is also fully convinced of his observed conduct, having without the least concealment requested and also obtained the consent of the Honorable Governor to attach the purchase money, he can deduce nothing else from the statement contained in your Honorable and Esteemed resolution of the 27th of September last, namely that consent was never granted for this, than that in granting the consent to the attachment, which usually occurs without deep investigation, that part of the memorialist's request concerning the purchase money of the sold houses escaped the attention of his Honor. However, though the memorialist is not accustomed to view the actions of his fellow men, and especially of his superiors, from an unfavorable point of view, and for that reason very willingly trusts that the Honorable Governor misunderstood him, the memorialist, this nevertheless by no means removes the detrimental impression that must naturally arise in the minds of those who are not in a position or able to observe the memorialist's conduct closely, from calling the obtained consent into doubt or representing it as merely pretended; nor could a late posterity, finding the memorialist depicted in such unfavorable colors in the records of this Honorable Assembly, fail to regard him as an unfaithful servant and perhaps even view him as the cause of the unpleasantries, of which merely some effects have meanwhile fallen upon him. The memorialist will not enter into any investigation here as to whether, by the attachment of the purchase money, the proceedings against Mr. van Reede van Oudtshoorn must be considered to cease; it is sufficient that the memorialist in his conduct has steadily pursued the true interest of his lords and masters, knowing in any case, as he respectfully trusts, that it cannot be demanded of him that, in order to keep lawsuits alive, he should neglect the security of his superiors. And it is solely the confidence of having in all things conducted himself as befits a faithful and zealous servant of the Honorable Company, which now gives the memorialist the freedom, in order to remove all adverse expressions and to prevent all detrimental consequences that could well be drawn by posterity from his silence, to turn herewith to your Honors with the humble request that this his respectful memorial may not only be entered into the minutes of your Honorable Assembly for his discharge, but also transmitted for his justification to his high-commanding lords and masters, as well as brought to the knowledge of the High Honorable Lords Commissioners-General who are daily expected from the Netherlands; the memorialist remaining in all submission patiently awaiting their Honors' decision in this respect. On this occasion, it was communicated to the council by Mr. van Oudtshoorn, etc., and this matter having been maturely deliberated upon, it was thought best and resolved to place this matter into the hands of the fiscal office, in order that not only on account of the missing stipulated bail bond in the sum of 5,000 rixdollars, but also on account of the customs and other revenues which the aforementioned Mr. van Lynden claimed to be attached to the fiscal office, for which restitution should be made to the Honorable Company, as well as on account of the judgments rendered both by the Court of Justice here and on appeal by the Court of Justice in Batavia, against all goods and effects left behind by the Fiscal, such proceedings may be commenced as shall be found proper and serviceable for the proper indemnification of the Honorable Company and other interested parties. Answer to the notification served upon us in the name of Mr. Jacob Pieter de Neijs, interim Fiscal here, ex officio: that we are prepared to consign a sum of eighty thousand guilders Indian valuation, consisting of two deeds before schepenen passed in favor of the notified principal under special mortgage of the house and land well and lawfully sold by him, until the Lords Masters shall have made the necessary determinations regarding the revenues enjoyed by our principal. While we nevertheless consent to the consignment, insofar as it concerns the judgments of the Honorable Court of Justice, both here and in Batavia, solely under this proviso and condition, that it shall be left to the judgment and decision of the Lords Masters whether and to what extent a fiscal is obliged to bear any costs in lawsuits conducted by him ex officio to maintain the rights of the supreme authority, to which ruling we respectfully refer ourselves. We consider ourselves all the more obliged to this condition because our principal, with all due deference, is of the opinion that when an officer of justice is not condemned to pay the costs from his private purse as a fine for recklessly conducted proceedings, but is only referred to the costs generally in his official capacity, such costs ought then to fall to the charge of the Country on whose behalf the action was taken. Trusting that with this generous offer we have sufficiently answered the amicable steps of the notifying gentleman, and have thereby prevented those unpleasant pursuits which the notifying gentleman declares he would otherwise be obliged to undertake.

Upon this was read a Representation submitted by the interim Fiscal, Master Jacob Pieter Deneys, containing a report of what had been executed by him pursuant to what had been mandated to him at the session of the 29th of June last, to initiate such proceedings as he should deem necessary against the estate left behind by the repatriated Lord Governor Cornelis Jacob van de Graaff and the Independent Fiscal who has departed from here, the Lord Johan Nicolaas Steven van Lynden; which representation read as follows: To the Right Honorable and Honorable Lord Johannes Izaak Rhenius, Commander of this Government, together with the Honorable Council of Policy. Right Honorable and Honorable Lord and Honorable Lords! The Officer Representant has the honor hereby most respectfully to present to Your Right Honorable and Honorable Lordships the answer given, both by the attorneys of the repatriated Governor, the Right Honorable and worshipful Lord Cornelis Jacob van de Graaff, being the Captain Engineer Sebastiaan Willem van de Graaff, as well as the Secretary of the Honorable Court of Justice Willem Stephanus van Ryneveld and the Adjunct Fiscal Master Johannes Andreas Truter, as well as by those of the likewise repatriated Independent Fiscal of this Government, Johan Nicolaas Steven van Lynden van Blitterswyk, to the formal notice served upon them by the court messenger Ziervogel, in order that, pursuant to the respected Council resolution of the 29th of June of the current year, proper security should first be furnished by the former cited for the ordinary and stipulated bail in the amount of Ten Thousand Rixdollars, which was refused by the said Lord Governor, and to the aforementioned Lord Independent Fiscal, being his wife Mrs. Johanna Elisabeth Helt and the aforementioned van Ryneveld and Truter, not only for the bail of R. 5000 still lacking, but also regarding the Customs and other revenues, as well as regarding the judgments, both before the Court of Justice here and on appeal before the Honorable Court of Justice of the Castle of Batavia. The Officer Representant takes the liberty to submit to Your Right Honorable and Honorable Lordships with all due respect whether it would not be sufficient, in order thereby to prevent all scandal and outcry as much as possible, to demand from the abovementioned Attorneys of the repatriated Right Honorable and worshipful Lord Governor an Inventory of such Goods as have been left behind here by the same, and that they bind themselves upon their Word of Honor to retain in their possession such funds as are to proceed from the sale of the same, whether privately or by public auction, and not to remit them until such time as the Right Honorable and Most Respected Lords and Masters shall have ruled upon this point and question, or else to furnish the humble subscriber with such further orders in that regard as Your Right Honorable and Honorable Lordships shall deem necessary to be proper. Answering for the first three defendants in their capacity as attorneys of the repatriated Independent Fiscal Mr. Johan Nicolaas Steven van Lynden, I declare that, whereas Mr. van Lynden has always been inspired with those generous sentiments to properly and fully secure all those who might maintain even the slightest semblance of a claim against his Honor, his attorneys, consequently in accordance with the intention of their principal, in addition to the offer already made of namely the sum of eighty thousand guilders, are willing, if necessary, to add all the monies resting with the Vendue Master, thus together amounting to more than one hundred thousand guilders Cape valuation, all however under this provision and condition that it shall be deferred and left to the judgment and decision of the Gentlemen Directors whether and to what extent Mr. van Lynden shall be obliged to pay the costs of proceedings in which his Honor was condemned ex officio and thus to maintain the right of the sovereign authority; The plaintiff ex officio produces the writ of attachment with the report of the messenger, as well as two extract resolutions of the Honorable Council of Policy, the one of the 29th of June and the other of the 20th of July recently passed, making request thereupon as in the presentation. capacity to be authorized to collect various outstanding claims, relating both to the revenues which have not yet been collected, in order at least to prevent all damages in this regard. Whereupon the Honorable Officer Plaintiff declared to leave the matter to the judgment of the court. However, the said defendant persisted in what he had put forward. And the said van Leeuwen, acting as proxy for the merchant, currently titular, Constant van Nuldt Onkruidt, and the bookkeeper Jan Jacob Fredrik Wagener on behalf of the vendue master Mr. Cornelis van Aerssen, also declared that their principals shall obey the attachment placed in their hands. That the petitioner, in dutiful obedience to the orders of this Honourable Worshipful Council, as speedily as his manifold official duties have permitted him, has examined both the aforementioned letter of complaint and the documents produced by the aforementioned Lord Gordon, and furthermore has judicially obtained all such statements by which he believed the alleged facts imputed to the said de Sandol Roy could be verified, and particularly with the aim of investigating whether there would result therefrom any weighty fact of which the adjudication belongs to the Civil Judge, and whereby the petitioner might thus be enabled, in accordance with the intention of Your Honourable Worships, to bring this matter to the cognizance of the Honourable Worshipful Council of Justice, and to have the said Council, propter continentiam causae, judge the military as well as the civil facts of him, de Sandol Roy. Yet that from the evidentiary documents obtained by the petitioner, which he has the honour herewith to present to Your Honourable Worships, nothing has appeared that could successfully subject the aforementioned case to the jurisdiction of the aforementioned Council of Justice, since all the said statements contain no other circumstances than those which relate to some of the accusations appearing in the aforementioned documents placed into the hands of the petitioner. That therefore, since the facts appearing in the said documents, being considered criminal, ought without any doubt to be ranked among purely military offenses, as having been committed by Major de Sandol Roy qua miles in his capacity as a military officer, the petitioner, subject to respectful correction, believes that after the establishment of a Military Court in this government, the adjudication of the aforementioned facts cannot be avoked from the Court Martial and transferred to the Council of Justice without concurrence of the parties; at least one has in this case grounded reason to fear that the defendant will avail himself of the exceptio fori and thereby, if not immediately return the case to the Military Judge, at least by interposing an appeal in case the aforementioned exception were rejected, will always manage to direct things so that the principal case could only be initiated after the lapse of whole years, whereby not only the punishment, si qua esset infligenda, would be of less weight, but also the ordered speedy investigation could for the most part be rendered illusory. That besides these consequences, the initiation of proceedings before the Council of Justice in casu subjecto moreover exposes the petitioner to being condemned in the costs from his private purse for having summoned Major de Sandol Roy before a notoriously incompetent judge, which condemnation would not only bring him, the petitioner, little honour, but would also suit him very poorly in his straitened circumstances. That therefore the petitioner has deemed it his duty to bring the aforementioned inconveniences, which he is bound to foresee in his capacity, to the notice of Your Honourable Worships, with the respectful request that Your Honourable Worships may be pleased to devise such measures in this matter as whereby you shall judge the aforementioned difficulties can be prevented, and the petitioner be enabled fruitfully to initiate the necessary proceedings, for which he is otherwise in readiness, against Major de Sandol Roy. Achtbren Raade van Iustitie te brengen en door deezen propter continentium causce zoo wel de Militaire als Civieele feijten van hem de Sandol Roij te doen beoordeelen. Appeared before the undersigned commissioned members of the Honorable Court of Justice of this government, the soldier Willem Koek, of competent age, who, at the requisition of the Deputy Fiscal, Mr. Johannes Andreas Freiter, expressly qualified by resolution of the Honorable Political Council on 16 Novb. of this year to fulfill the office of Fiscal in this matter, declared it to be true: That the deponent arrived here on 17 August 1788 on the Company's ship 't Slot ter Hooge, immediately joining the Corps Pépinières commanded by Major Simon Chevalier de Sandol Roy, having brought his uniform from the fatherland, which he also retained, whereas subsequently, after the lapse of fully six months, the deponent received a uniform from the aforementioned Major, which was charged to him at R=s 12 and for which one ducaton was deducted from him every month, this uniform being taken away from him again in the month of August 1789 upon the departure of the troops to Macasser, without another uniform having been provided to the deponent until a year later, when he received an unlined uniform which he had to pay for at the same price as the previous uniform, in addition to a grenadier's cap and the other items belonging to his uniform, which he received piece by piece and paid for separately. That the deponent also received the necessary bedding from his said Chief, for which, according to custom, money was deducted from his monthly account, which bedding, since the deponent acted as a horse doctor and had a separate room outside the barracks and thus used his own bed, was subsequently brought to the storehouse by the corporal named Knoobel, without the deponent ever receiving the bed back. That finally, when the deponent was in the hospital due to illness, the service money due to him monthly, amounting each month to 7 schell:, was withheld from him, while for the rest the deponent was paid his board money monthly and received his pay. Copy Appeared before the undersigned commissioned members of the Honorable Court of Justice of this government, the soldier of the Honorable Company Hubertus Snijder, of competent age, who, at the requisition of the Deputy Fiscal Mr. Johannes Andreas Fruter, expressly qualified by resolution of the Honorable Political Council on 15 November of this year to fulfill the office of Fiscal in this matter, declared it to be true: That the deponent arrived here on 6 May 1789 on the Honorable Company's ship Canton, and was immediately placed in the Corps Pépinières garrisoned at this place under the command of Major Simon Chevalier de Candol Roy; the deponent having brought a uniform from the fatherland, besides which the deponent received a complete new uniform from his abovementioned Chief and also retained it, and the deponent was likewise provided with the necessary bedding, which was charged to his account upon receiving his uniform, and for the payment of which a portion of his monthly service money was deducted on two different occasions. That further, the deponent was paid his service money monthly, except for the last three months prior to the departure of the troops to Batavia, during which the deponent kept his money in the care of Sergeant Knobel, whose payment the latter refused under various pretexts when the deponent demanded it; to which sergeant the deponent also had to pay 2 rixdollars twice during the abovementioned period for shoes, which according to custom were provided monthly on account, and which he had left with the supply of shoes instead of receiving them, because he did not need shoes at that time. That the deponent, who understands the trade of bricklaying, was also employed by his aforementioned Chief in that trade at 6 st per day, working in this manner for 14 days, after which, being dissatisfied with this low pay, he quit, on account of which the sergeant, when he came into the barracks, not only reprimanded him but also struck him, and the next day, upon the deponent's repeated assertion that he could not work for such low wages, had him given 50 blows with a cane, after which the deponent, having declared that if he was forced to work, he would rather work for nothing, went back to work and then received 2 schell:s in wages daily. R C Appeared before me, the undersigned commissioned members from the Honorable Council of Justice of this government, the soldier of the Honorable Company Johan Paulus Swaab, of competent age, who, at the requisition of the Deputy Fiscal Mr Johannes Andreas Truter, as expressly qualified by the Honorable Political Council by Resolution of 15 November of this year to fulfill the office of Fiscal in this matter, declared it to be true: That the appearer, having arrived here in the month of January of the past year 1790, first had to stay in the hospital for the period of one and a half months on account of illness, and thereafter was placed under the Corps Pupilles commanded by Major Simon Chevalier de Sandol Roy, from which Major he, the appearer, received a uniform coat, for the payment of which one Ducaton was deducted monthly from his service pay. That the appearer, having returned to the hospital as sick after 4 months, subsequently had his chest fetched, which had remained in keeping in the room of Sergeant Knobbel, and had then found the padlock to the same to have been broken off, while his aforementioned uniform coat was no longer to be found in the chest, which, as the appearer later learned, had been taken from the chest by the aforementioned Sergeant and given to another soldier, the appearer having also received a straw mattress without knowing for certain whether a separate payment was deducted from him for it or whether it was placed on the uniform account, which straw mattress having likewise remained in keeping with the aforementioned Sergeant, the appearer subsequently asked the aforementioned Sergeant about it, who thereupon indicated that possibly the same straw mattress was taken along by one of those who belonged among the dispatched troops of the said Corps, without the appearer having seen it again, while in the meantime the appearer had to pay separately for the grenadier cap and other uniform items issued to him. The appearer also declaring to have received monthly some money of his earned wages, without however having been paid for the period of 7 months that he spent in the hospital the service allowance due to him amounting to 7 schellings a month. Copy 6 Colonel Gordon, having read with attention the statement delivered at the last meeting of 17 February by the adjunct fiscal Mr. Jan Hendrik Truter, with his official acts and the investigation ordered of him in the case of Captain Sandol concerning the pepiniere, to which he, the adjunct fiscal, has added eight depositions obtained by him from some of those pepinieres, which themselves all most soundly demonstrate the highly punishable and scandalous conduct maintained by him, the Captain, among all pepinieres, and reinforced further with three new depositions, he, the Colonel, cannot sufficiently express his surprise at that hidden and concealed conduct of the adjunct fiscal in this so-called investigation; first, that Mr. Truter, as appears from his first two obtained depositions and other documents, which speak strongly and clearly, obtained them only on 12 December 1791, that is, approximately one month after the received orders and documents, after which the third deposition followed on the 13th, and the fourth, fifth, sixth, and seventh on 15 December, and finally the last deposition on 10 January 1792, thus this one again approximately one month after the first. If one now only casts an eye upon this unlawful handling of matters and then upon the statement of him, the adjunct, which he delivered on 17 February last, thus five weeks after the last obtained deposition and a full three months after the investigation ordered of him, then his conduct herein will be most glaringly obvious; also all depositions showed that the pepinieres complained that they were wronged and mistreated, so it could clearly appear at once from the first deposition of December, besides from the complaint sent by the High Government of India to this government for a rigorous investigation, alongside the depositions and other documents submitted by him, the Colonel, whether the matter was military or not, and he, the adjunct fiscal, in such an important matter, should not have delayed and acted in such an overly conspicuous manner, and finally delivered such a statement so many months after the receipt of the order, when the matter had already been started for more than two months; that he, the Colonel, thus adds this note and remarks of his to his previous ones of 3 February last, and cannot be satisfied with this, requesting that the same may be forwarded both to the High Indian Government and to this government for his discharge. vehement complaints and accusations from Colonel Gordon, Commander of the Militia here, joined with certain allegations of some soldiers among the Pepiniers, were placed in the hands of the Military Auditor in order to initiate proceedings before the Military Court Martial here against the undersigned. He has therefore now deemed it necessary to bring his legitimate grievances concerning this under the penetrating eye of Your Honourable Worships. Far be it from the undersigned to bring forward provisionally anything whatsoever in his defence; he will also not incommode the precious attention of Your Honourable Worships with this, since the accusations charged against him are considered to be of such a nature that they ought to be subjected to a judicial investigation, whereby the undersigned will thus be afforded the opportunity to answer for himself and thus be able to justify his conduct before the entire public, as soon as he may see his lawful cause placed in the hands of judges who are both competent and impartial enough to judge upon it. Yet, Honourable and Worshipful Sirs, with all respect and deference to the President and members who may be ordered here to hold a Court Martial over the undersigned, the undersigned must declare that the same can neither be regarded as competent nor as impartial enough to judge over the undersigned in the capacity of judges. Wherefore the undersigned, saving your reverence, hereby recuses the same in the most solemn manner in that capacity. The reasons for this recusation lie in the following: 1. Concerning the incompetence under which the Military Court Martial here labours to pass judgment upon the undersigned: that the establishment of a Court Martial here has not yet been properly approved or confirmed by the Lords Masters, and moreover, that the same cannot be composed otherwise than of one or two Staff Officers, and for the rest of Captains and subaltern Officers, whereas all military laws teach that a staff Officer may be judged by no less than staff officers. Regarding this, van Hasselt himself states in his instruction on the holding of a Court Martial in the Garrisons of the State of the United Netherlands, Page 70. Here it should further be noted immediately that no members must be ordered to a court martial who are lower in rank than the one who is placed on trial, for jurisdiction involves an authority over the one who is placed on trial, and it would indeed be contrary to exercise authority over someone who is higher in authority; this could therefore not be reconciled with the subordination that ought to be observed to the utmost among military men. See Regnerus Engelhard and Spee Juris milit: natural § 1224. 2. Concerning the suspicion of partiality, it will be sufficient solely to leave to the equitable judgment of Your Honourable Worships whether the undersigned (this being said, however, always saving all respect) can place in the court martial to be appointed that peace of mind which everyone in a civilized society ought to feel toward those who shall judge over him as judges. Indeed, it is fully known to Your Honourable Worships with what animosity Colonel Gordon has always been prejudiced against the undersigned, and how very much his Honour has displayed for a long time on all occasions his inexorable inclination to persecute the undersigned, and shown that the total ruin of the undersigned would provide his Honour with real satisfaction. Moreover, Your Honourable Worships will still be very well informed that, upon the incorporation of the undersigned as Captain in the Battalion here, the Gentlemen Officers of that time, considering themselves prejudiced thereby, authorized deputies from among themselves to complain about this to the Honourable and Valiant Lord Governor and the Lord Colonel, which gives the undersigned no reason, saving their Honour and dignity, to be able to view those gentlemen directly as neutral judges. See Merula Manner of Proceeding, Book 4 Title 40 Chapter 4, where among the well-founded reasons for the recusation of a judge the following are listed: § 11: that I have a lawsuit pending with the Judge as with a private person. § 12: that he is my mortal enemy, being severe against me in everything. Some go further, and maintain that a defendant may recuse the Judge who formerly was his enemy, notwithstanding the reconciliation between them both that followed thereupon; but with reason the defendant may recuse the Judge who has threatened to harm him. § 13: that the Judge is all too familiar with my adverse Party, and bears him too great a favour. § 17: If he is a commensal table-companion of my Party or of my enemy and lives in one house with him.

Section 18 that he is under the jurisdiction of my adverse party or of my enemy, being his vassal, or that my party is under his authority, force, and dominion. The aforementioned van Hasselt, in his instruction on holding a court-martial in our Republic, further says on page 34: since it must be an established fact according to law and sound reason that all partiality must be banished from all courts, and nothing harder can be devised for a party than to have to litigate before a suspect judge and let him interfere and pronounce judgment, special attention must be paid that no officers are admitted as members in a court-martial to be held who are suspect for this or that valid reason, that is, who behave partially; and consequently, anyone is held suspect in this regard who favors one party more or appears to want to favor one over the other. Indeed, who does not see, upon confronting these presented points with the qualities and requirements of a competent and neutral judge, that the undersigned, in a matter of so much consequence, can only with great hardship be submitted to the judicature of the court-martial; Colonel Gordon being well able to remember the serious representation made by his Honor in the year 1785 to the Governor of that time, on the occasion that Colonel van Meuron desired a court-martial to judge the disputes between himself and his brother, the Lieutenant Colonel of the same regiment, and how strongly his Honor then touched upon the influence which a Colonel has on the court-martial, especially in matters that concern him privately or in which he is a party, which was also the reason that no court-martial was granted to the Colonel to decide the case of him and the Lieutenant Colonel. The undersigned does not wish in any way to withdraw himself from the judicial examination of his case; on the contrary, he feels fully convinced that the same must serve to demonstrate his conduct and bring his innocence to light. He has also never failed to answer properly the questions put to him by a commission expressly appointed to examine his case; but he only desires and expects from Your Honorable Worships' justice that he may see himself judged by judges who are competent and neutral in this matter. These weighty reasons for recusal the undersigned takes the liberty of bringing under the discerning eye of Your Honorable Worships, while he, on the basis of what is found noted by the aforementioned van Hasselt on page 68 regarding the effect of a submitted recusal, further remarks that the same being well and lawfully proposed, binds the hands of such a judge, is ipso jure null and of no value; it is accepted according to the most common opinion that when a recusal is made against a member of a court, the lawfulness thereof is then decided by the remaining members of a court, and thus it must also be practiced in a court-martial; and in case an entire court-martial were recused, another and impartial court-martial ought then to be appointed by the Lords of the Council of State or the Lord Hereditary Stadtholder, or whoever represented His Highness, or positis terminis habilibus this point could come and be brought before the High Court-Martial pursuant to its instruction of 27 October 1700, to be found among the appendices of the treatise by the same van Hasselt, letter H. Very humbly requesting that it may be Your Honorable Worships' pleasure to refer this case either to the High Court-Martial of the United Netherlands or to the High Indian Government, in order that judgment may be rendered according to law upon the undersigned and the charges brought against him. Colonel Gordon finds himself on this occasion obliged once again to protest against the fact that Captain Sandol is still titled and considered a Major here, and requests that this may be noted and forwarded both to the Lords Majors and to the High Indian Government: That Captain Candol was firstly appointed illegally and contrary to the orders of the Lords Majors, since they clearly prescribe in their letter to this Government that such could take place if it were consistent with the welfare of the service, and this was clearly quite the contrary, Captain Candol being himself under a commission appointed by the Governor himself; secondly, two members of the Council, the Secunde and the Cashier, were absent on a commission to Swellendam; thirdly, no Captain can be made a Major without the nomination of the Head of the Militia, who had not the slightest knowledge of it, and thus this appointment was made to openly affront the Head of the Militia, who sought nothing but justice and fairness and the welfare of his Master's service, and to overturn all good order by insolent authority; lastly, Captain Sandol's illegal appointment here has not only not been approved, but in the letter of the Lords Majors of 2 October 1790 he was clearly placed in his original rank to depart with the miners to Batavia, while the Lords Majors as well as the High Indian Government were kept unaware of his unpardonable conduct. the undersigned, however, of the equity of your Honorable and Right Honorable Lordships, that they will grant priority to the investigation of crimes whose perpetrators are held in detention, and wherein they may remain no longer than is necessary for the prosecution of their cases, as all other matters must, according to the rules of an equitable administration of justice, be postponed to the cases of detained delinquents. That, in addition, since the month of October of the past year 1791, the number of criminal prisoners has by chance increased so considerably that the undersigned, aside from what the respective Drostampten produced, has been occupied almost day after day with cases of criminal prisoners for the Fiscal Office: the undersigned having had the fortune, among other things, to his immense pleasure, to finally discover those persons who for two to three years had disturbed the entire Colony and through violent thefts had jeopardized the lives and possessions of the good inhabitants, and indeed in such a manner that they are soon to undergo their rightful punishment as an example to others. That meanwhile these circumstances, added to the entirely foreign content of most of the documents placed in the hands of the undersigned, necessarily resulted in a very natural slowness in examining those documents, and were thus also the cause that the undersigned was not able to begin gathering the depositions before 12 December, nor able to proceed with it more rapidly, the less so because taking depositions in all matters of weight, according to the modest understanding of the undersigned, must be done judicially, the undersigned therefore having had to accommodate the Gentlemen Commissioners in an equitable manner, as much on account of occupations as due to the small number of members on the Company's behalf in the Council of Justice; and besides that, the deponents, who were assigned to different posts, were often difficult to find. That, just as the aforementioned reasons delayed the investigation of the matter in question, along with the gathering of depositions, these same reasons by natural consequence were also largely the cause that the undersigned did not submit earlier his representation mentioned at the beginning of this report: a principal contributing cause in this matter having nevertheless been that, notwithstanding the consent of the Honorable Lord Governor, granted in the month of December, to deliver to the undersigned a copy of the Instruction drafted for the military court martial of this castle, the said Instruction was nevertheless only delivered into the hands of the undersigned around the middle of the month of January of this year, upon which the undersigned also immediately, according to the circumstances of the time, instituted his investigation as to whether, according to this Instruction, the case of Major de Sandol Roy was purely military, which quality the undersigned found, according to common law, had to be attributed to it in the strictest sense: That the undersigned furthermore, as soon as it had appeared to him that the aforementioned Instruction contained nothing by which the questionable case of Major de Sandol Roy, contrary to common law, could devolve to the civil judge, gave notice thereof to the said Lord Governor more than eight days before the submission of his frequently mentioned representation, with the request to be permitted to make a representation regarding this to this Honorable Council; as then also occurred on 14 February last. Honorable Worshipful Sir, Honorable Worshipful Sirs, With due respect, Your Honorable Worships' and Worshipfuls' humble servants, the Burgher Councilors of this town in their aforesaid capacity, give notice how they, the petitioners, together with the inhabitants, have had the opportunity to learn that our High and Mighty Lords and Masters desired to have the Collateral succession tax introduced into this Colony, and to that end had also actually supplied their letters to Your Honorable Worships and Worshipfuls to give effect to that order; that furthermore these rumors gave occasion whereupon several of the most prominent inhabitants declared to the petitioners that they were already subject to enough taxes, and that due to a lack of ready money the circumstances of this Colony became increasingly precarious and the means of subsistence more meager, which comes to reveal itself in various ways from time to time, and they therefore could not bear any burdens whatsoever. The petitioners in this matter being fully convinced of the truth of their observation, and that these rumors among the inhabitants in general had not only stirred up much discontent, but that also several expressions used by them in this regard in daily conversations caused the petitioners to fear consequences; and considering the unhappy circumstances in which the inhabitants of this Colony actually find themselves at present due to the introduction of paper currency, the increase in the value of silver coin, and diverse other burdens to which they nevertheless have subjected themselves without contradiction, and the prospect that our High and Mighty Lords and Masters would also think of means to give the inhabitants of this Colony the opportunity to find a living for themselves and theirs, since indeed the prosperity of the Honorable Company is inextricably linked to that of the inhabitants; if the petitioners had not confined themselves to the matter of the Collateral tax to fix their attention only for this time, they would find an ample field to demonstrate how all these newly introduced taxes and changes have brought the inhabitants of this Colony to the brink of their ruin. The petitioners are fully convinced that Your Honorable Worships and Worshipfuls must have full knowledge of this, since indeed daily experience comes to manifest these statements of ours. Wherefore they, the petitioners, both for themselves and on behalf of the inhabitants of this Colony, have approached the Honorable Worshipful Mr. Acting Governor of this government and requested His Honorable Worship if it would please His Honorable Worship to bring these grievances of theirs to the table of Your Honorable Worships and to direct matters there so that the publication of the Collateral tax might be suspended until the arrival of the Right Honorable Lords Commissioners, to whom they, the petitioners, would then submit all their concerns. However, to their sorrow the petitioners had to experience that on the 2 of this month, notwithstanding their humble requests, the public was notified of this tax in the ordinary manner under the ringing of the bell. Barely had this publication taken place, or it had immediately that effect which the petitioners had feared, namely many seething tempers; wherefore the petitioners, fearing consequences, were compelled to approach the Honorable Worshipful Mr. Acting Governor of this government once again, and declared to His Honorable Worship that, for all the reasons cited above, they, the petitioners, could not or would not let themselves be used as instruments to execute that hardship or injustice, and requested rather to be discharged from their posts as Burgher Councilors, as they had understood from the publication that they would have to assist in the judicial commissions, in order not to bring the curse and hatred of the inhabitants upon themselves; which declaration the petitioners hereby solemnly repeat in the most absolute manner, whereupon they implore Your Honorable Worships' attention. After the petitioners had made this declaration, they were furthermore requested from all sides to please exert their efforts to the end that this tax, as little as any other, be introduced in this Colony, since they, the inhabitants, would on no conditions whatsoever agree to paying the same. the eldest of them gathered together, where a large number of inhabitants appeared, who declared to the petitioners that they made known their pressing grievances to the petitioners as city fathers, stating that by a publication of the 2nd of this month the inhabitants had been notified that the highly respected Lords Masters desired to have the levying of the Collateral tax introduced in this Colony; that they were already subject to so many taxes, which they had borne with patience in the expectation that privileges would also be granted to them whereby they would be enabled to raise the same; but since this well-founded hope of theirs had vanished into smoke and they faced the bitterest poverty daily, they could or would therefore bear no more taxes and already found themselves burdened above all former charges, requesting that the petitioners would intercede with the government so that they might be discharged from this as well as all previous burdens; upon which the petitioners could say nothing else than that they would employ their good offices to that end, yet for this time only to confine themselves to the Collateral tax, wherewith this appearance came to an end. On the same date, by the Heemraden of Stellenbosch and Drakenstein, as well as military officers of that same Colony, the petitioners were also requested to meet together on the 9th of this month in order to hear their grievances as well, for which purpose the petitioners accommodated them on that day at the house of the eldest of them, whilst the aforementioned Heemraden and military officers, presenting themselves there on the spot, gave to know that they had learned with the utmost astonishment that the publication at this capital regarding the levying of the Collateral tax had been made on the 2nd of this month at a juncture when they had rather expected that suitable means would have been devised to prevent in time the ruin of this Colony, which was already tottering, and hereby declared for themselves and the inhabitants of the districts of their Colony that they were not in a position to bear any tax whatsoever named; and whereas they had learned that in such commissions Heemraden would have to assist, they further declared that they did not wish to be used as executors of any orders that related to the levying of the Collateral tax, thus being the instruments, as it were, to rob their fellow citizens of their lawful property, and requested the petitioners, as the mouth of the people, whether they would convey this their open-hearted and well-meaning declaration to the government, adding thereto that if, contrary to hope, this tax must nevertheless be introduced, they desired to be discharged from their posts. The petitioners hold themselves assured that Your Honorable and Respected Worships, perceiving the matter according to its weight and the dreadful consequences that are otherwise to be expected for lack of a timely provision, will be pleased to take the same into serious consideration and, in consequence thereof, take the most suitable paths for the public good in order to avoid all troubles and divisions. would have to take place, will mainly consist of appointing Commissioners; determining both the terms and the manner in which the Liberal Gift will be paid here and in the respective outer districts; and placing the collection boxes required for this purpose, the undersigned has also deemed it necessary to examine on what basis the 50th penny was likewise levied here in the year 1752, in order to be able to state to Your Honorable Worships with greater foundation and confidence what regulations should now also be made on the part of the government, in order to make the transmitted placard for collecting the 50th penny serve locally, pursuant to the respected missive from the aforementioned Supreme Government of India. In this examination, it appeared to the undersigned, subject to correction, that the arrangements made and established in this regard by resolution of this Table on 6 June 1752, insofar as they are applicable to the present state of the Colony, omitting however certain points that had their specific application to the placard issued at that time, could and should now also be adopted and followed with regard to the present Placard; at least and in any case that, the 50th penny having to be levied, one could proceed in no other manner than according to the directive found recorded in respect thereof in the same resolution. Following this guideline, the undersigned is then, subject to better judgment, of the opinion that the aforementioned Liberal Gift ought to be furnished here at the Capital, and the oath also taken in respect thereof, into the hands of specially appointed commissioners, consisting of three Honorable Company servants and three from among the burghers, who should sit in turns and to whom, to perform the clerical work, two clerks should be added. That in the respective outer districts the Landdrost, together with two Heemraden and two militia officers of the same district, should officiate, who ought to be appointed by the Landdrosts, Heemraden, and Militia Councils, each from their own body from among the most capable persons, and who, before entering upon their commission, should come hither to take the oath prescribed for that purpose; while the secretaries of the said Councils should be ordered, each in his department, to serve as secretary for this Commission. That furthermore, in order to proceed in this matter with all possible speed and, under the approval of the government, to issue the necessary orders regarding all difficulties that might arise in the execution hereof, two members of Your Honorable Worships' assembly should be appointed as Chief Commissioners. That the pay-bookkeeper of this Castle should prepare a list of all the Honorable Company's servants who shall be found present here locally, and the Burgher Councilors a list of the burghers, free blacks, and all other such persons carrying on burgher trade residing under the Cape, both to serve for the information of the Commissioners who will officiate here at the Cape for the levying of the aforementioned Liberal Gift or 50th penny; while for the Commissioners in the outer districts, the lists of names of the inhabitants held at the Drostadyes should serve. That, whereas according to Article 24 of the aforementioned placard the payment is required to be made half in cash ringing gold or silver coin and the other half in bank certificates or letters of credit, the latter should be altered by stipulating that the other half of the Liberal Gift shall be paid in current paper or card money, on the grounds that no certificates or letters of credit are in circulation here. That the Commissioners of this Capital should officiate here in the Reformed Church from eight to eleven o'clock in the morning and from three to five o'clock in the afternoon, at such terms as Your Honorable Worships shall be pleased to determine, and those of the outer districts at the house of the respective Landdrosts; the undersigned being of the opinion, however, that the terms of payment at the Cape and the Colonies of Stellenbosch and Drakenstein could run every three months, but that for this purpose in the Colonies of Swellendam and Graaff-Reinet a full five months would be required. And just as in the year 1752 the farmers who sustained themselves with cattle farming, among whom were found most of those who were destitute of cash and silverware with which to satisfy the 50th penny, were accommodated by leaving them free to furnish the liberal gift with cattle; so the undersigned, since this difficulty still exists in reality, could likewise find no other expedient for this. Wherefore he is then of the opinion that the inhabitants in the outer districts who are unable to pay the 50th penny in cash species, after having first declared so under solemn oath according to the form annexed hereto, should be allowed the freedom to furnish the said Liberal Gift in livestock, whether oxen, cows, sheep, or horses, namely to surrender two head for every hundred head owned by them, and proportionally as much more according to their further possessions, provided that the livestock is judged good and sound by the respective Landdrosts and other appointed Commissioners in each district. At present, however, the undersigned have been enabled, in accordance with the draft plan received from the Fatherland, to formulate a rough calculation of the required cash for the year 1792/93; which they have the honor to submit herewith, with the addition of the separate calculations of receipts and expenditures relating thereto for the year 1791/92. They have found that, assuming it will best accord with the intention of the High and Mighty Lords Masters to continue, for the time being—until the Company's circumstances are better remembered—to send cash for this Government, to make use for the most part of the introduced paper money in expenditures, no cash will need to be requisitioned for the year 1792/93; but that even by ultimo August 1793, when that which is still to be received on the allocations of the aforementioned High Superiors to the amount of ƒ161653 13 — may meanwhile have been brought in, a sum of ƒ278815 10 — in cash will remain for the following year.
