Collated. f. 8 e E 6 0 f Statement of Claim drawn up and submitted to the Honorable, the President and Council of Justice of this Government by and on behalf of the Pro Interim Fiscal, plaintiff in criminal matters, on the one side, against the former first sworn clerk at the Political Secretariat, Johannes Marthinus Horak, summoned in person by edict, in default and in hiding in the aforementioned case, on the other side. 1. Saying in fact: 2. That having had delivered into the hands of the plaintiff the extract resolution taken in the Honorable Council of Policy on Thursday the 24th of July of this year, together with an attached extract from the report submitted by the appointed commissioners in the case of the former first sworn clerk at the Political Secretariat, Johannes Marthinus Horak, as well as some supporting documents; 3. It has appeared therefrom to the plaintiff: 4. That the aforementioned defendant, in default and in hiding, did not hesitate, 5. Setting aside his bounden duty and sworn fidelity, for several years to collect the Company's monies in a very excessive, unauthorized manner and to employ them for his own benefit; 6. In such manner that the said defendant in default and in hiding has not only, by the transferring of real estate before the lord's dues were properly paid into the Honorable Company's treasury, defrauded the Honorable Company of the considerable sum of 18005 Rds. 22; 7. But has also sought to enrich himself through the collection and embezzlement of recognition monies; 8. Whereof, however, the sum charged against him cannot yet be fully determined, 9. Since other clerks have also signed for the receipt, and this amount can only be established upon closer investigation; 10. Apart from what, in the still continuing investigations of the abovementioned commission into the delivery of cattle instead of cash payment, may yet be found to have been embezzled by the same; 11. That the defendant, in default and in hiding, has consequently made himself entirely guilty of forgery and theft of the country's monies, which is properly called peculation.

and thus this case was placed into the hands of the Fiscal Office, not only to take action against the person and goods of the said defaulting and absconding party, but also to investigate to what extent the other clerks are guilty in order to likewise institute action against them. That the said Plaintiff, in accordance with the facts and nature of the remaining circumstances, without any loss of time, requested at an extraordinary meeting before this Honorable Council, and having obtained bodily apprehension, directly requested and applied all measures to take hold of the person of the said defaulting and absconding party. However, the said defaulting and absconding party having already absented himself, and the said Plaintiff having given notice thereof to Your Honors, it was granted upon his further petition that the said defaulting and absconding party was summoned by toll of bell and public edict to appear in Court on the next following court day, in order to come purge and answer for his malversation and committed theft, on pain that, in case of neglect, proceedings shall be taken against him according to law. So that, the said defaulting and absconding party not having appeared on the appointed day, default was granted against him, with such benefits as ought to follow by law, along with a second citation. Which having been properly served, and the said defaulting and absconding party still not appearing on the appointed day, the second default was furthermore granted by this Council, with the benefit thereof according to law. That further, the said defaulting and absconding party having been properly summoned as before by a third citation, and likewise not appearing, a third default was granted. By virtue of which the said defaulting and absconding party was barred from all peremptory exceptions, essentials, and defenses and other benefits, and the said Plaintiff was admitted to submit his statement of claim. To serve which statement of claim, the said defaulting and absconding party was summoned today for the fourth time, ex superabundanti. And the same likewise not having appeared, the said Plaintiff serves this his statement of claim. For which and other reasons and remedies to be declared further in due time and place if necessary, the said Plaintiff concluded that, by virtue of and for the benefit of all the aforesaid defaults, the said defaulting and absconding party shall remain barred from all declinatory, dilatory, and peremptory exceptions, as well as defenses and essentials of law which, appearing in this Council, he might have proposed and made; and that consequently, the said defaulting and absconding party, by definitive sentence of Your Honors, shall be condemned to be banished forever from this government and its jurisdiction, on pain that, if he should at any time fall into the hands of Justice, he shall then be punished according to his deserts; expressly reserving to the said Plaintiff the right, upon a fully completed investigation and finished inquiries, to make a further claim, or to all such other penalties and punishments as Your Honors in good justice shall see and deem proper. Thursday the 21 July 1788. Was read the Report submitted today by the Commission for the investigation of the prejudice brought upon the Honorable Company by the former First-mentioned Clerk at the Political Secretariat, reading From which report having appeared that the former first-mentioned Clerk at the Political Secretariat Johannes Marthinus Horak regarding the deficit of the sums of money expressed in the report has in a far-reaching manner made himself guilty of malversation and theft of the Honorable Company's moneys, it is therefore approved and understood to place an Extract from the aforesaid report, in so far as it concerns the finding regarding this, into the hands of the Fiscal's Office, with the documents relating thereto, in order to initiate such procedures, both against the person and goods of the said Horak, as the nature of the matter requires, as well as regarding the further sworn ordinary Clerks at the Political Secretariat appearing in the documents to investigate to what extent they may also have made themselves guilty of any fraud or malversation, and therein then likewise to act ex officio according to the findings. Extract from the submitted report of the Honorable and Worshipful Gentlemen Master J: J: de Meuron and Tobias Christiaen Rönnenkamp, as well as the Gentleman Salemon van Echten, as specially appointed commissioners in the case of the first-mentioned Clerk at the Political Secretariat Johannes Marthinus Horak. Having perceived from the extract of your Right Honorable and Most Worshipful respected resolution dated the 1st of April of this year handed to us, that the former first-mentioned Clerk at the Political Secretariat Johannes Marthinus Horak, out of a far-reaching negligence and carelessness, had gone so far beyond his duty as not only to grant transfers and conveyances of these and those immovable properties which from time to time have been sold, without prior payment of the Lord's dues into the Company's Treasury, but that the same, in addition, also had marked as settled, both in part and in whole, in the warrant books the recognition and arrears outstanding thereon for diverse cattle places granted on loan, but which likewise had not been paid or brought into the aforesaid Treasury; Your Right Honorable and Most Worshipful had been pleased to find good to specially commission the undersigned to accurately check, from the confrontation of both the protocols of the executed transfers of immovable properties and of the warrant books of the loan places against the cash books of the Honorable Company, all the items of the Lord's dues and loan moneys which have been neglected to be paid to the Honorable Company, in so far as the said dues should have been paid, and the recognition on the places standing erroneously recorded by the aforesaid Horak as settled yet not found brought into the Honorable Company's Treasury, with further order to combine all such items on a general list or account and subsequently deliver it to your Right Honorable and Most Worshipful. submission of the aforementioned demanded of them, immediately after the receipt of the said resolution, having first taken in hand the examination of the books or protocols of the transferred immovable properties since the month of December of the year 178 when the said Horak was appointed as first clerk, up to the day that he was suspended from his aforesaid post, they have, upon the ordered confrontation of the deeds of transfer against the cash books, discovered that the Honorable Company has generally been curtailed and harmed regarding sold immovable properties in lords rights to a considerable sum of ƒ55017:4: or rd:s 18339:8, as appears from the list formed thereof and attached hereto under L: A, there being clearly made known therein not only on which folios the deeds of transfer were protocolled in the books, with the addition of the year numbers and dates of the same, but also the names of the respective sellers and buyers, as well as what the ceded and transferred properties consisted of, along with the prices for which the same were transferred and how much ought to and should have been paid for lords rights. Whereafter, having proceeded with the confrontation of the books in which all the cattle places granted on loan are registered against the aforesaid cash books, it has become evident to us, after the one as well as the other were likewise searched through and checked in the most accurate manner, that in the aforementioned ordinary books very many annotations were recorded not only by the aforementioned first clerk Horak, but also by several other clerks, both ordinary and extraordinary, presently serving at the political secretariat or formerly stationed there, and signed by them, according to which the persons noted therein would have paid in full to the Honorable Company on the whole a considerable amount of rd:s 34660.- both for renewals and arrears of recognitie monies, but of which, according to the records kept of the daily receipt in cash, nothing has come in; meanwhile Your Honors, Noble and Most Honorable, from the compilation which is also submitted herewith, the specific list L: B, which is framed in the same manner as the previously mentioned one, with citation of the names of the farmers who are named as having made the payment of the recognitie monies for the cattle places held on loan, will be able to perceive, if desired, which clerks made the abovementioned annotations, of which however some were found unsigned, and for how many months of renewals and arrears, as well as up to what sums each of them signed. And although this assigned commission does not extend further than to the person of the first-mentioned clerk Horak, we have nevertheless thought it improper to omit bringing that which we have come to discover to the charge of the other clerks regarding the cash box also to the knowledge of Your Honors, so that each of them, in their justifications, will have to show and demonstrate to what extent they, whether with or without intent, have made themselves culpable and liable in that regard or not

The undersigned must further, with regard to the notes concerning the stations whose arrears will have been settled with delivered cattle or trek oxen at the Honourable Company's outposts, state that the receipts that must be granted for this by the respective overseers of the said outposts are only partly present at the Political Secretariat, and that some arrears, both in money and cattle, have also been paid for many months without proper notification, so that we have consequently found ourselves obliged to discontinue and suspend the investigation in this regard until we have received from the cited overseers the general lists of all the cattle that have successively been delivered to their subordinate posts for the aforementioned purpose during the past ten years, so that these lists may subsequently be confronted with the aforementioned notes, and we may then report our findings more fully to Your Honourable Worships. Meanwhile, although we have made every possible effort to investigate in what manner the frequently mentioned first clerk Horak may have arranged and practiced thus to defraud the Honourable Company to a far-reaching extent of its rights and revenues, and to attempt by that path to enrich himself shamefully, we have nevertheless been able to discover nothing further in this regard, except that there has come into our hands a note sub & C: annexed hereto, which was signed by the Noble Lord Governor and granted to the chief sailmaker Cornelis Mol for the payment of the Lord's Dues to the amount of rds 17:24 on account of a house and erf which he bought from the burgher Ch. Jfland for ƒ 10500 and for which a transfer has accordingly taken place, the said Mol having testified to us that he handed the aforementioned amount to the said Horak to be deposited into the cash office, which however, as shown by List L: A:, did not occur. On the other hand, with respect to the loan moneys similarly held by the frequently mentioned first clerk Horak, we have obtained some further light, as it has appeared to us from two receipts issued under his own signature, annexed hereto sub Lib: D: E:, that he has receipted the arrears of recognition money that the farmers Douwe Gerbrand Steyn and Marthinus Els, the former for six years and the latter for 12 years and three months, owed on their abandoned cattle stations named therein, which receipts, however, as they were not granted by the Lord Cashier, are by no means acceptable or valid, so that not the slightest doubt remains that he has made himself guilty of many other such malversations. by virtue of which he was qualified to have the often-mentioned Horak apprehended. Which request having been deliberated and taken into consideration, that the said Horak by the aforesaid resolution is already himself considered to be someone who has made himself guilty of malversation and theft of the Honorable Company's monies, and there thus remains not the slightest doubt either regarding the crime committed or with respect to the perpetrator himself, it was therefore approved to grant the requested apprehension to the said Fiscal, and also that he should immediately proceed with the court messenger to the house of the said Horak to put this decree into execution, while in the meantime the Council would remain assembled to await the outcome hereof, in order that, in case the rumors which have already spread, namely that the said Horak had absented himself, should prove to be true, such further measures could then be taken as the circumstances of the case might require. The pro interim Fiscal, having subsequently upon his return to the Council made known that he had been informed by the wife of the said Horak that her husband had gone to the country, and she still expected him back this afternoon, it was then requested by the said pro interim Fiscal that, if the said Horak—notwithstanding the diligence which he, the pro interim Fiscal, would attempt to employ so as not to render the decision of this Council illusory—could nevertheless not be found nor come to present himself, the same Horak might then tomorrow, against a certain appointed day, be summoned by edict after the tolling of the bells. Wherefore he, the Fiscal ad interim, after obtaining authorization for bodily apprehension and being properly assisted, made a search for Horak at his dwelling house, but received as an answer from his wife that, her husband having ridden out into the country, she nevertheless expected him at any moment; so that the Fiscal, having returned here this morning, nevertheless did not find the said Horak, and was informed by his wife that her said husband had not returned, so that both thereby and according to general rumor it was abundantly clear that he has either absented himself or taken flight. Wherefore the said Fiscal ad interim requested that the aforementioned Horak might be summoned by public ringing of the bell and edictal citation, in order to appear before us on a certain appointed day and to answer for the malversations and theft committed by him, on pain that, in case of non-appearance, proceedings shall be taken against him according to law. Thus it is that we, having considered the aforementioned request, have deemed it good and necessary for the maintenance of justice to cause the aforesaid Johannes Marthinus Horak to be summoned for the first time by public edict and the ringing of the bell, as we do summon and cite him by these presents, to appear in person in judicio in our council chamber at Cabo de Goede Hoop on Thursday the seventh of the coming month of August, in order to purge and answer for the aforesaid malversations and theft perpetrated by him, on pain that, upon failure thereof, further proceedings will be taken against him according to law. With due reverence and most humbly, Yda Margaretha Alleman, wife of the former First Clerk of the Political Secretariat Johannes Martinus Horak, gives to understand: That since the husband of the undersigned had always flattered himself with the certain hope that his affair would be dealt with politically, he had therefore never thought of such means of defense as would now be suitable before the Honorable Council of Justice; That he also remained in that firm confidence until, some time ago before his case was turned over to Justice, he had to learn through rumors that he would be taken into custody, his affair turned over to justice, and be prosecuted by the Fiscal; That seeing himself thus at that moment and entirely unawares threatened with a criminal action and imprisonment, and having been advised by good trustworthy friends to look after his safety, and seeing himself then directly disabled from any means for his defense, he was thus compelled to keep himself in retirement; That he never out of any reasons of contempt [illegible] After the reading of which, Messrs. Khönnenkamp and Van Echten, finding themselves most severely aggrieved by certain expressions appearing in the said petition with respect to the commission entrusted to them by the Honorable Council of Policy in the case of the said Horak, requested a copy of the aforesaid petition, in order to make such use thereof as their Honors should deem necessary, and that at the expense of the estate of the said Horak; which request having been granted, the contents of the aforesaid petition were subsequently maturely deliberated and taken into consideration. Whereas the Council very well knows that the duty of a Judge is, without respect of persons, always to maintain an unblemished Justice, and this Council has also always been intent with the utmost diligence upon acting in all respects according to their oath and conscience, they therefore do not need to be animated or urged thereto by anyone, just as in granting the summary execution on the estate of the said Horak, the precaution now employed by the petitioner has already been used; wherefore, after consideration of all matters, the following apostil was granted on the aforesaid petition: The Council, having read this petition and considered its contents, grants the last item of the request made by the petitioner, namely to retain, according to her choice, some of her slaves and the most necessary household furniture; provided that, if upon the sale the estate should presumably not yet yield as much as the claims made upon it amount to, the petitioner shall then immediately provide proper security for the shortfall; the Council rejecting the remainder of what was requested. and that because some of the aforementioned signed clerks, having had the liberty to make extracts from the submitted note, with those same extracts, upon which were noted the names and places of those for whom they recorded the payment of arrears in the so-called Gamekeeper's Book or signed for the same with their own hands, betook themselves to the Honourable Company's [illegible] and there conducted a close examination, whereupon it immediately appeared to them from that examination that of some the whole, and of others indeed the greater part, of the costs stated as unpaid in the report of the said Commissioners or in the note submitted therewith, had been paid in cash. Now the undersigned asks, yet under reverence and with fitting respect for the high dignity of Your Right Honourable, whether in a matter of so great importance, where the total ruin of an entire family, an innocent and blameless woman and children, is involved, double accuracy and double caution ought not to have been the guiding stars of those who were charged with this so weighty an investigation; and whether, therefore, pursuant to their estimation, the petitioner's entire estate should immediately be liquidated, since it is nevertheless more than probable that of that enormous sum which was placed to the account of the petitioner's husband, many items, just as with the other noted clerks, will also be found well satisfied in the Honourable Company's treasury; as the petitioner's unfortunate husband, before his departure, assured and affirmed to the petitioner under the most solemn protestations that the sum which he, both in lord's rights and recognition money, because of the scarcity of ready money prevailing here, had taken unto himself in order to employ the same for the payment of the overdue instalments on his house and the rebuilding thereof, and yet subsequently in due time consecutively to bring into the Honourable Company's treasury, does not amount to more than 70 to 75,000 Guilders; at the same time warning the petitioner, in his absence, strictly not to proceed to any further payment, but in any case to protest against it, as they never ever enjoyed the same. At an approaching juncture wherein the petitioner could have the surest and most well-founded hope for the betterment of his condition and earthly fortune, as the sole fruits of a twenty-five-year labor, he must to his deepest sorrow learn that, however much he had always applied himself in the observance of all those duties of his service, it had nevertheless been discovered and found that, during the elapsed period of ten years in which the petitioner served the Political Secretariat as first clerk, various transfers and conveyances of sold real estate were executed of which the monies for the lordly dues were not paid into the Company's treasury, and likewise that of various leaseholds the said entrance monies, according to the records in the order books at the Secretariat, were similarly not received into the Honorable Company's treasury. Wherefore, your Right Honorable and Most Respected worships, understanding that all this was caused solely by inattention and neglect of duty at the Secretariat, where the warrants must be drafted and dispatched, and for which the petitioner, as first sworn clerk, could and must in the first place be held accountable, had to take the resolution to qualify the Council of Justice of this Government to seize and place under sequestration all the petitioner's goods and effects, in order to recover therefrom the damage and detriment that the Honorable Company might otherwise come to suffer thereby. What can or may the petitioner now advance in this matter in his own excuse and justification? Nothing else, Right Honorable and Most Respected Lords, than that, appealing solely to your most undeserved favor and kindness, he must confess and acknowledge his guilt as sincerely and candidly as possible, and that these are all the consequences of a wrongful course of action, an inexcusable personal negligence and carelessness on the one hand, and an overly heedless trust on the other. final years of the life of the late Mr. Secretary Bergh, when his Honour, worn out by continuous labour and struggling with bodily ailments, left the petitioner to bear almost the entire burden of the daily management of the Secretariat alone, he was sometimes so overwhelmed with business that he was unable to devote to all daily occurring private matters, which had to be dispatched from the Secretariat and which properly belong to the department of a first clerk, all that attention which would otherwise have been required of him, having sometimes in these urgent circumstances been forced to entrust certain matters to others. It is true, Right Honourable and Worshipful Gentlemen, that the Company neither by the petitioner's improper administration of matters entrusted to his office, nor by his careless placing of trust in others, nor by any other reasons and causes which he has already attempted to put forward for his exculpation, can or ought to suffer the least disadvantage. Nor would the petitioner for a moment seek to call into doubt the right that the Company has to claim reasonable compensation from anyone through whose carelessness or neglect of duty it might suffer any disadvantage. First Clerk ever interfered with that work, except only that the First Clerk was obliged, for the stamp of the receipts for delivered cattle for overdue recognition, and likewise upon the abandonment of loan places, to note the cancellation thereof in the books, or in extraordinary cases, whether in the case of arising disputes between the possessors of those loan places, or on other particular occasions, when by order of the respective Governors one or other notes had to be made and kept in the aforesaid ordinance books, that this manner and method of administration over the frequently mentioned ordinance books continued until a period of two years before the decease of Mr. Secretary Bergh, when his Honor saw fit to make such alteration in that regard that, the book of ordinances of the granting of the loan places remaining on the old footing, the registrations of the paid arrears should henceforth nevertheless have to be signed by the petitioner as First Clerk, as has indeed occurred since then, both by the petitioner and by the ordinary clerks who joined later, although the petitioner now, from a demonstration of the manner and method in which the commissions for the country people in expediting both the ordinances of their loan places and those of the arrears were ordinarily observed and executed, could deduce and present the possibility that existed that very often, and indeed principally in all such pressing circumstances of time in which he, petitioner, as already stated, was almost overwhelmed by manifold occupations regarding other matters concerning his service and had to keep all his attention focused, some abuse could have been made of his misplaced placing of trust in this, in what manner shall the petitioner now finally and at last be able to make to the Company that compensation which he reasonably [illegible], and even if the petitioner could convince your Right Honourable Honours of this in the clearest manner, all that will certainly nevertheless not be able to serve as his excuse that he ought not to have paid more attentive regard to all such matters in which the interest of the Company was so greatly involved, only, the petitioner begs that in this matter it may be favorably taken into regard by your Right Honourable Honours, that, whereas the keeping and administration of the so often mentioned ordinance books of the loan places, for so long a time before it was assigned to him, the petitioner, as stated, had always been entrusted to the ordinary clerks of the secretariat, and indeed particularly to the eldest of them, of whom, however, none are any longer in service here, whether and to what extent he, petitioner, can be held liable for misuses or abuses committed, for which others signed and thus held themselves responsible, he nevertheless submits himself in this regard to such a decision as by your Right Honourable Honours, according to the nature and circumstances of the case itself, for the interest of the Company as well as for the prevention of all harmful consequences which could further aggravate the petitioner's unhappy fate, shall be found to be proper in accordance with your most usual equity and justice.

It is true, Right Honorable and Worshipful Sirs, the petitioner's goods, effects, and meager possessions have been judicially seized and placed under sequestration; however, if these his meager possessions, furthermore encumbered with private debts, would have to be executed upon and sold in the usual manner in a further judicial prosecution, especially in these present times of a generally notorious scarcity of money in this place, the consequence thereof will certainly entail nothing other than total ruin for the petitioner and his innocent wife and children, without him then perhaps even being able to cause the Honorable Company ever to receive its due; thus entirely destitute and incapable of his own accord, the petitioner will therefore, in these his distressed circumstances, need the help and assistance of his family and relatives, as well as other good friends, who have offered, in case Your Right Honorable and Worshipful Sirs would most graciously take this into consideration and grant the petitioner time and delay for the satisfaction of that which the Company, to compensate for the prejudice that it would otherwise come to suffer through his negligence and dereliction of duty, may justly claim from the petitioner, to then provide the necessary surety for the auction. constitutes a severe punishment, forming together a chain of the most dreadful consequences of an unhappy fate that can ever befall a human being in this world, on the one hand causing such deep and most grievous feeling and suffering for a soul in which even the slightest ambition resides, and on the other hand most distressing for the tender heart of a man and father who has nothing left for himself but to bewail with bitter tears the fate of his innocent family; to say nothing now of the harm that the first petitioner has already suffered to his health, through the most painful emotions of doubts and despair, whereby his soul has now been tortured for more than three months; for after the loss of his honor and reputation, offices, income, property, and possessions, he could undergo no heavier punishment than the loss of life and limb. Agreed [illegible] [illegible] to serve as intendit No. 83. 1 And stated: 2 that pursuant to the Political Council resolution of 21 July of this year, the Officer-Plaintiff was also charged with investigating 3 whether and to what extent the other aforementioned and further clerks of that same secretariat, who have signed for the receipt of recognition monies which, however, are not found paid into the Honourable Company's treasury, have been guilty of fraud; 4 and, upon finding, to act ex officio; 5 and that the said defaulting and absconding Quist Mollerstrom, according to the lists compiled by the Commissioner of Estates, was not only personally recorded for the sum of 938 rixdollars, 6 but that he had furthermore declared to Messrs.
