To the Right Honorable, Greatly Venerable Lords, I hope that my letters, which I had the honor of sending to Your Honors by the ship Beverwijk and the packet boat De Vlijt, have arrived safely, and that Your Honors, having seen the reasons why it was impossible for me to comply with Your Honors' venerated orders within the specified time, will not have taken this amiss of me. Having recently obtained most of the documents which had to be collected with great difficulty, owing to the great confusion that prevailed at the Secretariat, I hasten to send to Your Honors the following vindication and elucidations. I shall have the honor of beginning with two points concerning me in Your Honors' letter of 3 December 1789, having thought that these would have been provided to Your Honors on the part of the government, but having now understood that this was not done. The first point concerns the purchase of 79,400 pieces of gunflints in the month of March 1787, allegedly made by me, whereas 20,000 pieces had already been brought in on 22 November 1786 by the ship De Vrouw Wijnanda Lubertz. The second point concerns a resolution taken here in the Council, whereby the Master of the Equipage was ordered to submit a written report to the head of the Militia upon the arrival of ships. On the first point, I shall have the honor of sending to Your Honors under No. 1 what the trade bookkeeper Van Eerden has stated to me concerning this matter, since that purchase took place a considerable time ago, he having previously refused me a copy of the declaration which he had submitted to the Governor regarding this. That purchase having been ordered directly by the Governor when there were no longer any gunflints, and the warrant for payment having been drawn up later than that purchase, I questioned Sergeant Scheijfsel, who at that time was performing the duties of adjutant and who made that purchase by order of the Governor, and who showed me the invoices and receipts for it (a copy of which I have the honor of enclosing to Your Honors under No. 2), and this agreed with the bookkeeper Van Eerden's statement. Such items are certainly exorbitantly and arbitrarily expensive here, especially when it is known that there is a shortage. Thus, Your Honors see that I neither ordered that purchase nor saw the money, but that it was necessary to provide for such an indispensable item (of which such a large quantity was supplied annually by warrant, both for the various posts and for the Regiment of Württemberg, as Your Honors will see from the enclosed Nos. 3 and 4). I shall now proceed to the second point, regarding the Resolution concerning the report of the Master of the Equipage to the head of the Militia, and have the honor to elucidate to Your Honors that such has been the order here from old times, and had also always been done by the various Masters of the Equipage to my predecessors and likewise to me, until Captain Dumenie, having been appointed Master of the Equipage, refused to do so. as can be seen in my advices: I therefore delivered on the 13th of February following my [illegible] of a separate Corps, from which people later wished to draw so many absurd consequences: and I gave those two Captains our written orders, of which I have the honor to enclose a short extract regarding the monthly payment of the military, No 8, in order to have no disputes or two separate administrations, since the service here, since the arrival of the new [illegible] I have inquired in vain at that Office. I shall now proceed further to the accountability demanded head for head from the members of the Council in Your Right Honorable Highnesses' letter of the 28th [illegible] 1790, and take the liberty of Your Right Honorable Highnesses to bring in person, so that I can see that everything goes right, to request beforehand to take into consideration, that as it will clearly appear from the following documents, that I in my own post as head of His Honorable Company's militia, the soldier is well treated and, just as in Europe, properly kept in clothes. However, this did not suit Captain Sandolroy's plans, as Your Right Honorable Highnesses from his new administration, which was later introduced against my will and wishes by High Authority, the welfare of their service (with the most zealous intention I could not execute), Your Right Honorable Highnesses will kindly please relieve me of and from his handwritten monthly lists and further complaints against him, which I have the honor to send hereunto to Your Right Honorable Highnesses under No 9, will appear more clearly. I then became in the month of November 1788 such matters that depended on other posts and of which I had not the least knowledge or communication, also because the repatriated Lord Governor declared in the Council to take all this upon his own accountability, very sick, and use was made of this; and those recruits now wanted an increase of pay or to be sent to Batavia, as, in order not to bore Your Right Honorable Highnesses with repetitions, can be seen clearly connected in my answer to thus presenting himself as the one who managed those matters alone and thought he ought to manage them, and I, being in uncertainty, also labored under the idea that the Lord Governor had a separate instruction the fourth letter of a Committee of Inquiry appointed by the Lord Governor, and whose entire correspondence I have the honor to send hereunto to Your Right Honorable Highnesses under No 10; and carte blanche; as the same also later, in full Council on the 28th of February 1789, when I tried to keep the Lord Governor from the repatriated step that could be taken in the military (as has only appeared too since nothing can make Your Right Honorable Highnesses see the matters and the handling thereof more clearly. This therefore remained quiet again until the month of January 1789, when the letters from Captain Sandolroy were produced in the Council by the Lord Governor, without my knowledge, clearly afterwards, through all the disorders that have occurred here in the military since, and that the military must now be satisfied with even less), since without Your Right Honorable Highnesses' orders I would not consent to any increase of pay, and the Council would not enter into any increase of pay without declared to me that he was Governor and knew what he had to do, that he would give me orders and I only had to obey, that he alone was accountable for everything; whereas I nevertheless lodged my reasonable protests my advice and proposal: as appears from the letter of the Lord Governor and my answer to the same, No 11. I then received hereupon on the 31st of January through the adjutant the message No 12 and gave the enclosed answer to it, upon which I received and answered the last-mentioned letter; without having been able to lay eyes, up to now, on those documents of which the Lord Governor speaks in that letter: after which the payday of the month of February occurred, and then through the conduct of Captain Sandolroy that increase was forced, as has clearly appeared afterwards; wherefore against it, and called all the members of the Council upon their honor and oath as witnesses; although everywhere in the Resolutions, as much as possible, the head of the militia has been made to appear as if he had great influence or authority, whereas in fact that influence or authority was completely nil; and as will clearly appear from the following documents, I have furthermore investigated the points on which Your Right Honorable Highnesses, in the aforementioned letter, demanded accountability and elucidation, as far as I I sent Major de Lille to the Lord Governor concerning that action of Captain Sandolroy, as appears from the reports attached hereto, No 13. I shall then have the honour to give Your Noble Great Mightinesses, as briefly as possible, an outline of those matters; and begin by reporting that when Your Honours' orders arrived here concerning some Captains of the Regiment Meuron, that they (under certain restrictions) could be placed with the Dutch garrison, the national officers objected to this, and that then, to avoid all discord, the two Captains Sandolroy and Bonstetten, who remained here out of the five, were placed with the so-called nursery or recruits, whom Your Noble Great Mightinesses had ordered to acclimatise here for the Indies, in the month of February 1788, each as Captain of a company, just as they had been with the Regiment Meuron; as appears from the attached deed of appointment No. 7, and thus by no means as chief or head. Sandolroy acted in that matter afterwards, while a well-serving and well-disciplined battalion was deprived of so many men for years and months on end, as will be shown to Your Noble Great-Aughtinesses in abundance from the copy of the letter from Lieut. Col. Hamell and the declaration of the Major No. 24, besides the harmful example that this entire treatment of affairs has set here. Secondly, if Your Noble Great-Aughtinesses please cast your eyes upon pages 16, 17, 18, and 19 of this book, Your Noble Great-Aughtinesses will see a jump of resolutions from 13 March 1789 all at once to 9 July 1790, because having understood that a certain Wernsdorf, a burgher saddler at the [illegible], whose goods had been sold by the court, and who several years previously had had to take his discharge from the company of Major de Lille, for reasons to be seen more closely in Lieut. Col. Hamell's letter No. 25, had been appointed without my knowledge as sergeant among the recruits (in order to make him an officer later), I asked by whom he had been appointed, and they then wrote the last paragraphs into this strange extract resolution book. my further considerations with document No. 19 in Council, and had this been able to obtain a copy of the protest, and had only once heard read everything will further appear from this extract resolution book, but I must inform Your Honours beforehand that this is a separate book (neatly bound) and sent to the head of the militia from the secretariat, and in which, for good reasons, not everything has been entered as it ought to have been, as appears first of all from the resolution of 3 April 1789, page 3, taken upon a memorial from the Governor, No. 23, which I laid eyes upon for the first time only a few days ago; and the reading of which surprised me not a little, the more so because I find myself held accountable therein to His Most Serene Highness the Prince of Orange, Hereditary Stadtholder, Captain-General of the Union, and furthermore wherever and in whatever place each of us is accountable regarding our conduct concerning the respective posts entrusted to us, etc., as Your Honours will maintain finding in that memorial, and without my having known this, as one certainly could not guess this from that extract resolution on page 3. I shall therefore have the honour of rendering my account briefly here: firstly by my two opinions of 6 and 13 February 1789, Nos. 14 and 19; secondly by the monthly lists written by Captain Sandol's own hand, the duty roster of Adjutant Bleumer; and lastly by everything that has happened since in that new establishment, under No. 9; from all of which it will clearly appear what my motives were, and how little service the Noble Company has had from that nursery or recruit corps (notwithstanding all that fuss in that singular memorial), and how shamefully Captain Sandolroy acted in that matter afterwards, while a well-serving and well-disciplined battalion was deprived of so many men for years and months on end, as will be more than evident to Your Honours from the letter of Lieutenant-Colonel Hamell and the declaration of the Major, No. 24, besides the harmful example that this entire handling of affairs has given here. Secondly, if Your Honours would be pleased to cast your eyes upon pages 16, 17, 18, and 19 of this book, Your Honours will see a transition of resolutions from 13 March 1789 suddenly to 9 July 1790; because, having understood that a certain Wernsdorf, a burgher saddler at the Cape, whose goods had been sold by the court of justice, and who several years previously had had to take his discharge from the company of Major de Lille, for reasons to be seen further in Lieutenant-Colonel Hamell's letter No. 25, had been appointed as sergeant among the recruits (in order to make him an officer later) without my knowledge, I asked by whom he had been appointed, and they then wrote the last paragraphs in this strange extract resolution book. I shall now return to the thread of the case in question and have the honour to inform Your Honours further that on 5 April following, I received, namely after the first session of that commission of inquiry, thus two months after my opinion, and which commission, as Your Honours will easily see, must now be considered needless, since they left Captain Sandol master of everything, had granted him an increase in pay, etc., as appears from the resolution on page 3, the first letter from the sworn clerk Goets (who acted as secretary thereto in the name of that commission), and I thereupon sent the books; and Your Honours will see from the aforementioned correspondence No. 10 that I, although not obliged to do so, entered the following protest No. 21 against me (thus a month after my first opinion), against which I submitted the two notes No. 22 successively, as I had not yet received the desired effect, for the day after that I received a commission from the Council, and as I could recuse that commission, since the opinion of the head of the book, page 13, shows that the Governor on 6 March following, as shown by the declaration No. 20, nevertheless took that matter, without my being able to state the exact reason for it, though I could not suppose otherwise than that it was caused by the arrival of the Independent Fiscal, into a completely different turn; as can be seen from what occurred concerning this matter in Council on 28 February 1789, mentioned herebefore, and from the resolution of 24 February in the extract resolution book; although from my letter in reply to the letter of the Governor, and the reports of Major de Lille, all under No. 26, it is clearly evident that already in the month of March previously I had resolved all these chicaneries, and that at that time no complaints had been or could be brought forward, although I asked for them in my letter; and that nevertheless that so-called investigation protocol, No. 27, was drawn up without my knowledge at that time, and indeed by Captain Sandolfoy and Binder, the quartermaster of the Regiment of Württemberg, and was produced only on 23 June following, as was also added thereto in the original document at the top by the Governor's own hand. thus even supposing that such had been true, no crime to hold someone under arrest for about two and a half years without form of trial; whereas I have known this Sergeant Kontse for many years and still, besides the whole battalion, acknowledge him to be one of the most distinguished, capable, and faithful non-commissioned officers with whom I have ever served; and this was also the reason that I placed him with the pupillen, and the Governor also wished to advance him to adjutant, as appears from the letter cited hereinbefore No 11. Having now complied with Your Right Honourable and Most Respected Orders, I shall await with the greatest confidence that satisfaction which is due to Justice, to the service, and to my person. I could now add several other matters and grievances here, but I thought it best to save them until such time as the Commission of Your Right Honourable and Most Respected Lordships, which has been announced to us, shall have arrived here, because those gentlemen will then be able to investigate everything on the spot, and then supply Your Right Honourable and Most Respected Lordships with those documents. I shall nevertheless take the liberty to report to Your Right Honourable and Most Respected Lordships concerning a court-martial in that Government, which was introduced without my communication, except that during the presence of the Commission of Their High Mightinesses, I advised that this court-martial was highly necessary here, as it indeed is, properly defined. But I have always also been of the opinion of Your Right Honourable and Most Respected Lordships that in prescribed cases, according to the laws, one must be able to appeal to a higher court, and in that court-martial judgment may only be passed on purely military offences which no one other than a military man can commit, while the Independent Fiscal for the time being can demand inspection of all documents; and extraordinary cases, in which a military man was involved with a burgher or alone, ought to be left to the Ordinary Judge here, provided that for that time and for that case alone, two captains or subaltern officers were co-opted into the Council of Justice, to sit alongside the other members in their place and rank, to advise, judge, and see the sentence executed, whereby much trouble and jealousy would be cleared out of the way, as I, who have sat in the Justice here for five years, am assured of through experience in this colony. And it is completely unnecessary to allocate the expenses of a captain to an auditor, since if Your Right Honourable and Most Respected Lordships consider an auditor directly necessary here, that of ensign or lieutenant would suffice for him; or else that post could be attended to by the adjutant here, to whom, for the days that he attended to cases, a certain daily allowance could be allocated for his extraordinary trouble. This would save expenses and achieve the same desired end. I shall then finally add here that it is necessary for the service of the Honourable Company that I must request Your Right Honourable and Most Respected Lordships to be pleased to give a positive order that I may obtain at once from the offices the necessary information regarding matters concerning my post, which I might demand, and properly signed and dated, as they currently absolutely refuse to do, and that even the books concerning the soldiers or their pay, or charges, or the write-offs or charges of uniforms or uniform materials, or the armoury, both from the Pay Office and the Trade Office, at those times that they are not in use, must be delivered under receipt for my examination and speculation, as I have suffered the greatest vexations and delays in this regard, to the detriment of the service, and can never clearly know how matters stand, whereas an accounting can nevertheless be demanded of me.
