Furthermore, we take the liberty to let this serve as an escort to the brigantine vessel the Helena Louisa, into which, for the account of the Presidial Chamber of Amsterdam, there have been loaded here 50 leagers of ordinary Cape wine; duly accounted for in the bill of lading and invoice accompanying this. With respectful reference to all that which we took the liberty dutifully to report to Your Right Honourable Worships concerning the aforementioned vessel the Helena Louisa, we shall now have the honour to offer Your Right Honourable Worships in authenticated copy two reports made to us, both by the equipage master and the master shipwright of this government, and by the officers placed by us upon that vessel, concerning the defects that were discovered on that vessel in Saldanha Bay, 449 and which have been properly repaired. The Lieutenant in the service of the state of the United Netherlands Cornelis Boomans having presented a petition to us, of which we take the liberty to offer Your Right Honourable Worships an authenticated copy, wherein he requested to be allowed to convey the repeatedly mentioned vessel the Helena Louisa from here to the Netherlands, without enjoying any wages or bounty, provided that his wife, married here, were granted free passage to the Netherlands; that petition having been deliberated upon in our meeting, the undersigned Governor, Secunde, and Independent Fiscal were of the opinion that one ought to seize such an advantageous opportunity. But the undersigned cellar master was against it, as he was of the advice that that Lieutenant Breugeman, whom we had left on that vessel after the departure of the commander Stol, ought to remain on it; whilst the undersigned cashier was of the opinion that, since there was an order that no naval officers might be placed on the Company's ships, one could therefore not enter into the request of Lieutenant Boomans when one could manage with the Company's officers; and the undersigned purser has submitted against the removal of Lieutenant Bruigeman from the aforesaid vessel such a protest as we take the liberty to offer Your Right Honourable Worships in authenticated copy. The votes thus balancing, the undersigned Governor, in consideration of the advantageous conditions proposed by the repeatedly mentioned Lieutenant Booman, and while not a single Company's officer was at hand here of that 450 451 rank and of that reliability to be able to entrust the command over that vessel, found himself obliged to conclude with the opinion to place the same Lieutenant Boomans on those conditions in command of the repeatedly mentioned vessel the Helena Louisa, in order to bring the same first to Saldanha Bay, and having returned from there, to convey it to the Netherlands, taking along his wife on this last-mentioned voyage, for whom the exemption from the customary passage and board money was, by the majority of our council, respectfully left deferred to Your Right Honourable Worships. The aforesaid protest of the undersigned purser having been read in our meeting, the undersigned Governor declared that he was most acutely affected by the contents of that document exhibited by the youngest member of the council; wherein he, the Governor, had to experience that virtually every point of the 452 conduct maintained by the Governor was reprimanded and carped at, and whereby thus his character and authority, placed in his hands by Your Right Honourable Worships, had been assaulted; and although such a manner of proceeding and the motive thereof are conspicuous, and he, the Governor, will in due time obtain certain satisfaction regarding this, he nevertheless reserved the right, pursuant to the favourable permission granted to him in his Instructions, by a separate letter, concerning his conduct maintained in this matter, to justify himself both to His Serene Highness, the Lord Prince of Orange as Supreme Governor-General and Supreme Director, and to Your Right Honourable Worships' illustrious assembly, with a humble request to maintain him in his character and authority, and for the future favourably to provide against such a manner of proceeding; upon which declaration the 453 undersigned purser requested to be allowed to know in what respects he had assaulted the character and authority of the Governor; and upon that it was answered by the undersigned Governor that he would explain himself on that account directly to Your Right Honourable Worships. With the packet boat the Lugtbol, we have had the honour to receive Your Right Honourable Worships' very revered letters of 1 October of the past year, and, awaiting the disposition which Your Right Honourable Worships will favourably impart to us in a secret dispatch, we shall 454 dutifully observe in every part the orders given in Your Right Honourable Worships' aforementioned dispatch regarding the forwarding of the Regiment of Württemberg garrisoned here. Pursuant to the resolution of your Right Noble, Rigorous, and Respected Political Council dated the 15th of June last, it having been resolved that the brigantine vessel Helena Louisa, before being able to undertake a voyage to Europe with safety, should be sent to Saldanha Bay in order to be rebuilt and repaired there as usual under the direction of the Master of Equipment by the Master of the Shipwrights; so the undersigned, in pursuance of this resolution, betook themselves thither and have the honor in this to inform Your Right Noble and Rigorous Lordship that having come on board the aforesaid vessel in Hoetjes Bay on the morning of the 23rd of the past month of July, they immediately made a beginning with executing this commission, and the following morning they careened the ship over port with the starboard side up, and found that the keel of the ship was undamaged, but that on the seam of the garboard strake below and above the sternpost, forward up to near the mainmast, it was nailed over with three battens, of which one sat above the garboard strake, and two below next to each other, beneath which was a piece of sheet lead. The uppermost batten was nailed in an insecure manner; there were, as far as one could ascertain, Right Noble and Rigorous Lord. To request passage for himself and his aforementioned wife on the Company's brigantine vessel the Helena Louisa, recently refloated from the beach, whenever it might be dispatched for a homeward voyage. That on that occasion, it was made known to the petitioner by the Honorable Governor that, owing to a lack of qualified persons, they found themselves at a great loss as to whom to entrust the command of that vessel, and that the departure thereof could therefore not yet be determined. That thereupon, the petitioner, who will always consider it a singular honor to be of any utility or service to the Honorable Company, replied to the aforementioned Honorable Governor that, if this should be the difficulty that would delay the departure of the aforementioned vessel, he, the petitioner, in that case offered his services to bring the same over to the Netherlands. Secondly, because on the report of the expert commission, directly contrary to that submitted by the undersigned and Mr. Le Sueur in Council, no payment was made to the contractors for bringing the vessel the Helena Louisa into floating water, and Bruggeman having examined with the undersigned the defects incurred by that small hull through its stranding and found them to be such as were stated by the undersigned in his report submitted with the aforesaid Mr. Le Sueur; the aforementioned Bruggeman had, moreover, made himself accountable to the undersigned for all further defects that might befall the brig aside from the effects of storm and tempest, which now having been unable to be fulfilled by the same, the undersigned protests once more in the most solemn manner against any damage that might befall the ship during the voyage to Saldanha Bay or during its careening there, declaring that of whatever nature the incoming reports concerning the condition of that vessel may be, which would seek in the least to contradict the submitted report also signed by the undersigned, he—by reason of having been prevented, through the setting aside by the Honorable Governor of the resolution passed by the majority on the 15th of June last, from taking ocular inspection in a legal manner of the further defects that may have occurred to that vessel—cannot nor may attach any credence thereto. While the motive why the undersigned could not be satisfied with the appointment of Mr. Coomans was this: because according to the explicit order of the Lords Principals, as appears from the extract of the secret letter from the Fatherland to the Supreme Indian Government dated 23rd of November 1785 and the ditto Batavian resolution of the 10th of July 1786, no land officers nor passengers may be taken into service on the Company's vessels. And although that gentleman has offered to bring the vessel to Europe without claiming the least wages or bounty for it, this advantage cannot be regarded as a pure gain for the Honorable Company, considering that

To address to the Right Honourable, per the Honourable Company's ship Gouda, which set sail therewith on the 11th. No. 1. We may have the pleasure to dutifully communicate to Your Noble Right Honourable the safe arrival of the two following outward-bound ships: On the 13th of this month, Candia, with 3 dead, 20 sick. On the 14th of this month, Rusthoff, with 5 dead, 24 sick. As well as that on the 10th of this month arrived here safely the return ship Regt door Zee returning from Batavia, with 13 dead and 14 sick, which vessel, together with the other return ships present, will be dispatched by us to the Netherlands as soon as possible, whither yesterday departed the brigantine vessel the Helena Louisa. to remove it, and thereby, as much as was in our power, to deliver this Colony from the devastation which that disease has more than once caused therein, and also that we had appointed a medical Commission to submit to us the Precautions under which the goods loaded in that vessel for this Government and the passenger who arrived with them, Mr. Rijk Le Sueur, might be transferred onto the Ship 't Duifje; so we shall now take the liberty to present to Your Right Honourable in authentic Copy, the memorial submitted to our Meeting in that regard by Surgeons Johannes Leeuwer, Johan Godlieb Mader, and Jean Martin. This having been deliberated upon by us, we decided to have the goods that had been unloaded in the ship de Batavier, both for the Company's and for private account, transferred under the precautions mentioned in the aforesaid memorial into the Ship 't Duifje, which Ship to that end, as long as those goods were not discharged from the same, remained deprived of all access, both from Land and from other Ships; and we sent someone on our behalf thither for the receiving of those goods, and for the care of the items that were damaged by the removal of the packaging, and gave the necessary notice thereof to the Public; and the aforesaid passenger Mr. Rijk Lesueur transferred under the stipulated precautions onto the Ship 't Duifje, and from there, after the expiration of 14 days, since during that interim no signs of infection appeared, came ashore here. 535. on the 16th of this month to the private ship de Eensgezindheid of this current month addressed to Your Right Noble Worships per the ships Gouverneur Generaal de Klerk and Regt door Zee, which therewith on the 17th of that month undertook the voyage to the Netherlands. The ships Spaarenrijk, Candia, and Rustoord, having successively on the 17th, 23rd, and 28th of this month undertaken their voyage to Batavia, we dutifully give Your Right Noble Worships notice thereof, as well as that the following return ships have again safely arrived here, namely: on the 15th of this month, the private ship Broederslust; on the 16th, Vasco da Gama, with 2 dead and 3 sick; the Afrikaan, with 14 dead and 8 sick. Furthermore, we may have the pleasure to communicate to Your Right Noble Worships that the permanent ship 't Duifje departed on the 26th of this month from False Bay for the Fatherland. With the aforementioned ship Vasco da Gama, we received with heartfelt sorrow a dispatch from the Company's servants at Canton, wherein they inform us that the ship Canton on the 21st of September last came to anchor 10 to 12 miles 536. miles west of the Mandarin's Cap, took three pilots on board there, discharged a Chinese passenger, and that the said vessel set sail that very same day in the afternoon, and on the 23rd of the said month was overtaken by a hurricane, in which the ship presumably perished with all hands and sank, as on the 30th of November, the date of the aforementioned dispatch, it had not yet reappeared. Having dutifully informed Your Right Noble Worships by our humble following letter dated the 19th of February last of the arrival of the packet boat the Maria Louisa, and that the same had lost its mainmast and feet in a storm on the voyage hither, we can inform Your Right Noble Worships that that vessel is now again properly repaired from its suffered damages and in a condition to undertake the voyage to the Netherlands, presenting enclosed to Your Right Noble Worships a declaration given by the officers, from which Your Right Noble Worships 537. will dutifully be pleased to see that the fierce southeasterly winds have been hindrances why those repairs could not have been completed earlier. For the rest, we let this serve as an escort for the aforementioned packet boat the Maria Louisa, in which we have allowed to remain the cargo shipped therein at Ceylon, as Your Right Noble Worships will find the same specified on the accompanying bill of lading and invoice, to which are also added some wines shipped on freight in this vessel here by private individuals. Since, pursuant to Your Right Noble Worships' respected letter of the 2nd of October of the past year, the post of Town Major in this Government must be abolished, we have placed an extract of that part of that venerated writing into the hands of Charles Philip Baron van Bonstetten, who held this post, and as he has made a request to us by petition to repatriate with the bearer hereof, we have, pursuant to Your Right Noble Worships' favorable authorization, granted him permission to sail over to the Netherlands while retaining the rank, 538. status, and pay of Captain, as well as the baggage belonging to that status. Anno 1791 February Saturday the 20th, began to unrig the Maria Louisa in order to take down the rigging erected by us upon the loss of the mainmast, and to send the stump ashore, where we were occupied both with erecting the sheers and otherwise until the 24th of the same month. The 25th, sent the foremast ashore, and had in the meantime also sent thither all the empty water casks. The 4th of March, received the foremast back on board, which has been fitted with three iron hoops around its masthead, and meanwhile the carpenters had repaired the covering board and railing. The 9th, received the mainmast on board. The 10th, 11th, 12th, 13th, 14th, and 15th, were busy clearing and stepping the new main rigging. The 17th and 18th, hard southeasterly wind, which prevented us from accomplishing anything on the rigging. The 19th, sent the longboat to bring more ironwork ashore, but the southeasterly wind beginning to blow hard, it returned shortly without success. Extract from the logbook kept on board the Honorable Company's packet boat the Maria Louisa, lying at anchor in Table Bay. The Copy The 20th and 21st, had a persistent storm of southeasterly winds, by which we were unable to accomplish anything. The 22nd, the weather and wind moderated, began directly to load, and took over 15 whole, 12 half leaguers, and 5 aams of wine as freight. The 23rd, took again 15 whole leaguers and some small casks of wine, as before mentioned. The 25th, it being fine weather, took in our water as well as some more wine, the same as aforesaid. The 26th, received the rations for the voyage. The 27th and 28th, set up topmasts and yards, also stays and shrouds set up, bent sails to the yards, and had everything in such readiness as to be able to depart. The 29th, were mustered. It may be necessary to occupy Your Right Honorable and Highly Respected Lordships' attention for a moment concerning a matter which, subject to respectful correction, appears to me to be of the utmost importance to this Colony, as it concerns the administration of impartial justice, without which certainly no land or people can continue to exist. In granting me the commission to the post of Independent Fiscal at this place, it pleased Your Right Honorable and Highly Respected Lordships at the same time to command me to observe, protect, and promote the interests and concerns of the Honorable Company with all my faculties and zeal, and to tolerate no infractions or abuses against them; And I would consider myself utterly unworthy of the trust with which No 3. 541. I have seen myself honored hereby, if I did not blindly, that is without the least respect of persons and without favor or disfavor, endeavor to apply my utmost efforts to fulfill it. From which claim here annexed under No 3, together with the minutes of the meeting held on the appointed day under No 2, and to which I respectfully refer, so as not to trouble Your Right Honorable and Highly Respected Lordships with tedious repetitions: Your Right Honorable and Highly Respected Lordships will be able to see what is charged against that defendant, and what conduct the Council of Justice, against all law and good order, has seen fit to maintain concerning that matter; And when Your Right Honorable and Highly Respected Lordships will please to confront the facts charged against the defendant in that writing with the cash books of this Government, of which I am informed that copies are sent annually to the Motherland, I do not doubt for a moment that Your Right Honorable and Highly Respected Lordships will find the truth thereof undeniably proven. The messenger was ordered to place a chair for the same, which chair, NB, was placed to the right hand of him as public prosecutor and next to the President; however, not at the table. While I, pursuant to Your Right Honourable Orders contained in the 8th Article of my instructions, had taken my place somewhat separated from the table. A circumstance, Right Honourable and Most Respectable Sirs, which, however minor in itself, nevertheless demonstrates most clearly the spirit with which that President and his Council were inspired at that time. Omitting a whole multitude of reflections which naturally spring to mind regarding what occurred in that matter, I find myself obliged only to submit the following for Your Right Honourable and Most Respectable's consideration: Namely 1st: Whether I, in my capacity as officer of the police, have not conducted my verve and conduct with the greatest moderation, discretion, and decency, as far as the duties imposed upon me could in any way allow. 2nd: Whether the defendant, both by the answer to the notification previously served upon him and by his dilatory exception, which was as illicitly fabricated as it was puerilely selected, has not shown most clearly that he is at a loss with the matter, unable to produce anything substantial for his defense, but is fully convicted of the crime of peculation and the further offenses pointed out to him. 3rd: Whether it is not likewise to be inferred from this that with that device he had no other intention than to postpone the matter indefinitely in order to gain time so as to continue further with his committed malversations and to enrich himself more and more with unjust money? 4th: Whether, moreover, the defendant, having as a fellow member of the Council of Policy solemnly sworn by oath not to reveal the secrets of the Council to anyone, by producing in his favor in the Court of Justice an extract of a secret missive addressed by Your Right Honourable and Most Respectable to the Governor and Council, and thus strictly and primarily belonging among the secrets of the Council, has not rendered himself guilty of perjury, and consequently is newly actionable and ought to be challenged by me in my capacity as Independent Fiscal. 1744. Actionable is and ought to be challenged: 5th: Whether the conduct maintained in this matter by the President of the Court of Justice is not likewise utterly reprehensible. As having attended the deliberations on whether or not to grant a suspension in a matter in which he himself was interested, without the least hesitation, and even putting the request of the defendant to the vote without having the regular claim made. Indeed, how well and conscientiously the same knows how to perform his post as President of a Court of Justice, and how pertinently and according to the order of law he knows how to collect the votes and to form a proper conclusion therefrom, even in matters concerning the life or death of his fellow man, the Right Honourable and Most Respectable Sirs will be able to deduce most clearly from the copy also annexed hereto under No. 4, of a missive written by the Governor of the Cape to the High Government in Batavia, dated [illegible]. To which is further added that he has the constant habit, contrary to the custom in all well-regulated Courts of Justice, of always expressing his opinion first and then asking that of the other members. A practice, Right Honourable and Most Respectable Sirs, extremely dangerous to the administration of pure justice; especially when knowledge and proficiency are not precisely the greatest attributes of the other members, and the president manages to acquire some influence over their minds; who then, often out of a misplaced trust in his greater learning and experience, say yes and amen to everything with him.
