C. van Citters and Company Middelburg In the Castle of Good Hope the 28th of December Noble, Honorable, Highly Respected, Most Wise, Prudent and very Generous Gentlemen, High and Mighty Lords: With the Dutch private ship Rhijnoord chartered by the Honorable Company, which departed from here on the 1st of this month, we hope that after its successful voyage completed, our respectful letters of the 25th and 28th of November prior may have been delivered to your Noble and High Mightinesses long before the arrival of this letter, of which we take the liberty to accompany this with the duplicate of the first-mentioned. While we dutifully inform your Noble and High Mightinesses that on the 17th of this month the journey to India's capital was undertaken by the ships De Mentor, De Zeebouwer, Dordrecht, and D' Eenparigheid, which was followed on the 28th by the ship 't Hof ter Linde, while also on the following dates the following outbound vessels arrived here in good condition, namely: on December 10th the chartered Dutch hooker ship Oostzaandam, on the 17th ditto the flute ship De Vrouwe Agatha, and also on the 20th ditto the hooker ship Sterreschans sent out for the service of this Government, with only 5 dead and 1 sick. The bearer of this, the Honorable Company's packet boat De Vlijt, having sailed from Batavia on the 14th of October and passed the Sunda Strait on the 18th thereafter, arrived safely here on the 16th of this month, having sustained only one invalid on the voyage hither, and reports that the preceding ship De Valk was to undertake the voyage hither on the 20th of that month. The undersigned Governor having made known to us how, among various proposals made by the Military Commission that recently departed from here, there was also one for the establishment of a Court Martial for the national corps in garrison here and the appointment of an Auditor-Martial thereto; that His Honor had already long been convinced within himself of the usefulness and necessity thereof for various reasons and motives, for the maintenance of strict discipline and good order among the troops of the National Garrison, had without delay placed these in copy into the hands of the also undersigned Independent Fiscal, in order to make use of his considerations and advice regarding that point, whether and to what extent the desired objective could be achieved with favorable success, and had also delivered an identical copy to the heads of that National Corps in order likewise to ascertain their thoughts thereon, and thereupon had received from the said Independent Fiscal a rescript which we take the liberty to present herewith in authentic copy to your Noble and High Mightinesses; that His Honor, both by the motives on which the aforementioned proposal of the Gentlemen Military Commissioners was founded, and by the advice of the undersigned Independent Fiscal, had been most strongly confirmed in the idea of the absolute necessity for the immediate establishment of such a Court Martial, and at the same time the latter had appeared to His Honor upon reading to be so detailed and of such a nature that it could very well serve as a guideline and instruction for the Court Martial to be established, as well as for the duties of the auditor to be appointed thereto, while His Honor had to trust that on that footing the political jurisdiction, whose intact preservation, together with the direction and conduct of all civil as well as criminal matters, as well as the support and protection of the majesty and authority of the Dutch state, had been entrusted by instruction to the one who had drawn up that advice, would in no way suffer or be curtailed thereby. All of which having been proposed by His Honor, maturely considered, and taken into consideration by us, how your Noble and High Mightinesses' revered letter of the 5th of February of this year indeed dictated an authority to immediately put into execution the changes and improvements that shall appear necessary for the management of the military establishment, which is repeated in the sixth article of the instruction for the Gentlemen Military Commissioners and that power is indeed granted to the heads of the respective possessions, while that same instruction also gives the Commission the faculty to introduce such changes and improvements to the military establishment.

to bring the state to what the greater knowledge available in Europe suggests; and since that proposal was presented by the said Gentlemen Military Commissioners, as appears from a missive produced by the undersigned Governor, as indispensable for the maintenance of military subordination, and against which in a colony such as this no reasonable objections can be raised, and therefore the failure to put it into immediate effect was also left by their Honours to our responsibility; from which, therefore, most clearly not only the authority but also the obligation for us to do so became manifest; we have therefore unanimously approved and resolved to attach to the national troops here a court-martial, as well as a military auditor, on the footing as specified and proposed in the aforementioned advice of the undersigned Independent Fiscal; while for the performance of the post of Military Auditor we have qualified the Adjunct Fiscal Gabriel Exter, who appeared to possess the required capacities for it, in the flattering expectation that this provisional appointment made of the person of Gabriel Exter as Military Auditor, as the most suitable subject presently available for it in this colony, may meet with Your Right Honourable Worships' approval, respectfully requesting therewith that you will be pleased benevolently to grant the said Exter the rank, pay, and emoluments which Your Right Honourable Worships have granted to the military auditor of the regiment of Wurtemberg; We therefore flatter ourselves with the happy prospect that when all this shall have been accomplished, the interests of the Noble Company will thereby be truly benefited, in so far as satisfaction will thereby have been given to the long-manifested desires of a considerable number of men who place the greatest value and pride in having their own separate judges, and they will thereby be more and more encouraged, when their term of service has expired, to enter into new engagements and dedicate their best years to the service of the Noble Company. And we shall not fail dutifully to observe that which Your Noble Great and Honorable Worships have been pleased to write to us concerning the master of that vessel, Claas Keuken. For the rest, it follows naturally that if there is to be a court-martial, there must also be a person who acts ex officio before it and presents the cases according to the style and practice of the military: whereby the undersigned trusts to have settled the question whether, that is, whether such a court-martial can and ought to exist here. It will now further depend upon determining the question how, that is, to define the operations both of that court-martial itself and of the auditor to be added thereto. Regarding which the undersigned is of the opinion that one ought to proceed with all circumspection, in order to prevent, now and in the future, as much as possible all disputes, misunderstandings, and conflicts of jurisdiction that could arise from uncertainty or obscurity therein. To satisfy the reasons for establishing that court-martial, as presented both by the Lords Commissioners and by the undersigned and cited above, it will, in his view, be sufficient if the court-martial is granted the authority to adjudicate purely military offenses. Which is entirely consistent with the Capitulation of the Regiment of Wartemberg, Article 22, stating: "The Regiment shall have its court-martial for purely military offenses, it being understood that death penalties must only be executed after the approval of the government, and in all other cases the Regiment shall conform to the laws and customs of the Company." From which the Lords Superiors also do not appear to dissent entirely, as is evident from their dispatch written to the Governor and Council here, dated 28 July 1785, verbatim: That the garrison offenses, that is, purely military offenses of the artillerymen, just like those of the other troops of the garrison, must be punished with the prior knowledge of the Chief of the Militia and at the discretion of the Governor, while the imposed military punishment must be executed by the corps to which the delinquent belongs. By purely military offenses, legal scholars, such as Arrius Menander in the books on military matters; Groenewegen on the abrogation of laws, at law 6, Code on the jurisdiction of all judges; Vromans on the competent court, Book 1, Paragraph 9, Number 13; Voet on military law, Chapter 7, Number 9; Bynkershoek, questions of private law, Book 1, Chapter 13, on the military court in cases of military offenses; Van Hasselt, instruction on military jurisdiction, Chapter 1, Paragraph 53; and a great many others, understand: such offenses that military persons commit as military persons, and of which no one can be guilty unless he is a military person. Such as desertion, fleeing in battle, deserting to the enemy, transferring from one company to another without a passport, the loss of weapons or the alienation thereof, abandoning one's post, sleeping at the same, one who remains away having been sent out to reconnoiter or to forage, one who leaves the trenches, one who leaves the guard, one who remains away when out on leave, one who climbs over the rampart or who enters the camp over the wall, one who wades or swims through the moat, furthermore disobedience, mutiny or conspiracy against his commanding general and other superior or non-commissioned officers, drunkenness, debauchery, and whatever similar types there may be, all detailed in the laws on military matters. From which are clearly distinguished the ordinary or common offenses that can also be committed by persons who are not military personnel, such as manslaughter, adultery, rape, counterfeiting of currency, arson, violence, forgery, public disturbances, burglary, theft, and the like. This court-martial being intended thus to judge solely purely military offenses, all other offenses and contraventions against the enacted laws, edicts, and ordinances shall remain under the jurisdiction of the ordinary daily judge as of old; and consequently, military persons in all other cases, both civil and criminal, shall be subject to arrest, summons, jurisdiction, and execution by the civil judge, as was already established in the year 1651 on 25 March by resolution of the Allied States, after the States of Gelderland and Utrecht on 30 January and 2 February, and those of Overijssel on 7 February, had already made the proposal thereof in that general assembly. From which it also follows that no political or civil persons, in either civil or criminal cases of any kind whatsoever, may ever be summoned or sued before the same. institute before the ordinary Civil Judge, and that the military shall be obliged to answer there or to summon their parties. That two military persons in civil matters such as concerning the meum et tuum, on account of inheritances or successions ab intestato, testamentary dispositions, leases, rents, purchase, sale, acknowledgments of debt, borrowed money, etc. etc., having any claim against one another, shall likewise have to do so before the ordinary Civil Judge: to whom also alone the jurisdiction over matrimonial matters shall have to remain. Except that, whenever military persons might have any disputes with military persons regarding their pay, wages, clothing, weapons, food, bedding, and the like, the same being considered as purely military internal domestic matters, it ought to be settled by the Court-Martial. Furthermore, the undersigned considers, subject to correction, that in case of provocations and duels between military persons, the same ought to be convened before the Court-Martial, but between military and civilian or political persons, both should then, propter continentiam causae, be amenable before the Civil Judge. The first, among several other reasons, because circumstances can often arise that would rank such a provocation or duel, although generally counted among the communia delicta, nonetheless among the purely military offenses: and the latter in conformity with the Placard of the Lords States of Holland and West Friesland against duels dated 22 March 1657, to be found in Mr. S. van Leeuwen, Manier van Procederen, among the appendices page 428. Now as further concerns the manner in which such a court-martial ought to be constituted, the place where, the times at which it must convene, as well as the determination of the costs of the parties, the remuneration of the Lord Members and the Auditor, their rank, number, presidency, manner of deliberation, and so forth; the undersigned, deeming this not to belong to his department, will not need to express himself further on this matter. Regarding the Auditor, the undersigned is of the opinion that there ought to be chosen for this post a known person, of good name and reputation, sober and capable, possessing at least a superficial knowledge of Roman law, furthermore somewhat experienced in the art of war, and fully experienced in military laws and military domestic affairs. That the auditor should be permitted to act solely and exclusively in purely military offenses and matters already enumerated herebefore. That of all other matters and offenses coming before him, concerning the military or also the civilians, he ought to give notice to the Independent Fiscal, with the surrender of the delinquents and pieces of evidence that he might have at hand, and thus assist him in every way for the furtherance of Justice. That he shall not be permitted to execute or draft any judicial or notarial acts of whatever kind, whether powers of attorney, bonds or acknowledgments of debt, antenuptial contracts or agreements, testamentary or codicillary dispositions, conveyances, donations, cessions, transactions, lease or rent schedules, deeds of sale, nor any other such like, much less inventories or public sales, whether of deceased or still living persons; nor to gather or have repeated any testimonies or affidavits, except only in purely military offenses and that only from military persons. Except that when civilian persons were also involved in purely military offenses, of whom he needed any declarations, he would have to seek the same from the ordinary Justice; just as all others in cases being litigated before the ordinary Judge would have to be obtained and given there. That however, in order to prevent the service of the country from being hindered by the frequent demanding of such testimonies and declarations from active military persons at inconvenient times, and whenever the same were required and summoned for that purpose either on behalf of the Fiscal office or on behalf of private individuals, it would be most convenient that such summonses were served by the Messenger of Justice not on the persons themselves, in case they should be non-commissioned officers or privates, but on the auditor, or on the commanding officer of the corps to which they belonged. Who should then be obliged to ensure that what was required was properly fulfilled, and that the required witnesses appeared at the proper time and place: all the foregoing nevertheless with the understanding that in case either the Fiscal office or the parties, for the convenience and relief of the Lord Commissioners and the secretary of the honorable Council of Justice, or for other reasons, might prefer to have their needed testimonies and declarations from military persons taken by the auditor and before military commissioners; they shall be permitted to do so, and he, the auditor, shall be obliged, upon being required, properly to perform this; when at the same time the Council of Justice should be enjoined to accept the same.

Finally, in order to avoid and cut off as much as possible all cavillations, disputes, and conflicts of jurisdiction, in occurring cases that were subject to any doubt as to whether they might indeed be ranked under the class of purely military offenses, the auditor or other interested parties ought to request the decision thereupon from the Honorable and Worshipful Council of Policy. However, since by the High Commanding Lords Masters in the Meeting of Seventeen, by instruction of the year 1785, the administration of justice without the least exception or distinction of political or military persons is and remains assigned and commended to the Independent Fiscal, and that by the 5th article in verbis: The Independent Fiscal shall have the direction and management of all cases, both civil and criminal, in order to institute the action and further prosecute it to the very end, as he shall judge proper according to his oath; so the undersigned believes he must still briefly present to Your Right Honorable some considerations and reflections, by which he is of the opinion that it could be prevented that his office be in any way curtailed in its rightful authority. In the first place, then, the members of that Court Martial qua judges, together with the auditor to be appointed, just like the respective Landdrosts, in case of protraction of justice, excess and grievance, corruption, vexatious practices, or negligence and dereliction of duty in their office, ought respectively to be and remain subject to call to account by the Independent Fiscal. Secondly, the concession to the Court Martial to judge and pass sentence solely in the field and under arrest over purely military offenses ought also by no means to obstruct the 8th article of the hereinbefore cited instruction, stating: the Independent Fiscal shall have access to, inspection of, and reading of all registers, books, letters, accounts, and papers, none excepted. And thus, whenever he desires such, he ought to have disclosure of the minutes regarding what was transacted in that Court Martial, of the procedural documents or papers, means, evidence, interlocutory and definitive sentences in cases decided before the same. Thirdly, the faculty ought to be left to him, pursuant to the sixth article of the often-mentioned instruction, reading: And the Independent Fiscal, wherever such shall be required, may join with parties, who in that case shall not be permitted to make use of any writings, documents, or proofs before and until the Fiscal shall have had inspection thereof; in order, in case of provocation or assault between military persons, to be judged by the Court Martial as is said hereinbefore, to join himself with the auditor before the same. Fourthly, it likewise ought to be left open to him, whenever any reports from the auditor arrived of other, not purely military, but slight and petty offenses and misdemeanors, to be able to hand over and cede the same to the auditor for handling, and thus to the judicature of the Court Martial. Fifthly, and finally, just as in criminal cases conducted by the respective Landdrosts the executions of passed sentences must take place in the presence of the Independent Fiscal, so also here the executions of the sentences of the Court Martial—after having first been approved more solito by the Governor, Thus His Excellency advised, which involved a poena mortis or that a soldier could not remain a soldier, for example cashiering with infamy, or when the delinquent was handed over to the executioner or Caffers for the undergoing of corporal or capital punishment, and which thus entailed an infamy—ought in like manner to be carried out in his presence. But concerning the military punishments not being capital punishments applied by military persons to military persons, such as those of degradation, the gauntlet, cordons, matches, caning, etc., not to speak of other and lighter ones, the execution thereof could and ought to be left solely to the Court Martial or to commissioners thereof together with the auditor. Yet, since the undersigned believes that the adherence to the aforementioned form must primarily serve to shed clarity on the weighty subject of the expenses, and that to this end, especially for this Government, belongs the demonstration of the reasons why the same so excessively exceed the budget, he has considered it his duty to do so herewith, and, with respectful reference to the ordinary demonstration of the Expenses submitted by him today, in order to follow the prescribed form as much as possible, will have the honor to present to Your Right Honorable and Worshipful Honors that: The trade books of the year 1787/8 having been closed under proper balance, The Expenses in that financial year amounted to; and ƒ 1798717„ 5„ The profits and revenues ƒ 363845:9 Thus that the expenses exceeded the profits . . . . ƒ 1434871„ 16. This increase in Expenses over the budget is attributable to the following reasons: 1st. To Expenses of ships, which amounted to ƒ 191460„ 2„ 8 And in the memorandum of retrenchment calculated at „ 130000: —„ thus exceeding the budget by ƒ 61460. 2„ 8 The undersigned cannot refrain from repeating what he has previously had the honor to remark concerning this expense item, namely: that this Government is very improperly charged for its entire amount, since it for the greatest part consists of provisions to the passing ships, which he thinks, under correction, ought to be charged to the goods that are transported with those ships and thus accounted to the places of their destination. Carried forward ƒ 843026„ 2„ 8th To Extraordinary Expenses Carried forward 993301„ 18„ 8. 13076„ 5„ — which also amount to ƒ 101235„ 19„ — yet calculated in the aforementioned Memorandum at „ 9000„ —:— Thus exceeding what was set down therein Must largely be attributed to the extraordinary mess allowances and gratuities which, according to the resolution of this Government in former times, to various corps, both on account of the withdrawal of the wage passes and on account of the still continuing high cost of provisions and other urgent reasons for relief, have been granted; and from time to time increased by the reinforcement of the garrison; this expense item has also increased considerably for some years by the provisioning of powder, lead, and other necessities to the remote districts in order to prevent or counter the incursions of the Caffers and Bushmen, as well as by the gratuities granted to the artillerymen for the extraordinary and heavy work which in this year was performed by that corps on account of the hauling and placing anew onto the widely separated batteries of all the heavy ordnance, according to a new distribution thereof made and sent to their High Mightinesses at that time, which was unavoidable if one wished in time of need to obtain the desired effect therefrom. 9th To Carpentry and Repairs For which the expenditure amounted to ƒ 73039„ 17„ — However, in the often-mentioned memorandum only estimated at „ 15000„ —„ — And for that reason exceeds the sum calculated for it by 58039„ 17. For the few buildings, magazines, and posts which in the year 1754 or 1755, when the Memorandum of Management was prepared, were required for the service of the Honorable Company in this government, the allocation of ƒ 15000: – per year was certainly very considerable; but since an ever- increasing growth of the inhabitants, an ever-increasing enlargement of the garrison and the militia, have also increased the Company's household in this government so considerably that, despite all means of praiseworthy frugality, and notwithstanding the multiplication of the Company's buildings, one has even had to rent houses and warehouses from private individuals, this expense item, far from diminishing, will still have to increase until the buildings still lacking shall have been constructed, and one will be able to make a fixed determination regarding their maintenance and successive renewal. The assurance in which he finds himself, that the high-commanding lords see the necessity to continue the reinforcement of this place with all courage, and that their Right Honorable High Mightinesses have even expressly desired such, seems to demand nothing more from him than the statement made by the Right Honorable and Valiant Lord Governor, that in this the Company's true interests have also been observed; in which he, as far as he is concerned, can completely rest with the flattering hope that when the projected works shall have been completed, this account will again decrease considerably. 11th: To expenses of the Company's bondservants, which likewise have risen to ƒ 43076. 5„ - whereas for the same only is granted 3. The undersigned, having summoned before them the officers of the Honorable Company's outgoing ships the Mentor, 't Hof ter Linde, and de Eenparigheid, in order to ascertain from those of each ship individually whether each in his own capacity had properly complied with the highly respected orders framed by their Right Honourable Lords Seventeen pursuant to their resolution dated 2 April 1774, the said persons, upon the questions put to them concerning the articles, testified that they had complied therewith in all respects, indeed as far as circumstances had permitted during their voyage. And consequently, as appears from their ship's resolutions kept on board and shown to the undersigned, all possible care was taken by everyone concerned for the preservation of the ship's company and the recovery of the sick, and they did not fail to put into practice the means prescribed for them by the aforesaid esteemed resolution. No Resolution taken Aboard the Honorable East India Company's Ship De Zeebouwer, 10 August 1789 Copy Taking into consideration that, for the preservation of the crew's health, everything must be applied that in any way tends to their well-being, both in the distribution of rations and in keeping the ship clean and pure, as well as ensuring that every member of the crew keeps himself clean and pure; thus it has been resolved in the broad council to have the between-decks scraped dry with scrapers every week or as circumstances require, two to three times, and mostly each time burned with herbs and juniper branches and sprinkled with vinegar, subsequently aired with windsails in the hatches; and every day to have the hammocks brought up on deck for those who had no watch to keep, also to have the hammocks scrubbed out every two to three weeks; further, the military personnel and others were kept in moderate motion as much as possible during the voyage; their rations properly distributed every week, clean, according to the instructions of the Honorable Company, and regarding the kettles and pans it was always observed that the same were clean and pure; further, it was approved and agreed in the broad council not to distribute the tamarinds, also provided by the Honorable Company, weekly to each person, for reasons that experience has sufficiently taught, yea still daily teaches, that by distributing them, very great detriment to the crew's health and a strong predisposition to illnesses have been caused; the more so because whenever a common sailor or soldier receives his ration of this all at once, it is not possible for him to use it moderately, while one trades with it and the other consumes the same all at once, which is found to be directly contrary to being regarded as wholesome, but extremely detrimental to the crew. For all of which reasons, and the more so as by God's goodness and blessing we have very few or no sick persons, and in order to prevent illnesses in the future as much as possible; thus it has been approved and resolved in the broad ship's council to employ and distribute both the tamarinds and the syrup in such a manner that, according to our humble opinion, it is not only not harmful but very wholesome, namely, in the warm climate to distribute every evening to everyone in particular a good portion of tasty punch made of water, lemon juice, gin, and syrup, and then again, instead of lemon juice, prepared from tamarind and syrup; and then in the cold climate to have barley groats served every morning with the same drink, and into which also a good portion of wine was put; also every Saturday evening, flour, butter, and syrup distributed as an extra to bake pancakes from. We have taken the liberty to address our latest respectful letters, dated the 28th of the recently elapsed month of December, to Your Right Honorable High Respected Lordships per the Honorable Company's packet boat the Vlijt, of which the duplicate accompanies this; we have likewise, by our humble subsequent letters of 29 and 31 December, given notice to Your Right Honorable High Respected Lordships of the safe arrival at this roadstead of the bearer hereof, the advance return ship the Valk, and of the packet boat the Expeditie, which latter this morning commenced its voyage to Batavia, whither on the 7th of this month the private chartered ship the Vrouwe Agatha also departed. Meanwhile, the following of the Honorable Company's ships returning from Batavia have also safely arrived at this roadstead, namely: on the 1st of this month, Sparenrijk, with 2 dead, 4 sick; Roosenburg, the 2nd, with 8 dead, 11 sick; Houtlust, the 3rd, with 3 dead, 14 sick; as well as on the 8th of this month, the ship Tijlingen, with 3 dead, 4 sick, favorably appointed by the High Indian Government as a provisioning ship for this government. The three first-mentioned ships having departed from Batavia on 28 October, and the last-mentioned on 6 November, all four ships were overtaken by a severe storm on 28 and 29 December near the point of Cape Agulhas, whereby the main topmast of the ship Sparenrijk cracked, the main topsail yard, the main topgallant yard, and a jibboom broke, and the main shrouds and fore shrouds lost 2 pairs forward and 4 pairs aft. Upon the verbal report received in that regard from the ship's officers, the undersigned Governor appointed the sea captains Fredrik Schaak and Claas Keuken, in order that they, assisted by the master shipwright Meyndert van Eijk, should go aboard the aforesaid vessel, and there, before the Master of Equipage Cornelis Corneliez and in the presence of Captain Dirk Sem, accurately inspect the defects found in the spars as well as otherwise on that vessel; which commissioners have submitted a report regarding this, which we take the liberty of presenting to Your Right Honorable High Respected Lordships in authentic copy, and from which Your Right Honorable High Respected Lordships will be able to perceive that in order for that vessel to pursue its voyage to Patria with safety, it will necessarily have to be provided at this corner of the world with: A new main topmast A main topsail yard A crossjack yard A main topgallant yard A jibboom A main topmast cross-tree Main shrouds and Fore shrouds. We shall not fail to take proper care that everything the vessel lacks is repaired with the greatest possible dispatch, and we find ourselves obliged to inform Your Right Honorable High Respected Lordships regarding the ship Rosenburg that upon its arrival it was reported by the ship's officers that, being overtaken by the aforesaid storm, they had found themselves forced to throw 7 pieces of cannon overboard, having had 8 feet of water in the ship, whereby they presumed that the lower tier of sugar had melted and apparently much of the cargo and provisions would be spoiled.
