34 47 by refusing so reasonable a request, Your Honours deprive us of the means to judge their claim in accordance with the standard that Your Honours set for yourselves, that is, their firmans. This further insistence and repetition of the demands made by letter of 28 February seemed to indicate awaiting a further reply; nevertheless, Mr. Boddam and his Council proceed to say: "however, we are always willing to support Your Honours in all the privileges that Your Honours' Company actually enjoyed at the time we took possession of the Mogul's Castle & fleet, in accordance with the assurances given to Your Honours at the time by our Chief." After having laid this foundation, by which Their Honours limit the maintenance of our privileges solely to those that our Company actually enjoyed at the time the Noble English Company took possession of the Mogul's Castle and fleet, Mr. Boddam and his Council continue by saying: "Since we, through [illegible] the very one-sided appearance of your firmans, which Your Honours have seen fit to present, can form no judgment whatsoever on their claim as a privileged firman, we shall therefore also not view it in that light; it is consequently only necessary to decide whether Your Honours actually enjoyed this privilege at the time we took possession of the Mogul's Castle & fleet." To that end, Their Honours say that they have made all necessary investigation, and that the result has convinced Their Honours that the privilege we now claim was not granted to us at that time, and that therefore a pretension so greatly prejudicial to the rights and revenues of the Mogul cannot be permitted by Their Honours either. Herewith, therefore, the state of the dispute has not only been greatly anticipated, but through it we are also finally denied the right to the privilege that we claim; and this upon two entirely untenable grounds: namely, that for us the right of possession is necessary, and that we did not have it at the time determined by Their Honours here above; and we therefore do not doubt that Your Right Honourables will find that it is with very just cause that we now address ourselves directly to Your Right Honourables. What Mr. Boddam and his Council call a very one-sided appearance of our firmans, through which they can form no judgment on our claim as a privileged firman, are without doubt the extracts of the firmans which, as we have noted here above, are entered in our letter of 22 February, and literally correspond with the old translation that we have of them. Yet it is evident from the foregoing that we have grounded our right not on these translations, which Mr. Boddam and his Council call very one-sided, without however pointing out any defect therein in any part, but on the original documents which we have offered to produce. As regards the aforesaid restriction of the guarantee of the privileges of the Noble Company, by limiting the maintenance thereof solely to such privileges as our Company actually enjoyed at the time the Noble English Company took possession of the Mogul's Castle & fleet, this runs directly contrary to the clear and literal content of this guarantee. John Spencer Esqr. and his Council, after having previously stated the reasons that moved Your Right Honourables at that time to procure satisfaction for themselves by force of arms, say in the letter written to us by Their Honours to that end on 18 February 1759: "We take this opportunity to inform Your Honours thereof; and we faithfully assure Your Honours that the execution of these measures shall in no way infringe or diminish any privileges in trade or otherwise that the Noble Netherlands East India Company or Your Honours yourselves have obtained at Surat;" which solemn declaration was subsequently confirmed in the most emphatic manner by Your Right Honourables yourselves in Your Honours' highly esteemed letter of 25 January 1765, with assurances of Your Right Honourables' steadfast efforts to preserve inviolate the privileges of the European Nations residing in Surat. It is consequently all obtained privileges that are guaranteed to us thereby, and not solely those that our Company actually enjoyed at the time the Noble English Company took possession of the Mogul's Castle and fleet; and it is therefore also of no consequence whether our Company actually enjoyed the privilege in question at that time, other than that it further confirms the reality of this right. It is unknown to us what evidence came before Mr. Boddam and his Council in the investigation that Their Honours have conducted, and of which they say that the result has convinced Their Honours that we were not at that time in possession of the right that we now claim. If the written orders that the City Governor repeatedly issues to his officers upon the export of the Company's goods are preserved at the customhouse—which we do not know—these might already provide very good proof of the actual possession of this right. asked, Mr. Boddam and his Council could have provided a very decisive proof that demonstrates the actual possession of this right, and which must be found in their Honors' own archives. In the year 1762 we had the displeasure of falling into a dispute with the Mr. City Governor, and the unrest over it rose so high that we resolved to request the mediation of the English Chief and Council at Souratta therein, who accordingly took it upon themselves. In that capacity, the Mr. City Governor presented to their Honors several points which he claimed to have against us, and made among others at article 6 verbatim the following complaint: "The Dutch merchandise, such as sugar, spices, etc., which Gouwenzam, Pandool, and Mantcher, their brokers, buy from them and sell again to the merchants in the city, are transported by the said brokers under the name of the Dutch Company without paying toll, thus keeping for themselves the amount of the export duties that the merchants pay them, which being highly unjust and tending to the great detriment of the Government cannot be permitted." It having been observed on our side that our brokers had been questioned on this, and that they had denied the abovementioned accusation, the English Chief and Council, as mediators, replied thereto in their letter of 1 September 1762 on the sixth: "The Nabab proves his accusation by the testimony of Caljaandas Perhotembas and Critkendae, two brokers of known credit and means, who each individually declare that they have bought Dutch goods from your Honors' brokers Pandool and Mantcher at high prices, in consideration that these have given them permission to export the said goods toll-free, for which they would otherwise have had to pay 5 percent to the Government, and that according to their estimation or valuation; and if more proofs are required, the Nabab adds that he can produce them." Both this complaint of the Mr. City Governor, which was sent to us translated into English by the gentlemen mediators, and the aforesaid answer of their Honors themselves prove in the clearest manner both the right itself and the actual exercise thereof, since it speaks for itself that we must have had and exercised this right, or our brokers could not, according to the content of the complaint of the Mr. City Governor, have made misuse thereof. This appears even more clearly from the continuation of the gentlemen mediators' aforementioned letter, wherein their Honors say: "From this it appears that the Government has suffered greatly through these unjust practices, and that according to equity reparation ought to be made for it; but as it would cost very much time and endless trouble to make up the account thereof exactly, the Nabab and all others who have an interest in these revenues will have to rely on your Honors' word of honor to prevent their brokers from doing so in the future." This proposal of the gentlemen mediators, according to which this point was subsequently settled, was acquiesced in by both sides, and for the settlement itself their Honors took the guarantee upon themselves, as appears from their letter of 24 September 1762. All this demonstrates the right that we now reclaim so clearly and indisputably that we can hardly understand how it could have been called into doubt. Meanwhile, our Company has remained deprived of the use thereof during this entire navigable season, which has caused very great damage to its trade, and we therefore very subserviently request your Honors to be so good as to cause all further hindrances therein to be removed through your intervention, and thereby to restore the breach that has also been made to the privileges of the Dutch Company; if your Honors should deem it necessary to see, over and above the firmans mentioned in appendix No. 3, also all the other firmans that have been granted to us in proof of the right in question, we have, apart from what we have indicated on this subject above, no reasons not to have both the one and the other of these firmans exhibited, and we would also ultimately have preferred to offer this to Mr. Boddam and his Council rather than to insist upon extreme rights and lose time uselessly, if this could still have taken place after the receipt of their Honors' letter of 20 March. As for the other firmans that were given for other purposes, these can be of no service whatsoever in the case in question. We also take this opportunity to request your Honors' permission that we may have the place where we are accustomed to store our gunpowder somewhat better secured against the accidents that we have to expect from it every day. The same is enclosed on three sides between walls of stone and lime, and on the fourth side thereof there is only a wall of bamboos smeared with cow dung, of which the ceiling is also made. We have requested Mr. Boddam and his Council to be allowed to have the necessary repairs made to it, and their Honors have also been so

Your Right Honourable and Honourable, by these presents, for the kindness that you have had to impart to us the instruction sent to Mr. Boddam and his Council, to acquiesce in our offer made to them by our letter of 18 March last. Likewise, we thank Your Right Honourable and Honourable for the permission granted to us to carry out the necessary repairs to our powder magazine. The production of the firmans took place on 28 August, and at the same time we had given the members of our council who displayed them the necessary instructions to enter into a conference thereupon, if needed, with the commissioners of Mr. Boddam and his Council. But the said commissioners declared that they were instructed in nothing else than solely to collate the original firmans against the copies sent of them by us. Having thus far waited in vain for the further necessary reply thereto, we have this morning caused Mr. Boddam to be spoken with regarding this, who has informed us that his Honour had already sent to Your Right Honourable and Honourable the translations that his Honour had caused to be made of the aforesaid firmans, and was awaiting the reply of Your Right Honourable and Honourable thereto. We do not doubt that these translations will have been found to agree with those that were inserted by us in our letter written to Mr. Boddam and his Council on 22 February, as we otherwise believe we may hold ourselves assured that Mr. Boddam would have appointed a further meeting. Extract from the Requisition of Respectful Answer to the Beside Requisition of Returns from the Indies for the Year 1779 determined the 16th October 1777, received at Batavia the 11th June 1778, and here the 1st November thereafter. Regarding the Linen Trade, the improvement which we, with Your Honour's help, have obtained in the quantities of the different sorts of Linens, has at the same time produced an increasing growth of profits for the Company. The Yields, from which one can see the profits that the Company has achieved, and the Information which was sent to Your Honour after the conclusion of the Autumn sale of 1776, demonstrate at which Offices people have exerted themselves the most, and which sorts also still demand a greater Attention from the Subaltern ministers at the respective Offices. As appears from our Resolution of the 23rd January of this Year, we have been in a position to conclude the contracting of the Linens and Cotton yarns specified on the opposite Requisition for the prices that were paid for them in 1777 and in the Last preceding Year; the same are all sent with the Ship Europe to Ceylon in order from there to proceed further to Your High Right Honourables, and since nothing has been left unattempted to make the same of the required quality, we flatter ourselves that the same will obtain the approval of Your Right Honourable High Mightinesses. Finally, it will be useful for Your Honour to recommend to the ministers at Surat to ensure that the Requisition we are now making is fulfilled with the required attentiveness, so that our advances, which have now increased for several Years, are not diminished. Currently that of the Linens at Surat amounts to 30,900 pieces. On account of the same reason as was stated under the Immediately preceding matter concerning the lack of Papers, we can mention nothing special with regard to the Requisition of this Office, and therefore confine ourselves to the hope that Director van de Graaff, who is currently at the head of this Directorate, will take Care that the Company, regarding those articles of the cotton yarn and Linens, is dealt with with Fidelity and competence. The white Berempaats have all the requested 3,000 pieces this time fulfilled in pieces 25 long, broad 7½ ells dressed; for those of 24 ells long and 1½ cobidos broad was paid last Year rupees 88 1/2 the corge, and since they are now One ell longer, there was paid for this One ell above the previous price 3 1/2 the Corge. The ordinary Niquanias of Surat of 8 threads long 19 to 20 Ells, and the Brouwles or Chiadder Boraals, are delivered for the prices that were paid for them in the Year 1772, being the Lowest price of all preceding Years. Although the Cutch caused a loss at the sale last Year, we have nevertheless requested 1,000 lb of it again, merely not to lose sight of this medicine. Returns from the Indies for the Year 1779, determined the 16th October 1777, and received at Batavia the 11th June 1778, and here the 1st November thereafter. The Quantity of cloths that we currently demand, and of which the specification follows below, amounts to a Quantum of 30,900 pieces; as soon as the sale shall be finished, the findings of the Linens will be sent to Your Honour with Honcoop, written in order that one will be able to Regulate oneself accordingly in the future. This order was granted by the Nawab only a few days before the English Government prevented the Dutch Company from the further exercise of the right to export its goods free of toll. Concerning the Toll, how it is calculated, as well as in what places, and on what goods it may and may not be taken. On all merchandise that we import and export, the toll must be paid according to custom at 2½ per cent. See firmans of the years 1618, 1627, 1645, 1662, 1709, and 1712. However, such goods as serve for personal use, such as clothing, consumption, bodily needs, crafted gold, silver, and copper works, jewels, all kinds of provisions and victuals, are entirely toll-free both upon import and export. See firmans of the years 1618, 1643, and 1712. On everything that has once paid toll at Souratta upon import, no one may henceforth demand any toll at any place whatever it might be. See firmans of the years 1631, 1633, 1638, 1643, 1657, 1662, and 1712. On all merchandise that we trade in Agra, Dillij, and other places, and bring down via Amed-abaad, as well as on the linens and other goods that we purchase in Amed-Abaad, Patten, Dholka, Cambatt, Brodera, Brootchia, Ocelisser, etc., and transport to Souratta, no toll may be demanded or taken anywhere except only the customary 2½ per cent in Souratta. Translation of a Firman, in the Persian language, granted by King Djahan-Sjah for the benefit of the General Dutch Chartered Company to Mr. Joan Josua Ketelaar, Director and Ambassador, in the first year of His Majesty's reign, on the 14th of Rajab 1123, or according to our calendar in the year 1712. To all present and future governors and officials of the seaport of Souratta, be it known in hope of the King's favor: That in these happy days in which justice is maintained, Joan Josua Ketelaar, Ambassador, Director, and Plenipotentiary of the supreme Governor-General of the Dutch Company, has appeared at the greatest Court in the world, and there, with the assistance of those who are acquainted with His Majesty's secrets, has represented: That pursuant to the granted firmans of their late Majesties, Sja-Jehaan, Orang-Zeeb, and Sja-Alem, who have now departed to Heaven, it was established and granted; that on the goods which the Dutch purchase in Agra, assessed at 12 for every 10 of purchase value, and the goods traded in Amedabaad, at 10½ for every 10 of purchase value upon import, the customs toll may be collected in Souratta according to that calculation and custom; but as for the goods collected in Souratta, Brodera, and other places, the actual cost shall be determined according to the invoice and the toll demanded accordingly; but the Dutch shall be exempt from road tolls and transit duties. However, 3½ percent was collected from the Dutch, namely 2½ percent for toll and 1 percent for brokerage, whereas from other merchants no more than 2½ percent is demanded, without their being troubled for 1 percent. And since in these days all transit duties and road tolls throughout the whole of Hindoustan are free and have been remitted by the King; therefore he lived in hope that through the King's favor this 1 percent might likewise be remitted to the Dutch. Since all the King's thoughts are directed toward the prosperity and flourishing of the merchant: The King, who must always be obeyed, orders that the Dutch shall likewise be exempt from this 1 percent brokerage; it is therefore required that this order of the King be obeyed and that no one shall trouble them in the future regarding this, but continue to collect the toll according to former custom, while no one shall be permitted to contravene this order or demand more. It was further represented to the King that the Dutch imported woolens and other goods from certain seaports into Hindoustan with their ships, and in turn traded indigo, linens, saltpeter, and other wares both in Agra and other places and transported them to Souratta; they therefore also lived in hope that the King's order might be given that, after payment of the toll, which in Souratta has been fixed at 2½ percent since ancient times, no one, in accordance with that custom, shall be permitted to trouble them in Souratta and Brootchia for anything more, but that they shall remain licensed to sell their goods to whatever merchant they desire, and to transport them to whatever places they are inclined, likewise to purchase goods from whomsoever they wish, and also to employ in their service such brokers as they themselves desire at their own discretion; while no one shall be permitted to intrude into their affairs without their consent. These requests have all been granted through His Majesty's favor; therefore the King orders that no one shall be permitted to trouble them in the aforementioned matters. It was further represented to the King that His Majesty's order might be given that the Dutch should not be forced to bring the copper they import into the mint at Souratta, but after payment of the ordinary toll be licensed to sell that metal throughout the King's lands wherever they desire; without the merchant who comes to buy this copper from them being troubled on account of the purchase. Whereby the Dutch will import more copper annually; whereupon the King's order was given that no one shall compel the Dutch to bring their copper to the mint, but after payment of the ordinary toll license them to sell that metal throughout all of Hindoustan, or wherever they desire; likewise that no trouble may be caused to the buyer on that account, so that they may import much copper according to their promise, whereby there will be an abundance of this metal. Upon these supplications the King has ordered and determined that no merchant or other persons being indebted to the Dutch shall be permitted to delay, but the regents must ensure that they, according to justice, come to obtain their monies, while it must not be tolerated that anyone protects the debtors; Likewise that whenever the Dutch ships depart for Gamron or other places, and any merchants were inclined, under payment of the proper freight, either to accompany them in person or to load goods therein, no one shall be permitted to hinder this, just as it is also permitted to them to hire as many carts, camels, etc., for the bringing in and conveyance of their merchandise as are needed. It being further submitted and requested to the King that in the bringing in and conveyance of goods, both by water and by land, serving for use, whether for clothing, consumption, personal necessities, as well as fabricated gold, silver, and copper works, item jewels, all kinds of provisions, and necessities of life, they may not be troubled and addressed for the delivery of any tolls; Likewise, whenever a Dutchman of the Dutch Company should happen to absent himself, hide, or run away, the regents shall be obliged to arrest and apprehend the said absented or runaway person, and as such hand him over again to the Dutch Captain; Just as it was further requested that, pursuant to the order of His deceased Majesty Orang-zeeb, the collectors of the Jizya or poll taxes shall not trouble the Dutch and servants reckoned under the Dutch Company for any poll taxes; Also that the house of the deceased Ettebaarchan, situated in Souratta, may be given to the Honorable Company as a perpetual residence for the Company's servants, under condition of not making thereon bastions and embrasures, or placing thereon large or small artillery; likewise not to make or build thereon anything other than dwellings and rooms for residence, item warehouses for storing merchandise, or other necessary repairs. The King grants all these requests, and orders that no one shall cause hindrance in this regard. It was also submitted to His Majesty that the General sometimes sent over 10 to 15 horses for his servants, in which no one should cause any hindrance either. Hereupon His Majesty's order was given that no one shall be permitted to trouble them on account of 10 to 15 horses which they bring in yearly, whenever they are not worthy of His Majesty. All these orders are most highly recommended to everyone, and it is ordered that the King's command must not be transgressed, nor is a new firman to be demanded for this every year. Translation of a Firman in the Persian language granted by the King Sja Alem to the benefit of the General Dutch Chartered East India Company to Mr. Iohan Grotenhuijs, Director of the Surat Directorate, at the request of the Governor of Surat, Amanetchan, the 2nd year of His Majesty's reign, or the 19th Shawwal 1120, or according to our reckoning in the year 1709. Be it known to the present and future regents and servants of the King in the seaside city of Souratta: That upon the representation of the Governor Amanetchan, the King has learned that the Dutch, who had left Souratta, had returned through his good words and promises, thus requesting from the King's goodness that the Dutch be forgiven their committed misdeed and their desires be granted. The King, being merciful, has not only forgiven their fault, but has also granted that which Ian Grotenhuijs, Director and Envoy of the great Dutch General, has submitted in writing on the back of this firman; It therefore requires that the Dutch be met with an amicable and friendly treatment in Souratta; No one therefore, under whatever pretext it might be, shall be permitted to bring any hindrance to them, to the end that they, as before, may conduct their trade there in complete peace. First, that the 20 Lakh Rupees which the Souratta merchants and others took from them by force may be returned. Whereupon the King has ordered: That after the merchants whose goods and ships were taken are satisfied, 8 Lakh and 11,000 Rupees shall be given to the Dutch. Secondly, that in the 5th year of the reign of the deceased King Orang-zeeb, it was established by a firman granted by that monarch that for all goods 2½ percent toll must be paid; and in Souratta and Bengal 1 percent was taken instead of Jizya or poll tax, and thus together 3½ percent. Hereupon the King has ordered that henceforth no more than 2½ percent shall be taken. Thirdly, that from the goods brought from Sillij and other places via the Brootchia road, there is taken, above the ordinary toll that is always paid in Souratta, an additional 1½ percent. The King orders hereupon that the 1½ percent which was additionally taken in Brootchia is remitted. Fourthly, that all servants of the Dutch Company, as well as brokers and chiefs, who travel throughout Hindustan to conduct trade, shall for no transit duties or other road expenses...
