who has made an offer to assist the Honorable Company with some grain, provided that the continuation of the brewery being granted due to the lack of roof thatch, it was further resolved for the future to stipulate that no beer lessee shall be permitted to accept any other beverage excise to come to a halt, if in proportion to the remaining time of the lease, an equitable reduction of the lease money percentage was granted to the lessee; but that since the people who had established themselves in retailing the aforementioned beer by small measure, would find themselves injured in their meager livelihood and take up something else, whereby in time very much damage would have to be brought both to the aforementioned brewery and to the lease of that beer; the said Van Reenen had offered that, if the continuation of the brewery could be granted, to cede to the Honorable Company 100 mudden of the barley which he had purchased in reserve for that purpose, and also further to assist the Honorable Company with as much wheat as he would be able to spare after making a calculation of the utmost necessary for his household, in addition to another 100 mudden of that grain which were in negotiation by him with the burgher farmer Jacobus Louw Adriaansz, if the same might still be on hand; whereupon, after consideration of all of this, it was approved to let the aforementioned brewery proceed under the said offered and in every way judged very reasonable conditions. And out of consideration thereof, and in order to preserve the aforementioned brewery against all prejudice that might be attempted thereto by one or another lessee of the public revenues, it is also resolved that at the upcoming leasing of the Cape malt beer and thereafter annually it shall be expressly stipulated that no lessee of the same shall at the same time be able or allowed to be the lessee of any other beverages. And for the further reasons mentioned here adjoining, while the burgher Van den Berg has offered for sale to the Honorable Company a very good warehouse and adjacent spacious land, the Chief Administrator, Mr. P. Hacker, was qualified for the purchase of butter at 10 pence per pound, and on further occasions more other warehouses shall be purchased on the Company's behalf, the members of the Council named at the side being qualified to enter into an agreement with the burgher Jacobus van den Berg for his warehouse, Furthermore, taking into consideration that by the sale of the warehouses which the Honorable Company has had on lease from the repatriated Dispenser, Mr. Adriaan van Schoor, one would be greatly impeded in case an opportunity might arise during an opulent grain harvest to collect any reserve, since the said warehouses together with the dwelling house of the said Mr. Van Schoor, as a wine merchant, the burgher Jacobus Johannes van den Berg intended after the ultimo of August next, until which time the Company still had the lease thereof, to employ those warehouses for his own use; the more so because one has neither time to spare nor sufficient laborers on hand to undertake the construction of the required considerable warehouses, while above all this, even if such impediment did not exist, the construction of the warehouses would not cost the Company much cheaper than if one or another opportunity to buy them from private persons might present itself; it is therefore judged best to provide the Company, the sooner the better, with the necessarily required warehouses instead of the aforementioned warehouses that will be missed; and since the aforesaid burgher Van den Berg has again come to offer for sale a two-story warehouse newly built by him, of a length of circa 100 feet and two separate rooms, with the spacious ground belonging thereto, standing and situated at the upper end of the Cape settlement, which buildings upon examination are found not only to be of very good construction and well situated for distinct uses on behalf of the Company, but that the ground has a suitable space to be able to construct more warehouses or other necessary buildings thereon, for which parcel the said Van den Berg was demanding a sum of 40,000 Cape guilders; it is resolved to expressly commission and qualify the gentlemen members of this Council, Oloff Godlieb de Wet and Tobias Christiaan Rönnenkamp, to purchase the aforementioned warehouse buildings together with their land from the above-mentioned Van den Berg on the Company's behalf at such price as can best be agreed upon in that regard, and that furthermore on more other occurring occasions one will attempt in like manner to acquire for the aforementioned purpose some more suitable warehouses here for the Honorable Company, if capable. Finally, on the representation made by the Chief Administrator, Mr. Pieter Hacker, that because of the high price of foodstuffs no butter was to be obtained for the Honorable Company for less than 10 stivers per pound, it was approved to authorize the said Chief Administrator for its purchase as far as such might be necessary.

Decision to take into the Honourable Company's service 52 men from the wrecked French ship Holland. and also to qualify him, if it should be necessary as President, at the said price, and also to buy in his capacity as President of the Court of Justice, for the service of that body, all such books that may be of service and use to the administration of justice. Thus resolved and decided in the Castle of Good Hope on the days [illegible] Was signed: C. J. van de Graaff, P. Hacker, R. J. Gordon, J. J. Le Sueur, O. G. de Wet, and P. C. Ronnenkamp. Saturday the 20th of May 1786. All present. The Governor having been pleased to inform the meeting that a large number of crew members from the wrecked National ship Holland had arrived here overland, a portion of whom, by order of the Commander Silvester, had been returned to False Bay under the escort of an officer appointed by his Honour for that purpose, while fifty-three of the said crew members were still present here, namely forty-six sailors and seven soldiers, all willing to engage in the Company's service at such monthly wages as they had earned with the State. That correspondence having been entered into with the aforementioned Commander Silvester regarding this matter, his Honour had declared that, since no use could be made of these crew members for the State's service, they could be disposed of for the service of the Honourable Company; it has therefore been approved and understood to take the said 53 men into the service of the Honourable Company. Underneath stood: Received by the Governor and communicated to the meeting, Thursday the 25th of May 1786, in the forenoon, all present. Letter from the Commander of the National Squadron, Commander Silvester, in which important demands are made for the ships Goes and Juno, but which can impossible be fully satisfied. Being a letter from Willem Silvester, as Commander of the National Squadron bound for the Indies, presently at False Bay together with the two National ships Goes and Juno returning from the Indies. By which letter the aforementioned Commander indicated that the said two ships Goes and Juno required an astonishing quantity of all kinds of necessities and would not be able to continue the voyage if no means of repair were found; while merely noting that the ship Goes required virtually an entire standing and running rigging, and that his Honour feared the warehouses would not be well stocked, he also proposed to make a virtue of necessity and to unload all the timber laden therein for Batavia, both from the flute De Vrede en Vrijheid lying ready in the aforementioned Bay and from the ship Neptunus. Upon examination of the list of equipment goods that the aforementioned Commander Silvester, alongside several other different necessities, demands in large quantities for the said ship Juno alone, and which, insofar as the ship's rigging was concerned, the aforementioned Governor had caused to be verified by the Equippage Master in order to know to what extent this could be complied with, it appears that several articles among them are already lacking in the Company's warehouses, and that rendering this assistance to the aforementioned ship Juno alone—whereby provisionally one of the heavy cables unloaded for this Government from the aforementioned ship De Vrede en Vrijheid had to be supplied to the ship Goes on the occasion that one of its heavy cables parted in the aforementioned bay—together with the equipment goods already supplied to the two National ships Utrecht and Wassenaar that passed through earlier to further their homeward voyage, will not only leave the Company's warehouses here so depleted and further emptied that, should the Company's ships happen to appear here in absolute need of such items, one will be utterly unable to

And since for that reason it could by no means be deemed advisable for the present to accede fully to the aforementioned proposal of the well-mentioned Lord Commander Silvester, yet both the distressed circumstances of the extreme lack of bread here, as well as the State's service require that the two aforementioned ships Goes and Juno are not placed in the necessity of having to remain here to winter through want of their necessities, it has, after careful deliberation on this matter, been thought best, in order at least to be able to assist the frequently-mentioned ship Juno for the present to further its voyage, Upon resumption of the lists of necessities for the State's frigate Juno, sent by Mr. Silvester as Commander of the State's squadron to the Lord Governor along with those of the ship's necessities for the same frigate, on which latter the necessary decisions had already been made in the meeting of the 26th of this month, Tuesday the 30th of May 1786 In the forenoon, all present Thus resolved and determined in the Castle of Good Hope on the day and year aforesaid. Yet since the extreme lack of bread, which we ourselves feel not without very grave concern, absolutely prevents the giving away of even the least of the small remaining surplus, it has been thought best to commission and authorize the fellow member of this meeting, Mr. Tobias Christiaan Rönnenkamp, to proceed in person to False Bay, in order to confer with the aforementioned Lord Commander Silvester whether any means could be found to provide in that crucial article, and to put into effect in that regard whatever shall be deemed best. On the occasion that the two Company return ships, the Africaan and Het Slot ter Hooge, are currently in the aforesaid False Bay, and will as speedily as possible be repaired of the damages sustained and made ready to continue the voyage further to the Fatherland, it having been taken into consideration by the Lord Governor whether, since no more ships of the Company are expected from the Indies for the return of this year, it might be expedient for their protection against hostile enterprises to request the convoy of the State's ships; It was, after deliberating on this, approved to request the well-mentioned Lord Commander Silvester that, if the aforementioned ships might yet be made ready in good time, as all possible efforts shall be applied thereto on account of the passing of the good season, to sail together with one of the State's ships, provided they are not detained too long for the reasons mentioned, to await the departure of

To diminish the ordinary refreshments to the Squadron. difference occurred in the readiness of the ships, about which His Honour would speak further with the Lord Governor, and subsequently upon His Honour's arrival at the Cape had been pleased to declare orally that, since the ship the Meermin, which had already departed from here for the Baay Fals on the 30th of the past month of May, laden with the necessary provisions both for the Company's and Country's ships there, had not yet appeared, and the dispatch of the Country's ships was also solely dependent thereon, he would be able positively to determine, as soon as that vessel should have arrived in the aforesaid bay, when the Country's frigate the Juno, being the first to be brought into readiness, would be able to depart. And it was therefore resolved to continue to await for a few days more the arrival of the aforesaid ship the Meermin in the aforesaid bay. Whereupon by the Senior Merchant and Dispenser Mr. Tobias Christiaan Ronnenkamp it was reported, following the resolution taken at the last session, that His Honour, having proceeded to the Baaij Fals in order to confer with the aforementioned Mr. Commander Silvester as to whether any means could be found to provide for the requests made for bread for the country's frigate Juno, had found in that regard that to enable the said frigate to depart, it would be necessary to supply at least Two Thousand pounds of hard bread, besides 10 mudden of Peas and Beans and 50 head of live sheep; that furthermore, because the country's ship Goes also required a considerable quantity of hard bread, the Captain of that vessel had been pleased to be satisfied if instead thereof he could obtain 10000 pounds of rice, 15 mudden of Peas and Beans and live sheep; which provisions for the said two Country's ships it was consequently approved to have supplied to them. The remarks that their Right Honorable Worships were pleased to make regarding the conduct concerning the ships Middelburg, Honcoop, de Paarl, Hoog-Carspel, and de Dankbaarheid, which were lying in Saldanha Bay and lost there; the long delay of the reports concerning this without providing the slightest reason therefor; as well as the manner of answering the questions proposed on the 13th of the year 1782 regarding the unloading of the aforesaid ships; the insufficient grounds brought forward as an excuse for the disorders that took place at that time; and the reasons brought forward as an excuse for the directors of the measures taken for the protection of the aforesaid ships lying in Saldanha Bay, it was resolved to keep constantly in mind, in order to serve us as a rule and guideline to handle matters in the future with greater deliberation, on surer grounds, and with the required exactness. Concerning what their Right Honorable Worships have further seen fit to remark upon the negligence brought forward by us of the commander of the hooker De Snelheid, which was also lying in Saldanha Bay at that time, in executing the order so clearly given to him to set fire to the said hooker in order thereby, if not completely to prevent, at least to make it very difficult for the enemy to carry off the aforesaid ships; when a detailed account regarding the taking of four of the aforesaid ships by the enemy and the burning of the fifth had been received by the Council here, and it was thereupon resolved to place the said account into the hands of the Fiscal in order to conduct an exact investigation into how far the officers of those ships had or had not complied with their duty, the said Fiscal was naturally led to the discovery of the thoroughly punishable neglect of the aforesaid commander to set fire to the frequently mentioned hooker according to the order given to him, so that the enemy managed to recover the sails from it and employ them to carry off the mentioned four ships.

and having been deported by the Council of Justice, as well as having appealed from that sentence to Batavia and having been restored there, no copy of that sentence has yet been received here, as well as having been referred to the aforesaid Lord Fiscal Boers for restitution of the legal costs, has died. That he, the Lord Fiscal, having already been mandated by this Council, upon finding the officers of the said four ships guilty, to prosecute the same before the Council of Justice here, also could not dispense with taking up the case of the aforementioned Commander, as being connected with that of the other ship's officers, and proceeding against him in that regard for the prosecution of punishment, without awaiting anew a mandate from the Council for that purpose, as was indeed carried out by him, the Lord Fiscal, with the result that the aforementioned Commander, named Roelof Pieterse, by sentence of the Council of Justice was deported from his rank and capacity which he held in the service of the Honorable Company, and declared unfit and incapable ever to be employed again in the same service, with confiscation of all his earned wages and pay standing to his credit, and condemnation in the costs of that trial. To report by our humble letter of 30 June 1784 the trouble of the leakage by which the officers were forced to turn back, and on which occasion the ship ran ashore, occurred on the voyage thither, and thus before the beams were loaded into it or the cargo ports opened for that purpose, so that we, under respectful correction, believe that no supposition could be made as if a lack of attention in re-fitting the cargo ports should have given occasion thereto, but that the poor condition of the ship itself was the cause thereof, as appears more closely from the investigation conducted in that regard, of which the liberty will be taken to offer copies of the documents to Your Right Honourable Worships at the same time, as, according to the report of the nautical experts, a severe leakage was already discovered upon reaching the sea; and, while the wind daily continued with a storm from the southeast, the main seams of the ship opened on all sides due to heavy working, whereby the leakages increased hand over hand. That concerning the treatment of the sick and the crew of the ship De Schelde and the investigation whether and to what extent the officers thereof complied with the orders in that regard, we trust that the copy of the report submitted by the late Independent Fiscal and the Master of Equipage, together with both chief surgeons of this government, sent to the presiding Chamber of Zeeland with our respectful letter of 12 February of the past year per De Vrede en Vrijheid, will have since answered Your Right Honourable Worships' expectations. That regarding the poor condition of the pork and meat sent with the Java in the year 1782 to Batavia, it will be noted that, since upon the urgent requisition of Their Excellencies the High Indian Government in the late part of the year 1782 to be promptly provided therewith, we were forced to have the salting done in the middle of summer, being the most unfavourable season of the year for it, the spoilage can also not be attributed to anything other 227 as also of the mortality among that of the year 1785 of the slaves brought here from Mozambique. To the knowledge of which people the treatment of the ship's officers must contribute more. than to that, the salted pork and meat having been sent with the aforementioned vessel to Batavia in May of the following year 1783, while, moreover, merely to be helped under the circumstances that then prevailed, all choosiness with regard to the meat itself had to be set aside. That the pleasure which Your Right Honourable Worships were pleased to take in the resumption of the slave trade served as a very agreeable satisfaction to us, and that we therefore wholeheartedly wished that the outcome thereof might have answered the purpose, but as that first resumption upon the arrival at the beginning of the year 1785 had succeeded so unhappily that the profits of this undertaking were then for the greatest part absorbed, yet the mortality among the slaves had principally taken place before the ship De Meermin had left Mozambique, and the cause of the disease with which the remaining slaves were subsequently also infected was to be deduced from that which had already come to reside among them prior to the purchase, in our view an improvement and investigation in that regard would have been very difficult and enigmatic, so as to be able to devise any measures against it for the future with sufficient certainty. That since experience has taught that the preservation of health among those slaves depends mostly on the treatment of the ship's officers who have had the opportunity to learn to know the nature, constitution, way of life, and customary food of such people, just as we have had reason to rely upon the management in that regard of Captain Dieminij, it has also appeared afterwards by the fortunate outcome of the subsequent voyage, of which we had the honour to report in our humble letter of 4 March last, that the frequently mentioned disease and great mortality on the previous voyage were accidentally caused by the infections prior to the embarkation.

Report on the reasons adduced by the owners of Constantia regarding their wines, and further considerations concerning the requisitioning of all or a part of the same for the Honorable Company. It was nevertheless understood that, in order to be able to prescribe a suitable rule in the future for the preservation or restoration of the health of the slaves, an accurate statement of all such means as he shall judge serviceable and fit shall be demanded from the aforesaid Captain and current Equipment Master Diemeny, as having the best experience in that trade, so that these can be ordered and put into effect to that end, in order that, when the present shortage of provisions may happily be remedied and the slave trade can be undertaken again, such use will be made thereof as was judged necessary and best. And along with this, to charge the Fiscal and Equipment Master, upon the resumption of that trade and the return of the vessel sent out for that purpose, to conduct a strict investigation each time into the causes and mortality among the slaves, and whether in all respects such and other suitable means as shall be prescribed for that purpose have been observed and put into effect for their preservation. Regarding the item of the Constantia wine, and in order both to inform the Right Honorable Gentlemen to what extent the reasons adduced by the owners of the estates at Constantia, Hendrik Cloete and Nicolaas Colijn, appear acceptable to us, and at the same time to dutifully disclose our considerations as to how it would be best to act regarding the requisitioning of the Constantia wines to the greatest profit for the Honorable Company, it was approved, concerning the first point, to declare that it cannot be endorsed that everything adduced by the first-named owner, Hendrik Cloete, in his objection is to be accepted in as broad a sense as he has made it appear. Although, on the other hand, it cannot be denied that when he, Cloete, became the owner of the estate that constitutes the largest part of Constantia, since both the buildings and the vineyards and orchards had been neglected to a very great extent, he, by applying considerable expense, care, and effort, has now brought that estate into a very advantageous state; and that also truly the multitude of destructive insects to which the estates there are more subject than elsewhere necessarily require, continually, before the vineyard even shows its first bud until the grape is cut and brought into the winepress, a large number of slaves to search them thoroughly and thus preserve the grape from its destruction. That likewise, for the preparation of the Constantia wine, since the grape requires a greater ripeness than is observed here regarding all other wines, this causes a lesser amount of liquid, which thus also brings about a great difference in the quantity of the wines; but that in addition it cannot be denied that, apart from the said Cloete, due to the capable means he possessed for it, very few could have been found who would have been in a position to restore the said estate to its present state; and that the second-named Nicolaas Colijn, or the owner of the smaller portion of Constantia, indeed finds himself in that situation as has been stated by him. That with respect to the second point, we find ourselves obliged very respectfully to disclose to the Right Honorable Gentlemen that if the owners of Constantia were obliged to deliver all their wines, or indeed the largest part thereof, to the Company for the price set on them, this would involve a hardship for them as well as have a detrimental effect on the Honorable Company. Which will be regarded as having a detrimental influence on the affairs of this government, and why the aforementioned owners have not for the present been forced into any large deliveries. The price paid for those wines can also not be proportioned to that, the more so because all foreign nations passing here on their way to Europe use all manner of flattering means to obtain those wines from the owners, and at the same time pay very high prices, which have now already risen to 80 piasters in ringing coin for the half aam of both white and red; which high prices the said owners also consider as sweetening what is paid to them on behalf of the Company, and therefore still willingly undergo the great difference in the Honorable Company's price, as long as it is not demanded of them to make deliveries to the Company to their palpable detriment. That their Right Worshipful Nobilities will therefore also easily grasp what a detrimental influence it would have on the affairs of this government if one were to proceed to obstruct the sale to foreign nations, especially in the present juncture, of such a product of these lands which is so highly esteemed throughout all Europe. And that forcing the owners of the said places to deliver all or the largest part of their wines to the Honorable Company at the fixed price would be of detrimental effect to the Honorable Company, since one would then certainly have to expect that the same owners, aiming at their own interest, would bring about a poor quality in the wine, either by pressing the grape when it contains the most juice in order to obtain a larger quantity of wine, or by applying less cost, trouble, and attention to it; whereby its credit and reputation, and with it the profits still enjoyed therefrom by the Honorable Company, would likely cease altogether very quickly. That these so essential reasons have also always restrained the government from taking any effective measures in hand to force the owners into large deliveries to the Honorable Company that would be harmful to them, since it is moreover not well possible to prevent the export of Constantia wine by foreign nations without that of all other wines also being prohibited; which latter is again completely contrary both to the interest of the Company and to the intentions of their Right Worshipful Nobilities concerning this colony. That since it does in no way accord with the interest of the Company to continue securing the profits that can be obtained from that precious product of this region by purchasing it on the present footing, whereby it would nonetheless always remain deprived of the enjoyment thereof, we have been unable to devise any other means to bring the Company the advantage that can be derived therefrom, than if their Right Worshipful Nobilities could see fit to grant the Governor of this colony the authority to purchase from the owners of the Constantia estates, either through commissioners from the Council of Justice or through such Company servants in whom the Governor should believe he could place the best trust in that regard, such quantity of wines as their Right Worshipful Nobilities should see fit to requisition annually, at such prices as could best be agreed upon with them, according to the harvest and what can be relied upon regarding the soundness of the wines, given the influence of the seasonal hardships to which it is more exposed in one year and less in another; under reserve, however, of the right of the Company, if it should be found that this did not answer the intended purpose, to be able to continue to insist, as is now the case, on the delivery of a portion of the harvested wines at the fixed price, and to have this effected at that time by appropriate means. under assurance of all frugality, with a statement of the large quantity of timber required for the completion of the hospital, which has been taken in hand for that completion according to the resolution of the 19th, has fallen by ƒ406595: 5: 8, but that the profit and loss account has also yielded a surplus amounting to a sum of ƒ6072315: and as we anticipate that this will be pleasing to their Right Honorable Nobilities, the same will also be assured that, just as the expenses must very naturally increase due to an expanded administration of this Government, we nevertheless make every possible effort toward economizing and have done nothing else in this regard, nor shall introduce anything further, except through a sheer conviction of its necessity, and that the same could not, or will not be able to be spared. As it is indisputably certain that, in order to look after the interests of the Honorable Company in completing the hospital presently underway, it must result to its disadvantage if that work is delayed any longer, and that the requisite durability can never be imparted to the said work unless the European timber employed therein is immediately protected from the influences of the air and rains by completing the work or the sections presently in hand, to which end kiaat wood is best preferred for the exterior parts, including the uppermost flat roof, and its completion is deemed exceedingly necessary, so that not only for this purpose, but for so many more buildings as are required, and the repairing and maintenance of those already in existence, a considerable quantity of that timber must be on hand, this will be disclosed to their Right Honorable Nobilities; and further that we have taken the liberty to request the Supreme Indian Government anew that this be taken into consideration and that the respective requisitions for timber may be fulfilled; meanwhile, in order not to delay the completion of the said hospital any further, such measures have been taken in hand with the addition of the means as our resolution of the 19th of April last dictates, as well as how we also hope that, if the cutting of timber and other wood in Plettenberg Bay, for which all possible efforts will be made, should happen to succeed—since a type of wood is found there which equals kiaat wood in durability—a very great deal of kiaat wood may subsequently be spared. Just as we have already had to learn with very great regret from the letter of the Supreme Indian Government the displeasure conceived by the same regarding the poor and meager fulfillment of the respective requisitions for wheat since the year 1781, and we have submitted our apologies thither on that account, it is understood to lay those same reasons open to their Right Honorable Nobilities as well, in the hope that this, together with what was very humbly presented on that matter in our submissive letter of the 19th of April of this year concerning the affairs of this government, may also be accepted by them as our excuse. than could be made of it for the Honorable Company, it was deemed in its interest that the same ought to be sold, and this will, with their favorable interpretation, also be effected. It was found that, according to the purpose tending thereto, which was primarily to have built on the Company's behalf a block of barracks and some suitable storehouses, the said plot is at least certainly not fit for barracks, as it is situated in the best part of the Cape, opposite the Reformed church along the principal thoroughfare, while both for the construction of the barracks and the required storehouses other sufficient and better situated lands are also available, so that neither for that purpose nor for any other end could any preferred use of the said land be made for the Company. And as one has hereby become fully persuaded that the public sale thereof, after having first been divided into suitable lots, will best accord with the Company's interests, as, due to its pleasant situation, it is very much desired by everyone for the erection of advantageous houses, which gives the expectation of obtaining an important sum thereby, and the said reasons will also not fail to bring Their Right Honorable Nobilities to that conclusion; but in the meantime, before the receipt of an order for its sale, the change of times could easily also bring about a considerable change in the value of those lots, so that by first awaiting the same most respected order so much would be resigned in that regard, it has been resolved, subject to their most favorable interpretation, to sell the said land divided into lots shortly by public auction, all the more so because one must thereby expect to recover, at least for a large part, the sums that had to be paid for the warehouses recently purchased on the Company's behalf. with the addition of these and other remarks, in the hope that a favorable disposition will be made in this matter, satisfying the requests made from here. In order to avoid prolixity, we take the liberty of referring to them and further remarking that, as can be gathered from various reports, it is very difficult to designate with certainty the actual author of the project. Even if this could be done, it would still have to be investigated whether there were reasons that made it necessary subsequently to deviate from that project and to make the actual cargo such that the difference and that yield arose from it, which is now just as impossible to discover as the former. As a complete settlement of that matter by the Right Honorable Lords has been linked to this, we most humbly beg their Honors to take favorable consideration of so many very delicate and disagreeable circumstances that coincided at that time, which continuously troubled the Government here and constantly occupied its attention. Furthermore, the drawing up of the said project was an affair entirely foreign to them, and they did not realize that it was intended to have the purchase amount of the cargo insured—under the supposition that such insurance would only be taken out on the purchase—so that the difference between the project and the actual cargo could not be regarded by them as a matter of such gravity as was subsequently experienced. This is all the more so since, with very respectful correction, the Right Honorable Commissioners for the Affairs of War, in their letter dated 5 August 178, did not deign to declare that the desire for an earlier transmission of the project of the cargo was intended to enable them to effect insurance on the cargo. Taking these reasons together, and considering the affirmation made by each of the aforementioned servants who found themselves specially involved in that matter, as well as by the present members of the Council who also constituted the assembly at that time, that they proceeded therein with that zeal and regard for the interest of the Company that befits dutiful servants, without having aimed at or been able to pursue any private interest in any advantage or disadvantage that might arise from it, and that any lack of attention that might have occurred without any intent was attributable almost solely to the concurrence of the aforementioned difficulties; it is hoped that a favorable disposition in this matter may be brought about by the Right Honorable Lords, alongside the presentation of the request made by the frequently mentioned Chief Administrator Hacker, praying that his account may graciously be relieved of that which has been debited to his Honor on that account. Furthermore, we will continue to insist on the sending of fine cardboard, printer's ink, and stamps, citing the necessity thereof. Regard shall be paid to the said persons and the petitions. As the Right Honorable Lords have encountered the impossibility of granting anything more to the so highly necessary financial requests than the twelve tons that have been allocated for this government, of which a large portion is still to be expected, this leads us to trust that we may receive within a short time the fine cardboard, printer's ink, and stamps requested in our humble letter of 6 September last, in order to renew the circulating and completely worn-out paper currency in such a manner as to make the counterfeiting thereof more difficult and thus give less cause for it. It will be demonstrated to the Right Honorable Lords how we recently had to experience the utmost necessity of this once again, when the case concerning the assistant Marinus Simon van Cruijsselbergen was made known to us by the Court of Justice on the 17th of the recently passed month of May, and whereupon, after serious deliberation, we found ourselves under the necessity of reducing the said Cruijsselbergen to his former rank of young sailor and, as such, sending him on to Batavia, the primary place of his destination. Resolved to observe the recent order concerning the gauging of the draft of the ships coming from the Indies. requested to be pleased to permit that, in order to state to Their High Mightinesses the scruples raised by us against the granting of such requests, we take the liberty most respectfully to refer to that which we have submitted in that regard in our aforementioned humble letter of 23 December and separate letter of 19 April last. That pursuant to the permission which Your Right Excellencies were pleased to grant to the former Master of the Equipage at Colombo, Abraham van der Segge, to proceed on his voyage to the Netherlands with one of the first departing ships of the Company, the same has also already departed thither with the Bengal return ship Constantia. On the occasion of our ordinary, and likewise the adjacent annual requisition, also provisionally that of gunpowder and further artillery supplies to Your Right Excellencies, beside our aforementioned humble letter of 8 May last, and thereby in reply to that which has been ordered by Your High Mightinesses regarding the requisition of gunpowder for this Government, having noted that this arrangement will be able to answer the intended purpose once the magazines here shall have been properly replenished beforehand, and that the aforementioned requisition only preceded the plan regarding the defense system of this place, on which the Governor is working, so that one might in the meantime, with the pleasure of Your Right Excellencies, be provided with that quantity of gunpowder and further artillery supplies as soon as possible, the liberty will be taken very respectfully to refer thereto as well. As all hope has now vanished of still seeing the return ships the Harmonie, Bredenhoff, and Overduijn, as well as the provision ship Zeeduijn, appear, so that the prescribed investigation into the causes of the disasters that have certainly most lamentably befallen those ships cannot be applied: It is further, in satisfaction of Your Right Excellencies' highly respected order in that regard, resolved to instruct the Master of the Equipage, upon the arrival here of each ship from the Indies, whether loaded for this Government or on return to the Fatherland, to measure the draft of the ship with the assistance of two Captains or other maritime experts, and also to observe the same upon the departure of such ship from here, whether back to the Indies or further to the Fatherland; and to make a proper written report of the findings under offer of oath, in order to compare them with the findings in the Indies and to be able to render a detailed report of everything both to Your Right Excellencies and to the High Indian Government. There being added by the Chief Administrator Pieter Hacker, next to his report mentioned here before concerning the project of the cargo of the ship the Kroonprins van Pruijssen, nine different lists concerning the goods which were discharged here from the cargoes of the return ships Batavia, Amsterdam, Middelburg, Honcoop, de Paarl, Hoog Carspel, de Dankbaarheyd, 't Huis te Spijk, and the Morgenster, in answer to that which Your Right Excellencies were pleased to write in that regard, in order to obtain therefrom as much as possible what is missing to be able to draw up the liquidations for the return goods of the years 1781 and 1784 and the confusion which took place regarding the same, the same lists shall also be transmitted to Your Right Excellencies alongside the aforementioned report. Because we find ourselves unable for the present dutifully to supply to Your Right Excellencies the chart of Table Bay, as it is said to have been improved some years ago, and on which would be found an indication of the marks for the anchorages under Robben and Dassen Island and even in Hout Bay, of which chart, however, no trace Lists to be sent over serving for the liquidation of the return goods of 1781 and 1784. 244 being to the intention of the Lords Masters regarding the Botanicus Masson answered by appropriate measures Their High Mightinesses required consideration thereof from the former Fiscal Boers is to be discovered in this government, while from the Register of our general Missive dated 2 March 1778 it only appears that both the Report of the commissioners for the surveying of the anchorages near Robben Eiland and the original Chart formed therefrom were dispatched on the Johanna Margaretha to their Right Honourable High Mightinesses; and its counterpart at the same time on the Behemoth to Batavia, But among the documents for the forming of a Military Chart for this government, very necessary the depths of this Table Bay and also those of the Salt Bay will have to be made accurately known, as shall also be carried out after a further exact survey thereof shall have been done, with which surveying and collecting the documents required for the mentioned Chart one has already been continuously occupied for several months, it shall in the meantime be assured to their Honourable High Mightinesses that as soon as they shall be ready, the same will be most submissively presented to Their High Mightinesses While regarding the Botanist Masson, who was admitted here upon the recommendation of his Excellency the Lord of Lynden, Extraordinary Envoy of the state to the English Court, to their Honourable High Mightinesses, that such measures have been taken by us as will fully be able to correspond to Their High Mightinesses' intention, to the end that he shall not make use of his presence here for purposes contrary to his Commission to collect the remarkable plants and herbs of this country, as we have already had the Honour to report thereof. — And whereas their Right Honourable High Mightinesses on a certain request furthermore alongside their aforementioned very revered Missive have been pleased to send us a Copy presented to Their High Mightinesses by the former Fiscal of this Government, Mr Willem Cornelis Boers, having deemed it necessary, before deciding thereon, to require our report and Considerations regarding it shall be it is thought, subject to correction, the legal costs charged to his Honour. which are the motives for this assertion in order to answer this dutifully, the costs mentioned therein, the liberty will be taken to remark that the said former Fiscal Boers, as has already been brought forward hereinbefore, having been under the obligation, ex Officio, to initiate the appropriate legal proceedings against the commander of the Hooker De Snelheyd on account of the extreme Neglect committed by the same in that which had been clearly ordered to him, his Honour, in our view, subject to correction, very improperly would have to bear the costs thereof in his private capacity, being a matter in which nothing was awarded to his profit That we sustain this all the more, since, as the said former Fiscal rightly remarks, in case by the final verdict at Batavia that of the Council of Justice here had been approved, the costs could never have been declared on his side, as deviating from that which at this government has remained practice through a Constant custom, as also did not happen through the mentioned former Fiscal regarding the proceedings which his Honour conducted at the same time against the officers condemned thereupon by the Council of Justice here, who were then also situated on their respective vessels in Saldanha Bay, and had been guilty, the one more and the other less, of negligence. That these thoughts also have further foundation when it is considered that the said custom here also entails that all documents which one comes to require for such proceedings conducted for the interest of the High Authority, and particularly also for the Interest of the Company, are not only expedited gratis, but also small stamp duty is never used for this, as would nevertheless have to happen if it could be supposed that the costs thereof could be charged to the Officer himself who initiates such a Process Ratione Officii. — That there is then moreover an example that a Fiscal in such a case out of his
