Mr. van Lijnden, due to the capital accusations militating against him, finds himself in the situation where the highly venerated directive of the highly aforementioned masters, dated 9 August 1782, can and must be applied to him in the strictest sense, in which their Right Honorable Lords stated, among other things, both with regard to the repatriated Equipage Master Starring in particular and in relation to all servants in general against whom any complaints from the burghers had been lodged: "We must particularly express our displeasure over the discharge granted to the aforementioned Equipage Master Starring at a time when the accusation brought against him still constituted an object under deliberation and the outcome thereof was still uncertain. You have thus, through this discharge, deprived us of the power to employ such means as could otherwise have been implemented in case the aforementioned Equipage Master were found guilty. We recommend to you, etc., while we furthermore most earnestly order you not to grant discharge to any Company servants whose accusations and justifications have not yet been examined and settled by us, but, upon their making a request to that effect, to refer them to us." 4. In contravention of the very explicit orders of the Lords Majors, contained in their missives dated 23 October and 3 December 1789, to farm out the tacit revenues hitherto enjoyed by the respective Fiscals and to collect the profits arising therefrom for the Company, those revenues were continuously levied and collected by him, the Fiscal, by way of import and export duties. This article also being included among the points of grievance appearing from the frequently mentioned document of the Council of War, the attention of the High Masters concerning this could be aroused anew, resulting in a new order to compel compensation to the Company, as Lord of the Land, for all that which he, Mr. van Lynden, has enjoyed for so long; which compensation—Mr. van Lynden having withdrawn himself from this Colony and from under the power of his masters with the obtained consent of the Government—would notoriously also be demanded from the undersigned and the other members of the Council, who initially acquiesced in the further collection of those revenues by him, the Fiscal, and would now also have voted for his departure, and would also have to be paid. was signed: W: F: van Rede van Oudtshoorn In the margin: handed over on 22 May 1791. The undersigned, having reserved the right to lodge such objections as he should deem necessary to bring forward, both against the declaration made by the Independent Fiscal, Mr. van Lynden, on the occasion of the petition of the local burgher military council submitted to this Meeting on 13 May, whereby His Honour makes known his intention to undertake the voyage to the Netherlands on account of the vehement accusations brought against His Honour in that petition, in order to go and account for himself in person concerning those allegations before the High and Mighty Lords and Masters; as also against an opinion brought in by His Honour on the following 24th, regarding a passage contained in the highly respected missive of Their Right Honourable High Mightinesses the Lords Seventeen of 10 November 1695. He will first make some remarks on this rambling opinion, in order subsequently to confine himself to the declaration itself. And he cannot then, in the first place, leave untouched the singular explanation which Mr. van Lynden wishes to give to the so very clear words appearing in that revered letter. It is indeed so far from the case that the words to send away and to allow to depart should be equivalent terms, or of one and the same meaning, that anyone who can merely read, or knows how to attach a sound meaning to words, is at once, at least in these parts, 803. parts, led to understand that the word to send away can only mean to send someone up to Batavia for some dereliction of duty or other, whereas on the contrary the words to allow to depart clearly encompass permitting to depart upon his request, with the consent of the Government, or else not permitting to depart, preventing, hindering them from retiring unobserved. Equally absurd does it appear to the undersigned to be the opinion of Mr. van Lynden that the words to Batavia or elsewhere should be understood as to Batavia, or some other place in the Indies, and not to the Fatherland. The contrary thereof is indeed most clearly shown by the letter itself, for the Lords and Masters, after having informed this administration that they had appointed Mr. Elzevier as Secunde in this Government, and Mr. Blesius as Independent Fiscal, let follow thereupon: "And we furthermore understand that those whom we have already appointed, and shall hereafter come to appoint, in this and that function, Your Honours shall not be empowered to send away, or to allow to depart, from there, whether to Batavia or elsewhere, unless with our special mandate and orders." Which words thus indisputably indicate that those officials may neither be sent away, nor may they depart, either to Batavia or to whatever place, without such high order. That order was given to the Governor and Council, and they are therefore very well obliged to take care that it is not acted against. And however much the Instructions for the Fiscal may be of very recent date, it is indisputable that positive orders of the Lords and Masters retain their force until they are explicitly revoked, which Mr. van Lynden will not be able to show to have occurred concerning the above-mentioned order, and the same therefore remains in force regarding His Honour, for the very same reason which His Honour adduces, namely because his Instructions do not speak of it. And this brings the undersigned to the second point, namely the declaration of Mr. van Lynden that he intends to depart for the Fatherland, with the addition that, pursuant to his aforementioned Instructions, he had committed the observation of his office to his adjunct Truter, believing himself to be qualified to do so by the 38th and 39th Articles of those Instructions. However, when one calmly examines those Articles, one will soon discover that the conclusions drawn therefrom prove too much. The same, however, 38th Article: when the Independent Fiscal shall deem it necessary or expedient for the performance of what belongs to his duty to travel to one place or another, there shall have to be provided for him that which he requires for making that journey according to the order, custom, and constitution.

tion of the Country will require, article 39. And the Independent Fiscal shall have to make provisions so that during his absence (described in the preceding article) the administration of Justice, no less than any other matters of importance under his purview, shall suffer any detriment; by which we know that these articles speak only of such absence and journeying here within the Country as the circumstances of affairs might make necessary at times, in order, by means of inquiries taken on the spot, to be able the better to inform himself, for which purpose he must, pursuant to the order, customs, and Constitution of the Country, be enabled and provided with what is necessary thereto, without this by any possibility being applicable to the journey to the Fatherland now intended. 5. The Independent Fiscal of this Government is subordinate only to the Illustrious Assembly of Seventeen, and accountable to their Honorable High Mightinesses for the actions concerning his function. But for that reason, pursuant to the 2nd Article of his Instructions, if the Fiscal should overstep his bounds, or in any manner commit acts that might be blameworthy or punishable, the inquiries made regarding them, and the documents serving thereto, must be copied and sent by the Governor and Council, or if the nature of the matter absolutely should require it, by the Governor alone, to the Assembly of Seventeen, as well as to the Governor-General and Council, without, as the undersigned believes, pursuant to the above-cited letter of 10 November 1695, the Fiscal being permitted to follow the same without prior orders. And indeed with the highest right, since to the High Honorable Lords Directors, having no judicature in the Republic, the right does not appertain to be able to try their Servants who have made themselves guilty of one crime or another in their possessions, upon their arrival in the Fatherland, and to punish them according to the findings of the case. And that this is indeed the essential reason for that order can indisputably be drawn from the letter of 9 August 1782 written by the most aforementioned Lords 17 to this government with regard to the discharge granted to the Master of the Equipage Staring, and permission to proceed to Europe, wherein their High Mightinesses, after showing their particular displeasure at these measures of the Government and deviation from established orders of the Company, also add that through this discharge to the said Master of the Equipage their Honorable High Mightinesses were deprived of the ability to employ such means as their High Mightinesses, in the event that that servant were found guilty of what was charged against him from here, would have been able to put into effect, namely if he had remained here; and the Governor and Council are therefore in the most serious manner ordered not to grant discharge or permission to go to the Fatherland to any servants of the Company whose accusations and defenses have not yet been examined and settled by their Honorable High Mightinesses (by lawful deduction also all such servants who find themselves in a similar case), but when they make their request for that purpose to refer them to the aforementioned Lords Directors. Those same reasons also apply in the case in which the Lord van Lijnden finds himself, who, being very heavily accused, yet not permitted to be judged here, the documents of these accusations must be sent over, in order to await thereon the revered judgment of the High Rulers. And it is for these reasons and motives that the undersigned finds himself obligated to advise that, if the Lord Independent Fiscal van Lijnden should happen to make a request to be allowed to sail over to the Fatherland, such must be refused his Honor as being contrary to the orders of the High Government; and in the event that the Honorable Lord Governor and Council should be of the opposite opinion, and should come to give permission for that departure, then the undersigned declares that he must protest most strongly against it, as he does by these presents; leaving the responsibility for it to those who shall have concurred therein. Preservation of peace and good order, the promotion of the Company's interests, the maintenance of the power and authority of the Government, and a strict observance of the orders of its Lords and Masters. Much as one might assume that these ends and objectives in any case harmonize and outwardly appear to require the same handling, the undersigned nevertheless encounters therein at present a contradiction which, however much he would otherwise for his own part, in this case, do that which can give him peace of conscience, nonetheless causes him concern regarding the perception of his conduct in this matter by his highest-mentioned, respected Lords and Masters. Viewing the petitioners of the request in their capacity, he must fully acknowledge that it is in no way fitting or competent for them to interfere with the specific exercises of the Fiscal's office, and that it also presents a dangerous prospect when officers of the Burgher militia arrogate to themselves such freedom without qualification; and he would then also readily advise returning the request to them with indignation, under a serious recommendation to carefully refrain in the future from such steps, which serve as a bad example for their lesser fellow citizens. But in doing so, one would lack the information that the Governor and Council are obliged to supply to our High Rulers. In doing so, one would give the petitioners, who demonstrate a jealousy against the conduct of the said Lord Fiscal and in the request make it sufficiently known that they will not remain quiet on this matter, occasion for commotions which, because of their terrible consequences, must be carefully prevented and averted. Since the decision of this matter entirely depends on the highly wise insight and the venerated dispositions of the highest-mentioned Lords Superiors, to whom alone the Lord Independent Fiscal is accountable regarding his actions; since, however, while one will have to await their orders and writings in this regard, many far-reaching disorders and confusions in the administration of Justice are to be feared if the Lord Independent Fiscal continues to exercise that office and people were to stubbornly resist him, and in such case, unless for the preservation of good order and of Justice as well as the maintenance of this office violent means, even more dangerous than the said disorders and confusions, were undertaken; since it furthermore falls outside the power of this government to suspend the said Lord Independent Fiscal in his functions pending this case in order to prevent this, if it were possible, as the only means which would otherwise appear capable of preventing those disorders, confusions, and further consequences; and the Lord Independent Fiscal does not appear disposed to refrain from the exercise of that office in the meantime out of his own accord, though an act would also be committed hereby for which no authorization has been granted to His Honour; since finally one can still expect no certainty against the extremes that could arise from such a vehement embitterment against His Honour, to the detriment of the dignity of that office, which would not entirely cease; the undersigned, in order to prevent and avert all this, could devise no more capable means than that which the Lord Independent Fiscal himself suggests through His Honour's aforementioned declaration. Yet regarding this expedient, he fears that, by consenting or acquiescing to this, a course of action would be pursued contrary to the orders of the highest-mentioned Lords and Masters, however much their Right Honourable Worships have pleased on another occasion to approve that in occurring cases of importance, when prudence might so advise, that which necessity demands is done provisionally; adding thereto, however, that the positive provision must be left to them. The orders militating against such a departure consist of this: 1st. That although the Lord Independent Fiscal is not bound to any term by his instructions, yet he is also not excused therefrom by the same instructions, and in the regulations concerning this no provision is to be found either, nevertheless, according to the customary style regarding all Servants, the Independent Fiscal in this Government has always been considered among those officials who have a term of Ten Years. 2nd. That even if this term were not applicable to the said office, indeed even if such a term had expired, the writ of the highest-mentioned Lords Superiors dated 10th November 1695 nevertheless expressly forbids those whom their Right Honourables

Noble, Right Honorable Sirs have appointed in this or any function, to send or allow to depart from here to Batavia or elsewhere, unless with their highest special command or order. III. That when the Government here in the year 1782 granted the Equipagiemeester Staring discharge and permission to repatriate, the Most Honorable Masters expressed their highest displeasure thereover by missive of 9 August 1782, because this had occurred at a time when the accusation brought against the aforementioned Staring still formed an object of Their Noble, Right Honorable Sirs' deliberation and the outcome thereof was still uncertain, adding that through this discharge one had deprived them of the ability to employ such measures as might otherwise have been put into effect concerning him in case of guilt. All of which taken together sufficiently demonstrates that it is by no means free to this ministry to let the Independent Fiscal depart, much less to grant his Honor permission for it, at a point in time when the Most Honorable Masters are to be informed of the accusations brought against his Honor, and one must await their highest orders in the matter. It is true that the 38th article of the Independent Fiscal's Instructions entails that whenever he shall judge it necessary or expedient for the performance of what pertains to his office to travel to one place or another, there shall be provided to him what he will need for making that journey according to the order, customs, and constitution of the country; but that this cannot be applied further than specifically to the jurisdiction of that same office admits of no contradiction. And although the aforementioned Independent Fiscal declares that he must of absolute necessity make the journey to the fatherland in order to comply with the first article of the Instructions and to account to the Most Honorable Masters themselves for the conduct of his Honor's office with regard to the points contained in the request, it nevertheless remains beyond dispute that in such case the remark of Their Noble, Right Honorable Sirs regarding the departure and discharge of the Equipagiemeester Staring, adduced herebefore, is applicable to his Honor. The undersigned readily acknowledges further his scruple and concern about doing anything in this matter that he might expect to conflict with the intention and pleasure of his Masters: for if he considers his duty for the preservation of peace and good order in this colony—as fully conforming with the Company's essential interests and with the welfare of the inhabitants, a duty of such importance and weight that the observance of all other duties and in particular of that which calls him to a strict observance of the commands of his Masters depends upon it—he would judge that the departure of the Independent Fiscal, being in the present case the only remaining means to preserve peace and good order and to prevent all extremities, may not be hindered, subject to the provision of proper security. But if he considers on the other hand that if the Independent Fiscal is found guilty by the Most Honorable Masters, this departure might very well be an obstacle to Their Noble, Right Honorable Sirs in such measures as they might judge necessary and expedient, then this alone is enough to bring him back from his aforesaid opinion; then he neither can nor may grant his consent in any way to such a departure, nor also acquiesce in the same; in which opinion he therefore declares he must persist. Furthermore, concerning the aforementioned request, he is of the opinion that in opposition thereto it ought to be granted that, in so far as it concerns the request for sending the same petition and the documents attached thereto both to the Noble, Right Honorable Lords Seventeen and to Their High Noble Indias Government, action and proceedings shall be taken therein completely in conformity with this request as agreeing with the Company's orders; but that regarding what was requested prior to that concerning the person of the Independent Fiscal, this Government, and with them also the petitioners, will have to await what the Most Honorable Masters, upon whom alone the Independent Fiscal depends, shall be pleased to deem fit and to dispose thereon and in all respects; and furthermore that the decision on the request for relief against the proceedings of an Independent Fiscal against burgher officers acting in their post shall remain suspended until the trial in a similar case against Ensign Nelson pending before the Court of Justice here shall have been terminated, in order to be able to discern from the trial and the documents to what extent this request is based on any ground or equity, and to proceed therein at that time as the matter and circumstances shall require. When the undersigned dispenser, upon the reading of the document which Fiscal van Lynden submitted in the recently held meeting of the 24th of May under the title of advice regarding the home country missive dated 9 November 1695, reserved to himself the right to have a counter-entry made against it, he intended to lift the veil with which the aforesaid writing is covered and to submit it in its true form to the further judgment of the council. However, having seen that returning to their natural order and sense those orders that, with certain intentions, have been torn from their context and connection and presented in a false light, would entangle him, the undersigned, in a pen-fight with Mr. van Lynden, in which he ultimately, not being skilled in the war of lawyers, would have to give up after having thus uselessly wasted his precious time; That even if the undersigned should succeed in presenting the absurd and untenable nature of the allegations and reasonings of the Fiscal to the other council members so convincingly that it would merely be a matter of feeling and touching to become as convinced of it as he is himself imbued with it, this nevertheless could bring about no change in the measures as long as that executive power of the commander-in-chief and that unlimited independence of the Fiscal, which combined by their preponderance have sometimes laid down the law to the council, shall reside with the present Governor van de Graaff and Fiscal van Lynden; And that, moreover, there shall and cannot escape the penetrating eye and judgment of the lords and masters all those reasonings and incorrect conclusions derived therefrom, with which one has sought to intimidate the council members, to captivate them, and along that path to persuade them to consent to, or at least to acquiesce in, steps which they are bound to oppose and prevent with all their might; That the issuing of an advice in one's own affair by the person who does so instead of retiring from the meeting when the subject of deliberations concerns his person, assumes an intent to insult or dupe those who must judge him, since from that pre-advising one can infer nothing other than that one assumes no sufficient understanding and competence in those who are to deliberate to be able to render a decision on the point in question according to their own light and insight, or that one seeks to give such a turn to orders and commands that are susceptible to false interpretations, that if these orders are misunderstood, the proposer can thereby gain an advantage for himself while casting the responsibility onto others; He has subsequently thought it best to abandon that intention, in order to be able to apply his precious moments better to the advancement of the Company's interests, and not even to give any occasion to be further hindered therein; Yet so that he does not wish to leave unremarked: That, as a confirmation of this, it is noteworthy that while Mr. van Lynden takes the mutilation of such an old order of a few lines of writing as the subject of a memorandum in order to build his conclusions upon it and to fill several pages with it, he does not even mention, but entirely passes over in silence, the further order of the Directors of the 9th of August 1782, issued on the occasion of the repatriation of Mr. Staring and cited verbatim by the undersigned in his advice of the 24th of May, an order, however, which is plain, clear, very positive, and in all respects applicable to the Fiscal in his present circumstances and binding upon the government, and by no means ignored by the Fiscal, since it was cited by his Honour himself in the aforesaid session of the 24th of May; While, for the rest, persisting in his stance submitted in the aforesaid meeting of the 24th of May, he is now further of the opinion: That since the Fiscal may not depart from this colony without having obtained permission thereto from Europe, one can and must employ the required measures to keep him here; That to that end, among other means, the executive power resting with the Governor must also be required, and his Honour be commissioned to use the same to prevent the flight of the Fiscal; That in case the Governor unexpectedly should not defer to this, but on the contrary should lend a helping hand to the aforesaid Fiscal in his unauthorized undertaking upon his made claim, Then a protest against this ought to be made by the council, as the undersigned, the case existing, already provisionally does in the most solemn manner hereby; And that then also Governor van de Graaff ought to be held responsible, as the undersigned hereby in the absolute sense holds him accountable.

The undersigned Independent Fiscal of this Government, having heard read the protests of some honorable members against his absence arranged from here, shall, without entering into a tedious debate over the terms and expressions appearing in some of them, which are as grievous as they are offensive to him, merely remark in a few words and with all moderation: 1st That the alleged case of the year 1695 must indeed differ by the width of heaven from his own, since it appears as though that Fiscal of that time had been sent from here to India by the Government, or had been ordered to depart, or had left for good for elsewhere with a quiet drum, as they say, and without settling his affairs or his post in any way, and the Council here had provisionally appointed a certain Blesius as Fiscal in his place. Indeed, Copy 818 Indeed, this latter could not otherwise have been permitted to happen, since the Instructions of the Independent Fiscal, Article 35, dictate in plain words that upon the departure or decease of the Independent Fiscal, the adjunct fiscal shall provisionally act in his place. If the Independent Fiscal acts wrongly in this, and thereby does anything blameworthy or punishable, he is indeed answerable for it solely to those upon whom alone he depends, and whom it is his intention to address. 4th That although it may well be true that somewhere in the Company's orders mention is made of a certain obligation for the Company's servants, one nevertheless nowhere finds, as far as the undersigned knows, that the Independent Fiscal is mentioned by name. Since he is the only one of all the Company's servants who depends directly and solely on the Assembly of the 17, he must by all means, should that order also apply to him, be found distinctly noted therein; while also his instructions, as the sole law and guideline by which he must regulate himself in his official affairs, prescribe nothing thereof. will address. 5th That the same applies to the demanding of bail, since indeed this is required of no Company servant anywhere, except only from those who have Company funds or goods under their administration, or who directly resign their post. And as the Independent Fiscal holds no such administration, nor does he, as has already been stated repeatedly, resign his post, and moreover this is nowhere required nominally of him, nor is any mention made of it again in his instructions, even if he had already requested and obtained his discharge, this can indeed be of just as little application to him as the former. Against which nothing can be contributed to the matter, neither that which the former Independent Fiscal Boers here saw fit to do and put into effect of his own accord, because surely these actions of his, according to the orders of the Lords Seventeen contained in his instructions, cannot serve as laws for the undersigned; besides the fact that this gentleman had become involved in a legal proceeding with Jan Smit Jurriaansz, not as Fiscal, but as a private individual, which upon his departure was not yet concluded; nor even if one considers the case of the late Master of the Equipage Staring, who indeed held Company equipage goods under administration. All the more so because both of these gentlemen had requested their formal discharge from their posts. 6th That from all that has been stated here before, by legitimate reasoning and consequence, it must stand firm that to oppose the undersigned in the execution of his office and post, that is, to place any obstacles in this his intention which he, by virtue of his office and duty, believes he must carry out, can be called nothing other than to run counter to the Lords Superiors and their orders, and knowingly and willingly to resist the very same. 7th That regarding the establishment of a customs house out of the income of the Independent Fiscal, which he has enjoyed from time immemorial, openly before the eyes of the entire world, and even with the full and legal knowledge of his Lords and Masters, which have even been partly allocated to him nominally and distinctly by the very same, upon the enjoyment of which the undersigned was appointed, and which constitute his only livelihood here, it was indeed decided by unanimous resolution of this table to suspend the same, until the considerations and the interests of the undersigned regarding this matter, together with the considerable and irreparable prejudice that he would come to suffer thereby (since he was certainly not sent from here to cause him and his family to perish from hunger and destitution), had been brought to the attention of his gracious Lords and Masters, and their further pleasure had been received thereon; while this point also provides a principal reason that has moved the undersigned to make his voyage to the Fatherland, and consequently no alteration can or may now be made therein either, except by unanimous votes, especially since the current introduction of such a customs house could be extremely dangerous for the peace of the colony, at a time in which the minds appear to be by no means pacified, and in which one seems to have called upon the Burgher War Council, and has managed to bring them to take such far-reaching steps. 8th That the undersigned is therefore of the opinion that the safest and surest course, both for the Company and for the preservation of peace for this colony, would be, as soon as he has departed from here, to have the revenues or percentages of the ships then arriving provisionally consigned into the Company treasury at the disposal of the Lords and Masters against a proper receipt from the Cashier, collected then in the usual and due manner by the interim Fiscal I. With the ship Beverwijk, which left this roadstead on the 28th of June last, Noble, Stern, Greatly Respected, Highly Wise, Provident, and Very Generous Gentlemen, No. 1 832 we last had the honor to consign our humble letters to Your Noble and Greatly Respected; meanwhile we have had the bearer of this, the ship de Phanecier from Batavia, projected for Your Noble and Greatly Respected Chamber, made ready to sail again, wherefore we let this serve solely to accompany the same, while respectfully notifying that Your Chamber's ship Christophorus Columbus received its dispatches for the Ceylon Government today. Mr. Montegnij, former governor of Sandernagor, having recently had the misfortune along this east coast, on the Genoese ship the Edward returning from Bengal, to suffer shipwreck with the family who were with him, has urgently requested us by petition to sail over to the Netherlands with this vessel, and, on account of his unfortunate fate, to let him suffice with the payment of the ordinary transport 833 and board money; so have we, subject to your favorable interpretation, consented to his request, and granted him, along with his wife and two free slaves, passage to the Netherlands on this vessel. We have likewise permitted Charles Herculis de Capol and Hendrik August Heintzman, former officers in the Regiment of Wiertemberg, upon their requests made in that regard, to repatriate with the bearer of this, of which we hereby respectfully inform Your Noble and Greatly Respected. In February 1790 my predecessor had the misfortune to break his leg, which I cured for his honor. About three weeks after his recovery he was, by a severe fever after being bedridden for more than 14 days, on the 15 May 1790 snatched away from the temporal world. After whose death I immediately applied again as before to fill this post. The Honorable Respectable Gentlemen of the Council all testified, following the example for many years past, upon the arrival of the favorable recommendation of their High Mightinesses, and knowing nothing against my person, that they would sign for no one but me.
