Contract, whereby it was stipulated: that the said de Haan would provide a suitable pontoon across the Berg River, with which he would be able to transport loaded wagons and undamaged across the said river, as well as maintain the path to the Klein Berg River and its ford in a usable condition throughout the whole year, for which the said de Haan would receive annually from each person one mudde of corn, or such money as a mudde of corn was bought for by the Honorable Company. Which was further specified in a contract between the said Lord Landdrost and Heemraden with the burgher Jan Booyens in the year 1747 regarding the said pontoon, which he, Booyens, had acquired by purchase, entered into for one mudde of corn or eight Cape guilders. After which, in the year 1757, with the favorable consent of the high government aforesaid, a pontoon was likewise placed across the Breede River in this district, and it was contracted with the burgher Gideon van Zijl: that he would receive for it the same emoluments that the pontoon operator at the Berg River came to enjoy: However, in the year 1759, complaints having been made by the said van Zijl that many people refused to pay their pontoon monies granted to him by the Board; which, not to divert Your Honorable and worshipful assemblies with tedious accounts of important matters, was of such consequence that in the year 1762 the said pontoon was taken over by the Colony at the request of the aforementioned van Zijl; and in collecting these funds, very many difficulties and disputes arose between the two Colonies. Whereupon, in the year 1763, at the meeting of the Honorable Governor and worshipful Council, a request was presented by the Lord Landdrost and Heemraden of Stellenbosch and Drakenstein, in which they, among other things, clearly set forth and demonstrate: that that portion of the inhabitants who live toward the Roodezand side in this district, presently having no need to make use of the pontoon on the Berg River, nevertheless naturally cannot be considered exempt from having to pay for passing the Hottentots Holland and Roodezand Kloofs, both of which have been improved not without heavy expense and must still be kept in good repair: requesting finally: that it might please the same to interpose their authority, to the end that the pontoon keeper might be maintained in his rightful claims. Concerning which the report of the Landdrost and Heemraden here having been required and supplied to the same, on the order of the high aforesaid government a commission was held at Stellenbosch in the year 1764 by the Landdrost and Heemraden and secretaries of both Colonies; whereby the differences were settled in such manner: That this Colony shall pay annually to that of Stellenbosch for the use of the Hottentots Holland and note well Roodezand Kloof a sum of four hundred Cape guilders, provided that those who do not pay toward the pontoon that they use shall pay each time to the pontoon operator four shillings for a wagon and one shilling for a horse. Which agreement was then also approved as such by the aforementioned government. Now it is so, Right Honorable and worshipful Lords, that those persons who live between the Cogmans Kloof and Hex River, and who are largely the petitioners herein, because they can more conveniently pass the Berg than the Breede River, have been assessed at six Cape guilders instead of eight, in order thus to contribute to the maintenance of the Roodezand Kloof, for which this Colony, as aforesaid, pays 400 guilders annually. It is true that the petitioners offer to pay each time upon using the pontoons on the Breede River; however, this is in no way relevant, since this would only be a benefit for the pontoon operator, and not at all for the Colony. The undersigned having thus briefly shown not only the basis of their right to the pontoon monies, but also the notorious untruth of what was posited by the petitioners: that the same was imposed on them by the first undersigned as a novelty, will merely add a few remarks concerning the signatories of the request presented to Your Right Honorable and worshipful assemblies.

who will be ordered to pay the pontoon and other taxes make request, and have the honor to say: that Johannes Petrus Nortier and Jan Bastiaan Raure Christiaansz have never yet appeared on the list of pontoon taxes, and the same have never been demanded from them, much less paid by them; that Abraham Cilliers and Carel Marais, living on one farm, thus only one of them, namely the first-named, pays the pontoon tax or appears on the list; that Gerrit Cloete has already for several years been excused from paying the pontoon taxes; and therefore those people have not the least reason to complain about a burden that they do not bear, and it appears to us that they were merely recruited to artificially increase the number of signatories. Such conduct had surprised His Honor all the more since that arrest had moreover occurred without His Honor's prior knowledge regarding a person and at a place considered to belong under the department of His Honor's domestic retinue, and whereby His Honor thus finds the character of a governor to be not a little compromised, considering that such ought to be exercised with restraint even regarding one of the members of this Council. That although the said Pro Interim Fiscal, having been addressed by His Honor concerning this, acknowledged the impropriety of it It was subsequently further made known by the Governor that when His Honor at the last Burgher Exercise, both here at the Cape and at Stellenbosch, and His Honor, professing not to have foreseen the matter to that extent, had asked for forgiveness regarding this, wherewith His Honor declared to be willing to let this instance pass for this time; since, however, good order required that proper provision be made for this in the future, His Honor had deemed it necessary to submit the said case to this assembly for that purpose: which having been deliberated upon, it was resolved to enjoin the said Pro Interim Fiscal to conduct himself in the future with greater attentiveness according to the provisions of the Criminal Ordinance, and thereby to take into account that by no step of that nature in the future may the character of the Members of the Council, much less that of a Commander-in-Chief, be offended, and likewise to let this serve for the information of whoever shall come to hold that office in due course. with

Thursday the 2 Febr: 1786 In the forenoon, all present except Colonel Robbert Jacob Gordon. The Governor gave to know that he had called this meeting expressly for the purpose of proposing to the same that His Honour had observed with great pleasure the skill with which, among others, that part thereof which forms the Cavalry or dragoons, as people who are obliged thereto only once a year, came to perform the said exercise; His Honour, because of the great use which, by other means toward repelling an enemy landing, would have to be made of the same, had noticed that the broadswords with which they find themselves armed would, on such occasions, come to have virtually no effect. That His Honour, having spoken about this with the respective Captains and other officers of the Burgher Cavalry and dragoons, the same had made known their desire to be provided with suitable broadswords, and indeed such that, since in general the Burgher community takes pleasure in the neatness of their weapons and further equipment, the same broadswords might also be proportioned accordingly. That His Honour, being persuaded of this, knew of no kind of broadswords more suitable to satisfy both these purposes than such as are presently in use with the guard dragoons in The Hague. And since the said Governor came to propose to request a suitable number thereof from the Lords Major for the service of the Burgher Cavalry dragoons, it is therefore approved that upon the ordinary requisition there shall be petitioned a number of 1186 pieces of the aforesaid broadswords, namely: 42 pieces for the officers 94 pieces for the non-commissioned officers 1050 pieces for the privates with a separate most humble request to their Right Honourable High Mightinesses that this may be fulfilled in the speediest manner. The Governor communicates the case concerning a certain deserter of the Meuron Regiment named Robert. That His Honour, some days ago, had been informed how a certain soldier of the Swiss Regiment de Meuron named Robert, together with two other fellow soldiers of the same Regiment, having made themselves guilty of desertion, when the same were placed on trial for this before the Court-Martial, and the latter two also then received their sentence; the said soldier Robert, however, because he had put forward in his excuse that they had made him pay for a musket for the second time, although he had already paid for his first one, albeit unserviceable, and that testimony regarding this had also been given in the full court-martial by the quartermaster Luchain, because of the difficulties which the majority of the judges raised against sentencing on the accusation brought against the said Robert before the necessary information regarding that matter should have been obtained, had then also remained unsentenced. That he, the Governor, upon the reports which the Major of the Regiment came to convey to His Honour regarding the sessions held concerning that matter, having continuously held before him the fairness and legitimacy with which the said difficulties of the judges were accompanied, His Honour ought to have expected that Colonel de Meuron, being informed thereof, would not have hesitated, but on the contrary would have put to work such inquiries as could serve to clear away everything that could hinder the judges in delivering sentence; but that on the contrary he had to discover how the often-mentioned Colonel de Meuron had seen fit, just before the past Tuesday, or the 31 of the last past month of January, on which day with the foreknowledge and consent of him, the Governor, the said Colonel had intended to hold the Court-Martial, to cause to be arrested those fourteen officers who in the Court-Martial had formed the majority for the decision that, before sentencing, the necessary information regarding the presented excuse of the soldier Robert ought to be supplied to the Judges, and thus had been intending, with the exclusion of the same fourteen officers, to let the Court-Martial proceed. manner of proceeding maintained therein by Colonel de Meuron, with the submission of the written order dispatched by His Honour to the said Colonel. and having been informed of the unheard-of and unauthorized manner of proceeding, had asked Captain van Bonstetten, who was the eldest of the Captains of the Regiment present, and having received a confirming answer from the same, had thought it necessary for that reason to suspend the court martial at that time: all the more because His Honour came to learn that the aforementioned quartermaster Louchain had subsequently given a declaration before the commissioners concerning that matter, entirely contrary to what he, as said above, had deposed in pleno Judicio, so that His Honour, also for the aforementioned suspension of the Court Martial, had sent the written order to Colonel de Meuron by the Major of the Regiment in the following terms: Having been informed that Colonel de Meuron intends to proceed to a court martial to the exclusion of fourteen officers, who are under arrest for having raised a scruple, in a previous sitting of the court martial, about judging and pronouncing on a procedure which according to their opinion was not properly drawn up in form, regarding the soldier Robert, accused of desertion, who is said to have complained in the declarations of having paid for a second musket, the first having already been defective, as well as that quartermaster Luchain had made depositions regarding that matter in full court martial previously and afterwards privately, before Commissioners named subsequently; and as according to my information, these depositions are absolutely contradictory, they cannot therefore be admissible in either case, and for that reason were rejected by the majority of the said past court martial. These gentlemen therefore thought it their duty to suspend their judgment until complete information was obtained. And as these fourteen officers, by order of Colonel de Meuron, are to be excluded from the court martial: In consequence, I order Colonel de Meuron to suspend the court martial until the procedure is in proper form and completely drawn up, and leaves no further embarrassment to the judges. — Beneath stood: At the Castle of Good Hope, 31 Jan 1788. As the said Robert is convicted of desertion and theft, so that under our laws and those of the noble Company he cannot escape at least the galleys, I leave him in prison until our masters have enabled you to know in what form one must pronounce upon his further fate. and decided to order to act therein according to law and the prescription of the rules of the Swiss Regiment in force, Caroline ordinance, Paris edition, folio 134 on article 108, page 171, reading: in the inquiries made against a soldier accused of desertion, there are four principal heads to examine: 1st, the causes of his desertion, namely, what drove him to this act, whether he received his pay punctually, etc. that as regards the right to which Colonel de Meuron appeals, as if it belongs to him alone to have the inquiry made, and to the superior judge to accept it, no attempt has been made to deprive either of them of anything in that respect, provided the inquiry is in all respects properly conducted and satisfies the requirements of the law. that neither with the protest that the Colonel follows this with, and the accompanying notification of his intention to send to the Lords Majors the judicial proceedings and all the documents relating to this case, nor with the detention in custody of the soldier Robert until the disposition of the aforementioned Lords Majors shall have been received, would any service be done to Justice, nor would the intention of these our Lords and Masters be answered. And since, on the contrary, both good order in the aforesaid Regiment and the general welfare are in the highest degree dependent upon Criminal Justice taking its course, and crimes being punished properly. Therefore, it was resolved to order the said Colonel de Meuron, as he is hereby ordered with the delivery of an Extract hereof, without the least further delay, to reconvene the court-martial with the combination of the aforementioned fourteen officers illegally excluded therefrom for the trial of the repeatedly mentioned soldier Robert; and thereby to have the said court-martial fully instructed regarding all the points about which it, or rather the dissenting majority, comes to desire the information: so that by them, as is fitting for all well-disposed Judges, a judgment may be rendered with complete peace of conscience, resting upon law and equity, and by no means depending upon an informal and untenable manner of proceeding. By Christoph Otto van Kamptz, it was declared to the meeting that he, having considered the offer made by the Merchant and Dispenser, the Honorable Adriaan van Schoor, in the name and on behalf of this Council, to pay him from the Company's Treasury a sum of Ten thousand Rixdollars for his place situated behind the Kloof of the Lion's Head and Table Mountain, was finally ready and inclined to accept the said offer, and thus to sell and cede the said place to the Honorable Company for that amount; on the condition that the aforesaid sum, together with whatever he shall make at the sale of his remaining household effects to be held shortly (estimated at most to amount to an amount of Twenty thousand Cape guilders), shall be accepted into the Company's Treasury for remittance to the fatherland, to be paid to him by bill of exchange after the conclusion of the autumn sales of this year. Requesting at the same time that he might be permitted to maintain his residence on the aforesaid place until the end of the coming month of April, and in the meantime to make use of what it produces, so far as he needs for his own household, and finally, that permission might be granted to him to depart with his wife for the Fatherland on one of the return ships of this year. Whereupon the purchase of the aforesaid place for the said sum of Ten thousand Rixdollars with the aforementioned van Kamptz having been finally concluded under the aforementioned condition, it was further granted to him both to maintain his residence on the said place until the end of April next, and in that intermediate time to consume its produce for the benefit of his household, in so far as is necessary for that purpose, as well as to depart from here for the fatherland with his wife, provided he pays the established transport and board money for that purpose, for which latter, at the express insistence of him, van Kamptz, all possible care will be taken so that this may take place with one of the ships of our nation returning in this year on which a suitable opportunity for it shall present itself.

And it was noted hereupon that the Lords Majors, in their most respected letter of 5 December 1783, were pleased to consider that since a sufficient number of copies of the compilation of a general placard and necessary instructions ordered therein could, as soon as it had been finalized, be printed in the Fatherland and sent hither, it was not necessary to expose the Honorable Company to the expenses of a printing press here, and that thus only the frequent copying of those documents at the secretariat would be spared; yet their Right Honorable Worships could in no way see that the establishment of a printing press here would be of such necessity to save a greater burden for the Honorable Company. The petitioner further takes the liberty of petitioning your Right Honorable, Severe and Respectable Sirs that, since on the occasion of this his return he is under the necessity of transferring his money present here, or a part thereof, to the Netherlands in a suitable and secure manner, your Right Honorable, Severe and Respectable Sirs may likewise graciously permit the petitioner to pay provisionally into the Company's treasury here a sum of twenty thousand Rixdollars, to be repaid to him again upon assignment in the fatherland; as the foundation for which request the petitioner takes the boldness to observe that during the long years which he has resided at this remote corner, he has almost never paid an amount of any consequence into the aforesaid treasury, but on the contrary has always managed most carefully to avoid troubling the Honorable Company in this matter; wherefore the petitioner dares flatter himself that your Right Honorable, Severe and Respectable Sirs will, for those reasons, be pleased to have a favorable regard for his petition in this matter. The Lord Governor communicates having granted leave to Europe to the Lord Colonel de Meuron, as also by what means His Honour has deliberated to provide for the prevailing scarcity of grain, to which end some proposals were made by the Burgher Lieutenant Johannes Gysbertus van Reenen, according to the annexed document; and to encourage the cultivation of grain further inland in remote districts. Having made the aforementioned request for a convoy, His Honour was at the same time informed of the time at which the said return ships will be ready for their departure. Furthermore, the Lord Governor made known to the assembly that, since the Count de Meuron, Colonel of the Swiss Regiment of that name garrisoned here, had long since insisted to His Honour for a leave of eighteen months in order to proceed to Europe for the transaction of some private affairs, His Honour could no longer refuse this, and that the said Lord Colonel was accordingly to depart shortly for the motherland on a convenient occasion for the said period. The Lord Governor also made known that, in view of the above-mentioned prevailing great scarcity of wheat and the well-founded fear of falling into a general bread shortage after the lapse of a few months, His Honour, having considered what means could be undertaken to provide for this in the best and speediest manner, had conceived the thought that among some of the inhabitants living far inland there might well be a greater supply on hand than their own necessity requires, but that to obtain it here the costs of ordinary transport run too high for one to expect any supply of that nature from the said inhabitants by that route; and concerning the grain situated around Mossel Bay, that whereas for this reason it would be necessary to send a ship or vessel to one of the eastern bays to fetch the said grain, yet one ought first to have some certainty in order not to expend useless costs, both for that purpose and regarding the cultivation of grain, which one had already intended to encourage further inland in the course of time, some proposals had been made to His Honour by the Burgher Lieutenant Johannes Gysbertus van Reenen, contained in a writing from the said van Reenen which His Honour presented to the assembly, being of the following content: To the Right Honourable Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its dependencies, etc., etc., etc. Right Honourable Sir, The undersigned Johannes Gysbertus van Reenen, burgher and resident here, having been proposed by Your Right Honour to undertake a journey over the mountain in order to inquire most accurately among the farmers residing there what quantity of grain is still on hand among them, and how much of it they could spare for the convenience of the Cape settlement and its environs, and to purchase the grain to be spared by them to the greatest advantage for the Honourable Company, in order thereby, if possible, somewhat to prevent, or at least alleviate, the otherwise dreaded scarcity and the general shortage of wheat; as well as to inspect carefully which places in those regions would be the most suitable and fit for the cultivation of that indispensable grain, and to encourage the farmers thereto, and to report on his findings. That however much the undersigned's household circumstances and affairs absolutely require his presence here, the undersigned nevertheless did not wish to decline accepting the favourable proposal made to him by Your Right Honour, all the more because he believes that the welfare of the colony depends not a little on the supply of that grain. The undersigned, being prepared to undertake this journey as soon as possible at his own expense, will take the liberty to submit to Your Right Honour's consideration: That, since the feeble condition in which the undersigned has found himself for a considerable time now would make it entirely impossible for him to cover such a long ride on horseback, and moreover that expedition could not then take place with that dispatch which the colony's interests require, and which can be effected with an ox wagon; the undersigned will therefore provide himself with an ox wagon with a span of oxen, which will transport him to the nearest neighbourhood from here, and since that journey can be continued with greater speed if one can each time inspan a fresh and unfatigued span of oxen.

to span in, and it would not be burdensome to the farmer if each of them, wherever the undersigned arrives, provided him with a team of draft animals, at least to the nearest adjacent places; those who cannot do so without causing themselves considerable harm being capable of being properly indemnified. Requesting therefore very humbly that Your Right Honourable Sir might have the goodness to make such arrangements therein as Your Right Honourable Sir's thorough knowledge shall deem appropriate, and to grant the undersigned an order to be transported by each farmer with the greatest speed from one place to another. The undersigned furthermore takes the liberty to submit to the consideration of Your Right Honourable Sir whether it would not serve to hasten this expedition that the two Heemraden of Swellendam granted to him for his assistance might also, by an authentic copy of the undersigned's instruction, be authorized to carry out the purchase of grain among the farmers as well, and to encourage them in the cultivation of grains, because, being provided with such an instruction, they could make purchases apart from the undersigned and thus expedite the journey with greater speed; by which the one riding eastward and the other westward could quickly fulfill the intention, and designate a place to meet with each other. Which instruction the undersigned hopes will contain an authorization to purchase such quantity of grain for the Honourable Company at the lowest price as Your Right Honourable Sir shall deem necessary and proper, or as one will be able to obtain, as well as what proposals and allowances the undersigned may make to those country people in the name of Your Right Honourable Sir for the cultivation of grains, in order to encourage them all the more thereby, everything to take place in consultation with both Heemraden. The undersigned also requests to be informed, in case the quantity of grain to be purchased might not be worth the trouble of being collected by a ship from Mosselbaaij, and in such case had to be transported hither by wagon, how much shall then have to be paid for a load of grain, because the country people cannot recoup the expenses of making such a heavy journey if they receive no more than Ryxd:s 40 for the freight. The undersigned, in case the purchase of those grains should fail to meet expectations, or should not be worth the trouble, will immediately, without the least delay, report thereof via Swellendam to Your Right Honourable Sir, and nevertheless proceed on his further journey for the encouragement of the farmer and the contracting of such engagements as may serve the benefit of the Honourable Company and Colony. and at what prices they have approximately been set, and the measures that will be taken to encourage the inhabitants at Mossel Bay and Plettenberg Bay toward the cultivation of grains, rye, barley, peas, or beans they can spare, how great the quantity of each of those grains they can spare is, and whether they would be inclined to deliver the same to Mossel Bay, as being the most conveniently situated for that purpose. And that in case sufficient certainty can be obtained to procure at least the quantity of 500 mudden of those various grains, the same delegates shall be able to agree with the aforesaid inhabitants on behalf of the Company, for that amount and for as much more, even were it 6,000 mudden, on account of the aforesaid scarcity, and for the reason that such will more or less be surrendered from their own needs to alleviate that scarcity, at the following prices currently paid by the Company, namely: One mud of wheat at twelve Cape guilders One mud of rye at seven Cape guilders One mud of barley at four Cape guilders One mud of peas at fifteen Cape guilders One mud of beans at twelve Cape guilders provided that each person undertakes to deliver his specified quantity, well cleaned, there at the end of the coming month of May, or whatever terms may be deemed favorable for safely dispatching a ship or vessel to the aforesaid bay, subject only to the usual deduction of the legal tithe for the Company. And that pursuant to the recently received written instructions from the High-Ruling Lords Masters, six commissioners, in an equal number from among the Company's servants and the burghers, shall be appointed to regulate annually, with the approval of this Council, the prices of those products, as well as the demurrage for the ships or vessels that will be employed to collect the same. While, in order to provide as much as possible for such of those country people as may lack the iron tools required for grain farming, it has been approved, as soon as their desire for it has been ascertained, to have some plowshares and other necessary ironwork manufactured in the first instance, whether by private individuals or at the Company's smithies, to be collected by them or sent to them with the ship or vessel to be dispatched, in order to serve as an advance to the suppliers of the grains on the account of the products to be delivered by them. That this Sodokus de Bakker, having arrived in Europe on a private French ship chartered for the Honourable Company, entered anew into the service of the Honourable Company as a cooper, but under the assumed name of Pieter Bachland; furthermore, that he recently arrived here once again on the ship Ridderkerk, and upon his arrival, having been very quickly recognized on shore, the undersigned, to whose knowledge this was immediately brought, provisionally caused the said Pieter Bachland to be arrested as a deserter, with the intention of proceeding against him in a criminal case ex officio in conformity with the existing laws regarding this matter. That the undersigned considered himself all the more obliged to do this because, upon further inquiry, the prisoner was not found to be of the best reputation, and someone who has attempted to desert on several occasions, just as the change of name cannot speak in his favour either, and in such premeditated and deliberately committed crimes, showing leniency would certainly give occasion to bad consequences. But because the aforesaid ship would thereby be deprived of its cooper, and another cannot easily and without disadvantage be spared from here in his place, the undersigned believes, subject to your Right Honourable and Honourable Sirs' better judgement, no less that through the strict enforcement of the laws in the present case the beneficial objective of the High Indian Government might not be completely fulfilled, and that, on account of the general shortage of craftsmen, it would be far more in accordance with the intention of the same and with the interest of the Honourable Company to apply an extraordinary punishment at the discretion of your Right Honourable and Honourable Sirs according to the actual circumstances in such cases. It was resolved, with respect to the first main part concerning the policy, most respectfully to thank the most highly mentioned Lords Masters on behalf of the Lords Members of this Council Adriaan van Schoor and Mr. Jacobus Johannes Le Sueur, having according to the aforesaid disposition received the title and rank of senior merchant, for this favourable decision. Whereafter, upon the requisition of the Lord Governor, the fellow member and secretary of this Council Olof Godlieb de Wet having stepped outside, the well-mentioned Lord Governor proposed to the remaining members: That whereas from the aforesaid order of the Lords Masters it appeared how the same, having seen fit to grant each of the members who are not senior merchants the rank and title of the same quality, and also in respect of the former fellow member and secretary the late Mr. Olof Marthini Bergh to dispose in that same favourable manner; but that their Right Honours have nevertheless pleased to determine that at the first vacancy of the office of secretary, the person who is promoted to the same shall only be permitted to have the quality and rank of merchant, and that also upon such an appointment of another Secretary, the same would no longer be given a vote in the Council of Policy, and that he would consequently only be secretary, without at the same time being a Councillor. in regard to which the Lords Majores will likewise be pleased to favor him with the title and rank of senior merchant, which rank and title the said Mr. de Wet shall provisionally hold. According to his honor's understanding, the Colony could benefit from his service, he having taken upon himself the secretariat of this Council, of which the dignity of Councilor was at that time not yet separated, and at that time, as it was deemed necessary, was also added to the said Mr. de Wet. So that, since the same High and Mighty Lords Masters have also been pleased to qualify this Council, if there should be weighty objections to any points that their Right Honorable High Mightinesses have seen fit to decree, which would advise against the execution of the orders laid down in the aforementioned dispatch, then to bring the same to the notice of their Right Honorable High Mightinesses before putting that order into execution. And it cannot be understood to agree with the intention of their Right Honorable High Mightinesses, if that same fidelity demonstrated by the often-mentioned Mr. de Wet in the discharge of that difficult office were to be answered with his humiliation, as the deprivation of his co-membership would undeniably cause him; whereas on the contrary it may be expected that their Right Honorable High Mightinesses, having learned how the said Mr. de Wet had already been appointed as a voting member prior to the receipt of their most noble dispatch, will, for the aforementioned reasons, wish to grant him a share in their favorable disposition just as the other members. The well-mentioned Lord Governor, for the reasons set forth above, was of the opinion that a further representation to the High and Mighty Lords Masters ought to be made concerning him; with which the remaining gentlemen members of the Council having fully concurred, it was resolved respectfully to request the most noble Lords Majores by a separate dispatch, presenting the foregoing, that it may please their high mightinesses, upon approving his appointment as member and secretary of this Council, to favor the often-mentioned Mr. de Wet, just as the other members, with the rank and title of senior merchant, under the salary and emoluments of a merchant. While it is understood that, pending their Right Honorable High Mightinesses' disposition in this regard, and to place the same Mr. de Wet outside of any distinction or exception that might be made between him and the other members of this Council on account of his lack of the aforementioned title and rank—since on the aforementioned grounds one believes oneself justified in anticipating nothing other than a favorable disposition from their Right Honorable High Mightinesses—he shall provisionally be permitted to enjoy the title and rank of senior merchant. After which the aforementioned Mr. de Wet, having re-entered and having been informed of the aforementioned resolution, expressed his gratitude to the assembly for the favorable sentiments toward him and for this provisional arrangement. And that, because such cases can only occur very rarely, as the number of the Reformed by far surpasses that of the Lutherans, their Right Honourable Worships will be most humbly requested that the aforementioned order might be restricted to such an extent, and that on rare occasions, in which much confusion might otherwise arise through the complete adherence to the frequently mentioned order, and moreover, in order not to discourage those of the Lutheran denomination who are of irreproachable conduct and at the same time excel in zeal and loyalty for the interests of the Company, but on the contrary to awaken more and more emulation among the servants, freedom may be left to deviate from it upon complete conviction of the necessity thereof. Furthermore, in order to respond to the aforementioned disposition of their Right Honourable Worships with respect to the second main part concerning justice, it was resolved to have delivered to the Council of Justice for their information an extract of the aforementioned missive, in so far as it concerns them and the function of the commissioners to be appointed from among them, and also of what their Right Honourable Worships have understood and decided regarding the dispute that had arisen between the same Council of Justice and the then pro interim and subsequently Independent Fiscal, Mr. Jan Jacob Serrurier; together with a copy of the instruction further established by their Right Honourable Worships for the Independent Fiscal of this government; and likewise an extract of what their Right Honourable Worships have thought fit to dispose upon the request of Anthonij Krynauw. Furthermore, as according to the intention of the aforementioned decree of the Lords Masters, Colonel Robbert Jacob Gordon, as well as the members of this Council Adriaan van Schoor and Olof Godlieb de Wet, together with the military captain Lodewijk Christoph Warnecke, shall in future no longer have a seat on the Council of Justice, and thus, besides the Secunde Pieter Hacker as President, and the Independent Fiscal for the time being, only four members who are Company servants remain, for the completion of the determined number of members in the same Council, from the Company servants is furthermore appointed the Junior Merchant and superintendent of the timber magazine William Ferdinand van Rheede van Oudshoorn, with the rank and title of Merchant assigned by the aforementioned Lords Masters to all the members of that Council.
