The arrival of the officers brought about what the remonstrances, urgent requests, and tears could not even effect (for they carried off the consul, whose wife and daughter did not leave him), and these men, who ought to have been at the head of those troops, had probably appeared only very long afterwards so that, without hindrance, they could commit all these excesses as they wished and practice pillaging. They also dispersed the commotion, but without abating the unceasing anxiety with which the family of Mr. Anquetil was constantly threatened; they then placed double guards everywhere. The consul, uneasy regarding the fate of the Frenchmen who at that time were wandering here and there through the garden, demanded that they be presented to him. Mr. Trublet, utterly wretched and beaten black and blue, was handed over to him. Mr. Charleville, who had been confined to bed with fever for eight days, was also brought to him, as well as two of his clerks and four sailors of the Curieux. Then, since besides and apart from the blows no fatal accident had befallen the Frenchmen, everyone returned to his dwelling, where these champions, awe-inspiring solely by their multitude, kept them very closely locked up and guarded. Mr. Anquetil did not even know then what could have caused him this night visit, which he considered to be an act of pillage peculiar to the robbery of the Nabob's troops. Toward eleven o'clock at night, the Nabob's servant appeared, who explained the reason thereof to him in these few words, namely: Some merchants have complained to the Nabob that Your Honour owes him money, and they send the chokey so that Your Honour may pay him. Is it with such cruelty, answered the consul, that money is demanded? I do not refuse to pay if I am indebted; others are indebted to me as well, and I am ready to furnish my accounts. But I am neither a thief nor a criminal; what reason is there then to violate thus the law of nations and that of humanity by committing so many atrocities against me, my wife, and my children, against all the Frenchmen who are here, and finally against all my servants? In the capacity of consul, one ought to have respected in my person that of the King of France; but no, as if I were a dishonourable man, my clothes have been torn from my body, and my wife and children have been treated with the greatest brutality and the basest indecency. The consul's servants then came to complain about the thefts committed during the uproar, such as spoons, forks, water jugs with silver, napkins, tablecloths, several skirts of Mr. Anquetil's wife and of his children, and a large quantity of handkerchiefs stolen from the tailor's broken-open and almost completely plundered trunk. These brutes had already divided the booty among themselves; therefore, the searches of the Jamadars returned only a very small part of this plunder. The Nabob's servant returned to his master in order to report to him the success of his expedition. Since the Caffre Jamadar was probably ordered to treat the consul's family in the most disgraceful manner without the least respect or the slightest decency, he let no opportunity pass for this. 273 whose urgent condition necessarily required attention with regard to the widow Du Gras, who had been ill for four months. The sight of these sepoys, who had come foraging right into her room, had caused her to faint several times. Who could ever have thought that this permission to allow the surgeon to come would be refused? The savages themselves would not believe it, and if it was granted after much urging, it was because this shameless knave had the impudence to touch the head and the pulse of the sick woman himself—an act that revolts decency and is even contrary to Moorish laws, even with respect to women of the lowest class. But what does insolence not permit when it is encouraged by impunity and supported by despotism? Mr. Blakeman, an English practitioner, arrived at three o'clock in the French Garden. That honest man can give a public account of the sight, hideous on the one hand and soul-stirring on the other, that met his eyes upon his arrival and caused him to shed tears in spite of himself: tears provoked by compassion and pity. His visit completed, his pockets were thoroughly searched upon his departure, as if the respectability and the dignity of his office did not vouch for his integrity. All those who had dealings with the consul during the entire time of his detention were, upon leaving, [illegible] treated just as indecently. But the insolence committed against the consul and his entire household had not yet reached its highest peak. This final masterpiece was still to come. The entire night from nine o'clock in the evening until the next morning was spent in constant fear and alarm. The clock struck ten in the morning, and whoever it might be among this pitiable family, the father, wife, children, and even servants had not yet been able to obtain the slightest bit of food. The consul's little children, innocent victims of the hunger they were forced to endure, cried out demanding food. The Nabob's men had occupied the kitchen, and no one was permitted to approach it. Fifty rupees that day and as many the following day, counted out to these monsters, satisfied their inordinate greed and, though with great difficulty, provided food and drink for the consul's family. The laws of the land regarding the posting of chokis forbid all actual violence, prevent the troops from entering the dwelling of those whom they wish to place under arrest, and permit only the surrounding of the exterior. Yet all the law of nations, hospitality, humanity, decency, piety, and uprightness—in short, all sacred human rights—were grievously violated with respect to Mr. Anquetil, French consul at Suratte, and with respect to his entire family. The rough outline of these horrors is sketched in this official report, 242 9 2 which is a bare depiction of it. The most authentic compensation in this regard will never erase the sorrowful remembrance of all these dishonorable acts, which lasted 48 hours. The consul, who was ready at any moment to fear for the lives of his beloved and children, exposed in the midst of so many disorders, confusions, and acts of violence, found no better means to prevent all mishaps than to execute an agreement himself and make a general surrender of all that he, his wife, and children possessed. This sacrifice, demanded by force rather than by justice, showed them divesting themselves of their jewelry. This made these savages more humane. On 23 September, on the stroke of eleven in the evening, the Nabob's troops, who had come to demand the consul's life or his purse, left the French Garden, as soon as he, without the least other formalities of a trial, instead of providing bail, had furnished a pledge for which a receipt was handed to him. Consequently, we, Anquetil De Briancourt, in the capacity of Consul representing His Most Christian Majesty here, protest against all the acts of violence mentioned in this official report and against such detrimental consequences as might arise therefrom to the detriment of the credit of the French Nation at Suratte, reserving to ourselves the right to convey our most weighty complaints in this regard. To the Worshipful Rawson Hart Boddam Esquire, Chief for affairs of the British Nation and Governor of the Mogul's Castle and Fleet, in Council at Surat. The Noble Netherlands East India Company has the right to export her merchandises throughout the whole Mogul Empire, if by import she has paid the duty of 2½ percent, without being obliged to pay any more customs thereof. This right appears amongst other things very plain by the Firmans which were on a precedent occasion laid before you by our commission upon the 24th June 1773. Worshipful Sir and Sirs, In consequence of which we have according to custom lately acquainted the inspectors who are ordered by the noble English Company to take care for their share in the custom, that we would send some merchandises abroad; but they have sent us word that henceforth this could not be done without paying thereof once more the duty for exportation. We request therefore of you gentlemen that you will inform the said custom house inspectors hereabout, and give them the necessary orders that the exportation of the merchandises belonging to the Company may be done without any further impediment. We are making this request in the most friendly manner, and with all the confidence possible reposing upon the written assurances given us by John Spencer Esquire and Council the 10th February in the year 1759, and which were afterwards ratified in the most solemn manner by the Honourable the Governor of Bombay, Charles Crommelin Esquire and Council, in their letter dated Bombay 25th January 1765. Copy To the Honorable, Respectable Sir Jacob van de Graaff Commander of this Directorate. To His Excellency The Most Honorable, Most Respectable, Wide-ruling Lord Reinier de Klerk Member of Council on behalf of the state of the United Netherlands and its General Company Governor-General and The Most Honorable and Rigorous Lords Councillors of India Most Honorable, Most Respectable, Wide-ruling Lord and Most Honorable and Rigorous Lords Your Excellencies were pleased to order, by your missive of 8 August 1778, the undersigned members of the Political Council at Surat to pay to the Honorable Company the balance of the estate of the late Secunde Bangeman, and this in reduction of the debts of the Brokers to the said Company. The said members therefore take the liberty to remonstrate and represent to Your Excellencies in all humility: That the petition of the Brokers, inserted by Resolution of 21 February 1774 from which the disposition of the Lords Superiors and of Your Excellencies emanated, was intended for no other purpose than to obtain that same privilege which has always been granted here to native creditors, and had previously been permitted in the estate of the Fiscal de Jongh, who died here; namely, that to them, as the sole native creditor in the estate of the said Bangeman, preference over all others might be granted, and that accordingly the proceeds of his estate might be handed over to them, in reduction or satisfaction of their claim, and that in such case those funds might be received into the Company's treasury in reduction of their debit to the same. That the decision of the Council taken thereupon shows that, in consideration of Your Excellencies' permanent orders always to give preference to native creditors, the testamentary executors, the former Director Bosman and the Storekeeper Monte, were authorized to pay the remaining funds of that estate, after deduction of the funeral and medical debts, to the Brokers under security of restitution, and to subsequently count this into the treasury. That Your Excellencies were pleased to conform with the aforementioned decision of the Council in your revered missive of 18 August 1774, with this express restriction: that the Brokers would have to provide security of restitution. From this, the remonstrants and Council very humbly think they may conclude that just as the request of the Brokers was aimed at enjoying the privilege granted by Your Excellencies to all native creditors, the decision of the Council was intended to procure the same for them, while Your Excellencies' revered missive of the aforementioned 18 August assured them of that same privilege; and that it could never have been the intention of the Surat Council to immediately take over, by such a decision, the debt claim of the Brokers against the estate of the Honorable Bangeman, or his testamentary executors, but only that they allowed it to be received into the treasury upon payment; and that Your Excellencies were pleased to understand it in the same manner is evident from your order not to have these funds paid before and until the Brokers should have provided security of restitution. Clear proof that this claim of theirs remained at their own risk and benefit, and that they were obliged to demand it from the executors once they had posted this security, which was never done by them. And although the former Director Bosman had indeed undertaken in their meeting to count the amount of these funds into the treasury, as the remonstrants took the liberty to inform Your Excellencies in their humble missive.

missive of the 25th of December 1774, such did not alter anything of its nature, nor was the same therefore transferred to the Company; the Executors remained accountable to the Brokers, and the latter for their debts to the Company, just as they themselves also never understood it otherwise, for on the 13th of December 1776 they themselves resolved in meeting to keep whatever of this sum should not be recovered for their own account, as appears by the Resolution of that date. Thus the Remonstrants hope that they have demonstrated that it always was and remained the obligation of the Brokers themselves to look after their interest, and how indeed were the Remonstrants capable of doing so, under a commander such as the Gentleman Bosman, who was not to be moved by any good reasons or representations, and who never wished to comply with their made requests and instances, especially of the first undersigned, as appears by the resolution of the 31st of August and 4 November 1776. They could not accuse the aforementioned Gentleman Bosman before the Court of Justice, for who indeed among them would have made the claim, and who would have pronounced the verdict, and even had this been possible, the executive power nevertheless always resides in the person of the Commander himself, and thus the Remonstrants had no power to compel their then Commander to compliance, besides which they had never seen any financial statements of this Estate, nor were they aware of the sums for which they could have held the Gentleman Bosman accountable, even had they possessed the power to do so. Wherefore the Remonstrants most humbly request that Your High Honours may be pleased graciously to exempt them from the payments imposed upon them of the balance of the aforementioned Estate. Extract from the Resolution taken in the Council of Policy at Souratten, Friday the 4th of December Anno 1778: The Gentleman Director communicated to the assembly that these days there came to him a Portuguese sailor, who reported to him that a Company ship had ended up stranded at Rio de Lagoa on the African coast, and that further and broader information thereof could be requested from the Gentleman Burton, captain of a vessel sailing under the Imperial Flag and belonging to the Gentleman Bolts, which had recently arrived from there, and as the aforementioned Portuguese sailor believed, had also brought letters for this assembly. That His Honour thereupon immediately dispatched a letter to the aforementioned Captain Burton with a polite request to please inform him what there was of this, and that if he had letters, he would wish to send them to him, whereupon yesterday evening the following reply was received. That it is beyond all doubt that the Cape ministers, as soon as they receive news of this incident, will immediately send the necessary assistance thither, but that it may easily happen that this news arrives there too late to be able to reach Rio de la Goa before the change of the monsoon, and that in such a case the assistance from the Cape by sea cannot be there before the month of March or April next. 3rd. That on the contrary, by departing from here still within this month, barring unforeseen adversities, one can be there in the latter part of January or the beginning of February, and that the ship and crew may at times be in circumstances where no sufficient haste can be made to bring them all the aid we are capable of providing from here; it has been resolved and agreed, after having first taken the advice of the Skippers Kuijl and van Es, both summoned to the meeting for that purpose, to send with the utmost speed to Rio de la Goa the smalschip De Jonge Petrus, which was judged fit for undertaking this voyage by the two aforementioned skippers, under the command of the Equippage Master Johannes Boelen, crewed with as many good native sailors as it can conveniently carry, and provisioned for 7 months; as well as to place thereon, to assist the Equippage Master, the second mate of Landskroon, Daniel de Haan. Your Honour's ship lying at Delagoa, here The Venus, Capt. Pensondar, destined from Batavia to the Netherlands, had already been underway from Batavia for 5 months when they fell off; they were almost as far as the Cape of Good Hope, but the winds being so terrible, and the distressed situation in which they found themselves, having caused their timber to creak in several places, while besides that they barely had 5 men in a watch capable of managing the ship, caused them to resort to this taken measure to which they were certainly forced, for the preservation of ship and cargo. They had, I believe, lost 60 men before they fell off, and the remainder were for the most part in such a distressed condition that they were incapable of standing on the deck. During the short time that they have been at Delagoa, upon my arrival there, they have moreover buried another 7 to 8 men. The Captain himself was very ill when I departed, and all the officers in a very distressed condition. I do not believe that there were more than 10 to 12 men on board capable of performing duty. They intend, and I fear indeed they will be obliged, to remain there until such time as they shall have obtained assistance from Your Honour, or else through Your Honour's intervention from the Cape or from Ceylon. I would regard it as a favour if it were in Your Honour's power to convey my best respects to Mr. De Brisincourt, the French Consul, his beloved wife, and daughter, as well as to assure them of my gratitude for all the kindnesses and favours received from them. General Comparison of the Profits and Charges against the established provisions, with attached reasons from which the differences take their origin; namely For the profits: in the Memorandum of Management dated 9 May Ao 1755, a sum of ƒ867000:—:— was stated, which reduced by one-fifth or in heavy money amounts to ƒ693600:—:—. The Lord Director communicated to the meeting that the Banyan Siwidas Nagerdas, brother of the Banyan merchant Tabidas Nagerdas, came to report to him yesterday evening that the former Director Martinus Joan Bosman, who came over from Bombay to Surat some days ago, had this brother of his arrested by the English Chief, Mr. Boddam, on account of a claim he, Bosman, claims to have against him; and that he, Siwidas Nagerdas, at the same time, in the name and on behalf of this his brother, reclaimed the protection of the Company granted to him by deed of the last of August 1756 by the late Councillor Extraordinary Taillefert at the time he was Director here, and the Council. The 25th of February Anno 1778. Whereupon, having deliberated and taken into consideration that everything that occurred as mentioned in the aforesaid Resolutions are matters arising from the insolvent estate of Tabidas, in which only his creditors had an interest at that time, and that he seems to have done nothing in all these circumstances that could or should have deprived him of the protection of the Company, it was unanimously agreed that the aforementioned Tabidas Nagerdas must still be considered to be under the protection of the Dutch Company. Subsequently, it was proposed by the Lord Director whether the said Tabidas Nagerdas should be claimed from the English Government by virtue of the protection granted to him by the aforesaid Act. Upon which second point, having deliberated and taken into consideration: That the English Government in particular is entirely unauthorized to have any of the Company's dependents placed under arrest and to arrogate jurisdiction over them, for the Castle Governors, if they wished to assume this capacity here, never had the right to do so, and that they may do so even less as servants of the English Company. 2nd: That it is meanwhile beyond doubt that if this is allowed to slip by and the English Government is allowed to proceed in exercising its jurisdiction over the said Tabidas Nagerdas, who is under the Company's protection, it will not stop at this, but that in the same manner all the others who are under the Company's protection will be exposed to this persecution. 3rd: That this is all the more to be feared because the arrest of Tabidas occurred without any preliminary inquiry and without it having yet appeared whether and how much he owes the former Director Bosman, as they say, solely upon the demand of Bosman to have an audit of accounts from Tabidas covering 18 or 20 years, and that if it is sufficient according to English laws or customs to have someone detained upon such a bare demand, Bosman could make this same demand against everyone with whom he has ever conducted any trade, and on account thereof have him arrested or at least subject him to great trouble and affronts. 4th: That this is all the more to be feared because one cannot doubt that the said former Director Bosman has arrived here, among other things, with the intention of causing the Company or its dependents as much vexation as possible through the English Government, of which, among other things and besides various other malicious conversations that it is said he held from time to time in Bombay, may serve as an example that when the Company's Moedie Mannik Dada visited him a few days ago, he, according to the reports of this man, said among other similar things that the Company unlawfully occupies the [illegible] road that runs across the Wharf, and consequently has no right to have it closed off with gates on both sides of the Wharf, and that he, Bosman, would certainly know a way to compel Their Honors to have both of these gates torn down and to leave the road open. 5th: That although Their High Mightinesses, in Their Most Honorable missive of the 31st of December 1773, recommended and ordered that no steps be taken for the promotion of private interests that could bring the Company into trouble here with the Government, the case in question is of a completely different nature, and it is not a matter here of

333 The 25th of February 1778. had sent him as Second, to request in the capacity of a friend of Mr Boddam to release Tabidas and hand him over. Mr Boddam replied to this, after prior protestations of his readiness to maintain good harmony, that he judged he had the right to keep Tabidas under arrest until he should have provided bail, on the grounds that he was said to have acknowledged the debt to the former Director Bosman, and that one always acted in such a manner with all inhabitants. Whereupon, it being answered by the undersigned that although such was practicable with the natives and the English, such could have no place at all with persons belonging to and under the Dutch Company; that he, Mr Boddam, and even the Nabob, did not have the least right over these subordinates of the Company, but that if any complaints were made regarding their conduct, those had to be brought before the Dutch Director, and in matters of meum and tuum, that those belonged to the Council of Justice there, just as such was also previously practiced by the English regarding our claims upon their subordinates, citing in support of this argument the case of Mr Boucard; Then Mr Boddam changed his tone and said that Tabidas had not claimed the protection of the Dutch flag, nor had told him that he belonged under it, adding thereto that he was inclined to hand him over, provided the Director accepted and promised that he would send him back whenever he required him again concerning his affairs with Bosman. To this the undersigned replied that [illegible] The 25th of February 1778. such a promise on the part of the Director was impossible, as His Honour was not permitted to let anyone among the subordinates of the Dutch Company stand trial or appear before a foreign judge, while outside of this Company no one could claim any right or jurisdiction over this Tabidas, and that accordingly the former Director Bosman, if he believed he had any action against this Tabidas, must bring it to the place where it belonged; Mr Boddam, answering to this that he was prepared to let Tabidas go from his arrest if it was accepted to let Mr Bosman receive proper justice; the undersigned replied that he could give his word for that, adding that the Dutch nation was not accustomed to withhold that from anyone; and whereupon it was then accepted by Mr Boddam to release Tabidas and send him immediately to the Director with his books; subsequently Mr Boddam said that this matter would then be considered as settled in an amicable manner, and that he would take no cognizance thereof or have any record kept in his resolutions, whereupon the undersigned answered that such would also be understood likewise among us, according to his thoughts. Furthermore, the Director communicated to the meeting that the repeatedly mentioned Bosman sent him a message this day and had him asked to come and speak with him; that he had replied to him that the circumstances did not permit receiving him at the shipyard, but that the next day he would go to the Company garden Zorgvliet and that Mr Bosman could come to speak with him there, if he thought fit; that in consequence thereof he went in the morning, accompanied by the Merchant and Fiscal van der Sleijden, to the said garden Zorgvliet, [illegible] 354 The 25th of February 1778. and shortly thereafter the said Mr Bosman came to him and requested copies of all the letters and resolutions relating to the points of charges that have been imposed on him; that he answered thereto that if Mr Bosman had to make such requests to the Company, the same had to be done in writing, whereof it was resolved to keep this record.
