Adrianus Gerardus Krayenhoff, pursuant to the favorable license of Their High Excellencies dated 23 September 1791 to be permitted to cross over to Europe on one of the ships of the foreign nations, is set to undertake that journey on the 4th of this month with the Danish ship Juliana Maria. We direct this solely to give notice thereof to Your Right Honorable Worships and at the same time to report on a certain transaction which took place in his regard and which he has bound himself to fulfill immediately upon his arrival in the Netherlands. By the marginal disposition of Their High Excellencies the Honorable High Indian Government on the findings of the Bengal trade books from the years 1782/3 to 1788/9, received by us on the 2nd October 1792 per the ship De Zeebouwer, he was, as former Fiscal, charged with the reimbursement of f 7515 8, with one-sixth for the Visitateur-Generaal, or f 1252 11 8, making together f 8767 19 8, because the expenses entered under the account of Condemnation and Confiscation exceed the stipulations of the Regulation of Expenses. Since we were convinced of the truth of what was alleged by him, and it therefore would have been extremely hard on him had we continued to insist on the payment of the compensation in cash or the provision of other sufficient security for the same, since his house, although in former times well worth the sum which he states it cost, currently, owing to the so deplorable decline of the colony, would yield scarcely a fourth part of that amount upon sale, we decided on the aforementioned day to allow him to suffice with the execution of a double suretyship, in accordance with the order to the sum of f o r. o 3200:—:- for the period of eight years, for which his house has been accepted as collateral, and furthermore demanded from him a notarial deed by which he bound himself immediately after his arrival in the Netherlands, which is calculated to be in May or June next, to deposit into the Company's treasury at the Amsterdam Chamber an amount of ƒ10767„19:8, or else to provide sufficient security for it to the satisfaction of Your Honorable and Highly Respected Lordships, in order that there may be recovered from it not only the compensation already imposed, but also whatever may still be charged to him for the years 1790 and 1791, or so much of the one and the other as will in due course be demanded of him according to the further disposition of Their High Honors, with instructions to his attorneys-general, the Messrs. 204. the former Fiscal has been ordered to pay compensation of f7515:8:— plus one-sixth, or f1152:11:8, making together f8767:19:0, on the grounds that the entered expenses charged to the account of Condemnation and Confiscation exceed the provisions of the Memorandum of Economy; that in his submitted report, together with the Memorandum and Summary annexed thereto under date of 30 June 1791, the monthly and annual receipts and expenditures, both with respect to the Company's Villages and those of the Condemnation and Confiscation account from 1784 to 1790, as well as the reasons for the extraordinary repairs carried out in the Villages, are sincerely demonstrated; that he requests permission to refer thereto, and that it may please this Assembly to permit him to confirm the authenticity of what has been stated under oath, expressing furthermore his utmost regret that those papers had not yet arrived in Batavia at the time when Their High Excellencies decided to make him restitute such a considerable sum, since he trusts that those documents would have brought about Their favorable disposition; with which, and with the favorable exemption from the imposed compensation, he still ventures to flatter himself once They will have examined his sincere representations, especially if supported by the well-intentioned recommendation of this Assembly, for which he petitions; that regarding the differences between the provisions of the Memorandum of Economy and the entered expenses charged to condemnation and confiscation, he requests leave to state that this has already taken place since the year 1760, as from that time on the advanced wages for peons and vessels have always exceeded the stipulated limit; that it is indeed true that in the last five years there have been few detainees, but 205. that what was entered in excess thereof truly served as a supplement to the expenses for the unavoidable servants, etc., in the Company's Villages; that he, the petitioner, acknowledges that this practice was certainly not as it ought to have been, and that he neither should nor ought to have followed the example of his predecessors, but that he hopes for favorable indulgence in this regard, and that the monies thus re-expended, as appears from the aforementioned Summary, may be taken into consideration; that he, the petitioner, being unable to await the decision of the said High Excellencies upon his humble request for the exemption of the compensation imposed on him in this country, because, pursuant to the leave granted by Them, he intends to depart for Europe on a Danish ship in the coming month, has nothing else to offer as security than his substantial house and grounds, as he has already remitted his modest wealth through the Company's bills of exchange and still has heavy expenses to incur regarding his voyage; the petitioner therefore humbly requests that this assembly would do him the favor of accepting the said house as a guarantee until such time as he shall obtain a favorable decision from Their High Excellencies: this petition being further accompanied by a separate address to the Honorable Officer in Command, wherein, excusing himself for the fact that indisposition prevents him from delivering the petition in person, he also attests that he would have done so earlier were it not that he could now consider the negotiations with a certain English gentleman concerning the sale of his house as virtually broken off, declaring that, as there is now absolutely no other means left to save himself than his house, which cost him more than 20,000 Sicca rupees, to offer to the 206. heavy and oppressive restitution, as well as whatever might further be imposed upon him hereafter and from which Their High Nobilities unexpectedly might not be pleased to liberate him, to furnish and pay from his modest fortune in Europe, which was transferred long ago, in five installments from year to year, or else to remit it to Bengal; declaring furthermore to feel that this, under correction, is all that can be required of him, and consequently venturing to flatter himself that the Lord Governor, through his kind cooperation with the Council, will direct matters in such a way that he will not be detained by this vexatious affair and his departure for Europe, which would cause him an irreparable loss, since he has already paid for his passage and his health makes a speedy departure from here most urgently necessary: as all this is further evident from the aforesaid writings themselves, which are to be inserted by resolution. Whereupon having deliberated, and having taken into consideration on the one hand the critical circumstances in which the petitioner finds himself, now that he is on the point of departure and, as is generally known, his assets are in Europe, to find guarantors or provide security for so considerable an amount as has been imposed upon him as compensation, which he certainly could not have counted upon, having relied on being relieved of all further concern and enjoying the freedom to make use of the license favorably granted to him to sail to Europe on a foreign ship by providing a double bail bond, not amounting to more than S:r r: 3200:-:— according to the standing orders for that purpose, to which end he has already booked passage and paid the money agreed upon for it, and that it would thus be extremely harsh and ruinous for him to be frustrated in this intention of his and detained in a country where the cost of living is very expensive and he lacks the means to provide for it properly; while on the other hand stands against this the obligation of this Assembly to employ all possible means to promote the Master's interest and the securing of the funds that have been imposed upon the petitioner as compensation, for, no matter how much credence may be given to the petitioner's assertions in his report and the accompanying memorial and comparison inserted by resolution of 17 September 1791, namely that the excess revenue admitted by him charged to Condemnation and Confiscation beyond what that account ought to have borne was offset by the Company's villages being burdened so much less than what was actually disbursed for their service, and no matter how much one may hope on the basis thereof for a favorable disposition in favor of the petitioner as soon as the true state of the case shall have appeared to Their High Nobilities from his representations on the subject and the aforesaid writing, that disposition is not yet known here, and this Assembly is therefore obliged to devise the very same measures for the security of the Company as if the same had actually been decided to the disadvantage of the petitioner: since, however, this security is the only objective one intends to achieve and the petitioner's adduced arguments are acknowledged to be based on reason, it is, although those reasons simultaneously operate to deny the first part of his request regarding the acceptance of his dwelling house as a guarantee for the entire amount of the compensation imposed upon him, since it is feared that the same upon sale would not be able to fetch that sum at present, nevertheless approved and agreed to accept that guarantee as security for the double bail bond which the petitioner, pursuant to the orders, is obliged to provide for the period of eight years to the sum of Sa. ro 3200, and otherwise to allow him to suffice with the execution of a notarial deed whereby he will bind himself, immediately after his arrival in the Netherlands, which is calculated to be in the month of May or June next, to deposit into the Company's Treasury at the Amsterdam Chamber such amount of ƒ10767:19: as has already been imposed upon him as compensation in the aforesaid manner, or will probably still be imposed for the years 1790 and 1791, or else that sufficient security will be provided for it by him to the satisfaction of the Right Honorable the Deputy Directors at the Meeting of Seventeen, in order to recover therefrom the whole, or such part, as will be demanded of him in due time according to the further disposition of Their aforesaid High Nobilities, with instructions to his general attorneys Samuel Radermacher and Gozewyn Willem Hendrik de Vriese, in case of death or longer delay of his journey to the Netherlands than the time stipulated above, being required to do so, to deposit the said sum in his name and on his behalf from the petitioner's money, shares, or credits in their custody, or else to provide security for it, as they shall deem appropriate in accordance with his interest: this aforesaid obligation remaining in force until such time as the reports of the aforesaid decision have arrived in the Netherlands and have been fulfilled by him, while at the same time his house and premises shall be deemed generally bound as a guarantee for the fulfillment of the Deed, with the liberty, however, for the petitioner to be allowed to sell the same to the greatest advantage

from him in due time, according to the further decision of the said High Indian Government, might be demanded; both for the compensation already imposed upon him, and for that which will likely still be imposed upon him to compensate for the years 1790 and 1791; this aforesaid obligation remaining in force until such time and while the notices of this decision shall have arrived in the Netherlands and been complied with by him there. For the fulfillment of that which is written above, the appearer binds in general his person and goods, submitting the same to the jurisdiction of all the Lord's Courts, laws, and judges, at the place and under whose jurisdiction he might find himself, to that end expressly renouncing all exceptions in general, and specifically the declinatory exception. Since the late arrival of the vessel mentioned in the margin, which, dispatched from Batavia via Malacca to here on the 11th of October, did not enter this river before the 27th of January, compelled us, on account of the passing monsoon, to choose from the two-fold orders received therewith for its dispatch via Coromandel By the packet boat de Faam 224 Hooghly, the 19th of February 1793. and Ceylon or else directly to the Netherlands, to give preference to the latter, we address this both as an escort for that vessel and to communicate that we have loaded the same with 300 bags or 43092 lb of saltpetre, for the account of the Honourable Company, and 55 bales of diverse linens and raw silks, on freight according to the regulation framed thereon dated 29 March 1791, for the signature of the junior merchant Johan Carel Lodewyk Blume and consigned to Messrs. Hope & Comp. or to their deputy, factor or authorized agent in Amsterdam, as appears from the enclosed bill of lading invoice, whereby it appears that the freight to the amount of sr: 1498:17 12/15 or ƒ1873:2:– has been duly paid into our treasury; the saltpetre could not be charged because up to this day its cost has not been provided to us by the English gentlemen.
