583. and alongside the aforementioned national ships, the required provisions and crew, and upon the arrival of the national ship the Scipio and the brig the Comeet, in order that he, together with his wife and two children entrusted to their care, may await another shipping opportunity here for the recovery of their health, we have readily acceded to that request. The national frigates of war Thetis and Bellona, having arrived here on 18 February, together with the national brig Mercuur on 7 March last, are ready to undertake the voyage to the Fatherland. And since Mr. Staringh, commanding this squadron, requested some provisions and necessities from us, as well as to assist his Honor with some crew, we have complied therewith pursuant to the honored orders of your Right Honorable and Grand Lordships, and accompany this with the accounts of those provisions and a pay statement for the crew from this Government placed on the ships Thetis and Bellona. Paragraph 54. On this occasion, we shall also bring to the knowledge of your Right Honorable and Grand Lordships that successively, on 28 March and the 4th of this month, there have arrived at this remote corner the national ship of war Scipio 584. Detail of the reasons which prevent us from supplying the resolutions of our Council further than until the end of December last to your Right Honorable and Grand Lordships. 587. by resolution of 20 Ianuarij last to appoint the undersigned to conduct a meticulous investigation of all those allowances, both in cash as might be, and in goods, which the servants lawfully have enjoyed from the Company's warehouses, to draw up a price current of the ordinary buyout amount of the domestic products when these might be included under the emoluments, and to calculate the European and Indian goods, as having to be imported from abroad, at 25 percent advance on the net purchase cost. In order dutifully to comply herewith and to enable Your Honorable Worships to judge what those allowances have consisted of up to the date hereof, and how much the same calculated for each servant individually would yield monthly in money, they have deemed it best to draw up the specific statement accompanying this, with the addition of the calculation of those allowances, and a summary of the amount that the same, calculated over the qualified servants currently serving in this Government and a few other persons, would come to make up, to which the undersigned, in order to observe all possible brevity in this regard, referring themselves, now only have to note here the market price of the domestic products: that they have determined the same as follows, to wit: The leaguer of wine at rd:o 40. Yet as some doubt might well arise among Your Honorable Worships why the undersigned have not regarded the spices as having to be imported from abroad as such, but on the contrary have placed them in the aforesaid specific statement under the domestic products, they shall have the honor to supply Your Honorable Worships with the following reasons in that regard: that if the spices were calculated at 25 percent above the net purchase price, this price would by far not be sufficient to provide oneself with that ingredient; that the same being obtainable nowhere here except only in the warehouses of the Honorable Company, the sale thereof there does not take place at 25 percent calculated across the board; In the Castle of Good Hope, the 27. Exhibited 24 February 1792 All the documents relating to the proceedings initiated by the Interim Fiscal, Mr. Jacob Pieter de Nijs, against the former Master of the hooker ship the Herreschans, Jan Valkenburg, having been supplied by the Council of Justice upon the requisition of this Council, the undersigned has, upon the reading thereof, been further enlightened concerning the motives that moved the said Council of Justice to grant and permit a composition of Two Thousand Rix-dollars. But since he must, for special reasons, hesitate to judge and examine entirely by himself to what extent such compositions are detrimental to the interest of the Master, as well as to what extent the same may be entered into by the Fiscals, and what solemn obligations ought to restrain them therefrom, he will patiently await what the Illustrious Assembly of the Seventeen shall be pleased to decide in this regard. In a previous opinion, the undersigned believed that the composition was proof of the crime confessed by him, Valkenburg. Yet, although in the petition presented by the same to the Council of Justice they have very carefully managed to avoid everything that could have revealed the slightest glimmer of an admission of guilt, and on the contrary brought forward other reasons why one would gladly wish to have the case declared civil and composable, this nevertheless does not alter the fact that the request to be permitted to compose cannot have originated from anything other than a complete conviction of the crime, from the awareness of the punishment appointed therefor, and from the fear of undergoing that punishment. Wherefore that request can thus also be regarded as nothing other than a confession of that crime, however much they have managed to have him evade the same, certainly because if the defendant had confessed the committed act in its aggravating circumstance to the judge, the latter would thereby have become more attentive and would surely have investigated how far the Company's interest was entangled with the committed acts, and would then certainly have deemed himself incompetent to let him escape corporal punishment through a certain monetary fine. The investigation having been entrusted to the Interim Fiscal not only with the purpose of having the aforesaid Valkenburg punished according to his merits if he could be convicted of the crime, but also partly having had the purpose of being informed through that accurate investigation of the circumstances that accompanied the case, the undersigned must express his astonishment that from the day these inquiries were demanded of the fiscal office, which was the 29th of June last, until the day that the frequently mentioned Valkenburg forestalled the Fiscal office by petitioning the Council of Justice that his case might be declared civil and composable, although constituting an interim period of more than four months, one sees no other inquiries obtained than two statements and a single interrogation of the accused's own brother. The latter, to get at the truth, the undersigned would certainly not have preferred if he had been able to obtain impartial statements, even if only from the common crew of the ship the Sterrenschans, for which abundant opportunity presented itself; while the statement of the Captain of the Burgher Militia, Johannes Gie, moreover still remained unverified and unsworn, and was placed among those documents as such. The undersigned leaves it in its place whether the intervening composition did not make a more accurate investigation inadvisable. Exhibi 24 Febr: 1792 Alle de stukken betrekking hebbende tot de Prcedures door den Pro Interim fiscaal M=r Jacob Pieter de Nijs teegens den geweesenen Gezaghebber van het Hoekerschip de Herre Schans, Jan Valkenburg g'intameert op te quisitie deezes Raads, door den Raade van Justitie gesuppediteerd, zijnde, is bij de Lectuure daar van d' ondergeteekende nader gelucideert, ge worden, van de motives, die gem: Iustitielen Raade hebben gepermoveerd, omme eene Composita van Twee Duysend Ryksdaalders, 't accordeeren en toe te staan; dan alzoo hij om bij zondere reedenen moet hesiteeren voor zig zelf alleen te beoordeelen, en te onderzoeken, in hoe verre diergelyke Compositien voor het intrest van den meester schadelyk zijn mitsgaders in hoe verre dezelve door de Fpiscaals morgen worden aangegaan, en welke plegtige verbin„ tenissen hen daar van behoorden af te houden zal hij met geduld afwagten wat d' Illustre Vergadering van Zeventhienen daar omtrent zal gelieven te beslossen Bij een voorig advijs Vermeende de ondergez: dat de Compositie, een blyk was, van de door hem Valkenburg beleede misdaad, dan schoon men bij het request, door den zelve aan den raade van Iustitie gepresenteerd, zeer zorg vuldig heeft weeten te verwyden, alles, wat maar de minste glomp van Schja Schuld be o. 17 605. bekentenisse aan den dag zou hebben kunnen leggen, en in teegendeel andere oorzaaken opport„ Waar om men gaarne wenschte de zaak Civiel en Composibel te hebben verklaard, neemt het egter niet weg, dat het versoek omme te moogen Composeeren, uit niet anders kan zijn, ontstaen als uit eene volkoomen Overtuiging van de mis raad uit de bewistheid van de daarop gestelde straffe, en uit de Vreeze, om die straffe te onder gaan, Weshalven dat versoek dus ook niet anders kan worden beschouwd; dan als eene belydenisse van die mestaad, hoe zeer men hem dezelve ook heeft weeten te doen ontduijken zekerlijk omdat wanneer den ged het begaare fait in zijne agraveerende omstandigheid den rechter beleeden hadde, dezelve daardoor opmerk zaamer zou zijn geweerden, en gewsselyk hebben ondersogt, haer verre 's Comp: Intrest met de begaane facten waaren gemeleerd, en zig zeeker als dan onbevoegt zoude hebben geacht hemde Corporeele straffe door eene zeekere geld boete te doen ontgaan.— Het onderzoek aan der Pro Interim Fiscaal opgedraagen zynde, niet alleen met dat oog merk om, wanneer voorsz: Valkenburg van de mirdaad konde werden overtuigd, den zelve als dan na menites te doen straffen, maar meede ook ten deel hebbende gehad; om door dat naauwkeerig onderzoek te worden onderrigt van de omstandigheeden die de zaak hebben E verzeld; moet de onderget: zyne verwondering te kennen geeven, dat van den dog dat deze recher„ ches aan 't officie fiscaal gedemandeerd zijn geworden, zynde geweest den 29 Junij laast leeden, tot den dag dat dikwyls gem: Valkenburg het officie Fiscaal voorgekoomen ins, met den Raade van Iustitie te suppleceeren, dat zyne zaak Civiel, en Composibel mogt worden verklaerd of schoon een tusschentyd uitmaakende van ruim vier Maanden, men geene andere enquees =ten ingewonnen ziet, als Twee verklaaringen en eene enkelde ondervraaging van des beschuldig den eijgene broeder welke laaste de ondergez: om agter de Waarheid te koomen, gems niet zoude hebben geprefereert, wanneer hij al was het ook maar van het gemeene volk van het schip de Stervenschans, en Waartoe overvloedig geleegentheid zig heeft opgedaan, onportydigen Verklaaringen hadden kunnen magtig worden Terwijl de Verklaaring van den Capitain der Buryerij Johannes Gie bovens dien nog onge recolleert en onbeedigd gebleeven, als zoodanig bij die stukken gelegt geworden is. 606. the case is, is obliged to supply their high honors with those elucidations that may possibly be obtained on that subject, in order to enable the high authorities to be able to judge what is real concerning the complaints brought forward by the Burgher War Council against the Independent Fiscal van Lynden, who has departed, and the persons involved therein: And in order to contribute thereto on the part of the undersigned as much as is in his power, or in case the documents to be sent over by the Council of Justice might cause any doubt in judging the crime whether or not committed by the said Valkenburg, he will therefore only briefly cite here what the present Lord Commander brought to his knowledge some months ago, namely: That when the aforementioned Valkenburg, with the hooker ship the Aerreschans, which had been dispatched to Saldanha Bay to collect some wheat, had returned to this roadstead, surely upon the information that must have been supplied to him that complaints were about to be brought against him on account of the selling of some equipment goods of his ship, he immediately did not fail to come and request the Lord Commander, then the Chief Administrator, that whereas before his departure to the aforementioned Bay the boat of his ship had been washed away from behind it by a strong southeasterly wind, and having drifted ashore at Robben Island was crushed there, and also on that occasion one of his cables had broken, which he had not been able to recover with the anchor, because he had had no buoy on the rope; all of this might be added to the inventory of his board, or else written off from the same. That the Lord Chief Administrator, for special reasons, namely because he had understood indirectly that the aforementioned Valkenburg had sold the boat and the rope in Saldanha Bay, having been unable to consent to the request made, had nevertheless promised to condescend thereto if only a sworn declaration by the other ship's officers could be produced by him, Valkenburg. And that this declaration could not be submitted by him, Valkenburg, consequently the inventory was not supplemented with these reported items. The Lord Commander, being well able to remember all of this, the undersigned therefore requests 607. requests that His Honor may be pleased to demonstrate this declaration further in the resolutions of this council, as agreeing with the pure and sincere truth. If one is now to believe the report of the two sea captains whom the repatriated Lord Governor van de Graaff commissioned to accurately take inventory of the equipment goods of the ship the Herreschans, and who in their report state that they found the same complete according to the inventory, then it speaks for itself that the Commander Valkenburg, certainly regarding the sold goods as lost, wrote them off from the inventory; the more so since the commissioners did not specify which equipment goods they found, but only that the goods present on board agreed with the inventory, and thus also that he, Valkenburg, in making the aforesaid request to the chief administrator, had the objective of enriching himself with Company goods, if it were possible, if he had not done so before; but if one prefers to attach truth to these missing items, then it speaks for itself that the boat and the anchor rope were made away with by the said Valkenburg, because the ship's officers were unable to testify in that regard, which the Lord Chief Administrator came to demand in accordance with the Company's orders. As much as the undersigned has considered it his unavoidable duty to contribute here for his part what was known to him of the case of Commander Valkenburg, he finds himself no less obliged on this occasion to remind your Honorable Excellencies not only of the aforesaid dutiful promise to supply their Right Honorable High Mightinesses with further reports, both concerning the representation of the Burgher War Council itself and concerning the accusations made therein against some persons, but also the assurance that was given to their Right Honorable High Mightinesses by almost every ship's opportunity, that one would only be engaged in handling the affairs in this Government properly, and that mainly because with that promised report one solely intended to disabuse their Right Honorable High Mightinesses concerning the imputations made by the Lord Governor van de Graaff against the inhabitants of this Colony, as if through the writing of the War Council the pernicious fire of perverse Patriotism was about to burst out in the same, for which reason the undersigned also believes that

Undoubtedly the Fiscal ad interim, by carrying out the commission given to him, would have best enabled the Council to inform the High Authorities with all accuracy regarding this matter, especially if, not being unacquainted with what occurred, he had added to the report on the outcome of the inquiry ordered of him such considerations as he might have been able to make ex officio concerning the accusations appearing in the aforementioned document. The undersigned therefore hopes that this Council will (:as speedily as possible:) be active with all well-meaning zeal, in order that, as far as each is capable thereof, we may jointly fulfill our oft-mentioned promise, and disabuse the Illustrious Assembly of the Seventeen of the harmful notions which their Right Honorable High Mightinesses might have conceived against this Country and its inhabitants. The undersigned feels himself the more compelled to urge Your Honorable Council with all earnestness to this end, because it is very possible that the private reports which have been sent to Batavia in the most underhand manner, as if a tumult had arisen among the inhabitants of this Colony, may likewise have been dispatched to the Fatherland by the very same despicable spreaders at the same time; and which, added to the false accusation brought against the Burgher War Council, could naturally not have failed to alarm our High Lords Masters as well as the entire Fatherland, and fill them with indignation, both against a quiet, peaceful, and obedient people, and against a government which may boast of having done nothing in everything except what promotes the delicate and precious interests of the Fatherland and of this Colony, with that happy success that everyone expresses satisfaction therewith, and shows it all due respect and subordination. 611 to have to initiate proceedings against the petitioner, and that in such case the petitioner would have to remain here until that matter were principally settled. That the petitioner has also actually perceived that the interim Fiscal intends ex officio to institute an action against the petitioner. And notwithstanding that the petitioner finds himself fully capable of completely purging whatever might be laid to his charge and could defend himself against all accusation in court in such a manner that his innocence would be proven clear as midday, which the petitioner could do with all the more ground, since the repatriated Governor, the Right Honorable Cornelis Jacob van de Graaff, has already appointed a Commission concerning that affair and sent it on board the hooker ship Sterrenschans to investigate this matter, and from the report submitted by the commissioner gentlemen it also appeared that everything was found in proper order, the petitioner on that account having believed that this matter was concluded, yet now foreseeing that he will have to enter into a lengthy and vexatious lawsuit, which he must try to avoid as much as possible, by reason that he is still actually in the service of the Admiralty, and his leave being expired, the petitioner would thereby have to delay his return voyage to the Fatherland, which would tend to his considerable damage, the petitioner has therefore resolved to turn with all respect to Your Right Worships with the humble request that it may kindly please Your Right Worships, for the reasons mentioned, to declare the matter civil and composable, in order that the petitioner may thereby be enabled to continue his necessary voyage to the Fatherland. 614. to present annexed hereto six exhibits, of which the first two were submitted on behalf of the Burgher Court-Martial to the Honorable Council of Policy, and subsequently placed in the hands of the undersigned; while the remaining four were obtained by him ex officio. From these exhibits it will appear to Your Honors that the petitioner, during the time he commanded the said hooker ship, and specifically on the occasion when he was in Saldanha Bay with his vessel in the month of February of this year, delivered to the captain of a French merchant ship then also lying at anchor therein various goods belonging to the category of equipment goods and provisions; both being specified in the documents annexed hereto. Furthermore, it appears in particular from the private declaration of Captain Dupin and some of his subordinate officers that the aforesaid goods and effects were indeed sold by Commander Valkenburg for such prices as are stated by the designation of those goods, without, however, the same Captain Dupin and associates, any more than the deponents of the other declarations, having determined whether the equipment goods and provisions thus sold and delivered as aforesaid belonged to the hooker ship De Sterreschans, or whether the same were the commander's own; it being true, though, that the Sub-Lieutenant of the Seijtels Eelders, upon the swearing of his declaration annexed hereto under No. 4, testified that the boat sold by the petitioner Valkenburg to Captain Dupin belonged to the hooker ship De Sterrenschans; but on the other hand, the petitioner's brother, in response to Article 14 of the interrogatories put to him, annexed hereto under No. 5, declared that the same boat was by no means the ordinary ship's boat, giving as reasons for his knowledge that a boat of six rowing benches belongs to the ship De Sterreschans, whereas the one sold was constructed and planked for nine; while the deponent under No. 3, being the lieutenant of that vessel, Johan Jacob Carstens, declares that he does not know whether the provisions belonged to Commander Jan Valkenburg, or to the Honorable Company. The undersigned, finding the matter thus situated, has furthermore examined the 615. report mentioned by the petitioner in his petition, and annexed hereto in copy under No. 6, of two sea captains expressly commissioned by the Right Honorable Governor Van de Graaff, from which it has appeared to him that the hooker ship De Sterreschans was inspected on 13 May of this year, and thus after it had returned from Saldanha Bay to this roadstead, by the sea captains J. Bakker and D. Muller, and both the state of the equipment goods themselves and the inventory were properly examined, and indeed in such a manner that the commissioners made not the least difficulty in frankly declaring that everything was found to be complete according to the inventory at the time. Yet, however much it might appear at first glance to follow from this that the equipment goods sold by the petitioner must be considered to have belonged to him privately, the undersigned nevertheless understands, on the other hand, that the aforesaid examination having taken place after the sale of the aforesaid goods, it may very easily have occurred that the petitioner at that time, fearing prosecution, replaced the missing and traded goods, and thus put everything in a condition to undergo the ordered examination; which latter, if it could be proven, would certainly cause the petitioner to fall within the terms of the laws framed concerning equipment goods for shipmasters. For the fact that the letter of the prohibition in the ordinance of the High and Mighty Lords Mayores dated 21 May 1670, as well as in the ordinance of this Government of 12 February 1732, does not explicitly stipulate any punishments when the shipmasters sell equipment goods and the like belonging not to the Company but to themselves, is evident from the determination of the penalty, which, besides dismissal and arbitrary correction, consisting of a fourfold restitution of what was alienated, cannot very suitably be applied to cases in which the Honorable Company suffered not the least damage. The officers of the ships shall be bound to manage and look after their equipment goods properly, as well as to keep a pertinent record of what has been used and to deliver the remainder on each voyage to the respective equipment masters and to regulate that accordingly as shall be deemed fit, and whosoever has alienated any equipment goods to his own profit or might venture to sell any thereof shall be physically punishable: Yet, notwithstanding the literal violation in the subject case would be, if not wholly unproven, at least very difficult to prove; the undersigned, subject to respectful correction, is still currently of the opinion that the facts charged against the petitioner never cease to tend to the considerable detriment of the Company, wherefore it is also generally forbidden to Company servants to trade in goods which belong to their administration: The undersigned therefore judges that the petitioner is always within the terms of having acted contrary to the interests and the intentions of his masters, and that he can therefore never be regarded as wholly unpunishable, with however much confidence one has sought to bend and palliate such by the arguments of his petition, however much the undersigned must also testify to encountering very great obscurity and uncertainty in the laws known to him regarding the determination of a condign punishment, which, as can be gathered from what has been related above, proceeds from the obscurity with which the nature of the act is surrounded. Having thus presented the principal circumstances both of law and of fact, it finally remains to determine whether the matter in question is compoundable, yes or no; the named Professor Voet expresses himself in this matter as follows: To which public prosecutors, although in the previous century it was forbidden that they should settle any crime, of whatever name, because thereby not only were the entirely innocent often exposed to extortion, but rich people were also enticed, as it were, to commit a crime, as they could atone through a settlement not with their skin, but with their money or purse, according to the Ordinance on Justice of King Philip of the year 1570, Article 13. Afterwards, however, compositions for petty crimes were permitted to the officers, just as settlements are made for many serious crimes with the permission of the Sovereign or of the Chamber of Accounts as representing the Sovereign, especially when the crime with which someone is charged is indeed probable from strong presumptions, but cannot be proven by complete proofs as clear as the sun at midday, Professor Voet alleging in this respect several prominent Doctors of Law. Master Pieter Bort on Criminal Cases, Title 12, Part 9, Numbers 2 and 3, says: That in order to avoid long litigation, trouble, and expense, one may enter into submission, and that the Prosecutor General is also empowered to do such with the approval of the Court; All by virtue of the 27th Article of the Court's instruction, the said Mr. Bort adding hereto at Number 4: That the Court permits the Prosecutor General to do so if it finds from the information of the Prosecutor General that the crime is compoundable, Number 5, or even if it is not compoundable in itself, that the matter is nonetheless very doubtful owing to the defect of proof. Since, therefore, the case in question not only cannot be placed in the class of enormous crimes, but moreover, as far as the nature of the act is concerned, is subject to doubt and labors under a defect of proof, the undersigned judges, under the favorable interpretation of Your Honorable Worships, that he may declare that the request of the petitioner can be acceded to without any difficulty, especially since the Honorable Company, as far as is evident, has suffered no damage, and so far as the petitioner has not acted in accordance with the intention of his masters, composition in this Colony is practicable instead of submission, always according to the doctrine of the cited Mr. Pieter Bort, and ought to be regarded not as a pardon, but as a distribution of justice, arranged and suited to the doubtful nature of the crimes charged against the petitioner. The undersigned trusts to have hereby complied with the esteemed intention of Your Honorable Worships, and submits these his considerations and advice to your most enlightened judgment, signed: I. P.
