Whether the members of the Council who concurred in that strange resolution of surcease have not also fully demonstrated thereby their partiality against the Independent Fiscal and in favor of the defendant, and exceeded their duty as judges, by granting his request immediately, sine praevia causae cognitione, without even having the charges brought against the accused read aloud or examining them, by suspending this entire proceeding for an unlimited time and day, indeed, by moreover simply flatly denying the demand for provisional suspension pending the conclusion of matters, of the Honorable Administrator, accused of having robbed the Company! 7th. Whether the honorable judges have not thereby left the defendant the opportunity to proceed further in the evil he has committed! Especially since it is not to be expected that this matter will be fully concluded before the end of the month of August, in which he is accustomed to perform his tricks. 8th. Whether those honorable judges cannot and must not, much rather and without doing them great injustice, be considered, if not as accomplices of the defendant, at least as abettors of his misdeed, and on that account also punishable, and furthermore responsible for the damages to flow therefrom. 9th. Whether consequently he who must observe the rights of the High Government can and may safely in good conscience leave the adjudication of a case, in which the interest of the Company, together with the honor and reputation of the Chief Commander of this Colony, is so remarkably involved, to such judges! And whether he must not always be scrupulous about conducting any proceedings, especially against natives of this place, as they are almost all related to one another, ratione officii before such a court! 10th. Whether he did not with the greatest right, since no other means remained to him at that moment, protest in full Council against the protraction of justice and nullity: adding that to decide upon matters without examining the documents was to act like blind judges, and looked more like favors than impartial justice! 11th. And lastly, whether anything else now remains for him than, while complaining about these proceedings, to address himself in the first place to his honorable Masters, and to render to their High Noble Great Worships a detailed account of all that has occurred, before ever wearying with those complaints their High Mightinesses the States General, in whose supreme name justice is administered here! For your High Noble Great Worships will easily be able to agree with me that this could not in this case, for various reasons, occur in the first instance in Batavia, given the time that must elapse before a final decision can be expected from there, owing to the constantly accumulating occupations and appeal cases at hand in the capital of the Indies; while in the meantime the Company would be increasingly injured. I therefore take the humble liberty of most submissively requesting your High Noble Great Worships, at the Cape of Good Hope, the 19th of March 1791, to maintain me, through your supreme authority, in the exercise of the post so favorably entrusted to me, and in the obtaining of impartial justice, and to honor me as soon as possible with your supreme orders, as to how I shall have to conduct myself in this present and further similar cases that might arise! Whether it may please your High Noble Great Worships to judge these proceedings de plano yourselves, or to leave them to other impartial judges in the Fatherland for decision! Having already written this off, I received the note annexed hereto under No. 5, from which Your Right Honourable Graces will be able to see: How the President and Council, continuing in their partiality and animosity against the Fiscal Office, have seen fit, after I had requested from the Secretary an authentic copy of his submitted claim in order to append it hereto, and from which the latter erroneously concluded that I had kept no draft of it, The former to bring this into question, and the Council directly to decline such without the slightest reason; And consequently to refuse me a copy of the said document; which nevertheless must never happen; And since Your Right Honourable Graces, in the 24th Article of my Instruction, have been pleased to determine: The Independent Fiscal shall have access, inspection, and perusal to and of all registers, books, letters, accounts, and papers, NB, none excepted; I thus find myself rendered unable to send to Your Right Honourable Graces any other copy of the aforementioned document of claim than one authenticated solely by myself, And, if this continues in this manner, to be able to continue and further perform my office unhindered without further provision from Your Right Honourable Graces; So it speaks for itself that, while to me by the 5th Article of that Instruction is mandated the direction and conduct of all matters both civil and criminal, at least that which belongs to the Secretariat of Justice is indisputably included thereunder in the first place. That consequently the aforementioned Council, in a very sophistical manner, has brought about a direct obstruction and hindrance in the execution of my office, and has conflicted with and disobeyed the so clearly established orders of Your Right Honourable Graces. 548. Appeared before the Noble Honourable Council of Justice of this Government, J. N. S. Baron van Lijnden, Independent Fiscal, Plaintiff ratione officii on the one part, in the case of malversation and improper conduct in his administration and post, against Jacobus Johannes Le Sueur, Cellar Master, Defendant in the same case on the other part. And made known: How the Lord Governor-General of the Netherlands Indies, G. W. Baron van Imhoff, already in the year 1743, had seen fit to confirm the custom that had been in use for many years, namely that of whatever remained over of the fixed price of the wines delivered to the Company, two thirds should be enjoyed by the Governor or Commander at this place, and the remaining third by the Chief Administrator and Second; As appears from their left-behind Instructional Memorandum annexed hereto under letter A; That also in that same year, by resolution of the Political Council of this Government, likewise with the consent of the aforementioned Lord Governor-General van Imhoff, it was enacted that henceforth for every leaguer of wine that should be driven past the Castle and brought into this town, three rixdollars should be paid to the Honourable Company; According to the extract from that resolution hereto under letter B; That in conformity therewith, subsequently, from what was paid on the Company's behalf to the suppliers of the wines, thirteen rixdollars were constantly withheld from every leaguer. Of which ten rixdollars went to the benefit of the Lord Governor and Second, in distribution as stated above, and the remaining three rixdollars as a recognition fee into the Company's treasury; the wines delivered to the Company nonetheless being entered in the cash books just as if those thirteen rixdollars had also been paid to the suppliers. While in the receipts the three rixdollars in recognition money were brought in as received from those suppliers, without finding any mention made in the expenditures of the ten rixdollars per leaguer enjoyed by the Lord Governor and Second; Until the Illustrious Assembly of Seventeen was pleased, upon a certain petition of complaint of the citizenry of this town, by missive dated 27 November 1784, to order: That whereas for every leaguer of wine delivered to the Company, an ordinance of forty rixdollars was drawn, but the supplier received no more than twenty-seven rixdollars thereon, while out of the withheld thirteen rixdollars, with their highest permission, ten were enjoyed by the Governor and Second as a means of subsistence, and the remaining three were withheld for the Company; Their Right Honourable Graces, in order to prevent all wrong impressions that might arise from this practice, however lawful in all respects, had seen fit that henceforth on a separate account, the said

That besides these ten rijxdaalders per leaguer for the ordinary Cape wines delivered to the Honorable Company, there is also, according to an old custom, enjoyed jointly by the Governor and the Secunde ten rijxdaalders for each leaguer of brandy likewise delivered to the Company, As appears, among other things, from the vindication of the Senior Merchant and Secunde Pieter Hacker, as former, and the Merchant Mr. J. Wherein these gentlemen express themselves thus on page 257: That it is a deliberate lie that the money for the delivered wines is received by the cellar master, but it is also fully known to everyone that for a leaguer of white or red ordinary wine never more than twenty-seven rijxdaalders is paid, even though the warrant reads forty rijxdaalders, and for a leaguer of brandy fifty rijxdaalders is enjoyed, of which the warrant specifies sixty rijxdaalders, the remainder being withheld both for the recognition fee for the Honorable Company and for a gratuity for the Governor and Head Administrator, and no secret has ever been made of this, etc. That also, since the order contained in the previously cited missive under C, continuously in 551. Letter A the treasury accounts, these ten rijxdaalders per leaguer of brandy, just as with the wines, are found separately recorded as paid to the Governor and the Secunde. That meanwhile, the present cellar master J. J. Le Sueur, notwithstanding his own statement in the just-cited memorial of vindication, finds it considerably easier and more profitable, instead of paying those ten rijxdaalders per leaguer of ordinary Cape wine and brandy to those gentlemen, as well as the three rijxdaalders recognition fee for each leaguer of wine to the Company, to keep the same entirely for himself, and therefore considers it best to appropriate for himself, from such wines and brandies as he delivers to the Company in the month of August, the full sum of forty rijxdaalders per leaguer of wine and sixty per leaguer of brandy, exactly as they are charged to the Company as an expense. There having been granted to the cellar master, by resolution of the Governor and Council here dated 31 January 1758, annexed hereto under Letter D, a write-off of ten percent of the yearly surplus stock of wines as well as arak and brandy remaining at the end of August upon the closing of the books, with which he must content himself, and from which alone the delivery of wine and brandy made by the cellar master to the Company can consequently arise; for indeed our High Ruling Lords Masters, by resolution of 3 December 1783, likewise to be found in the printed Cape documents among the appendices No. 12, declare themselves on page 124 regarding this matter as follows: That in order to prevent disadvantage to the Company, it is established that no Company servants shall be permitted to make any delivery, under whatever name, to the Company, with the exception of that which is credited to them for permitted spillage, and that they shall likewise not be permitted, directly or indirectly, to conduct any trade in matters belonging to their administration.

That the Honourable Ex Officio Plaintiff, some time ago, accidentally learned from the Governor that His Honour had been required to submit to the High and Mighty Lords Seventeen a statement of the revenues enjoyed annually by His Right Honourable and Gallant Sir as chief commander of this Government, and this upon the oath taken to the Company. That, furthermore, some time thereafter, he had received report from the Fatherland that, upon confronting that statement with the trade books of Cabo there, it was found that the same did not agree, but that the Governor was said to have reported lower receipts than those books showed. Indeed, that some ill-disposed persons, surely unaware of the disinterested and noble character of the said Governor, or indeed his enemies, had wished to infer from this that this had occurred audaciously; from which consequently nothing else could be deduced than that His Honour, forsaking oath and duty, out of a remote and uncertain prospect of foul gain, deliberately made a false statement to his masters. That the Honourable Ex Officio Plaintiff, being in his conscience fully convinced of the contrary, and assured that either an error must have taken place here, or, if any embezzlement was involved, it had to be sought elsewhere, and at the same time understanding that in the latter case the Governor was not only shamefully defrauded of the emoluments legally due to him, but that his honour, with which he had served the Country for so many years, was placed in jeopardy, deemed it entirely consistent with the duties of his post to institute a precise investigation in this regard and to make his office active. That the Plaintiff ratione officii has therefore found himself obliged in his official capacity to have the previously served party summoned before this Court of Justice, and to institute a claim against him more consueto et secundum ordinem Juris, since, pursuant to his instructions as Independent Fiscal, he could not leave or submit a judicial proceeding to the decision and judgment of the Political Council. That the Plaintiff, having set forth the foregoing narrative, will now proceed: 1. To demonstrate clearly to Your Right Honorable and Esteemed sirs from the trade books what was committed on the part of the Defendant, along with the manner, in order to conceal it if possible, in which this took place. 2. To examine under what sort of offenses that which was perpetrated is to be classified. 3. What the punishment is with which the same must legally be sealed. And finally, having formed a conclusion therefrom, to leave the same with confidence to the judicature and impartial decision of Your Right Honorable and Esteemed sirs, with the prior protestation that the Plaintiff, as a hater of all personal attacks that are irrelevant to the case, will observe all possible moderation, gentleness, and deference that are in any way consistent with the duties imposed upon him, but at the same time also with the hope and in the confidence that Your Right Honorable and Esteemed sirs, in the adjudication of this case, will exercise the officium judicis ut semper nobile, without the slightest respect of persons, according to the rules of justice and equity pro ut res ipsa postulat; and this is especially necessary in a case like this, quae tam magni momenti est, since it here concerns the concerns and the interests of our Lords and Masters, so dearly commended to our care and supervision, together with the interests of the first two Ministers of this Colony, and especially also the honor of the Chief Commander of this Government, which it is the duty of all of us to protect to the best of our ability. Letter G The Plaintiff ratione officii, out of all the available years in which the Defendant held the post and administration of cellar master, will take out only one as a sample and example of what was practiced and put into effect throughout all that time. That according to an annexed extract from the cash accounts of the financial year 1785/86, and specifically for the month of August, it appears that in that month there were delivered to the Honorable Company 110 leaguers of ordinary Cape wine and 178 leaguers of brandy, making a total number of 288 leaguers. That of these 288 leaguers, the 10 rixdollars per leaguer, as paid to the Governor and Secunde, are also entered into expenditure, thus 2880 rixdollars, while they in the meantime have only received a sum of 1580 rixdollars, namely for 158 leaguers. That the defendant has thus moreover acted contrary to the express and hereinbefore cited orders of his Lords and Masters, and consequently has brought upon himself the punishment of Deportation enacted by Their High Mightinesses against this. For indeed, Right Honorable and Respected Sirs, the Drinks from the 10 percent conceded leakage must have been sold to the Company or to private persons, which latter is forbidden under the same penalty as delivering to the Company in a quantity greater than that leakage amounts to, seeing that neither the Defendant nor anyone in the World will be able to maintain that that quantity of Leggers would have been consumed in the defendant's own household. That the Officer Plaintiff herewith trusts to have concluded the first point, namely demonstrating what was committed on the part of the Defendant, together with the manner in which it was 557. concluded; in the firm conviction, however, that the Defendant will not be audacious enough to dare deny what has been stated, or to reproach the Extract from the Cash accounts drawn up in the Officer Plaintiff's own hand and attached hereto, while he, for various reasons, must make difficulty about giving those books into other hands in order to have the necessary Extracts taken and authenticated therefrom, in the contrary case expressly reserving the right to prove all that has been stated clearly and indubitably from the Trade books or other Documents by petitioning for a Commission expressly appointed for that purpose. That regarding the second point, namely under what kind of Offences this course of action of the Defendant must be classified? it could in no way appear strange to anyone who possesses even the slightest tincture of the Roman Civil Law, in case the Officer Plaintiff placed the same under the lex Cornelia cited in book 48 Title 10, especially when he compared the description by all prominent legal doctors of the Crime dealt with therein to the Case in question with all its circumstances. That, however, to take all this as mildly as is in any way feasible, the Officer Plaintiff does not doubt for a moment that the defendant himself, who formerly also frequented the Universities in Europe, at least if such occurred with any fruit, will have to agree with all impartial persons that it is by no means aggravated if one brings the same under the 13th Title of the same book of the Pandects, namely under Peculatus or Embezzlement of public funds, which is unanimously described by Criminalists to be, Furtum pecuniae publicae factum ab eo, cujus ea periculo non sit. That is, a theft of the Country's funds, not committed by him who had the same at his risk. Whereupon, on the further insistence of the defendant, the extract produced by His Honour having been read in Iudicio, the same was found to be of the following content: Extract of a Missive, written by the Right Honourable and Highly Respected the Directors Commissioned to the Illustrious Assembly of the Seventeen of the United Netherlands Chartered East India Company, to the Governor and Council of the Cape of Good Hope, dated 2 October 1790. After the reading of which, His Honour informed the Council: That in the aforesaid most respected communication from the Lords Majores, it was likewise so seriously demanded and imposed upon His Honour to prepare his reports, considerations, etc., on various distinct points within three months after the receipt of that missive; and yet until now he had been prevented from doing so because, shortly before receiving that communication, His Honour had gone to the Baths for the restoration of his health, and had only returned from there a few days ago; that as that order is so strict that its omission or neglect would justly bring upon His Honour the highest displeasure of his High Rulers, His Honour also believed that no external matters, and especially no untimely legal proceedings, should be placed in his way that would prevent him from dutifully obeying those high orders; that for these weighty reasons His Honour found himself obliged to request the council that this matter might be stayed until His Honour had dutifully fulfilled the duty imposed upon him; further declaring that, after the expiration of that period, he would appear before this respectable tribunal and then state whether he would request a copy of the claim or not. 571. that the defendant may be ordered to respond within a certain term; and that finally, if the council should judge what has been brought forward on the part of the defendant to be of such weight that the case would have to be suspended, he, the plaintiff ex officio, in the present case then found himself forced to request that the defendant be suspended from his respective offices, in order thereby to prevent the further damage that the Honorable Company still suffers daily through the defendant's administration. The defendant continues, on the basis of the instructions from the Lords Masters and the arguments alleged by him, to persist in his request. The Council, having considered the matter, grants the defendant's request and thus suspends these proceedings until the order of the Lords Majores, contained in the produced extract of the dispatch of 2. October 1790, shall have been fulfilled by the defendant, further denying the request made by the plaintiff ex officio for the suspension of the defendant. And the Independent Fiscal, following the pronouncement of this order, furthermore made the following denunciation in court: Honorable and Respected Sirs! Since the Gentlemen have seen fit, notwithstanding my alleged reasons, to proceed to this disposition, I request that they do not take it amiss that in my office as Independent Fiscal of this government I most formally protest, as well of the protraction of justice as of the nullity of the resolution now taken; leaving the individual responsibility, both thereof and of the damage that the Honorable Company comes to suffer hereby, to those Gentlemen members who have voted for this, reserving to myself the right to address myself concerning this as I shall be advised; and I protest of nullity because I see that the Lord President, who is interested in this lawsuit and therefore cannot judge over it as a judge, did not absent himself during the deliberations; To which statement the Honorable Lord President declared that he had not known that he was involved or mixed up in this matter, that he would otherwise certainly have absented himself during the deliberation thereof, while his Honor might reasonably have expected that, as has been requested repeatedly by parties in various matters, the Independent Fiscal would have informed him beforehand, either privately or in this assembly, 572. that matters appeared in these proceedings instituted against the defendant which required that his Honor recuse himself from voting or retire from the assembly itself; further declaring that he now retracts the opinion he had delivered in this matter and will withdraw from the deliberations hereon in the future. And whereas after these various statements, the said Lord Independent Fiscal answered in substance: that he had not wished to commit the indiscretion of recusing the Lord President, or of requesting him beforehand not to vote in this matter, since he expected that the said Lord President would observe this of his own accord; adding here to the said Lord President: that from these various things it now appeared that a decision had been made without the claim and the documents having been read; that if one acted in that manner, one would be acting as blind judges, and it would look much more like favors than impartial justice; and that he finally referred back to the above-mentioned protest, etc. While furthermore the Lord Mappa, who, with regard to the order issued in the aforementioned case, was of the opinion that, since one ought not to obstruct the course of justice, and the manner of proceeding ordered for observation here clearly sets the term of the proceedings at fourteen days; that also the order produced by the defendant was not addressed or assigned to this council to be followed by the same, and the excuse of the defendant ought therefore not to be taken into consideration, and he consequently had to be ordered either immediately to request a copy or to answer thereto as he thought he was able and allowed to do; has had this vote recorded in the minutes. That, however, the said President, falling under the first five, notwithstanding that a complete parity of votes existed, thought fit to formulate the conclusion toward the side of the strictest advice and accordingly had this sentence drawn up: On the grounds that his Honor claims to have a casting vote. That is, in case of a tie of votes, to then be able to provide the party to which he aligns himself with a double vote, and thus to be able to establish a majority in order to cause the conclusion to incline to that side, Whereas sound reason and innate natural law dictate That it is always safer and better to let a guilty person go free than to condemn an innocent one, And that in case of equality of votes one must always choose the milder side, which therefore, in the event that the President actually possessed this privilege, could never occur, I found myself aggrieved to have this so singularly concluded sentence carried into execution, and considered that I must provisionally suspend that execution. - Since not the slightest proof or indication has come before me that to a President of the Council of Justice of the Cape, whether by our High Commanding Lords Masters, or by Your Right Honorable, Most Respectable Worships, such a right of a casting or concluding vote was ever given, especially in a criminal case such as this where the death or the life of one's fellow man is at stake. Just as I have also never heard that a similar grant to a presiding member of any tribunal in Europe is in use. — When it would indeed very often have to happen that the welfare, the honor, 577. 578. and the life of prosecuted persons would be exposed to, and depend solely upon, the caprices, nature, greater or lesser humanity and conscientiousness of such a presiding member alone. - It is therefore, pursuant to the letter of the highly esteemed Lords Masters, dated 4 September 1739, that I, with the transmission of all the documents relating to that proceeding, together with the accused himself, have the honor to give proper notice of this to Your Right Honorable Worships, with the request to be permitted to learn their highest pleasure whether this sentence, considering the manner in which it was formulated, can remain valid and take effect. 586. to undertake the voyage to the Netherlands, we take the liberty to present herewith to Your Noble Right Honourable Lordships the copy of our humble dispatch of 31 March last sent to Your Noble Right Honourable Lordships by the packet boat the Maria Louisa; with which the same departed from here the following day, whereas on the 2nd of this month the Honorable Company's ship Sint Laurens arrived here, which departed on 22 November of the past year from Batavia and only on 25 December from the Sunda Strait, where by a storm it lost its main yard, as well as two anchors and two cables, while during the voyage hither 18 of its crew have died and 17 have become disabled. We further have the honour dutifully to inform Your Noble Right Honourable Lordships that we have caused to be laden into the ship Tijlingen: 5 leagers of ordinary Cape wine 6 aams of red Constantia wine, namely 2 aams from Cloete, and 4 ditto from Colijn 4 aams of white Constantia wine, namely 3 aams from Cloete, and 1 ditto from Colijn as well as from private individuals on freight 5 leagers of Madeira, appearing more fully from the bill of lading and invoice drawn up thereof and accompanying this. The Assistant Joachim Godfried Matthiesen having made a request to us by petition, 587. dutifully to Your Noble Right Honourable Lordships, to repatriate by the China return ship Vasco da Gama lying here in the roads, on account of the expiration of his contracted term, we have permitted him to do so; and since he has given us all reason for satisfaction in the performance of his duties, we take the liberty humbly to supplicate Your Noble Right Honourable Lordships that, should the said Matthiesen apply to Your Noble Right Honourable Lordships to return to this place, it may please Your Lordships to cast a favourable eye upon his petition. 680. taken the liberty to address our latest humble letters to Your Noble High Mightinesses dated the 23rd of the recently ended month of February, and we respectfully accompany these with the duplicate thereof, with the dutiful notification that that vessel commenced the voyage to the Netherlands on the 25th of that month. We also have the pleasure to report to Your Noble High Mightinesses the safe arrival on the 1st of this month of the return ship Thijslingen with 18 deceased and 10 sick, as well as that on the 3rd of this month the outbound ship de Ystroom arrived here in good condition with 3 deceased and 10 sick. To these reports of Your Noble High Mightinesses' ships we shall further dutifully add that the ship Willem de vierde on the 8th of this month, and the Scherpen Bletterswyk and de Zwaan on the 9th of this month commenced their voyages Batavia to the Netherlands, and that the ships de Gouverneur Generaal de Klerk and Regt door Zee are being mustered today in order to be able to commence the voyage to Europe. 3rd. With respectful reference to everything that we, in our successively dispatched letters, have taken the liberty to communicate to Your Noble High Mightinesses concerning the stranded ship de Zeenimph, we consider ourselves obliged to report to Your Noble High Mightinesses that the undersigned Governor has issued a commission to Naval Captain Christiaan van Veerden and Captain Lieutenant Ian Valkenburg to accurately inspect and examine, in the presence of the resident at False Bay Christoffel Brand and the Equipment Master of this Government, assisted by the master shipwright, when the aforementioned ship de Zeenimph should be careened for its heaving down, what defects that ship had sustained both to the keel and to the rigging due to its stranding; whether the same were repairable or not; and if so, how high the costs to be incurred for this would run by estimation; that thereupon a report regarding their findings was handed to him, the Governor, by the aforementioned maritime commission, 602. to which were annexed two lists, one from Captain Lieutenant Coertse and one from the master shipwright Meyndert van Eyk, concerning the necessities both for the rigging and for the rebuilding of the ship de Zeenimph, of which report and annex we take the liberty of presenting the authentic copy to Your Noble High Mightinesses; that the undersigned Governor, in order to be able to judge with greater foundation concerning the costs that ought to be incurred for the further repair of the abovementioned ship de Zeenimph, had the Trade Office calculate what the items stated in the aforementioned lists would amount to; that according to this calculation, which we likewise take the liberty of presenting to Your Noble High Mightinesses in authentic copy, the same would come to amount to a considerable sum of upwards of f 20,000, the undersigned Governor declaring 603. that since these costs appeared very high to him, especially at a juncture when the Honorable Company had given orders to repatriate all its empty ships present in the Indies, he had demanded a report from the aforementioned commission whether, if the circumstances should require that one ought to await further orders from Your Noble High Mightinesses in this regard, one could then leave the aforementioned keel in the situation in which it currently finds itself, with complete peace of mind, without fear that the same might serve to the detriment of the Honorable Company, whether through rot or through any other damage; that thereupon a written report was again submitted by the very same commission, which we respectfully present in authentic copy to Your Noble High Mightinesses; that these matters were deliberated upon in our assembly, and it was resolved to place copies of the aforementioned calculation of expenses into the hands 604. of the repeatedly mentioned maritime commission, to serve for their considerations whether the repeatedly mentioned keel of the Zeenimph was still found to be in such a condition that the same was worthy of the aforementioned expenses, so that, these being expended upon it, the ship would still be of long service to the Honorable Company; and since it was not apparent from the first-mentioned report of the aforementioned maritime commission where the various items had ended up which were to be replaced by the newly requisitioned items, we have made the officers of the repeatedly mentioned ship de Zeenimph account for the inventory of that vessel point by point; that the undersigned Dispenser declared in this matter that he could not conform with the aforementioned opinion of the majority of our council, but was of the opinion that, since a beginning had already been made with the rebuilding, one ought to proceed with it, provided 605. Having read the report requested by us from the repeatedly mentioned nautical committee, and which we accompany herewith in authentic copy, it appeared to us from that report that although the aforesaid committee judged this keel, as well as the costs to be spent on its rebuilding, fully worthy, it nevertheless made the usefulness or uselessness of that vessel upon its return to the Fatherland depend on circumstances, about which we furthermore could by no means judge; whereunto it was furthermore taken into consideration that according to the declaration of the undersigned chief administrator, we had a very great shortage of cordage here because the requisitions for that item have not yet been fulfilled, so that we necessarily had to preserve the cordage still on hand in order to supply from it, in case of need, the richly laden return vessels that are expected; that this shortage was further explained to us by the equipage master 607. master of this government, and that we therefore resolved, even had we judged it best for the Company's service to let the aforesaid rebuilding proceed immediately, we had to decide to suspend it until we shall be honored with the final orders from your Right Honorable Worships in that regard. To the Right Honorable Sir Cornelis Jacob van de Graaf Governor and Director of Cape of Good Hope and the dependencies thereof etc. etc. etc. Right Honorable Sir Your Right Honorable having been pleased expressly to order the undersigned to report accurately whether, during the time that one would have to wait for the orders of the High Governing Lords Masters, the Honorable Company's ship the Zeenimph could be left lying in the situation in which it currently finds itself with complete peace of mind, without any fear that the same, either through rotting or through any other damage, would turn out to be to any disadvantage of the Honorable Company. Thus the undersigned are, subject to correction, of the opinion that the aforesaid ship the Zeenimph, in that time of some months, underwater will not rot so much that it would become unable to be repatriated, although it is certain that the ship above water suffers damage due to the severe drought, but nevertheless, that the ship, as far as it is above water, could be tarred, and the stern frame kept under base coat with oil and paint, the officers and a part of the crew serving to remain on board to maintain the same, and in the morning and in the evening before sunrise and after sunset, daily, to have it washed or drenched with seawater; it is also certain that the Honorable Company will incur the expenses of having to furnish more heavy ropes to the keel during that time than those that have already been requisitioned, and finally that certainly in all bays, ships run the risk of being driven ashore by violent storms, which God forbid, for which neither the undersigned nor any other human can vouch. Your Right Honorable having been pleased expressly to commission the undersigned, in the presence of the Resident C. Brand and the Equipment Master C. Cornelissen, assisted by the master of the shipwrights M. van Eijk, to carefully inspect and examine, when the ship the Zeenimph shall have been careened for its heaving down, in the presence of the Captain of the aforesaid vessel Theodorus Soussaint, what defects that ship, both to the keel and to the rigging, has sustained through its grounding, whether the same are repairable or not, and if so, how high the costs to be applied thereto would run according to estimate. Thus have we, the undersigned, in order to comply with the commands of the very honored letter of Your Right Honorable, proceeded on board the aforesaid ship the Zeenimph, and after the same was careened on both sides, To the Right Honorable Sir Cornelis Jacob van de Graaff, Governor and Director of Cape of Good Hope and the dependencies thereof etc. etc. etc. careened, 615. found the damage to be of not the slightest importance, except only that a piece of the false keel was broken off by the grounding, we declare the said vessel in all respects sound and repairable. However, since it is not possible for us properly to answer the intention of Your Right Honorable with respect to determining the expenses that would run according to estimate for its repair, we have thought best to have the items necessary for that purpose estimated and set down under their signatures, due to the indisposition of the Captain, by the Captain-Lieutenant I: C: Coersse and the master of the shipwrights M. van Eijk, which notes we have the honor dutifully to present herewith annexed to Your Right Honorable.
