122. to write to the Landdrosts of the Colonies Zwellendam and Graaffe Reinet, instructing them, pursuant to the aforementioned list, to summon all the country people residing in their district to their drostdies as speedily as possible, and there to have depositions taken at the requisition of the Fiscal's office, as well as to have the same depositions sworn before commissioned Heemraden; with the proviso, however, that this qualification, with respect to the aforementioned drostdy of Zwellendam, shall in no way be drawn into a precedent for the future, but shall cease immediately after the holding of these inquests; while with respect to the Landdrost at Stellenbosch, instructions shall only be sent that, since it is almost all the same to the country people whether they come to make depositions at the aforementioned drostdy, which lies barely five hours from this capital, or here, he shall therefore send Cape-wards both the persons listed on the aforementioned list who are at his drostdy on the occasion of the impending burgher exercise and inspection of arms, and also write to the inhabitants residing under his district to come up here as speedily as possible to give depositions; and the necessary notification will be issued by this Council to the inhabitants residing under the Cape district for that purpose; while in the meantime, concerning the persons who must bear witness regarding the seigneurial dues, since they mostly reside here at the Cape and in the vicinity, their depositions must also be taken here at the requisition of the [illegible] [illegible]. Finally, it was communicated to the Council by the Honourable President that the pro interim Fiscal here, the Honourable Gabriel Exter, had brought to his Honour's knowledge that the burgher Pieter Heynkes having punished his slave woman Louisa of Mallebaar in an improperly severe manner, he, the pro interim Fiscal, had compounded with the said Henkes regarding this for a sum of 200 Rixdollars; but at the same time it having been reported to the Council by Messrs van Echten and Smuts that their Honours had conducted a proper inspection of the aforementioned slave woman and had then found that she had been mistreated in an inhumane manner, so much so that they had discovered various wounds not only on her buttocks from behind but also on the thighs on both sides up to the groin, to such a degree Wednesday the 8th of October 1788. In the forenoon, extraordinary meeting, present the Honourable Johannes Isaak Rhenuus, President, and all the Members, with the exception of Messrs Myer and De Wet, the former due to business and the latter due to indisposition. The Pro Interim Fiscal, the Honourable Gabriel Exter, having appeared in the Council pursuant to the resolution taken on the last ordinary court day, and having been heard concerning the composition entered into by him without decree or knowledge of this Council with the burgher Pieter Steynkes on account of the mistreatment of his slave woman, it was then advanced by him for his justification: that the aforementioned Heinkes, after he, the pro interim Fiscal, had already given knowledge of the cited mistreatment of the aforementioned slave woman to the Honourable President and the same slave woman had already been inspected by the commissioned gentlemen, had approached him several times and requested him, out of consideration for his impoverished circumstances and to prevent heavy costs, by all means not to embroil him in a lawsuit; that he, the pro interim Fiscal, on that account and because of the repeated entreaties of the said Heynkes, had allowed himself to be persuaded to settle this matter with him for 200 Rixdollars; and all the more so At Cabo de Goede Hoop, day and year as above. below: present me, signed: W: J: van Ryneveld, sworn Clerk. that their Honours testified never to have witnessed the marks of such an extreme mistreatment; while their Honours were also informed that, notwithstanding the aforementioned cruel mistreatment, the pro interim Fiscal had nevertheless seen fit to send the aforementioned slave woman back home to the said Heinkes after the composition; so, after deliberation on this matter, it was resolved provisionally to hold the aforementioned composition as null and void, and to order the pro interim Fiscal to have the same slave woman brought back at the earliest opportunity, as well as to summon him, the pro interim Fiscal, to appear before the Council at the next meeting to be heard on this matter. underneath stood: that since

124. 125. since the said female slave, who was of a insolent nature and had thereby given her master much reason for displeasure, had not died from the mistreatment, and also that the Instruction of the Fiscal allows a composition not exceeding the sum of 200 Ryxds, without a decree from the judge being required in such a composition; while he, the Fiscal pro interim, had furthermore returned the often-mentioned female slave to the aforesaid Heinkes, though under the express condition of having to sell her as soon as possible. Which matter having been brought forward and deliberated upon, it was remarked that however much the said Fiscal pro interim, pursuant to the [illegible] article of the Instruction of the Fiscals, is indeed permitted to compose such fines and offenses that do not exceed the sum of 200 Rixds; the extreme mistreatment by the aforesaid Heinkes can nevertheless never be categorized under those offenses intended in the aforesaid article of the just-mentioned Instruction: since such mistreatments rightfully belong among those crimes regarding which the correction, depending on the findings of the case and according to the mitigating or aggravating circumstances, can be extended by the judge himself to a corporal punishment. So that no officer can nor should be granted that power and authority to impede the judge or deprive him of the ability, whenever he merely settles his fine up to the aforesaid sum of 200 Ryxds and no higher, to counteract the cruelties of a master with respect to his slave by a judicial sentence, and to cause such unfortunate victims of the malice of their masters to receive that justice which they may reasonably expect from the fairness of a neutral judge. Yet nevertheless, having taken into consideration in this regard the impoverished circumstances of the aforesaid Heinkes, the insolence of the just-mentioned female slave, and also that the same female slave is not without hope of being completely cured and recovered from the blows inflicted upon her, even so that no fear remains that her health will need to suffer the slightest harm thereby: so it is, for these reasons, that the aforesaid composition is for this time The sworn Clerk of this council After which, the documents and records having been brought to the table that served in the trial initiated by the Fiscal pro interim against the chief surgeon of the ship Dregterland, Gerrit Blikman, residing here, defendant; the Council, after considering everything that merited reflection and could move Their Honorable Worships; Administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, has dismissed the plaintiff from his claim and conclusion brought against the said defendant, condemning the said defendant however, for reasons moving Their Honorable Worships thereto, in all the costs incurred in this matter, furthermore reserving to the defendant the action implored by him in his conclusion of answer, with respect to such person or persons against whom he shall be advised in due course to institute the same on account of these proceedings. /:was signed:/ At Cabo de Goede Hoop, the day and year as above. /:below in my presence /:signed:/ W: J: van Rijneveld Clerk. Versus The pro Interim Fiscal here, the Honorable Gabriel Exter, on the one side, and Gerrit Blikman, former chief surgeon remaining here from the ship Aregterland, on the other side, the first-mentioned acting as Prosecutor R.O. and the latter as defendant, having requested the court to pronounce sentence upon the documents and muniments produced reciprocally by them in Judicio. The Council, having read and reviewed with all possible attention the documents exhibited reciprocally by the parties in Judicio, and having considered all that pertained to the matter and could move Their Honors; doing justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, denies the Prosecutor R.O. his claim and conclusion made and taken upon and against the defendant, and, for reasons moving Their Honors thereto, condemns the defendant in the costs incurred in this case; furthermore reserving to the defendant the action requested by him in his conclusion of answer with respect to such person or persons against whom he, by virtue of these proceedings, shall in due time be advised to institute the same. By the merchant and member of this Council, Mr. Ryno Johannes van der Riet, acting officially for the Landdrost of the Colony of Graaffe Cheinet, Morits Herman Otto Woeke, a request having been made under the exhibition of four depositions sworn by the burghers Pieter Schalk van der Merme and Hendrik van der Merwe gerritsz, as well as the Hottentots Tromp and Joris, the first two mentioned having been properly verified and sworn before the Heemraden of the said Colony, to be permitted to summon in person before this Council the burgher Gerhardus Dirk Cotzee, residing within the aforesaid district of Graaffe Reinet, on account of the mistreatment of a Gona Hottentot named Geswind, to such an extent that he died shortly thereafter, in order to hear such criminal claim and conclusion, request or requests, as the said Landdrost R.O. would wish to make and take upon and against Cotze on that account, to answer thereto, and further to proceed as according to law; as well as that this summons, on account of the distant location of the residence of the aforesaid Cotzee, might be dispatched by letter under the Council's seal: therefore, the aforesaid depositions produced by the officer having been inspected and deliberated upon, this request was granted to the aforementioned Landdrost. Whereupon a request was also made by the aforesaid Mr. van der Riet in his aforesaid capacity, because he had been informed that the summonses dispatched by letter under the Council's seal on the 7 February last for the summoning of the burgher Louis Cotzee and his wife Johanna Tienaar, as well as the burghers Philip Potgieter, Johannes Jansz van Rensburg, and the wife of the burgher David Botha, had not been delivered to the Landdrost at the aforesaid Drostdy, and that the same would thus apparently have gone missing; to summon now the aforesaid persons for the same purpose as was set down in the aforesaid summonses, except for the aforesaid wife of the burgher David Botha, who Below stood:

Subsequently there appeared in the Council the above-mentioned burgher Louis Cotzee, stating that having stayed in person at this capital since 24 January last until now, in the expectation that the proceedings which had been initiated against him by the acting Fiscal, the honorable Gabriel Exter, concerning the matter of the Landdrost of Graaff-Reinet Morits Herman Otto Woeke, would make progress, he has had to experience that, although he had already answered before the delegate Commissioners the interrogatories presented to him on behalf of the officer, the said acting Fiscal nonetheless dragged out these proceedings up to now in such a manner that he, Cotzee, being continually obliged to stay at the town and spend his money here, suffered much disadvantage as a result: requesting that this case might nevertheless be pursued as speedily as possible. To the Right Honorable Johannes Isaak Rhenius, President, together with the further Members of the Honorable Council of Justice of this government. Right Honorable Sir and Gentlemen: In compliance with your Right Honorable very honored decision, granted on the 30th of the recently passed month of October, upon the petition presented on the same day by the elder of the Swartland Church, David Malan the elder, as father, and Elisabeth Malan as wife of the fugitive Cornet of the Burgher Cavalry at Stellenbosch, David Malan David's son, and of which a copy was delivered to the undersigned, in order to serve his Considerations thereon within the time of fourteen days, the undersigned will take the liberty to remark beforehand: that when, upon reading the same petition, he observed that the citation from the named criminalist Carpzovius alleged at the beginning thereof was entirely misapplied to the case at hand, he deemed it unnecessary, on account of the short allotted time, to occupy your Right Honorable attention with an extensive argument thereon, but felt obliged to proceed immediately to his Considerations; although he fully acknowledges that in the bonds of nature between a father and his son, and a wife and her husband, and vice versa, lies the obligation to put everything into effect for rescue and preservation. And as the undersigned in the first place believes that the terms by which the aforementioned David Malan David's son was summoned by your Right Honors were expressly set at four weeks, so that he could claim no ignorance of that summons nor of the crimes charged against him thereby, the undersigned also imagines that the progress of those proceedings cannot well be deviated from without well-founded reasons intervening, which by law make any, even the slightest, stays of proceedings necessary. For the examination of such reasons, the undersigned believes he will find opportunity, in the second place, to demonstrate: that the reasons upon which the petitioners believe their request should be taken into consideration cannot provide sufficient grounds for it, if one only traces the course of the proceedings from the beginning up to the present day with the slightest accuracy. One will find that immediately in the beginning, the female petitioner declared to the gentlemen commissioners from this Honorable Council that her husband had gone to his cattle posts situated in the district of Graaff-Reinet for the transaction of his affairs, and that she was also expecting him from there daily; and thereafter, so the undersigned believes, testified to this in this Honorable Council either orally or in writing. The petitioners indeed cannot deny that they have made every effort, either in a direct or indirect manner, to bring the proceedings initiated by the undersigned to the knowledge of their son or husband: they even sent a wagon with a slave and two riding horses in hand to the aforementioned district for that purpose in the month of September last, and very probably also with the aim of inducing him to return; besides which the undersigned, on his part, already in the month of August on two different occasions, on account of the then presumptive absence of the Landdrost of Graaff-Reinet, Mr. Woeke, gave notice of this and that to the Secretary of that Colony, and on September 10 aforesaid, upon sending the Edictal Citation, also requested the same that in case the fugitive David Malan David's son should appear elsewhere in the aforesaid district with the Savin Sara named in the trial, he would have both of them arrested and sent up; so that when the same Malan comes to stay on his cattle posts or elsewhere in the aforesaid district, it is indeed beyond all dispute that he can pretend not the least ignorance of the proceedings initiated against him by the undersigned. And assuming the contrary, then it remains an undeniable truth that he is a fugitive, and then it is proven clear as day that the request made by the petitioners ought not to come into the least consideration. III that after all the defender, even if he has pleaded, cannot undergo the sentence to which the criminal might be condemned, and thus the respectability of the court would be compromised and the entire sentence rendered illusory. However, Your Honourable Worships are requested with your customary attention particularly to heed number 29 of this same cited question, wherein Your Honourable Worships will perceive in the clearest manner that it is indeed permitted to an absent criminal, even in criminal cases, to assign an attorney or defender who may present the reasons for the absence of the guilty party and defend his innocence, so that the absent person is not condemned but the sentence is postponed, if the judge shall have approved those reasons as correct, whereof the contrary has already clearly been shown here before in the second place, to which extent an absent criminal may indeed be granted a defender, but not regarding the principal cause, nor that, even if his produced excuses were correct, the absent person could therefore be acquitted. And secondly, such a defender must produce these reasons for the absence of the criminal before the joinder of issue. Furthermore, Your Honourable Worships are requested to fix your eyes on number 81 and 82 of this same question, wherein Your Honourable Worships will find that a father, on behalf of his son who is criminally accused of manslaughter, may not only appear for his interests, but may also intervene as the defender and apologiser of his absent son. Further, it was reported by the court messenger that the wife of the burgher Stephanus Fauché is present before the council chamber, who had been summoned in person against today by a missive under the council's seal, pursuant to the decree issued upon the representation submitted here on the date 22 August last by the Fiscal pro interim, who attested that her husband had received the summons and that she, holding power of attorney from him, would defend his case; but since the said Fauche was summoned in person criminally, and thus cannot allow a proxy to act for him in this matter, it was therefore resolved to dismiss the aforesaid wife of Fauche and to issue a second citation to the said Fauche to appear in person before this council three months from today, or on the 5th of the upcoming month of February, and this on pain of bodily apprehension. Taking also into consideration here, however, that this case could not be placed on the court roll because the Landdrost of the colony of Swellendam, notwithstanding that this was so explicitly commanded of him, sent no certificate of the service of that citation, and that this is also not an isolated occasion that such negligence by the aforesaid Landdrost has come before the council, but that by his inattention in this matter the course of justice has already repeatedly been impeded and confusion caused; as among several other examples occurred recently on the occasion that, at the own requisition of the same Landdrost, a summons by missive against the burgher Carel Sterenberg was requested on 12 June last by the member of this council, Mr. Ryno Johannes van der Riet, as well as in regard to the summons issued under 29 May last against Susanna Holtshausen, wife of Jacobus Steyn Jacobusz, both of which persons appeared on the appointed day, without Right Honorable Sir. The Assistant Jacobus Vercueil, as proxy of the respondent, states also to renounce and to leave the matter to the judgment of the Council. The Council holds this case for circular consultation in advice after the depositions shall first have been re-examined and sworn. The burgher Jacobus van Leeuwen, as proxy of the fellow-burgher Jan Barendse, plaintiff, against The Honorable Gabriel Exter, respondent, summoned to hear answer to his submitted claim, and to hear renunciation of further productions. Van Leeuwen produces his written answer. The member of this Council the Fiscal pro interim, Mr. Rino Johannes van der Riet, acting for the ex officio respondent due to his indisposition, states to renounce further productions. Van Leeuwen requests to add some more pieces of evidence to this lawsuit, stating that he will then also renounce. The ex officio plaintiff advances thereupon that the respondent has had enough time and has even already obtained the depositions, as well as has been sufficiently capable of properly equipping himself, therefore requesting default of evidence. 1708. 1:49 of the United Netherlands, has condemned the prisoner April of Bengal, as their Honors hereby condemn the same, to be taken to the place where criminal sentences are customary to be executed here, to be handed over there to the executioner, and after having stood under the gallows with a rope around his neck, being tied to a post, to be severely scourged with rods on the bare back, and thereupon to be branded, and also to remain banished for the term of his life to Robben Island, to work at the Company's public works, with condemnation of the prisoner in the costs and expenses of justice, and dismissal of the further claim made and conclusion taken by the officer. In the forenoon, present the Honorable Johannes Isaak Rhenius, President, and all the members, except the gentleman Mappa due to indisposition. The citizen Jacobus van Leeuwen, as general attorney of the fellow citizen Johan George Barends, petitioner, against the pro interim Fiscal, the Honorable Gabriel Exter, respondent, The petitioner requests by memorial to be allowed to obtain such evidence, and to put it in forma probanti, and subsequently to submit it in Council, as he believes he will still be able to procure for the defense of the case of his principal. The respondent advances thereupon that the petitioner has caused him, the respondent, to be summoned in an entirely unauthorized and improper manner, since, while renunciation has already been made in the case of the aforesaid Barends, this summons ought therefore to be regarded as taking place in a new case; consequently, he should have requested veniam agendi, and at the same time expressed in the citation what his request would contain, claiming that this prerogative belongs to him as an officer of justice; requesting therefore satisfaction from the petitioner over this improper conduct. Van Leeuwen replies thereto that he did this with not the least ill intention, and furthermore had obtained permission from the Honorable Gentleman, and moreover had believed that, since he came to make this request in the lis pendens trial of his aforesaid client, he therefore did not need veniam agendi from this Council, nor was it necessary to express in the citation the request to be made by him, persisting therefore as above. The Council, after deliberation of matters, reprimands the petitioner in his aforesaid capacity, Jacobus van Leeuwen, for the informal manner in which he has proceeded in this matter, and at the same time grants the request made by the petitioner in his aforesaid capacity regarding the evidence to be obtained by him. The aforesaid pro interim Fiscal, the Honorable Gabriel Exter, in his official capacity prosecutor in a criminal case on the one side, against Silvia of the Cape, slave of the Valiant Military Captain Jan Arnolt Bleumer, prisoner and defendant in the aforesaid case on the other side. The official prosecutor exhibits a written claim, to which are attached annexes, concluding as at the end of the same. The prisoner and defendant, having heard the same read, requests a merciful punishment. The Council keeps this case under advisement for circular reading. The pro interim Fiscal here, the Honorable Gabriel Exter, in his official capacity prosecutor in a criminal case on the one side, against Jan Hertel, prisoner and defendant in the aforesaid case on the other side. How they, the petitioners, during the inventory of the estate of the absconded assistant Quist Möllerstroom, sold on the 1st of the past month of October by the Gentlemen Commissioners from Your Honorable Council, duly made known to the said Gentlemen Commissioners. That at the purchase of the house now vacated by Mollerstroom, the petitioners interposed themselves as guarantors for the sum of twenty thousand guilders Indian valuation, and this through the three bonds to be mentioned hereafter, namely: A private bond of 25 September 1788, for the benefit of the citizen Tobias van Dyk, in the amount of f 6000: —, this capital having been taken up to fulfill the agreement with the seller Hermanus ter Hoeve, stipulating that a portion of the purchase money had to be paid off within a certain time before the formal conveyance. Two judicial bonds, each amounting to f 7000:– of the said value, both passed on 6 January 1787 or the day of the conveyance, the first-mentioned for the benefit of Miss Johanna Adriana Arendse, and the last-mentioned for the benefit of the Bookkeeper in the Honorable Company's slaughterhouse, Mr. Benjamin Seydler, as attorney of Mr. Hendrik Pieter Möller, who is residing in Europe. Whereas the cited debt, as Your Honors can very rightly perceive, originates and arises collectively from the sale of the said house, which must therefore be regarded as the actual and true reason whereby that debt arose, according to the nature of the matter, the first-mentioned bond should be granted the same equality and privilege as the two last-named, which are secured by a mortgage on the aforesaid house; so the petitioners believe, on that account and with good reason, that the said charges are entitled to priority over all claims on the estate. Upon closer inspection of this, the petitioners further take the liberty most respectfully to note: that when the petitioners stood as guarantors for the said sum of f 20000:-, this occurred under special and specific collateral of the frequently mentioned house and further goods, as further appears from the cited bonds. Since the estate of the said Mollerstroom has now fallen to Your Honors for assumption and settlement, and its effects, namely the house and the goods, being the only security and support upon which their obligation was founded and upon which they might always have had recourse, have already been taken from the petitioners and disposed of by Your Honors; the petitioners defer to Your Honors' highly enlightened judgment whether, as soon as the frequently mentioned house and goods have yielded as much at their sale as the aforesaid sum amounts to, the petitioners' engagement, for the reasons just mentioned, could not be considered as already having ceased, and they consequently be released from their suretyships.
