That Ernst Striets of Hamburg indeed, as shown by the muster roll of that vessel held here, arrived in Anno 1760 per the ship 't Huis te Manpad, but neither from that nor from other pay records does it appear whether he was placed on one of the return or other ships; so that there is reason to maintain that he has absented himself from the Honorable Company, the more so because the pay bookkeeper at that time apparently, out of ignorance, for that reason gave him no account in the pay books of the year 1760/1761. The contents of that document were discussed at length, and in particular it was taken into consideration that although the Lords Masters have repeatedly, and now most recently by their letter of the 15 September 1747, absolutely desired and positively ordered that henceforth all insolvent estates of the Company's servants shall be sent over to the Netherlands and there settled, 261 settled, this nevertheless does not seem well suited to take place here in this country in case natives are among the creditors, because those people, being ignorant of our laws, have in case of insolvency no concept of any preference, knowing of no other satisfactions than pound-for-pound equal distribution, and also have no one whom they could appoint in Europe to look after their interests; and therefore, if one wished to execute the aforesaid order here in this country and remit the estates to Europe, they would most vehemently complain of injustice and then address themselves to the Moorish Government, who would then have no hesitation to prohibit this immediately, and in any case to compel the Company to satisfy all such complaining creditors, as they wish to recognize no laws other than those of Indostan.
