295 1 Resolutions No 10: — 4 Jacob 1785 Anno 1785: — 10 Jacob Tuesday the 4th of January 1785, forenoon, all present. Granted bonus to the servants whose time has expired, who will enter into a new engagement. Written protest from the Independent Fiscal Mr. Jan Jacob Serrurier, concerning the presidency of the Orphan Chamber. Since the discharge of the servants of the Honourable Company whose time has expired is at hand, it is therefore agreed, on the proposal of the Governor, to act in the same manner towards them as in the past year, and consequently to pay from the Honourable Company's Treasury the sum of 10 Rixdollars to those who will engage themselves anew for one year, as well as a bonus of 25 Rixdollars to those who will enter into a new three-year contract. Subsequently, the Independent Fiscal Mr. Jan Jacob Serrurier, pursuant to what was declared by His Honour at the resolution of 28 December last, submitted the following written protest: The undersigned Independent Fiscal, having reserved to himself at the last meeting the right to set down in writing such further remarks on the minute then made by Mr. van Schoor and the resolution taken in the Council as he should deem advisable, however much he could not but be extremely surprised at the singular contents of a part of the aforementioned minute, which appeared to the undersigned to contain expressions that members of a governing council certainly cannot imagine having to expect from their fellow members; nevertheless, in order not to give occasion for this matter to cause any delay, which is always detrimental to the public, he will not elaborate further on it, merely protesting against the resolution by which Mr. van Schoor is left in possession of the presidency of the Orphan Chamber, and in this matter leaving it to the further decision of our Lords and Masters, to whom the undersigned requests that express mention shall be made in the first ministerial letter to be sent from here, both of his first written representation and the reply of Mr. van Schoor that followed it, together with the present minute of the undersigned, and that all the aforementioned documents shall be sent over at the same time, the undersigned will await with respect what our aforementioned Lords and Masters will be pleased to decide further in this matter. /:was signed:/ J: J. Which protest having been read, the Merchant and Dispenser Adriaan van Schoor, after having first declared that regarding the pretended surprise of the Fiscal at what His Honour was pleased to call the singular contents of a part of the writing submitted by him, van Schoor, at the previous meeting, and also regarding the protest added thereto against the resolution passed by this Council, he thought he did not need to express himself, but that it was best to refrain from providing any appropriate remarks on this, further requested that it might be recorded that, after he had submitted his aforementioned document at the previous meeting /:in which otherwise the following should have been included at the 4th or last section:/, he had not only been reliably informed that in the governments both in Colombo and Nagapatnam none of the Fiscals hold the presidency of the Orphan Chamber there, but on the contrary, that from time to time in Nagapatnam, namely Messrs Bonk, de Filletaz, and Mossel, all Trade Administrators, had occupied that post, but that moreover it is evidently established even by an authenticated will deposited at the Orphan Chamber here, that Anno 1780 at Nagapatnam this presidency was held by the aforementioned Mr. Peracules Mossel, then Trade Bookkeeper there; and further: that, since according to the orders to be introduced in the future, recently allocated to this government from the Fatherland, the Fiscals shall henceforth continue to hold a seat here in the Council of Justice, to which the supreme guardianship must surely be assigned, whereas on the other hand the other members of the Council would not be part of it

Request of the skipper of the wrecked fluyt ship De Hoop, Sybrand Sax, to be excused, it being understood with favorable interpretation that it follows very clearly that the aforementioned presidency, with greater and better reasons, could be held by one of the Council members rather than by a Fiscal, who always if necessary could also with greater tranquility join and serve with the Board of the Orphan Chamber. And considering that the Honorable Company has already for two to three years been supplied with none or very little sweet wines, and the requisitions, both for the Fatherland and the offices in the Indies, come to consist solely of sweet, full-bodied wines; it is therefore deemed proper to notify the respective wine farmers, by the posting of notices, that upon the upcoming reception of those wines, the same shall with preference be taken from those who will supply the Honorable Company with the aforementioned sort of sweet wines. corn etcetera was ground for them and others; And finally in the third place, a presentation of the legitimate complaints and well-founded dissatisfaction of various inhabitants of this Cape concerning the unreasonable and arbitrary conduct of the majority of the privileged bakers, who, under frivolous pretenses, had failed for some time now, in accordance with the content of their Baking Ordinance, to provide the inhabitants with bread; with the accompanying request that the necessary provisions might be made in all these matters by Your Right Honorable and Worshipful Council: Thus it pleased Your Right Honorable and Worshipful Council to place the aforementioned petition into the hands of the undersigned fellow members in Your Right Honorable and Worshipful assembly, the Merchants Adriaan van Schoor and Mr. Jacobus Johannes Le Sueur, and at the same time requested and commissioned them to devise, together with the aforementioned Burgher Councillors, proper arrangements whereby the arbitrary conduct of the bakers regarding the baking and selling of bread, being entirely removed and cut off, they might be brought and kept under the obligation, in the best possible manner, to leave the inhabitants without distress; and that on the other hand, through grinding at private mills, no infringement or disadvantage would be caused to the respective compulsory mills. The undersigned then, in fulfillment of the commission entrusted to them, held sessions with the aforementioned Burgher Councillors Le Sueur and Karnspek (Burgher Councillor Jan Hendrik Munnik having been unable to be present due to absence) alongside the newly arrived Burgher Councillors Johannes Smuts and Jan Coenraad Gie, and having heard them concerning the grievances set down in the aforementioned petition, they declared thereupon: that with the objections raised concerning the grinding at the Honorable Company's and other mills, the intention was by no means to prevent grinding on those mills for anyone at all, but solely to prevent and counteract the abuse that occurred in this regard contrary to the established prohibition, the infringement upon the privileges of the respective compulsory mills, and the great disadvantage that was caused to one of the principal civic revenues. that therefore it might be proposed to Your Right Honorable and Worshipful Council, by renewal and amplification of the previous local laws, to interdict the grinding of corn and other grains at the Company's and private mills in this regard, both for the privileged bread bakers and all other inhabitants, unless the Colony's compulsory mills, through some accident, defect, or inability, should be unable to grind, in which case freedom could be left to everyone to have their grains ground at such a mill as shall best suit them, yet with the stipulation that they must previously have obtained a note, signed on behalf of the acting Burgher Councillors, whereby freedom is granted to such private or Company millers to grind the corn that shall be brought to those mills: that likewise henceforth all those residing here at the Cape and who are accustomed to have corn or barley ground by single mudden at the Company's water mills, should also provide themselves with a similar note from the Burgher Councillors; for the granting of which notes the aforementioned Burgher Councillors requested Your Right Honorable and Worshipful Council's authorization: that further it might be approved by Your Right Honorable and Worshipful Council to establish certain penalties, appropriate and suitable to the nature of the matters, against the violators of the prohibition, as well for those who, without having obtained a note from the Burgher Councillors, shall have had their corn or barley ground at mills other than the Colony's compulsory mills, as for such private persons who, without such consent note, shall have ground any grains at their mills: and that finally, reflection having occurred among the Burgher Councillors on how some of these Cape inhabitants, among whom are even privileged bread bakers, had horse-mills or hand-mills on which their corn was ground; that this must also be considered a notable infringement upon the privileges of the compulsory mills and as a principal means also of disadvantaging the respective leaseholders of those mills; and that, given the proximity of the other mills in case of need, the necessity of those horse-mills or hand-mills could not be found, they the Burgher Councillors therefore, on good foundation, believed that having and keeping such horse-mills and hand-mills in the houses and gardens located in this Cape District could rightfully be prohibited to everyone without distinction. that lastly the unreasonable and

and arbitrary conduct of the majority of the privileged bread bakers concerning what was set forth in the petition of the Burgher Councillors, the Burgher Councillors found themselves obliged to bring this to the attention of Your Right Honorable and Worshipful Honors, wherein it must further be remarked that, since none of these privileged bread bakers held an ordinary Baking Ordinance in the past year, this had primarily served as an exception and an excuse for them in their aforesaid unlawful conduct; that therefore, for these reasons and others cited in the petition, the Burgher Councillors persisted in their proposal, namely, to oblige the bakers to place above the front door of their houses in which they keep baking businesses a sign board or other token by which their privilege as bread bakers may be recognized; and that it might further please Your Right Honorable and Worshipful Honors, in granting the ordinary privilege to bake for this year, to subject the said bakers by the Ordinance thereof to all such other restrictions with penalties for violations as Your Right Honorable and Worshipful Honors, in order to curb the arbitrary conduct of these bakers, according to the weight and circumstances of the matter, in your higher and wiser judgment shall deem proper; it being also noted on this occasion by the Burgher Councillors that, since grain no longer needs to be purchased by the privileged bread bakers at such extraordinary prices as before, the principal reasons why the weight of the bread was reduced by the notice of 16 March of the preceding year have thus ceased, the Burgher Councillors therefore believed that the weight of the bread could again be set as before and on the old footing, namely, the two-stuiver white bread to 1 1/8 pounds, and the dubbeltje wheat bread to the weight of 3 pounds; and that likewise, in order that the inhabitants may be served better and more conveniently, the bakers might also be bound, instead of two hours as hitherto, to deliver bread to passing and coming customers four hours a day, namely, in the summer from five to seven o'clock in the morning and also at the same hours in the afternoon, and during the winter from seven to eight o'clock in the morning and from four to six o'clock in the afternoon; the undersigned take the liberty to propose all this to Your Right Honorable and Worshipful Honors, and believing thereby to have fulfilled the commission entrusted to them, let this serve as a respectful report. After reading of which report, and the Ordinance that last served for the respective privileged bread bakers having also been reviewed, it was approved to establish for the said bakers the following regulation, as: Article 1. That a baker at his dwelling house in this Table Valley, during the time that his baking Ordinance shall run, for the convenience of both the passing and coming customers as well as his daily patrons, shall be obliged to bake and sell good and wholesome bread. Article 2. That each baker shall be obliged to provide himself in good time with a sufficient quantity of grain, since no excuse of a shortage thereof shall be accepted, the bakers collectively remaining furthermore bound to such further Ordinances and Statutes as have already been issued or are yet to be issued here regarding the matter of bread baking; on pain that, when a baker stops or ceases his business within the stipulated time of his baking Ordinance without having obtained permission from this Government, he shall, in addition to the forfeiture of his privilege, incur a fine of one thousand Cape guilders, of which one third shall be for the informer, one third for the Burgher Treasury, and one third shall be enjoyed by the Officer. Article 3. That a baker shall be bound to deliver the dubbeltje white bread at one and one-eighth pounds, and the two-stuiver wheat bread at the weight of three pounds, the latter baked from good wheat flour as it comes ground from the mill, and the same must be marked with the customary mark in separate use by the bakers; and upon failure to put his mark on the bread, or giving less weight, the baker shall each time incur a fine of fifteen rixdollars, likewise to be divided one third for the informer, one third for the Burgher Treasury, and one third for the Fiscal, in addition to the forfeiture of the entire batch baked on that day.

Art. 4. That a baker shall be obliged, throughout the entire year, to deliver his baked bread in the morning from six to seven, and in the afternoon also at that same hour, as well as in the winter from seven to eight o'clock in the morning, and from four to five o'clock in the afternoon, on pain of forfeiture of Thien Rd:t for the benefit of the civic treasury. Art. 5. That, by renewal and amplification of the laws previously enacted, every baker remains enjoined and forbidden to have any corn or other grain milled, whether at the Honourable Company's or private mills, unless the Colony's compulsory mills, through some accident, defect, or inability, should be incapable of milling, in which case the bakers are respectively granted liberty to have their grains milled at such mill as shall best suit them. That neither shall any of the bakers be permitted to keep horse-mills or hand-mills in their houses, on penalty of Een duysend Caabse Guldens, to be divided as expressed in Art. 2. and 3. However, with this stipulation, that they must first have obtained a note signed by the acting Burgher Councillors, whereby liberty is granted to such private or Company's millers to mill the corn that shall be brought to those mills, on pain that both the bakers who, contrary to this, shall have had any corn milled elsewhere than at one of the Colony's compulsory mills, and those by whom it shall have been milled, shall each time forfeit a fine of Thien Ryxds for the benefit of the Colony's millers. Art. 6. That the privileged bread bakers alone shall be at liberty to bake and deliver ship's biscuit or hard bread, both to the Company's ships and to those of foreign nations, as well as to sell their wheat flour, provided that the same shall not be sold to the residents who happen to need it for use in their households for more than Two stuivers per pound, on forfeiture by the offenders of Thien Repedts for the civic treasury. Art. 7. That a bread baker shall also be required to hang out a sign or board above the door of his house, as a token that the trade is carried on therein by them as privileged bread bakers, on forfeiture by the negligent party, as often as he remains in default concerning this, of a fine of 25 Rds for the officer. Art. 8. And it is further agreed, that in order that the intended objective may be all the better fulfilled, so as in the future not to be subject to any cavillations with the aforementioned bakers; and to cut off their path, and further prevent them from traversing the aforesaid made arrangements upon frivolous pretexts, before dispatching the aforesaid draft of the Ordinances for the same, a copy thereof shall be delivered to the Burgher Councillors, together with a list of all persons who have applied to practice the baking trade, with orders to summon the aforesaid before them, and to read the said document clearly to them, to the end that they shall not subsequently be able to claim ignorance in that regard, as well as to inform them thereby that whichever of them will not submit to the prompt observance of the aforesaid regulations, shall not obtain the privilege of baking and selling bread; after the performance of all which, a proper report shall be made to the Governor. While it has furthermore been thought fit that of the notes which shall be granted by the Burgher Councillors, both to the bakers and other persons, to be allowed to have their corn milled at the Honourable Company's and other mills under the circumstances mentioned hereinbefore, a record shall be delivered every two months to the Independent Fiscal, in order to be able properly to verify which persons have acted pursuant to the obtained license regarding the milling of their corn. Just as, pursuant to the proposal made in the aforesaid report concerning this, it is resolved that, in view of the damage residing herein for the millers of the respective compulsory mills, it shall also be enjoined and forbidden, by publication and posting of notices, to all other persons residing here at the Cape as well as in the surrounding gardens, to keep horse-mills or hand-mills in their houses, on penalty of a fine of Een duysend guldens Indian valuation, of which One third shall be enjoyed for the benefit of the civic treasury, One third for the informer, and One third for the Fiscal. Right Honorable, Highly Esteemed Sir and Honorable Gentlemen! The undersigned Sea Captain and Master of Equipage of this Government, Justinus van Gennep, having been handed the written report submitted to your Right Honorable, Highly Esteemed Sir and Honorable Council by the skipper of the return ship 't Huys te Spyk returned here from Mauritius, Christiaan van Veerden, together with his mates, concerning the present condition of that vessel, and how it was found during the voyage hither with regard to the repairs made to it at the aforesaid island, together with an extract from the honored resolution of December 7 last adopted thereon by your Right Honorable, Highly Esteemed Sir and Honorable Council, whereby the undersigned was instructed, alongside other knowledgeable persons to be taken by him, to examine the said report, and thereupon to provide advice as to whether the aforesaid ship 't Huys te Spyk may safely be given a cargo, either of wheat or wines, and be dispatched therewith to the Indies, in order subsequently to serve there with usefulness and advantage for the Honorable Company. Therefore, in pursuance thereof, the undersigned Master of Equipage, after having first examined the aforementioned report of the officers of the ship 't Huys te Spyk with the undersigned fellow captains of the Company's ships present, Constantia, d'Eenparigheit, and Castor, Adriaan Catersfeld, Pieter Johan Muller, and Matthys Lodewyk Hycoop, subsequently alongside the same three captains, assisted by the master shipwright of the Honorable Company's shipyard here, Meyndert van Eijk, in the presence and before the aforesaid skipper Christiaan van Veerden and the chief carpenter of the aforesaid ship 't Huys te Spyk, inspected and examined the same in its entirety in the most accurate manner, as to the condition in which that vessel presently finds itself, and regarding which the joint undersigned thus have the honor to report to your Right Honorable, Highly Esteemed Sir and Honorable Council the following: That, upon examination of the aforesaid ship 't Huys te Spyk, the upper and tween decks were found to be water-soaked in many places to such an extent that, if one were to load that ship with wheat or anything else to which any leakage or water ingress could cause damage and spoilage, the upper deck would then first and foremost have to be entirely removed and laid with a new deck, and the tween deck would likewise largely need to be renewed, on all of which very extensive repairs would therefore have to be expended. However, if that vessel were to be laden with nothing other than wines in casks, to which water ingress can cause no damage or harm, the necessary repairs to the ship could then be effected by placing some planks in the decks in the seams of the waterways, driving battens against the sides along the entire tween deck, thoroughly caulking the ship further throughout, and making some minor repairs to it, whereupon the aforementioned ship 't Huys te Spyk, according to the opinion of the undersigned, will be able with complete safety to take in and transport a cargo of wine for the Indies, where that vessel afterwards can still be employed for several years in the internal navigation and trade for the Honorable Company. From the contents of which report, it being apparent that the said vessel has not been found in a condition to be dispatched to the Indies with a cargo of wheat, but on the other hand, without heavy repairs, can be laden with wines or other goods, Trusting hereby to have complied with the honored intention of your Right Honorable, Highly Esteemed Sir and Honorable Council, the undersigned let this serve as a humble report. to which the specified repairs should be made, and that this vessel, laden with wines etc., would depart for the Indies, and that it could be offloaded with goods to which no damage can be done by water, it was resolved to allow the repairs specified for that purpose to be carried out on the said ship Het Huys te Spyk, and subsequently to allow that vessel to depart for the Indies, either laden with wines or for such other purposes as may serve the benefit of the Honorable Company. And whereas it appears from the customary list of vessels belonging to this government, now submitted by the Secunde, Mr. Pieter Hacker, and the condition in which they are found according to the report of the aforementioned Equipagiemeester, that the frigate Jagtrust, on account of its weak condition, required a major repair and for that purpose necessarily needed to be sent to the Fatherland, as it would otherwise within 3 to 4 years become unable to navigate these coasts during the winter season; it has therefore been judged best and accordingly resolved to commission the said Equipagiemeester van Gennep together with two skippers of such of the Company ships lying at the roadstead, in order, assisted by the Master of the shipwrights of the Company yard here, Meyndert van Eyk, as well as in the presence of the skipper Cornelis Andriesen and the shipwrights of the aforementioned frigate Jagtrust, after a careful inspection thereof, to state in detail what the defects of that vessel consist of, and the reasons why the repairs to be made to it will have to take place in the Fatherland, so that upon receipt of such a report, such a resolution concerning the aforementioned frigate may then be taken as shall be found to be in the best service of the Honorable Company. Subsequently, the burgher and General Leaseholder of the Cape Cool Wines, Jacobus Johannes van den Berg, presented the following petition: To the Right Honorable, Highly Esteemed Mr. Joachim van Plettenberg, Councillor Extraordinary of the Dutch Indies, as well as Governor of the Cape of Good Hope and its dependencies, etc. etc. etc., together with the Honorable and Esteemed Council of Policy of this government. Right Honorable, Highly Esteemed, and Esteemed Sirs, Right Honorable Esteemed Sirs! With all submission and due respect, your Right Honorable and Esteemed Honors humble servant, the wine merchant and general leaseholder of the Cape Cool Wines, Jacobus Johannes van den Berg, makes known that upon the complaints submitted by him concerning many disorders occurring under the general lease, among others regarding those lodged against the brewer and the excise collector of the Cape malt beers, the Burgher Captain Lieutenant Dirk Gysbert van Rheenen, a convention was arranged between them by your Right Honorable and Esteemed Honors commissioned gentlemen, which was approved and confirmed by your Right Honorable and Esteemed Honors on the 17th of the past month of December, it being stipulated: that the leaseholder of the Cape malt beer shall be permitted, with or without a sign or signboard, to sell by the drink and tap the beers from the Cape brewery in three houses, to be specified by him, in the same manner as has been granted to any other leaseholder or tapster; while the brewer of the Cape malt beer shall be permitted, pursuant to the contents of his lease conditions, to sell his beers to anyone without distinction by large or small measure, yet without those who make a living by retailing those beers having the freedom to seat drinking parties, much less to hold music or so-called entertainment houses. Although the undersigned flattered himself that he had satisfied the objective of your Right Honorable and Esteemed Honors to prevent all further disputes, disorders, and complaints without harming the interest of the Honorable Company by this concession, he now sees himself, to his greatest regret and grief, deceived in his hope: Yes, Right Honorable, Highly Esteemed, and Esteemed Sirs, this Van Reenen, who, pursuant to the convention, has specified his three houses to the Right Honorable Esteemed Independent Fiscal, consisting of those of Hendrik Benkes, Barend Barendse, and Hendrik Bruyns, and should be content therewith, continues, notwithstanding the aforementioned convention, to have beer retailed and tapped in almost all taverns belonging to the general lease, whereby in the most natural way the condition of the petitioner, instead of being improved, has been worsened. To the Right Honourable, Valiant, and Worshipful Lord, Mr. Joachim van Plettenberg, Councillor Extraordinary of the Netherlands Indies, as well as Governor and Director of the Cape of Good Hope and the jurisdiction thereof, etc., etc., together with the Worshipful Council of Policy. Shows with the deepest respect and submission, Right Honourable, Valiant, and Worshipful Lords! For although every inhabitant is permitted to retail beer by small and large measure, it is also strictly forbidden to each and every person, outside the permitted houses, to keep drinking parties therewith, and even less music and gambling houses, which belongs solely to the general leaseholder to establish such houses, as many as he shall think fit for the advancement of his trade. And the petitioner, believing that all laws and ordinances must ordinarily be understood literally and interpreted according to the nature of the matter, also believes that in the most natural way no houses where drinking parties are kept in any way, or games are played, whether on a billiard or kolf course, with cards or music, etc., may be exempted, and no distinction can be made whether beer is tapped by bottles or glasses, for a schelling or a dubbeltje, which fully agrees with the lease ordinance of the general leaseholder of cool wines and especially with the general placaat of the year 1740, but furthermore, in order to prevent all smugglers, it is forbidden by the same to keep coffeehouses, and thus the permission to tap and keep gaming houses, under whatever name it may be, may not be granted otherwise than on the condition of selling no other drink than from the general wine leaseholder. When now the petitioner has suffered the most sensitive harm through such unlawful dealings and continual spiteful opposition of the aforementioned brewer from the beginning of his lease, and this brewer seems with wantonness and intent to continue, in prejudice of the law, to inflict still harder blows upon the petitioner, and even to bring the wine lease to a collapse, to an irreparable loss for the Honourable Company and the inhabitants; then it will be all the more forgivable to the petitioner that he repeats his complaints and very well-founded grievances to your Right Honourable, Valiant, and Worshipful Honours, humbly adding that under such infringements already nearly half of his lease term has passed, and having collected scarcely one-third of the lease monies, half of it must be paid off with the coming month; and thus the petitioner, upon continuation, would have to face his complete ruin. Yet the petitioner, hoping for the lawful protection of your Right Honourable, Valiant, and Worshipful Honours, and consoling himself with your highly favourable maintenance and speediest assistance, most humbly requests and beseeches: That it may graciously please your Right Honourable, Valiant, and Worshipful Honours, for the reasons presented, once again to annul and cancel the convention made between the petitioner and the often-mentioned brewer and excise master of Cape malt beer, and to direct the said brewer to conduct himself strictly according to the existing placaats and the lease conditions grounded thereon, and in no way to cause harm to the general leaseholder of Cape cool wines, as well as most favourably to order that in terms of the lease ordinances and placaats, outside the houses belonging to each leaseholder, all innkeepers or inhabitants keeping gaming houses, billiard, kolf, and skittle alleys, or music and dancing parties, as belonging to the general wine lease, under the penalties enacted and sanctioned against smugglers, shall not be permitted to retail or sell any drink other than from the general leaseholder of Cape cool wines, or such as your Right Honourable, Valiant, and Worshipful Honours shall find to be proper according to the justice and equity of the placaats and laws. To the Right Honorable and Most Respected Gentlemen, the very humble servant Jacobus Johannes Van den Berg shows that, as General Farmer of the Cape light wines, in order to tap wine for the Meuron regiment, he granted wine tapping licenses to certain persons, but has very often had to experience that, contrary to the verbal and written assurances given to the Chief and Major of the said regiment, all kinds of smuggling occurred, because of which, and on account of the many complaints that the petitioner had to make about it, at least in vain, the petitioner was finally prompted to withdraw the tapping license from the said persons and to refuse to supply them with wine in the future. However, just as they previously managed to receive wine from other wine sellers despite the laws prohibiting it, they now continue without permission or authority to tap wine daily, such that two, three, indeed four and five half-aams of wine are brought to them daily, whereby the petitioner is harmed and prejudiced to the utmost, finding himself deceived in one way or another, and seeing existing laws rendered without effect. The petitioner therefore turns to Your Right Honorable and Most Respected, highly and most humbly requesting and beseeching: That it may please Your Right Honorable and Most Respected, out of your high favor, to prohibit and forbid any and everyone of the Meuron regiment from retailing and tapping any liquor, under the penalties determined against smugglers, or to make such orders in this regard out of your high favor as Your Right Honorable and Most Respected shall deem appropriate according to the nature of the matter. The weight and price having been restored to bread as before. being caught, over and above the confiscation of the traded flour or biscuit for the benefit of the Honourable Company, shall furthermore incur a fine of Fifty Rixdollars each time, for the benefit of the fiscal. Just as, by renewal of the laws previously enacted against this, it shall likewise most strictly be prohibited that anyone shall sell, barter, or trade any wheat, rye, or barley in any manner whatsoever to the crews of ships passing here, from which, however, remains excepted such moderate quantity of barley as shall be needed on the aforesaid ships for feed for the large livestock, sheep, and poultry taken from here, the shipment of which may likewise not take place except with the special consent and written permission of the Governor, upon penalty that all such grains shall also be confiscated for the benefit of the Honourable Company, and the offenders shall not only without leniency incur a fine of One Thousand Cape guilders, to be divided one third for the officer, one third for the informer, and one third for the Council Chamber, but besides this shall also be sent from here to the Fatherland as useless and harmful subjects. Shows with due respect to Your Most Noble and Honorable worships, your humble servant the shipmaster Christiaan van Veerden: how he, the petitioner, in the aforementioned capacity as shipmaster, is in command of the ship 't Huys te Spyk currently present here, wherewith he arrived at this place from Ceylon in return to the Netherlands in the year 1781:— that because of the late war that arose between the Crown of England and Our State, the petitioner's vessel under his command, along with several other return ships of that year, having been detained here, the said ship 't Huys te Spyk, subsequently after the discharge of the cargo here in the past year 1784, was also employed for the transport, to the Island of Mauritius, of the French troops of the regiment of Pondicherry who had been garrisoned here: Most Noble and Honorable Sir and Honorable Gentlemen! that he, the petitioner, having returned to this place with the said ship 't Huys te Spyk after a prosperous voyage, Your Most Noble and Honorable worships, upon the declaration made by him, the petitioner, and his ship's officers concerning the condition in which they had found that ship on the voyage hither, were pleased to see fit to have the same inspected and examined by expressly commissioned seamen: whereupon it being found that the aforementioned ship 't Huys te Spyk, without an entirely new and very costly repair, could only serve for the transport of a cargo to which no damage could be brought by leakage and waterlogging, it was thereupon resolved by Your Most Noble and Honorable worships to employ that vessel for the conveyance of a cargo of wine to the Indies.— Since now, by such a long stay at this place, the petitioner's private affairs and interests have had to undergo very great derangement, it would be to the considerable disadvantage of him, the petitioner, if he saw himself forced to make the voyage to India with the aforementioned ship 't Huys te Spyk; so it is that, for those reasons, he takes the liberty of turning to Your Most Noble and Honorable worships, with a humble request favorably to excuse him, the petitioner, from that voyage, and to discharge him from the command of that vessel, with permission to remain for some time at this place with the suspension of his salary.— /:Below stood:/ Doing which etc. /:was signed:/ C. It having pleased Your Most Noble and Honorable worships to have delivered into the hands of the undersigned, former second chief surgeon of this Government, Your Most Noble and Honorable worships' very humble servant, a resolution of the Council of Policy dated 21 December 1784, founded upon the venerated letter of our Lords Superiors, concerning a certain eight thousand rixdollars, which, according to the statement of Mr. Abraham Douglas, his nephew the former Merchant at Batavia Abraham Douglas or Donglas, would still be in the hands of the presenter, as his attorney, with orders to provide Your Most Noble and Honorable worships with a report thereon. The undersigned therefore has the honor to state that, when during his last stay in the Fatherland he accidentally became acquainted with the said Abraham Douglas, the latter, upon his departure hither, had charged him, the undersigned, by power of attorney, to demand, receive, and remit to the Fatherland such 8000 rixdollars as he, Douglas, had standing with the former Merchant of the Honorable Company residing here, the Honorable Johannes van Echten, which the undersigned had undertaken to do; and as the undersigned, upon his arrival here, had indeed addressed the aforementioned Sr. Van Echten for the payment thereof, he received the answer, however, that those funds had been placed under arrest by the government, and he therefore could not release the same, of which answer the undersigned had given notice to the said Donglas by letter. Whereupon it was resolved to place the same in the hands of the Landdrost and Heemraden of Stellenbosch and Drakenstein, so that, having properly examined the said petition, they may subsequently report whether the requests made therein by the petitioner will in fact not prejudice other inhabitants, and can thus suitably be granted to him. The newly arrived and above-mentioned Governor van de Graaff, who, together with his family, arrived here the day before yesterday in perfect health on the ship Voorschooten, was introduced today into this Council by Governor van Plettenberg. Thereupon, having been most kindly complimented by the same outgoing Governor and very respectfully by the respective Members of the Council, and this being answered by His Honour in the most obliging terms, His Honour took his seat on the left side of the repeatedly mentioned Mr. van Plettenberg. By whom it was subsequently made known that, through the commissions dispatched by His Honour, the inventorying of the Honorable Company's effects was already so far advanced that the general inventory would be ready within a few days, in order to properly hand over the Government to his successor at the next meeting, for which a special meeting would be convened by His Honour. Proceeding then to the disposal of the business at hand, the said Mr. van Plettenberg initially submitted a letter written to His Honour under date of the 20th of this month by the Colonel of the Legion of Luxemburg, garrisoned at Ceylon, the Knight d'Hugonet, who arrived here on the ship 't Lam, which letter read as follows: The 20th of January, 1785. Monsieur le Baron, After the certain proofs that you must have that sailors and soldiers under all powers are always disunited, and that they are much more so when they are not of the same nation, or especially when they do not speak the same language; from this certainty, Monsieur le Baron, I believe that it would be very appropriate, and that the good of the service requires, that the same vessel which brought us here should take us to Ceylon, although its destination is for Batavia. Thereby you will perhaps avoid the loss of a very large number of men, who, now being accustomed to one another and to the officers with whom they have to deal, will no longer dare attempt sedition, as happened with the sailors supported by their boatswain against my soldiers. A new acquaintance between these two classes of men cannot take place without some trouble, whereas it is clear that there will be none if the same persons travel together. The captain of the vessel has earned not only the affection of the officers, but also that of the soldiers generally, who have obeyed him and will obey him in all circumstances with pleasure, just as they obey me, because what I have ordered them must be a very sufficient proof of the union that will reign from here until our arrival at Ceylon, a matter very desirable for the tranquility of everyone. As there will be due at the end of this month three months of pay both to the officers and to the soldiers, I beg you to be so good as to give an order for payment to be made to me, this being necessary to provide for their urgent needs. Proposing to take back with me two officers who had submitted their resignation, and my intention being to preserve their posts for them, I further beg you to have the goodness to give orders to pay them the salaries that may be due to them, as they ought to be regarded as still belonging to the corps, since there are more vacancies than necessary to replace them. This is something I can assure you of according to the statement of the condition of the regiment given to me by Mr. le Flerc, who styled himself Lieutenant Colonel of the corps. of the present ships Castor and Middelwyk, Matthys Lodewyk Hycoop and Cornelis de Clercq, with assistance and in the presence, as dictated by the order here above, examined in the most accurate manner the present state and condition of the aforesaid frigate Jagtrust, and upon inspection conducted found: that the ship in several places, principally along the keel, near the stem and sternpost, has been gnawed through the sheathing into the solid timber by the worm, which, in general, in this Table Valley and here at the Cape roads grows very quickly and heavily: that on various voyages, which have already been made with the aforementioned frigate over the course of 8 years, and especially now in the past year, when it served for the transport of the cargo of the fluyt Vreede en Vryheid from False Bay to here, which largely consisted of heavy timbers, through the heavy working of the ship, the butt and seam joints have mostly all parted from one another, in such a manner that they, at the least violent movement of the ship, open and close, which must as much as possible be made tight with continuous caulking and graving, to which, however, proper attention cannot always be given, on account of the lack of shipwrights, whose number at the Honorable Company's yard is very small and barely sufficient to keep the work going for the departing and arriving, principally the return ships of the Honorable Company: that furthermore the riders forward and aft in the hold, mostly all of them, and the ceiling throughout the entire hold, are decayed and rotted in several places. All of which defects happen to be of such importance that they require a most necessary repair, without which the said ship Jagtrust will otherwise inevitably end up, within 3 to 4 years' time in this harbor and climate, in such a condition that it can no longer be employed with any confidence for the usual voyages here, much less then be sent to Europe for refitting. Now the reasons and causes that occurred to the undersigned why the aforesaid stated, most necessary repairs to the aforementioned frigate Jagtrust cannot well take place here, consist in this: That of the timber required for it, the principal parts are not on hand at all, and other parts only in a very small supply: that besides this one must also assume as a certain consequence that upon opening up the ship various other defects will yet be discovered, for which the absolute necessities for repair would be lacking: that in order to carry out those necessary repairs properly and as it should be, the ship would absolutely need to be careened, which however cannot possibly be done in this Table Bay, owing to the volatility of weather and wind in these roads, where, throughout the entire summer monsoon, one is not safe for a single day from the fierce south-easterly winds, for which reasons one would also not dare, with any peace of mind or the least confidence, to remove the timbers from the ship's solid hull in order to place others back into it, and it remains besides an all too certain impossibility that during a strong incoming south-easter another ship needed for the careening of the frigate Jagtrust could be kept alongside it: that it is true that the situation of Saldanha Bay is very suitable for repairing and careening ships, but regarding this in the case of the frigate Jagtrust the undersigned must take the liberty to remark: that for the careening of the same, another vessel is absolutely and necessarily required, which one does not have at hand, however, and for which there would then be no other means than to detain another capable ship of the Honorable Company here for the careening of Jagtrust, which however the undersigned, subject to wiser correction, believe would not correspond very well with the true interests, the more so because the refitting of the frigate Jagtrust, once it is assumed that one were provided with everything necessary for it, would require a very considerable time owing to the shortage of the shipwrights required for it, from which would then further arise this unavoidable inconvenience, that the outbound and homebound ships, all of which require repairs more or less, would have to remain without the assistance of the workmen during all that time; or that one would otherwise be compelled, upon the arrival of every ship here in the roads or in False Bay, to summon from Saldanha Bay those same shipwrights who would then be employed there on the work on Jagtrust, which in any case would only

Notification having been given by the Junior Merchant and Trade Transferor Casparus van Eerten that the quantity of 19000 lb. of butter had been purchased by him for the Honorable Company, which he had not been able to obtain for less than 6 to 8 stuyvers per pound, as also that he had been obliged to pay 4 stuyvers per pound for the carwaat purchased on behalf of the return ships, with the added urgent request that, since through the spillage occurring during the weighing in and out, as well as the repacking of the butter, he could not deliver this dairy product, any less than the aforesaid dried fish, back to the Honorable Company at those same prices without important loss to himself, this Council might therefore favorably please to accommodate him in this matter; it is understood, both for the aforesaid butter already purchased and for that which is yet to be purchased on behalf of the Honorable Company, over and above 5 per cent spillage, to have paid to the mentioned Junior Merchant van Eerten nine stuyvers per pound, as well as the carwaat at five stuyvers per pound. And since among other things it was brought to attention that by the Chamber of Zeeland, per the repeatedly mentioned ship 't Lam, 60 barrels of beer were sent out for this government, of which some were sour, empty, and some, though not spoiled, were nevertheless not distributable, and the remainder, except four barrels from the brewery De Fles, of which the fifth barrel, being barely half full, was used to top up the others, were so thin that one would have to leave that beer lying until next year, and that unfilled, since the rations of this current year had already been distributed to the servants up to the ultimate of August, and because being brought from different breweries, it cannot well be topped up and thus kept from spoiling; it has therefore been necessary to resolve to have the barrels of the repeatedly mentioned beer sold by public auction, and to have the money proceeding therefrom entered into the trade books of this government, as well as to give notice of all this to the Noble Lord Directors of the above-mentioned Chamber of Zeeland. Permission granted to Skipper Cornelis Andriese to depart for the Fatherland with his wife and daughter. Grant of some lands in ownership. Whither the burgher Franciscus van Heerden will likewise cross over. The skipper of the hereinbefore mentioned frigate ship Jagt Rust, Cornelis Andriese, having made a request by petition that, in case it was resolved by this Council to let him depart for the Fatherland with the vessel under his command, permission might then be granted to him to take along his wife Anna Trowyn and little daughter named Catharina Andriese; it is understood to grant the aforementioned request to the petitioner as of now. As likewise to the burgher Franciscus van Heerden, also making a request in scriptis for this, it is permitted to depart for the Netherlands with the Dutch private ship De Jonge Franc presently here. Pursuant to and in compliance with the esteemed resolution taken by your Right Honorable and Honorable Council on the 25th of the past month of January, whereby the undersigned Equipment Master was instructed, together with the skipper of the present return ship Roosenburg, Gerrit Bruyn, and that of the permanent frigate yacht Rust, Cornelis Andriesse, as well as in the presence of the skipper of the outward-bound ship 't Lam, Bartholomeus Veau, to provide a report on what time difference it would make in the present season in the voyage of the same ship 't Lam, whether sailing directly from here to Batavia, or via Ceylon thither, and at the same time to indicate at which of the Company's establishments on the said island the recruits currently on board the aforesaid ship 't Lam and belonging to the Regiment of Luxembourg should, in the aforementioned case, be disembarked, the undersigned have the honor to inform your Right Honorable and Honorable Council in this regard: That the aforementioned ship 't Lam, departing from here in this month of February or upcoming March for the island of Ceylon, in order to sail from there to Batavia, would, in an ordinary voyage without any other accidents and hindrances along the usual route to the islands of St. Paul and Amsterdam, make a difference of three months longer than the voyage directly from here to Batavia. — That if, however, this vessel were detained here until the last day of April, after which time it could take the route through the Mozambique Channel, in such case the difference in a voyage would only be two months longer, as that route is much shorter than the ordinary one. — That nevertheless, in both cases, whether the aforesaid ship 't Lam departs from here in February, March, or the last day of April, it always remains certain that this vessel will have to call at Tuticorin or Trincomalee to disembark the troops on board at one of those places, since, according to orders, the Colombo roads may not be approached before the last day of August. — That, while it is true that the Bay of Point de Galle can serve as a safe anchorage for ships in all seasons of the year, it is very uncertain during the west monsoon to be able to make that bay, since in that monsoon ships run a daily risk of being carried south of it by the strong currents running to the north, and once having fallen south of it during that monsoon, it is impossible for a Company ship to...

The undersigned are therefore of the opinion that, if your Right Honorable and Honorable Sirs should think fit to let the ship 't Lam make the voyage to Ceylon, whether in the months of February or March, or after the end of April, it remains certain in both cases that the troops will need to be disembarked, either at Tutecoryn or Trinconomale. If wishing to touch at this last place, the ship's officers could always first and beforehand try whether there were opportunity and means to enter the Bay of Punto Gale without danger; but, in which case, those officers should be very expressly and strictly instructed to take care not to keep too far north of Punto Gale, too close inshore on the Island of Ceylon, and thereby run no danger of being embayed upon the same. The undersigned, hoping to have complied with the honored intention of your Right Honorable and Honorable Sirs, let this serve as a humble report. Thus, in consideration that besides the excessive delay that would be caused to the voyage of the mentioned ship 't Lam, in case that vessel were dispatched to Batavia via Ceylon, the same would also be exposed to no small adverse accidents, such as are detailed at large in the aforesaid report, it has therefore been judged most advisable, and consequently resolved, not to accede to the request made by Colonel d'Hugonet in his letter of the 25th of January last, tending to be transported, together with the recruits for the Legion of Luxembourg in his charge, to Ceylon with the repeatedly mentioned ship 't Lam, but in this respect to await the arrival here of the outward-bound ships destined directly for Ceylon, which are daily expected, in order to let the said Mr. d'Hugonet continue his voyage to the said island with one of those vessels, and to distribute the repeatedly mentioned recruits among the aforesaid ships destined thither in such manner as the circumstances of matters and the greatest service of the Honorable Company shall come to require; the frequently mentioned ship 't Lam shall consequently also be dispatched to Batavia as soon as possible. And regarding the fact that the minister Philippus Kuys, who served the congregation at Stellenbosch, has passed away in these days, it has therefore been resolved to give the required notice thereof in the first outgoing dispatch of this Government to the High and Mighty Lords Masters, with an added request to send out again by the first suitable opportunity another preacher for the service of this Government; while furthermore, in order that the divine service at Stellenbosch may not in the meantime come to a standstill, the Reverend Minister at Drakensteyn, Robbert Nicolaas Alingh, shall be written to, to go preach at Stellenbosch once every month and distribute the holy seals of the covenant there at the customary times, of which arrangement the Stellenbosch Church Council shall also be given the necessary notice by letter. were sent for the Honorable Company have been sold successively without having been able directly to fathom to what to attribute that great difference, while they themselves are assured, just as they also can solemnly continue to assure your Right Honorable Valiant and Honorable Worships, that they always come to select and send their best wines, and as much as is ever possible, from one and the same for the Honorable Company; but having come into experience that those wines, brought into the Fatherland and laid down in the Honorable Company's wine cellar, the casks are broached, the ullage found being filled up, and are broached again on the sale day to let the buyers taste thereof, the petitioners believe they have found a well-founded cause whereby it may have happened that one cask comes to differ so much in quality and aroma from the other, since experience both here and elsewhere teaches that most similar wines must above all be preserved from the air, since otherwise, if not spoiling altogether, they nevertheless come to lose much of their aroma and muscat flavor: the petitioners therefore, as much to preserve as far as possible the renown of those wines so wanted everywhere, as above all for the interest of the Honorable Company and of themselves, who otherwise come to suffer not a little, take the most humble liberty to turn to your Right Honorable Valiant and Honorable Worships, with the most respectful request that it may be your supreme pleasure to bring these various matters to the attention of their High Nobilities the Lord Masters, and to request that henceforth the Constantia wines, being brought to the respective Chambers, may remain lying until the day of the sale, and thus, after tasting has taken place, be offered for sale; and in order, as far as possible, to prevent that prematurely, during the voyage, through any bad insects or other accidents, any leakage be caused to the cooperage, the same further most urgently request your Right Honorable Valiant and Honorable Worships that henceforth all the aams with Constantia wine being sent to the Fatherland may be packed in well-nailed cases manufactured for that purpose, in order to remain therein until the sale day; the petitioners at the same time seize this opportunity to make most humbly known to your Right Honorable Valiant and Honorable Worships how they, notwithstanding the favorable disposition of the Lords Majores of the year 1764, whereby there was allotted to them 10 per cent of the sale of their wines that had yielded above a capital advance, nevertheless have now already for a long time remained deprived thereof, since of all the wines sent from here since the year 1780 no returns have been sent over hither, other than only of those which have been consigned per the ships Holland and Alkemade to the Chamber Amsterdam, and per Hinloopen to the Chamber Rotterdam; wherefore they take the liberty to request your Right Honorable Valiant and Honorable Worships in the most respectful manner for your gracious letter of recommendation to the aforementioned their Right Honorable High Worships; to the end that the petitioners may receive from all the respective Chambers the profit accounts of the Constantia wines sold by the same, and they thus enjoy the highly favorable arrangement made in their favor.
