the last inserted the commissioners having sent a written report of their commission instead of the short report already rejected on 27 October last, together with a statement of the expenses which they were obliged to incur for the execution of the matter, to the amount of pagodas 986:4:½, being of the following content: Statement of such expenses as the undersigned were unavoidably obliged to incur to make good their costs concerning and on account of the commission assigned to them at the Office of Jagernaickpoeram from the day of their arrival at the aforementioned Office until the 15th of this month, which was presented in all respect to the Right Honorable Mr. Jacob Eilbracht, Senior Merchant and Commander of the Coromandel Government and its dependencies, together with the Council at Palliacatta; namely: 10 December 1790. and the account of expenses incurred in the Jaggernaikpoeram Commission, in order that they may in due time be reimbursed to the Company by whoever shall be burdened with the cost as the guilty party by Their High Excellencies aforesaid; to suspend further decision upon the report until the Merchant Willem Hendrik van Bijland, to whom a copy of the same shall be delivered, shall have made his declaration thereupon so far as it concerns him, and furthermore respectfully to offer the same to the Noble High Government of the Indies in original with the cited documents, with orders to the Commissioners to send once more that Report with the Memorial of expenses to remain here, if this should not already have happened before the receipt of this order. 10 December 1790 Van Halm serves with an answer regarding 1 lease of rent. In compliance with the requisition of the resolution of 27 October last, both from the Head Administrator Van Halm and the Commissioners at Jaggernaikpoeram, having been received the defense to the petitions of complaint inserted in the said Resolution from the former Renter of the Village of Gollepalem, and the Jaggernaikpoeram suppliers of white cloth. 10 December 1790 Which first mentioned reads as follows: 10 December 1790 To the Noble Honourable Lord Jacob Eilbracht, Senior Merchant and Commander of this Coast of Coromandel and its dependencies, etc. etc., together with the Council. In order to comply with the honored resolution of Your Honours of 27 October last, by delivering a copy of the adjacent petition to the humble undersigned to serve with an answer thereto, he accordingly has the honor humbly to inform Your Honours that during his presence at Jaggernaikpoeram he never heard that one Pendepoloo venket Reddij was renter of Gollepalem before the past war with the British, but indeed the father of the present Renter, named Ramaijan. The humble representations of Pendepoloo venketreddij to the Honourable Jacob Eilbracht, etc. Insertion: In all humility I take the liberty to represent to Your Honour that for a considerable time, besides my ancestors, I have been Meerasidar and Renter of the village of Gollapallim, besides merchant of the Company in Guinees; but for these 6 years a person named Pendepoloo Ramaija, a son of my uncle, has taken the said village separately on lease in his name, and refuses to pay me the yearly money or revenue from the produce of the Village, for which reason I have often tried to bring my complaints before the gentlemen here, and the said Ramaijan, being protected by the gentleman Obdam, has prevented me from going to any gentlemen. Six months ago the gentlemen Commissioners arrived here, to whom I made my complaints against my defendant. The ordinary lease of the abovementioned Village of Gollapallum is 250 pagodas, but I offered 375 Pagodas if they would give me the lease of Gollapallum, and to that end I handed over a translated paper to the gentlemen Commissioners, who thereupon ordered me to wait until the said village should be auctioned, saying further that because I was a capable man and meerasidar, and besides offered the most, I should have it, and therefore I should not fear or doubt, and ordering me further to look for a security for the same. I searched and found a capable person for it. In the month of August, after the tom-tom had beaten for three days to make known to everyone that the village of Gollapallum and other leases would be public had been served by or on behalf of the said Pendepoloo venket Reddij, otherwise he would have acted with equity in the matter. And since the gentlemen Commissioners have had the governance and management of the Company's affairs at Jaggernaikpoeram since the month of March of this year, it is impossible for the humble reporting party to elucidate to Your Honours how far what was said by Pendepoloo venketreddij, that it was promised to him by the aforementioned gentlemen Commissioners to cede the lease of Gollepalem to him for 375 pagodas under security, corresponds with the truth, having never heard this or heard tell of it. The 10th. became known that Pinto Poele Wenketa Riddij complained unjustly against Pinta Poele Wenketa Ramaija concerning his refusal to liquidate that which he claims to demand; that the latter had not refused to give the former that which would be imposed upon him by arbitrators, but that Wenketa Riddij had rather attempted visibly to frustrate the efforts toward settlement of affairs regarding an estate account; that it was true that Pinta Poele Wenkata Reddij had made an offer to have the village of Gollapalium relinquished to him for 375 pagodas, yea, even that they, the commissioners, had heard that December 1790. The 10th. continuation that he had declared he would give 500 pagodas for it. But that, since they, the commissioners, upon inquiry regarding that person, had found that he was a stupid and inexperienced creature, who was being incited by a vagrant named Mantrepreggade Wenkettappaij, a mortal enemy of the present renter, and who, if affairs went poorly, would always leave him to take the blame for the consequences, they had judged it contrary to the welfare of the inhabitants of Gollapalium, who had already suffered so much from the storm and war, to accept that bid, as they were well assured by investigation that he could not produce what was offered, or he would have 1355. The 10th. would have to make use of extortions, the notorious consequence of which would be the depopulation of that place; furthermore, that experience had shown that the relinquishment of Gollapalium to another renter had always had very bad consequences, yea, even murder and manslaughter, whereof the Head Administrator here, the Merchant Paul Engelbert van Halm, is and could give sufficient testimony; to prevent which, and so far as lay in their power to care for the welfare of the Company's inhabitants by not sacrificing them to the avarice of someone of whose conduct they are entirely ignorant, just as they are void of December 1790. The 10th. of trust in such a man under whom they would nevertheless have to live, they had thought it best, subject to the approval of the Government, to relinquish that place again to the former renter, with an increase, however, of 50 pagodas per year; that these were the reasons that had moved them to act in such a manner, which they hoped would be accepted by this Council as sufficient; observing, regarding the petitioner's submitted list of revenues of the village, that it could not withstand scrutiny and was perhaps drawn up to make his offer acceptable, or fashioned after the proceeds of a profitable year, which, however, generally speaking, could not hold 1357. 1361. ought to be publicly auctioned and not ceded by grant to one or another favorite, since the documents sent hither merely indicate the conditions according to which the auction was to take place, which, as it were, although stated to have been signed by the farmer and his sureties, it has further been understood also to demand in this regard a greater reassurance and security; or else, in so far as matters here may not have been handled properly, under annulment thereof and of all unlawful agreements, to order them to effectuate and execute the same as has been prescribed to them concerning Gollapallem, under further remark that without regular proof of a public lease one cannot attach the seal to negotiations that do not agree therewith, and are of such a nature that, as far as the servants as commissioners are concerned, they are left to their account and responsibility. And in order to provide that the clerk guard against lending a hand to any unlawful dealing with respect to the lease, it has been approved further to order the said commissioners, while presenting to him the aforementioned remarks, to warn him in the name of this meeting to proceed in this matter in accordance with his oath and duty, without signing for anything against which he might feel aggrieved, and of which he remains in any case obliged to give proper notice to this Council. 1363. 10 December 1790. Concerning now the elucidation given by the frequently mentioned commissioners on the aforementioned complaints of the three new suppliers, by name Kala Kistnama, Pinetie Riddij, and Datavie Anandoe, directed in particular against Pintoe Poele Ramaija, they deem that there are no grounds to consider this to arise from anything other than jealousy and envy, referring in this regard to the Head Administrator van Halm, who would be best acquainted with whether the accused has acquired a share in the trade through sinister tricks, or rather has deprived those suppliers thereof; affirming that no such thing had come before them, nor had it sufficiently appeared that he, Ramaija, was the author of the disputes that have arisen there, although the Masulipatnam merchants also accuse him thereof, which, however, had not been proven up to now; that, to their knowledge, Pintoe Poele Ramaija has not been away from the place and has behaved well, 1365. 10 December 1790. and that they had no reason to complain about him, and even that he was not unworthy of the protection of this government; whereas, on the contrary, the three other suppliers, being unable to provide any proof of their accusations, deserved the displeasure of this meeting on account of their rash conduct. Which cases having been discussed and considered how the reference of one to the other, like the Head Administrator to the commissioners and the latter again to his honor, yields no small suspicion that something seems to be kept hidden in this matter, of which the truth is set aside, leading to a suspicion that the complainants, if not entirely right, are nevertheless not wholly in the wrong; but seeing that it may be acknowledged that the envy and jealousy of one native toward another is also sufficiently known to be of such a nature that they continuously cross each other's path and restlessly seek each other's harm and ruin; so that to do justice, the matters in dispute, on account of what happened over there and the confusion and discord that arose from it, appear very doubtful and cannot be treated except when one can reconcile them with the public state of affairs, which concerning Poele Ramaija 1367. 10 December 1790. as well as the others, give rise to considerations which it will be impossible to clear up until the effect of the advertisement dispatched on the 27th past to Jaggennaikpuram shall have appeared, serving as an intimation to each and every person who maintains to have been wronged to come hither to lodge their complaints and produce the evidence; so it is understood after deliberation to remark and reply that the disposition over the declaration of the commissioners regarding the said Poele Ramaija and the three others shall remain suspended until after receipt of an answer to the aforementioned advertisement inserted by separate resolution of 27 November last, in order that, if the said merchants should find themselves among the aggrieved community, they may first be heard, and then to act therein as shall be deemed to be consistent with equity. The 10th. to be able to buy for ready payment and acceptable prices, without confining oneself solely to the contractors, who always know how to find sufficient reason to complain, while meanwhile others would wish to have the opportunity to make some profit. Molinga Letjema Chittij, and Kansela Obloe Chittij, as well as Meddha Wardarasoe Chittij and Wengeta Kistnama Chittij of the other part, hereby declare that, for the procurement of such linens and other returns as have been requisitioned on behalf of the aforementioned Dutch Company Pro Patria and India in the respective demands for the year 1791, the one dated Amsterdam the 20th of November 1789, and the other Batavia in the castle the 22nd of April 1790, they have agreed and contracted with each other as follows: Article 1: The contracting parties of the other part undertake and bind themselves to the delivery of such goods as are specified in the memoranda drawn up concerning this and annexed hereto, which have been delivered to them in the Gentoo language. Article 2: The contracted goods must be of sound quality and contain the proper length and breadth, with all other requisites according to the demands, each piece properly containing the number of threads or caalen as specified to them according to the demands. Article 3: The delivery shall take place according to samples of each sort of goods, which shall beforehand be manufactured and approved by the contracting parties of the other part according to the muster pieces resting here with the invoice keeper, in order subsequently, so far as the assortments for Europe are concerned, to be dispatched with the return cargo to the Netherlands. Article 4: The payment for the goods shall be made according to the old unincreased prices, as the same are made known in the aforementioned memoranda and Article 5: And to enable the contracting parties of the other part to do so, the contracting parties of the one part declare to have agreed with them upon the following terms and conditions: 1. That for the requirements of the Home demand, the advances must be furnished in cash, and for the Indian demand, it must be left to them, in deduction of the advance, to accept as much merchandise as they shall declare to require at the previously paid prices; 2. That, after the signing of the contract, the advances must commence, and that, before the ultimate of January next, one third of the whole must be furnished; 3. That the second installment of the advance shall commence with February, and that before the ultimate of April the amount thereof must be complete; 4. That the last portion shall be furnished upon the arrival of the ship or ships expected with money; 5. That the delivery, according to previous custom, must be completed by the ultimate of September, but that in fulfillment of the contract, the acceptance shall take place until into October of goods that might only become ready after the ultimate of September, against which, by a timely, complete provision of money, all possible care will be taken and efforts made to complete the delivery strictly up to the ultimate of September. Article 6: The contracting parties of the other part further declare to have divided themselves into two teams, the one consisting of four and the other of two persons, of which the first are named Ragoe Wengatra Rama Chittij, Ekoeloe Annam Chittij, Boddel Molinga Letjema Chittij and Kansela 1425. Obloe Chittij, and the other Meddhawardarasa Chittij and Wengeta Kistnama Chittij.
