The fate of Portonovo §37. notified on the 26th of September last to apply, and in the future not to be so hasty. — With regard to Portonovo, we have already briefly cited in our brief advice dispatched under date of 26 September last the sad fate that has befallen the Company's factory there, caused by the aforesaid marauding bands of Tipu, who occupy themselves with robbery, murder, and arson; we then already mentioned that the Resident Topander, having just barely escaped the danger, had arrived here with the Company's effects that he had been able to save, and was ordered to provide a clear account of that event, from its first origin until the day he was forced to yield, and thus to justify himself in writing regarding his conduct. Resident has arrived here with the preserved effects. Was ordered to make a report. which has been complied with. what all this demonstrates. — has presented by document 138. He has complied with this and, during the drafting of this letter, submitted a detailed written report, wherein the dangerous condition in which he found himself upon the approach of the aforesaid rabble is most clearly detailed and described, demonstrating that his escape, together with what he was able to save and secure, the specification of which was handed over alongside the report, was attended with the utmost danger, as he was virtually taken by surprise, barely having been able to escape it. On the morning of the 3rd of August, the fatal day both for the Company and for him, the Company's lodge was surrounded in the early morning by 600 horsemen. The defenseless community, which had not been able to escape, became the victim of their rage, and was sabered down in the streets; several who sought the river drowned, and others perished in the most miserable manner. Furthermore, George Hendrik Nessenius is sailing as a passenger on the ship Horsen to the capital of the Indies in accordance with what was agreed by resolution of the 15th of this month. He served as an officer under the Hanoverian Regiment for the English at Madras, and having requested and received his discharge and passport, which he presented to us as proof that nothing can be said against his conduct, for which reason we, to promote his inclination to seek employment with us in the Company's service, cannot refrain from recommending him to the favor of Your High Excellencies, since this motive also constitutes a principal reason for granting his request, which we might otherwise, as belonging among foreigners, have had to refuse. § 43. Also, in the hope of Your High Excellencies' favorable approval, we have granted passage per the aforesaid vessel Horsen to a Malay priest named Machometh Sale, who belongs in Batavia, and this at the instance of the Eastern Captain of the Jaffanapatnam detachment, named Machomet. § 44. Judicial Matters. At the meeting of the 15th of this month, two notarial addresses from the Council of Justice of this factory were presented, dated April 23rd of this year, stating the hindrance caused by the Moorish government here in the execution of a criminal sentence passed against a slave of the bookkeeper Prins, condemned to lose his life on account of committed manslaughter; likewise the failure to sentence another delinquent, a Gentoo named Kotta Narsjimbhoeloe, also guilty of the fatal and murderous death of a Brahmin at Jaggernaikpoeram named Souraija, with the request to send both aforesaid delinquents in that manner to Batavia for the esteemed disposition of Your High Excellencies, to which end they are also already on board the ship Horsen by an order of the first signatory. § 45. During the deliberation on this, it having been remarked by the second signatory how the order regarding the punishing of criminals and their trial or sentencing generally dictates that such must take place at the location where the offenses are committed, with a prohibition against sending them over otherwise or unsentenced, except in case of appeal or for other ordinary remedies of justice; that the administration of justice ashore, at places where the Moorish government or presently the English authority predominates, as in Bengal and Surat, is not permitted, but that nonetheless, in Bengal at least, all criminal sentences for the execution of which consent has been granted by the Director are carried out on board one of the Company's ships or sloops, or sometimes ashore after having first requested and obtained permission from the Nawabs; that if the country's Regent or his representative, the dewan acting here, is entitled to prevent us from punishing criminals ashore—which time does not now permit us to verify and examine from the privileges—one ought, after the arrival of the ship Horsen, to have proceeded to the execution of the sentence already passed, in the same manner as is customary in Bengal; but against which it was alleged that this would indeed be practicable insofar as the punishment corresponds with naval or military discipline, such as running the gauntlet through a watch or the entire ship's crew, or arquebusade; but that for death and other corporal punishment which must be applied by an executioner or the headsman, one would again be at a loss, since such servants are not at hand here, and none are to be found among the common people who would allow themselves to be employed as executioners. For which reasons, and because time is too short to act otherwise at present, we have jointly resolved to send the aforesaid delinquents on the ship Horsen to Batavia for the disposition of Your High Excellencies, the latter, as stated, unsentenced, though apprehended since November 14th of the past year, without any claim or movement having yet been made regarding the right of jurisdiction or trial in his respect, although he is a native of the country. § 46. Both aforesaid delinquents are therefore sailing on the ship Horsen in secure custody, and the original case documents are respectfully attached hereto, each separately among the annexes, for the esteemed disposition of Your High Excellencies. § 47. At our meeting today, a request addressed to us was submitted by the aforementioned Porto Novo Resident Librecht Cornelis Topander, wherein the petitioner, after setting forth the severe misfortunes that have struck him twice during twenty-seven years of service, and the sad consequences resulting therefrom for him as well as from the captivity suffered in the year 1781 upon the surrender of Nagapatnam to the English, now finding himself stripped of everything he had in the world and plunged into the utmost poverty, requests us to place these disasters and unbearable losses vividly before Your High Excellencies' eyes, and in consideration of these endured calamities, following the example of two of his predecessors, to support with a favorable recommendation his request for promotion to under-merchant as some recompense thereof and on account of his many years of service, with the promise of further loyalty, zeal, and vigilance. Batavia To His Honour, The Right Honourable and Highly Esteemed Lord Mr. Willem Arnold Alting Governor-General together with The Honourable Lords Councillors of the Netherlands Indies, Right Honourable and Far-Ruling Lords! The alarming circumstances in which we find ourselves, and which make it utterly uncertain when we will be able to dispatch from here a complete general overview of affairs and the dutiful reply to the common, secret, and separate letters received from Your Honours during the past year, are the reason why we respectfully draft this, in order not to leave Your Honours in ignorance of where the obstacle lies, and at the same time to show that we have not fallen into inactivity regarding the discharging of our dutiful obligation in this matter. It is not enough, Right Honourable Lords, that the heavy and weighty deliberations on Your Honours' aforesaid esteemed letters and the results thereof have produced an extremely extraordinary extensive amount of writing, anxiety, and reflection, so that, however diligently and earnestly work is being done, it has been found completely impossible to have everything copied out and subsequently arranged in an interconnected context so as to respectfully present one thing and another to Your Honours around the middle or at the latest on the 20th of this month, as had been the untiring zeal and intention of the first undersigned, for which even a few more days will indeed be required; we find ourselves, moreover, in no small concern about how we will transmit the papers from here with security, since the surrounding area and further to the south is in an extreme state of turmoil and agitation, and the community in the countryside, filled with anxiety and fear, is everywhere fleeing from the fury of the barbarously operating irregular troops, or so-called Intjaks, of Prince Tipu Sultan, who is at war with the English. Furthermore, we are continuously disturbed during our heavy work, one day with lesser and the next day with more alarming news, of such a nature as if one must immediately raise the alarm and take refuge from the writing tables to arms, which, in a place like this, where our inhabitants and their houses are located on a territory over which we have no power or jurisdiction and, with others, only a conceded residence, and where an enemy attack could unexpectedly be our fate, plunges us into an anxiety that Your Honours can more easily understand than we are able to describe; all the more so since the theatre of war virtually surrounds us and we have every danger to fear when the English armies invade Tipu's lands, as is the intention, and thus, so to speak, leave the Carnatic exposed. A vessel that we had chartered to transport our papers by sea to Gale in this predicament has not yet arrived here from the North, where it belonged. In a word, everything is going against us, and we are therefore very perplexed as to how we shall keep ourselves free from any suspicion of neglect of duty with Your Honours. We therefore very humbly request Your Honours' favourable consideration of all the aforesaid circumstances, as unpleasant as they are dangerous, and that we may be acquitted of any negligence in the pursuit of that which we know to be of such great importance, namely a timely report of affairs; being confident that, when our activities since the end of October of the past year are presented and brought to light, Your Honours will be magnanimous enough to acknowledge that we have, this time, found ourselves in a turmoil and trouble that cannot be compared to the ordinary course of business, having undergone a general reformation and several very important arrangements. We seem to have to give up the Japanese bar copper and the cloves, without nutmegs and mace, as virtually unsaleable, at least judging from what was bid for both of those commodities at the public auction held on the 15th of this month, for each in particular, as shown by the enclosed copy of the report, and for which the one as well as the other was withheld from sale, practically nothing else could be said about it: The only thing that comes into consideration against this is that the unfortunate circumstances of the war, and the real lack of money, as it is being entirely consumed by the warring parties, indeed constitutes the principal reason why there is no market and consequently no other buyers appeared at the auction than our usual suppliers and a few other impecunious persons, who lack the credit and means to fulfill the stipulated conditions of cash payment, but, aside from that, would not have reached that price at which we had determined to let the aforementioned commodities go, namely the copper at 80, and the cloves at 400 pagodas per bahar, rather than letting the substantial remnants of both lie over any longer and causing the Company to suffer losses from the interest that the capital drags after it day after day. We therefore take the liberty of seriously submitting for Your Right Excellencies' consideration the absolute necessity of a further determination and reduction of the selling prices of the copper and the cloves, when we find ourselves in circumstances such as the present, where no other commodities that encourage the merchants, or the nutmegs and mace, can be added to them; we even believe that, in order to get rid of the remainder once and for all, the old determination in Bengal of 180 per cent for the copper will hardly and with difficulty be stipulated or obtained for it, although regarding the cloves we realize that they absolutely cannot and must not go for less than the prices that have been fixed for them by the Gentlemen Directors and also by Your Right Excellencies by extract from the General Resolutions of Batavia Castle dated 28 December 1787, or eighty stuivers Indian, being seventy-five stuivers Netherlands money the pound. The remnants of both of these commodities are very substantial, for as of the last of December 1790 the following was on hand; namely: 252,313 lb of Japanese bar copper; of which: 200,888 lb at Palliacatta 76,980 lb at Jaggernaijkpoeram, and 74,445 lb at Bimilipatnam 83,512 lb of cloves; namely: 52,645 lb at Palliacatta 17,707 lb at Jaggernaijkpoeram 13,155 lb at Bimilipatnam. Of which nothing has been sold since, which has caused us to ponder how we might best frame our formal requisition for both of these commodities. If 125,000 lb of copper is now added to this, as was made known in the recently dispatched provisional requisition, then upon the arrival of the ships there would be on hand 377,313 lb of Japanese copper, which, along with the aforementioned quantity of cloves, is too much to find a market in 1 and a half book years: It is for that reason that it is respectfully left deferred to Your Right Excellencies what should be dispatched in fulfillment of the aforementioned requisition, without our having dared to demand anything thereof in the formal requisition, since the sale for the time being depends entirely either on a substantial reduction in price or on the possibility of supplying the requested nutmegs and mace, alongside which there is a prospect of better disposing of the other commodities, even if it were, as is the custom here, partly to make good the necessary cash advances to the suppliers, who still accepted the latest lots ceded to them at the previous selling prices because cash was furnished with them, entirely for the European requisition and partly for the Indian requisition; yet for the nutmegs and mace they could have paid more, had we been fortunate enough to have had a more abundant supply thereof on hand, in which case the distribution, although it is now less than before, could also have been directed thither in order to take more cloves and copper in proportion thereto. From Jaggernaikpoeram and Bimilipatnam, 312,000 lb of Japanese bar copper was requested in the provisional requisitions and from Sadras in the formal requisition. The last-mentioned office has none of that metal left on hand; the other two offices still have 151,425 lb in stock; thus, to satisfy the requisitions, 160,575 lb would still be needed, which, being supplied from our stock, leaves us with 40,313 lb remaining, which constitutes the reason why, in the recently dispatched provisional requisition, what was requested for the offices was deemed unnecessary.
