43 Thursday the 15th of May 1788. — In the forenoon, present the Honorable Johannes Isaak Rhenius, President, and all the Members. The Secretary of this Council, Mr. Cornelis van Aerssen, ex officio. The merchant and Landdrost of the Colony of Graaffe Reinet, Mr. Maurits Herman Otto Woeke, on the one side, and the burgher Andries Burgert, on the other side, the first-mentioned appearing as Plaintiff ex officio and the last-mentioned for the Defendant, in court, in order to hear pronounced the sentence rendered in their case in Judicio. — The Council, having read with attention and resumed the documents and muniments exhibited back and forth in Judicio by the parties, and also having taken into account all that was relevant to the matter and could move Their Honors, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, absolves the said Andries Burgert from this action and enjoins the Plaintiff ex officio to institute such action against the field corporal Johan Adam Raubenheymer as he, in case of negligence in his service, shall find proper; the Council, however, for reasons, condemns the Defendant in the costs incurred in this matter. underneath was written: Thus done and sentenced at Cabo de Goede Hoop the 21st of March 1788, and pronounced the 15th of the month of May. — was signed: P: I: Rhenius, Joh.s Smits, W: F: van Reede van Oudshoorn, J: G: Maasdorp, C: Mappa, G: H: Meyer, J: C: Gie, H: J: de Wet. — lower: In my presence / signed:/ C: van Aerssen, Secretary. 42 To the Right Honorable Lord Johannes Isaak Rhenius, President, together with the Honorable Council of Justice of this Government. Was served by Mr. Ryno Johannes van der Riet, on behalf of the Landdrost of Swellendam, the following petition. - Shows with the greatest respect the undersigned, qualified by the High Government of this country to attend to the affairs of the respective officers in the countryside: That he, petitioner, some weeks ago requested from Your Honors, while producing the evidence against the burgher Pieter Johannes de Plessies, to grant in respect of him such provision of Justice as he, petitioner ex officio, in order properly to maintain the rights of the High Government and according to the letter of the Criminal Ordinance, had conscientiously believed to be proper. — That, however much the petitioner ex officio had flattered himself, since it was fully established that the above-mentioned person had made himself guilty of crimes which, according to the laws and placards of the country, placed him in the terms of having to be criminally prosecuted and apprehended, that Your Honors would have granted to the petitioner ex officio such provision of Justice as was in accordance therewith, Your Honors had nevertheless determined to grant to the petitioner ex officio no other disposition than one by virtue of which the said person could be taken into civil arrest. 44. 45 Mr. van der Riet in his aforesaid capacity serves with a writing passed on the 7th of this past month having pleased to enjoin to serve in principal upon and against the said du Plessies with a claim, and however much he dutifully attempts to comply with this order, he, the exhibiting substitute officer, nevertheless finds himself notably in an embarrassment in what manner he would formulate this claim (the crime committed by the defendant being a proven matter) as long as no other disposition regarding him, the defendant, was taken, therefore he deemed it most advisable to return again to this Honorable Council with a respectful request that it may be their pleasure to revise the aforementioned disposition, and now disposing de novo to grant the aforesaid criminal apprehension to the exhibiting substitute officer upon and against the defendant, at least and in any case, if your Honors should understand not to make any change in the abovementioned resolution, then to declare to the exhibitor in what manner in this case (it being entirely contrary to and outside the order of the Criminal Ordinance) he will be able and allowed to act under the authority of this Honorable Council for the maintenance of the right of the high authority, in order thereby to be freed from all liability on that account. In the morning Extraordinary meeting present the Honorable Mr. Johannes Isaac Rhenius, President, and all the members except the Messrs. Maasdorp and van der Riet due to indisposition. The merchant and Member of the Honorable Council of Justice, Mr. Ryno Johannes van der Riet, as qualified by the high authority of this Country to conduct the affairs of the Landdrost of the Colony of Swellendam, Mr. Constant van Nult Onkruyt, Substitute Officer, Prosecutor in a Criminal Case, on the one part, upon and against the burgher Petrus Johannes du Plessies, defendant and prisoner in the aforesaid Case, on the other part. The defendant, having been provided with the claim with annexes, having heard it read, refers to his given responses. Whereafter the Parties renounce further production. The Council keeps this matter under advisement for circular reading. Having come to the Table the documents and proceedings circulated among the remaining Members, initiated by the Landdrost of the Colony of Swellendam, Mr. Constant van Nult Onkruyt, against the burgher Petrus Johannes du Plessies: thus, after ripe deliberation thereon, and having considered with all possible attention that which merited any reflection, together with taking note of all that served the matter and could move their Honors, administering Justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, the defendant is confined to Robben Island for the period of five consecutive years, as he is confined hereby, in order to be sent away from here after the expiration of the aforesaid five years, with condemnation of the defendant to all the costs incurred in this matter and dismissal of the further or otherwise made claim and taken conclusion of the officer. Whereafter by the Honorable Mr. President was produced a letter to the Landdrost of Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman. At Cape of Good Hope, the day and year as above. 46 47 Already in the month of August 1786, a musket having been sent to me by the field corporal in the Bedouw, Frans Lubbe, with the notification that he had caused the same to be taken from a Hottentot, Wessel Caro, because he was suspected of having shot an ox dead, I was informed on 12 October thereafter by the burgher Carel van der Merwe Isaaksz that the above-mentioned Hottentot had stolen a musket from his herdsmen, being two Hottentots; the said van der Merwe subsequently having come to me again the following year, namely on 16 October of the past year, and the same musket having been shown to him among several others, he immediately recognized the above-mentioned as his own, which I returned to him, just as that same afternoon the burgher Arnoldus Vlok complained to the undersigned that one of his slaves accused the above-mentioned Hottentot of having administered poison to him, but that the said slave had recovered again, without any probability of that accusation being able to be deduced by the undersigned from the aforesaid story. That subsequently on 2 January of this year, the said van der Merwe having informed me in writing that for some time continuously, now one and then two sheep had been stolen at night from various local residents there, the above-mentioned Hottentot was held very suspect regarding this, and now upon information received that the same was again staying in the Bedouw at a certain Jan Matthys Kok, he notified the said Field Corporal Lubbe of this and that he should see to taking that vagrant prisoner, after which on 8 April last the aforementioned Hottentot Wessel Caro was also sent to the undersigned by the said Field Corporal Lubbe, with the request that he might be banished elsewhere, Honorable and Worshipful Sir, addressed by Hendrik Lodewyk Bletterman to His Honorable and Worshipful, reading as follows: as he was a vagrant and kept no fixed place of residence and was suspected of cattle theft, he, the field corporal, in case the aforesaid Hottentot were again set at liberty, would no longer be able to discharge his post, since the men who had been commanded for the capture of the same Hottentot had declared that, whereas the same Hottentot had already some years ago been taken prisoner for presumed cattle theft, yet had then escaped again, they did not wish to go out in vain time and again after such robbers and endure much cold and discomfort day and night. And just as, on the one hand, regarding all the accusations made to the charge of the said Hottentot hitherto, aside from that of the musket, not a single piece of evidence has come to my hands to this day upon the basis of which criminal proceedings could be instituted against the said Hottentot with any good success, on the other hand, by virtue of the probability of the presumptions lying against him, it would be no less inadvisable to give him the opportunity again to come into the aforementioned districts, and consequently to set the said Hottentot entirely at liberty, I have deemed it best, following the multiple existing examples thereof, of which shortly before the assumption of my present post a similar case as with the said Hottentot took place here, to propose to Your Honor and Worship whether the said Hottentot could be handed over, with an iron ring on one of his feet, to the burgher Frans Roos, who made a request in this regard, to serve with him provisionally in this manner for board and clothes, so that he may be released from his imprisonment here. Which letter having been read, it was approved to condescend to the request of the Landdrost mentioned therein to the extent that the suspect Hottentot Wessel Caro, with an iron ring on one of his feet, shall be handed over to the burgher Frans Roos, in order to serve with the same for his food and clothing in such manner for the period of five consecutive years. Officio judicis: The Merchant and Landdrost of the Colony Swellendam, the Heer Constant van Nult Onkruyt, on the one side, and the defendant, the burgher Petrus Johannes du Plessis, on the other side, summoned to hear sentence pronounced on the claim and conclusion submitted by the first-mentioned officer of justice against the defendant. The Council, having maturely deliberated and with all possible attention considered whatever merited any reflection, and having noted all that was pertinent to the matter and could move Their Honors; Administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Petrus Johannes du Plessis to be confined on Robben Island for the period of five consecutive years, and after the expiration of the aforesaid five years to be banished from here, with condemnation of the defendant in all the costs incurred in this matter, and dismissal of the further or otherwise made claim and taken conclusion of the officer. The Pro Interim Fiscal, the Honorable Gabriel Exter, plaintiff in his official capacity, against The chief surgeon Gerrit Blikman, who had been assigned to the Company's ship Dregterland, to hear claim and conclusion in a case of committed insolence and brutality, to answer thereto, and further to proceed as according to law. The official plaintiff produces a written claim furnished with nine annexes, concluding as in fine thereof. The defendant requests to be allowed to serve an answer to the one and the other two weeks from today. The Council grants the defendant a copy of the one and the other and the requested day to answer. Subsequently, the said Pro Interim Fiscal, on account of insolence committed against the Landdrost of the Colony Graaff-Reinet by the burgher Louis Cotzee, which case by resolution of the 7th of February last was placed into the hands of the Fiscal's office for the purpose of investigation, requested a personal summons against the said Louis Cotzee. 32. 53. both on account of the farewell of Mr. William Ferdinand van Reede van Oudshoorn, appointed Member of the Honorable Council of Policy, and the reception of Mr. Tobias Christiaan Ronnenkamp, again taking his seat de novo, having been convened: a friendly request was made by Mr. Ryno Johannes van der Riet, acting in his official capacity for the Landdrost of the Colony of Swellendam, Mr. Constant van Nult Onkruydt, that Gerbregtje Elisabeth Vosloo, widow of the late burgher Ferdinand Hartzenberg, who had been sent up by the Landdrost of the said Colony to give testimony of the truth regarding the death of her husband, might be ordered by the Council not to leave the Cape until further orders, to the end that he, in his aforementioned capacity, might be enabled to confront the account of the said Widow Hartzenberg with the statement of the expected burgher Meyer. Which request having been consented to, the said Widow Hartzenberg was notified by the messenger not to leave this capital without the special consent of this Council. below stood: At Cape of Good Hope, day and year as above lower: In my presence, signed: C. Null onkruyt acting presents the following to the roll, with communication of a written declaration from the first chief surgeon Hendrik Le Cueur, concerning the physical condition of the degraded corporal Ian Klepson, who was condemned to run the gauntlet, in order to promptly provide Your Honourable Worships with a report and considerations regarding its contents, the same having the honour to advance in compliance with these orders. - That the reports on the physical condition of the aforesaid person made to the undersigned from time to time are in full agreement with the declaration given by the said chief surgeon, the undersigned having for that reason until now had to postpone carrying out the execution of the sentence of Your Honourable Worships, whereas in this case the dictated punishment cannot be considered as anything other than a correction, it would be against the nature and laws of punishment to deteriorate the condition of the person by inflicting the same, and even to make it fatal; wherefore it is also expressly taught by the learned doctors that for weighty reasons, due to sickness and weakness of the accused, this punishment may be reduced or omitted, and that such falls within the law is sufficiently known in practice, see Port summa quaest Carpz: 142: 144: That, however, this person remaining here longer without further punishment could easily serve as an offence, and such having to occur at the expense of the Honourable Company, the undersigned believes, under correction, that it might be most advisable to have the said Jan Klepson, as being unfit for the Honourable Company's service, return to Europe. - Below stood: Which doing, etc. - Was signed: G: Exter In margin: Exhibited the 12th of June 1788. - - Which having been read, it was resolved to keep this matter under consideration for the present. To summon Carel Sterrenberg by missive order under the council's seal, in order to give testimony of the truth regarding what he has spread here at the Cape concerning the widow of the late burgher Ferdinand Hartzenberg. While furthermore the following was read out by the said Mr. van der Riet in his last-mentioned capacity: The applicant takes the liberty to inform Your Honorable Worships that late yesterday evening, he received here from Swellendam, under escort of the substitute, the servant of the murdered Hartzenberg; that this man during an extrajudicial interrogation fully confessed to having committed the manslaughter, and that because he maintained relations with Hartzenberg's wife, a quarrel had arisen between him and the deceased while they were alone, as well as that the wife of the deceased had given him cause to commit that scandalous deed; thus the applicant provisionally had the said Meyer placed in civil custody in one of the detention rooms, in order to prevent all difficulties that could result from the escape of that man; thus the applicant deemed it his duty, in accordance with the style of proceeding in criminal cases and the ordinance on criminal justice, to give Your Honorable Worships the necessary notice within 24 hours and to request Your Honorable Worships' approval thereof; the applicant intending, once Meyer has been interrogated, as the circumstances of the case appear, to make a further request for criminal apprehension, and likewise to request such a decree from Your Honorable Worships regarding the accused wife as the circumstances of the case shall require. Thus, upon the request made by the officer, the following decree was granted: The Council accords the Officer, the exposer, the requested apprehension regarding the burgher Barend Meyer, and likewise the request made to be allowed to interrogate Elisabeth Roslo, widow of the late burgher Ferdinand Hartzenberg, before commissioners on such articles as have been drawn up for that purpose by the Officer, the exposer; qualifying at the same time the commissioners, in case the said Elisabeth Voslo should come to confess the deed, to be able to take her into apprehension as well. That the said Sies, besides not yet having produced the aforesaid sum of 75 Ryxds, of which he, the Fiscal pro interim, had already delivered the agreed 25 Rps from his private purse to the aforesaid Pauli, had moreover since that time behaved very irreverently and obstinately toward him, the exposer; he, the exposer, however, had never wished to pay attention to that in order to prevent unpleasantness; that the said Sies had nevertheless gone so far with his insolent undertakings that yesterday, when the exposer was at the guardhouse of the Württemberg Troops on the square, he had not refrained from intentionally offending him, the exposer, first by walking back and forth several times with the hat on his head close against the body of the exposer and spitting down in front of him; but that also, notwithstanding he, Sees, was told in a friendly manner by the same exposer that he must refrain from further insolence, or that such measures would be taken concerning him as are deemed serviceable for the security of the public roads and similar public places, neither this polite admonition nor the presence of the Captain Lieutenant van Kervel, with whom he, the exposer, was in conversation, nor the presence of other bystanders, had been able to restrain him, Lies, from placing himself right in front of the exposer and defying him to such an extent with various mocking and taunting words, that he, the exposer, although having hitherto overlooked everything with calm so as not to expose himself to hateful encounters in public, was finally compelled to have him, Sies, taken into civil arrest. The undersigned, Morits Herman Otto Woeke, Landdrost of the Colony Graaff-Reinet, having been privately informed that a certain Jan Jurgen Meyer, formerly confined to Robben Island by your Honorable Worships by definitive sentence, has made himself a fugitive from there and violated his confinement, according to received report keeping himself beyond the Roggeveld with the counterfeit coiner Carel Kruger, alongside his brother Jacob Kruger and a certain Anthony Botes, all together in a plot, and from there betakes himself into this Colony, to a certain Jurgen Smit residing at the Sundays River, where the fugitive's wife happens to be found; for verification whereof the undersigned has the honor to attach those depositions to your Honorable Worships. Yet although the undersigned knows himself obliged ex officio to have all fugitives, vagrants, and similar scoundrels apprehended and delivered into the hands of Justice, the undersigned is nevertheless ignorant for what reasons, both the undersigned and the public of this Colony regarding the incident in the case subject, and your Honorable Worships' further decree concerning this, whether by supplying publication to the undersigned or by writing from the Fiscal pro interim Mr. Exter according to custom, has not been done, and therefore the undersigned also does not know whether any pardon might have been granted to the fugitive and he discharged from his confinement; or whether the fugitive might have been declared an outlaw by your Honorable Worships, as each and everyone could easily excuse themselves with ignorance, just as the undersigned himself can, having understood this or that merely discourse-wise, and could show themselves disinclined to apprehend such vagrants. 75. Thursday the 17 July 1788 in the forenoon, present the Honorable Johannes Isaak Rhenius, President, and all the Members, except Mr. van Echten due to occupation. While the Council was convened in extraordinary session today to review and sign the sentence of the slave January, the Honorable President brought to the table a certain representation and annexed documents, already read by the respective members, from the Senior Merchant and Cellar Master, as well as Member of the Honorable Council of Policy, the Honorable Mr. Jacobus Johannes Le Sueur, concerning the soldiers Bernhard Christiaanse, Bernhard Koningswinter, and Johannes Kuipers, previously stationed on Robben Island, but fetched back from there upon obtaining further indications. Concerning these persons, the said Honorable Mr. Le Sueur, in the aforementioned representation, because of the doubt that still existed regarding this matter, submitted for consideration whether, since the Most Noble Lords Seventeen have been pleased to write to the government here that the Right Honorable Baron van der Linde tot Blitterswyk has been appointed Independent Fiscal for this government, who was expected here shortly, it would not therefore be best to leave the prosecution of this matter suspended until the hoped-for safe arrival of the well-mentioned Lord Fiscal, and in the meantime have the persons of Koningswinter and Kuipers return again to their previous confinement on Robben Island, yet suggesting with respect to the aforesaid Christiaansen whether it would not be most advisable, in order to avoid all correspondence between him and his aforementioned comrade Koningswinter, to place him separately from the other. The contents of which representation and documents having been deliberated upon, it was approved and agreed, on account of the motives diffusely set forth therein, to stay this matter until the expected Honorable Independent Fiscal shall have arrived here; and the aforesaid three detainees, however much the Council considers it very necessary not to have them placed together, yet on the grounds that there is no opportunity here to keep them separate in any other convenient and secure manner, will therefore be sent back together again to Robben Island. It having been communicated by the Honorable President to the convened Members that His Honor had caused this extraordinary meeting to be convened at the express request of the Fiscal Pro Interim, the Honorable Gabriel Echten, the said Fiscal Pro Interim then appeared in the Council, who orally made known that yesterday, by extract resolution of the Right Honorable Governor and Honorable Council of Policy, there was placed into the hands of the Fiscal Office an extract from such report as was submitted to the well-mentioned Council of Policy by the committee appointed by the said Honorable Council of Policy to investigate the damage caused to the Honorable Company by the former First Sworn Clerk at the Political Secretariat, Johannes Marthinus Horak, together with and alongside all the documents relating thereto, in order to initiate such procedures against both the person and property of the said Horak as the nature of the matter required, as well as to investigate with regard to the other sworn and ordinary clerks at the Political Secretariat appearing in the documents, to what extent they might also have made themselves guilty of any fraud or malversation. That the said Pro Interim Fiscal, having found this case to be of such a nature that he maintained in the first place that he must immediately secure the person of the mentioned Storak, therefore requested a decree by virtue of which he would be qualified to cause the often-mentioned Storak to be apprehended. Which request having been deliberated upon and taken into consideration that the said Horak, by the aforesaid resolution, is already himself considered as someone who has made himself guilty of malversation and theft of the Honourable Company's monies, and therefore not the least doubt remains, neither concerning the act committed nor with regard to the perpetrator himself: it is therefore resolved to grant the requested apprehension to the said Pro Interim Fiscal, and likewise that he should immediately betake himself with the court messenger to the house of the mentioned Storak to execute this decree, while in the meantime the Council would remain assembled to await the outcome hereof, in order that, in case the rumours that have already spread, namely that the mentioned Storak has absented himself, should prove to be true, such further measures may then be taken as the circumstances of the case would require. The Pro Interim Fiscal, having subsequently made known upon his return to the meeting that he had been informed by the wife of the mentioned Storak that her husband had gone out to the country, and that she still expected him back this afternoon, it was then at the same time requested by the same Pro Interim Fiscal whether, in case the said Storak, notwithstanding the diligence which he, the Pro Interim Fiscal, would endeavour to employ so as by no means to render the resolution of this Council illusory, might nevertheless not be found nor present himself: the said Horak might then tomorrow be summoned by edict upon a certain fixed day, after the tolling of the bells; the said Storak therefore, if he could not be apprehended within twenty-four hours, would then be cited by edict under the tolling of the bell, in order to appear in judicio here in the Council Chamber on the next ordinary court day, which will be the seventh day of the upcoming month of August, in order to answer for his aforesaid malversation and committed theft, upon penalty that in case of negligence or non-appearance, proceedings will be instituted against him as the laws dictate. this illustrious court of justice were defamed in a wicked manner; this matter had by the aforesaid resolution been placed in the hands of the Fiscal office, in order to institute such proceedings, both against the said defamatory writing and the author thereof should he be discovered, as the nature of the case required; That since it was not very likely that the creator of the said libel—notwithstanding that the government had placed a considerable reward of One thousand Ryxd:s upon it—will ever be discovered, and yet all renowned Doctors of Law teach that in such cases the pasquil must be burned by the hands of the executioner, and at the same time the author be declared infamous: he, the officer acting as plaintiff, therefore requested that in this case also action might be taken in conformity with the aforesaid opinion of the criminalists. Having deliberated upon which request and taken into consideration the great importance of opposing in a striking manner such shameful conduct in order to maintain peace and good order in this colony and to preserve everyone in his good name and reputation; The following definitive sentence was thereupon pronounced. The Council, having heard the request made by the officer acting as plaintiff, and having also considered everything that pertained to the matter and could move their Honorable worships, declares the creator, writer, and poster of the said infamous libel to be dishonorable and infamous, with the reservation that whenever this villain may fall into the hands of Justice, he shall be punished according to his deserts: furthermore, one copy of the aforesaid defamatory writing shall be burned publicly on the scaffold by the executioner in the presence of a Judicial Commission. Which sentence it was also deemed proper to make known to the public under the tolling of the bell from the balcony of this Castle in the presence of the full council, and subsequently to carry into execution as aforementioned. While it was furthermore also understood, in order to be able to convict the perpetrator should he be discovered in time, to deposit the other copy of the said pasquil under the Council's Seal at the Secretariat of Justice. At Cape of Good Hope, the day and year as above. in my presence signed C:L: Neethling Today the 15th of August 1788 the undersigned, by order of the Honorable Lord President, brought to the reading of the respective Members a letter from the Landdrost of the Colonies Stellenbosch and Drakenstein, Mr. Hendrik Lodewyk Bletterman, containing a report that Elisabeth Malan, wife of the Burgher Cornet David Malan, had given notice to him, the Landdrost, that her husband, with whom she had held no carnal conversation since he had according to her statement been caught having mingled with the female slave Sara, belonging to the Burgher Iurgen Radyn; on Monday night the 11th of this month departed from their residence situated in Hottentots Holland, and had taken with him a quantity of powder and lead, together with some bedding and two riding horses, and that the same night the aforesaid female slave Sara had likewise absented herself; While the said Elisabeth Malan had further added that she, from what her said husband had previously often said himself, presumed that he had gone to the banished burgher Carel Kruger; And it being proposed by the undersigned, also in the name of the well-mentioned Honorable Lord President to the respective Members, whether, since the said Malan by this desertion of his and committed adultery has made himself subject to Justice, and with regard to the Estate possessed in common between him and his Wife, considering that an apportionment and division thereof will immediately have to take place, the necessary precautions ought to be taken; one might therefore deem it proper not only to have the Honorable Vendue Master notified on behalf of the council that, since the wife of the said Malan, who currently has no legal standing, is unqualified in the absence of her
