Not being able to occupy ourselves with the investigation of these charges themselves, we limited ourselves in our letter of 25 June last to demanding your considerations whether the charges brought against the aforementioned Sandolroy were of such a nature that they can be investigated and decided here locally, either by the Council of Justice, and what were the reasons of recusal brought by Sandolroy against the first-mentioned. That, those considerations having been sent to us by your letter of 4 July following, it has become evident to us that the aforementioned charges must be considered as twofold, namely those brought by Colonel Gordon in the manner aforesaid, and those of 26 persons formerly having been in the military depot, appearing in a petition to the High Government of India sent to you with a letter of 31 December 1790, whereby you are ordered to cause the complaints mentioned therein to be strictly investigated. And as regards the first of those accusations which Colonel Gordon has brought against the frequently mentioned Sandolroy, the investigation thereof has appeared to us also not to be something that can be demanded of the military court-martial provisionally subsisting here, firstly because of your allegation regarding the validity of the contention of the aforementioned Sandolroy that he cannot be judged by any inferior officers, and secondly on account of your observation of not being able to disavow that, as regards the recusal of officers belonging to the National Battalion, Sandolroy was not able to find among them, at least not among all of them, that so necessary impartiality of the others; the reasons adduced by Your Honour in support of this your sentiment having appeared to us to be in accordance with those rules of law and equity, according to which everyone must have for himself the necessary assurance of being judged by an impartial judge, even if that impartiality is deemed beyond all appearance of doubt by others who do not find themselves in that situation, since it cannot be denied that such assurance cannot be demanded of Captain de Sandolroy on account of what has already transpired in this matter. 435 Appeared before the Honorable and Esteemed Mister President and Council of Justice of the Castle of Good Hope, on the one side the Independent Fiscal Johan Nicolaas Stephen van Lijnden, in his official capacity as Plaintiff in the case of alienated provisions and equipment goods, and on the other side Captain Lieutenant Jan Brugeman, formerly stationed on the Honorable Company's brigantine Helena Louisa, defendant in the aforesaid case. And he stated that the said Plaintiff has been informed, and it has appeared from the accompanying declaration of the crew stationed on the Honorable Company's brigantine the Helena Louisa, 3. that Captain Lieutenant Jan Brugeman, who was also stationed on the said vessel and had command for some time, during that time made himself guilty not only of the alienation and overseer of the Artisans' Quarter George Coenraad Ruchler and the Captain Engineer Louis Michiel van [illegible] No. 2 Copy Valuation of the Honorable Company's territorial possessions in the Government of the Cape of Good Hope, prepared by commissioners from the Council of Justice with the assistance of the Captain of Artillery [illegible] of a portion of the monthly ship's provisions, consisting of peas, beans, rice, butter, and sugar, which he saw fit to hand over to a certain widow Mosterd, Anna Mulder, and the boatman Joseph Heinsz, 4. but that in addition to this he also delivered a new hawser to the said Heinz, 5. who, upon inquiry and interrogation having taken place, did not deny having received both, and himself surrendered and turned over the hawser. 6. Just as the other two persons are likewise not only in confession of having received such goods from the defendant; 7. but the defendant himself has also confessed to having sent and transferred some of the mentioned goods, as well as the hawser, to the aforesaid persons. 8. And whereas it is expressly sanctioned by the Placaats of 12 February 1732 and 11 October 1740, 9. that whoever sells, barters, gifts, or in any other manner alienates equipment goods, munitions of war, ship's tools, cooperage, provisions, etc., shall compensate the same threefold, be dismissed from his office and rank, and forfeit the wages due to him. 10. Furthermore, under 27 February 1748, it was ordained by renewal 11. that no equipment goods are to be alienated, on pain of corporal punishment. 12. Claimant had produced a written claim accompanied by an authentic copy of a private declaration passed by various persons stationed on the ship Helena Louisa. That the petitioner, having heard the same read out, stated in response that he had given away nothing other than 128 lb of rice, namely 60 lb for food on shore for the petitioner's little son and 60 lb sent to Joseph Heins, in order to send some bread in return instead, the petitioner furthermore having had delivered to him, Heins, a piece of rope 2 fingers thick and 2 to 23 fathoms long, while the petitioner testified this to be the pure truth, without knowing of anything else, whereas Your Right Honourable Lordships were furthermore pleased to grant, upon his request, a copy of the claim and annex in order to serve with an Answer thereto today, for which he then also expresses his due gratitude to Your Right Honourable Lordships. Then, however much the petitioner comfortably trusts that he delivered the aforementioned to the aforesaid Joseph Heins without any intention to cause the least disadvantage to the Honourable Company, and to enrich himself thereby, while the same belonged not even to the Honourable Company but indeed to the petitioner himself, consequently he also could not have thought to have committed a criminal offense thereby, over which any criminal proceedings could be undertaken against the petitioner by the Mr. Independent Fiscal, but on the contrary, if the petitioner might have transgressed in anything at all, the same is to be ascribed to nothing other than the petitioner's innocence and simplicity, the more so when one considers, firstly, on what occasion, and secondly, to what end this occurred; as far as the occasion is concerned, it is that the petitioner found himself in the most dreadful situation of oppressive poverty and thus unable to feed his child; and who indeed would behave like a monster of nature toward his own flesh and blood, and in violation thereof see his own child, so to speak, in agony for indispensable natural food, and when Your Right Honourable Lordships consider the small importance of such a trifle, which, it is true, has not escaped the attention of the legislators, it is no less true that the legislator, observing the common imperfection and weakness of humans, especially of a father toward his child, does not make unintentional trifles the objects of punitive executions, and therefore 442 it would very easily be pardoned in the petitioner, and therefore it is after all inherently the case with human nature that something can easily be conceded to the natural weakness and frailty of humans; the petitioner might therefore well await the outcome of those proceedings, were it not that the petitioner, as well on account of the uncertainty thereof as because the same criminal proceedings, even if they were decided in favour of the petitioner, would always bring in their wake a blemish on his reputation, which could possibly be of the most detrimental consequence for him hereafter in the advancement of his fortune; the petitioner has therefore also resolved to forestall the same criminal proceedings in time by appropriate means, if it were possible. That he, the petitioner, hesitated to condescend to the aforesaid request, in consideration of the strictures that would mostly flow from such procedures and their consequences, and which, in the case of triumph, might indeed redound very heavily upon the head of the defender in his capacity, and not this alone. But also, in the event that he should unexpectedly happen to succumb, so as not to expose himself then to the groundless claims and accusations of others, they had excused him therefrom.
