[illegible] 1788 Amster Seventh Volume. Register of Letters and Papers from the Cape, arrived in 1789. 1788 Judicial papers and Criminal Court Roll of the Year 1788. Thursday the 10 January 1788, in the forenoon, present the Honorable Johannes Isaak Rhenius, President, and all the Members. Vercueil serves answer, the Assistant of the Honorable Company Jacobus Vercueil acting as the attorney of the Burgher Andries Burgert A:Z: versus the Merchant and Landdrost of Graaffe Reinet, Mr. Maurits Herman Otto Woeke, ex officio, in order to see answer served to his filed Claim. As in writing. The sworn junior Ryno Johannes van der Riet, appearing before the Court on behalf of the ex officio prosecutor, requests a copy thereof in order to serve a reply in 14 days, or else to renounce. The Council: granted as requested. The petitioners serve a request, the Lieutenant of the Honorable Company Arnoldus Castelyn de Keulenaar and Sub-Lieutenant Johannes Cornelis de Buissinne, petitioners, versus the Fiscal pro interim, the Honorable Gabriel Eilbracht, ex officio, to see served a request for a term and delay of answer to the prosecutor's filed written Claim, for 14 days. Surrendering as mentioned in the presentation. The ex officio prosecutor requests, if this is permitted, that it may then be under penalty of foreclosure. The Council grants the petitioners the requested delay to serve an answer in 14 days, under penalty of default. Whereupon, by the sworn clerk Mr. Ryno Johannes van der Riet, qualified to attend to the affairs of the Landdrost of Graaffe Reynet, it was verbally mentioned how he ought to act concerning the Hottentots [illegible] and [illegible] who had been sent up by his principal on suspicion of committed murder, without his aforementioned principal having [illegible].

[illegible] had also sent over such documents and evidence on the basis of which he, in his aforesaid capacity, could institute an action against the said Hottentots; and as he, the attestor, was himself not provided with a statement of the facts of the case, he could also learn nothing from those Hottentots, who do not understand a word of Dutch; while in the meantime, if they remained sitting in the jail, they might become ill and die before one was in a position to interrogate them: it has been approved to allow those Hottentots to take a walk daily on the inner courtyard under the supervision of the officers of justice. Lastly, the pro interim Fiscal, the Honorable Gabriel Exter, produced in council a specific list of the Honorable Company's servants who during the past year willfully abandoned their service and fled, with the request that the same fugitive persons, pursuant to the circular orders of the High Indian Government, might be summoned in person peremptorily by edictal citation to appear before this Council within a certain specified time, on pain that, upon non-appearance, proceedings will be conducted against them in contumacy: it has been approved to have the aforesaid fugitive persons summoned and cited by the public tolling of the bell, to appear in person peremptorily before this Council or the Gentlemen Commissioners from the same within the period of the next four weeks, in order then to purge themselves concerning the aforementioned willful desertion and abandonment of service, on pain as is established by the aforesaid orders. Below stood: At the Cape of Good Hope, the day and year as above. Lower: in my presence, signed: C: van Aerssen. Thursday, 21 January 1788. In the forenoon, present: the Honorable Johannes Isaak Rhenius and all the members. The sworn clerk at the Secretariat of Justice, Mr. Ryno Johannes van der Riet, in his said capacity, waives further productions, since nothing for the defense has been brought forward by the defendant in his answer from which the claim could in any way be considered unfounded, and no evidence has been produced that contradicts the declaration exhibited by the ex officio plaintiff, and he therefore requested a short and fair judgment. Lieutenant in the service of the Honorable Company Arnoldus Castelyn de Keulenaar and his Lieutenant Johannes Cornelis de Buis, having produced a written answer accompanied by annexes, the plaintiffs proved their case, the officer also waives further productions, the defendant also waives, and requested a short and fair judgment. The Council holds this case for final reading and in advice. The pro interim Fiscal Gabriel Exter, acting in office to observe the affairs of the Landdrost of the colony of Graaff-Reinet, the Honorable Morits Herman Otto Woeke, required that on his submitted written answer a waiver or a reply be heard from the defendant, the Burgher Andries Burgert, who was told to submit his answer pursuant to the appointment of the Honorable Council of Justice on his submitted ex officio claim. Present: the Honorable Johannes Smuts, President, and all the Members except Messrs. Mappa and De Wet, the first mentioned due to indisposition and the last mentioned due to other occupation. that the claim may be The Official Plaintiff requests The Council refers this matter to the Honorable Council of Justice of this government. Thereafter came to the table the memorial submitted by the Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, regarding the Hottentots Toon and Steyn; which having been deliberated upon and taken into consideration, that the two depositions later obtained by the said Landdrost could shed much light on this matter, it has been resolved to hand this memorial back to the officer, in order that the same, equipped with the said two depositions, may further proceed against the aforesaid Toon and Steyn, as he shall find proper. Thereafter, having taken up the memorial exhibited by the aforesaid Landdrost of Stellenbosch regarding the burghers Hendrik and Isaak Beukes, which having been dealt with, the officer was granted the requested personal summons against the said Hendrik and Isaak Beukes, and the same was enjoined to furnish himself with the inspection certificates upon which he relies in the said memorial. There being furthermore brought to the table the proceedings instituted by the pro Interim Fiscal, the Honorable Gabriel Exter, on and against Louis Pisani of Almelo, sailor in the aforesaid case, among others on and against the burgher Jan Theunis Mulder; which having been deliberated upon, the Honorable President declared it to be his opinion that, since Corporal Klepsen has been punished according to the strict letter of the law, the said Mulder, as the buyer of the stolen goods, ought also to incur the punishment enacted by the same law and in the same article, and thus be condemned to the fine of 15 Rixdollars stipulated therein, as well as to restitute the goods to the owner; against which, however, the majority was of the opinion that this punishment could not be imposed upon him, Mulder, because soldiers and military men were daily seen buying and selling, whereby this law silently, as it were, seemed to have lapsed, and the burghers thus could no longer know that they were not allowed to purchase anything from any military personnel; wherefore the Council, having had regard to all that militated for reflection and could move their Honors, administering Justice in the name and on behalf of the High and Mighty Lords States-General of the United Netherlands, has denied the Official Plaintiff his claim made and conclusion taken on and against the defendant Jan Theunis Mulder, and ordered the defendant, upon demand, to surrender the two pieces of blue Cassar and one ditto bafta, currently resting under sequestration of the Secretary of this Council, at the purchase price, provided that the defendant shall confirm and declare under solemn oath that he did not know, directly or indirectly at the time of buying, that the aforesaid goods were stolen; but in default of that oath, the Council adjudicates to the Official Plaintiff his claim made and conclusion taken on and against the defendant; with condemnation in both cases of the defendant to the costs of these proceedings. The Landdrost of the Colony Stellenbosch and Drakensteyn Mr. Hendrik Lodewyk Bletterman ex officio Plaintiff in a Criminal Case on the one side, Against The citizens Andries van Zeyl, Adriaan van Zeyl, Hendrik van Zeyl and Jan Wreder, Defendants in person in the aforesaid Case on the other side, to hear such Criminal Claim and Conclusion, or indeed request or requests, as the ex officio Plaintiff shall make and take upon and against the Defendants in person on account of the violence committed by them against certain Hottentots, to answer thereto and further to proceed according to law. The messenger, stepping inside, reports that the first-named Andries van Zeyl has not appeared. The sworn Clerk S: Rino Johannes van der Riet, appearing for the ex officio Plaintiff, says, with the exhibition of some statements, the following: The ex officio Plaintiff, before making any Claim, requests by virtue of the 4th article of the Criminal Ordinance that the Defendants may be incarcerated and consequently ordered to go into close criminal custody, and that in such manner that by means of separate imprisonment they be deprived of all correspondence with one another, so that when this case shall have been terminated by final judgment by your Honors, the sentence to be pronounced therein may not be rendered illusory, since the absence of the Defendants, because the punishment applicable to such criminals as the Defendants have committed can be executed upon no one other than the persons of the Defendants, and this because there are at hand against the Defendants more than half proofs, indeed vehement and probable suspicions regarding extreme acts of violence and atrocities committed against a large number of Hottentots, as was extensively demonstrated from the memorial exhibited by the ex officio Plaintiff in the month of November last in your Honors' assembly, and regarding which some further proofs have since been obtained, whereby the assertions of the ex officio Plaintiff have been most strongly corroborated; and further that the Defendants may be ordered to answer to such interrogatories as shall be put to each of them individually by the ex officio Plaintiff before the Commissioners from this Honorable Council. And on account of the Defendants in person and the defaulting Andries van Zeyl, the ex officio Plaintiff takes the liberty to request of your Honors the default, and by virtue thereof, according to the Criminal Ordinance, that the ex officio Plaintiff may be granted prise de corps or bodily apprehension against the aforesaid Andries van Zeyl, and that for the one and the other the necessary authorization may be granted to the ex officio Plaintiff, and if needed in all cases the necessary assistance in apprehending shall be rendered to the ex officio Plaintiff; and if your Honors unexpectedly should not incline to the request, which nevertheless is made on the basis of the laws, that then the ex officio Plaintiff may be granted the default and a second summons by letter. The Council, having read and reviewed with attention what has been brought forward by both parties, and having also paid attention to all that served the matter and could move their Honors, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, dismisses the claim and conclusion made and taken by the ex officio Plaintiff upon and against the defendant Jan Theunis Mulder, and orders the defendant, if required, to hand over against the purchase price the two pieces of blue kersey and one ditto bafta currently held under sequestration by the secretary of this Council, provided that the defendant shall confirm and declare under solemn oath that he did not know, directly or indirectly, at the time of purchase, that the aforesaid goods were stolen; however, in the absence of said oath, the Council adjudicates to the ex officio Plaintiff his claim and conclusion made upon and against the defendant: with condemnation of the defendant in both cases in the costs of these proceedings. Whereupon the aforementioned sworn clerk, qualified to attend to the affairs of the Landdrost of Graaffe Reinet, served the following memorial, reading: To the Right Honorable Johannes Isaec Rhenius, President, together with the further Honorable Members of the Worshipful Court of Justice of this government. Right Honorable and Worshipful Sirs, Shows with the greatest respect, the undersigned sworn clerk at the Secretariat of Justice, qualified in office by the High Government of these lands to attend to the affairs of the respective Landdrosts of the outer colonies. How, upon the arrival of the Landdrost of the colony of Graeffe Reinet, Mr. Herman Morits Woeke, at his drostdy, and thus upon assuming his office there, there was handed over to him the Landdrost, among other papers, by the respective field-commandants who were stationed in that district by the high government here to maintain good order, a certain accusation made by the burghers Philip Potgieter and Iohannes Janse van Rensburg with respect to their respective mother and mother-in-law Clara Isabella du Preez, widow of the late burgher J: Potgieter, namely that she was allegedly living in unchastity during the marriage of and with the burgher Louis Cotze, and that their mother had already been delivered of a dead child and was in childbed with the second, and that testimony regarding the miscarriage could be given by the wife of the burgher David Botha. That the said memorialist, concerning that accusation, caused the said Louis Cotzee, as well as the wife of the said Cotze, named Johanna Pienaar, concerning a certain infamous correspondence with the said Potgieter and her present husband, Fredrik Otto, from which the crime of adultery can also partly be proven, to be summoned before him at the drostdy in order to hear the parties extrajudicially concerning the one and the other, without the said Cotzee or his wife having complied therewith or deigned to come to purge and justify themselves concerning this. That in the meantime, long thereafter, the said Cotzee came to the drostdy on a certain day in the beginning of the month of November last, and after he had committed some insolences with respect to various persons, as appears more fully from the declarations annexed hereto, he subsequently came to the said Landdrost and accosted him in a violent and insolent manner, both with words and deeds, as the evidence annexed hereto indicates, and to the contents of which the Prosecutor ex officio takes the liberty for the sake of brevity to refer, so that the memorialist ex officio was compelled for the protection of his house and life to resist the said Cotze with force, and with the help of the surgeon there, [illegible], and an orderly trooper who had arrived in the meantime, to have him struck out of the house, without having given any further order to those two persons than to drive him Cotze further than the door, as the Landdrost afterwards learned was done out into the street, and in which he could not at the moment establish order, because from the blows received on the head from him Cotze he had not only become dizzy, but was also somewhat agitated, and had fallen into a sort of frenzy and confusion of senses, as he could not have presupposed that people could be found who, not only forgetting everything they owe to their fellow human beings, but also setting aside all respect and the proper reverence that they owe to someone who has been deemed worthy by the high government of these lands with a part of the administration of Holy Justice in the name of the sovereign, and who consequently ought for more than one reason to be maintained in that respect and proper reverence which the public welfare requires to be accorded to his person. And yet that the petitioner, finding himself noticeably deceived in his completely equitable and trusted hope, instead of finding a legal protector, found an accomplice of the petitioner's said adversary. The prosecutor requests that regarding the petition and unlawful instrument exhibited by the Burgher Louis Cotze, of which perhaps no example will be found anywhere, and which completely runs counter to all legal doctrine and laws, because the text among all those who have ever commented on that matter is very clear in that regard, stating sufficiently clearly that no one in his own case in criminal matters, when he has committed one or another offense, may give a declaration, nor offer to further confirm that declaration at the end, nor may confirm such by oath, because the very natural consequence thereof is that if someone lies under criminal action, very easily, as presumably takes place in the present case, a false The prosecutor cannot refrain from expressing his astonishment to your Honourable Worships as to how Cotze dares to recommend himself to the protection of your Honourable Worships or submit his case, whereas it must after all be sufficiently known to everyone that whenever one is innocent, one need fear nothing, and thus needs nobody's protection to escape punishment; and this premature step proves all too clearly the guilt of him, Cotzee, upon which the prosecutor implores your Honourable Worships' reflection, for which reason the prosecutor once more requests your Honourable Worships that the petition and deed of him, Catzee, may be returned. 17. of this Council, that their Honorable Worships might be pleased to reflect upon the expression used herein by his sworn Clerk, calling the aforesaid declaration an unlawful instrument; that since the same had been executed before him as secretary, he consequently thought he had to take this injurious remark to heart, and therefore requested the Council to examine whether this instrument was unlawful or not, and if not found to be so, to maintain him in his office, as he would otherwise acquire the reputation of drawing up unlawful deeds, and consequently be judged guilty of malversations in his function. 20. Appearing upon the presentation of Sara Johanna van Zeyl and Helena Johanna Laubscher, wife of the burgher Johannes Wiese. That the petitioners' said husbands, having been summoned by and on behalf of the Merchant and Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, to appear before your Honorable Worships' court, notwithstanding that the petitioners are fully convinced of the innocence and blamelessness of their said husbands, as the Hottentots whom the petitioners' husbands, as the petitioners are informed, attacked and, as they believed, wounded in rendering help and assistance to some other oppressed Hottentots by recovering the cattle that had been driven off from the latter, were veritable Bushmen who daily occupy themselves with stealing and robbing, both from the burghers and from the good, tame Hottentots living in that vicinity, of which the undersigned, if given the time and opportunity, could at all times provide very valid proofs to your Honorable Worships; nevertheless, the Landdrost has already proceeded so far against their said husbands that they have both been placed in criminal detention incommunicado, and subsequently heard on interrogatories at the requisition of the prosecutor. That, however much the petitioners know that the reason and purpose of holding a criminal detainee incommunicado is solely to prevent the accused from receiving any prompts whereby he might be enabled to mislead the judge, the petitioners must now, alas, to their bitter grief, experience that notwithstanding their said husbands have already been examined before the Commissioners and have answered to the interrogatories, and thereby, as the petitioners respectfully submit, the reasons cease for which one is under the necessity of cutting off and preventing all correspondence with the said detainees, the petitioners have nevertheless thus far had no free access to their said husbands, and thus have not been able to obtain the consolation of offering some comfort by their presence to these their dear spouses in their wretched circumstances. After the pronouncement of the aforesaid sentence, the aforesaid Landdrost put forward the following: The Landdrost of Stellenbosch and Drakenstein, having heard the aforesaid sentence pronounced, declares that he will acquiesce therein, yet finds himself obliged, with respectful deference, to remonstrate in that regard to this Honorable Court, that having believed he made and drew his claim and conclusion against Adriaan van Zeijl, in his capacity as officer, upon the confession of the prisoner and defendant and according to the letter of the statutory laws, which according to the general written laws ought always to be preferred before the latter, and upon which he, having acted as the prosecutor ex officio, grounded his claim, and therefore considers that he may not deviate a straw's breadth from the same, also hereby finds himself obliged, with respectful deference, to declare to your Honors as those who administer that same justice, that he will not be liable for the consequences and repercussions thereof, requesting therefore at the same time that he be provided with a copy of the entire trial record, in order to be able to act against the two other sons of the said van Zeijl, whose crimes are likewise grounded upon the documents attached to the same claim, in such manner as he shall be bound in conscience and deem proper. The Council, having heard with astonishment that which was put forward by the prosecutor ex officio, enjoins him to refrain in the future from similar remonstrances against a sentence passed by this court of justice, and furthermore grants him the requested copies of the trial record. After which it was put forward by the sworn clerk Ryno Johannes van der Riet, authorized to attend to the affairs of the Landdrost of Swellendam, that, whereas it had pleased this Council, upon his request made on the last court day, namely that the commissioner gentlemen who should officiate at the interrogation of the citizen Petrus Johannes du Plessis might be authorized, in case the said du Plessis persisted during that interrogation in the murder of the Hottentot confessed in open court, to place him in criminal detention, to dispose thereon that their Honors held this request under advisement until such time as further report regarding that interrogation should be received, he, the sworn clerk, therefore now reiterates his made request upon producing the interrogatories; whereupon the Council thought fit to resolve to place the said du Plessis in civil custody until such time as the inquest roll shall have arrived and the officer shall have served a report on that which was put forward by the aforesaid du Plessis in his responses with respect to the report made. 28. 29. when he was heard before the Gentlemen Commissioners on interrogatories, has fully persisted, the Officer Informant therefore again takes the liberty to renew his request for the apprehension of the said du Plessis, concluding accordingly that he shall be ordered to be placed in criminal detention. It having been stated on the last court day by Mr. Gerrit Hendrik Meyer, as a member of this Honorable Council, to this illustrious assembly that he had reliable information that the post-mortem examination of the corpse of the Hottentot shot dead by the aforementioned du Plessis had been conducted very accurately, whereas, however, du Plessis during his interrogation fully admitted that when the commission sent by the Landdrost arrived at the place where the manslaughter had occurred, they did not find the body, but saw signs of where the body was said to be buried, so that the cadaver was apparently not examined by that judicial commission because of the long time elapsed and because it would already have passed into putrefaction, but having indeed heard that the body was examined without proper authorization by a certain Jesaias Meyer and Fredrik Botha, who surely must have arrived there by chance, which persons then also buried that body; that this is also the reason that no official autopsy report could be sent by the Landdrost; and since one can sufficiently observe from the deposition of the brother of the aforementioned du Plessis, named Jacobus du Plessis, that a corpus delicti is established, at least in all cases as much as the two persons who buried the cadaver could declare, the Officer Informant further takes the liberty to implore the highly wise advice of Your Honorable Worships, whether one could, upon the confession and evidence which according to the Informant's view are complete, proceed to a claim on the principal charge, or whether one should wait until those two persons who examined and buried the body shall have come to the Cape to provide a declaration concerning the matters; and in case Your Honorable Worships might incline to the latter, then I take the liberty to request that those two persons may be summoned by order of the Council to come directly to the Cape, in order to give an account of their findings. Hendrik Lodewijk Bletterman, Prosecutor in Official Capacity in Criminal Cases, on the one part, against the Burgher Hendrik Beukes and Isaak Beukes, defendants in person in the aforesaid case, on the other part, in order to answer such Criminal Demand and Conclusion or request or requests as the Prosecutor in Official Capacity shall come to make and take upon and against them, defendants in person, and further to proceed according to law. Honorable President and Honorable Councilors, The undersigned Hendrik and Isaak Beukes, brothers, show with the required respect most humbly: That the petitioners find themselves prosecuted by the Landdrost of Stellenbosch, Mr. Hendrik Lodewyk Bletterman, Prosecutor in Official Capacity, on account of a suspected treatment committed by them against a slave boy of the burgher Jacobus Malan, and to that end have been summoned in person by the aforementioned Landdrost before this Honorable assembly for the last court day, being the 3rd of this month; but as the petitioners are completely unaware of such a crime, yet are most apprehensive of its consequences. Therefore, the petitioners take the liberty to present the facts of the case truthfully to your Honors, in the hope and trust that your Honors will make no difficulty in declaring that matter civil and composable. May it please your Honors to be informed that the petitioners, having come up to the Cape in the month of September of the past year, had a coat stolen from the wagon at the Steenbraassem River, where they had outspanned; having arrived on the return journey at the outspan place at Botte Rivier, where one of their boys was alerted that a Hottentot, who was there with a slave boy, had a stolen coat on his shoulders; the petitioner Hendrik Beukes addressed the aforementioned Hottentot and demanded the coat from him, who at first completely denied having stolen the coat, but upon the conviction by the petitioner's boys that it was the same coat, gave the aforementioned Hottentot some blows with a small lath that the petitioner had in his hand, whereupon he immediately confessed to having stolen the aforementioned coat, and that the slave boy, whom he called his father, had ordered him to do so; meanwhile, the aforementioned slave had approached the petitioner Isaak Beukes, who was busy inspanning oxen, and addressed him with a far-reaching impertinence to excuse the aforementioned theft; the petitioner, holding the oxen fast with one hand, gave the aforementioned slave a blow with the fist with the other hand, whereby the aforementioned slave fell to the ground; having gotten up again, without complaining about anything, after saying a few more words to him, the petitioner, he walked away, without the petitioners being aware that the aforementioned boy had sustained any injury or discomfort either from the blow or from the fall, as the Burghers Hendrik and Jan Groenewald, who were present there, must also testify, as the petitioners trust. That in the month of October, the petitioners having come to Stellenbosch, were informed that the aforementioned slave boy had broken his arm, and by some accident it had the consequence that the aforementioned boy came to die from it, on account of which the petitioners, as said before, see themselves prosecuted with a Criminal suit by the Prosecutor in Official Capacity. The Merchant and Member of the Honorable Court of Justice, Mr. Rijno Johannes van der Riet, acting ex officio on behalf of the Merchant and Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewijk Bletterman, Plaintiff, against the wives of the banished burghers Adriaan van Zeil and Johannes Wieser, Defendants, to hear the demand and conclusion for the posting of sufficient security, within the period of four times twenty-four hours to the satisfaction of the Officer Plaintiff, and this pursuant to the sentence pronounced on 27 March of this year in the case of the Officer Plaintiff against the defendants' aforesaid husbands, in order to deliver the cattle confiscated therein for the benefit of the Honorable Company, amounting to the number of 160 head, within the period of three months to the Honorable Company's post De Schuur, as a place designated by the Right Honorable Governor on site; which sureties shall thus have to bind themselves jointly and severally so that, in the event the aforesaid cattle are not properly delivered, they shall pay the money into the Honorable Company's treasury according to the market price, and in default of posting the above-mentioned sureties, further to hear concluded that after the expiration of the above-stipulated time, the estates of the defendants shall be sold by form of summary execution. For it being beyond dispute of the laws that anyone is permitted, not only in defense of his body but also of his honor, to kill the assailant or threatener who confronts him with a knife or gun, since the fighter or threatener is understood according to law, by cause of his threats, to have killed himself sooner, as the jurists maintain. That now, Noble and Right Honorable Sirs, the aforementioned defense must indeed with good reason be considered as a causal, immediate act of the aforementioned alarm, and the shot fired possibly to instill fear in the said Hottentot is evident; and because of his pressing on all the more strongly against the petitioner's son, having been hit from the front, it provides clear proof of his furious aggression, from which it must be presumed that the petitioner's aforementioned son had no intention of malice to offend, but rather of necessary defense, and consequently had no intention of doing evil.
