writing, with the Dutch private flute ship de Vreede; we take the liberty of presenting to the same the duplicate thereof with the enclosures and the register, the said ship de Vreede having set sail for the fatherland on the 9th, and the likewise chartered private ship d'Eensgezindheid on the 10th following. Currently also lying ready for departure thither, the bearers of this, the private ships Oostzaandam and the Vrouwe Johanna, we let this serve as an escort for those two vessels: on which last-mentioned bottom, the Vrouwe Johanna, there happens to be the repatriating Merchant and former administrator of the Bantam Commandery, Jan de Roverre van Breugel, by whom it was represented to us by petition: That he, having been discharged to the Netherlands upon his request, on account of the expiration of his term, retaining rank and pay, by their Right Honourables the gentlemen of the High Indian Government at Batavia, was permitted, according to the regulations on the baggage of servants sailing home, by virtue of his rank as Merchant and being burdened with a child of his own, to take along three five-foot and two smaller permitted chests for the storage of his goods, which were then also filled at Batavia and were located on the aforementioned ship the Vrouwe Johanna: but that he, the petitioner, through ignorance neglected to have those chests branded at Batavia; and having only been further informed here of the necessity thereof, therefore requested that, in order to prevent unpleasant consequences resulting therefrom for him, the petitioner, the aforementioned chests might be branded at this place: wherefore we, subject to your Right Honourable High Mightinesses' esteemed approval, having granted the branding of those chests to the aforementioned Merchant van Breugel, take the liberty of presenting to the same the aforementioned petition, with the certificate submitted therewith from the master of the said ship the Vrouwe Johanna, Simon Koter, and an extract from the minutes of the resolution of the Council of India, alongside this in authentic copy. A request having been made to us by the master of the bearer of this, Jacob de Vries, that since his two carpenters had passed away on the voyage hither from Batavia, he might therefore be assisted with the master carpenter of the Ceylon return ship laid up here, the Paarl, Levenus Gerhardus de Donker, offering that the owners of the said ship Oostzaandam will not only allow him such pay as he earned with the Honourable Company, but also upon arrival in the fatherland half of his earned premium, we have granted this to the aforementioned master de Vries, in the hope of your Right Honourable Great Mightinesses' esteemed approval. and alongside this are transferred the bill of lading and invoice. The condition of the aforementioned ship de Paarl, after the discharge of the cargo having been further accurately examined and inspected by nautical experts and shipwrights expressly appointed for that purpose, appeared from the report delivered by that committee in that regard and accompanying this in copy: that both stern transoms of the aft-ship are in pieces; the main wales and fashion timbers, which ought to hold the entire aft-ship in its cohesion, have all separated from one another; the floor timbers or riders, which also belong to the strongest framing of a ship, are dry-rotted, the bolts loose, and all the counter stanchions have departed nearly 3 inches from the stern transom; that under the main chainplate, where a ship must exert its greatest force and also has the greatest working, the wales, both on the starboard and port sides, are all in pieces and sprung apart from each other, and also the wales at the break of the bow, where a ship suffers much from pitching, are broken straight across; that the stem, being fastened to the timbers of the inner and outer hull, has parted entirely from its rabbet, and furthermore the bands forward in the bow as well as all the lodging knees in the hold being dry-rotted, the bolts are almost all loose, so that one can drive them in and out with an ordinary nail hammer; that these reported defects were unanimously declared by the aforementioned committee to be of such a serious nature that the ship has thereby been found irreparable here and totally incapable of any voyage from this roadstead; that even according to the opinion of the shipwrights who assisted this committee, the ship would not be judged worthy in Holland itself to spend the expenses and required effort on it. That even if no sufficient defects had been discovered by them, the commissioners, which could with complete confidence cause them to declare that vessel irreparable, since the ship, lying still at present, has several parts closing up, and had it been deemed fit to let that ship, after some repairs, continue the voyage from here, the captain assigned to it down to the lowest crew members would nevertheless oppose the departure from here with that ship, as they all, thanking God's goodness, testified that they had arrived here miraculously, and they did not wish to endure again such dreadful circumstances as that ship, when it came to sea again, beyond repair and above all through working apart, would surely present to their eyes, as they had been obliged to witness enough of on the voyage hither. And it being clearly established from this that, besides the defects which they discovered to the aforementioned commissioners upon examination and which they have already found irremediable, others of no less importance, through the closing up of the strained parts while the ship is now lying still, may yet have remained concealed from them, which nevertheless, having to reveal their effect during the working at sea, could have caused such a scruple among the officers together with all the rest of the crew that, after whatever repair one might apply to it, they would not be inclined to put to sea again with that vessel: we have therefore for those reasons had to resolve to have the repeatedly mentioned vessel de Paarl broken up, and subsequently to employ the timber that is still serviceable for various necessities, both on the batteries and otherwise in the service of the Honourable Company, and to let the unusable timber serve where it may best come in useful on the Company's behalf. However, since from the report also delivered above by the commissioners who served to transfer the cargo of the aforementioned ship de Paarl into the ship de Vreede mentioned herebefore, and of which report an authentic copy is annexed hereto, it has appeared that among the bales of linens of that transshipped cargo there were still found a number of 357, which, as specified herebefore, being found unmarked but outwardly dry and undamaged, must contain the linens which the ship's officers, according to their sworn statement given at Isle de France, had washed and dried, without any further account or justification being obtainable from those officers in that regard other than upon opening those bales, wherefore it was also deemed necessary that someone among them be present at the discharge of the repeatedly mentioned cargo from the ship de Vreede in the Fatherland, in order to be able to render a proper accounting in that regard; we have therefore for those reasons also thought best to have the aforementioned Captain Cornelis in 't Anker, retaining his rank and wages, repatriate with the said vessel de Vreede for such an accounting. Under the main channel, where a ship must endure its greatest strain and also experiences the greatest working, the wales and the break of the bows, where a ship suffers greatly when pitching, are broken straight through. The stem, which is joined with the knees from within and without, has completely yielded from its rabbet; furthermore, the knees forward in the wales as well as all the hanging knees in the hold are dry-rotted, and the bolts almost all so loose that one can drive them in and out with an ordinary nail hammer. These aforementioned defects we all find to be of such a critical nature that we can unanimously and with complete confidence report to Your Noble Rigorousness that we find the ship irreparable here, and entirely unfit for any transport from this roadstead; indeed, according to the opinion of the shipwrights assisting herein, the ship would not even in Holland itself be judged worthy of expending the costs and required labor upon it. And if, for example, we had not been able to find sufficient defects to declare the said vessel irreparable with complete confidence—because, now lying still, several parts settle together—and had it been deemed proper to let that ship, after some repair, continue its voyage from here, then from the captains down to the least of the crew, all would have opposed departing from here on that ship, as they all testify, thanking God's goodness, to have arrived here miraculously, and to have experienced enough on their voyage hither of such dreadful circumstances as that ship would surely present to their eyes when it returned to sea, being beyond repair and above all working itself apart, and they did not wish to endure the like again. Pursuant to Your Noble Rigorousness's highly esteemed written order, we the undersigned have closely inspected and examined the journals kept by the ship's officers of the Ceylon return ship De Draak, recently arrived here from Mauritius, and have perceived therefrom what reasons and causes compelled the said officers on their return voyage from Ceylon hither to put into the island of Mauritius; and we found that the said officers were unavoidably forced and compelled thereto by the loss of their rigging and the severe conditions into which they were brought between the 26th and 27th of March of the previous year by a heavy hurricane; having furthermore done everything that capable seamen ever can and in such a case ought to do. Whereupon we proceeded to the aforementioned ship and there, as accurately as possible and so far as we were able without discharging the cargo, inspected the same and found that no damage by leakage has been caused to it since the departure from Mauritius. However, by order of the Commissioners of the Admiralty there, they had to throw into the sea 302 bales of entirely spoiled cinnamon, 110,000 lbs of pepper, and 414 bales of likewise totally spoiled coffee beans; also, upon unloading, they found 2,119 bags of saltpeter melted empty. There are still on board, according to the statement of the ship's officers, 82 bales of cardamom and approximately 500 bales of cinnamon, all of which have been wet. Next, with the assistance of the master of the shipwrights of the Company's equipment yard here, Meijndert van Eijk, and other experts, we accurately recorded the condition of the ship and the repairs made to it at Mauritius, which we have the honor to set forth below: Namely, that the futtocks on the starboard side, over which the ship lost its rigging, have almost all shifted 2 inches, which we cannot repair here, but is not of such consequence that this ship cannot with confidence continue its voyage to Europe. The repairs done at Mauritius were inspected by us and found to consist of the following items, namely: First, in the repair of the starboard channels; and next a new scroll and beakhead. On the starboard gallery, the renewal of all the windows and blinds in the cabin. A new set of gudgeons on the sternpost; the refitting of the rudder, sternpost, and stem; the bulkheads between decks and in the hold; and in the rice store rooms two planks in the deck between decks and a piece placed in the upper deck; a cleat against the beam of the quarterdeck; a new gunwale on starboard; all the ports between decks refitted and some renewed; some pieces in the wales on starboard; the sheathing from aft to forward on the starboard side, damaged by the rigging to a height of 5 feet, renewed; and on the port side some pieces inserted; a new warping chock; a new fiddle on the bowsprit; likewise all 3 masts of the purchased Russian ship repaired, and further the ship both inside and out clamped and caulked. Dutch Indies, La Perle. - No. 3 Today, Saturday the seventeenth of February, one thousand seven hundred and eighty-seven, in the afternoon, in the presence of Mr. Pierre Malo Le Bras de Villeviderne, King's Attorney in the Royal Jurisdiction and Admiralty of Isle de France. At the registry of the court and before us, Ignace Brunel, Royal and Admiralty Judge on this Island, assisted by Mr. Jean Pierre Auffray, Royal Notary, Chief Clerk in charge of the administration of the Registry of the Royal Jurisdiction and Admiralty of this Island. Appeared Sir Cornelius in 't Anker, Captain of the ship of the Dutch East India Company, La Perle, lodged aboard his ship in the roads of this Port Louis. Who said that he departed from Ceylon on the twenty-fifth of November last, that he made way to proceed to the Cape of Good Hope and from there to Europe; that finding himself in the latitude of eighteen degrees and by ninety-three degrees of longitude, meridian of Tenerife, he encountered a furious gale from northeast to southeast, which put him in danger of sinking to the bottom; that this event took place in the night of the twenty-sixth to the twenty-seventh of December last; that there was then up to eleven and a half feet of water in his hold; that he remained in this critical position until the twenty-ninth of the same month; that having then no other hope than to reach the nearest port, he made course for this port where he arrived on the thirteenth of January; that being ignorant of the customs of this port, he made no declaration, but that he first occupied himself with the unloading and salvaging of his goods; that there remains in his warehouse a considerable quantity of coffee, pepper, and other spices which appear to him to be totally damaged and spoiled; that he has also been occupied since his unloading in repairing his vessel; that in the gale he suffered from the twenty-sixth to the twenty-seventh of December, he lost his mainmast entirely, his mizzenmast entirely, his fore-topmast, so that he was only able to preserve his foresail mast and his bare bowsprit; of which declaration he requested an act, which was granted to him with the consent of the King's Attorney, under the reservation made by him to have the damages verified to the goods which are in his warehouse, as well as any other damages that may be necessary hereafter; and signed with us, the King's Attorney and the Clerk; and in the register signed: Le Bras; Brunel; C: in 't Anker; and Auffray. 449 Frederik Languier des Baniets, also merchant of this town, expert chosen and appointed by us ex officio, which said Sieur Languier des Baniets having taken the oath before our hands as required, we proceeded to His Majesty's warehouse located at the place of Caudan, in which are deposited the goods of the said ship La Perle, in order to inspect and ascertain the condition of the pepper and coffee forming part of the said cargo. Arriving at the premises, the said Sieur Cornelius in 't Anker having opened the said warehouses for us, in the presence of those as above, the said sieurs experts proceeded to examine the goods and immediately stated and reported to us, after verification, that there are one hundred thousandweight of pepper and one hundred thousandweight of coffee from Jacatra, black, burning, and completely rotten, whose loading could only be very harmful to the crews; and they signed, requesting record, thus on the draft: Lanquiers des Banets and Moriniere Cadet. And the said Sieur Cornelius in 't Anker having requested a formal record of the said inspections and report, and moved that, in view of the danger to which the crew would be exposed if the said goods were loaded, he be authorized to throw them into the sea, he requested formal record and signed thus, signed: in 't Anker, surxior, having heard the consent of Monsieur the King's Attorney. 5 May 1787. In the year one thousand seven hundred and eighty-seven, Monday the fifth of May, at two o'clock in the afternoon. Upon request and in the presence as aforesaid, and by virtue of our order contained in our official report of the twenty-first of February last on the other part, the King's Attorney, granting formal record to the Sieurs Experts and to the said Sieur Captain of the said inspections and reports, orders that at the request, suit, and diligence of the said Sieur Cornelis in 't Anker, the hundred thousandweight of pepper and the hundred thousandweight of coffee found to be rotten shall be forthwith thrown into the sea in our presence and that of Monsieur the King's Attorney; and we signed with Monsieur the King's Attorney and the Clerk, signed: Le Forestier, Le Bras, and Auffray. The said Sieur Salineau residing on this Island in the town of Port Louis, rue du Rempart de la Grande Montagne, parish of St. Louis, acting in the name and for the account of the outfitters, of all insurers and others having rights to the said vessel. Who, in execution of the judgment and authorization rendered at the seat of the royal Jurisdiction of this Island holding the place of the seat of the Admiralty on Tuesday the twenty-third of January last upon the petition of the said appearing Sieur against Monsieur the King's attorney at the said seat and Sieurs Brondon and Gesfroy, Commissioner of the Classes, February 1787 ƒ 454. and Treasurer of the Invalids of the Navy, whereof an extract collated and signed by Auffray, head clerk, is present, sells by these presents and promises to guarantee against all debts, privileges, claims, and all disturbances and impediments generally whatsoever, to Sieurs Janvier Monneron et Compagnie, merchants of this Island, stipulating through the said Sieur Janvier Monneron, residing in the said town of Port Louis, parish of St. Louis, here present and accepting in the name and for the account of the noble Dutch East India Company, as will be declared hereafter. The hull, keel, rigging, and tackle of the said vessel the David, of the burden of about six hundred tons, currently aground at Port Louis of this Island, sails, ropes, and masts, anchors, and generally all objects belonging to the said vessel included in the general inventory that was made thereof in execution of the judgment announced above by Messieurs the officers of the royal Jurisdiction holding the place of the Seat of the Admiralty on this Island, whereof an extract was delivered to the said Sieurs Janvier Monneron et Compagnie, who further acknowledge being well acquainted with the whole, having seen, visited, and examined it, and having taken possession and entered into enjoyment of the whole, with which they are content and satisfied. This sale is made in consideration of the sum of ninety thousand livres as the agreed price, which the said Sieur Salineau acknowledges having received in cash on this day from the said Sieurs Janvier Monneron et Compagnie, whereof he acquits and discharges the latter.
