324 No 13. Per the State's frigate Alarm and the French private ship the Castries, which successively departed from here for the Netherlands on the 9th thereafter, the outward-bound ship Texelstroom continued its voyage to the Indies main settlement on the 11th of the same month. Now likewise lying ready for departure to the Netherlands, the French private ship le Neptune, we take the liberty, in accordance with our duty, to bring to Your Right Noble and Right Honorable Worships' knowledge concerning that vessel: that (as we had the honor to report by our humble letters of the 8th of February last via the French private ship l' Elizabeth Sophie) the said ship le Neptune sustained a severe leak on the voyage hither from Batavia, which made it necessary to unload its contained cargo here; and having been requested by the Captain of that ship, Louis de Martignac, for the necessary assistance in unloading that cargo and for a storage place for the same, we thereupon, in the same manner as was done regarding the Swedish private ship la Bonne Resolution, 325 No. 13. granted to the Captain—since one had no other suitable storage place—that in case he, after examination of the ship 't Huis te Spijk laid up here for demolition, should judge that vessel suitable for the purpose, in order that the unloading and reloading of the cargo could take place both with the greatest speed and in the most convenient manner, he might then make use of the same ship 't Huis te Spijk; with the understanding, however, that all of this should take place for the account of the owners of the ship, the unloading, repair, and reloading of the said ship le Neptune being without any risk to the Honorable Company. In addition to which, from the Company's treasury there has been paid to the aforesaid Captain Martignac for his necessary expenses here at this place a sum of two thousand five hundred rixdollars, whereof, as well as of that which was further furnished to him, an original signed account, together with the original short invoice of its lading, has been sent over to the Noble Gentlemen Directors of the Delft Chamber, for which the aforementioned ship le Neptune is returning. This 326 No. 13. then having taken place in the manner as aforesaid, notice in writing was subsequently given to us by the aforesaid Captain de Martignac that upon the reloading of the cargo it was found that of the Company's goods, seven bales of coffee beans and two pieces of linen had gone missing and were stolen, with the request that an investigation be made into the matter, and that he, the Captain, might be relieved of the accountability therefor. Into which request of the aforesaid Captain, however, we considered ourselves unable to enter, since, as has already been cited hereinbefore, the unloading and reloading of his vessel had to take place for the account of his owners without any risk whatsoever for the Honorable Company; and that he, the Captain, moreover had complete freedom to apply all such precautions as he deemed necessary, both in the unloading and the storage of the goods. Which request was consequently rejected; nevertheless, the necessary copies of the petition of the aforementioned Captain and of the declaration submitted therewith have been placed in the hands of the provisional Fiscal, in order to make a precise investigation as soon as possible concerning the theft committed, and in case 327 No. 13. anything of the stolen property might be recovered, to hand the same over again to the same Captain de Martignac, or else to the person whom he upon his departure shall have qualified for that purpose, for the account of his owners. The authenticated copies of the documents submitted to us by the aforementioned Captain in this matter are enclosed herewith. Furthermore, there arrived here this morning the State's warships Utrecht and Wassenaar, commanded by the Gentlemen Captains Jacob Pieter van Braam and Gerrit Oorthuijsen, which departed hither from Point de Galle on the 28th of January last. The Dutch private ships the Vrouwe Johanna Jacoba and Willem en Jan likewise being due to depart from here for the Netherlands within 5 to 6 days, we must hereby further bring to the knowledge of Your Right Noble and Right Honorable Worships that the Danish ship the Kroonprins, commanded by Captain Jung, returning from China, on the 12th of this month in the evening while sailing into this roadstead, having been forced by the strong south-easterly wind to make for Robben Island, had the misfortune to misnavigate there and to run aground; 320 No. 13. In the Castle of Good Hope, the 17th of March 1786. that ship, however, through the assistance of the vessels dispatched from here, having fortunately been refloated again yesterday, and having come up here into the roadstead this afternoon, without it being known with certainty up to now whether and what damage that ship has sustained. To Monsieur van de Graaff, Governor of the Noble East India Company, and the Gentlemen Councillors of the High Council at the Cape of Good Hope, Humbly petitions C. Lourde Martignac, Captain commanding the private ship Le Neptune, chartered to the East India Company to make its return to Rotterdam, and putting into this port for reasons which he explains in the official report that he has the honor to present to you, stating that the long stay he was forced to make at Batavia waiting for his cargo placed him in the position of consuming all his provisions and seeing his ship deteriorate daily despite the care he took for its maintenance and repair, which was done or carried out under the eyes of the Vice-Commander of Batavia. And despite this, the said petitioner found himself obliged at sea to pump every hour, taking on twenty inches of water per hour, which obliged him to investigate where the said leak originated, and he indeed found two in its stern without being able to remedy them except by pumping continuously, as was done. This misfortune, joined to that of having twenty-five to thirty-four men sick since the departure, having furthermore lost seven men, and lacking, moreover, bread, wine, and good water, decided him to put into this port in preference to any other, and in accordance with what his charter-party states: that he will be provided, whether at Batavia or at the Cape, with whatever is necessary by the East India Company, for which accounts will be drawn up that the said petitioner will sign, to be deducted subsequently from the payment of his freight. Consequently, the petitioner has the honor to point out to you that to remedy the needs of his ship, it is of absolute necessity that he unload his 'tween-deck, containing arrack and tamarind belonging to the Company, and re-embark them aboard his said ship as soon as the repairs are made, and following the assistance of workers and materials to this effect that the said petitioner has the honor earnestly to request of you, in order to accelerate his operations. He has the honor also to point out to you that, as he will need to pay the workers, materials, and provisions during the stay in this port, his sick in the hospital, and his return to Europe, he will need you to be pleased to grant the sum necessary for these purposes, which will amount to three thousand rix-dollars, the petitioner reserving the right to make another request to you if this is not sufficient, as well as to provide him with a draft from the Company, should he have any remaining upon his departure. The petitioner dares to flatter himself that you will be pleased to cast a favorable eye upon his just requests, and that it will please you to give certain and precise orders so that he is not refused any assistance whatsoever that he might need. 332 two decks: and would have sent on board the said vessel serving us as a warehouse, under the direction of Mr. Desmoriez, First Lieutenant, the said goods: of which the stowage and unstowage on board the said warehouse vessel would have been done by the named Julien Yves Bouton, petty officer of the Neptune, and the longboat and the boats serving for the transport would have been escorted by Sieur Garrau, officer of the said vessel, according to what is stated in the official report that the petitioner has the honor to place before your eyes; where in the quantity of goods that had been unloaded and transported on board the warehouse vessel, the major item of the Company consisted of eleven hundred and seven bags of coffee, of which only eleven hundred bags were returned on board the Neptune, which makes seven bags missing. Likewise, the major item of the Neptune consisted of forty-five coils of cordage of various qualities, and two coils would have been stolen from it on board the said warehouse vessel, as well as the seven bags of coffee. The petitioner has every reason to believe that the theft took place on board the said warehouse vessel, based on the reports that have been made to him concerning the conduct of the persons appointed to its guard, and notably regarding the proposition that was made to one of his officers concerning these same goods; which greatly astonished the petitioner, who adds that the said theft could only have been done through the mast-hole of the foremast of the said warehouse vessel when it was dismasted; that following the orders of the said petitioner, the hatches would only Whereas the petitioner, upon his request made to that effect, was granted permission by resolution of the 17th of January of this year to make use of the ship 't Huis te Spijk mentioned in this petition for the unloading and storage of the goods from the vessel under his command, in so far as that ship, after examination by him, the petitioner, should still be deemed suitable for that purpose, provided that everything shall be at the risk and account of the shipowners and without any risk to the Company, and that he, the petitioner, moreover had complete freedom to take all such precautions as he deemed necessary both in the unloading and the storage of the goods, the request made by him can therefore not be granted; have been permitted and opened in the presence of his first lieutenant, keeper of the keys. And consequently, the said petitioner has recourse to your justice, so that the people of this vessel may be made to answer for the missing goods mentioned above on their board, or that the said petitioner may be discharged thereof by the noble Company, and will do justice. and by boats that the Company sent us, under the conduct and inspection of Monsieur Garnier Desmorier, first lieutenant of the vessel, and stowed in the hold of the said vessel by Julier, Yves Bouton, petty officers also of the vessel. The count having been taken both entering and leaving on board the said two ships by Sieur Charles Garrau, officer also of the vessel, notably on January 24, I had loaded into a boat of the Company four hundred three bags of coffee of eighty pounds each, and carried on board the Dutch ship in question. On the other hand, I had loaded on the 28th of the said month into a boat of the Company in two trips seven hundred four bags of coffee, each also weighing eighty pounds, and carried always on board the designated vessel, which makes in total eleven hundred seven bags of coffee of eighty pounds each and belonging to the Company. The same day, which is the one on which we finished or ceased unloading anything, we sent by our launch forty-five coils of cordage, of different size and quality, on board the said number 2 Huys te Spyk, which is the last trip of the boats and launches. We always kept a padlock on each of the three hatches. The ship being thus lightened by means of the unloading of its merchandise, we worked to seek and remedy the leak, having done all that it was possible to do. In consequence of this, we set about taking back the items that we had warehoused on board this vessel and began on the 5th instant, loading into a boat of the Company, always under the inspection, as much for the conduct as for the stowage, and taking the count of the staff officers and petty officers, named elsewhere, three hundred seventy-nine bags of coffee, four hundred twenty-one in another boat on the 6th instant, first trip, and three hundred bags the second trip, which makes in total only eleven hundred, of which there is a deficit of seven bags, not having been able to find any more in the hold, each weighing eighty pounds, together five hundred sixty pounds in weight. That on the 9th of the same month we took back in our launch the cordage that we had warehoused on board the said Dutch vessel, but instead of forty-five, we found only forty-three, missing one coil of fifteen yarns and one coil of eighteen yarns. During the time that these items and goods or foodstuffs, belonging both to the Company and to the vessel Neptune, remained on board this Dutch ship named the Huys te Spyk, this ship unstepped its foremast to give it to a vessel of its nation that had need of it. It is therefore to be presumed, indeed certain, that the void that this mast left, by being removed, provided the means to penetrate into the hold, and take out the items and foodstuffs that are missing, although the Dutch officer ordinarily residing on board this vessel said that they had plugged the hole that this mast had left immediately after it had been unstepped. Given this operation, the loss of the coffee must be for the account of the Company, and these two coils of cordage of deficit must be paid by it to the outfitters.
