time when the service of each of the gentlemen in office cannot be spared in the various departments. The politeness and friendly disposition of Lord Titsingh towards the English East India Company and the esteem which he personally bears your Lordship are so well known that I cannot in the least doubt his readiness to meet your Lordship's wishes in the present case as soon as his Honor receives a proper explanation of the nature of the commission sent by the High Court of Admiralty of England to the High Court of Justice, and how far your Lordship's request extends; for he will then have reasons to be satisfied that the inconveniences which he fears will not be experienced, and that the High Court of Justice could not do what his letter shows he desired of them. The commission whereby the witnesses are requested to appear for examination was sent by the High Court of Admiralty in England to the members of the High Court of Justice at Calcutta to be executed by them without any power of substitution or delegation to others; so that the High Court of Justice had no power to transfer to the Council of Justice the authority to examine the witnesses residing at Chinsurah whose testimony was required by the aforesaid commission, and who must either be examined here by the judges of the High Court of Justice or cannot be examined at all; so that Lord Titsingh will find that if the gentlemen who are requested to appear are not permitted to come to Calcutta, the object of the commission will be entirely frustrated, and the Company will have to forgo the benefit of this testimony, for the obtaining of which this commission was sent. I also take the liberty to inform your Lordship that your Lordship can safely assure Lord Titsingh that the gentlemen of Chinsurah, by coming to Calcutta to give testimony by virtue of this commission, will in no manner whatsoever submit themselves to a foreign court of justice. It would be as much a mark of politeness on their part as it was on the part of the judges of the High Court of Justice in accepting the commission: since neither has the Court of Admiralty the power to order the judges of the High Court of Justice to accept and execute the commission, nor does the High Court of Justice derive any power therefrom by which and by virtue of which they could compel anyone to appear, not even British subjects residing at Calcutta. As regards the inconveniences that would certainly have to be experienced if virtually all or any large number of Chinsurah gentlemen were now requested to come down to Calcutta for examination, I have the pleasure to inform your Lordship that neither the nature of the matter nor the limitation of time is so pressing that the gentlemen of Chinsurah could be exposed to the feared inconvenience; for if three or four of them who were present at the capture of Chinsurah and are in a position to give testimony concerning all the circumstances that occurred on that occasion between the officers or marines of the naval force, the military officers of the Honorable Company, and Lord Ross, then Director of Chinsurah, are pleased to appear for examination, the testimony of a larger number of witnesses who could only speak to the same matter would be unnecessary. With Your Lordship's respected letter of the 10th of this month, accompanied by the unsealed one from the Advocate General, I presented the same again in Council this morning and have the pleasure to share that the clarifications in the latter have caused this matter to be viewed in an entirely different light, the objections of the members against providing testimony before the Supreme Court in Calcutta have thereby been completely removed, and Your Lordship's request will be complied with in all readiness. The remarks of the Advocate General, both regarding my inclination towards the English East India Company and regarding my respect for Your Lordship, are too obliging for me not to do my utmost to show in the most convincing manner my desire to respond to these favorable sentiments, and continuously to deserve the goodwill of Your Lordship, which has been so visibly demonstrated to me on several occasions. It is in these sentiments that I take the liberty to assure Your Lordship that however much I personally shall always make it a point of honor to contribute everything that may tend to your satisfaction, I found myself obliged, for the sake of the consequences, to proceed herein with the prior advice of the Council. Since after the dispatch of our letters for Batavia, scheduled for the 13th, the work will effectively be settled and Messrs. van Haugwits, Blume, van den Broek, van Amelangxen, de Vilinghoff, and Roselje are to proceed to Calcutta in the following week, I shall consider myself particularly obliged to be informed of the day deemed most suitable for that hearing, and of the place appointed for it, in order that thereby no delay may be caused to either side. The Advocate General has informed me that the appearance of the Dutch gentlemen will be necessary next Friday morning, and I hope therefore that it will be convenient for them to be here early on that day or on Thursday evening. I have given the necessary orders for their accommodation, and it will give me pleasure to show them every attention during their stay. I have now the pleasure to share that Messrs. van Haugwits, Blume, van den Broek, Amelangxen, and Roselje have accepted with pleasure to be present there at the appointed time. A relapse of Mr. de Vilinghoff, whom I judge could be most useful in this matter, makes his departure impossible. I therefore hope that the testimony of the aforementioned gentlemen may fulfill the intended purpose. The Court of Admiralty had not, as I apprehend, any jurisdiction in this case to pass any adjudication or condemnation upon the surrender of the Fort, there being no sea prize or capture upon the sea to give the Admiralty a jurisdiction. It has been determined in the cause between the East India Company and Mr. Halsey that the seizure of the Fort by the Company did not vest the debt due from Halsey in the English East India Company, and that decision has been submitted to, so that it appears to me the Company are concluded on that point. and that the right to institute an action was not established in the captors by the capture. In point of locality, personal debts are considered to follow the person of the debtor, so that the debt itself being in another country could not form part of the capture. If the Dutch East India Company can prove the payment of the money which Halsey was to pay to Ross to the English East India Company, and if they can show that the money advanced by Ross to Halsey was money of the Dutch East India Company advanced to Halsey by Ross as agent of the Dutch Company, I think that the institution of an action by the Dutch Company against the English Company for money had and received by the English Company for the use of the Dutch Company is an appropriate remedy to recover it. His Majesty, whose right to make prize is antecedent and of much higher authority than any other rights of prize, is not indefeasibly entitled to a prize until after it has been condemned by sentence; and upon this I ground that so long as such a sentence is not pronounced, there is no conclusive evidence that the seized goods are the property of an enemy, for their being found in the possession of the enemy is indeed only a presumption and not a proof that he is the actual proprietor thereof. And if the King, from whose grant all other rights to make prize derive their origin, is not entitled thereto without a sentence, it cannot, I think, be contended that his grantees can possess this right. 125: 2nd Question: I am of the opinion that debts due to the Dutch Company or to Dutch individuals by British subjects and others are not in any manner vested in the captors thereof by the capture of Chinsurah. By the Law of Nations, as understood and practiced at present, debts due to an enemy do not generally follow the possession of his person, nor from the possession of those written instruments of contract by which the debts are established. By the laws of England, debts in favor of an alien enemy, if there be effects recoverable within the dominion of the Crown, are forfeited to the King, but there must be a commission appointed and an inquisition held to enable the King to do so, and if peace comes before such an inquisition is taken, the forfeiture is discharged, and the title of the alien revives. In the present case, no such inquisition took place during the war, and I conceive therefore that the right of the Dutch East India Company revives, unless it has been legally divested by the assignment made thereof by Mr. Ross. 3rd Question: I am of the opinion that the assignment made by Mr. Ross to the English East India Company is not a legal assignment, having been made either from ignorance, because he considered the rights of war to be of greater extent than they truly are, or in breach of the trust reposed in him by his constituents, the Dutch Company. If Mr. Ross was of the opinion that he was bound jure belli to make such an assignment to the British Commissaries, then he erred in point of law; if he made the assignment knowing that he was not bound jure belli to do so, then he is guilty of a breach of good faith, and I conceive that on either ground the Dutch East India Company is entitled to relief. 126. The Dutch Company must seek its recourse directly against Mr. Ross, their agent, who by mistake or breach of good faith has transferred their property in an improper manner. Redress against Mr. Ross must be sought in the courts of law of his own country to which he is subject. property is declared prize, it is regarded throughout the whole world as decisive, unless such a sentence is repealed. But it does not appear to me that such a sentence is absolutely necessary to complete the title to a prize, if it was in fact lawfully captured according to the Jus Belli, which decides all disputes of that nature. In the case submitted to me, after reading the annexed papers marked A, B, and C, I think that the English East India Company had a good right to the property seized at Chinsurah, and that it may now still obtain a regular sentence of condemnation. Answer to Question 2. I am of the opinion that debts which the Dutch Company or private individuals have to claim from British subjects and others did not pass to the captors by this capture. Answer to Question 3. In the case stated, it is my opinion that the Dutch East India Company cannot by any means recover the money paid by Halsey under the decree in the action instituted in the name of Ross. action instituted in the name of Ross. Signed: Edward Bearcroft Lincoln's Inn, 12 September 1788. After reading the copies of the opinions on the foregoing case and questions given by gentlemen for whose judgment I entertain sincere respect, I remain, however, unable to persuade myself that there is any mode of proceeding by which the Dutch East India Company can recover from the English East India Company the sum of money which the latter has received from Mr. Halsey by virtue of the decree in Equity rendered in the suit brought against him in the name of Ross. In the first place, I know not in what manner the Dutch East India Company can maintain a suit before any of our Courts, whether they judge according to Law or Equity, as the private individuals interested therein are too numerous and fluctuating to do so with effect, and in my opinion they cannot be recognized here as a body in the manner of our own corporations, which are chosen bodies politic empowered to sue or be sued by Act of Parliament or the King's letters patent. If this obstacle can be overcome, there are other difficulties in the way of the Dutch East India Company obtaining recovery from the English Company in this matter, which I confess myself unable to clear away. Here is a decree of a Court having competent jurisdiction, ordering the payment of a sum of money by the defendant to the plaintiff Ross as belonging to him in his private capacity. The defendant submits, payment accordingly follows, and the English East India Company receives it in the name of Ross and on the pretence of being authorized thereto as his agents. As long, therefore, as this decree stands, it appears to me an impossible matter for the Dutch East India Company to obtain this money from the English East India Company, for thereby one would assert a right to claim moneys that were received by the agents of Ross on the foundation of his private right and pursuant to an action instituted by himself, whereas it is clear that whoever receives money by virtue of a judgment or decree granted in favour of another can never pay the same over to a third party so long as that judgment or decree remains in force. It is certain, however, that the English Company has no right to this money by virtue of the capture, and that this Company has instituted the suit against Halsey in the name of Ross without having sufficient authority thereto, or pursuant to a power of attorney and assignment granted by Ross through misunderstanding and ignorance of the law and without receiving any equivalent consideration therefor. On the whole, therefore, it seems to me that Ross alone can obtain this money from the English Company, which acquired it in the manner aforesaid, by presenting a bill in Equity in his own name against the English East India Company, wherein the entire matter and transaction that took place at the assignment is set forth, with a request that it may be set aside as made [illegible]

Ross ought to be requested to authorize the Dutch East India Company to present such a petition against the English East India Company in his name, and it seems probable that he, being indemnified, will do so and consent to the Dutch East India Company receiving the money for their own use when it is recovered.
