Articles drawn up and presented to the Commissioners from the Honorable Worshipful Council of Justice of this government by and on behalf of the Independent Fiscal Mr. Willem Cornelis Boers, in order to examine the master of the hooker De Snelheyd, Roeloff Pietersen, defendant in person, his replies to be given in the margin of each article duly noted. Appeared before us, the undersigned Commissioners from the Honorable Worshipful Council of Justice of this government, Roelof Pieterse of Amsterdam, master of the hooker De Snelheyd, who answered the adjacent questions as noted alongside each of them. Article 1 The defendant in person's name, age, position, and place of birth. Says: Roelof Pieterse of Amsterdam, aged 43 years, master of the hooker De Snelheyd. Article 2 Whether he, the defendant in person, did not command the hooker De Snelheyd when it was sent for the last time to Saldanha Bay. Says: Yes. Article 3 Whether he, the defendant in person, was not there with his hooker at the same time as the Honorable Company's ships Honcoop, De Paarl, Middelburg, and Dankbaarheid. Says: Yes. Article 4 Whether it was not known to him, the defendant in person, at that time that the Crown of England had declared war on our Republic, and that the said ships and his hooker were therefore sent thither in the hope that they would not be captured by the English. Says: Yes. Article 5 Whether he, the defendant in person, received orders from anyone to take all the sails of the said ships into his hooker, then to make fast behind Schapen Island, and, if the ships should be captured by the English, then to set fire to his hooker. Says: He did receive orders that, once he had taken in the sails of the ships, he was to make fast behind Schapen Island, but that he never had any order from whomever it might be to burn his hooker, and furthermore had received no other order than the one delivered in writing to the Commissioners herewith, which is of the following content: To keep secret. Sir and Friend, You will please take care that, upon the arrival of an enemy force here in the bay, all your crew and officers, as well as the men of the post with the arms you have at hand, come hither immediately in the boats and sloops that are above, and help us offer defense. Do not leave more men there than those keeping watch, and inform the postholder of this. As soon as the Frenchman is off the roadstead, we hope to come to you; he must not know where we are going. Underneath stood: Your Friend. Was signed: G. Harmeyer. In the margin: 3 July 1781. On the reverse stood: To the Master Pieterse, master of the hooker De Snelheyd, lying in Riet Bay. Article 6 If so, by whom he was so ordered. Says: As before. Article 7 If not, whether a ship's council was not convened by the Commander of the said ships, Gerrit Harmeyer, at which the defendant in person was present, and in which an order and instruction was disclosed to him, the defendant in person, given by the Right Honorable Governor and the Honorable Worshipful Political Council to the masters of the said ships for their observance. Says: Yes, he was once at a ship's council in the beginning when they had arrived in Saldanha Bay, and at that time the said order and instruction given by the Honorable Governor and Honorable Worshipful Political Council was indeed read aloud, in which he heard nothing about burning his hooker. Article 8 Whether to have the said instruction shown and read to him, and then to inquire whether he, the defendant in person, never knew anything of the said instruction. Says: Yes, that this is the same instruction and order, and that it was indeed read out in the meeting, but at that time he did not understand from it that he would have to set fire to his hooker. Article 9 Whether all, or at least some, sails of the said ships were not given to him, the defendant in person, in his hooker. Says: Yes, at first he had almost all the sails, but later, in the end of June, the greatest part was fetched away again. Article 10 Whether on that occasion, or afterwards, it was never told to him, the defendant in person, why and for what reason they wished to have the said sails stored in his hooker. Says: No. Article 11 Whether he, the defendant in person, was not present on board his hooker when the signal was made from the Postberg that some ships were seen at sea, and when the English fleet arrived there. Says: Yes. Article 12 At what time the said signal was made. Says: By estimation, ten o'clock. Article 13 Whether he, the defendant in person, did not thereupon send a mate to the shore to learn what was seen. Says: Yes, upon the signal which the postholder made to that end. Article 14 Whether he, the defendant in person, then or previously, made or caused to be made any preparations to burn his hooker pursuant to the aforesaid order. Says: No, he did nothing in that regard. Article 15 If so, in what did they consist. Lapses. petition presented to Your Right Honourable Worships by the former commander of the hooker de Snelheid, Roeloff Pieterssen, upon which Your Right Honourable Worships were pleased to see fit to place the said petition into the hands of the undersigned Independent Fiscal of this government in order to serve this Council with his report and considerations thereon, the undersigned shall have the honour briefly to remark upon the request made in the said petition: That, regarding the first part of the request made therein, namely to be permitted to lodge and prosecute his appeal against such sentence as was previously pronounced and passed against him on the 15th by the College of this Council in such criminal case as was pending before this Council between the undersigned ex officio and the said Roeloff Pieterssen, with respect to that request it can and ought only to come into consideration: 1. Whether the said sentence by the College of this Council was purely and simply based on the defendant’s own personal confession, or whether any other evidence or documents produced either in that case or in the proceedings of the other skippers provided the foundation for the said conviction. That in the first case, namely if the said sentence was delivered upon the defendant’s own personal confession, without the intervention of any other document that might be subject to any qualification on the part of the defendant in person, then, since his proceedings were initiated and prosecuted in an extraordinary criminal case, he ought by no means to be granted permission to lodge his appeal here or to prosecute it elsewhere, since according to the universally known and generally received principles of law it is beyond all dispute that a person convicted in an extraordinary criminal case purely and solely upon his own confession is not entitled to claim any means of appeal against such a conviction, as is found deduced in great detail by De Groot in his justification of the lawful government of Holland, Chapter 12; by Mr P. Bort in his treatise on appeals in criminal cases, Parts 1 and 5; Merula, Neostad, and all others who have ever written on that subject, to such an extent that by resolution of the Noble and Mighty Lords States of Holland dated 10 September 1591, it was understood that those of the High and Provincial Council of Holland shall grant no provisions upon the request of any persons against whom proceedings shall be conducted extraordinarily in a criminal case and upon their confession, but the sentences passed in the aforementioned cases shall be executed against the convicted persons without any appeal, reformation, or challenge being permitted against them. That, on the other hand, in the opposite case, if the defendant in person was not convicted solely upon his own confession, but some other documents outside his confession may have given rise to the said conviction, then also the lodging and prosecution of his appeal cannot or ought not, with humble reverence, to be refused him. That furthermore, regarding the second request, the same in the view of the undersigned can only be considered as an accessory which must follow its principal, and that thus the granting or withholding thereof will have to depend on the form upon which the conviction itself is based. Thursday the 8 November 1781. In the morning, present the Honorable Pieter Hacker, President, and all the members, except the Honorable Petrus Ludovicus Le Sueur due to indisposition. The Honorable Independent Fiscal Mr. Willem Cornelis Boers, by virtue of his office, Plaintiff, Against The Commander of the hooker de Snelheyd, Roelof Pietersen, in person, Defendant, to hear such claim together with request or requests as the Plaintiff ex officio shall see fit to make and take against the Defendant, to answer thereto, and further to proceed as is customary according to the style in criminal cases. The Honorable Plaintiff ex officio, presenting interrogatories answered by two persons who were stationed on the hooker de Snelheyd, requests, before making his claim, that the Defendant in person may be ordered to answer to such articles as shall be delivered for that purpose by the Plaintiff ex officio to the Commissioners from this Council. The Defendant says he is willing to do so. was deliberated in the Council of Policy, it is nevertheless very likely that the person who made the plan must have been qualified to do so by the said Council, and that the undersigned possibly even gave his consent to the said qualification. This being so, it is also equally likely that this work could have been assigned to no one other than the Equipage Master van Gennip, as directly belonging to his office, with orders to consult with the Commissioners Kuuhl and Holtzapfel, who had the goods to be loaded in their custody, and the Trade Bookkeeper Kirsten as keeper of the invoices. The undersigned is all the more strengthened in that opinion when he observes from the statements given and negotiated in the report of 30 June 1784 that the Equipage Master van Gennip entered into negotiations concerning that plan with the aforementioned persons, having requested from the one a list of the merchandise in their custody, and having sent for the invoice of the ship 'T Huis te spijk from the trade office. However matters may stand with the said qualification, and whether or not the undersigned gave his consent to assign the drafting of that plan to the said van Gennip or to other persons, and although he is unaware who should be regarded as its author, he nevertheless dares to flatter himself that the High-Commanding Lords Masters, together with Your Right Noble Fierce and Right Honourable Worships, will please rest assured that the same was assigned to the person deemed most capable, and he, together with all the members who constituted the Council of Policy at that time, although nothing proves that they gave their consent to that choice, must nevertheless necessarily have voted for it and will also have voted for it. This being so, and the choice of the most capable person or persons having been made, the undersigned hopes that the High-Commanding Lords Majores and Your Right Noble Fierce and Right Honourable Worships cannot interpret it as a neglect of duty that he fully and quietly relied upon that person or persons to whom the drafting of the aforementioned plan was assigned. And assuming, as all circumstances seem to indicate, that the Equipage Master van Gennip had drafted that plan and had consulted with the skipper Huizing, the Commissioners, and the Trade Bookkeeper, it was certainly drafted by the only men capable of doing so, and to whose report one was accordingly obliged to conform. The undersigned in no way denies that the plan of the cargo, according to which the report was made to the Right Noble Great Honourable Lords Directors, was submitted by him for that purpose in the meeting of the Council of Policy, but dares repeatedly to assure Your Right Noble Fierce and Right Honourable Worships that he was, and still is, unaware of the person who handed it to him. It is most natural to suppose, and one might be almost certain, that this can have been done by no one other than the late Trade Bookkeeper Kirsten, since the same was prepared at the trade office, the only place where calculations of that nature are made. Yet this can in no way remove the presumption that the Equipage Master van Gennip must be regarded as the actual author of the plan; for it is indisputably evident from the given statements that he directly took the trouble that the one to whom the drafting of the design had been assigned ought to have taken in order to carry it into execution. And what is less subject to objection than that the plan, as it was delivered to the meeting of Your Right Noble Fierce and Right Honourable Worships by the undersigned, owes its origin to the said van Gennip, was sent by him to the trade office for calculation, and from there was handed to the undersigned to be submitted to the meeting! Concerning the alterations made to the aforementioned plan, as appears from comparing the draft of the cargo with the invoice of the actual cargo itself, the undersigned can repeatedly assure Your Right Noble Fierce and Right Honourable Worships on his honor that he had not the slightest knowledge thereof, and flatters himself that nothing from all the documents produced in this matter will show that this occurred on his authority or with his approval. than to most respectfully and preliminarily submit to your Right Honorable Sirs and Worships, that he requested the invoices from the Trade Office with no other intention and purpose than to discern therein how many packages, bales of coffee beans, and couwers were still resting in the ship Buys te Spyk, and not to form therefrom a proposed cargo for the ship de Kroonprins van Pruijssen, since no mention thereof was made on the memorandum of the ordinary commissioners. The undersigned does not deny, but rather completely acknowledges, that according to the nature of his post, and as the Gentlemen Masters are pleased to note correctly and rightly in their most revered circular, it entails drawing up and putting in order the plans and cargo of the ships, but in this case he did not occupy himself with it, indeed strongly and firmly denying ever having received an order, neither from the former Lord Governor van Plettenberg nor from the Chief Administrator Hacker, to form a plan of the cargo for the ship de Kroonprins van Pruijssen, especially since the monetary amounts were specified and made known therein, because the invoices where the monetary amounts are stated have always been kept concealed from him with the utmost circumspection, for what reason is completely unknown to him, and if it should still happen to him, when the utmost necessity requires it, that he must look into it, then it has never occurred except in the presence of one or another clerk of the Trade Office, just as took place when he requested the invoice of the ship 't Huys te Spijk, as appears from his granted declaration dated 12 June 1784; but on the contrary he received an order from the cited Lord Governor and Chief Administrator, and that only orally, to load that vessel with such goods as were on hand in the government and the ships present, without having received any specification of what the monetary amounts had to be, furthermore even expressly denying having spoken or consulted about that subject with either Captain Huyzing, or the late Trade Transferer Korsten, or the ordinary commissioners Kuuhl and Holtzapffel, while they also never received an order for that purpose, as appears from the above-mentioned declaration, since the said Kuuhl and Holtzapffel thereby declare most clearly and in the most solemn manner to know nothing of a plan. The undersigned took the liberty just now to acknowledge that the nature of his post entails making the plans for ships that are laden here and to take counsel and communicate in that regard with the Trade Transferer, in order to be able to determine and know the monetary amounts, but in the case at hand that never occurred; the undersigned did indeed, Right Honorable Sirs and Worshipful Gentlemen, from the provided memorandum of the ordinary commissioners, form for his own speculation a plan or project that he deemed necessary and useful for the loading of the above-mentioned vessel, but he never showed or delivered the same to anyone, whomever it may be, and even less provided a copy thereof, and which memorandum, without the monetary amount being known therein, contained all such goods as were on hand in this government and resting in the ships, as well as those that had to serve as cargo for Europe, and which memorandum he demanded in order to cite thereon and note such goods as could be loaded in the Kroonprins van Pruyssen, so as not to commit any mistake in that regard, since he had not the least note of what goods were on hand with the government, and wherewith the remaining ships for Europe had to be laden and dispatched. The reasons and motives that have moved the humble subscriber, Right Honorable Sirs and Worshipful Gentlemen, not to have wished to submit and declare under oath with respect to the statement or non-statement of the plan of the cargo in writing or not, are very simple as well as without any of the least complexity, the same consisting herein: Firstly, because he directly or indirectly is not the maker of the plan in question, nor did he receive any order from whomever it may be to form the same and put it in order. an established rule and custom that when the Master of the Equippage must serve with a memorial, declaratory report, or whatever it may be, concerning his service and department, he is enjoined and ordered to do so by a written ordinance, written at the secretariat and signed by the Governor, to serve with such required papers in writing; which papers have always been drafted for the undersigned at the political secretariat according to custom, following the draft that he provides thereof, and of which a copy with the ordinance signed by the Governor remains deposited there, to serve as proof in due time. And it is very remarkable that such an ordinance, precisely now that it comes to a meeting, and which they would very much like to charge to the undersigned's account, cannot be found at the secretariat, and the current trade bookkeeper Casparus van Eerten does not know on whose order he wrote the draft of the cargo of the ship the Kroonprins van Pruissen, although it is very likely that he must know on whose order and command that draft was made, and who gave the order for it, because at the time of the deceased trade bookkeeper Kirsten, he mostly took care of and observed the business of that office in person. In addition to which, he also very much wishes to declare that he is not capable of it, much less could he recall what he might have given to another by verbal statement to that end in such a case. But on the contrary, it is certain that if the undersigned had been required to form such a draft and submit it in writing, they would certainly have done so by an ordinance. And if it was submitted in writing, then according to the above-cited established custom and rule, three distinct pieces of evidence as living and vocal proof ought to have been found at the secretariat, whereas at present, now that it comes to payment, not a single one is to be found. And therefore it is certain that such a draft was never conceived into the world by the undersigned, nor the ordinance required for it, or that precisely in this case, and where it comes to payment, they acted negligently at the secretariat. And for all these reasons, the undersigned respectfully maintains that in this case no oath can be demanded of him, but that the greatest right in the world is on his side to refuse the same, which often, through the passage of time, could run directly contrary to his own writing. This having also been one of the principal causes and motives why he refused to confirm his declaration under oath, because he is not unaware that the head administrator, Mr. Pieter Hacker, had introduced the aforementioned draft in question to the Honorable Political Council, and notoriously also had to know who the author of the same was.
