860 Request of the codicillary attorneys of the late Captain at Sea Took van Baggen. Remittance of money to the Fatherland. The Deputy Fiscal, Mr. Johannes Andreas Truter, is qualified to attend to his affairs. Ryno Johannes van der Riet, having represented ex officio the affairs of the Landdrosts before Your Right Honourable Sir and Worships, had made known that, on account of his domestic affairs, he was placed in the impossibility of being able to perform such duties any longer, and requested to be discharged from that charge. The petitioner, however, owing to the remoteness of the main station, not being in a position to handle and conclude the criminal and other legal cases himself as required, lest the same should be delayed and result in an unpunctual and inaccurate observance of his office, wishing to provide for this with all diligence so that everything may proceed with due order without the least prolongation of the petitioner's official duties, finds himself constrained to turn to Your Right Honourable Sir and Worships, as he does hereby, and humbly requests that Your Right Honourable Sir and Worships qualify the Deputy Fiscal, Master Johannes Andreas Truter, to conduct ex officio on behalf of the petitioner all legal cases without distinction before the Worshipful Court of Justice or wherever the same ought to be heard, and that the aforesaid Mr. van der Riet may be discharged therefrom, under the condition that he shall be bound and obligated to provide the aforesaid Fiscal Truter with an account and report of his past proceedings and how far the cases have advanced, as well as to return the documents and evidence of such actions as have not yet been commenced in court. Respectfully make known Clemens Matthiessen Junior and Johannes Leeuwer, as codicillary attorneys of the late Captain at Sea Hendrik Eduard Lodewijk Took van Baggen, that to them, the petitioners, there has been sent by the general attorneys in Europe of the aforesaid van Baggen an extract resolution of the Most Worshipful Lords Seventeen, taken upon a request presented by the very same, in order to obtain as soon as possible by draft on the Honourable Company the moneys belonging to the widow of the aforementioned van Baggen and residing with the attorneys both here and in the Indies; in consideration of the fact that the Most Worshipful Lords have not been pleased to make a positive disposition thereon, but have left the same to the disposition of Your Right Honourable Sir and Worships in so far as concerns the moneys residing with the petitioners, the petitioners take the liberty in all reverence to annex hereto the aforementioned extract resolution.

862 Apostille thereon Petition of the Secretary of Graaffe Reinet Johan Jacob Fredrik Wagener Resolution with humble prayer that it may please Your Right Honorable Severe and Honorable Worships to accept the sum of Ten Thousand and Thirty ryxd:s still held by the Petitioners into the Honorable Company's Treasury at the upcoming cash deposit, and thereby enable them to liquidate with a distressed widow made unfortunate by the death of her husband and breadwinner. Underneath stood: Which doing, Your Right Honorable Severe and Honorable Worships' most humble and obedient servants. Was signed: C. matthiessen Junior, J. Leuwer. To which was attached an Extract from the Resolutions of the Illustrious Assembly of Seventeen, dated 19 December 1788, also transmitted to this Council by the High Commanding Lords Masters, with orders to pay such regard to the request made to them by the Executors and Heirs of the aforementioned late van Baggen as might be found compatible with the interest of the Honorable Company; and as that interest, and primarily the interest of the Inhabitants of this Colony, requires that no preference be given to any person regarding the Monies paid into the Treasury here for remittance to the Fatherland, it was resolved and agreed to grant as an Apostille to the aforementioned petition that the petitioners, following the example of all the Inhabitants of this Colony, will be able to declare, at the upcoming registration, the sum that they wish to pay for their principal, in order to participate in the exact distribution that will be made in that regard according to ancient custom, in conformity with the interests of the Honorable Company. After this was read a petition from Johan Jacob Fredrik Wagener, former secretary of the Colony of Graaffe Rynet, of the following content: Cape of Good Hope To the Right Honorable Severe Lord Cornelis Jacob van de Graaff, Governor etc. etc. etc., together with the Honorable Council of Policy there. Right Honorable Severe Lord and Honorable Lords! It graciously pleased Your Right Honorable Severe and Honorable Worships, upon the request made by the undersigned petitioner Johan Jacob Fredrik Wagener to Your Right Honorable Severe and Honorable Worships on 29 March of this year, to discharge him as Secretary of the Colony of Graaffe Rynet, while retaining his rank. It pleased Your Right Honorable Severe and Honorable Worships at the same time to appoint the petitioner to a Commission to act in consultation with the Landdrost and secretary of the aforementioned Colony of Graaffe Rynet, in order to settle in the best possible manner the rupture that was taking place at that time among the Kaffir Nation, and to clear away amicably, if possible, the disputes existing between the aforementioned nation and some Inhabitants. The Petitioner therefore takes the liberty herewith to submit to Your Right Honorable Severe and Honorable Worships a Daily Journal of all the noteworthy events that occurred on that journey. It will appear to Your Right Honorable Severe and Honorable Worships from that same Journal what outcome and consequences the completed Commission of the Landdrost and Commissioners had, and how the petitioner, having obtained authorization after the departure of the same Commissioners, remained for a considerable time on the borders of Kaffirland and happily concluded the existing disputes, although not as perfectly as the petitioner had wished. The petitioner undertook this long and dangerous journey without receiving wages, board money, or emoluments from the Honorable Company. The petitioner was even obliged to use his own wagon

Furthermore, the petitioner gave some considerable presents of his own goods both to the Caffers and to the interpreters he required, as such sought-after goods were not to be found among the gifts of the Honorable Company, and of which the petitioner, if required, could produce a specific list. When one adds to this the unavoidable expenditure of cash money that one is obliged to make on such journeys, it will be evident to Your Honorable, Valiant, and Right Honorable Sirs that, taken all together, this constitutes a significant expense for someone who has never had the opportunity to earn anything more than what he absolutely required for his subsistence. The petitioner does not even wish to speak of the fatigues and dangers he endured on this journey; his journal, composed with the most upright truthfulness, will give the best testimony thereof. The petitioner flatters himself that, in consideration of both the one and the other, Your Honorable, Valiant, and Right Honorable Sirs will be pleased to give such reflection to the above as Your Honorable, Valiant, and Right Honorable Sirs, in accordance with your well-known equity, shall deem proper. Letter from the Drakenstein church council concerning the reader Johannes Krugel. and occasionally some people appear who nevertheless, to the prejudice of the principal petitioner, oppose it with all manner of unfounded pretexts, to the avoidance of all which the petitioner finds himself compelled to turn with all due respect to Your Right Honorable and Honorable Esteemed Sirs, most humbly requesting that it may please Your Right Honorable and Honorable Esteemed Sirs' high favor, by the affixing of notices, to interdict the first-mentioned petitioner's owned land, an outspan place situated near it, to make this known to everyone, and to order on behalf of Your Right Honorable and Honorable Esteemed Sirs that they may not use it, but must content themselves with the two other outspan places, or otherwise as Your Right Honorable and Honorable Esteemed Sirs shall find to be proper according to law and equity. Resumed Furthermore, a letter written by the Drakenstein church council to this Council was read, reading: Right Honorable Sir, Honorable Esteemed Sirs, The church council at Drakenstein takes the liberty to inform Your Right Honorable and Honorable Esteemed Sirs with all submission: that the present reader Johannes Krugel, already for the period of eight months, due to bodily indisposition, and particularly due to a continuous weakening of his hearing and sight, has no longer been able to perform his church service, but has had to have it attended to now by this person, then by that person. The church council, on account of his old age and because he has always performed his church service blamelessly, has until now very willingly exercised patience with him, in the hope that he would soon be recovered sufficiently to resume his post again. However, while little, indeed no hope of this presents itself, but the infirmities of his old age rather seem to increase than to diminish, the church council finds itself likewise placed under the necessity of turning in this regard to Your Right Honorable and Honorable Esteemed Sirs with this submissive inquiry, whether Your Right Honorable and Honorable Esteemed Sirs would not judge it necessary, along with them, that the present reader Johannes Krugel, on account of his continuing indisposition and the hopeless recovery from the same, ought to resign from his service, in order that another competent person may take his place; and in case Your Right Honorable and Honorable Esteemed Sirs are pleased to agree with the church council in this, they likewise most humbly request that it may please Your Right Honorable and Honorable Esteemed Sirs to appoint to this congregation in the place of Krugel a man who is both blameless in conduct and suitable for that service; and in case no suitable person should be at hand with Your Right Honorable and Honorable Esteemed Sirs for that purpose, the church council takes the liberty, with due respect, to propose to Your Right Honorable and Honorable Esteemed Sirs for that service, in the first place, the burgher sergeant Jan Rode, who has already with satisfaction conducted the church service for Krugel for nearly five months, being also a man unblemished in doctrine and conduct of life, and as we judge, competent for that service; in the second place, Abraham Christiaan Broodryk, who currently serves as schoolmaster with the widow Daniel Retief in the Wagenmakersvallei, whom we also deem to be a particularly competent

870 The inhabitants of this colony to be notified by placards to declare the funds which they desire to count into the Company's Treasury. Resolution to charge its officers for iron from the ship the Mentor. Publication of the days appointed to pass deeds at the Political Secretariat. to effect the same without any further delay and to report their findings to this Council, while furthermore the aforementioned church council will be written to, to the end that, if they find the young Krugel fit to perform his father's duties and the nearly decrepit reader Johannes Krugel might prefer to inhabit his own house, they shall make such disposition regarding the reader's house and especially the land situated nearby, belonging to the Diaconate for the benefit of the poor, as is customary upon a vacancy of the parsonage with respect to the arable land belonging thereto. And whereas the time approaches that, according to annual custom, the inhabitants of this colony declare the sums which they may desire to count into the Company's Treasury in order to be remitted from here to the Fatherland; it has been resolved, at the request of the Cashier, Mr. Olof Godlieb Dewet, to notify the said inhabitants once again by the posting of placards that this registration must be made at the Honorable Company's Treasury at the latest before the middle of January next, as after that time no registrations will be accepted, and the distribution of the offered sums will be carried out so that everyone will be able to know in good time how much he will be permitted to count, and take his measures accordingly, to ensure that the funds for the first counting are brought into the Company's Treasury at the latest before the end of February, and those for the second at the latest before the end of March; those who may be negligent in bringing what they are permitted to count into the Company's Treasury at the appointed time shall be forfeited of the privilege of counting. Taking into consideration that many inhabitants, and especially the residents of the outer districts, often address themselves to the Political Secretariat to have conveyances of real estate prepared, or to execute mortgage bonds, promissory notes, and other deeds, which must be executed in the presence of Commissioners from the Council of Justice at a time when the master's service makes it impossible for the clerks at the Secretariat to spare the time for the execution of deeds; 871 it has been approved and agreed, in order to facilitate the inhabitants as much as possible in these transactions so important to them, and at the same time to ensure that the service of the Secretariat need not be neglected thereby, to inform the inhabitants by publication that for the execution of the aforesaid deeds at the Political Secretariat, both by Commissioners from the Council of Justice and by the first sworn clerk, sessions will be held on Tuesdays and Fridays in the forenoon at nine o'clock, and that everyone must repair to the Political Secretariat on those appointed days and at the designated time, not only for the execution of those deeds, but also for submitting the same. 872 Resolution to dispatch a vessel to Saldanha Bay to cut firewood and collect the available corn. Report of the Equipagemeester Cornelis Cornelisz concerning the whale fishery. requiring provisions to be made, and that to this end the cutting of wood in Saldanha Bay must be considered one of the principal means, it was therefore resolved to dispatch a vessel thither around the middle of the forthcoming month of January, with as many crew and slaves as shall be required, in order to cut and load aboard a good quantity of firewood, so that it may be supplied to the passing Company vessels, and at the same time to make use of that ship to receive the wheat and barley that the aforementioned corn-growing inhabitants might wish to deliver to the Honourable Company and transport it hither. In order to proceed herein with greater certainty, the resident sergeant at Saldanha Bay shall be ordered to approach all the aforementioned agricultural inhabitants anew and demand from each a statement of the quantity of wheat and barley that each of them will be willing and able to deliver to the Honourable Company, informing them beforehand that a vessel will be dispatched to collect the same, and that they will be paid the same prices for the grain as those who bring their grain to the Cape, subject, however, to the customary deduction of the tenth belonging to the Honourable Company and 5 per cent for freight from Saldanha Bay hither, so that they will come to receive 22 1/3 rixdollars for every load of wheat of 10 mudden, and 11 2/5 rixdollars for an equal load of barley, in order, if possible, to encourage the inhabitants of those fertile yet remote districts through these facilities to engage in the necessary cultivation of grain, and, should this succeed, to be able to determine further on what terms the Honourable Company will annually be able to have their harvested wheat and barley collected. Subsequently was read a report submitted by the Equipagemeester Cornelis Cornelissen in compliance with what had been required of him by resolution of the 17th of November last, which report reads as follows: To the Right Honourable, the Valiant Gentleman Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and the dependencies thereof, etc. etc. etc., together with the Honourable Council of Policy. Right Honourable, Valiant Sir, Honourable Gentlemen, The undersigned Equipagemeester having been ordered in writing by Your Right Honourable and Valiant Sir and Honourable Gentlemen to report whether the whale fishery could not be undertaken by the Honourable Company itself with good success, the undersigned takes the liberty, in dutiful compliance therewith, to advise: That it is very probable that this fishery can be conducted here with good results, since foreign vessels from England, North America, and elsewhere cruise along these coasts annually to make profits thereon, just as several captains of these vessels have attested to me that the catch for their own share yielded five to seven thousand guilders and more, exclusive of the portions for the rest of the ship's crew; whereby it should be taken into account that the Honourable Company need not incur such great expenses for the outfitting of ships on such long voyages, as foreign nations must make for this purpose, because at certain fixed times of the year, namely from the months of April to September, the fish come into their own bays and can be caught and processed therein. Regarding the vessels of the Honourable Company available here, they, as well as the tools present here, are of no use or proper application for this purpose, as the very same sort of swift rowing shallops and fishing gear used by foreign whalers in this fishery ought to be employed; and since the Right Honourable, Valiant Lord Governor in loco has been pleased to speak with the undersigned about this on one or two occasions, this has prompted him to gather information about that fishery from arriving and departing foreigners, and furthermore to be on the lookout to purchase from one of them, as a provisional measure, one of their shallops, with a pair of harpoons and lances, in order to secure good models, both of rowing vessels and of gear and kinds of lines, in case it should be decided to establish this fishery for the Honourable Company; notwithstanding several attempts made by the undersigned with the captains of these whalers, it was repeatedly in vain, as none of them wished to agree to the sale of such a shallop, although the said ships were already fully laden, and some of them demanded six times more capital for it than it had cost, asserting that it came to cost that much in England. Thus the undersigned finally succeeded this past week, having provisionally purchased one of those shallops, along with the harpoons and lances, for his own account from Captain Wm Lloyd, of the English ship Roman Emperor, which opportunity he did not let pass by. In my humble opinion, as a trial, one of the decked longboats of the country, if provided with two to three of those fishing shallops with the necessary crew, could serve in Table Bay to kill the fish and, bringing the blubber ashore, boil it down; similarly, one of the said boats in Saldanha Bay, being provided in like manner, could conduct the melting there as well.

The undersigned flatters himself that once this fishery has been placed upon a good and firm footing, great benefit and utility could be brought about both for the Honorable Company and for the convenience of the inhabitants of this Colony. Wherewith, intending to have complied with the honored intention, let this serve as a respectful report. Below stood: Cape of Good Hope, 30 November 1789. Was signed: C: Cornelisz. Upon the contents of which having been attentively deliberated, and recognizing the necessity of undertaking a trial for the account of the Honorable Company of the whale fishery discussed therein, at this roadstead and in its vicinity, with the means that happen to be at hand in this Government, in order that the High and Mighty Lords and Masters may, through the outcome thereof, be enabled to judge whether the undertaking of that fishery in the bays situated along this corner or along the coasts could be undertaken with hope of profit; and, in order to carry out this trial, the Master of Equipage shall be asked for his considerations and advice as to whether the aforesaid fishery, making use of the means at hand, could be undertaken in the next upcoming favorable season with one or two government boats with well-founded hope of good success, stating therewith as accurately as possible the costs he expects will be incurred, and at the same time proposing to this Council the footing upon which he believes that navigation could be commenced with one or more vessels for the account of the Honorable Company, stating also what sort of ships, chaloups, and tools would be required for this purpose, in order to supply this advice, along with the further considerations of this Council, to the High and Mighty Lords and Masters. Through the death of Christiaan Godhelp Rudolph, Substitute Landdrost of Stellenbosch and Drakenstein, this post having become vacant, the Seal-Stamper Gustaaff Anderson was appointed to fill the same, and this under his earning wages and running contract, while the Bookbinder of this Castle, Johan Christiaan Ritter, was qualified to perform the duties of Seal-Stamper, to whom the wages and emoluments hitherto enjoyed by the Seal-Stampers were granted, to be paid to him, Ritter, to the amount of Rd:s 9 per month from the Company's treasury. Furthermore, it was made known by the Lord Independent Fiscal Johan Nicolaas Steeven van Lijnden how, from time to time, certain persons remain behind at this place in a clandestine manner, both from foreign nations and from private ships, who, without having obtained any permission to do so, come to reside either within the Cape or further inland, or else wander about here and there, and this notwithstanding the repeated orders to the contrary so often given by this Council and so recently renewed, with the request that this Council might provide for this matter; by whom, after ripe deliberation, it was resolved to enact for the future: Whereupon the alongside-mentioned: That all those with whom any person who has remained behind here in the aforesaid manner might happen to stay shall be obliged to report in writing to the Lord Independent Fiscal: 1st. the name of that person, 2nd. the rank or capacity, 3rd. when arrived, 4th. with which ship, and 5th. from where. 876 Regarding the failure of the inhabitants to report which ship's crew members spend the night with them, it has been resolved and determined as noted in the margin. Order given to the patrol guard to prevent strangers from riding inland. Nations have for some time been accustomed to ride or go outside the Cape at their own discretion, it has been decided to issue orders to the patrol guard to stop all foreigners, without distinction of state, rank, or condition, who might attempt to do so without having obtained written permission thereto from the Governor, or to cause them to return back to the Cape; and those who accommodate the same shall be earnestly advised to warn those persons thereof, and if it should happen that such warned persons nevertheless attempt to venture outside the Cape, then to report this to the patrol guard with a description of that person or persons so that they may be detained there upon their return, if they should have succeeded in passing that guard unnoticed; all upon a fine of fifty Ducatons for each person whom they shall be found not to have properly informed of this, or also whom they shall not have reported to the patrol guard, when they can be proven to have had proper knowledge thereof. Furthermore, since the orders enacted by this Council are also daily violated and neglected, namely that all inhabitants with whom any persons from the ships come to spend the night must give notice thereof to the officer of the main guard, it is further resolved and determined by renewal and amplification thereof: That all inhabitants without distinction with whom any persons or person, during the stay of the vessels to which they are assigned in this roadstead, come to lodge or spend the night, shall be bound to send notice thereof immediately, at least before sunset, by a note to the commanding officer of the main guard in the Castle, containing first the name, secondly the rank of the same, and thirdly the name of the ship with which they arrived. And this notification must be repeated once again as soon as the said persons shall have departed from them, whether back on board or to someone else to continue spending the night there, who shall likewise also be bound thereto, upon J. F. Rhenius, T. N. I. van Limden, J. T. L. Sueur. Thus resolved and determined in the Castle of Good Hope on the day and year aforesaid. It has pleased Your Honour and the Honourable Gentlemen to place into the hands of the undersigned a copy of a letter from the Lieutenant Colonel of the Regiment of Luxemburg, the Chevalier de Raymond, with orders to provide Your Honour and the Honourable Gentlemen with a report whether the monthly payment requested in the aforesaid letter can take place in accordance with the orders of the Honourable Company and the contents of the capitulation. Regarding the Capitulation, it is indeed true that in the 22nd Article it is stated, in case the Honorable Company comes to discharge the regiment, the same shall be paid until landing in France. Although this Article speaks without any reservation of payment, the respectful undersigned nevertheless believes, under correction from better judgment, that the same by no means excludes the restitution of such debts as the Regiment might incur during the voyage, under which the incurred hospital expenses may rightly be counted, and that all the more so since the subsequent 23rd Article states, the Regiment shall abide by the political orders established in the Colony where it shall serve, and shall introduce no novelties against the customs of the land. Since the custom here is that the invalids earn no wages for as long as they are maintained at the Hospital, the request of the Lord Lieutenant Colonel as a right comes to fail, both according to the orders of the Honorable Company and the contents of the Capitulation. 882 883 van Ommeren Whereupon, after mature deliberation and taking into consideration that, according to the Company's regulations, throughout all the Indies as well as in this Government, the wages must be withheld from such of its servants as are subsisted in the hospital, to which regulation the Regiment of Luxemburg must be held subject, because in the 23rd Article of its Capitulation it is stated that the regiment shall conform to the political orders established in the Colony where it shall serve, and introduce no innovations contrary to the customs of the land; and whereas the payment of wages requested by the Gentleman Lieutenant Colonel de Raymond to non-commissioned officers and soldiers maintained by the Honorable Company in the hospital would be an innovation, not only contrary to the usages established by specific orders, but also contrary to the interests entrusted to this council, it is approved and understood not to accede to that part of the request of the Lieutenant Colonel de Raymond, and to treat the non-commissioned officers and privates still present in the payment of their monthly wages on an equal footing with the military personnel here in the garrison, with the exception, however, that to each of them upon their departure from here shall be paid two months' wages in advance, in the same manner as took place regarding the entire Regiment of Luxemburg.
