From Souratta, the 14th of May, anno 1757. And another joined as member. Appointment of overseers over the buildings. Arrangements made regarding the other colleges. Two slaves punished for an attempt at sodomy. Completed further with the junior merchant Philip Wargaren, just as was previously decided on the 17th of May to appoint the fiscal and the equipagemaster, as long as the latter is a member of the Council of Policy, as permanent overseers of the buildings. The Council of Justice has undergone no changes since the spring, and regarding the other colleges and regencies, the necessary arrangements were made at our sessions of the 17th of May, 4th of June, 26th of November, and 10th of December last. Judicial matters having been dealt with up to that time in our letter of the ultimo December, it only remains to report that since then, upon criminal prosecution by the fiscal ex officio, his slaves Patientie of Diue and Cardoes of Mallabaar, about seven years old or thereabouts, the Company's prisoners for an attempted act of sodomy, that matter on the date of the 18th of the past month was concluded by the Council of Justice by From Souratta, the 14th of May, anno 1757. Dispatch of their case. Attachment obtained by the warehouse master Sweers on the salary. a final sentence entailing condemnation to be severely flogged according to their years and subsequently to be sold by public auction to the highest bidder, without distinction of nation or religion, on the express condition that they shall never again be allowed to come or be brought under the Company's jurisdiction, on pain of confiscation if it be the fault of their master or mistress, or heavier than the suffered punishment if it be their own fault, and this at the expense of the owner, provided they pay the costs and expenses of justice, which sentence was approved by the Director and carried into execution, the same going enclosed herewith in original along with all the court records of the trial. The warehouse master Sweers has obtained an attachment from Willem Marchis, bailiff of the Council of Justice of this office, on the salary in credit of the fugitive Sea Captain Marchis, to the amount of two thousand eight hundred twenty-two guilders and twelve stuivers, remaining in effect until news should be received here of Your Right Honourables' disposition regarding the petitioner's request sent along with our letter of the 2nd of March and the petition detailed therein concerning From Souratta, the 14th of May, anno 1757. Request concerning this. Required justifications regarding the excessive shortages on the spices brought in anno 1755/6. exemption from the compensation imposed upon him for the aforementioned amount on account of rejected cotton in the ship Bloemendaal, which attachment, having been duly decreed on the 17th of June last as appears from the judicial minute accompanying this in authentic copy, he humbly requests, since Your Right Honourables were pleased to pass over that matter in silence in your latest formal rescript, the interposition of Your Right Honourables' authority for obedience to the same, our pay bookkeeper having only undertaken to give notice thereof in his capacity to India's headquarters, and thus to obey the same to that extent. As a supplement to the rescript to Your Right Honourables' letters and enclosures, it should further be reported that as soon as we received the extracts from the minutes and further papers concerning the spices brought in anno 1755/6 by the ships Luxemburg, Middelburg, and Lapienenburg, we resolved to place those documents in the hands of the warehouse master Sweers, together with the junior merchants Wargaren and Burnat and the assistant Jan George Keijzer, as From Souratta, the 14th of May, anno 1757. To which one refers. Only with this addition. former commissioners in the trade warehouses, to give written account thereon as far as the delivery at this main office is concerned, and of the former factor at Rajapoer, Kroonenbergh, and the assistant Nicolaas Hermanus De Wind, who, together with the young assistant still at that office, Iohan Gothold van Schmidt, served as commissioners there, so far as concerns what was delivered there, as was done by the same in four writings that accompany this in authentic copy together with the sworn reports of the aforementioned commissioners, and to the contents of which we take the liberty to refer, as it has not appeared to us that the truth has been deviated from in the least, only noting in conformity with our resolution of the 20th of April that the present Director, as well as the head administrator and all of us individually, declare upon our word of honour, and offering to confirm this if required with a solemn oath, that we never heard that actually, according to the absurd statement of Sea Captain De Graaf and Lieutenant Kenze, not to give them a worse name, any request was made by the officers of the aforementioned ships,

From Surat, 14 May 1757 wished that the chests of spices might be emptied in order to compare the tare and the net weight, nor to our knowledge has the slightest complaint been made here by them, or any one of them, just as the first undersigned, who having only newly arrived here when Lapienenburg, Middelburg, and 't Huijs te Boede were unloaded, had no suspicion, much less knowledge, regarding the re-weighing of the spices here, which had to be handled differently, as at other outer offices where there is a lack of space to perform the Company's service properly, and where one does not need to consult anyone in that regard; nor have any orders been given, directly or indirectly, by the Head Administrator not to empty the chests, nor to weigh net, but merely gross, and to calculate and declare the gross weight as net after deducting the marked tare, all of which we humbly request may be taken into favorable consideration in the final disposition of this affair, as well as that this council had no knowledge of what occurred at Denda Rajapoer concerning the spices of 't Huijs te Boede, according to the reports of the aforementioned Kronenburg and De Wind, through the omission of a proper notification in the papers, and therewith proceeding to the Continuation From Surat, 14 May 1757. The supercargoes of Rhoon have resolved to come hither. To the same upon their arrival. They declare themselves convinced of the solidity of the reasons not to steer the vessel to Bombay. Continuation of the matter of the ships, concerning which we have in the first place to report that the supercargoes of the ship Rhoon, Walraven, Kroonenbergh, and van Harn, since the second persisted in his sentiment, and they understood that there was little prospect that the export of merchandise from Denda Rajapoer to the Deccan would be opened for a long time, and the indicated voyage to Onor, because it was already so late in the monsoon and they did not have the necessary knowledge of the affairs, likewise could not well be undertaken without danger, have resolved upon given notice to sail hither with ship and cargo, and to place the same at the disposal of this council, which in the session of the 20th of the preceding month, out of an abundance of caution, informed them that they should by no means consider the notice given by order of the council—that the service and interest of the Company did not permit going to Bombay for trade—as a prohibition against doing so, but as a mere warning of its opinion, still leaving them full freedom to act in that regard as they might deem justifiable by virtue of their instructions or otherwise, asking whether they had found the reasons upon which our opinion was based so solid that they had thought to defer to them, not for our pleasure, but From Surat, 14 May 1757 Resolution to send that vessel to Rajapour to overwinter, and meanwhile to see whether to dispose of it, or afterwards at Onor, yet subsequently to come here to fetch cargo. for the greatest service of the Company. Request of the Equipagemeester Falck and the second mate Fransz. for advancement. must return to take in the cotton and other returns for the Indies' Capital, which will then be ready for dispatch, with which arrangement the aforesaid Supercargoes being fully satisfied, that vessel now departs combined with the carriers of this letter, the ships Vlissingen and Lapienenburg from here, to sail in company up to the latitude of Rajapoor, in order that all three may be the better secured against all hostile enterprises. Also, upon the demonstrated necessity by the officers of the said three ships, it has been resolved to provision Rhoon for another six, and Vlissingen and Lapienenburg for another two months, since, owing to the late departure of the two last-mentioned keels, it is impossible to guess how long their voyages may sometimes take. Of the servants, the first master and Equipagemeester of this Directorate Jan Warnar Falck, and the second mate Arij Fransz., of whom the latter is more than a year past his contract and the other has virtually completed his, take the liberty, by two petitions sent among the enclosures to this letter, to request Your Right Honourables' favour From Surat the 14th May Anno 1757 Who they are. The second of Mandvi requests his release to Batavia. and the junior assistant Bunel has received the same. two persons serving at the pen request their advancement. favour for obtaining such promotion as Your Right Honourables shall be pleased to deem fit; in support of which requests we shall only say, with Your Right Honourables' permission, that this Falck is the same one who was spoken of hereinbefore under the chapter of the Gheriah and Bassein Pirates, and the said Arij Fransz. the person who commanded under him on the hoeker de Jonge Jacob and likewise conducted himself as a man of honour. Furthermore, the Bookkeeper and second at Fetsemandvi Carel Benk requests Your Right Honourables by a petition, which likewise accompanies this, for his discharge to the Indies' Capital, which we, as being contrary to the Regulation, could not grant him with retention of rank and pay, as was granted to the junior assistant Hermanus Bunel, who has served out his contract here and is due to cross over on the ship Rhoon. Meanwhile, we could not reasonably refuse, and propose to Your Right Honourables for obtaining their confirmation at the pen with assistant's board money, Sergeant Vincent Koutenberg, who From Surat the 14th May Anno 1757 and a certain under-surgeon for his confirmation. regarding some promotions according to the Regulation and the lesser servants, one refers to the Resolutions. who is not only a good writer but also a good reckoner, who out of necessity has been employed for more than a year at the Trade Office, and the gunner's mate Cornelis van den Bosse, who has been placed provisionally at the secretariat in place of the aforesaid Bunel, and whose handwritten petitions are sent among the enclosures to this letter. The under-surgeon Frans Christiaan Martens stationed at Danda Rajapoor, having been appointed to that rank on the ship Diemen by the Ministers at the Cape of Good Hope under date of 17th September 1754 subject to Your Right Honourables' approval, having had no opportunity during his presence at Batavia to request it, because he was stationed on Onrust, having made a request to us for his confirmation with the pay pertaining thereto from that date, we have judged this to exceed our authority, and therefore found fit to propose the same to Your Right Honourables. Regarding some promotions, both of clerks on shore due to expiration of time etc., and among the non-commissioned officers of From Surat the 14th May Anno 1757 With Vlissingen an incurable Bugis crosses over. Lesser desertion than in the previous year. of Vlissingen, to be found in our Resolutions of the 25th October and 28th November of the past, item 16th March of this year, we take the liberty to refer to the same, as also regarding the degradation of Corporal Johannes Pool to soldier, and the Quartermasters Jan Wagenaar and Andries Jansz. to sailors in the last-cited resolution, and that of the 19th following. On the said vessel Vlissingen there crosses over as incurable the Bugis soldier Batjang from Batavia, who through an ulceration in both his eyes has become virtually blind. The desertion has, through the measures devised in the spring of 1756, since been noticeably less, consisting in total of 27 heads both of the military and seafaring men in a round year, among whom nine who absconded at Danda Rajapoor, item a piper and two soldiers who turned Mohammedan and have been placed under the bodyguard of Ali-Nawaaschan, thus, excluding seven Bugis, still 46 fewer than anno 1756, and

All of which being maturely weighed by us, and having considered that the lodge in case of an attack was absolutely untenable, even if we had, instead of two non-commissioned officers and seven soldiers, enough men to occupy properly all posts where they could attack us, because it is surrounded on all sides by buildings, and one was in danger within the same of being buried under the rubble by the mere reverberation of our own or the enemy's artillery; that we had at the most rice in stock for four days, and had no foundation to flatter ourselves that we could receive any relief; that it also appeared as if the Regents, well informed of our shortage, were minded to wear us down by hunger and thirst, and subsequently prescribe such conditions as they themselves wished; so we devised, as appears from our secret resolution of the 2nd of this month, now accompanying this in authentic copy, 221 From Surat, 15 May in the year 1757. Ending finally this matter. the necessary measures to thwart that objective when danger was imminent, or to die like men of honor without diminishing in the least the rights of our principals through a dishonorable capitulation, of which we shall not cite the particulars here, but respectfully refer ourselves to our aforementioned resolution on that matter, since it was not necessary to come to the execution thereof, as the Company's brokers appeared before the Director on the 3rd of this month, or the fourth of our confinement, reporting that with the greatest trouble in the world they had finally brought it so far that the Regents promised to have the troops march off, who had enclosed the block in which the Company's lodge, the dwelling of the Director, and the further buildings are situated, on these three conditions, to wit: I. Surat, 15 May Anno 1757 They retreated. In view of the great danger of falling into the hands of the pirates with everything they had with them if they dared to undertake the voyage hither without escort on the defenseless battila De Voorn, they chose the former. However, on the 26th, before they could set out on their way thither, news arrived that the Prince had confiscated their dwelling there, accompanied by an order from His Highness to vacate Mandui within the space of half an hour, and that, having with great difficulty obtained permission to pass the night there, they were forced the following day to take up quarters in the open field, in order to seek asylum as soon as possible at Negger with the Company's cash and effects, leaving behind the debt of the Company's broker Taweertjent, who had died a few days previously and whose son remained at court. As this and several other circumstances, which time does not permit us to cite herein, and which nevertheless merit Your Right Honourables' esteemed attention, may be seen in detail in the ordinary and secret letters of the servants of the 14th previously, which we have the honour to present to Your Right Honourables, as well as their aforesaid latest letter, in authentic copy alongside this, together with the copies of our dispatched letters to the Rajah and the factors concerning that incident, to which we take the liberty to refer. From the Portuguese merchant Tiomor Vuegentio Ribeiro we have received a further missive dated 30 March last, accompanied by a translated copy of a contract entered into by the King of Bednore with the English in the year 1725, and a new memorandum of the prices of the merchandise produced by the country. To this we duly replied that likely in the autumn a ship laden with sugar, spices, minerals, and other merchandise from Danda Rajpuri will arrive at Honavar to make a trial of the trade that might be conducted there, with a request to instruct the supercargoes on board regarding the market prices and quantities of merchandise that could be disposed of there or in the vicinity, in order that they may take their measures accordingly; and that in the meantime we shall forward his letter and its enclosures to Your Right Honourables and await Your Right Honourables' orders concerning his proposals. The Fiscal of this Direction having submitted at our session of the 10th instant a report, likewise accompanying herewith in copy, wherein that officer, for reasons therein stated at large, testifies that he can institute no action against the arrested Corporal Jacob Galle or anyone else regarding the death of the previously mentioned native barber, since the same appears not even to be attributable to any carelessness; nevertheless, in order to remove him from the sight of the relatives of the deceased, we have thought fit on this occasion to send him to Batavia, so that by Your Right Honourables' pleasure he may not return hither, in order to give no offense to those people who, notwithstanding all the solicitations of the Regents, persisted in their declaration made from the beginning that this disaster was to be blamed on no one. By the Court of Justice of this factory, on the 9th instant, the trial of the Fiscal of this Direction, as plaintiff in his official capacity, against Anthonij Carlo, boatswain, and Jan Hendrik Velthuijs, ship's boy, both stationed on the ship Vlissingen, prisoners of the Lord, concerning an attempted act of sodomy, was concluded by a definitive sentence. This entailed the condemnation of the first-named to be flogged and shackled in irons, and subsequently to be banished as such to the island of Rosengain, or such other place as Your Right Honourables shall be pleased to decree, there to labour on the public works for his sustenance for the space of five years, and at the expiration thereof to be conveyed outside the Company's jurisdiction, there to remain banished for life; and of the latter, to attend the execution of his accomplice in person, and subsequently, as a scandalous subject, to be banished for the space of ten years outside the Company's jurisdiction, and to that end to be sent to Batavia, and from there onward to the Netherlands, serving during the voyages on the lowest ship's duties for his sustenance; and both delinquents condemned in the costs and expenses of justice, with the further declaration that they have earned no wages since the day of their detention. Which sentence, having been approved by the Director under some remarks, both with regard to the manner of proceeding and the establishment of the pleadings and other matters occurring in the trial, is to take effect upon the occasion of the dispatch of the ships.
