After reading of the request made by the aforementioned Landdrost and the documents submitted therewith, and having deliberated thereon, the following decision was reached: The Council, keeping the request made by the Officer ex officio regarding the burgher Cornet David Malan Davidzoon under advisement for the present, enjoins the officer to obtain as speedily as possible, and especially from the wife of the accused Malan, such further evidence as may serve to substantiate this case, in order that the Officer's ex officio request may subsequently be disposed of as this Council shall deem proper. And the said Landdrost requested, after the pronouncement of this resolution, the Council's authorization to hear the wife of the frequently mentioned David Malan in plenary session on such articles as were drafted by him ex officio to that end; which request, in view of the singular circumstances accompanying this case, was granted to the said Landdrost. The pro Interim Fiscal here, the Honorable Gabriel Eyter, Officer, Prosecutor in Criminal Matters, on the one side, against the former First Sworn Clerk at the Political Secretariat, Johannes Marthenus Horak, defendant, in person, on the other side, in order to purge his first default and further to still answer to the principal charges concerning the malversations and thefts committed by him. The member of this Council, the Honorable Ryno Johannes van der Riet, acting herein due to the indisposition of the pro Interim Fiscal, requests, because of the non-appearance of the defendant, the second default with the benefit thereof and a third edictal citation for two weeks from today. The Council, because of the non-appearance of the defendant, grants the Officer Prosecutor the requested second default, with the benefit thereof, and a second edictal citation for two weeks from today. Which request was unanimously assented to. Whereupon the aforementioned Mr. van der Riet, for the pro Interim Fiscal, submitted a written remonstrance in order to obtain, on account of the far-reaching, atrocious insults inflicted by the burgher Stephanus Fouché upon the Heemraden at Zwellendam, Daniel du Plessis, Jan Andries Holtzhausen, and Jacobus Steyn, alongside the Secretary Menso Blankenstein, in their respective offices, a decree by virtue of which the Officer ex officio might be qualified, because of the great remoteness of his residence, to summon the aforementioned Stephanus Fouché in person by missive under the Council's seal against a certain period to be fixed, in order to hear such Criminal Demand and Conclusion, request or requests, as he, the Officer, might wish to make and take in the aforementioned matter against him, Fouché, to answer thereto and further to proceed according to law. The Council furthermore grants the Officer Prosecutor, for the indemnification of the Honorable Company, immediate execution on the estate of the said Mollerstroom; provided, however, that no payment shall be made from these proceeds before the account, which is now being revised and confronted once more out of precaution regarding what the said Mollerstroom enjoyed from the Honorable Company, shall have been produced in Council, and the exact sum that is due to the Honorable Company from the estate of the said Mollerstroom in the aforementioned matter has been established; and likewise before all the country people who, in satisfaction of their overdue recognitions, handed over the moneys to the said Mollerstroom, and for which the Honorable Company has not yet received its payment into the Honorable Company's treasury, shall have been summoned hither and have provided the necessary information.

A E:: 85 Subsequently, on behalf of Miss Yda Margaretha Adleda, wife of the former First Sworn Clerk at the Political Secretariat, Johannes Marthenus Horak, the following petition was presented. To the Honorable Johannes Isaak Rhenius, President, together with the other Honorable Members of the Council of Justice of this Government. Honorable Sir and Gentlemen! With due respect, and most humbly, Yda Margaretha Adleda, wife of the former First Sworn Clerk at the Political Secretariat, Johannes Marthenus Horak, gives to understand: That since the undersigned's husband had always flattered himself with the certain hope that his affair would be settled politically, he was therefore also never prepared for such means of defense as might now be of use before the Honorable Council of Justice. That he also remained in that firm confidence until, some time ago before his case was handed over to the judiciary, he had to learn through rumors that he would be taken into custody, his affair handed over to Justice, and that he would be prosecuted by the Fiscal. That seeing himself thus at that moment and entirely unexpectedly threatened with a criminal action and imprisonment, and having been advised by good, trusted friends to see to his safety, and seeing himself then directly unable to provide any means for his defense, he was thus compelled to keep himself in hiding. That he never, for any reasons of contempt or disrespect for Justice, or that he found himself so guilty that he would never have dared to appear before Justice to clear himself of everything that has been laid to his charge and that might yet be brought against him; on the contrary, he has declared more than once, and even desired, that his case had rather been concluded judicially, in which case he would then have been able to prepare all those means that could have served for his defense. While the petitioner, on the other hand, also takes the liberty herewith to submit to Your Honors' consideration how she presently finds herself in that deplorable circumstance which could ever befall any mortal, since the petitioner regarding the case [illegible] And that the undersigned, unaware and innocent of the crime with which he is accused, and having nothing else in hand than those two copies of petitions, one submitted by himself and the other by the family to the Honorable Council of Policy, therefore delivers the same to this Honorable Council with humble request, on the one hand, that favorable consideration and regard may be given to those arguments appearing therein toward the mitigation and lightening of his punishment. That the undersigned, as his wife, not knowing herself where he is to be found in order to give him notice of the summons issued to him on behalf of the court, and fearing the disadvantageous consequences thereof, must thus see herself compelled to address the Council. That he therefore must not be considered as someone who has willfully made himself guilty of flight, because otherwise he could have done this long ago with the utmost safety, for which purpose he had already seen himself in complete freedom for about four months, without ever having been forbidden by anyone to absent himself from the Cape.

86. 87 with respect to her husband, having never or at no time previously had not only not the slightest knowledge or acquaintance, but even not the least suspicion of whatever nature, she has thus with this accumulation of disasters fallen completely unexpectedly and suddenly, and the petitioner trusts, therefore also on that ground, to be able to find some aid and comfort with Your Honorable Worships, from whom proven evil indeed receives its punishment, but ignorance and innocence on the other hand are protected. For this reason the petitioner takes the liberty to inform Your Honorable Worships hereby that she has now been reliably informed that a resolution has been taken by Your Honorable Worships to realize the petitioner's entire estate into money by prompt execution for the indemnification of the Honorable Company. The petitioner can by no means conceal from Your Honorable Worships that she was exceedingly astonished at this news, since she is not only fully aware that her estate by far infinitely surpasses the amount that the Honorable Company and other creditors have to claim upon her same estate, but also that she knows for certain that Your Honorable Worships cannot hitherto be informed of the exact sum that the Honorable Company must have from her estate, as it is sufficiently known to the entire public that, notwithstanding that the report prepared by the commissioners expressly appointed to the investigation of that matter has already long since been submitted to the Honorable Worshipful Council of Policy, and thereby besides the petitioner's husband also the late sworn clerk Diemel and several other clerks at the Political Secretariat have been acknowledged for various sums, they are nevertheless now again busy revising and checking everything de novo, and that for the reason that some of the said acknowledged clerks, having had the liberty to make extracts from the submitted note, with the same extracts whereon were noted the names and places of those for whom the payment of the arrears was noted in the so-called gamekeeper's book, or had signed the same with their own hand, went to the Honorable Company's treasury and conducted a thorough investigation there, as it then also immediately appeared to them from that investigation that of some, all, and of others, indeed the greatest part of the entries acknowledged and marked as unpaid by the said commissioners in their report or note submitted therewith, had been paid into the treasury. Now the undersigned asks, albeit with reverence and with due respect for the high dignity of Your Honorable High Worships, whether in a matter of such great importance, wherein the total ruin of an entire family, an ignorant, innocent woman and children are also involved, double accuracy and double caution ought not to have been the guiding principles of those who were charged with this so weighty investigation, and whether thus according to their estimate the petitioner's entire estate should just immediately be realized into money, since it is more than probable that of those enormous sums that were charged to the account of the petitioner's husband, many will also, just as with the other acknowledged clerks, be found in the Honorable Company's treasury as actually paid; as the petitioner's unfortunate husband before his flight testified to the petitioner under the most solemn assurances that the sum that he took upon himself, both in the Lord's right and recognition money, on account of the scarcity of cash prevailing so much here, in order to employ the same for paying the expired terms on his house and renovating the same, and yet later, in better times, to pay it again in cash into the Honorable Company's treasury, did not amount to more than at the very highest 70 to 75000:- guilders, at the same time warning the petitioner, in his absence, strictly not to proceed to any further payment, but in all cases to protest against it, as he had never or at no time enjoyed the same: While the undersigned, if it were nevertheless insisted upon, immediately because this is a matter that concerns her so in particular, would know to protest, and request that commissioners were.— have

88 89. from Your Honorable Worships, on whose report, after all, justice is always done by the Court, might examine and confront the aforesaid gamekeeper book and cash books further and with the requisite precision, and also that there be summoned before Your Honorable Worships and heard all the persons from whom the aforesaid petitioner's husband is known to have received moneys on behalf of the Honorable Company. Above all this, Right Honorable Worshipful Gentlemen, the undersigned also further understands that whenever proceedings were taken against her property, the undersigned then, either as the attorney of her husband or indeed for herself privately, in view of the absence of her said husband, ought to have been summoned by the officer to hear claims and conclusions entered for the payment of a significant sum on behalf of the Honorable Company, or else to see execution decreed thereon, in which case the petitioner would have been able to put forward her interests, and at the same time make such remonstrances and requests as she would have deemed serviceful in her case, considering that the undersigned, now being aware and assured of the magnitude of the sums of money enjoyed by her husband, cannot in the least be indifferent with respect to the tantum which one would wish to claim from her, lest she see herself—however much she recently obtained a considerable sum from her father by inheritance—nevertheless reduced to the utmost poverty. For these reasons, the undersigned turns to Your Honorable Worships, as those to whom the maintenance of an unblemished justice is commended in this place on God's behalf, and whom she, the undersigned, also trusts will take to heart in this matter both the interests of the undersigned, who sees herself innocently and guiltlessly brought into such a sad situation, and those of the Honorable Company. And the undersigned therefore very humbly requests that Your Honorable Worships please not only put into effect those means which are required to assure Your Honorable Worships regarding the settlement of the sum which the Honorable Company is entitled to from the undersigned's estate, so securely that not the least doubt remains thereof, to such an extent that Your Honorable Worships and the undersigned may safely proceed upon it, but that also, if by chance Your Honorable Worships unexpectedly cannot resolve to postpone the sale of the petitioner's estate until then, it may nevertheless be Your Honorable Worships' pleasure to grant the petitioner permission to reserve from her said estate—since the petitioner is assured that the estate will amount to more than all claims yield—for her convenience and help, at her choice, some of her faithful slaves who have always served so well, together with such household furniture as is unavoidably necessary for her. The Council, having read this request and considered its contents, grants the last part of the request made by the petitioner, namely to reserve, at her choice, some of her slaves and most necessary household furniture. After which reading the Gentlemen Rinnenkamp and van Echten, finding themselves most severely offended by certain expressions which appear in the said request regarding the commission assigned to Their Honors by the Honorable Worshipful Council of Policy in the case of the said Horak, requested a copy of the aforesaid request in order to make such use thereof as Their Honors deem necessary, and that at the expense of the estate of the mentioned Horak. Which request having been granted, the contents of the aforesaid request were subsequently maturely deliberated upon, and taken into consideration that while the Council knows very well that the duty of a judge is always to maintain an unblemished justice without respect of persons, and this Council has also always striven with the utmost care to proceed in every respect according to their oath and conscience, they therefore do not need to be animated or spurred on thereto by anyone, just as the precaution now implored by the petitioner has already been used in granting summary execution on the estate of the said Horak. While after consideration of all this, it was granted by apostil on the aforesaid request.

That on Tuesday the 12th of the recently passed month of August, in the afternoon around the hour of four o'clock, having been brought to the knowledge of the petitioner by the burgher Isaac de Vlaming, that he had been requested by the wife of the burgher Cornet David Malan Davidsz to make known to the petitioner on her behalf that her husband, the above-mentioned Malan, had absented himself from the dwelling place during the past night and had taken with him his flintlock gun, powder and lead, as well as a bolster, two pillows, some clothes, two thongs and two riding horses, and also that the maid of the burgher Jurgen Radin, from the kloofmaker De Vos where she had been placed as a wet nurse, had also made herself a fugitive during that same night, the said Mrs. Malan having requested through him, De Vlaming, to be informed by the petitioner how matters now stood with the impending public auction, and whether the placards by which the sale to be held on the aforesaid 18th of August had been fixed ought not now to be torn down, the petitioner, for reasons to be alleged hereafter, having essentially addressed him, De Vlaming: but De Vlaming, what business have you meddling in other people's affairs, and in order to make him leave, also asked whether he held a power of attorney. Whereupon the same affirmed that he did not, adding I have done no more than what Aunt Betje requested of me, and misfortunes may come of it, whereupon the petitioner, asking him, De Vlaming, why he thought such a thing? the same replied thereto God knows, or God alone knows, for sir will certainly hear of it later, so that the petitioner finally told him, De Vlaming, that even if he did have a power of attorney, he could not accept such a commission from him, since the matter was of far too great importance and the woman herself ought to come. That on the following day, the petitioner, having proceeded in the forenoon around the hour of eleven o'clock to the building under construction of the colony's mill, was shortly thereafter told by one of the orderly riders, who had sought and now found the petitioner: that Mrs. Malan had arrived with her horse wagon at the drostdy, urgently needing to speak to the petitioner, whereupon the petitioner immediately hastened thither, and upon his arrival found, sitting and conversing with each other on one of the benches in front of the door, the aforesaid wife of the above-mentioned Malan, namely Elisabeth Malan, and her brother-in-law the Heemraad the honorable Wium, and the latter having departed, the first-mentioned Mrs. Malan came inside into one of the front rooms with the petitioner and sat down there. That the petitioner was essentially informed by the aforesaid Mrs. Malan that the day before yesterday, in the early part of the night between the aforesaid 11th and 12th, she had heard a noise, but since it had happened more than once that her husband had gone out in the evening and returned home at night, she had thought that he had then likewise come home, but when she had risen in the morning and learned that no wine had yet been given out to the people, she first had her son knock on his chamber door, and this having been done repeatedly without obtaining any answer, she had the door opened from the inside by pulling open one of the windows from the outside, and then found that her husband had absented himself, and upon inspection discovered that he had taken with him his flintlock gun with his bandolier, powder and lead, as well as a new pair of trousers and two pillows, and also subsequently understood that he had likewise carried off with him two riding horses from the stable, and two thongs from the slave house, and also that the maid of the said Radyn had likewise absented herself in that same night, and she therefore did not wish to wait any longer to make the matter known first to the petitioner and then at the Cape, while she at the same time requested to know whether her impending auction might proceed or not, as the placards for it were still posted. That the narrator, meanwhile firmly trusting that the said Miss Malan would have fulfilled the promises she had made to the narrator, nevertheless found himself disappointed therein, because he was informed by the gentlemen commissioners, who arrived at Stellenbosch the following day at sunset, that although they had indeed heard something by way of rumor regarding the desertion of the said Malan, they were nevertheless not aware that anything in that regard had been brought to the knowledge of the Honorable Lord President of this assembly by the aforesaid Miss Malan on the day before their departure from here, so that the narrator then only continued to wait and see whether it would not be made known to him on behalf of the said Radyn that his female slave had also gone missing on that same night, which occurred shortly thereafter. but had already been found at the house of the said Mrs. Malan by the messenger, who then also came to the narrator the following day and, being asked whether he was now inclined to make a declaration before the commissioners regarding what might be known to him concerning the desertion of the said Malan, as well as what had been imparted to him by the same, he replied thereto that he knew nothing other than that the maid Sara, given to him by Mrs. Radyn as a wet-nurse for his child, had absented herself during the night between the aforesaid Monday and Tuesday. And to the further question of whether Malan had not been caught with him in the vineyard some time ago, he answered: No, he only came to me once since the maid has been with me, and that was to buy slaughter cattle for the auction. That the narrator, soon discerning from the behavior in the further account given to the narrator by the said De Vos that he, being aware of the main part of the matter concerning the aforesaid Malan, was seeking to obscure the truth; just as he was informed at the very same time that also the above-mentioned, with pleasure in causing the entire matter to take on another appearance, and if possible thereby to make the narrator suspect in the eyes of the public, as though he sought to bring the good inhabitants into grief through bad and wrongful reports, or to ruin them through ill-founded and sinister lawsuits, did not hesitate to submit in writing to the above-mentioned councilor how he should now present the matter to the narrator. That the relator, having subsequently been informed in the afternoon of Saturday the 23rd following that a servant of the Heemraad the Honourable Philippus Albertus Myburg had arrived in the village of Stellenbosch, who was nevertheless to depart immediately, and who on his way hither was said to have seen the aforementioned Malan and the maid, the relator forthwith summoned the same, and having subsequently inquired of him, it was related to him by the same, named Abraham Timmerholm, stationed at the farm of the aforementioned Heemraad the Honourable Mijburg situated in the Touw, that on his way hither, on Saturday the 16th preceding, having arrived near the burgher Simon Sandenberg before or at the Hex Riviers Kloof, just beside the road there, he had seen two haltered horses walking, and since that was not the outspan place, it having appeared strange to him, he, having approached the same horses together with the said Sandenberg, who was a few paces behind him, a male person had jumped out of the bushes across a stream and come towards him, dressed in a new green jacket and long white Chinese linen trousers and wearing a round pale hat, whom having asked who he was and where he was going, the same had given his name, which had, however, slipped Timmerholm's memory, and said that he had been up-country to fetch a maid whom he was now bringing down, which maid he had seen standing a short distance away, wearing a chintz jacket, a green grogram skirt and, so he believed, a cloth around her head; that having further asked that man whether there were any more people with him, that man was said to have answered him: No, I am here alone with the maid whom I fetched; after which the relator having asked whether that man called himself Malan, the same answered no, that man did not give that name. That the relator, since he is not authorized to take any statements except before Commissioners from this Honourable Council, having ordered that man to proceed hither in order to render a statement before Commissioners here regarding what he had related, the same requested to be allowed to continue his journey for the present, as a [illegible] provided with a musket was already ahead and he ought to ride after the same, promising however to return as soon as possible for the aforementioned purpose. That not only did the maid of the burgher Jurgen Radyn on the aforesaid 11th, unusually provided with fine clothes and without any harm having been done to her by anyone (as far as is known), absent herself on that same night, leaving behind her suckling child, but that it is also presumed that she was taken along by the said Malan, whilst the wife of the said Malan expressed herself to her brother-in-law in this manner: I shall report the matter to the judge, for he has definitely gone off with the maid, because he has provided himself with clothes, a firearm, powder, and lead; that he, Malan, not only made himself suspect of having had carnal conversation with that same maid, but that this maid herself testified to her mistress that she had fathered her child with the said Malan. The defendant presents the following plea for the record: Right Honorable and Honorable Sirs, The defendant humbly requests to be excused from the interrogatories, or otherwise to be allowed to have a copy before being required to answer. However, the undersigned takes the liberty of clearly demonstrating to Your Honorable Worships the groundlessness of their contention. From the attached deeds of the creditors of the estate, it will be evident to Your Honorable Worships that they make not the slightest difficulty regarding payment, but gladly wish to leave their capital sums with the undersigned, so that this assumption is out of place. Secondly, regarding the absence of her husband, the undersigned will briefly state that, subject to correction, she trusts one cannot judge thereon before and until he returns. Indeed, what reasons could be found, since the undersigned safely trusts that her husband has not made himself guilty of any matters in order to save himself by fleeing or going into hiding, and who will thus in the least doubt his return, for, be it said with all respect, he who has done no evil need not fear any evil. The Defendant for answer says that her husband himself is the cause of her fall, as having left her in the lurch in the recent war, when she had to pay 10 rds for a room in the dearest of times, without supporting her as every husband was obliged to do, so that she was thus driven to it by necessity, while her husband further had crawled with his own slave women and Hottentot maids, and had beaten and mistreated her, requesting that the Council please take these circumstances into consideration in her favor. The Officer of Justice, Plaintiff, persisting with his Claim for replication, and the Defendant for duplication, renouncing further productions. And since his estate is found unable to continue doing so, wherefore the petitioner in said capacity turns to Your Honorable Worships with the humble request that it may please Your Honorable Worships to authorize the principal petitioner to send all necessary supplies to her said husband, such that he has need of nothing else there other than decent lodging, and that Your Honorable Worships may please to make such equitable determination regarding the payment for it as Your Honorable Worships shall deem fit. Shows with due respect the undersigned pro interim Fiscal: That the petitioner having been informed on the 7th by the former bookkeeper Sr. Petrus Albertus van der Riet at the beginning of this month of September, that recently he had gradually lost 11 silver spoons with 5 ditto forks and 3 knives with similar handles, as well as one small and 2 large serving trays, the petitioner could not fail to make this directly known as much as possible, in order to give notice of it upon discovery of such silverware. That consequently, the citizen Ian Hendrik Smit having made known to the petitioner the following day that he had bought the aforementioned silver from a certain Markstad, and the latter from a soldier of the battalion, the petitioner decided to place both of these persons provisionally under civil arrest, and further to gather the necessary information regarding this matter. That according to the same and the statement given before the commissioner lords and the general inquiry made, the corpus delicti is fully established, and that the aforementioned soldier Johan Hertel, who however absolutely insists he found this silver, is in all respects guilty of the theft of the same, or must be the perpetrator himself, thus the petitioner finds himself compelled, ex officio, to act against the said Jan Hertel in the aforementioned case. Jonas Albertus van der Poel and his wife Anna Solome Eksteen, how the petitioner's estate, through misfortune and bad conduct by servants in purchasing cattle, has fallen significantly behind, so much so that the petitioners have seen no way to satisfy all their creditors, and have already been pursued by some, indeed to such an extent that their estate has been executed, whereby it has come into the hands and administration of Your Honourable Worships, which step is the most desperate that the petitioners have known to happen to them in their lifetime, and whereby they have both found themselves in the utmost turmoil of emotional passions; that during the inventorying of their goods, the Honourable Worshipful Commissioners assisted with the same, firstly being received by the female petitioner here at the Cape in the absence of her husband not only improperly, but out of an extreme confusion she inflicted several bad and impermissible treatments upon the well-mentioned Honourable Gentlemen; and in that state she brought some false reports to her husband the petitioner upon his return home, which, added to the petitioner's already extreme emotional disturbance, drove him even further and almost to frenzy, so that he received the well-mentioned Honourable Commissioners with no less coldness during the inventorying on his farm and injured them in their character; concerning all of which the petitioners were summoned before Your Honourable Worships at the last court session, the matter then being found so aggravating by Your Honourable Worships that Your Honourable Worships placed the same in the hands of the pro interim Fiscal, whereby the petitioners anticipate nothing other than facing a criminal action in their already disastrous state, and from which the petitioners must notoriously anticipate their further total ruin. Reasons why the petitioners in their pressing circumstances turn to Your Honourable Worships, confessing with the highest and most heartfelt sorrow their committed misdeeds, but having occurred, as just mentioned, in the utmost confusion of their state of mind, and by no means with a true intention of contempt for the well-mentioned Commissioners, Your Honourable Worships, most humbly begging for forgiveness in this regard, in the hope that Your Honourable Worships will take into consideration what such a state of insolvency must bring upon the hearts of an honest person, and that it may please Your Honourable Worships to forgive the petitioners this misstep, or at least to declare the same civil and composable, and that the pro interim Fiscal may be authorized to settle with the petitioners regarding this in the presence of the Honourable Commissioners. The Council, having read the petition submitted by the petitioners and having heard the officer thereupon, orders the petitioners Jonas Albertus van der Poel and his wife Anna Salome Eksteen, on account of their committed insolences, to request forgiveness at the upcoming ordinary court day in full court in the presence of the officer, this Council in general, and the Honourable Commissioners in particular, with condemnation of the petitioners to the costs incurred in this matter. Which having been read and the officer also having been heard thereupon, the same declared that, however much he believed he had sufficient grounds to pursue the appropriate procedures in a criminal case against the said van der Poel and his wife on account of the insolent conduct held toward the Honourable Commissioners, he nevertheless, especially if the offended Gentlemen wished to be satisfied therewith, left this matter to the Council's judgment. While then the Honourable Commissioners, also having testified that in consideration of the circumstances which the said van der Poel and his wife set forth in their aforesaid petition, they likewise completely leave this matter to the Council's judgment: thus, after the said Gentlemen had stepped down, the said petition was maturely deliberated upon, and an apostil was granted thereupon by a unanimity of votes.

120. 121. The titular Acting Prosecutor submits his written claim provided with four annexes. The Honorable Gabriel Exter, titular Acting Prosecutor in this criminal case on the one side, against Mentor of Mozambique, slave of the widow of the late burgher Willem Versfeld, prisoner and defendant in the aforesaid case on the other side. The prisoner and defendant, having heard the claim read, says that it is well. The parties renounce further productions. The titular Acting Prosecutor states that since his claim is reinforced with sufficient proofs, the request made by the defendant ought therefore to be rejected. The defendant persists in his request. The Council, having read the written claim and conclusion of the titular Acting Prosecutor, together with the documents produced therewith, and having considered everything that was pertinent to the matter and could move Their Right Worships, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, condemns the defendant Mentor of Mozambique, after being severely whipped by the Caffers, to be judicially sold for the account of his mistress, with condemnation in the costs and expenses of justice, and dismissal of the further or otherwise made claim and conclusion taken by the officer. After the closing of the roll, there appeared before the Interim Fiscal in the Council the burgher Lieutenant Jonas Albertus van der Poel, stating that his wife, owing to indisposition, was unable to appear in person and thus to comply with the order made on the petition presented at the last meeting; but that he nevertheless, both for her and for himself, sought the pardon of this Council and the Gentlemen Commissioners for the offense committed against them, with the added declaration that everything had occurred in a state of confusion of the mind caused by an accumulation of disasters, and with an earnest request that he might also be forgiven for that reason; while he would not only guard against such offenses in the future, but also take care to show all those placed over him such respect as his duty required of him. After which declaration the said van der Poel, having been seriously warned further by the Honorable and Worshipful Lord President to conduct himself strictly in accordance with this declaration made before the full Council, or that otherwise his insolence would be opposed with such effective measures as the laws have established with respect to such unruly and ill-disposed residents, departed again from the meeting. And furthermore, there being brought to the table the memorial submitted at the last meeting by the Interim Fiscal regarding the country people who were to give testimony in the case of the former First Sworn Clerk at the Political Secretariat, Johannes Marthinus Horak, and Assistant Quist Mollerstroom, which had been held under advisement until today; the matter was deliberated upon and at the same time consideration was given to the manifold inconveniences of summoning all the same country people, many of whom reside in the far distant district of Graaff-Reinet, to appear here within a certain fixed term, whether by the judicial citations requested by the titular Acting Prosecutor or otherwise; seeing that thereby not only would much time be lost, and thus the payment of the questionable funds from the estates of the said Horak and Mollerstroom into the Honorable Company's treasury would be greatly delayed, but also the country itself would be made unsafe by a summoning of so many residents and exposed to the raids of the Bushmen as well as otherwise; while in addition the aforesaid estates would thereby have to bear heavy costs; for which reasons it has been judged best and resolved to send to the three respective Landdrosts of the outer districts copies of the aforesaid list produced in the Council of such country people who handed over their overdue recognition monies to the sworn or ordinary clerks at the Political Secretariat, of which however no monies were received into the Honorable Company's treasury; and at the same time...
