very probable circumstances, that he, Arij, thereafter, being asked at the 16th article of the same interrogation in what manner and with what that murder was alleged to have been committed, having testified that he would confess the truth, said: that he had never murdered any human being, but that this had only been said by him and his mate Adam to their master in order to depart from the world, and on article 21, that he, the prisoner, also would rather die than return again to his master, bringing forward as reasons for this on article 22 that his master had shackled him, the prisoner, to his mate Adam with a ship's chain and had made them work in such a manner, just as the same, according to the answer to article 16, while punishing them, had even had them attacked by the dogs and caused the clothes to be torn from their bodies; that the prisoner Adam, however, immediately at his interrogation confessed to having agreed with his fellow prisoner Arij, on account of mistreatment inflicted upon them by their aforesaid master Malan, that they would pretend to have committed a murder in order to be freed by that means from the same, their master, as will further appear to your Honorable Worships from the documents produced herewith; that the representer in his capacity, having considered this and that, has deemed, subject to respectful correction, it most advisable for the Landdrost to bring the entire case with all its circumstances before the eyes of your Honorable Worships, to the end that such a resolution might be taken by your Honorable Worships whereby on the one hand it might be prevented that those who might be found entirely and utterly innocent should be tormented with no lengthy imprisonment, while on the other hand the prisoners' master David Malan might not remain deprived of properly defending himself in this matter. Which doing, etc. Was signed: H. L. Bletterman, sworn clerk. In the margin: Exhibited in the Court on 16 July 1785. After the reading of which, and having deliberated upon its tenor, the following resolution was passed: The Council, before deciding upon this, orders the Landdrost to hear the burgher David Malan before Honorable committee members from this Council regarding the charges brought against him, and subsequently to provide this Council with further information. Lastly, it was verbally reported by the said clerk in his aforesaid capacity that here in the Company's gaol had passed away the Hottentot Dikkop, who had shot dead the Hottentot Danser on the order of the farmer Jan Visser; while the same Bletterman also, in the name of the Landdrost of Swellendam, the Honorable Constant van Nuld Onkruijd, came to notify the Council of the Hottentot Christoffel Beestou, who also passed away a few days ago, and who was said to be guilty of the murder committed in the year 1781 against a certain Pieterse.

Thursday the 30th of June 1785. 62. In the forenoon, present the Honorable Pieter Hacker, President, and all the members, except for the merchant Mr. Oloff Marthini Bergh due to indisposition, with the burgher councillors, the Honorable Johannes Smuts and Jan Coenraad Gie, being assumed. It was made known in the council by the acting interim fiscal of this government, Pieter Gerard Exter, that the goods seized from the slaves Gree, Cun, and associates, who were criminally prosecuted and subsequently executed by the late Independent Fiscal Mr. Jan Jacob Serrurier, were still under the sequestration of this Council; and that various persons had come forward to whom some of these items belonged, while some goods that were stolen from Monsieur de Bonnaire, residing here, also had to be returned. Therefore, the aforementioned acting interim fiscal requested that it might please this Council to take such a resolution in this regard as Their Honors might deem fit, at the same time proposing the opinion of the late aforementioned fiscal that, after the return of those goods found among them that belong to various persons, the remainder be sold judicially, the costs and expenses of justice be paid from the proceeds thereof, and the surplus be divided, one half for the Council Chamber and the other half for the poor. Having deliberated on this proposal, the following decree was issued: The Council orders that after the return of such goods as belong to various persons following proper proof of ownership, the remainder shall be sold judicially, and the incurred expenses as well as the costs and expenses of justice must be paid from the proceeds generated therefrom, while regarding the monies that will remain as surplus, a further decision will subsequently be taken. After which, by the sworn clerk of this Council, being qualified ex officio to attend to the affairs on behalf of the Landdrost of Stellenbosch and Drakenstein, the petition below was exhibited, reading as follows: To the Honorable Pieter Hacker, President, together with the Honorable Council of Justice of this government. Honorable Sir and Gentlemen, Shows with deepest respect the undersigned, being qualified to attend to the affairs of the Junior Merchant and Landdrost of Stellenbosch and Drakenstein, Pieter Daniel van Reijneveld: That, it having pleased Your Honors in the latest meeting of Your Honors, upon the petition presented by the undersigned in the aforementioned capacity, to order the aforesaid Landdrost by a provisional proposition to interrogate the burgher David Malan, David's son, on such interrogatories as the said Landdrost might deem appropriate regarding the allegations brought against their master during their interrogation by the two slaves belonging to the aforementioned Malan, namely Arij of the Cape and Adam of Bengal, the same has also been heard in the presence of the Honorable Commissioners from this Honorable Council on last Monday, the 27th of this month.

that the undersigned, in order not to occupy the attention of your Honorable Worships unnecessarily, will take the liberty only to present the substantive content of what was brought forward by the said master in this matter; that he, Malan, when they had run away before their last desertion and were caught, had placed the prisoners in irons on the advice of a landdrost, as they continually plagued him, Malan, with their running away, and not upon their last capture; because both the said prisoners, after having worked for three days with the irons on their feet, had broken the irons and deserted again, and because they had pretended at their last capture to have committed a murder, he, Malan, had their hands shackled together and immediately transported them to Stellenbosch; further, that he, Malan, would gladly allow all his other slaves to be questioned as to whether they were mistreated by him, but that, on the contrary, he provided them with plenty of everything, and they received not a single blow undeservedly, but that these two slaves had run away continuously, and that the slave Arij had stayed at home for only three days in an entire year, and was therefore unaccustomed to work; that he, Malan, further had purchased the said African slave Arij at a public auction for the small sum of one hundred and one rixdollars and one schelling, because he was already known as a rogue; that he, Malan, finally made known to the honorable commissioners that if his two aforesaid slaves were found innocent of having committed a murder, he would indeed want to have them back, but because they were scoundrels, he requested that they might be punished, put in irons, and sold as such, in order to protect others from harm; that to the undersigned, from what has been cited above in contrast to what was declared by the imprisoned slaves Arij and Adam, it has appeared, subject to respectful correction, that the murder alleged by both the said prisoners is not so much suspected of being done to be rid of their said master Malan, but rather to be freed henceforth from all slavish labor, for which purpose they were nevertheless purchased by their master; and since he, Malan, then finally himself requests that, to avoid the one and prevent the other, both prisoners might be sold, the undersigned is of the opinion that this matter could be finalized without formal claim; wherefore the petitioner in his capacity takes the liberty of turning to your Honorable Worships with the humble request that both slaves mentioned herein, named Arij of the Cape and Adam of Bengal, may be sold publicly yet judicially for the benefit of their master, in such manner and under such conditions as your Honorable Worships, according to your enlightened judgment, shall find and deem appropriate; below stood: Which doing etc. was signed: H: L: Bletterman, in his capacity; in the margin: Exhibited in court the 30th of June 1785; which having been read and the representations set down therein taken into consideration, it was approved and understood to keep the same, together with the attached documents, under advisement for circulation; below stood: At the Cape of Good Hope, the day and year as above; lower:

Present: the Honorable Pieter Hacker, President, and all the members except the merchant Mr. Oloff Marthini Bergh and Mr. Olof Godlieb de Wet, both due to indisposition and occupation, as also the three Burgher Councillors. There was exhibited by the Fiscal pro interim, Gabriel Exter, the following representation, reading as follows: To the Right Honorable President and Council of Justice of the Castle of Good Hope. Right Honorable Gentlemen! Shows with due respect the undersigned Fiscal pro interim, Gabriel Exter, That on Thursday the 16th of June last, it was brought to the knowledge of the representation maker ex officio by the bondsman of the burgher living at the Tygerberg, Jan Andries Bam, named David of Mozambique, that one of his fellow slaves named Fortuyn of Bengal, who was accustomed to look after the horses of his aforementioned master, having run away because one of those horses had gone missing, was subsequently brought back home to his master by a certain Rossouw. That his master had the aforementioned Fortuyn tied up that same evening by two other slaves, subsequently had him beaten intermittently with pieces of rope, and left him lying thus bound the following night; and when the same Fortuyn was found unbound in the morning, his master had him tied up again in the manner aforesaid and beaten anew, as well as making him run immediately in front of the horses of a plow; that the consequence of this was that the said Fortuyn remained lying down the following day, and finally came to die on the ninth or tenth day after the received beatings, and was buried on the following day, or the 15th. That hereupon the Commissioned Gentlemen, having proceeded to the dwelling place of the said Bam, had the body of the same Fortuyn exhumed there and inspected in their Honors' presence by two surgeons from the Honorable Company's Hospital, whereupon the same was found to be such that not only did the marks thereof provide the clearest proof of an extraordinarily impermissible ill-treatment, but that through the cruelty of neglecting such a mistreated and tormented body, gangrene had set in, as appears from the inspection certificate annexed hereto and further inquests. That the representation maker ex officio, for the suppression of such prevailing crimes and for the maintenance of the laws urgent in that respect, considered it to be his indispensable duty to initiate the necessary proceedings in a criminal case against the same Jan Andries Bam. Since, however, Your Right Honors' authorization is required for this, the undersigned representation maker ex officio takes the liberty of turning to Your Right Honors, requesting a decree by virtue of which the representation maker ex officio may be qualified to summon the aforementioned Jan Andries Bam to appear in person before Your Right Honors on a certain appointed day, in order to hear such criminal claim and conclusion, or request or requests, as the plaintiff ex officio on the day of the hearing shall see fit to make and take upon and against the same Bam. Which having been read and its contents considered, his request to be permitted to summon the burgher Jan Andries Bam in person before this Council of Justice was granted. All present except the Honorable Burgher Councillors. The Fiscal pro interim of this Government, Gabriel Exter, plaintiff ex officio in a criminal case, on the one part, against the Sub-Lieutenant who was on the outward-bound Honorable East India Company's ship de Paarl, anchored in the False Bay, George Laurens Caroes, prisoner and defendant in the aforementioned case, on the other part. The plaintiff ex officio exhibits a written claim and conclusion, concluding thereby as at the end thereof, the said claim being furnished with six annexes. The defendant, having heard the claim read, says that he had no part in various accusations of the Captain, that the Captain had also reviled him and accused him of theft, and that he further requested a copy in order to be able to answer for himself in the Fatherland. The plaintiff ex officio persists in his claim and submitted evidence. The parties further renouncing any further productions. The Council, having considered the matter and doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, dismisses the defendant from office, rank, and salary; confiscating all his wages earned and accrued with the Honorable Company for the benefit of the Honorable Company, with condemnation in the costs; he shall furthermore be sent to the Fatherland on one of the first return ships departing from here, working for his food during the ship's service. The Prosecutor ex officio serves his claim and conclusion, as at the end of the claim. The prisoner and defendant having been heard thereon, persists in his confession. The parties, for reply and rejoinder persisting in what they have stated, renounce further productions, the Prosecutor ex officio requesting justice. The undersigned pro interim Fiscal, Gabriel Exter, represents with due respect that some weeks ago, there appeared before him a person calling himself Narcis of Mozambique, complaining that he was left behind at this place by his master, an English merchant named Kahman, who departed several months ago from this roadstead for Europe, in order to be able to return to Bengal on an available occasion. That he, Narcis, in the meantime and on the recommendation of his said master, had taken up his residence at the house of the private secretary, Mr. Fredrik Kirsten, where his master had lodged for some days, knowing nothing other than that he would be treated as a free person and sent back on an available occasion; but that he found himself greatly deceived, since he was not only mistreated by the said Kirsten in a slavish manner with beatings and otherwise, but was also threatened that he would be sold by him as a slave. That the repeatedly mentioned Narcis, upon further interrogation, made known to the representor that he was brought as a slave to Bengal by a French merchant named Cassie, whom he also served in that capacity until the latter's death at Ingeram, a place on the said coast, but that this, his master, prior to his death, had set him free according to the accompanying deed of manumission, which, because it was torn into pieces and almost illegible, the representor ex officio has the honor to submit both in the original and in copy. That he, Narcis, subsequently entered the service of the second governor, Mr. Heetsch, and upon the departure of the aforesaid Kahman, engaged himself to serve him on his journey to Europe for six rupees a month, and for that purpose had departed with him and arrived here. The sworn Clerk of this Council, Mr. Hendrik Lodewyk Bletterman, acting on behalf of the Plaintiff ex officio by virtue of the authorization granted to him, submits a written claim and conclusion with the documents pertaining thereto, against The Landdrost of the Colony of Swellendam, Mr. Constant van Nult Onkruijt, Plaintiff ex officio, against The burgher Cornet at Swellendam, Christiaan Andries Storm, summoned to hear such claim and conclusion as the Plaintiff ex officio shall make and take regarding the abuse committed by the defendant against the female slave Sophia of Bengal, to reply thereto, and further to proceed according to law. The burgher Pieter Hendrik van der Lith, appearing on behalf of the defendant by virtue of the power of attorney granted to him, requests a copy of the one and the other, in order to serve an answer thereon today four weeks hence. The Council grants the defendant the requested copy and a term of four weeks to serve an answer. Hereafter, by the same sworn Clerk in the name as above, the following representation was submitted, reading as follows: To the Right Honorable Pieter Hacker, President, together with the Honorable Council of Justice of this Government. The undersigned, Hendrik Lodewijk Bletterman, as being qualified to conduct the affairs of the Landdrost of Swellendam, Constant van Nult Onkruijt, represents with the greatest respect: That by the burgher Petrus Johannes du Plessis, 19 years of age, it has been reported to the aforesaid Landdrost that he, du Plessis, late in the month of May, on a certain day towards the evening, taking with him a musket loaded with shot, and having ridden out into the field in order to shoot some small birds, had met in his father's field a Hottentot with the cattle of the burgher Daniel Sienaar, to which Hottentot he, du Plessis, having substantially said that he had to go with the cattle into the pasture of his own master, that Hottentot, with a kirrie he held in his hands, struck at him, du Plessis, but hit not him, but indeed his horse in the neck; whereupon the same du Plessis had warned the aforesaid Hottentot that he should desist from doing so, while he saw that he had a musket in his hands; the same Hottentot, however, having cared little about that, on the contrary struck at him for the second time, so that he, in order not to be beaten to death by the Hottentot, had then cocked the hammer with the intention of shooting the Hottentot in the legs; but that by the jumping of his horse the shot had gone off, and he had hit the Hottentot in the chest in such a manner that, the same having fallen down, he had supposed that Hottentot to be dead as well, and thereupon returned home; and that since his father, who had gone elsewhere, had not yet returned home the next day, he had immediately proceeded to Swellendam and reported the incident in the manner aforesaid. The Prosecutor ex officio, having been heard on the contents thereof, advanced that since the Field Sergeant Gerrit Maritz had made known to his predecessor, both by word of mouth and by his report, that the Hottentots Danser, Gerrit, and Slat had accosted the aforesaid Johannes Hendrik Visser in the field on their return from Stellenbosch, and that this man had thus been in mortal danger, he, the Prosecutor ex officio, submitted the request made by the aforesaid Gerrit Visser as father for his son in the aforesaid petition to the Council's highly wise judgment, producing at the same time two letters from the Field Sergeant Gerrit Marits dated 17 June 1785, a report from the same Maritz, the interrogatories of the Hottentots Dikkop and Kieriet, a declaration of the burgher Fredrik Janssen, a declaration of the Hottentot Gerrit, and a report of the Hottentot Cupido, all relating to the matter. The Council holds this matter under advisement for circular reading. Mr. Gabriel Exter, serving as Prosecutor ex officio in the interim Fiscal office, plaintiff on the one part, against the burgher Jan Andries Bam, defendant in person, to hear such criminal demand or request or requests as the Prosecutor ex officio shall see fit to make and bring against him, the defendant, to answer thereto, and further to proceed according to law. The Council, having heard the parties, after consideration of the matter, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Melt van der Spuy to a fine of fifty rixdollars pro fisco with costs, the female slave Roosje van Maconda to be sold judicially for the benefit of her owner, under the condition of never ever being permitted to come under the power of the same again, nor that of his family and relatives. The pro interim fiscal and plaintiff ratione officii, Mr. Gabriel Exter, plaintiff of the one part, Against the burgher Daniel Bosman, defendant, to hear such claim and conclusion as the plaintiff ratione officii shall come to make and take, to answer thereto and further to proceed as according to law. The said pro interim fiscal delivers his written claim and concludes therewith as at the end of the same. The defendant, having heard the claim read, says substantively in his defense that, being ignorant of the Placard, he had thus by no means acted intentionally; that the burgher Martinus Laurens Smit, having come to him, had asked him to deliver a load of coal, without having spoken of needing to have an ordinance for it, so that he, the defendant, when his wagon was stopped, had betaken himself to the said Smit, in the opinion that the same best knew how this matter ought to be handled, who had handed him a note, which he was to hand over to the sergeant of the guard; that it was indeed true that the ex officio plaintiff had spoken of needing to have an ordinance, but that he, out of ignorance and inexperience, had not been able to comprehend that, having never engaged in such matters. The ex officio plaintiff, for replication, persists with his claim and conclusion. The defendant, for duplication, as above, further renouncing further productions, the plaintiff ratione officii requesting judgment. The Council, having heard the parties and having considered what was pertinent to the matter, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Daniel Bosman to the fine stipulated by the Placard of fifty rixdollars with costs. All present except the Burgher Councillors. Finally, there came to the table the petition presented by the pro interim fiscal Mr. Gabriel Exter, and the interests submitted thereupon by the bookkeeper Jan Fredrik Kirsten regarding a certain Narcis delivered to the latter as a slave by a certain Englishman named Kahman, who already departed for Europe some months ago; which Narcis, however, upon exhibition of a private deed of manumission, says he is not a slave but by virtue of that document a free person, and has therefore addressed himself to the said pro interim fiscal; so the Council, because of the uncertainty of the state of the matter, has deemed it good to place the said Narcis on Robben Island, until such time as further evidence regarding that matter shall have arrived, either through the aforesaid Kirsten or otherwise. Thursday the 22nd of September 1786. In the morning, present the Honorable Pieter Hacker, President, and all the members, except the Honorable Oloff Marthins Bergh, as also the two burgher councillors the Honorable Johannes Smuts and Jan Coenraad Gie. The Prosecutor ex officio delivers a written claim accompanied by a statement, and concludes therewith as at the end of the same; the interim official performing the Fiscal's office, Sieur Gabriel Exter, Prosecutor ex officio, against the burgher Nicolaas Laubscher, defendant, to hear such claim and conclusion as the Prosecutor ex officio may come to make and take against him, the defendant, to answer thereto, and further to proceed according to law with costs. The defendant says for his answer that his wife had bought wethers from the Hottentots, having thought that they were permitted to do so. The Prosecutor ex officio says he abides by the content of his claim and attachments, and rejects the defendant's futile allegations which conflict with the truth. The defendant, for his rejoinder, requests that the case might be declared civil and settleable. The Prosecutor ex officio leaves this to the Council's judgment. The Council, having heard the request of the defendant Nicolaas Laubscher Nicolaasz and also having heard the officer thereupon, declares this case civil and settleable, the same to take place in the presence of the Honorable commissioners of this Council. Whereafter by the very same interim Fiscal was presented a written statement concerning the soldiers Jacob Bernard and Jan Christiaan Pruysman who made themselves guilty of fencing stolen goods; requesting their apprehension, together with the request that, since the same soldiers were burdened with some debts, their little belongings might be judicially sold, whereon the following order was made: The Council grants to the Prosecutor ex officio the requested physical apprehension of the soldiers Jacob Bernard and Jan Christiaan Pruysman, and furthermore agrees, after an inventory has been made, to the requested sale of the goods belonging to the aforesaid soldiers, the monies proceeding therefrom to be held provisionally in sequestration. These documents having been circulated for consultation in the Council, today the judgment below was rendered thereupon: The interim Fiscal Sieur Gabriel Exter, Prosecutor ex officio in criminal cases on the one side, against Pannaaij of Bougier, slave of the burgher Marthinus van der Spuij, at present the Lord's prisoner and defendant in the same case, on the other side. The Council, having read with attention and considered the written criminal claim and conclusion, as well as considered everything that merited reflection and could move their Honors, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Panaay of Bougies to be taken to the place where criminal sentences are customary to be executed here, and there being delivered to the executioner, to be punished with the rope at the gallows until death follows; his dead body, having been dragged to the outside place of execution, shall there again be hanged up and thus remain until it shall be consumed by the air and the birds of the heavens, with condemnation in the costs and expenses of justice.

The Prosecutor ex officio on the one side, against the exile Padang van Padang, who served as a convict laborer, now prisoner of the authorities, in the same case, on the other side. Thursday the 29th of September 1785. The Prosecutor ex officio produces a written claim, provided in accordance with the attached inventory, and concludes as at the end of the same claim. The defendant, having heard the claim read, requests that he might be buried under the gallows. Shows with the greatest respect, the undersigned Hendrik Lodewijk Bletterman, Landdrost of Stellenbosch and Drakenstein, That on the 15th of August of this year, the burgher Andries Stephanus du Toit came to the memorialist at the drostdy of Stellenbosch, bringing along the inquest report attached hereto, delivered to his hands by the Field Cornet Abraham Josia Le Roux, with the request whether the memorialist would investigate the matter regarding the shooting to death of his slave Louis of Mosambicque by the burghers Anthoni and Daniel Roux, together with Pieter Ignatius Marais. That to the memorialist, from the mere reading of the same inquest report, it immediately appeared that both aforesaid Roux and Marais had not shot aforesaid Louis to death during a pursuit, but rather willfully or out of a misplaced compassion, as they had pretended. The Prosecutor ex officio memorialist, however, in order to be better convinced of the whole circumstance of the matter, summoned before him such persons to whom the aforesaid both Roux and Marais had themselves related how they had conducted themselves regarding the aforesaid. Just as the memorialist, after this information gathered by him, even to his utmost astonishment had to learn from the aforementioned both Roux and Marais themselves, that the aforementioned Marais maintained that aforesaid Louis could not well remain alive; and the mentioned Louis, as he Marais confessed to the memorialist, had not been given a shot to the head, but rather the muzzle of the firearm was placed before the mouth of that already mistreated slave, and he had shot him in the mouth in such a manner that he, Louis, immediately fell dead to the earth, in which course of action both Roux assented. Whereupon the following unanimous resolution was approved. The Council, having read the representation submitted by the officer ratione officii, grants his request and accordingly qualifies him to cause the burghers mentioned therein, Anthonij and Daniel Roux, as well as Pieter Ignatius Maraes, to be summoned in person before this Council for such purpose as is set forth in that representation. After which, by the same Landdrost in Judicio was exhibited a written report, made by the First Field Commandant Adriaan van Jaarsveld to his predecessor, the late Sr Daniel van Ryneveld, regarding a certain farmer named Erasmus Smid, about whom complaints had been lodged with the said Adriaan van Jaarsveld by the fellow farmer Gerhardus Dirk Kotze in a case of ill-treatment committed against him, Kotze, the said Field Commandant, together with and alongside the Second Field Commandant Van der Merwe and the farmer Hendrik Badenhorst, had made efforts to reconcile those two persons with each other, on which occasion complaints had likewise been brought forward by some of the children of the aforementioned Erasmus Smid, not only about ill-treatment but also about violent incest committed with his two daughters; of which various offenses a detailed description is given in that report, wherefore the said Sr Bletterman verbally requested that he might be granted bodily apprehension of the person of the aforementioned Erasmus Smid, in order to be able to proceed against him at law: which request made by the officer, as well as the atrocity of the deed in question, having been taken into consideration and weighed, the Council granted the said Sr Bletterman the following disposition: The Council grants to the officer ratione officii the requested bodily apprehension of the person of the farmer Erasmus Smid. Ninthly declaring that the questioned beasts belonged to the burgher Ian Buurman, requesting further that since the aforesaid van Kamptz, pursuant to the attachments under Letter a, refused to surrender the beasts and the same had already been in the kraal for three days without feed, the Remonstrant ex officio might give the necessary orders regarding this. That the Remonstrant, having consequently charged the court messenger, the same court messenger notified the aforesaid van Kamptz in writing, as the statement under No. 2 contains, that he, van Kamptz, by order of the Remonstrant, should surrender the beasts, simultaneously having the damage caused to him appraised by two irreproachable men, and placing their statement into the hands of the Remonstrant; no less was Ian Buurman appointed to appear before the Remonstrant at the earliest opportunity for the settlement of these matters and the satisfaction of the oft-mentioned van Kamptz. That the Remonstrant, thus believing to have treated this matter according to the best order and law, was extremely surprised by the communication from the court messenger of the answer received under No. 3 from this van Kamptz, whereby the Remonstrant was extremely aggrieved, both in his person and in his office. to herd horses, had come to tell him, du Plessis: that some torn clothes, the knapsack, and some flour and other food belonging to the aforesaid Damon having been found near the aforesaid amandelrivier, he, Tobias, as well as the aforesaid April and Hottentot Dam, had searched for the said Damon, without, however, being able to find him. That the aforesaid du Plessis, as one of his children was very seriously ill, having requested the citizens Daniel Fourie and Samuel Jacobsz to go look for the aforesaid Damon, the same Fourie and Jacobsz had indeed gone thither and upon their arrival had found the aforesaid Damon lying dead under a wild almond tree standing there by the river, without, however, after an examination performed on the corpse, having been able to discover the slightest wound or anything whatsoever from which they might have gathered the consequences thereof to be fatal. That the petitioner, since the road to the aforesaid loan farm, the amandelrivier, through the Franschhoek mountains, was very difficult and could not even be traveled on horseback without danger, and having taken into consideration that the corpse had already lain there three to four days before it was discovered, immediately wrote to the Field Corporal Daniel du Toit, who lived nearest to the aforesaid amandelhoute rivier, to proceed thither and upon his arrival to apprehend both slaves of the aforesaid Cahman named Tobias and April, together with the Hottentot Dam, and to send each of them separately to Stellenbosch, and subsequently to remain there awaiting the substitute Rudolphy along with the aforesaid du Plessis, who were ordered by the petitioner, as no surgeon was at hand, also to proceed thither in order to exhume the corpse that had been found and to examine it jointly once more. That such orders given by the petitioner having been executed, as it did not appear to the petitioner, neither from the report handed in by the aforesaid du Toit nor from the declaration made in this regard by the repeatedly mentioned du Plessis, that the oft-mentioned slave Damon had been killed by any externally inflicted violence or maltreatment, he decided to hear the aforesaid both slaves Tobias and April together with Hottentot Dam, based on the documents gathered in this regard by the petitioner as well as some preceding circumstances, before the honorable commissioners from this Noble and Honorable Council upon such articles as had been formulated to that end by the petitioner; that subsequently to the petitioner, neither from the responses given by the aforesaid captured slaves Tobias and April together with Hottentot Dam, nor from the report provided of the inspection held of the corpse that had been found, and further gathered inquiries, not the slightest semblance of grounds remained from which the petitioner could deduce even the slightest presumption against the aforesaid prisoners and by which the petitioner would be in a position to pursue his proceedings against the aforesaid prisoners, thus from the further investigations

The person acting pro interim in the Fiscal's office, Mr. Gabriel Exter, prosecutor ex officio, of the one part, against the citizen Willem Versfeld, defendant, to hear such claim and conclusion as the prosecutor ex officio shall make and take, to answer thereto, and further to proceed according to law, cum expensis. The sworn clerk of this Council, Mr. Rijno Iohannes van der Riet, serves in his capacity with replica, as in writing; the parties renounce further production. The Landdrost of Swellendam, Mr. Constant van Nult Onkruijt, prosecutor ex officio, of the one part, against the citizen David Keijser, defendant, to see served with replica upon his submitted writing of answer, to serve with duplica in six weeks. Van Leeuwen, for the defendant, requests a copy thereof to serve in six weeks. The Council grants the defendant the requested copy and a term of six weeks for duplica. The Council holds this case in advice until the submitted depositions shall have been recollected and, so far as necessary, sworn to, and read around together with the documents.
