Whereas up to now no fixed determination has been made of the duties due to the King of Cochin from the Christians who reside in his country, but are vassals of the Company, and from this uncertainty various odious disputes have often arisen: so the highly esteemed King and the Honorable Mr. Johan Gerard van Angelbeek, Extraordinary Councillor of the Dutch Indies, as well as Governor of this Coast, have deemed it proper, in order to remove this uncertainty and to prevent all disputes, to make a fixed determination of all the aforementioned duties. To that end, the three captains, Ignatio Rodriguez, captain of the Topasses, and Baboe Mattai and Andre Pereira, captains of the Malabar Christians, assisted by the Company's merchant Anta Settij, thoroughly investigated the mutual interests and claims with the King's Prime Minister Gowinda Menon and lesser officials, and subsequently made a proper report thereof to His Highness the King and to the Governor, whereupon this matter was examined and negotiated further and at length on the third of this month between the aforementioned Governor himself and the aforementioned Prime Minister, who had appeared at the government house for that purpose at 9 o'clock in the morning, and thereupon, finally after much debate, a fixed determination was made of all duties that the King shall henceforth levy from the Christians, and after the pleasure and approval of His Highness on all the particular articles had been requested and obtained, the following convention was thereupon concluded, put into writing, and duly signed. Art: 1. The King has, since the Kollam year 937, or according to our reckoning, since 1762, demanded from all inhabitants, and thus also from the Christians, a new duty of one-eighth of the coconut and other fruit-bearing trees, and three-tenths of the paddy crop; the Christians have not paid this duty until now, but it has now been established to mutual satisfaction that the King shall not demand this duty for the past years elapsed up to now, namely from the Kollam year 937 to 959, being according to the Dutch reckoning the year 1762 up to 1784, and that in return the Christians shall henceforth pay the same annually on all gardens and sowing fields which they hold as kana, Nerpattam, and Paneam. The Christians shall also be obliged to pay to His Highness duty on the salt which they make at the aforementioned Kanapattain, Aepattam, Paneam and Boeroepattam, concerning which it has until now been customary that one day was taken for the King, one day for the Queen, one day for the Crown Prince, one day for the Paliat Achan, and one day for the Owner; which custom is now abolished and in its place they shall annually yield to His Highness for thirty salt beds, seven and a half kooties of salt, and no more. Article 5. However, the own sowing fields of the Christians, whether they have purchased or inherited them, are free from the one-tenth and three-tenths, as well as from the salt duty, and they pay nothing. Article 6. Of the lands, gardens and salt pans which have been given in lease to the Christians by His Highness Himself, or by His Highness's subjects, the Christians shall henceforth pay no more than that which was in use in the Year 1775 according to the Dutch or in the Year 950 according to the Malabar reckoning of time, which shall be properly verified by the written receipts and other papers. And in order to settle this once and for all and to make a firm regulation, it has been approved and decided on both sides that all the accounts of what the Christians must pay shall be examined, and from them a fixed list shall be drawn up, according to which payment shall henceforth take place, provided that annually the additional fruit trees are added thereto and the lesser ones deducted; and for this purpose the King's Servants and the Captains of the Christians shall attend daily at the house of the Company's merchant Anta Settij, and if differences or difficulties arise regarding this, the same shall be investigated and settled between the Lord Governor and the Sarwadhikariakaren. And when this account is drawn up, each Christian shall be given a certificate of what he must pay. Article 7. In order to prevent all disputes and disagreements between the Nairs and Christians, which often arise during the collection of duties, it is agreed that the lease monies and duties mentioned herein above shall henceforth be collected, not by the Nairs or other Servants of the King, but by the Lieutenants or Ensigns of the Christians and Topasses, each in their respective parish where they reside, who subsequently shall further account for the same to His Highness or to the person whom His Highness ordains thereto, according to the List which they shall receive from His Highness for that purpose; and in case of default of payment, the King's people shall not use the slightest violence toward the Christians or their officers, but immediately give notice thereof to the respective Captains of the Christians or Topasses, who shall then first ensure that the same are paid; and upon neglect of the said Captains, notice thereof must be given to the Governor or Commander at the time, who shall then make the necessary order therein. Article 8. The term for collecting and again accounting for the duties to the King is fixed, regarding the money of the trees from August to January, and on account of the lands from September to December; and if in that specified time such does not happen to occur, the said Captains shall be called to account by the Governor or Commander at the time and held responsible for it. Article 9. The King promises not to have any trees cut down in the leased gardens of the Christians, unless there should be a great necessity for it, in which case such shall also not happen except in the presence of the Captains in each department, in order to select the bad ones among the trees. Article 10. Regarding the bringing of rice and other provisions here into the city, it is determined that the Christians shall pay the toll thereof on the land of Anje Kaimaal, at Vaipen, Bolghatty, or Palluruthy, along which places the river runs; but on the rice that has once been paid toll there, as well as on the rice that has been pounded from tolled paddy, no further toll shall be paid upon transfer to the city; especially also not on the river or near the city.
