With a request for a favorable reflection on this our application, as well as on his respectful forwarded petition. We therefore once again request Your Right Honourables to cast a favorable reflection upon this our application, as well as upon the original respectful petition submitted by him to us for that purpose at the session of the 5th of this month, addressed to Your Right Honourables, and accompanying this among the annexes, as well as upon the very humble application of of Frans Bernhard Zimmerman, likewise disapproved for the second time as junior merchant, containing: 1st, a humble expression of thanks for the high favor shown to him in the nomination of his person to obtain this respective rank, with a humble request that Your Right Honourables will be pleased to remember him most favorably at all times and on upcoming occasions; 2nd, an expression of the grievous pain which he feels regarding this his second disapproval, in which, however, he must console himself with all obedience and submission; and 3rd, a prayer that it may be Your Right Honourables' All other orders will be observed. great, favorable pleasure to let him retain the title and rank of Junior Merchant, having already had a seat in our assembly for seven years. Having herewith punctually and, as we hope, satisfactorily answered Your Right Honourables' cited precious letter of the 2nd of August, and in accordance with what was decreed on the 17th of November, and letting the orders and commands appearing among the annexes serve as our guideline, we further have the honor in this document to briefly report on all such matters and events as have taken place at this office since the 30th of April last and which we have judged granted for the benefit of two ships necessary to bring to the knowledge of Your Right Honourables at present, letting precede, however, all that has any relation to both of the Honourable Company's ships now returning from here. The matter here with the English and the Nabab concerning the outgoing customs toll, described at length in our more cited humble previous letter of 22 December 1774, having now been settled, as is reported extensively in our resolution of the 15th of this month and in today's general letter, we hope that this will meet with Your High Noble Excellencies' high approval, both on account of our having been unable to delay the settlement of this matter until we could be furnished with Your High Noble Excellencies' highly esteemed instructions therein, of which our resolution of 3 February bears full witness, and also chiefly because this same dispute has been settled according to equity and in such a manner that the Company henceforth shall pay no more than its exact obligation of 2½ percent; and although it grieves us that we shall now be unable to continue to procure for the same Company the small advantage that it was able to enjoy annually on the tolls, it is nevertheless a great piece of good fortune that such a manner of trading was never discovered, whereas it might possibly have ended up costing more in fines than the amount profited therefrom, for which, now that the matter has been placed on this firm footing, there is nothing further to fear. The opposite is just as true, as it is crystal clear from everything advanced that we have never troubled Your High Noblenesses with useless requests and without reason in this matter, much less that we would have complained wrongly about missing an alleged document that was barely worth mentioning. Gentlemen, The Governor of the City has thought fit to prevent us for some days from properly taking charge of the linens and merchandise of our Honorable Company arriving from Brootchia and dealing with them at our discretion, and furthermore to declare that he, the Governor, would no longer permit any unloading or transport of any goods whatsoever, so long as we have not resolved to pay to Mr. Marlij, Member of your Council and Collector of the portion which the Honorable English Company receives in the customs of this city on behalf of the Mogol's Governor of the Castle, a certain imposition on all incoming and outgoing goods, according to a note delivered to us, and this for the benefit and profit of the aforesaid Mr. Marlij, and possibly of all his successors in that office of Custom Master. And however much we have endeavored to demonstrate to the said Governor that, according to ancient customs and the firmans granted by the Mogol Kings to the Dutch Company, we are wholly exempt from complying with such novelty, or even any other by whatever name it might be called, being able to suffice with the payment of the toll of 2½ percent on incoming and dispatched goods established for 150 years, this has nevertheless not been able to bring about that the aforesaid Governor of the City has seen fit to desist from his demand, which conflicts with our privileges. Dutch Company was granted as a perpetual privilege the right to trade throughout the entire Empire, and especially in Souratta, upon payment of a 2½ P:r C:o duty on all incoming and outgoing goods, with this express privilege: that no one, whoever he might be, shall be allowed to take anything more, under whatever name, from it than the aforementioned 2½ percent once in Souratta, along with a prohibition against forming any greed or claim, just as no Regent has ever previously undertaken to encumber its trade with anything else; and on the other hand, that by the levying of such an imposition, the trade of our Company would immediately be burdened and in the future, through the levying of new duties etc., could be oppressed to such an extent that it would become impossible for it to trade in Souratta any longer, it being of no relevance under what name this new tax is levied, all taxes under whatever name being forbidden with regard to us, and consequently, with whatever legitimacy they may be characterized in respect of others, they can never be binding with regard to us; nor can anything be effected against this well-founded argument of ours by the assertion put forward by your Honor's Chief and Council in the repeatedly mentioned letter of the 2:e: June, namely that they could not see why we should not pay this imposition as well as the Armenians, Moguls, and other merchants of this city, these being people who are either native subjects of the Mughal or citizens subject to the common ordinances, and moreover have never been favored with any special privileges. To what extent the other Europeans trading here may or may not have an equal right by public privileges, and in what manner the representatives of those nations are capable of relinquishing their privileges, is not for us to investigate; but this, my Lords, is beyond all contradiction: that neither the impropriety nor the compliance of others binds us, nor can it in any respect move us to sacrifice the Company's precious privileges to the arbitrary desire of this or that person. And we ask of your Honor's own impartial judgment: for what purpose would privileges ever have been solicited and granted if they could lose their binding force, and if the respective Governors and Regents were able to destroy them at the very time when they are bound to protect each and every person in the same? And notwithstanding the strong conviction we had of being able to hope to find here sufficient equity not to be further importuned by this ill-founded demand, and to be guaranteed in all our rights and prerogatives; We were not a little surprised to see by the Letter of the second of this month that your Gentlemen are by no means inclined to do us this justice, and the Custom Master of your honorable Company, Mr. Morley, has already demanded of us a sum of 1624½ Rs. which he claims is due to him according to this newly imposed tax: After all this, and given the notice that your Chief and Council of Surat have given us, that they were awaiting your decisive orders on the matter: We find Ourselves obliged to forward the present to you, and We very strongly hope that the Nawab will leave us in the free exercise of all Our Privileges and will no longer vex us with such demands, which can only cause us many difficulties and losses, and to you, Gentlemen, much unpleasantness. We do not think it necessary, in order to demonstrate to you the insufficiency of this pretension of the Nawab, to enter into new details in this regard; the Letter We wrote to your Chief and Council of Surat, to which we annexed a copy of the Farmans and Privileges granted to us by the sovereigns of these countries, is more than sufficient; all these documents being enclosed in the present letter and translated, form evidence as clear as the sun at high noon. In the refutation that we are about to make of the Letter from your Chief and Council of June 2, we will present the truth in all its strength, and we will advance nothing that can suffer any contradiction on your part; and so as not to weary your attention, We begin by assuring you that We have no other desire than to preserve, as far as it shall be in our power, the good Harmony that currently exists here, and that in this our sole wish, which is very legitimate, is the defense and maintenance of the rights, prerogatives, and Privileges granted to the Noble Dutch Company by the Mughal Emperors, sovereigns of these countries, and which for more than a Century have never suffered any infraction or alteration similar to the one now in question. Although we have no intention of interfering in any way with the revenues that the noble English Company or its employees may enjoy in these Regions, so long as they do not infringe upon Our Privileges and Our Trade; we are nevertheless quite willing to admit that the Nawab, Governor of the City, may be entitled to make Ordinances for the well-being and advantage of his Inhabitants, as the Letter from your Chief and Council of Surat observes; but we will never agree, and the prudent writer of that Letter is very careful not to admit it either, that this power of the Nawab can extend to making reforms, or Laws, changes or reversals, contrary to the privileges granted to one or the other by the sovereign of these countries, (and to speak only of Ourselves) which are specially granted to the noble Dutch Company, because this power of the Nawab, if he had it, would then be contrary to Justice and Equity. Indeed, every order that emanates from a subordinate power has force and Validity only insofar as it tends to fulfill or execute the Decisions of the Sovereign; and such orders can never be given contrary to the will of the one who is in possession of the supreme power, who by his full and entire power has granted to both parties particular Privileges; so that all the ordinances of the Nawab of Surat (be it said without disrespect to the regard we owe him) are without force and of no value with respect to Us, insofar as they in the slightest degree violate our Privileges, and all the more so if they tend directly to infringe or annul them. When We now maintain that this new imposition, according to which everyone must pay to the Custom Master of the noble English Company, whether for your Account or for any other destination, which we do not know, an agreed sum on all incoming and outgoing Merchandise, on each Bale and Cask etc., is directly contrary to Our Privileges and would entirely destroy the Prerogatives granted to Our Company at Surat, we do not fear being contradicted by anyone whomsoever, especially when it will be taken into consideration that, on the one hand, these privileges and Prerogatives were granted to the noble Dutch Company by numerous
