have required, against a monetary equivalent, as well as to be able to send Your Right Noble and Most Honorable Worships, as soon as possible, the required statement of all those provisions with the monetary equivalent substituted therefor as aforementioned, and likewise to be able to supply our considerations as to what extent the same provisions with regard to the common soldiers and sailors could also be replaced by some allowance in money; we have demanded of the undersigned storekeeper and the trade carrier Casparus van Eerten to draw up a price current according to which the buyout value of all local products in which any provisions take place may be calculated now and henceforth upon further approval of Your Right Noble and Most Honorable Worships, together with a general and specific note of all provisions, both in cash and goods, that the Honorable Company's servants have lawfully enjoyed, of European and Indian as well as domestic goods, and how much both the first-mentioned articles, which must be imported from abroad, amount to with 25 percent on money, and the others at cost price; and also from the undersigned Colonel Gordon, the Master of Equipage Cornelisz, and the Regents which respectfully accompany this; Regents of the Hospital, for each to examine in his respective sphere and subsequently inform us whether and to what extent the said provisions to the common soldiers, sailors, and the Hospital might also be replaced by some allowance in money. The aforementioned commissioners having duly complied with what was demanded of them, by the report accompanying this in authentic copy and the lists attached thereto, we shall cause the provisions made hitherto to cease at the end of this month, and in their stead cause the stated equivalent to be paid in money, in order to continue therewith monthly pursuant to Your Right Noble and Most Honorable Worships' revered orders; and we add to that report three considerations submitted to us by the Regents of the Hospital, the undersigned Colonel and Chief of the Honorable Company's militia here, and the Master of Equipage Cornelisz; from which Your Right Noble and Most Honorable Worships, if you please, will be able to see the impossibility of replacing those provisions to the common soldiers and sailors with money, on which account we shall therefore provisionally cause the same to continue until we shall be honored with further orders on this matter from Your Right Noble and Most Honorable Worships. Section 3. the requisitions shall consequently be reduced, and of the provisions which will still have to be made, accurate records shall be kept. In order to comply with Your Right Noble and Most Honorable Worships' order concerning the requisitions, we have instructed the respective administrators to pay all possible attention that the homeland and Indian requisitions of necessities for this Government, after this change made, be reduced and decreased, observing, just as was ordered by the High Indian Government, that the requisition of cash, according to the calculation of the purchase cost, be increased in a separate column by 25 percent advance. Section 4. We have furthermore earnestly recommended to all the respective administrators and persons who have the handling of any administrations, however named, where provisions for the Honorable Company's needs and tools, equipage goods, etc., will still be made, to watch carefully that, in accordance with the order, an exact record and accounting of what has been provided, verified by receipts of those who shall enjoy the same, come to take place; to which end the aforementioned beneficiaries will henceforth have to sign for receipt on the warrants to be granted for the goods delivered to them, alongside the provision thereof, and that the books relating thereto be sent regularly to the Netherlands. We shall have the new equipage book sent to us duly observed, as well as the manner of placing the buoy ropes on the money chests. Section 5. One of the received copies of the newly established equipage book we have delivered to the Master of Equipage Cornelis Cornelisz, together with an extract from Your Right Noble and Most Honorable Worships' revered letter concerning the recommendation to take care that the equipage goods given to the outgoing ships, particularly the anchors and ropes, be properly accounted for and received into the Honorable Company's warehouses and the books belonging thereto. To the same Master of Equipage we have also communicated Your Right Noble and Most Honorable Worships' resolution of March 25 of last year, containing the manner in which henceforth the buoy ropes must be placed upon the money chests to the greatest possible security, in order to regulate himself strictly thereby in the transport of chests with cash. we shall dutifully observe your Right Honourable Worships orders concerning the deposit of Meuron. Demonstration of the reasons why we believe that no higher court of justice can be established in this place, to which the verdicts of the military court martial here could be appealed. Touching the complaints that have come before your Right Honourable Worships, that the recruits destined for the regiment of Meuron are not forwarded to Ceylon by the first shipping opportunities, we respectfully represent to your Right Honourable Worships that the said recruits have never, to the knowledge of any of us, or through our agency, been detained here longer than was required to await the opportunity to proceed on their journey to their destination, and that we accordingly also, since we ourselves feel the necessity of a speedy dispatch of those soldiers, shall strictly comply with your Right Honourable Worships command to send the same in future to the Government of Ceylon with the very first shipping opportunities. Paragraph 8. Regarding the point wherein your Right Honourable Worships are pleased to argue the necessity that there should be a higher court of justice than the military court martial established here, to which in important cases its verdicts might be appealed, and wherein your Right Honourable Worships are pleased to order us to serve you as soon as possible with our considerations as to how such a court of justice in this your Government could best be constituted, it has appeared to us, after everything that could have any bearing on the aforementioned subject or ought in any way to come into view in its discussion was attentively considered, that if such a higher court of justice were to be constituted here, the organization of the ordinary military court martial ought then first and foremost to undergo the change that, whereas it has hitherto been presided over by a lieutenant colonel and there have sat in the same, besides the junior officers, also the majors and captains commandant of the respective corps, the precedence in the said ordinary court martial ought henceforth to be assigned to one of the aforesaid majors and the members ought to be taken from the captains, lieutenants, and ensigns, and that then subsequently the higher court of justice to which the appeal would lie ought to be composed of the head of the militia for the time being, as permanent president, together with the further staff officers and captains commandant of the garrison, by turns, with the exception however always of the major who had the presidency in the ordinary court martial during the trial of the dispute or case over which the appeal is lodged. Against such a composition of a higher court of justice than the ordinary military court martial in this Government, however, the opinion of the undersigned Colonel Gordon has been that there must necessarily be a higher court of justice in case of appeal above the court martial here, but that such appeal ought to be sent to a court of justice in Batavia, whether to a court martial there or otherwise, and that for the following reasons, which are grounded upon his many years of experience here: and namely because, in the first place, the court martial here judges over nothing other than purely military offenses, and was established because, through the changes that were introduced into the Court of Justice, the officers who previously held a seat therein were excluded, and secondly that it is also natural that military men investigate and punish their own offenses, both to cut short all lengthy procedures and because they have more knowledge of military matters, as well as that this better confirms their necessary authority over their subordinates; furthermore, that in order to introduce a second military court of justice and appeal here, there are in the first place too few officers, and in the second place the accused might complain of not being treated impartially enough, while likewise many estrangements and jealousies might arise from this, and it is thus better that in a case, which will also seldom occur, this court of appeal be established at Batavia; and on our part there came immediately into consideration solely the present weakness of the garrison, whereby it is utterly impossible to bring together the necessary number of staff officers and captains to form the just-mentioned higher court of justice with them, the more so since Colonel Gelquin is about to repatriate, and the vacant place of Lieutenant Colonel Hamel, who departed for Batavia, not having been filled again, the entire number of those staff officers will thus find itself reduced

and why we believe that the same tribunal ought to be established at Batavia, reduced to three members, namely, the undersigned Commander of the Honorable Company's Militia, Major de Lille, and Major of Artillery Fisscher, of which two last-mentioned there would still always be one who, serving as president in the ordinary Court Martial, could not hold a seat in the high tribunal thus to be established; and that also the numerous duties with which the Council of Justice is more and more overwhelmed would not well allow one to re-involve it, whether in whole or only in part, with matters which once, for very weighty considerations and reasons, were withdrawn from its jurisdiction and decision. Thus we have, with the exception of the undersigned Commander, who has declared himself in favor of constituting the aforementioned Tribunal on the basis just cited in the best possible manner in this Government itself, resolved to respectfully submit to Your Right Honorable Excellencies' consideration whether, for the aforementioned reasons, it would not be best that such a high military court martial or tribunal, instead of here locally, should rather be established at Batavia, where a much larger number of senior officers is at hand; and that then, in the few extraordinary cases in which it might be applicable, appeals should be made thither from the sentences of the court martial, in the same manner as presently takes place regarding ordinary cases heard before the Council of Justice: by which arrangement, in case Your Right Honorable Excellencies might be pleased to embrace it, not only would we be saved from our predicament, but the objective that Your Right Honorable Excellencies had proposed for yourselves with the erection of such a tribunal could also undoubtedly be best fulfilled. We shall meanwhile await the further instructions which Your Right Honorable Excellencies have proposed to issue to us concerning the relinquishing of all trade in European articles to private individuals; and of which we have received the conditions as well as those under which Your Right Honorable Excellencies have been pleased to permit the carriage on freight of various articles from the Indies and from here to the motherland, without meanwhile devising any arrangements or taking any decisions on that subject whereby we might anticipate Your Right Honorable Excellencies to the disruption of the plan which your highest selves might have in view in this matter. §10. But since various inhabitants have come to request of us to permit them to send wines and some other articles on freight to the Fatherland on the return ships present, in accordance with the aforementioned conditions, with which most of the Burghers have been provided from Europe by their correspondents, we, in consideration that Your Right Honorable Excellencies, long before the shipping of any goods on freight was permitted, were pleased favorably to allow the inhabitants of this Colony to send wines on freight to the motherland via the ships of the Honorable Company, have likewise permitted them again by posting notices to submit a declaration, exclusively of the wines which they are inclined to ship, to the Trade Office, in order that, as far as the ship's hold will permit, the same may be shipped out, on condition that the freight thereof, in accordance with the determination most recently made by Your Right Honorable Excellencies, shall be calculated at ƒ32 per leaguer, which shall be paid as before in the Netherlands, and the wines thus to be shipped shall, as has been done hitherto, be noted on the bills of lading of each ship, while the proceeds thereof may be paid to the order of Your Right Honorable Excellencies to such persons as the respective shippers shall come to authorize for that purpose. §11. On this occasion, we also consider ourselves obliged to bring to the knowledge of Your Right Honorable Excellencies that several persons who have received goods on freight from the Netherlands with the Company's ships have made difficulties regarding the payment of the import duty which they are bound to pay to the Company, out of a mistaken notion that no import duty was levied on behalf of the Company for such goods. In respectful answer to your Right Honourable missive of 31 October last, to help relieve the condition in which it finds itself, and to notify everyone of his obligation to make payment, through the publication and posting of notices to make known to everyone their obligation to the aforesaid payment, we have qualified and instructed the ad interim Fiscal Mr. Jacob Pieter Deneijs to proceed in law toward the actual enforcement of payment against those who might still remain unwilling to pay the sums owed by them, since all pretext of ignorance that one might pretend has hereby been removed. Section 12. Since most of the orders and commands prescribed to this Government for observance, both by your Right Honourable and the High Indian Government, have attained their settlement, and we now find ourselves in a position, pursuant to your Right Honourable orders, to take the incoming letters successively directly into resumption: we have accordingly resumed in our meeting of 23 March last the missive received per the packet boat de Faam on the 15th of the same month, with which it pleased your Right Honourable to honour us on 31 October of last year. And with the respectful assurance that the commands given therein will be dutifully carried out, we shall take the liberty, with respect to the petition of Jan Roos received alongside it tending to be allowed to return to this Government, to write back to your Right Honourable that regarding this, the only consideration is the motive why he went up to the Netherlands in the year 1785 with other malcontents, and the well-founded fear that if his request were granted to him without using proper precautions, such might easily have some evil consequence at a time when, on account of the ordained impositions and taxes, the unrest in the minds of the public has not only been rekindled, but is also daily fanned more and more by the instigations of members of an infinitely more dangerous temper than the said Roos himself happens to be. We therefore leave it entirely in submission to your Right Honourable as to how far and under what terms and conditions it would be advisable to condescend to the aforesaid request of the same Roos. Section 13. However, since no such or other reasons militate against the request of Regina van Wyk, wife of Corneelis Johannes Baak, which Baak, though not finally discharged from the service of the Honourable Company, has nevertheless been placed under written-off wages so that by giving lessons he may employ his talents for the instruction of the youth, we gladly join with the petitioner earnestly to solicit from your Right Honourable both to grant her the requested permission to be allowed to come over to her aforementioned husband, and to excuse her from paying the customary passage and board money, both for herself and for her children, on account of his straitened circumstances. Section 14. which justification we shall dutifully supply to Your Noble High Honors. in order to be able to set in motion the levying of the duty on legacies and collateral successions were found not to have been delivered, and for what reasons in particular the said Comans was not procured the means to successively transmit knowledge of his needs and condition hither, in the customary manner, by sending letters with the men stationed in Baay Fals and Saldanhabaay, without being compelled always to come up in person for that purpose expressly! And when this justification shall have been received, and we thereby enabled to judge with sound reason upon the grievances of the petitioner, together with the claims founded thereon, we shall also not fail to take up this point again, in order to dutifully report further on the same to Your Noble High Honors. § 15. Having received some months ago from Batavia an ordinance regarding the levying of the tax on all legacies and collateral successions, which henceforth, pursuant to the revered orders of Your Noble High Honors, must be paid throughout all of Dutch India and at this corner of the earth, we have, the alongside mentioned arrangements having provisionally been made by us and the edict itself, in order to remove all difficulties, into the hands of Willem Stephanus van Rijneveld, appointed as Collector, by interpretation of the 22nd, 23rd, and 26th paragraphs of the received ordinance on that matter, provisionally resolved to appoint as Receiver of this resource the undersigned Cashier; as Collector at this main place and its subordinate districts, the Secretary of Justice; and in the outer districts, the Secretaries of the respective Boards of Landdrost and Heemraden there, yet in such manner that these latter shall be required to render account and justification of their collections to the first mentioned with the delivery of the sums received, so that, everything being gathered together into one mass under his administration, it might also be handed over by him to the Receiver with greater order; likewise as Taxateurs here, the Messengers of Police and Justice, of Commissioners from the Council of Justice and from the Orphan Chamber, and in the outer colonies, likewise the Messengers of the aforesaid Boards of Heemraden. § 16. But whereas, upon the attentive review of the aforesaid ordinance, it became apparent to us in the most convincing manner that the introduction and levying of the aforesaid tax could not but be accompanied by very many inconveniences and confusions, caused by the difference in the state of affairs between this establishment and the main seat where the draft was made, so that it was very necessary that such alterations and additions be made to the same as the local situation of this Colony and its particular institutions came to require, we therefore, before doing anything further in this matter, handed over the Edict received on this subject to the Secretary of the Council of Justice, Willem Stephanus van Rijneveld, appointed as Collector, and further commissioned him to examine with the requisite attention how the difficulties occurring in the same could best be resolved and cleared away through suitable interpretation, and the edict thus in its context be made applicable to this Government, in order subsequently to serve with a report at the earliest opportunity regarding his reflections and findings, submitting a draft edited in the aforesaid manner. § 17. The said Willem Stephanus van Rijneveld having complied with this order, by who complied therewith by the memorial accompanying this, yet when the burgher councillors of this place came to make representations against the introduction, with the request that the same might be postponed, submitting to our meeting of 7 February this ample memorial accompanying in authentic copy, and it becoming evident to us therefrom that by adopting the stated alterations and interpretations, the principal aim of Your Noble High Honors, namely the levying of the tax itself, could be fulfilled, the undersigned Officer in Charge then communicated to us that, while the just-cited memorial of Secretary van Rijneveld was still before us for reading, two of the burgher councillors had come to His Honor, and had declared, both for themselves and for their fellow councillors, that having learned how, by order of Your Noble High Honors, the levying of the duty of collateral was about to be introduced in this Government, they felt they could not avoid politely pre-warning him that this news had aroused the greatest dissatisfaction and discontent among the inhabitants, to such a degree that they were apprehensive that the immediate introduction of this tax, in the circumstances in which the Colony currently fluctuated, would have had very regrettable consequences, with

526. the undersigned Commander has advised, with the added request that he, the Commander, to prevent this, would kindly direct matters in council so that the introduction of the said tax on Legacies and Collateral Successions might be superseded until the forthcoming arrival of the Right Honourable Lords Commissioners-General, in order to give the burghers an opportunity to address themselves with their grievances to their Honours. Section 18. The undersigned Commander, having subsequently asked our opinions individually on this delicate matter, advised in the meantime that, since the condition of the Honourable Company at present is such that without extraordinary efforts on the part of its Servants to help sustain and uphold it, it would immediately have to succumb, and with its ruin that of the entire Colony would also be brought about, he was therefore of the opinion that, in order to avert so great a calamity, as well as to acknowledge to Your Right Honourable Worships the infinite obligation which all the Inhabitants in general, but especially we and 527. with us the other Servants, owe to their Honours for the unbroken tokens of favor and goodness, and at the same time to acquit ourselves of our due obedience to the orders of Your Right Honourable Worships; no matter how precarious the state of the Colony and how agitated the minds of the public may have been represented by the Burgher Councillors, nevertheless, while keeping in view the proper prudence and necessary discretion, the aforesaid tax ought to be introduced. The undersigned members of the Council thereupon also delivering their respective opinions one after the other, the undersigned Colonel Gordon declared that, since the introduction of the Collateral tax is an explicit order, he conformed in all respects with the opinion of the Commander, and consequently also thought that the said tax ought to be introduced, provided that the payment was adjusted to the local circumstances of this Colony. The undersigned Cellar Master Lesueur, advising hereupon, declared himself of the opinion that the Collateral tax, in order to assist the Honourable Company in its distressing circumstances, ought indeed to be introduced, 528. but that, taking into account the great lack of money from which the Colony suffers, he thought that those who would have to pay the said tax should be permitted to suffice with declaring the estates and having them appraised, deferring the payment itself until the arrival of the Right Honourable Lords Commissioners-General, provided that in the meantime sufficient security be given by everyone who would be subject to the payment of this tax that it would be paid when demanded. Against this, the undersigned Cashier de Wet was of the opinion that, since Burgher Councillors had already made representations to the undersigned Commander against the introduction of the Collateral tax, with the request that it might remain postponed, and the arrival of the Lords Commissioners is at hand, the introduction of the aforesaid measure ought to be suspended until their Right Honours' arrival here, in order that, if their Honours should take into consideration the actual implementation and the Colony's present circumstances, 529. present circumstances, it might thereby be prevented that a placcaat once issued would not have to be revoked again; but that in the meantime, in order to prevent the detriment that might arise for the Honourable Company through omitting the publication of that placcaat, the Collector ought to be authorized to summon the administrators of the estates that according to the Placcaat are subject to the Collateral tax to retain from those estates such a sum of money as would be required for the payment of the Collateral tax, so that it can always be paid whenever the placcaat should subsequently be published. While the undersigned Dispenser van Reede van Oudtshoorn finally was of the opinion that the placcaat for the introduction ought to be issued as soon as possible, yet in such a manner that he, just like the undersigned Cellar Master, maintained that those who would have to pay the Collateral tax could suffice with making a proper declaration and submitting to the appraisal

But as these votes came to be tied, and the undersigned, despite all efforts, could not persuade the majority of the council to proceed with the immediate implementation of the tax, letting it take place while one ought to suspend the collection until the arrival of the Gentlemen Commissioners, provided that in the meantime sufficient security were given for the prompt payment; but since upon taking the opinions, the Commander, notwithstanding the opinions thus delivered, found that while only one of the members had voted to postpone the introduction of the so frequently cited tax on Legacies and Collateral Successions, the four remaining votes were tied solely in this: that the undersigned Commander and Colonel Gordon had declared themselves for an immediate levying of the impost, whereas the also undersigned Le Sueur and van Rheede van Oudtshoorn, on account of the Colony's condition and the representation made in that regard by the Burgher Councillors, wished to have the payment referred until the arrival of the Right Honourable Gentlemen Commissioners General; the more-mentioned undersigned Commander judged himself obliged to employ all possible efforts to make the other members realize, even as he himself felt, that Gordon nor P 531. and dared not make use of a casting vote on account of the reasons adduced, he joined the undersigned cellar master and dispensary master. the Company's circumstances, as is stated above, nor the nature of the matters could tolerate such a delay, since it was in no way the form but the deed that could benefit the Company in this matter, and the deferred payment, when it should finally nevertheless have to be rendered, would then certainly be accompanied in time by infinitely more difficulty than at present, seeing that the number of persons by whom this payment would have to be furnished having increased through the elapsed time, while they had in the meantime flattered themselves with the hope of being exempted from furnishing the same, the dissatisfaction would then be more general than if one now, as soon as an estate fell under the terms of having to furnish the more-cited tax, immediately caused the same to be collected from this one and successively from all others. 534. while the report of the Collector Van Deijneveld was converted into a resolution, to suspend the monies arising therefrom until the Right Honourable Lords Commissioners General should have arrived here, unless those who were to make the payment should themselves choose to render the same immediately, and in the meantime to have sufficient surety provided by the donated persons for what they would have to pay; but to declare the estate administrators and heirs of the deceased whose successions should be found subject to this duty liable therefor alone, with which provision it was furthermore unanimously resolved by us to adopt the aforesaid report of the Secretary of our Council, Van Deijneveld, and to convert it into a resolution, in order that the same, together with the ordinance sent hither by the well-mentioned High Indian Government, be compiled into such an edict as would be required for the best understanding of the matter and explanation of the opinion of Your Honourable Right Worships; while we furthermore, out of consideration of the inconveniences that might present themselves regarding the valuations in the presence of the Fiscal, together with commissioned 535. members from the Court of Justice and their Secretary, as well as the Landdrost and Heemraden, beyond what the commissions can attend without a trail of any other expenses than the fixed salary, and indeed chiefly consisting therein, that while the aforesaid expenses cannot very fairly be charged to the estate from which the duty must be levied, very often all the benefit that should accrue to the Company from such an estate would be absorbed by the same expenses in case one wished to have them charged to its account, have resolved to declare that these valuations in the presence of the aforesaid commissions shall only take effect in so far as anything should have to be appraised at this main place, or in the village of Stellenbosch, or any other nearby locality whither one could proceed without incurring any extraordinary expenses, while for all that which is so far 536. distant that in order to be able to make the valuation thereof on the spot itself, the employment of wagons and other encumbrances might be required, it might suffice to submit a conscientious statement of the value of the donated or inherited property by the donee and executor or estate administrators, as well as two unblemished men, under the offer of oaths, unless there might reside with the Receiver, the Collector, or the Fiscal, or the respective Landdrosts, any suspicion that in one case or another in the statement thus to be made there had not been acted in good faith, in which case upon their request an express commission would be ordered by the Commander for the time being, or delegates from the Court of Justice or the College of Heemraden, to cause the valuation to be made anew by the appraiser of the property in question on the spot itself where it is situated or to be found, in the presence of sworn officers of Justice; whereupon, 537. upon finding that the valuation made by the donee, executors, or estate administrators has occurred below the value, besides the application of the 28th article of the ordinance itself, all the costs of extraordinary attendance, wagon hire, etc., shall also be charged to the account of the benefited persons or heirs in whose behalf the valuation took place; whereas in all other cases, in which the commissions being executed here in this place or in the village of Stellenbosch or in the vicinity of both, no attendance fees could be calculated, the salary determined by article 29 of the same ordinance shall be charged to the donor, or to the estate to which the goods belong; while we have furthermore resolved that the fine to be forfeited when on the countryside, deeds of donation inter vivos having been executed in the presence of seven witnesses, it might be neglected by the donor and donee to give immediate notice thereof to the Collector, 538. shall be charged to the same donor and donee, each for one half, and we have fixed the same fine at One hundred Rixdollars. § 20. The Burgher Councillors, however, having again made very serious representations, first verbally and thereafter in writing, against the posting of the aforesaid ordinance. Before the posting could take place after the proclamation of the aforesaid edict was made, very many serious and emphatic representations and entreaties were made verbally by the joint Burgher Councillors of this place against the introduction of the tax on all legacies and collateral successions, to the effect that both the posting of the edict and the introduction of the tax, in whatever manner and under whatever conditions that might also happen, might be suspended until the arrival of the Right Honourable Lords Commissioners General over Netherlands India, who are daily expected here; which representations and entreaties having subsequently been repeated in writing with no less earnestness and emphasis by one, as it were in the name of all the Burghers of this Colony, we have, before

We have meanwhile had the placard posted, but to prevent all sensation among the inhabitants we have at the same time caused to be published that the same will remain without effect until the arrival of the Right Noble Lords Commissioners-General. Before deciding on a writing of so much weight, having circulated the same, and shall not fail to send the same writing to Your Right Honorable Noble Excellencies at the first upcoming opportunity, and dutifully inform the same of the decision which we shall have taken thereon. Meanwhile, pursuant to the resolution taken by the majority of our council, we have immediately caused the copies of the frequently mentioned placard concerning the tax on Legacies and Collateral Successions to be posted, but to prevent all further sensations in the already agitated minds of the common people, and the consequences which we would have had to fear therefrom for the rest and tranquility of this Colony, have at the same time caused to be proclaimed that, on account of the representations made by the Burger Councilors, the aforesaid ordinance provisionally would have no effect until the arrival of the Right Noble Lords Commissioners, but the placard for the levying of the 50th penny remain suspended for so long, in the hope that the public, being meanwhile disabused through the reading of the piece itself from the wrong concept into which it has been brought by some malicious, turbulent, and dangerous people, will show itself more tractable in the future, and along with the equity of the aforesaid tax will also come to feel their obligation to contribute their share with willingness and zeal, in order to come to the aid of the Noble Company, for so many received benefactions with which it has always favored this establishment, now also in its oppressive circumstances by bearing unavoidable taxes. Section 22. Not long after the receipt of the ordinance concerning the levying of the tax on all Legacies and Collateral Successions, there having also reached us the placard adopted at Batavia on 25 October last concerning the levying of the 50th penny, so have we, however much from we have placed in the hands of the undersigned Cashier to report how the same will have to be arranged according to the local situation of the country the events with the introduction of the tax on Legacies and Collateral Successions it can also be inferred that the levying of this resource could not be introduced except with the greatest opposition on the part of the Citizens, nonetheless commissioned the undersigned Cashier, before we should dare to undertake anything further in this matter, to examine the aforesaid placard with all accuracy, and subsequently to report to us how the levying of the aforesaid imposition, assuming that the same absolutely must take effect upon the arrival of the Right Noble Lords Commissioners-General, could best take place according to the local condition of this country, and what changes to that end would need to be made in the form of the cited placard to make the manifest will and desire of Your Right Honorable Noble Excellencies executable in this matter, we intending, when the undersigned Cashier shall have complied with this requisition of ours, then also immediately to make such dispositions that an immediate beginning can be made with the levying itself, as soon as the Most Honored Lords Commissioners-General shall be pleased so to order. Section 23. The representations of the burger councilors having also concerned a reduction in the Tithes and a change in their collection. We have proceeded to this postponement regarding the immediate introduction of the levying of the 50th penny all the sooner, since the representations and petitions of the Burger Councilors have not only been directed against the introduction of the tax on all Legacies and Collateral Successions, but they have also come to make no less urgent representations to the undersigned Governor in the name of the grain-growing inhabitants concerning the tax of the tithe which the aforesaid farmers are bound to pay as a recognition to the Honorable Company, and the manner in which the same must be paid in money to the Patrol Guard, with the added urgent request we have considered ourselves unauthorized to effect this reduction of the tithe that regarding the tithe a reduction might be made, proportioned to the present unfavorable circumstances of the Colony, and with respect to this collection, to remove a multitude of inconveniences, the facility might also be introduced that the payment of the said tax might henceforth take place, at the choice of each person, in products as well as in cash money. Section 24. This request having been deliberated upon at our meeting of 27 March current, we, considering the lack of authority in which we judge ourselves to be—at a time when the Finances of the Honorable Company, if one wishes to preserve it, far from being able to bear any reductions, on the contrary ought to be strengthened by all possible means—to grant the least reduction in the payment of a recognition that has already been paid on the present footing for so long, have indeed provisionally declined the requested reduction in the payment of the tithe, but in order

We have had the placard concerning the levying of the office-fee by way of a recognition posted. to the grain warehouse, where, such persons having discharged their obligation, a receipt of the collection shall be given to him, while subsequently each month, both on behalf of the storekeeper and by the aforementioned Clerk, a specific list shall have to be delivered to the Trade Office of all such people as have discharged the satisfaction of the tithe in the manner as is stated hereinbefore by paying in kind, in order to be able to discover through the confrontation of those lists with one another whether any fraud might also have been committed in this matter. The High Indian Government having also sent to us a publication to be able to carry into execution here as well the levying of the office-fee by way of a voluntary recognition, introduced by order of your Right Honourables throughout all of the Indies as well as at this remote corner, we have duly caused the said publication to be proclaimed at this Castle 546. and the placement of the donation chest and the appointment of the commissioners will be determined further by us. to proclaim and to cause to be posted everywhere, while we have deferred the placement of the donation chest into which the recognition must be brought and the appointment of commissioners to attend to the receipt until the time of payment shall be at hand, in order then to take proper resolutions thereon and to give the necessary notice thereof to the public. Section 26. Meanwhile, we would flatter ourselves that this tax will meet with no such difficulties as that on legacies and collateral successions, as this latter tax primarily concerns the servants of the Honourable Company, and we rest assured that all of them in this Government, along with us, out of a full conviction of their duty, will contribute with all cheerfulness to assist this Honourable Company as far as is in their power, and to show that nothing is closer to their heart than to help and promote its preservation and prosperity. 547. Further respectful report of the memorial submitted to Us by the pro interim Fiscal Deneijs in the case of the commander Jan Valkenburg. promote. By our humble letter of the 3rd of January last, we respectfully informed your Right Honourables that at a next following meeting we would resume consideration of the memorial submitted to us on that day by the ad interim Fiscal Mr. Jacob Pieter Deneijs, in order, both with regard to the same and with respect to the elucidations which we considered ourselves bound to furnish to your Right Honourables regarding the aforementioned conducted proceedings against the Commander Jan Valkenburg, to make such further disposition as the matter and its nature and circumstances came to require, in order to make a respectful report thereof to your Right Honourables. With respectful reference to all that we have taken the liberty to impart to Your Right Honourable concerning the dispatch of the permanent frigate ship de Meermin, to search for the missing return ships 'T Slot ter Hooge and Rotterdam's Welvaaren, and concerning the plan we had formed to make that expedition, if possible, serve to the benefit of the Honourable Company, we shall now have the honour dutifully to bring to the knowledge of Your Right Honourable that the said frigate ship de Meermin returned here safely on the 9th of the past month of March, and it was reported to us by the naval Captain Francois Duminij that he had heard nothing of the ship 'T Slot ter Hooge nor of the ship Rotterdam's Welvaaren, neither at Mauritius nor on the island of Madagascar or at Rio de la Goa, and also had been informed by diverse French sailors, who frequent both this coast and the island of Madagascar, that no Dutch ships had shown themselves in any of the harbours of those waterways. 561. These keels having thus probably perished. Fortunate outcome of the trade conducted by the above-mentioned frigate ship de Meermin. § 40. And as, upon the arrival of all English, French, and North American ships that have arrived here from the east coast of Africa and the island of Madagascar, we have always inquired very carefully whether the two aforementioned return vessels had not been discovered anywhere, without obtaining the very least information of them, all of which we have dutifully communicated to Your Right Honourable, we believe we may conclude that those unfortunate keels will have perished, and lament the heavy loss that is thereby inflicted on the Honourable Company in its oppressive and distressing circumstances. § 41. However much we were struck by this sad news brought here by the frigate ship de Meermin, we were just as much rejoiced by the outcome of the trade which we, as it were in passing, had conducted by that small vessel for the account of the Honourable Company at Mauritius and Bourbon, 562. since the 3000 mudden of wheat, which we caused to be shipped therein to make landfall at Mauritius, and having cost in purchase price, with the expenses incurred thereon both here and at the said island, an amount of 8769: 80:- rixdollars, were disposed of there to the Government for 13440:- Spanish reals or 15120:- rixdollars, for which were subsequently purchased a quantity of one thousand bales of Bourbon coffee and 29387 lb of black ebony, on which sale therefore not only a sum of 6351: 38:- rixdollars was gained for this Government, but we also dare to flatter ourselves that, upon safe delivery of the coffee and the ebony in the Netherlands, a considerable profit of 35000:- to 36000:- Dutch guilders will additionally be drawn therefrom to the benefit of the Company.

568. we have let it make a voyage to False Bay, the Castor, we believed that, pending the same, we should make a useful employment of that vessel for the service of the Honorable Company, especially with regard to such expeditions for which otherwise the permanent vessels of this Government are usually used, and therefore, before the frigate Meermin had returned, the said ship the Castor was employed to transport to False Bay all such articles as will have to be found in stock there in the coming winter, both for the provisioning and for the repairs of the Honorable Company's outward-bound and homeward-bound ships, and from there laden again with the goods which, in the past bad monsoon, were brought there by the outward- and homeward-bound vessels of this Government that passed in succession, with which it also returned safely on the 28th of this month. 569. and as we find ourselves instructed by Your Honorable Nobilities regarding the destination of the minister Manger, we have provisionally detained him here at this roadstead. Paragraph 15. Since we likewise have not been honored with Your Honorable Nobilities' orders regarding the minister Johan Heinrich Manger, arrived here with the private ship the Geertruida en Petronella, and have not found his destination made known on the muster rolls of that vessel, we have learned from the said Manger that he was sent out for this establishment and specifically for the colony of Graaff-Reinet, and therefore, considering that if he were detained here, and it were subsequently found that he was suited not for the Cape but for Batavia or any other factory of the Indies, there will always be an opportunity to have the said Manger proceed on his journey from here, whereas on the contrary a very long time would have to elapse before he could return from the said principal place of this Government, in case, having traveled on, it afterwards appeared that his ministry should have remained here, 570. Enclosed we take the liberty to present a representation of the scholarchen concerning the improvement of the schools, and pursuant to the same not to mention the hardship that would reside in having to undertake such a fatiguing round-trip journey for nothing and against his made declaration and testimony, we decided, with the highly favorable indulgence of Your Honorable Nobilities, to detain the frequently mentioned minister Manger provisionally here while drawing his salary, awaiting the orders or information which Your Honorable Nobilities will be pleased to give us in this regard. The High Indian Government having ordered us to observe the following regarding the buildings, we have applied this to the bail of Colonel Gilquin and increased the same to 10000 rix-dollars. on 7 October 1791, to be transported to the Netherlands as a harmful subject; having remained here due to illness from the returning ship De Eenparigheid that sailed ahead. Section 50. The High Indian Government having seen fit to decree that the costs for repairing the defects to the buildings which are not to be attributed to accidental causes or to the age of the buildings, but are the effect of bad management, as well as the damages further arising therefrom, must be for the account of those on whose administration one relied, we therefore deemed it necessary to alter the bail of 5000 rix-dollars previously determined by us for Colonel Gilquin to such an extent that it was brought to a sum of Ten thousand Rix-dollars. Against this, Colonel Gilquin submitted his objections in the representation accompanying this in authentic copy, with the request that the bail which had to be provided by him might again be brought back to the first determination. 580. Yet relieved him thereof for the reasons presented, Though not all of the arguments which Colonel Gilquin used in this matter for his discharge, and upon which he tried to base his exception from the aforesaid order of the High Indian Government, appeared to us equally plausible and acceptable, we nevertheless decided, in consideration of the other reasons presented, to relieve him from the ordered increase of bail and consequently to let him suffice with the provision of the previously determined security of 5000 rix-dollars for the ordered time of [illegible] years, dating from today.
