No. 4. 1300 Resolutions taken in the Council of Policy at the Cape in the year 1786. Letters dispatched from there in 1786. Daily register kept there in the said year. Fourth Part. Papers received from the Cape. 4 1707 Register of Letters and 1787 1787 Resolutions 1752 the 1st to 17 1 10 of the year 1786. Friday, 6 January 1786. In the forenoon, all present except Colonel Robbert Jacob Gordon. Appointment of the messenger Wagener as secretary, and of the soldier Christiaan Helm as provisional messenger of the Colony of Graaff-Reinet. On the proposal of the Governor, the messenger of the Stellenbosch and Drakenstein Colonies, Johan Jacob Fredrik Wagener, being a person of the requisite qualifications, has been appointed secretary of the Colony of Graaff-Reinet at a salary of 30 florins per month. Furthermore, in order likewise to provide the last-mentioned Colony with a person for the service of messenger to the magistracy there, for which no applicant has yet been received of whose good conduct and necessary qualifications for that post one could have sufficient assurance, it was agreed to appoint on probation the soldier Christiaan Helm. As well as of the soldier at the pen Gerhardus Henricus Cruywagen as second assistant in the Company's Treasury. And whereas the service at the Honourable Company's Treasury has increased in such a manner over some years that it can no longer be properly performed with the help of one assistant assigned there; and the soldier at the pen Gerhardus Henricus Cruywagen Junior, having now served for a considerable time as an assistant at the said Treasury to good satisfaction, has therefore been promoted to assistant at 20 florins per month, in order to continue in the aforesaid service at the Company's Treasury. Request made by the French supercargo Massonier to be allowed to bring some slaves on shore for refreshment. Remarks made by the Governor. The Governor subsequently informed the meeting that when the private French ship La Flore arrived here in the past month of December with a cargo of four hundred Mozambican slaves, and the supercargo of that ship, Jean Massonnier, had informed His Honour that he was destined with that cargo for St. Domingo, requesting that he might be permitted to refresh those slaves on land for a few days, fearing that if the necessary respite were not granted to them, the greatest part would perish on the remainder of the voyage. And His Honour having learned from experience how many means and practices such persons put into effect to sell a portion of the disembarked slaves at this place and cause them to remain behind; whereas on the one hand great prejudice might thereby be caused to the slave trade which had now been carried on for several voyages with good success for the Honourable Company, and on the other hand the scarcity of provisions recommended all possible frugality, it had been greatly difficult for His Honour to acquiesce to that request. this having however been granted on the aforementioned conditions; subsequent petition made by him by request with the intention of being allowed to sell some of those slaves. needing only greens for refreshment, to be fed with rice laden for that purpose in the aforesaid vessel, His Honour finally could not refuse to show humane assistance and to permit the aforesaid supercargo together with the cargo to let the aforementioned slaves refresh on land for a few days under the conditions mentioned just now, but that His Honour had thereby taken such measures as were expedient to prevent that the said supercargo should not fulfill his made assurance and promise; with which granted permission and the measures taken alongside it by the Lord Governor the members of the Council have fully concurred. And whereas the well-mentioned Lord Governor had further been pleased to add how the frequently mentioned supercargo, afterwards under all kinds of pretexts, had sought to obtain permission to dispose of some of the aforesaid slaves here, but in that had repeatedly been turned down by His Honour for the aforesaid reasons, and that the same has very humbly made known, Jean Massonnier, supercargo of the French private ship La Flore presently lying here in the roads with a cargo of Mozambican slaves, how among the cargo mentioned just now a small number of sick happened to be found, who, in case he petitioner were obliged to transport them further across the sea, would run great danger of dying, if not all then at least the greater part, to the notable prejudice of his owners and principals. And he petitioner seeing himself necessitated to make good the expenses incurred here from the proceeds of his slaves to be sold, Right Honourable Sir and Honourable Worshipful Sirs. To the Right Honourable Sir Cornelis Jacob van de Graaff, Governor of Cape of Good Hope and the jurisdiction thereof, etc. etc., together with the Honourable Worshipful Political Council. supercargo after the rising of the meeting came to present to the Lord Governor the following request: Takes which request has been turned down. returning Swedish private needlessly staying here lost. Takes therefore the liberty to turn to Your Right Honourable and Honourable Worships, humbly requesting, both for the reasons adduced hereinbefore and out of compassion for those unfortunates who otherwise face a certain death, that it may favorably please Your Right Honourable and Honourable Worships to grant permission to him, petitioner, to sell the aforesaid sick slaves by private contract to private individuals here. It was therefore understood in consultation by all members together to grant as marginal note thereto, that the Honourable Company reserves the slave trade at this place to itself, for which reason, and also because of the present scarcity of provisions, it was only permitted to allow the slaves mentioned in the request to refresh on land for a few days, and that upon the express promise of the supercargo that none of them should remain behind here; wherefore the request made herein is turned down. Below stood: Thus resolved and decided on the day and year aforesaid. In consideration that the Swedish private ship La Bonne Resolution, chartered on the Company's behalf and laden with return cargo at Batavia, has long since been repaired of the leakage it had suffered and brought into a state to pursue its voyage, yet notwithstanding the daily abundant and fit opportunities of weather and wind occurring to be able to leave these roads and to continue the voyage to the destined port, still remains here, it is resolved that, in case the said ship does not depart this very day, weather and wind permitting, in order to avert the prejudice that might arise therefrom for the Honourable Company, it shall be declared on behalf of this Council to Captain Andries Landgreen, and likewise to the other senior and junior officers stationed thereon, as far as the latter are concerned, how greatly one is surprised at such an unnecessary delay. a protest will for this reason be lodged against the captain and officers of the same. Resumption of the letter from the gentlemen of the High Indian Government of the 25th of the same month of the past year. It will, however, henceforth be complied with. Reasons why the letters to their High Mightinesses have thus far remained unobserved. The government expresses its surprise, and for that reason is obliged to protest in the most solemn manner against him, Captain Lundgreen, and the other officers, as representing the owners of that ship, against all damages and losses already suffered or yet to be suffered by the Honorable Company due to the said unnecessary delay of the voyage, thereby reserving for the said Company the right to employ and put into effect all such measures for that reason as the high commanding Lords Masters shall deem serviceable and be advised to take. After which, consideration having been given to the letter from their High Nobilities the High Indian Government dated 25 October of the past year, brought by the ship Trompenburg which arrived on the 7th of this month, and which has meanwhile been circulated among the honorable members for reading, it was resolved thereupon to reply in all respect: That concerning the recommendation in future to arrange the letters, or at least the general report of affairs, according to the directions of that letter and the annexed relevant extract of their High Nobilities' resolution dated 10 December 1778, however much inclined and prepared one is to defer with all respect to these and all further instructions and orders of their High Nobilities, yet on the grounds that it might happen, when readying the Company's ships for sailing by which this general report of affairs is prepared and brought for dispatch, that ships arriving from the east and west constantly cause changes in one matter or another, and that in order to bring the matters that arise in the meantime under the relevant chapter, which might well require the entire letter to be rewritten, the ships would have to be detained; in the hope that their High Nobilities, recognizing this, would kindly have excused this government from that rule and instruction; this was also the reason why that order has until now remained unobserved; but since the same order is now insisted upon further, one will not fail dutifully to obey it. Regarding the order given by their High Nobilities concerning the brief summary of the general number of servants and the statement of the cannon on hand, with their caliber, placement, etc., this being a matter of the utmost importance to be dealt with in secret, the Lord Governor has undertaken to render a separate report thereof to his High Nobility the Lord Governor-General as soon as possible, and subsequently every year separately, and a separate annual statement shall be provided by the Lord Governor concerning the above-mentioned secret matters. And as their High Nobilities are pleased to express their surprise at the negligence in replying to their highest letters dated 5 October 1784 and 31 February 1780, and the reason for this was that, since the Lord Governor had barely taken over the administration of affairs, and with everything that daily and continuously occupied his Honor in the strongest degree, his Honor found his attention diverted from inquiring whether any writing had also been received on behalf of their High Nobilities that would still need to be answered by this government, and at the same time the then Secretary of this Council, the late Honorable Merchant Olof Marthini Bergh, had likewise fallen into such a debilitated condition that several affairs of his department fell behind as a result; their High Nobilities will therefore be requested to take this into consideration and to overlook this omission for that reason, their High Nobilities being also requested to overlook the failure to answer the alongside-mentioned letters for the stated reasons, as well as the absence of a written declaration from the late Fiscal Serrurier regarding the murders committed on the ships 'T Slot ter Hoge and Java; the more so since the Independent Fiscal Serrurier, having already assumed that office provisionally upon the arrival of the ships 'T Slot ter Hoge and Java, was prevented by continual illnesses from submitting the still required written declaration regarding the murders committed on the same ships, or from indicating what prevented him from fulfilling that requirement, and this having remained entirely neglected due to his Honor's subsequent decease, one now finds oneself without any opportunity to report anything further in that regard to their High Nobilities, since both captains of the said ships have since continued to reside in the fatherland. That every possible attention will be employed to serve Their High Noble Excellencies dutifully in the future regarding the matters pointed out in the aforementioned esteemed writing of the same, which were omitted from the letters from here, in the hope that Their High Noble Excellencies will please be persuaded that this occurred without any intention to keep the same ignorant concerning those matters, being glad that the neglect has in some way been remedied by the complete information obtained by Their High Noble Excellencies in that regard from the copies of the letters dispatched to the commanding Lord Masters. What is to be reported concerning the extraordinary requisition received from the Fatherland, and of which a return will be sent at the closing. To what causes the mortality of the last traded slaves must be attributed. What was required for its complete recovery. That concerning the management of the sale of the goods sent from the Fatherland to this place on the extraordinary requisition, their High Excellencies will be informed how we, pursuant to our resolution of 29 March of the past year by a qualification given to the Secunde Pieter Hacker and the Merchant and Cellar Master Jacobus Johannes Le Cueur, having attempted to sell those goods in one lot through a negotiation with private individuals for the greatest profit of the Honourable Company; since this was by no means successful, on 28 April following we had to resolve to qualify the said Secunde as Chief Administrator to cause the said goods to be sold on behalf of the Company by public auction. And this having already been resumed at three different times on the most suitable occasions, an appreciable quantity of various articles of the same has thereby indeed been disposed of; but the remaining part is still too large to be sold all at once without any loss to the Honourable Company. Meanwhile, awaiting more favourable times regarding the same, and especially the woollen manufactures, every precaution is taken that can possibly be put into effect for their preservation against moths and other damage; and at the closing of the trade books, a return of the sales of the aforementioned goods conducted in the past financial year, showing the profits made thereby, will be sent to their High Excellencies. And what is thought to be best for their preservation on the voyage. That since the mortality among the Mozambique slaves whom Captain Du Miny traded on the African Coast must be considered an unfortunate accident, whereby the profits of that voyage were for the greatest part absorbed, and that mortality mainly took place before the said vessel had yet left Mozambique, and the cause of the disease—which subsequently also infected the rest of the slaves—was to be deduced from that which had already occurred before the purchase and embarkation, an inquiry into this matter would have turned out to be very difficult and puzzling, so as to be able to devise any measure against it with sufficient certainty for the future; for which reason, since it has been experienced that their preservation on the voyage depends mostly on the treatment by the ship's officers who have come to know the nature and constitution of those people, it was thought best to leave the management thereof to the said Captain Du Miny, as an experienced person in that trade, rather than to worsen the matter by ordering improper measures. We hope Their High Nobilities will willingly be persuaded that, far from intentionally neglecting the interests that the Honorable Company has in provisioning India's capital, on the contrary, immediately in the year 1781, and thus with the beginning of the said war, such a shipment of grain was made that Their High Nobilities, by their venerated missive of 5 November 1781, were pleased to testify that the demand at that time was completely satisfied and properly supplied. That, just as one already had the lamentable prospect with the wheat harvest for this year of little comfort of being blessed with a hoped-for and necessary greater abundance of that grain, it has alas now worsened to such an extent that, thus far, the registration of the farmers regarding what they have to deliver to the Honorable Company cannot reach a fourth part of the quantity that is strictly required for the Company's establishment here for one year's consumption alone; however much, upon the reliable reports concerning the wretched condition of the crop, in order preferentially to encourage the farmers to deliver the wheat to the Honorable Company, the price thereof was increased by 50 percent, in equality with that which was permitted to the private bread bakers under a heavy fine to pay as an utmost price for the grain. And which disadvantageous circumstances are also so great among some of the principal grain-farming country people themselves, that they, who otherwise made important deliveries, are now forced to provide for their required bread and new seed by purchasing what others may still have to spare. And since the consequences of this can only be viewed with dread, as the inhabitants multiply more and more, the garrisons are of necessity more numerous, and no adequate relief is to be expected or obtained from elsewhere, one must thus testify with regret to be strictly out of the possibility of being able to answer Their Right Excellencies' desire in any way, to which will also be added and what measures shall occupy the attention of the Government in this matter; the reported shortage of garden seeds shall be supplemented, and what the reasons were why a considerable sum remained in the petty cash chest in the year 1784; the demands thereof shall be fulfilled immediately after the collection. Louis de Martignac, Captain of the private French ship Le Neptune, likewise chartered on behalf of the Company and laden in Batavia for the return voyage, reading as follows: The private vessel Le Neptune, chartered to the East India Company to make its return voyage to Rotterdam, has put into port here for the reasons he explains in the statement that he has the honor to present to you, stating that the long stay he was forced to make in Batavia waiting for his cargo brought him into the position of consuming all his provisions and seeing his vessel deteriorate every day, despite the care he took for its maintenance and repair, which was done or executed under the eyes of the Vice-Commander of Batavia; and despite this, the said petitioner found himself at sea obliged to pump every hour, making twenty inches of water per hour, which obliged him to search for where the said leak came from, and indeed found two of them in his stern without being able to remedy them except by pumping as has been done continuously. This misfortune, joined to that of having twenty-five to thirty-four men sick since departure, having furthermore lost seven men, and otherwise lacking bread, wine, and good water, decided him to put into port here in preference to any other, and in accordance with what his charter party says, that there shall be furnished to him, whether in Batavia or at the Cape, whatever shall be necessary for him by the East India Company, for which accounts shall be drawn up that the said petitioner will sign to be subsequently deducted from the payment of his freight. Consequently, the petitioner has the honor to observe to you that, in order to remedy the needs of his vessel, it is of absolute necessity that he unload his between-decks containing coffee, arrack, and tamarind belonging to the Company, and that these items be placed in a safe location to be re-embarked aboard his said vessel as soon as the repairs are completed; and following the assistance of workers and materials to this effect that the said petitioner has the honor to request of you urgently in order to accelerate his operations. He also has the honor to observe to you that, as he will have to pay the workers, materials, and provisions during the stay in this port, his sick at the hospital, and his return to Europe, he would need you to please grant him the necessary sum for these purposes, which will amount to 3000 rixdollars, the petitioner reserving the right to make another request of you if that is not sufficient.

Whereupon it was resolved, seeing that on the Company's part there are no suitable warehouses available to store the cargo of the said vessel, in case the captain, after inspection of the ship 'T Huys te Spijk destined for demolition, should deem it still suitable for that purpose, to grant him permission, so that the discharging and reloading of the goods might take place with the greatest speed and in the most convenient manner, to make use of the said vessel, with the understanding, however, that all this shall be for the account of the owners of the said ship Le Neptune and without any risk to the Honorable Company; the required repairs to the ship Le Neptune being further carried out in accordance with the charter party for the account of the owners, to the satisfaction of the captain, and that there shall initially be paid to him from the Company's treasury for his necessary expenses at this place a sum of two thousand rixdollars, as well as satisfaction being made in respect of the provisions regarding the requested wines; however, the captain must state the quantity of bread required, in order to exercise all possible thrift concerning that article in view of the present prevailing scarcity. For the rest, the captain is left the option, in case the aforesaid granted sum should not suffice for his expenses, to address this Council with a further request. And if any surplus should remain from the monies received, this excess must be reimbursed by the said captain into the Company's treasury, as the request to accept such surplus funds on a bill of exchange cannot be granted. The Landdrost of the colony of Graaff-Reinet shall select a site there, as well as investigate whether another site can be obtained in that region as a means of subsistence for him, concerning arrangements for the establishment of the residency. And since the Landdrost of the remote colony of Graaff-Reinet is now ready to undertake the journey to the aforesaid lands, it is resolved to authorize him upon his arrival there to examine and investigate carefully which place in the Camdeboo or its surrounding districts is best suited and located for the establishment of the residency of the aforesaid colony, so that the inhabitants from all around may have all possible convenience in accessing it; such a place would for that purpose have to be resumed by the Company, leaving the current loan-holder the choice of one or two places to be selected by him, with the promise that upon its surrender proper compensation shall be made for the aforesaid land to be resumed. And the said Landdrost shall be ordered to establish order and to take the necessary measures, and since such a place must also serve for the grazing of the horses and draft oxen that the officials of the colony will strictly need to keep for their service, and it might be that owing to the limited extent or modesty of the pasture, the same place, combined with the ordinary salary, would not provide a sufficient livelihood for a Landdrost there, the said Landdrost must in such case investigate whether another place in that region might not be added alongside it for that purpose, concerning which a report must be made; as well as to make the necessary provisional arrangements on the aforesaid place for the account of that colony, so as to serve provisionally to have living quarters and further lodgings for the officials of the magistracy and subordinates of the Landdrost, and this as close to each other as possible, after which proper houses and what appertains thereto may subsequently be conveniently constructed on the said place on behalf of the same colony.

As well as to draw up a list of the most suitable inhabitants for the election of Heemraden, and establish a provisional council of war, as well as to effect a subscription for a certain sum of money for the costs of establishing the magistracy. As regarding the compensation that is to be paid to its owner to the least prejudice of the Honorable Company. The aforementioned Landdrost shall furthermore be required to form and submit here a list of the most suitable inhabitants of that colony, containing a sufficient number of them, in order to make therefrom the election and appointment of six Heemraden of the said colony, of whom two shall serve for the term of one year, two for two years, and the remaining two for three years, so that subsequently every year two new Heemraden shall be elected and appointed again from the nominations to be received, who shall replace those retiring and shall have a seat for three years. And in order that sufficient compensation may be brought to the Honorable Company as speedily as possible for the expenses which it incurs in establishing the magistracy there, for which it will serve as an apt means that the multitude of abandoned places in those regions immediately yield the usual annual recognition monies again, and that as many new ones as possible be granted in addition, the said Landdrost shall be authorized to form provisionally a council of war with the field commandants present there, and should these not suffice, with the addition of the most capable of the field corporals, in order to establish immediately the strictest and most suitable orders, as well as to take appropriate measures to counteract the violence and nuisance of the Bushmen Hottentots, and to maintain authorized commandos to subdue them, so that everyone may safely reoccupy and inhabit the abandoned places again. And since the erection of the buildings of the Drostdy, with its appurtenances, will cause great costs at the very outset, but the inhabitants of the aforementioned areas previously offered, if the establishment of a magistracy there should be granted, to bear and furnish such expenses, the aforementioned Landdrost shall likewise be authorized to effect a subscription of what each of them is prepared and inclined to contribute thereto as an initial and voluntary contribution towards forming a capital for the colony, so that there may be no necessity of plunging the colony into debt from the start. Furthermore, it being deemed necessary to renew the friendship with the Kaffirs, and that the captains or chiefs of the Kaffirs who stay on the other side along the Great Fish River have knowledge of the appointment of a Landdrost over those areas, it is understood that the said Landdrost shall not only inform them thereof through Hottentots known to that nation and speaking their language, but that the said captains must also be invited by him to present themselves on this side of the river at such times and places as can best be determined, in order to renew the so necessary friendship with that nation, which shall take place in the presence of the field commandants and an escort of the other inhabitants, then at the same time further confirming that according to previous agreement the Great Fish River shall continue to serve as a defined boundary between them and the possession of the Honorable Company. The Landdrost shall present to each of the same captains, as a token of friendship on behalf of the Honorable Company, a small gift of a grenadier cap, a piece of sheet copper, some copper wire and beads, and some tobacco; while nevertheless close care must be taken that on that occasion, and also further, no trade whatever be carried on with the Kaffirs by anyone whoever he may be, much less that the least nuisance or unfriendliness be shown to them. Since it is furthermore very probable that, contrary to the express prohibition, one or other of the inhabitants has settled across the Great Fish River, and that this must give rise to new hostilities with the said nation, it has likewise been deemed necessary to enjoin the said Landdrost to inquire closely into this, and very earnestly to notify and order such persons to depart from there as speedily as possible, and to conduct themselves according to the aforementioned determination of the boundary, and that communication of that notification and order shall also be given to the captains of the Kaffirs.

Upon the notification of the Lord Governor that an abundance of timber could be fetched from Plettenbergsbaaij, with the attached proposition that on the occasion of the upcoming journey of the aforementioned Landdrost Woeke, instructions should be given to require of him the necessary actions in this regard. On this occasion, further consideration was also given to the repeatedly raised concerns as to whether, in one way or another, in order to save the great costs that must be incurred for the transport of the necessary timber from the Company's post in Houtenequaland to this place by wagons, a more suitable means might be taken in hand. And the Lord Governor having made known that he has been informed by knowledgeable persons that, due to the vast extent of the Houteniqua forests far to the east of Plettenbergsbaay and the situation of a major part thereof in the vicinity of that Bay, if a sufficient number of men were stationed in the nearest forests at the said bay to cut timber for stock, that stock could be fetched annually from that Bay by one of the permanent hookers or other suitable vessels, with much greater convenience, in great abundance, and in a profitable manner for the Honorable Company (in order, once a sufficient stock thereof is on hand, to dispose of the remainder among the inhabitants at a reasonable profit). That according to what His Honour has been informed, since full knowledge of the said Bay was obtained, reflection has already fallen many times upon this matter due to such a situation of the timber forests and the shortage thereof at this place, the difficulty always having arisen regarding commencing that work and making progress under the supervision of an industrious person; and since His Honour submitted for consideration whether, on this occasion when the aforementioned Landdrost Woeke is to proceed to the distant outlying fields, and after affairs there shall permit, must undertake the return journey hither in order to report on his findings and to learn what orders shall be deemed necessary, both with respect to the aforementioned Colony and the Landdrost office, and the determination of the boundaries between the same and the other outer colonies to be devised and established, it might not at the same time be required of him, on his return journey, to take the route so as to call at the said Bay, and having surveyed the situation there, to establish the necessary orders to make a beginning with that work, it is, for the said reasons adduced by the Lord Governor, and because it is moreover deemed necessary to garrison the said Bay with military personnel, resolved also to instruct the frequently mentioned Landdrost Woeke to take the route on his return journey via Plettenbergsbaay, and accurately to examine and investigate in what manner the cutting of timber and other wood in the forests situated nearest to it may best be commenced and continued, so that subsequently, coming further hither, he may issue the necessary orders to the Master stationed at the Company's Post in Outennqualand to transfer, the sooner the better, a suitable number of men from that post thither and to make a beginning with that work, of which a proper report must likewise be made by him, the Landdrost, upon his return. Whereby it was furthermore approved to authorize the frequently mentioned Landdrost to survey in passing, on the return journey, how far they have already progressed with the erection of the huts for the military garrison at Mosselbaay, and to issue the required orders regarding whatever he might find necessary for the greater dispatch thereof. for which reason the burgher butchers repeatedly insisted on redress to maintain their trade, while the butchers themselves had suggested a suitable remedy for this, and the aforementioned Burgher Councillors came to support the proposal thereof with their request, against remaining obliged to deliver the fresh meat and fat at the fixed assessment, they all, in order not to be exposed to complete ruin, would find themselves forced to abandon the butcher's trade. That the Burgher Councillors, regarding the great inconvenience that would thereby arise for the inhabitants, at the request of the aforementioned butchers that the necessary representation for redress might be made by them to this Council, having hoped that with the ending of the war that price would also have fallen of its own accord, and having therefore disposed the same butchers for some time yet with that hope to continue with the butchery, were nevertheless urged anew by the more mentioned butchers to request redress in this regard. That it was submitted by the aforementioned butchers themselves as being convinced how the high price of slaughter livestock had arisen chiefly from a self-interested manner of trade of some among them, as a convenient and best-suited remedy to be presented to this Government, to permit them, just as recently occurred concerning the privileged bread bakers, to execute in the presence of the Burgher Councillors an agreement to purchase and pay for slaughter wethers at no higher than 42 schellingen, under a fine of 1000 Ryxdaalders for the benefit of the Burgher Treasury, as a price by which they would be enabled to continue delivering the meat and fat at the fixed assessment; requesting therewith, however, that in order not to be hindered in this their good intention, it might please this Council also to prohibit, under heavy penalty, that no private individuals besides their butchers shall be permitted to ride around in the countryside to buy up slaughter wethers in order subsequently to resell them again. That they, the Burgher Councillors, finding themselves compelled for the aforementioned reasons to bring all this to the attention of this Council, requested that such measures might be taken in that regard as should be deemed appropriate. And after deliberation, it was resolved, in order to prevent the inhabitants from being inconvenienced by the excessive price of slaughter livestock, and on the other hand to avoid the necessity, the bread bakers, to 25, they shall, conforming to the said butchers regarding the purchase of wethers, have to execute a deed of agreement, and this under the penalties set forth alongside, while the Fiscal Pro Interim shall be ordered to proceed against the violators thereof; a certain English botanist having made a request to collect herbs and plants here; as well as the buying up and reselling of slaughter wethers being prohibited to anyone not being a butcher, in which one would otherwise be placed, of permitting the butchers an increase in the assessment on fresh meat and fat to the oppression of the inhabitants, to authorize the aforementioned Burgher Councillors by extract of this resolution to have executed in their presence by all the privileged butchers collectively a deed of agreement, providing that they promise and undertake henceforth in no way to purchase or cause to be purchased and paid for slaughter wethers at more than 42 schellingen apiece, and this under a fine of 1000 Ryxdaalders for the benefit of the Burgher or Colony Treasury, to be forfeited by whichever of them might henceforth act against this agreement; with the obligation upon each of them also, whenever required at all times, to state under solemn oath the price for which any wethers shall have been purchased or traded by them or on their behalf. The Fiscal pro Interim being ordered, by virtue of the aforesaid deed, to act against any of the aforementioned butchers who might in one way or another fall under suspicion of having departed from this agreement of theirs, and to prosecute before the Court of Justice whoever shall be found guilty, and to proceed by summary execution to the payment of the said fine for the benefit of the Burgher Treasury. the adjoining reflections have fallen upon the granting of such permissions, which request, however, being supported by a letter from Their High Mightinesses' ambassador at the English Court, concerning the use that could be made of such a permission, as an example thereof was given by the English botanist Paterson, who, having obtained a liberty of that nature, thereby gained such knowledge of the access points that he afterwards, as is understood, was placed on the fleet under Commodore Johnstone, in order to be of service in case they should have seen fit to undertake a landing against this place. His Honour would therefore have had no hesitation directly to refuse that request, had not a letter from His Excellency Baron D. W. van Lynden, residing as ambassador of Their High Mightinesses the Lords States General of the United Netherlands at the English Court, been handed at the same time to His Honour by the said botanist Mason, which letter His Honour, being pleased to communicate to the assembly upon the presentation of the aforesaid request made, was found to be of the following content: I have been requested by the Marquis Carmarthen, Secretary of State for the Department of Foreign Affairs of this realm, favourably to recommend to Your Right Honourable Sir the bearer of this, Mr Mason, being a botanist who has been sent out by His Majesty the King of England to gather for His Majesty's gardens the remarkable herbs and plants growing at Cabo de Goede Hoop and to convey them over here. Your Right Honourable Sir will therefore greatly oblige me by being pleased to receive the aforementioned Mr Mason favourably, and to show him such services as Your Right Honourable Sir shall find himself in a position to do; whilst, for the rest, I also believe I may assure Your Right Honourable Sir that such will not be disagreeable in the Republic. Wishing Your Right Honourable Sir further all satisfaction in his distinguished post, and enduring and long-lasting health, I have the honour to be with all considerations, Right Honourable Sir, Your Right Honourable Sir's humble and obedient servant, was signed: D. which order to the Captain of the aforementioned ship Trompenburg, and the report regarding it that shall be given to the High Government of the Indies, to collect from the aforementioned island on its voyage to Batavia and, at the disposal of the High Government of the Indies, transfer to the same capital place. Wherefore it is understood that this vessel on its aforementioned return voyage shall call at the aforementioned island for that purpose, and that consequently the necessary orders thereto shall be handed to Captain Willem Udemans commanding thereon, with orders to address himself to the Governor on Mauritius and to request that two delegates from that government may be appointed, in order to weigh the aforementioned coffee beans accurately alongside him, the Captain, and the first Lieutenant, and specifically note which bags thereof are still preserved or spoiled. In the event that among those coffee beans any should be found whose decay might cause any harmful infection in the ship, that portion shall have to be thrown into the sea or burned. Meanwhile, the aforementioned Captain remains obliged to conduct himself in such a manner as best agrees with the interests of the Honorable Company, and to give a proper accounting of his actions to the well-mentioned High Government of the Indies. And thereby their Right Honorable Worships shall be informed that, having obtained knowledge by missive from Governor de Souillac dated 23 September 1782 regarding the arrival of the aforementioned ship de Morgenster at Isle de France, and subsequently by a ditto directed solely to Governor van Plettenberg by General de Bussy under date 17 December 1782, regarding the use that had to be made there of that vessel for transport to the Indies, without the least mention being made in either of those letters of the aforementioned discharged coffee beans; when subsequently in the year 1784 upon the arrival of the aforementioned ship de Morgenster here on its return from Ceylon to the fatherland, the skipper Gerrit Bergh came to give knowledge thereof with delivery of the official report kept on Mauritius concerning that discharge, one had to suppose at that time that care had already been taken there to send the same coffee beans on one occasion or another, either to the capital place of the Indies or to the fatherland, or that such was still to happen. Even though upon receipt of that news through the skipper Bergh on 2 June of the aforementioned year 1782, it was too late to give orders to take in those coffee beans to Captain van Veerden, who had already departed from here to Mauritius on 14 April of the same year with the vessel 't Huys te Spyk for the transport of the French troops; so that it is to be wondered at that the French ministry there, which well knew that we had been left completely ignorant regarding the aforementioned discharge, did not make use of that vessel at the time to have the same unloaded beans transported hither. The above-mentioned original official report shall be handed to Captain Udemans, in order that, having made the required use thereof at Isle de France, it may be presented to their High Honors, and a copy thereof added to the missive to be sent to the same High Government of the Indies. Because for its possessor, the mentioned place is of not the least use or advantage as long as no permission can be given to him to construct a suitable road to transport those products hither; and on the other hand, this is still far from answering to what may serve to cut off completely the aforementioned access from there for the enemy, which also cannot happen as long as the aforementioned place was kept in a habitable state and cultivated, His Honour had right away judged that care ought to be taken to bring the frequently mentioned place back into the hands of the Hon. have seen themselves rendered unable to continue the butcher's business any longer, unless the price for the slaughtered meat were proportioned and increased in accordance with the purchase price of the wethers: that they, the petitioners, however, on the other hand, having taken into consideration all the detrimental consequences of such a discontinuance or increase in the price of meat for the Cape inhabitants in general, in order to prevent both the one and the other, as well as to keep themselves as much as possible harmless thereby, have been able to devise no other means than to assemble and enter among themselves into a certain agreement that none of them henceforth shall purchase slaughter wethers at a higher price than at Twelve schellingen a head, and this under a forfeiture of one thousand Rexds for the benefit of the Burgher Treasury, of which agreement, after having obtained thereon the approval of Your Right Honourable and Worships, pursuant to Your highest resolution of the 17th of this month of January, a formal deed was then also executed by the petitioners on the 24th following at the political secretariat, subject to voluntary submission to the just-mentioned sum of 1000 Ryxds upon violation thereof: that they, the petitioners, thus trusting this to be an appropriate means, and that they thereby would be enabled to continue with the butcher's business for the convenience of the inhabitants here, nevertheless, amidst all this, it has further occurred to them: how on the one hand this mutual agreement of theirs indeed now gives a prospect of a lower purchase price for the slaughter wethers, but that on the other hand every one of them, the petitioners, still has a large quantity of wethers which had to be purchased at the previous price of two Rexds and more: that therefore, if either the livestock-owning country people themselves, or any private Cape inhabitants, encouraged by that arrangement made and the prospect of being able to obtain the wethers henceforth at the price of Twelve Schellingen, might be inclined likewise to take the butchery in hand, this would naturally tend to the marked prejudice and great detriment of the petitioners; for which reasons they, the petitioners, see themselves compelled humbly to request Your Right Honourable and Worships that during this current year permission to slaughter may be granted to no one else besides them, the petitioners: to the end that they, the petitioners, undertaking to continue to accommodate the inhabitants daily without any failure with fresh meat, may thereby remain in a position to remedy, through a more reasonable purchase towards the end of this year, the loss which they otherwise must suffer on the considerable number of dearly purchased slaughter wethers on their hands.
