From the ship Toggersbank, the chief surgeon Lebbing remained here due to illness, and the chief surgeon of the stranded hooker Katwijk aan Rhijn was transferred back onto it; the vessel departed with 1 chief surgeon, 2 second surgeons, and 1 third surgeon. NB: The ships in the year 1786 all sailed with 1 chief surgeon. In the year 1787. From the return ship De Schelde, the chief surgeon died, and that vessel departed with two second surgeons; the humble signatory presumes that one of them must have been qualified for the service of chief surgeon, and was perhaps advanced thereto upon approval by the Right Honorable Ordinary Councilor Boesses, whilst he does not recall that any proposal was made to fill that post, and such servants are also very difficult to find in this Government for the return ships. From the ship Hoorn, the chief surgeon Prediger remained behind due to illness, and the vessel departed with 2 second surgeons and two third surgeons. The aforementioned chief surgeon Prediger assured that one of the second surgeons was very capable and able to perform the service as chief surgeon, and the same will presumably have been appointed thereto by the ship's council upon approval of the High Indian Government; on the ship Pollux, which was mustered at the same time, there was only one chief surgeon; the ship Sevrathan was destined for Ceylon; of Voorschooten, one second surgeon and one third surgeon died on the voyage, and 2 second surgeons remained behind due to illness, which is the reason that both chief surgeons remained on board. From the ship Belvliet, the chief surgeon died on the voyage, and the chief surgeon who arrived in the service of the Honorable Company with the chartered ship Josephus the Second was placed back onto it. From the ship De Generaal Maatsuiker, the first chief surgeon died on the voyage; it still had a second chief surgeon on board. It pleased your Honor and the Honorable Council, by resolution of the 3rd of August last, to place into the hands of the undersigned Pay Accountant and Chief Surgeon of the Hospital of this Government a copy extract of the Fatherland Dispatch dated 3 December 1789, with orders to serve your Honor and the Honorable Council with a report and considerations on the seven paragraphs cited therein; in compliance with this order and to account for the personnel who remained behind here, the undersigned Pay Accountant presents the one under letter A to your Honor and the Honorable Council, demonstrating the number of personnel who remained behind at this corner in the years 1787 and 1788, with which ships they departed from here, how many have died and gone missing, and subsequently still continue in this Government, the number of which amounts for the year 1787 to 387 men and for the year 1788 to 318 men together, 705 men. Of whom, with suspension of wages, are on loan: 14. At the Line: 53. In the Hospital: 70. Total: 137. When one deducts these personnel as not assigned to fixed, permanent posts and on duty, amounting to 137, there remain 568 who are assigned to various posts and places and are on duty, specified more broadly in the cited memorandum. more than 250 heads, the number of which cannot possibly be definitively determined, for the reason that the discharged, the deserters, and the deceased differ noticeably from one year to the other; and the respectful assumption that the required personnel for this government amounts to 250 men per year makes 500 men for 2 years. Added to this, that the artillery has been increased by successive resolutions passed by your Right Honorable and Worshipful sirs, and this augmentation was approved by missive of 31 December 1788 by the high-commanding Gentlemen Majors, the number of artillerymen as of the last of June 1786 having been 190 men and on the last of June 1788: 381, thus in 1787 and 1788 increased by 181; on the Equipage Wharf also provisionally placed in the year 1788: 20; together 701 men, who were roughly needed both for keeping the posts complete and for increasing the artillery and for the service of this government. By a comparison of the number of those who remained behind with the number of required personnel, the undersigned believes to have clearly and distinctly proven to your Right Honorable and Worshipful sirs that no more personnel remained behind here from the years 1787 and 1788 than were necessary; and let this serve for the report and response to the first two paragraphs. Under Lit. D, I have the honor to present to your Right Honorable and Worshipful sirs a specific extract of the state of the ships dispatched to this corner in the year 1788, to which under Lit. t is annexed a recapitulation from which it will please to appear that fewer were placed on those keels than remained behind: 703 men. From this should be deducted the military personnel taken ashore according to the express list sent by the Gentlemen Majors and placed at the national depot, who were sent to Batavia in September 1789 per ship d'Eensgezindheijd, amounting to 179; remaining 524 men. When from this are deducted the deceased and the deserters, specified more broadly in the memorandum under Lit. A and the recapitulation annexed thereto, having amounted as of the last of August 1788 to: deceased 215, deserters 50; 265; there remain 259 men. As of the last of June 1787 the artillery was strong 313 men, and on the last of June 1788 381, thus increased by 68 men; on the Equipage Wharf in the year 1788 also provisionally placed 20; together 88 men, with which the strength of this government has increased. Subtracting those 88 from the above, there remain 171 men, after deduction of the personnel placed on the ships at this corner in the year 1788, who have served partly to keep complete the garrison, artillery, outposts, etc., and partly could not be sent away because of persistent illnesses. Wherewith the undersigned Pay-Bookkeeper hopes to have demonstrated to your Right Honorable and Worshipful sirs that in the year 1788 no more personnel were retained than necessity required. Regarding the increased number of the incapacitated during the lay days of the ships, the undersigned chief surgeon may have the honor to assure your Right Honorable and Worshipful sirs that from most ships, during the time they are lying here in the roads, patients are brought in daily, and sometimes even ten to twelve on a single day, whereby frequently the number of the successively brought-in incapacitated exceeds the number of the sick brought in upon arrival here in the roads. The reasons for this the undersigned chief surgeon believes to be chiefly the change of diet; the ship's crew having been accustomed during an outward voyage of about four months to hard and salted food, and upon arrival in this roadstead for the most part more or less scorbutic, through the use of fresh vegetables and foods, to which sometimes delicacies of fruits and cookies etc. brought on board from the shore are added, the disordered body is set in motion and they usually fall into a diarrhea, from which, while the ships tarry only about fourteen days in this roadstead, they cannot be restored so quickly and must remain behind until another ship's opportunity. Wherewith we hope to have properly elucidated §43 and §44 to your Right Honorable and Worshipful sirs. Regarding the large difference that occurs between the number of the incapacitated and the convalescents in the years 1777 and 1778 and 1787 and 1788, the undersigned Pay-Bookkeeper has the honor Lit. t to append hereto an extract of the persons remaining behind here from the passed ships two months before the last of June, from which it appears that the said number in the year 1787 amounted to 397 men and in the year 1788, 483 men. The undersigned chief surgeon must testify that the ships in the years 1787 and 1788 not only brought many sick people here, but even many severely suffering patients; it having happened more than once that while carrying up the sick from the pier to the epidemic building where the incapacitated are sheltered, they paid nature's toll on the quay and were brought inside lifeless. the large number of ineffectives is solely to be attributed to a fatal misfortune, as also took place in the years 1772, 73, and 74, when those years were compared with the ten preceding ones of 1762, 63, and 64, the undersigned Pay Bookkeeper taking the liberty to present to Your Right Honourable and Worshipful Sirs this Annex under letter C, an Extract from the general returns usually drawn up under the date of the last of June in this government, from which, if it pleases you, the difference will become apparent. Of the bad and dangerous condition in which the sick arrived, Your Right Honourable and Worshipful Sirs will be even further convinced when you are pleased to take into consideration the great number of the deceased, and particularly that those ships from which the most remained behind also had the greatest number deceased, a proof that with such keels the most severely and dangerously sick were brought in, and that the detentions took place out of necessity. Concerning the Line, the undersigned Pay Bookkeeper may have the honour to state for the elucidation of Your Right Honourable and Worshipful Sirs that since the last war of the Republic with the Crown of England, the garrison here having been notably increased, it has resulted that various posts, with the number determined under date of 6 July 1756, could not carry out the Honourable Company's work, and provisional men from the Line were added to them; and for the reason that such persons receive their rations there, they are accounted for under the last of June among the convalescents, which is the reason why their number is larger than in former years. From this it also arises that persons continue at the Line for years, among whom may also be counted those who permanently serve at the Line, such as cook, report-carrier, etc., as well as the free labourers of Your Right Honourable and Worshipful Sirs, who formerly belonged under the military of the Battalion, but since the last War were also taken off that roll and entered onto the Line. The number of the aforesaid provisionally serving men amounting to about 150 to 160 men, it will appear to Your Right Honourable and Worshipful Sirs upon deduction that no more men were at the Line than took place in former years. Wherewith we hope properly to have elucidated Your Right Honourable and Worshipful Sirs; and concerning the mustering out of people, both the undersigned may have the honour to assure Your Right Honourable and Worshipful Sirs that this was done by the chief surgeons of the ships themselves, who also sign a certificate thereof, which is delivered by the Bookkeeper of the Honourable Company's Hospital to the secretariat of Your Right Honourable and Worshipful Sirs and, as the undersigned Pay Bookkeeper presumes, is sent annexed to the letter that goes off with each ship to the Gentlemen of the High Indian Government, so that in this respect action was taken in conformity with the intention and desire of their Right Honourable High Worships the Lords Majors. The convalescents at the Line were regularly sent to Batavia upon the departure of each ship, and the mustering out thereof was also done by the chief surgeons of the ships, as appears from the certificate of the Bookkeeper of the Honourable Company's hospital annexed under letter H, to which the undersigned Pay Bookkeeper respectfully refers. Hoping herewith to have fully demonstrated and proven to Your Right Honourable and Worshipful Sirs that the shortage of people at India's capital was in no way caused by an unnecessary detention of men in this government, but is rather to be attributed to the bad condition of the crews with which the ships arrived here, and that the musterings in the hospital and at the Line were done in conformity with the desire of the High-Commanding Lords Majors, and that no persons were detained at the Line except such as provisionally serve at one or another post, we have the honour to let this serve as a humble report, and subscribe ourselves with deep respect. Duplicate W No. 18 No. 79 Duplicate Applicant Duplicate The undersigned Colonel Commandant of the Regiment of Wurtemberg, having received a resolution adopted by the Noble Regency on 3 September 1790, by which it orders him to hand over to the Independent Fiscal, Mr. de Linden, the named Hofmeister, formerly a sergeant in the Regiment of Wurtemberg, guilty of having manufactured counterfeit paper money, has the honor to inform His Excellency the Governor as well as the Noble Regency that he has not failed to fulfill the content of this order exactly and with the most respectful obedience. But as the undersigned finds himself in the position of being responsible to the Noble Company, to the Most Serene Duke of Wurtemberg, and to the regiment he commands for the maintenance of the solemn contract by which the regiment is in the service of the Company, it is his most sacred duty to submit on this occasion before His Excellency Pro Memoria to His Excellency the Governor and to the Noble Regency His Excellency the Governor as well as the Regency a formal reservation of all rights and prerogatives whatsoever founded upon the capitulation of the regiment, of which the very honored resolution of the Regency has provisionally deprived the regiment; the undersigned declaring furthermore that he considers Article 22 of the capitulation of the regiment violated: 1. By the restrictive interpretation of the said article regarding the nature of the offenses whose judgment belongs to the regiment. 2. Because the Noble Regency, by the analogy of the Capitulation of Meuron, has judged it appropriate to order the Regiment to conform in all cases, even for purely military offenses, to the laws and customs of the Noble Company, which is diametrically opposed to Article 22, in verbis: in all other cases the regiment shall conform, etc. 3. Because the Noble Regency has given the force of law for the Regiment to a passage from a private advisory opinion of the Fiscal, which had no other purpose than the establishment of a new garrison court-martial for the National troops, which has nothing in common with our court-martial already established by the Capitulation; which has all the more reason to astonish the undersigned, since having found theft mentioned in the list of ordinary offenses in this advisory opinion, they have derogated, in favor of the new court-martial, in its first act of jurisdiction from the principle established by the Fiscal, by allowing the said court-martial to judge definitively soldiers guilty of theft and housebreaking. These are the grievances that the undersigned will have the honor to bring before the august and enlightened tribunal of the two contracting parties, who are the sole authentic interpreters of the contract they made together. He ventures to flatter himself that the regiment will be rehabilitated and reinstated in the enjoyment of the rights of which the provisional order of the Noble Regency has just deprived it, and that our Lords and Masters will deign to take to heart the well-being and preservation of a regiment that aspires only to serve the Noble Company well and faithfully. There remains for the undersigned only this single way to raise the regiment from the mortal blow that the latest resolution has just dealt it. Perhaps the regiment would have been more fortunate if the Noble Regency had previously deigned to hear it in defense of its right, which the undersigned has already had the honor to set forth very fully in a memorial presented long ago to the Fiscal, instead of which, upon a private conversation that the undersigned had the honor to have with His Excellency the Governor regarding the beginning of Article 22, which has no connection with the present case of the counterfeiter, the Noble Regency has taken occasion to order provisionally that the regiment govern itself in all cases, even in military offenses, according to the Laws and customs of the Noble Company, according to the article brief, and according to the regulation of the Prince of Orange, in so far as it is in use in this country; although the undersigned is obliged to declare with the most respectful submission that this provisional order overturns the entire constitution of the regiment, that it attacks the validity of all the courts-martial that have been held up to now without anyone finding fault with them, that it renders useless the reversals and non-prejudice deeds that the Fiscal himself judged it appropriate to give to the Regiment. The undersigned, nevertheless, until further orders, has no other course to take than that of the strictest obedience. By virtue of this course, the only one that any military man can take toward his superiors, the undersigned begs the Noble Regency to cause to be communicated to the regiment the laws and customs of the Company, which have hitherto been constantly refused to it, and the article brief; and as in the resolution it is provisionally enjoined upon the regiment to conform in its judgments for military offenses to the regulation of His Most Serene Highness, the Prince of Orange, in so far as it is in use in this country, it is necessary to be informed in which cases the said regulation is in use and in which it is not in this country. Agrees, Goetz, First Clerk. 3:1 Right Honorable Sir, Honorable and Respected Sirs, Since Your Right Honorable and Respected Sirs, by resolution of the 15th of September last, were pleased to place a certain memorandum submitted to this Council by the Colonel Commandant of the Regiment of Wurtemberg, and dated the 10th prior thereto, into the hands of the undersigned, Independent Fiscal of this Government, in order to provide a report thereon, he deems, under respectful correction, that it will be sufficient for him to direct his report solely to the points that appear therein as directly concerning him in his capacity; without it being necessary to dissect that entire memorandum itself; for which he would otherwise by no means lack abundant material; he deems To the Governor and Council of the Cape of Good Hope this all the more unnecessary, as he rests in the firm confidence that a multitude of reflections, which clearly demonstrate the futility of those arguments and assertions, and which arise naturally upon the reading thereof, will by no means escape the attention of Your Right Honorable and Respected Sirs. That the undersigned, having examined the case in question with all attention, believed he had to advise in the end to bring the delinquents namely to trial before the court martial. 1st. Because they had absented themselves partly from their guard and post, and partly from the drill to which they were assigned and commanded, consequently a military offence preceded here, from which the committed theft followed as a consequence, since had this military offence not been perpetrated, the other could not have taken place at that time, as clearly appears from the extract of the sentence attached hereto under sub No 7. 2nd. Because thus, although the undersigned has classified a qualified theft in general, as he flatters himself with the greatest right, among the common offences, nevertheless in this case, on account of the continence of the cause, which clearly shines through here, both offences had to be brought before the military judge, as these delinquents were already undeniably answerable before that judge prior to the committed theft. 3rd. Because when one examines with any attentiveness the reasons why Your Honors and Noble Worships were pleased to establish this National Court Martial, as well as the salutary purpose that this Council intended thereby for the well-being of the Honorable Company, as may be gathered from the resolution of 19 October 1789, the nature of the matter then dictates that one must also leave to that court martial for adjudication as much as can reasonably and in accordance with its establishment take place, and at least must not detract anything therefrom, so as not to render this intended purpose ineffective and cause it to fail entirely in everything. 4th. Because the undersigned was assured that, as had already happened in the beginning thereof, also in the entire handling of that criminal procedure until the final conclusion of the matters, both by the Auditor and by the court martial itself, the orders and observances prescribed to them and contained in the repeatedly mentioned advice would be completely fulfilled. 5th. Because in case it could appear in any way doubtful or disputable (which it is not, however) whether what occurred here should not be regarded as a formal civil offence, and had to be judged by the civil judge, even then, by leaving the same to the court martial, the rights, jurisdictions, sovereignty, and authority of the Dutch state could hereby never be prejudiced in the slightest or least degree, since both this Court Martial and the Council of Justice here are a national court of justice, both are composed of subjects of the Dutch state, and both never administer justice or pronounce their sentences other than in the name of their High Mightinesses. The second passage of the said memorial of Colonel Commandant von Hugel, directly concerning the undersigned, is of the following content: that this provisional order overturns the entire constitution of the regiment, that it attacks the validity of all the courts martial that have been held until now without anyone finding fault with them, that it renders useless the guarantees and deeds of non-prejudice that the Fiscal himself thought fit to give to the regiment. To what extent these consequences now, which have been dragged in and forced as if against sound judgment and by violence, can be taken into consideration here, the undersigned will leave to the judgment of Your Honors and Noble Worships themselves, and only reflect that there might possibly still be quite a lot to say about those courts martial held, if the handling of matters under the Württemberg constitution does not proceed better than in the latest case of a certain Johannes Larsch, soldier in that regiment, who was reported by them as having deserted from the same in the month of June 1789, and departed from here for Europe with a national frigate of war. They wished to make it appear to this Council as if that deserter had been engaged and thus debauched thereto by the officers of that frigate, whereas these documents having been placed in the hands of the undersigned, in order to serve Your Honors and Noble Worships with his considerations concerning the circumstances stated therein, it appeared to him upon further inquiries that the aforementioned national frigate had already left this part of the world in the month of April, and thus fully two months before the absence of this deserter from the regiment. was solely the concurrent cause of issuing those documents, and that the same was done only for his security, because he alleged to fear that those surrenders, as commanding officer of the regiment, might be taken amiss by the same and by the Lord Duke, also that he might be considered to be surrendering the rights and privileges of the corps entrusted to him, and could hereby become involved in unpleasantness, unless he were provided with similar non-prejudicial acts. Now the undersigned, who remained in the firm conviction that the Colonel was obliged to make those surrenders pursuant to the Capitulation, also considered it certain that this Colonel, in fulfilling this his obligation, could never be accused of having undertaken anything to the prejudice of the privileges and concessions granted to his regiment by the Lords Masters upon the Capitulation; and believed he could do no harm in the world by issuing to that Lord van Hugel such a written declaratory document, inherently insignificant, as a superfluum quod nocere nequit. Whereas now the undersigned, if he could in any way be said to have sinned in all these two grievances brought against him, could have done so in the first case out of nothing other than an all too great condescension and affection for military affairs and also towards the attainment and further accomplishment of the salutary objectives targeted at the establishment of the National Court Martial, while this case, so broadly elaborated, could give or take absolutely nothing from those of Wurtemberg, they had nothing to settle therewith, and it did not concern them in any way. And the undersigned in the second case had proceeded to this solely out of pure complaisance for and at the request of the Colonel, against which he nevertheless hopes to guard himself in the future, he will again leave it to the decision of Your Right Honorable and Honorable Sirs whether it can befit such an old soldier who has only the strictest obedience towards his superiors as the only course to take, at least if he thinks somewhat like a true military man, that is generously, to bring such insinuations and reproaches against an officer of Justice, against a Member of this Government, before the eyes of those superiors of his. Together with whether one can reconcile with such strict obedience the refusal to surrender, contrary to the distinctly stated orders given by his superiors in the Capitulation, of a person who, according to the repeatedly mentioned memorial, was found guilty of manufacturing counterfeit paper money, whereas such an offense undeniably can never be ranked among purely military offenses. And whether consequently the course of action maintained in this matter by this old soldier is not rather to be regarded as disobedience and actual opposition against the orders of his superiors expressed in the Capitulation. Whereas the undersigned, while the Colonel had requested him more than once that, if anything should occur that had any relation to persons of his corps, he would then previously address himself to him, the Colonel, had done so in this case, and having conceived some suspicion about the money forgery, had information given thereof to the frequently mentioned Colonel, with the request to assist the undersigned in obtaining the necessary information; Whereas they have taken that information for themselves, having brought that delinquent before the court martial to conviction and confession, have withheld everything under themselves, and have communicated not the least bit thereof to the undersigned; and whereas, when finally the undersigned, having noticed something thereof from public talk, insisted on the surrender of the delinquent and the information, confessions, and evidence obtained relating thereto, they saw fit to flatly reject and refuse him this in an entirely disagreeable manner, so that, being unable to acquiesce herein pursuant to the duties of his post, he thought, in order to prevent further tergiversations and delays, since what can be done by few means is done in vain by more, that he had to address the Lord Governor of this Colony, with the request to oblige the Colonel, in that his Right Honorable capacity, as standing directly under his orders, to make that surrender; and the Lord Governor having brought this made request into this Council, with a further letter from the Colonel van Hugel containing the quasi reasons for that refusal of his, Your Right Honorable and Honorable Sirs then also saw fit to order directly those requested surrenders, whereas moreover all such surrenders had always taken place voluntarily, without contradiction, and even sometimes of their own accord, almost before the undersigned knew what had happened, and thus before he could demand them.
