That in the first case, namely if the said sentence was based on the own confession of the defendant in person, without the intervention of any other document that could be subject to any distinction on the part of the defendant in person, then also, since his proceedings were commenced and prosecuted in a criminal extraordinary case, he ought by no means to be granted leave to interject his appeal here or to prosecute it elsewhere, since according to the universally known and generally received grounds of law it is placed beyond all dispute that a person condemned in a criminal extraordinary case simply and solely upon his own confession is not entitled to claim any means of challenge against such a condemnation, as is very fully deduced and found in de Groot in his Justification of the Lawful Government of Holland Chapter 12, in Mr. P: Bort in his treatise on the Appeal in Criminal Cases chapters 1 and 5, Merula, Neostadius, and all others who have ever dealt with this matter, to such an extent that by resolution of the Noble and Grand Mighty Lords States of Holland dated 10 September 1591 it was understood, "that those of the High and Provincial Council of Holland shall grant no relief upon the request of any persons against whom proceedings shall be conducted criminally extraordinarily and upon their confession, but the sentences rendered in the aforesaid cases against the condemned shall be executed without any appeal, reformation, or challenge being permitted against them." The Independent Fiscal, Mr. Willem Cornelis Boers, on the one side, and the Master of the hooker de Snelheyd, Roeloff Pieterse, on the other side; to the end of hearing judgment pronounced upon the criminal claim made and conclusion taken ex officio by the aforementioned Fiscal against him, Roeloff Pieterse. was detained, and in what manner it was dealt with. From the said declaration it also appears how much tea, rhubarb, etc., which were unfit for shipment, were sold here; which sale took place not without very pressing reasons, because both through the prolonged stay of those goods in the ships, and through the damage which the same, notwithstanding the most careful handling that could be applied under the circumstances of the time, had to suffer in loading and unloading the country-boats and in moving them in the hired warehouses, which nevertheless were all dry and in very good condition, it was caused that many of them (especially the tea, due to the weak chests in which it is packed and the manner in which the same is loaded) became damp, moldy, and for a large part entirely spoiled, being in that state unable to bear or compensate for the expenses of new chests nor the freight of hired ships. The same is the case with the cinnamon, but with this distinction: that, although spoiled, it was nevertheless sent, because if sold here it would have yielded little or nothing, and in Europe it can always be sold at some value for the manufacture of oil. The coffee on board, both through leakage and other defects which the ship Batavia, as appears from the annexed declaration, had to endure, became spoiled and heated, and being as such unfit for a new shipment, was sold by public auction. All the sold goods have been credited to the General Office in the Trade Journals of the years 1782/3 and 1783/4. Furthermore, it seems to the undersigned to appear from the foregoing that no one can be held liable for the damage to the aforesaid goods. As regards the linens brought ashore here and sold according to a resolution of the Policy Council, this was done because of the scarcity of these articles observed in this place, and with the prospect of very considerable profits. It also appears from the return of 1782/3 that even the damaged linens yielded up to 87 per cent profit; and from that of 1783/4 that the unladen battecatjes yielded 131 per cent, the corroots 88 per cent, and the baboutrias 119 per cent in net profits after deduction of all expenses. Finally, the undersigned shall attach hereto a sworn declaration of the commissioners for the unloading of the ship Esperance de la Paix, which confirms that the 6 rolls of sheet lead were delivered short by Captain Le Houcq; and although he maintains that he shipped them, and thus presumes that that lead was stolen from the vessel with which it was brought ashore, he was nonetheless to be held liable for it, since prudence required him not to send any goods belonging to his cargo to land without the supervision of one of his officers to guard them and hand them over to the commissioners on the jetty. The ship l'Esperance de la Paix could not be given any further cargo, because there were no more of the goods detained in this Government at hand. The undersigned cannot omit to add hereto that a copy of this report, together with its enclosures, was already submitted to the meeting of Your Right Honorable and Worshipful Honors in the month of June of the past year, but that the then Secretary, Mr. Oloff Martini Bergh, undoubtedly through multiple occupations and the poor state of his health, neglected to make the required use thereof; all the papers pertaining to this having been found at the secretariat after his death and delivered again to the undersigned, except for the accounts of the French troops, which were dispatched to the Netherlands by the said Mr. Bergh.
