of his aforementioned Lords and Masters, and especially the one contained in Their Right Honorable High Esteems' letter to this Government dated 23 July 1711, reading as follows: Truly, expressions that appear to us completely indecent and unedifying; for even assuming that the aforementioned Governor had believed good reasons were on his side and in support of his delivered advice, favoring the aforementioned Skipper de Coning over the aforementioned Chief Mate appointed to the aforementioned Ship Bentfeld, he was indeed permitted to bring forward and allege the same in the Cape Council for information; yet he was nevertheless obliged to arrive at a resolution according to the majority of votes, without seeking to make his private sentiment prevail over that of the other council members, indeed, what is more, concluding contrary to the opposite and actually putting such into effect; as we find to have happened in the present case; since in that manner the entire Cape Council would not be necessary, if it could be deemed acceptable to let matters be handled by the Governor alone according to his own imagination; but far be it from that. Therefore, in order not to enlarge too much on this subject, we, along with the Governor General and Council, regarding this matter concerning the Governor, shall refer him to a diligent examination of the papers and previous acts preserved at the Cape, and especially to the well-drafted instructions of Commissioner General Mr. van Rheede qualitate qua formed for that Government, wherein he, by and from the review thereof, will be sufficiently informed how he will be able and must conduct himself in accordance with this for the future. And which letter in particular applies to the present case. However, as to whether in the matter of governance the concluding majority ought not to take into account members who have been commissioned in the matter under deliberation, the undersigned considers that this ought to be demonstrated on irrefutable grounds rather than by a mere contention: since in judicial sentences, even in sentencing capital offenders, those members who have attended to the examination of this accused, the inspection of the corpus delicti, or other circumstantial details are never excluded from the conclusive votes, and truly with reason, as such members find themselves better able than the others to judge the circumstances examined by them. It will then solely come down to whether, when a matter is submitted to the Council for deliberation in order to decide upon it, and the votes of the majority of the members turn out completely contrary to the opinion of the Commander-in-Chief, the Commander-in-Chief possesses the authority to keep the votes cast by that majority from a conclusion, which is nevertheless the same as keeping the conclusion of that majority without effect, and even contrary to the sentiment of that majority to carry out the matter according to his own opinion; and the undersigned maintains that this runs entirely counter to the previously cited clearly declared intention of the Lords and Masters, which is why he is also obliged to continue adhering to this opinion until it might please Their High Mightinesses to decide something further regarding this. For those same reasons, the undersigned is, subject to correction, of the opinion that once the vote of the majority toward any decision has been cast, such inherently includes the conclusion of the majority; which consequently demands its execution without that execution needing to wait for the confirmation, since the confirmation is properly and only necessary regarding the drafting of the resolution. A multitude of extracts from the brief minutes of what has been resolved by the High Indian Government show that, in order to make what is decided at that high Table take effect immediately, one by no means waits for the drafting of the resolution, much less for its confirmation; and truly, if one had to wait for this, especially in matters that demand a speedy execution, as was the case in the present instance, to what would the Company's interests not frequently be exposed! 1040 that human temperaments do not permit all matters to be advised upon unanimously, and matters frequently require order and disposition, and it is notoriously unreasonable that the majority should follow the minority. For which reason it can also never be demanded of any member of the government that his deference to a chief commander should be so great that, in order to prevent an outvoting against his opinion from taking place, he should deliver his advice or conclusion contrary to the conviction residing within him. Which makes someone just as culpable as a deliberate, actual execution of making agreements with other members in order to regulate certain points among themselves according to their pleasure, against the approval and sentiment of their commander, and then to force the same upon him. If, however, such had taken place in the present case, it were to be wished that the Lord Independent Fiscal had convinced those who might have made themselves guilty thereof in this regard, and had omitted, through the arguments generally used in that connection, to insinuate against all the members who constituted the majority such a condemnable intention; unless, whenever some members deliver their voting voices contrary to that of the chief commander and have the majority on their side, such always leaves the liberty to derive such an intention by consequence against them. The members of the council can likewise by no possibility flatter themselves that it would serve as an adequate justification to their lords and masters if, being convinced of having helped adopt some resolution contrary to their better judgment and contrary to the Company's interests, they could advance no other excuse than merely having avoided outvoting the chief commander out of deference to him; since Their High Mightinesses hold not the chief commander alone, but also all the members of the council responsible; of which a multitude of examples, both from former days and even in the most recently received letters, are at hand. And the compensation to the Honorable Company in which the present Lord Chief Commander has placed himself completely on an equal footing with the members of the council, when it pleased the Lords Masters to 1041 order that compensation in the event that the gratuity granted to the engineer Thibault and the pay to the cadets were taken too high, clearly shows that His Right Honorable Sir himself has held the council members no less responsible than a chief commander. And as regards the assertion of the Lord Independent Fiscal, among others, that he must protest against the conclusion to decree a commission of two members of the council to inspect the defects that might be discovered on the vessel the Helena Louisa, on the grounds of nullity and invalidity, because this commission would be unnecessary, contrary to the dignity of these council members, and of the least effect; the undersigned rests in the confidence that an impartial, unbiased, and calm examination, which the first report of the nautical commission and the master of equipment is to meet with, and a comparison of the same with what the subsequent decisions of this council and further reports relating to that matter entail, and as has also been confirmed by the outcome regarding the said vessel, will find not only the necessity of such a commission, but also at the same time that this commission, far from being in conflict with the dignity of these council members, on the contrary would have served to preserve that dignity, especially with respect to the two members who in a dutiful manner have applied their zealous efforts for the Company's interests toward the preservation of that vessel; and that therefore, even if no other effect was to be expected from it, this commission nevertheless ought to have taken place for that reason; without it being sufficient in such a case that the members who had been commissioned had the faculty to undertake the inspection of the vessel or of its keel for their private capacity. For if every member in that manner were allowed to act on his own, then no commission of them would ever be necessary; in their private capacity they indeed had no interest in the vessel, but they did for their masters; or otherwise, to recognize in them a faculty that every private person has makes them just as unqualified as every private person to submit a legal report of their findings, and also

1042 Nor could the costs have formed an objection against this Commission, since the same, with good management and thus entirely without the slightest expense to the Company, could have been executed, just as in the past year the Commission to a much further distance to Swellendam, without a penny of expense to the Company, with prompt readiness, was carried into effect by the Secunde Thenius and the undersigned. These reasons and motives regarding the undersigned concluding in favor of the aforementioned Commission being so plausible, his vote can also in no way be derived from kinship, for indeed no kinship exists between him and any of the other members in such a degree that it could dispose him to take any greater private interest in helping to decree such a Commission than in omitting to do so; and the closest kinship between him and the other members consisting in the brotherhood-in-law with Mr. Le Sueur, the differing opinions that now and then reside between that gentleman and him concerning various matters occurring in the Council shall serve as proof that even this brotherhood-in-law, let alone a very distant kinship with Messrs. Rhenius and Van Oudtshoorn, has not the slightest influence upon him to spare the putting forward of his true opinion when the same differs from that of their Honors: indeed, a clear proof of this is to be found in the Resolution to keep the ship Avenhorn longer in quarantine, taken, as he believes, in the month of April or May of the year 1788. And which decision, whereby that ship was exposed to a dangerous season of the year and was also actually shipwrecked, has subsequently made him realize even more that it does not always accord with the Company's interests when one thinks one can justify oneself by following the report or advice of those in whom one must suppose the closest knowledge of any arising point, when objections militate against the following thereof. With that said, the undersigned believes he may let the matter rest, as containing within itself the fundamental reasons for his maintained conduct in the aforementioned case and serving to refute the positions and assertions appearing in the protest handed in by the Independent Fiscal, as well as for his justification to his Lords and Masters; wherefore he also remains in the certain confidence that, far from being brought into any unfavorable suspicion by these positions and assertions with their Highest Lords and Masters, their Right Honorable Worships will be pleased to view this his entire conduct from a more favorable viewpoint, always serving him as a pleasant reward, as having been directed from the most proper basic principles for the defense of the Company's interests. He must furthermore in the strongest manner protest that he thereby intended nothing other than to follow the duty that rests upon him as a Member of the Council, nor to have had even the slightest design, much less to acknowledge himself in this or any other case guilty of a single step intruding or interfering in the post, domain or authority of the Chief Ruler, on the contrary enjoying for himself the satisfaction that in the various posts which he has had the honor to occupy in the service of the Company under this Government and still occupies, he has been able to give complete satisfaction to each of his Chief Rulers, and may it be permitted to him in that regard, with respect to the present Honorable Stern Lord Governor, to refer to the evidence that is available concerning this in the Resolutions of this council and the Letters to the Lords and Masters; yet for the reasons brought forward, while maintaining the respect owed to the character of the Chief Ruler, in his capacity as Member of the Council he finds himself obliged to leave to the aforementioned present Lord Governor the responsibility for not having executed the abovementioned decision taken by the majority at the meeting of the 15th past, and consequently must hereby in the strongest terms protest against the said non-execution, as also against the consequences that might arise therefrom. Beneath stood: Cape of Good Hope, the 20th of July 1790. Was signed: O: G: de Wet. After a perfect collation having been made, this was found in all parts to agree with the copy residing with us. Which we witness: P: V: Le Sueur. 1044 Upon reading the protest submitted in council by the Independent Fiscal van Lynden on the 23rd of June last and the decision taken by the majority of the Members on the 15th prior, to commission the undersigned together with Mr. Le Sueur from their midst to Saldanha Bay, in order to take ocular inspection there of the defects which one might further discover on that vessel during the careening of the small ship the Helena Louisa, subsequently to report their findings to the Meeting, and upon which submitted protest the aforementioned Resolution of the majority was rendered of no effect by the Lord Governor; the contents of that document having appeared to the undersigned at first glance to be of such a nature that he felt he could not avoid examining the singular propositions appearing therein a little closer and laying them open for the judgment of this Council, this is the reason that he had requested a copy of the same. 1045 not only of the council here, but also of the Lords Majores in the Fatherland, but that he at that opportunity likewise understood that, if the aforesaid Lords in the Fatherland are properly to feel the weight of the allegations appearing therein and rightly to understand their meaning, the same must not be mutilated by any interpretations, the less so because, being clear and plain, the object one proposed to oneself can thus also very easily be penetrated; but that the same, as they are in their context, ought to come under the enlightened eye of Your Right Honourable High Mightinesses— That the undersigned, therefore abandoning his initial intention to engage in a detailed refutation, now merely insists that this Protest, as it lies, with all the pieces not yet dispatched that have any relation to the history of the Helena Louisa, together with this his counter-note, may be sent over as soon as possible to the meeting of the Seventeen, in order to await Your Right Honourable High Mightinesses' decision thereupon. Yet so that he cannot refrain, for the better elucidation of some passages that might need some clarification, as well as to clear himself of the imputation so artfully slipped into the protest by the aforesaid Fiscal Van Lynden in obscure terms, as if the undersigned had not only exceeded the commission received by him with regard to the salvage of the repeatedly mentioned brig the Helena Louisa, but had also engaged with his fellow members in making secret agreements and entering into understandings to compel the Governor to form conclusions against his approval and according to the inclination of the undersigned and his fellow members, regardless of whether the same were in conflict with the interests of the Company or not, meanwhile to set down: That while it is true that assigning commissions of such a nature as the salvage of stranded ships and the examination of their defects to members of the Council of Policy in times when everyone acquitted himself of his duty and conscientiously watched over the interest of his paymasters, would have had very ill grace, indeed would even have conflicted with the dignity of the government, it is also indisputably certain that such commissions, in a time like this, have become most necessary for the attainment of the interest of the 1046 of the Masters. 1647 represent the government itself, that they can certainly never be compromised with, or considered as a party to, such a person or persons into whose position they, by virtue of their commission, intervene and whose conduct they must investigate, but that, on the contrary, not only when they have completed their commission and have reported on their activities to their principals, but even pending their aforesaid commission during the deliberations on the subject to which their commission pertains, they always and uninterruptedly have and retain a conclusive vote. That a chief commander, as long as he sees fit, may indeed withhold from the knowledge of the council this or that matter which ought to be brought to its deliberation, since the consequences that might result from an unnecessary proposal are for his account; but that once such a matter has been brought under consideration, the Lord Governor no longer has the right nor the power to withdraw the same from their decision; no, but he is properly obliged, after the votes on the subject in question have been taken, to dictate the resolution to the secretary according to the sentiment of the majority and to give it effect, even if the sentiment of the aforesaid majority were directly contrary to the pleasure and the understanding of the Governor himself. Rhenius These are to certify to whom it may concern that we the undersigned on the 28th day of this month between the hours of seven and nine in the morning saw the keel of the brig Helena Louisa from stem to stern, that is in some places we saw ten inches of it, in others eight, and the least we saw of it was six inches. We also felt the remaining inches of it with our hands and arms which we put under the keel and found it to be perfectly good. We also declare that the repairs done to the brig on that morning in the space of those two hours was such as renders her safe to make her voyage to any distant country and we declare that it is our opinion that should it be thought proper to repair her more substantially by heaving her down, it is only to shift a small plank which appears a little shook, which might be completed in a day or two, and which when done we give it as our opinion the ship is as good as new. Thus we declare to have carried this out, and regarding the distress signal, we received Rhenius 1054 in answer from Captain Lieutenant Jan Bringman that he had been forced to do so because he had no food nor drink for the crew on board. Whereupon we sounded the pumps and found in the stern by the pump well over 5 inches and 6 inches of water in the bow, and that the Captain Lieutenant declared to have pumped no more than once since one o'clock at night, and this only with one pump that was furthermore damaged, the second pump being unusable, which pumping had been done by the Captain Lieutenant at 10 o'clock in the forenoon. In the meantime, the two following packet boats of Your Right Honourable Grandees have again arrived safely in the roadstead of Baaij Fals: On the 24th of July the Maria Louiza, having sailed from Punto Gale on the 27th of May of this year; on the 28th of the same, Het Haasje, which was dispatched from Batavia on the 21st of May and sailed from Sunda Strait on the 25th of that month. Both of these vessels are today in a condition to undertake their respective voyages, and we therefore respectfully let this serve as an accompaniment to the latter, presenting to Your Right Honourable Grandees the list of persons repatriating with that vessel and the account of expenses for what was supplied to the same here. We also present herewith to Your Right Honourable Grandees the duplicate of our respectful general report of affairs, dispatched under date of 15 July to the illustrious College of the Lords Seventeen, together with the duplicate of our humble letter addressed today to the aforementioned Assembly, to which latter we shall take the liberty to refer in all respect, concerning what relates to the gruesome murder committed on board the bearer of this, as well as concerning the refloating of Your Right Honourable Grandees' Chamber ship the Zeenimph, and the defects that came to be discovered on the same.
