can be shown most clearly from Commissioners etc., namely that because of the situation of this remote corner, many sick are daily brought ashore from the ships, and the number of the Company's servants having greatly increased, they could thus no longer be attended to by the ordinary servants appointed in times of lesser activity; that even outside the garrison it is currently impossible, with the servants now at hand, to properly care for the sick, upon which so much depends as well for humanity as for the Honourable Company. And secondly, that surgeons must necessarily accompany a troop needs in his opinion no reply, as has also been seen in all regiments that have been here; for who shall care for the sick, and march out with the troops in case of attack and dress the wounded. This elucidation lapses if the Lords Majores wish to place the national Battalion on the same footing as that of Wurtemberg, since Surgeon Majors and mates of the necessary competence will then be appointed, Dr. A: Le Sueur being currently appointed as Chief Doctor in the Honourable Company's Hospital. when the permanent frigate the Meermin was declared unfit by certain naval experts specially appointed for that purpose to keep the sea any longer in that condition, and thereupon it was judged most necessary by your Right Honorable and Worships to send it to Europe for proper repair, submitted his humble application to the aforementioned Honorable Lord Governor to obtain the command thereof; however, the petitioner having been informed by His Honor how this Government, by a specific order of our Lords Superiors which dictated that if, during the presence of Captain Laurens Steenboom, who arrived here with the ship 't Duyfje, any Company ship should be present on which a vacant captain's post happened to be, then to place him, Captain Steenboom, in command of such ship and let him return home, therefore found itself obliged to obey this, however much His Honor was also convinced of the privilege that the petitioner had in all respects above the said Captain Steenboom to make claim thereto, and of the hardship residing in having to pass over the petitioner on this occasion. Commissioners have delivered an authentic copy of a petition presented by the comforter of the sick Hermanus ter Hoeven, placed under the below-written salary, and the citizen Hermanus Dempers, for the obtaining of a certain strip of land situated between their properties, as well as an extract of the resolution taken in your Right Noble, Right Honourable, and Worshipful Assembly on 7 October last, in order to make such arrangements, both with the petitioners and with all other interested parties, as shall be deemed necessary, as well for repairing the road running along their properties as for the further maintenance of the same. Thus, in compliance with that highly esteemed resolution, a meeting was convened by the appointed Commissioners on 24 December of the just-past year 1788 at the disputed location, and the interested neighbours were also summoned there. Having appeared, each of them was individually asked whether they had any objection to make against the granting of the strip of land requested by the petitioners in their petition and situated between their properties at the foot of the Lion's Tail, and whether they could be harmed by the acquisition of the same, whereupon it was declared by them that they could not be prejudiced thereby and therefore had nothing against its granting. The said neighbours further being asked whether they would not be willing to proceed to the making of an arrangement regarding the rainwater coming down from the Lion's Mountain during the winter season and the road running past the petitioners' properties, some objections were indeed initially raised by the lesser part of them, mainly consisting in that the water from the aforesaid mountain, instead of running toward the low ground and behind the premises of the said ter Hoeven, ought to run alongside and thus at the upper side of the aforementioned premises, in order the better to maintain the road toward the lower side in the winter. In which regard the aforesaid ter Hoeven showed himself very willing, on this condition however, that the said persons could dig a ditch there at their own private expense according to his indication, and fill up the one that drains downward according to its natural course, and would also have to maintain the same properly each year, as well as execute a deed whereby they guaranteed him, ter Hoeven, against all damage and loss that might be caused to him by diverting the rainwater from its natural course. Upon hearing which condition, the aforementioned persons also very quickly abandoned their view, it being considered by them that, if the water were diverted from its natural course, the said ter Hoeven would in time suffer irreparable damage; while also the greater part of the said neighbours, who had brought forward their interests against the aforesaid drainage, were of the opinion that, by the diversion of that water, a servitude would be placed on the premises of the oft-mentioned ter Hoeven, which he had bought free and thus ought to retain in that manner; the citizens Floris Brand and Hendrik Brand, as well as the Hermanus Dempers mentioned at the head, having furthermore alleged that, as brickmakers, they believed they would be considerably harmed in their trade by this proposal, since the water running around above the premises of the oft-mentioned ter Hoeven would then notoriously discharge into the road that runs to their properties and make the same entirely impassable in the winter season, whereby they would then be left stuck with their wares. Subsequently, after some words had been exchanged on this subject, the following agreement was reached among the said neighbours upon the proposal of the commissioners, namely: that the water shall retain its old and natural course, and that by the digging of a ditch six feet wide and at a distance of four feet along the wall of the oft-mentioned ter Hoeven, it shall be carried below and behind his premises in an even alignment to the ditch below; and likewise that, for the repair of the road extending along the petitioners' properties, with the approval of your Right Noble, Right Honourable, and Worshipful Assembly, a certain elevation heaped up with rubble on the alignment of a so-called pigsty standing there along the brickworks of the Honourable Company shall be leveled to a width of approximately eight feet, and the rubble coming from it raised along the aforementioned ditch to be dug, in order to prevent the overflow of the water and thus bring the road into a proper state. To which end, and in order to be able to maintain the same properly in the future, the collective neighbours have very willingly undertaken to provide, towards the approaching winter season, each in proportion to his ability, slaves under their supervision according to turns, until such time as the aforesaid road shall have been put in order.
