That the Landdrost, according to the duty of an officer of Justice in the District there, according to the determination thereof made by today's placcaat, shall be required to preserve and protect the Rights and authority of the high Sovereigns of these Lands. That he shall have, in the same District, the management of all Criminal cases, in order to instruct them before the Council of Justice here, in such manner and form as is prescribed by the ordinance concerning the style of proceeding in Criminal cases dated 9 July 170[illegible], nevertheless leaving entirely intact to the Fiscal of this Government his right of prevention, as he shall be permitted not only by prevention to overtake and prosecute all manner of Delinquents, but also personally to summon before the Council of Justice the Landdrost himself in case of frank collusion and offenses committed in the execution of his office contrary to our intentions and pleasure. And that, to the end that no persons who might cause any harm, either to the Company or to the Colonists, through evil deeds or practices, may reside in the widely remote fields, the Landdrost shall have to keep watch with all attention in this regard, so that such persons, according to requirement and circumstance, may be apprehended and brought to trial before the Council of Justice, as well as all other vagrants and vagabonds pursuant to the placcaats issued against them. That the Heemraden of the aforesaid Colony of Graaff-Reinet shall be qualified, upon the requisition of the said Landdrost, to take the preliminary informations concerning all Criminal cases occurring within their jurisdiction, wherein the circumstances, as the same Regulation further states, shall require that the witnesses be heard there; however, further Crimes may arise so great and severe that the apprehension of the Delinquent ought to take place very urgently and without delay, yet the far remoteness of the Drostdy from this Capital does not permit that the decree of the Judge can always and in all cases first be requested and awaited, but such might sometimes cause the Delinquent to find means of escape and thus remain unpunished to the detriment of Justice; the Landdrost shall in such cases have the authority, whenever from the preliminary informations taken in the aforesaid manner, both of the deed and of the corpus delicti, it shall have fully appeared, and that for the deed concerning which the informations were taken, in such manner and form as the same is circumstantiated in the taken informations according to laws or Placcaats, corporal punishment is absolute and without any doubt prescribed, to proceed with the requisite circumspection to the apprehension of such person upon whose burden the taken informations specifically lie and who has been reported or notorious for it, provided he shall then as quickly as possible and without the least delay give notice of the apprehension thereof, with the accompanying Informations, to the Honorable Governor and the Council of Justice, and request the approval thereof from the same Council of Justice; the Landdrost being accountable for this, and furthermore in all other cases being required strictly to govern himself according to the aforesaid ordinances on proceeding in Criminal cases. That the Landdrost shall also have to take care that the Interests of the Company are in no way curtailed, but shall advocate and help promote them in all respects. And further, he shall have to maintain accurately a List of all such Loan Places as have been granted under the aforesaid District, with precise notes of what is paid upon them, in order to spur on constantly those who might remain in default with the payment of the Honourable Company's dues for the same, and if necessary to constrain them by means of the law. That also, to the end that the Honourable Company is not curtailed in its rights, but on the contrary is properly relieved in the important costs which it must incur for the defense of these Places and Protection of the Inhabitants, as well as the payment of the Servants to the Colonies, the Landdrost shall have to pay attention, and employ all means thereto, that within the established limits of his Jurisdiction, as many Places are granted in Loan as is possible and can occur without noticeable prejudice to each other. As also, to prevent many disputes that arise over loan places upon their being granted, henceforth, whenever someone takes a Place in Loan, and wishes to make a request therefor to the Governor, it shall have to be investigated by the Landdrost whether such Places can be granted without noticeable encroachment, and a certificate thereof placed into the hands of the petitioner, to be shown to the aforesaid Governor upon the request, and to be preserved at the secretariat. In which it shall especially also have to be kept in mind that, through this living together of the Inhabitants in a suitable proximity to one another, they may be so much the better able, in case of emergency and in the event of attacks by the Bosjesmans Hottentotten [illegible]

Dat bij Landdrost volgens de pligt van een officier van Iustitie in het District aldaar na de bepaling die van hetselve by placcaat van heden is gemaakt, zal moeten bewaren en beschermen de Rechten onde authoriteit van de hoge Souverainen der„ Te Landen. — Dat hij in hetselve District zal hebben het beleid van alle Crimineelen zaken, om die te Instrueeren by den raad van Iustitien alhier, zo ende indervoegen als sulx by den ordonnamtie aangaande der stijl van pro„ Cedeeren in Crimineele saken de dato 9 Julij 170 voorgeschreeven is, latende niet te mijn aan der Fiscaal dezes Gouvernements zyn regt van proventie in zyn geheel, als die niet alleen bij praeventie zal mogen agterhalen te actioneeren, alle zoorten van Delinquanten waar ook den Landdrost zelve in Cas van france Collusie ende mis dryven, in het stuk van desselfs amb, Contrarien onse Insentien ende goed„ vinden begaan werdende persoonlyk voor den Raad van Iustitien te Caladeeren. promptly to assemble the force required for their pursuit or repulsion. But that, because the boundary with the Caffres has now been defined in the clearest terms, the aforementioned Landdrost must use every effort to prevent any of these inhabitants from crossing the Great Fish River, much less settling there, in order not only to prevent the most harmful further dispersal of the inhabitants, but also to forestall the hostilities that might arise anew from it with the said nation. That furthermore, in order to leave the inhabitants so much less opportunity to commit violence and annoyance against the adjoining Caffres, which nation, however, will always continue to apply to trade their cattle with them for other necessities, it has been approved—in view of the scarcity of suitable slaughter cattle currently found—to qualify the Landdrost to barter a good number of horned cattle from the said Caffres once or twice a year at the most convenient times for driving up the cattle, and to that end to have the required copper, iron, and tobacco supplied from the Company's warehouses, as well as to purchase the necessary beads and other haberdashery; and the Landdrost shall be earnestly recommended to conduct that trade in such a manner as may serve to the greatest profit of the Honourable Company, without, however, causing the least annoyance thereby to the Caffres or Hottentots, and to cause the bartered horned cattle to be brought up hither each time by well-trusted Bastards and other Hottentots expressly hired for that purpose, under the supervision of one of the mounted orderlies. Which trade the Landdrost shall always have to conduct in the presence of two Heemraden, with the assistance of the Secretary, and to keep an accurate account of everything that is expended for that purpose, both in copper and iron as well as otherwise, as also of the cattle that shall be traded for it, forming of the same a specific report signed by him together with the aforementioned Heemraden and the Secretary, of which report the original must be sent hither and a copy remain kept at the secretariat of Graaff-Reinet. That for the Landdrost and Heemraden and the Secretary, appropriate attendance fees and wagon or horse hire may be charged, as well as wages and hire of those whom one shall further find necessary to assist in that trade or bartering, or to serve in guarding the cattle, of which, alongside the report, a specific account must be sent hither, to be paid out of the proceeds of the bartered cattle when the same are sold, and otherwise out of the Company's treasury. While it shall be permitted to the Landdrost, in order to serve as messengers and interpreters with the Caffre nation and for other services that he might obtain from them, to retain two captains of the Gonaqua Hottentots, provided that they remain residing close to the Great Fish River in a stretch of land with their adherents; there being handed to each of them a cane with a brass knob upon which the mark of the Honourable Company shall be engraved, and to them, according to their fidelity and the service that they shall show during the cattle bartering with the Caffres, a reasonable reward shall be given each time by the Landdrost from that same cattle, or from the copper, iron, tobacco, or other trinkets. Furthermore, that the Landdrost, for the present at the most suitable places, but as soon as the court house shall have been built, there every month on the first Monday falling therein, shall have to convene a court of acting Heemraden and preside in their meetings as Landdrost, settling the dispute, and without formality of trial, all matters coming before them, according to the regulations, orders, and instructions established for that body in that regard, and must also take care that the same are properly observed and complied with in all parts. That after that time, in order that the Landdrost may come to hold this office with proper authority, there has been assigned to him a substitute and six mounted orderlies in the pay of the Company; the Landdrost as well as his said substitute must then also watch that no annoyance is committed by the same orderlies against the inhabitants. The aforementioned Substitute Landdrost being obliged to comply with and carry out whatever shall be ordered of him by the Landdrost touching his office. That furthermore, the Substitute Landdrost as well as the Landdrost himself shall be obliged constantly to supervise the prisons, in order that the same are properly cleaned, as well as to pay proper attention to the maintenance and keeping of the prisoners; nevertheless, while we do not want any contempt or slight to be shown to the office of Substitute Landdrost, the locking up and leading of the prisoners, as well as the domestic punishment of the slaves, must take place by the handling of such of the mounted orderlies [illegible]

which two loan places shall be withdrawn for the service of the aforesaid Drostdy, to such riders as this can best be entrusted to. And that notably the frequently mentioned Landdrost, whenever he shall need to betake himself to the Cape or otherwise be absent far from the Drostdy, shall have to make provision that during his absence the administration of his office shall not come to be neglected, making recommendations and handing over the same, in so far as it concerns civil and domestic affairs, to the Secretary, who has been prescribed how he shall then conduct himself therein, leaving the exercise of that office in criminal matters to the Substitute, with the addition of such orders as shall be required according to the circumstances of the time. Furthermore, with regard to the placement of the courthouse and the further buildings being required, it having appeared from the aforesaid report of the Landdrost that the place of the citizen Dirk Coetzee, situated in the Camdeboo at the source of [illegible] is most suitable for that purpose; and for which to its possessor, alongside yet another without payment of recognition fees, a loan place will be granted, whilst the same, moreover, because of the high purchase price of the homestead of the first-mentioned place, is to enjoy a reasonable compensation, and who of another place situated adjacent thereto has willingly made cession, yet with the request that on account of the prejudice which he suffers thereby, some proper compensation might be made to him; it has been approved to withdraw both aforesaid places of the mentioned Coetzee and let them serve for the aforesaid purpose, as well as to grant to the same Coetzee in full freehold the loan place whereof he has bought the homestead from the farmer Erasmus Smit, likewise situated in the Camdeboo, as well as to grant to the same further for his lifetime, without payment of any dues, in loan, such place as he, provided the grant thereof is to nobody’s prejudice, shall come to request from the Lord Governor; whilst the Landdrost and Heemraden aforesaid shall likewise be written to and authorized, in the matter of the mentioned Coetzee having had to purchase the homestead of the place of the aforesaid Erasmus Smit at a rather high price in order to have a good shelter, to let him obtain such compensation on behalf of the Colony as shall, according to the beside-mentioned place, which must serve for the keeping of the necessary horses, having also likewise been withdrawn for the Colony, over whose compensation the Landdrost and Heemraden will have to negotiate with the owner thereof. The aforesaid College is also authorized for the purchase of wagons and draught oxen to be used by the Landdrost on the commandos, fairness and reasonableness, in accordance with the damage suffered, be agreed upon with him. Just as it has also been resolved to likewise withdraw the place of the citizen Schalk Burger, situated on the Sneeuwberg, as the same ought to be employed for that purpose in order to be able to keep the necessary horses for the Landdrost and subordinates, and to preserve the same from the horse sickness prevailing yearly in the Camdeboo; and to likewise instruct the Landdrost and Heemraden to agree with the said Burger in fairness regarding its compensation. And as furthermore the marching out of the commanded citizens against the Bushmen Hottentots, or other necessary expeditions, often finds its difficulty because wagons that must serve to carry the provisions and other requisites cannot always be brought together, it has been deemed necessary to likewise instruct the Landdrost and Heemraden aforesaid, as well as to instruct and authorize for that purpose a number of mares and a stallion for breeding, to purchase and keep two suitable wagons and the necessary span of draught oxen, of which wagons and oxen the Landdrost, and with his approval also the Secretary, in order to assist them in the costs of their transport to the Cape and back, shall be permitted to make use in the meantime. Whereby it has been resolved that, in order not always to be in the necessity of purchasing the riding horses required for the subordinates of the Landdrost to the great expense of the Company, to likewise instruct the Landdrost and Heemraden aforesaid to purchase on behalf of the Colony a number of mares and one stallion, and to keep them on the aforesaid place on the Sneeuwberg withdrawn for that purpose, in order to be able to obtain from their progeny in future the aforesaid riding horses for the mentioned subordinates; the aforesaid wagons, oxen, and horses being required to be entered on the inventory of the Colony’s effects and surveyed and handed over yearly upon the arrival of new Heemraden. The above-mentioned amount, subscribed by the inhabitants in support of the colony's expenses, is noted. with instructions as to how it shall appear which persons and places henceforth must be included thereunder; all persons, families, farmhands, slaves, cattle, grains, and other possessions of the inhabitants situated under that district and also belonging to the said Drostdy of Graaff-Reinet, shall have to be reported annually at the time that, with the approval of this Council, is to be proclaimed each time by the Landdrost and Heemraden there, in order to pay the usual poll tax and the taxes on livestock as colony revenues there as well, on pain that anyone who is found negligent therein shall each time incur a fine of fifty Rixdollars for the benefit of the colony's treasury, without prejudice to his required return, for the fulfillment of which, in case of further unwillingness, proceedings will be taken against him according to custom. That also, in order to prevent fraud regarding the returns that must be made, henceforth, whether persons, family, farmhands, cattle, or other effects, they must be returned in the very district where each of them resides, stays, or is situated; therefore under explicit prohibition to the respective officers of justice and the commissioners who shall officiate for the returns here and in the outer districts, henceforth to accept any return other than of persons, family, farmhands, and slaves residing, as well as cattle and other goods remaining or situated within the district covered by the said return. However, in order to accommodate those who do not themselves reside in the district where their aforementioned possessions must be returned, it shall be permitted for such persons to authorize someone on their behalf, whether the farmhands of the places or others, enabling the person to whom the commission is given, when such might be required according to the prevailing proclamations, to confirm under solemn oath on behalf of his principals this return to be performed under commission. But that, if anyone who does not come to reside himself in the district of Graaff-Reinet, each being required according to custom in the outer districts to register himself in the aforementioned Colony, but is obligated to make a proper return at the Drostdy there of the effects situated under that district, is found unwilling in that regard, the Landdrost and Heemraden of that district, according to the authorization hereby granted to them, shall have to proceed to the place or places of the defaulting person situated in the aforementioned district, in order to survey there themselves the goods that ought to have been returned, and all this at the expense of such unwilling persons, in order to recover the same costs by immediate execution upon the goods found there. Which council of war shall be ordered and commanded to be mindful, with all diligence, of all such means as may serve to protect the inhabitants against the violence and nuisance of the Bushmen Hottentots, and to that end constantly to command and send out the necessary forces, so that the said sort of people may continually be overtaken in their hiding places, or at least disturbed, and consequently may be compelled either to a peaceful conduct or to return to their former place of abode. With qualification to fine the unwilling and negligent for the benefit of the war chest; anything occurring in bays or along the coasts to be promptly reported. To which end, and so that the commandos which shall be found necessary to establish may be properly observed, it is approved to qualify the aforementioned council of war to fine for the benefit of the war chest, according to the merits or exigencies of the case, anyone who, in a matter of so much importance and on which the livelihood and welfare of the inhabitants there depend, is found to be negligent and has not observed the commando assigned to him, and this up to the maximum sum of one hundred Rds with respect to the field-wardens or field-corporals, and of fifty Rds with relation to the common burghers. Report concerning the sale of house plots, corrected according to its tenor. Thus resolved and decreed in the Castle of Good Hope on the day and year aforesaid. Was signed: C. J. van de Graaff, P. Hacker, R. S. Gordon, J. J. Le Sueur, O. G. de Wet, T. C. Rönnenkamp. Friday the 4th of August 1786, in the forenoon, all present. The gentlemen members of this Council, Oloff Godlieb de Wet and Tobias Christiaan Rönnenkamp, having reported that, pursuant to the resolution taken at the session of the 14th of June last, and under the conditions arranged both at that time and subsequently at the meeting of the 19th of July last, the public sales had taken place of the nine pieces of house plots from the grounds of the old Hospital, as well as of the twenty house plots divided into two new blocks in the southwest of the Cape village; and that the said nine plots from the grounds of the old Hospital had yielded ƒ 118475, together with the twenty house plots in the aforesaid two new blocks ƒ 42275. Whereupon the proceedings of the said gentlemen members were approved. Thereafter it was made known by the gentleman Governor that His Honour, having learned that the Burgher Councillor Jan Coenraad Gie was inclined to sell his two warehouses, the one 100 feet and the other 67 feet deep, and both 16 feet wide internally, with a suitable dwelling house adjoining thereto, situated diagonally across from the warehouse and plot recently purchased on the Company's behalf from the burgher Jacobus Johannes van der Berg, next to which last-mentioned plot there was still lying a piece of land measuring 100 feet square, which the said Gie currently possessed by permission and had provisionally enclosed with walls, and which he was also prepared to relinquish. His Honour, with the intention of purchasing some more suitable warehouses for the Company, considering that the situation of the aforesaid warehouses and dwelling house, with their grounds and the opposite plot, could be of very great use and service to the Company, had caused the same to be examined and appraised by the Company's masters of the carpenters and masons, who had found the same well-built and had appraised them, according to the present value of real estate, at a sum of ƒ 45000. His Honour proposing to purchase the aforesaid warehouses, dwelling house, and plots for the Company, it was, in view of the necessity thereof and the fact that one has been placed sufficiently in a position to do so through the profitable sale of the aforesaid house plots, approved and resolved to authorize the said gentlemen members of this Council, Oloff Godlieb de Wet and Tobias Christiaan Rönnenkamp, to purchase the aforementioned parcels from the said Burgher Councillor Gie at such price as can best be agreed upon with him according to the measure of the aforesaid appraisal. Furthermore, upon the proposal of the well-mentioned gentleman Governor, it was resolved, in order to maintain better direction and supervision in the Company's slave lodge, due to the lack and want of which it is being experienced more and more that, to the great detriment of the Honourable Company, much sickness and mortality arise among its slaves, to expressly appoint the bookkeeper and plumassier Carel Mappa to also keep close daily supervision over the feeding, clothing, and further treatment of the slaves, so that this may proceed in the requisite order for their preservation and to the greatest interest of the Honourable Company. The gentleman Governor was further pleased to make known that His Honour, in the meeting of the 5th of August of last year, had laid open the necessity of augmenting the artillery corps, pursuant to which it had then been resolved to augment that corps with 400 private men, alongside two officers and the necessary non-commissioned officers; that the said proposal at that time had been made solely because one was most clearly convinced of the necessity that the proven weakness of that corps ought in some way to be reinforced until such time as the high-ruling Lords Majors would be pleased to approve the drafting of a fixed plan concerning it. They, while still awaiting the same, found themselves unable to draft a fixed plan for the strengths of the military forces in general, and that of the Artillery in particular, meanwhile ensuring that whatever could bear no delay was not neglected. And whereas this proposal of the well-mentioned Lord Governor was found to be of such weight and necessity that it ought to be executed without delay, it has been approved and agreed to carry out the augmentation of the artillery corps as detailed above, and in view of the unavoidable necessity, potentially upon the proposal of the well-mentioned Lord Governor, in order for the present to avoid appointing more officers to the artillery at the least expense to the Company, since otherwise the foresaid number of heads ought at least to be divided into three companies, which in the course of time and by the pleasure of the Lords Majors may still take place, to form from that corps, with the distribution of the present number of officers attached thereto, two companies of 150 heads each, and to grant the one to Colonel Gilquin as Effective Captain, and the other to Captain Johannes Fischer, as well as six non-commissioned officers, while the Third Engineer Thebault, needing assistance for the school, shall remain continued under the other arrangements at the same on the present fixed footing, until the wise directives of the high-commanding Lords Masters shall have been further understood in that regard; merely provisionally, in order to add the indispensably required non-commissioned officers to that corps and to the said two companies, it has been approved to appoint two bombardiers and four vice-bombardiers. has executed the inspection and cultures of grain both around Plettenberg Bay and Mossel Bay, it was observed and subsequently reported that the inhabitants in Houteniqualand, whose lands are naturally suited neither to grain cultivation nor to cattle farming, would be disposed to chop the necessary timber in the various forests and to deliver it at very reasonable prices to the Honourable Company at Plettenberg Bay; and among other things reported by him regarding this matter, it appears that in the event the chopping of wood were contracted out to those inhabitants, a large number of places or plots, which in such cases would not require as great an area as usual, could still be granted in Houteniqualand, and thus many families who would then wish to settle in those regions could obtain their livelihood by manual labour. It has been taken into consideration that such should further be done by public tender on behalf of the Company. Regarding all of which it has on the one hand been taken into consideration that if the chopping of timber were undertaken and continued on the Company’s account in that manner, the expenses would turn out to be very costly and run high, besides the fact that the employment of so many European crew members as required for the labour would have a detrimental effect on strengthening and keeping the garrison at full strength, and that the costs for those operations and equipment, especially also for purchasing the farm of the aforementioned Botha and his proper indemnification once made, in case shipping to the aforementioned Plettenberg Bay should unhappily and contrary to expectation not succeed, would have been spent in vain, whereas upon its good success and continuation the benefit of the Company would then also be limited to itself alone without any incidental benefit for the colony; but that on the other hand, the High Governing Lords Masters have wished to give so many distinct proofs that the prosperity and welfare of this colony lies very close to their hearts, and on this occasion their earnest recommendations are especially taken into consideration to keep in view everything by which the most disadvantageous further dispersal of the inhabitants could be prevented and hindered, so that if, as one relies upon with good reason, by contracting out the chopping and delivering of the timber to the inhabitants, the purpose is accomplished at one stroke, in accordance with the above-mentioned much-venerated missive, to fetch the required timber for the Company’s still-required buildings at the main settlement from the bays, and thus to obtain it here in the vicinity, assuming that this would not cost more than what has been obtained until now both from the Indies and the Fatherland, and through chopping and costly transport in this country; and on the other hand, by also keeping open a trade and shipping route whereof the inhabitants of Houteniqualand have undertaken the deliveries in the aforementioned bay, whereby in the future, from the sale to the inhabitants at this main settlement of the abundantly imported timber, not only will they be greatly relieved, but also, after the costs of the sea transit and the risk of the sea, a proportionate profit can be obtained for the Honourable Company. to the inhabitants there, incorporating with that opportunity the instructions to be observed, duly fulfilled their obligations, the cutting and transport of the felled wood to Plettenberg Bay could still be undertaken and continued further by workers to be appointed for that purpose at the expense of the Honorable Company. And it was therefore approved and resolved to conclude an agreement, likewise instructing the above-mentioned Master of Equipage Duminy, burgher Lieutenant van Reenen, and shopkeeper Bergh, along with their aforesaid commission, that having executed the same, they should also proceed to the aforementioned Outeniqualand at Plettenberg Bay, and after having inspected the existing forests and recorded all places in that region required for entering into and concluding an agreement in Plettenberg Bay, as well as having examined that bay accurately and as far as possible, the following standing instructions regarding this commission shall serve for their information and instruction, and thus: 1. To investigate whether the Company's ships would be exposed to excessive danger in the aforesaid bay, and whether and in what manner that danger can best be prevented in that case, as well as what kind of vessels would be best employed both for loading the timber and for navigating the bay, and at what times of the year the same bay can be navigated and called upon most safely; likewise whether the ships or vessels that would be dispatched to the aforesaid bay to collect timber, if such should be favorable, might at the same time call at Mossel Bay in order, before or after loading the timber, to also ship the grain in the latter mentioned bay; on all of which points the Master of Equipage Duminy shall especially direct his attention, as well as report his findings and accompanying considerations. 2. After the aforesaid Master of Equipage shall have judged and found that the aforesaid bay can be navigated with sufficient safety by the Company's ships or vessels, the aforesaid commissioners shall inquire of the aforesaid inhabitants whether they are inclined and prepared to cut the timber that the Honorable Company shall require, and which shall be successively specified to them, in the forests situated there, and to deliver it to the said bay, as well as to stack and store it in the same shed according to the directions and to the satisfaction of an overseer to be placed over the shed to be erected. And if they or any of them are inclined to undertake this at most against the above-mentioned prices, and also to calculate and deliver other required timber not expressed in their specification pro rata, then to enter into a final agreement with them in that regard, so that it can be provisionally contracted out to the said inhabitants or contractors to cut and deliver as many beams of the above-mentioned different calibers, as well as wagon-makers' timber, as they, the commissioners, shall deem sufficient for a full cargo of a ship or vessel best and most fitly to be employed for that purpose; the same inhabitants or contractors also promising, and upon penalty of being deprived and excluded forever from the supply of timber, binding themselves whenever any ship or vessel shall have appeared in the bay to collect timber, to provide as many of the people whom they ordinarily employ as woodcutters as shall be necessary, under the overseer to be appointed, against a reasonable daily wage also to be regulated with them by the said commissioners, to serve for the speedy loading of the ship or vessel. 3. In order to be able to carry out the timber conveniently for shipment and to store it in reserve for at least one year, in such a place as is best situated and shall be judged and found suitable for ready dispatch, a suitable shed must be erected, the construction and preparation of which, according to the specifications and design to be provided and indicated by the commissioners, shall also be contracted out to such of the inhabitants as will undertake it for the lowest price and for completion at a convenient time. 4. Just as also, because in the future a suitable and proper facility will have to be constructed on the sea beach in order to allow the small craft that will have to serve for the shipment of the timber to arrive and load safely and easily, the aforesaid commissioners are likewise ordered to have this examined by the master shipwright or other capable person of that trade, who shall also proceed to the aforesaid bay to assist the aforesaid commissioners, and to contract out to the suppliers of the timber all such timber as the said master or person shall state to be required for that purpose, in order to be delivered after completion of the shed, and stored provisionally in the same, so that as soon as affairs allow the necessary people to be sent from here for that work, the said timber may then be found on hand and in readiness. 5. And since it is very difficult to distinguish by eye between good and bad yellowwood, the aforesaid commissioners shall, if possible, investigate and report what measures can best be devised so that no fraud is committed through the delivery of the latter for or instead of the former, and to notify the inhabitants or contractors of the delivery that they must hold themselves bound to all such orders as shall be judged necessary to establish in the future to prevent this. 6. to prevent that no trees in the several forests of the Houtemqualand are needlessly cut down and destroyed to make room for timber, but on the contrary, in order to serve the further benefit of this Colony by further permission of the Honorable Company, ought to be preserved, they will also have to guard themselves against this, under such penalties as shall be found necessary to establish against it. While in the meantime it shall further be investigated and reported by their commissioners what orders according to their thoughts will be best and most suitable to combine and execute in this regard. 7 While it shall furthermore serve the aforementioned commissioners to ascertain what matters should chiefly be required for observation from an overseer to be appointed over the receipt, storage, and shipping of the timber, and to make a specific report thereof, in order that such can subsequently be enjoined and commanded to such an overseer in the instruction to be issued to him. 8 But in the event that the aforementioned commissioners should unexpectedly discover that the inhabitants in the Houtemqualand do not persist in their made offers and commitments regarding the chopping and delivering of the timber, and thus would by no means cooperate with the said dispositions that serve so much to their favor and also to the salvation and prosperity of their descendants; or should come to demand more than the above-mentioned voluntarily stated prices, they shall have to take all such measures as appear from the report of the aforementioned Landdrost or as shall be judged and found further and advisable by the commissioners that ought to be undertaken to begin and continue the same work on the Company's behalf. And after the aforementioned Honorable Rhenius made known that, whereas he had arrived in accordance with the aforesaid election in order to assume the said office, and that this conferred the full authority to demand that the Honorable Hacker, having obtained his discharge from the service from the High and Mighty Lords Masters, should as soon as possible make the transfer of his administration to His Honor, however much His Honor would otherwise not wish to deprive the aforementioned Honorable Hacker for the time being of the income attached to that office; yet since His Honor would be obliged to incur very heavy expenses to establish himself, and meanwhile, if the more mentioned Honorable Hacker were to continue to enjoy the said income, His Honor would have to find himself deprived thereof; whereas the same income was essentially limited only to the legaties enjoyed from the wines delivered to the Honorable Company, which deliveries for a following year will begin on the first of September next and would end precisely at a time when the said Honorable Hacker could make preparations to depart from here for the Fatherland at the suitable season of the year; His Honor, in order not to fall into the hardship of thus filling the office of Secunde for an entire year without enjoying the income thereof, and in the meantime, in order to maintain a state commensurate with that office, having to consume his own means; saw himself driven by all these reasons and by necessity to request that the aforementioned Honorable Hacker should immediately make transfer of his administration, and consequently also surrender to His Honor the aforesaid dues arising therefrom. Against which the Honorable dismissed Secunde Hacker advanced that, seeing that His Honor had now served the Company for more than forty-eight years with all zeal and faithfulness, solely because His Honor had experienced that due to advanced years he could no longer continue in the service, had requested his discharge, in order to spend the remainder of his days in peace in the Fatherland out of His Honor's very moderate means, acquired mainly both by marriage and by inheritance; and that the Highest mentioned Lords Majors had taken favorable regard of that request and, having granted the discharge with retention of rank and title, had pleased very expressly to write that the said discharge should take no effect before the transfer of His Honor's administration to his successor should have been made; and that the extent of the administration did not permit making that transfer in such a short time that His Honor's successor could thereby be put into the enjoyment of the income, without subjecting His Honor to the hardship of laying down his service in a rather disgraceful manner in the meantime and before a suitable season for his departure for the Fatherland should have expired; whereas His Honor, however, was informed on good authority that it was customary at all the Company's offices in the Indies that anyone arriving at another office as a successor to any directorship or administration did not enter into the function nor the profits before and until the person to whose succession he was appointed had handed over and vacated the office or administration; just as this had also been practiced in this government itself when the Honorable Secunde Sergius Swellengrebel had arrived here in the month of August of the year 1750, having entered into the complete exercise of the same office and the enjoyment of the benefits no earlier than the month of March of the following year, and that after the then Honorable Governor Hendrik Swellengrebel, through his departure, had afforded the opportunity for the Honorable Ryk Tulbagh to act as elected Governor, and for the latter to hand over the post of Secunde to His Honor's successor; the Honorable Hacker therefore was by no means inclined to resign the aforementioned head administration and until he shall have made proper transfer of his administration, nor the revenues appertaining thereto; declaring also that he could not expect that this Council, being well aware of all that had been adduced by His Honor, would subject His Honor to such a hardship, and thereby also deprive him of the salary, which in the present dearness of foodstuffs [illegible]

has been attentively deliberated upon this dispute among the other members, whether by equity the former revenues ought not still to be enjoyed according to His Honour's circumstances until his impending departure. Whereupon, after the aforementioned Messrs. Hacker and Rhenius had stepped outside, having been attentively deliberated and taken into consideration that however much, on the one hand, the aforesaid claim made by the aforementioned Mr. Rhenius is not to be considered unfounded, as His Honour was indeed actually present here in order to assume his post and to replace Mr. Hacker, to whom his requested discharge has been granted, and through the deferral of the immediate transfer His Honour would find himself deprived for an entire year of the aforesaid principal official revenues, at a time when the same must be of the greatest service to His Honour, both on account of the present pressing dearness of provisions and to purchase his foremost necessities, which presently turn out very expensive here, in order to live in accordance with the customary status and standard of a Secunde, it would, on the other hand, however, involve a great hardship for Mr. Hacker if it were imposed upon His Honour to lay down the exercise of that office immediately, even before the opportunity exists to be able to depart from here for Europe at a favorable time of year as a consequence of the obtained discharge, for which, however, no example is known of anyone who has not failed in one or another part of his duty having been forced to do so. Thus, in order to avoid the unpleasantness of a decision by which difficulty a hardship would be caused to one or the other side, it had to be resolved, subject to the favorable approval of the High and Mighty Lords Masters, to allow the aforementioned Mr. Hacker the enjoyment of the aforesaid revenues of the wines until such time as he shall have made the transfer of his administration in order and in a proper manner, and at the same time to allow Mr. Rhenius to enjoy from the Company's treasury an equal amount as shall be due to the aforementioned Mr. Hacker at that time from the first of September next out of the aforesaid revenue of the wines, both nonetheless under promise of restitution, if and insofar as it might not please the Most Noble Lords Masters to approve the aforesaid arrangements, and such in accordance with Their High Mightinesses' disposition or pleasure then to be learned thereupon. Subsequently, there being brought to the table by the Lord Governor a memorial from Mr. A. F. Steffers, Captain in the service of the State of the United Netherlands, presently finding himself in the direction and command at the wreck and over the portion of the crew of the wrecked national ship Holland remaining behind here, and likewise a submitted report from the Resident at False Bay, Christoffel Brand, and the Master of Equipage, Francois Duminy; it was, after consideration of the aforesaid memorial, because it appears from the aforementioned report that the cordage is subject to suffocation by the accumulated rainwater, and also has for the most part been damaged by being brought ashore over the rocks and reefs, and therefore could be of no use or service to the Honourable Company, and taking into consideration at the same time that the costs for its transport to False Bay would run very high, so that one would certainly find the value of the cordage to be surpassed by the outcome of those amounts; that moreover the transport of the heavy barrels over the intervening mountains and rocks cannot be undertaken without exposing a portion of the men to be employed for that purpose to danger of life, or at least to maiming, and that also in order to remain capable of having the salvaged cannon and further munitions of war, which one will gladly take over for the Honourable Company for the service of this government, fetched from the wreck and transported as quickly as possible, as this likewise cannot occur without employing many people and great costs, one moreover can find no possibility of carrying this out with regard to the salvaged goods for a long time, whereby absolutely more and more decay of the cordage would have to arise; for all these reasons it was approved and understood to declare to the aforementioned Captain Steffers on the first and sixth points of the aforesaid memorial that one entirely renounces the taking over of the cordage as well as the wreck and further goods for the Honourable Company, the cannon and further ammunition alone excepted, and that His Honour shall therefore be politely thanked for the offer made thereof, with the addition that it is left to His Honour's discretion to sell the said wreck, cordage, and further goods at public auction to the inhabitants, as we in such a case would find best and most advisable to act on the Company's behalf, or else to proceed therewith in such a manner as shall otherwise be more advantageous. which for the further benefit of this colony serves to declare, as also to provide as much of the requested rations as possible, and that ordinary sailors who can be spared and discharged from the service of the state may be transferred; the Lord Governor shall appoint someone to go there and take over into the Company's service, at the wages earned in the state's service, as many of them as shall be willing to do so. That, whereas through the present fortunate circumstances of external peace and internal tranquility, one finds oneself sufficiently able to redress and check events that demand a strong arm—which occur so rarely in this Colony—and thus, while expressing our obligation for the offer contained in the fifth point, we nonetheless acknowledge and shall gladly accept this offer from the aforementioned Mr. Silfvers as a particular mark of His Honour's readiness for the protection and security of this Colony. And that, in partial answer to the fourth and seventh points, order has already been given by the Lord Governor to furnish, upon the statements to be made by the aforementioned Mr. Silfvers, for the account of the Admiralty, whatever can be contributed toward the customary rations for the crew; but as the table money for the ships of the state has not been paid here except upon their voyage home, it has been approved and resolved to cause to be paid out from the Company's treasury to the frequently mentioned Mr. Silfvers, for the account as above, as much money as His Honour shall require for assistance in his own expenses and lodging, as well as for that of the officers, and to provide sustenance for the non-commissioned officers, soldiers, and ordinary sailors who may continue in the state's service; since on the Company's part there is no opportunity at hand to provide His Honour and the officers with suitable lodging, and only for the non-commissioned officers and common folk can suitable accommodation be prepared here. Item: to disburse from the Company's treasury what is necessary for the maintenance of the junior officers and common sailors. A certain number of men transferred from the state's service into that of the Honourable Company. The same shall be re-engaged in the manner and under the conditions as mentioned on the side. Having been returned by the Captains of the state's ships Goes and Juno to this government, a number of forty-three men with whom the said ships were assisted both at the capital of the Indies and at Ceylon, and who, with the suspension of their wages, were transferred from the Company's to the state's service—namely, thirty men from the state's ship Goes on the ultimate of June last, and another ten men on the ultimate of July thereafter; and three men from the state's ship Juno on the first of this month. While the accounts provided to these persons at Batavia were closed in such a manner that, pursuant to the secret resolution of the minutes of Their High Mightinesses dated 5 April 1785, they were transferred to the state's squadron, and their adverse balance was to be recovered in the said service, yet from the submitted accounts closed on the frequently mentioned ships Goes and Juno, it does not appear that their adverse balance was carried over there. Thus, concerning the aforesaid persons, it is deemed best and resolved to have their previous monthly wages earned with the Honourable Company take effect again from the day they were discharged from the state's service and returned to the Honourable Company; and that, in so far as their pay accounts have been received, those who had an adverse balance at the closing of their last accounts at Batavia shall be redeemed by this government upon being booked, and upon their departure for the Fatherland, the premium for all of the said men shall be left deferred to the discretion of the Lords Majors. Those aforesaid persons who were directly in the state's service, of whom no original pay accounts have been obtained, shall be taken in upon open accounts and retained here until their original pay accounts have been received from Batavia. And another number of persons also accepted by the Honourable Company. And since from the aforementioned two state's ships Goes and Juno a total of fifteen persons have also remained behind here in the hospital, who had departed with the same vessels from the Fatherland in the state's service, it is understood regarding them that those among them who should be inclined to do so may be engaged in the Company's service for the Indies; but the remainder, at the least expense to the Admiralty, shall be granted free passage on the upcoming Company return ships, performing ship's service for their board. To Monsieur van de Graaff Governor at the Cape of Good Hope Sir In the state of doubt in which we are regarding what gave rise to the shipwreck of the brig La Rozette, we ought, it seems to me, to apply ourselves to gathering everything that may enlighten us concerning an event that I still regard as extraordinary. You have just informed me, Sir, that independently of the three men of this crew detained in your prisons for some days, you have just at this moment suspected three others as accomplices, and that your orders had been given to secure their persons. I beg you to be so good as to order for these men the same inquiries which contain, against several persons of the French ship La Rozette, allegations of having run the same aground and murdered its crew; the said Agent requesting the administration of justice for the same that I requested from you for the first ones, and that they be likewise subjected to all the rigors of your laws. Thus, in order that the matter, in which strong suspicions of the case mentioned in the said letters appear, demands that without the least delay of time a thorough further investigation be conducted regarding this, and that it is of the utmost importance to the entire seafaring community of all nations that the crime of the persons noted in the aforesaid letters, so far as such might further appear, be punished; and that the said Mr. Agent, in this his capacity, is requesting that all submissions against the same persons may be ordered which, for the reasons mentioned beside, is granted to be delivered into the hands of the Justice of this Government; that His Honour, for that reason and to that end, is surrendering and abandoning the very same persons, along with the provisional examinations that were conducted, to this Government; and that on those terms, the requested administration of justice for the several aforementioned persons cannot be refused to the said Mr. Agent, even less so on account of the close alliance in which the State of the United Netherlands stands with His aforementioned Most Christian Majesty; it is therefore approved and agreed to place the six persons of whom the frequently mentioned Mr. Agent made mention in the aforesaid letters, with the delivery of an extract hereof alongside copies of the letters and the original provisional examinations, into the hands of the Fiscal pro interim, Gabriel Pieter Oster, with orders to proceed against the same persons ex officio and according to the nature of their crime; and likewise to command the Council of Justice to administer proper justice upon the several aforementioned persons regarding the pieces and proof of their crime; the frequently mentioned Mr. Agent having undertaken, Approval of the agreement made with the Company butchers regarding the supply of ordinary and extra meat insofar as the costs and expenses of Justice could not be recovered from the property of the delinquents, to satisfy the same on behalf of His aforementioned Most Christian Majesty. Jacobus Johannes le Sueur and Tobias Christiaan Ronnenkamp, that Their Honours, in conformity with what was resolved at the session of the 4th of this month upon the petition submitted on the same day by the contracted butchers, both regarding the difficulties Leasing of the Country's Public Revenues and Incomes raised by them against delivering the extra meat supplied to the Honourable Company and for the service of the Country's ships at a price lower than three stivers per pound, as well as with respect to their request made therein to be paid the same price in the future for meat to be delivered in that manner, had come to an agreement and settled with the same contracted butchers that the meat delivered by them in the aforesaid manner during the recently past month of July and this month of August should be calculated and paid at 12 stivers for five pounds, or two and two-fifths stivers the pound, but that from the first of September next, such extra meat to be furnished should be delivered by them at two stivers per pound. And this agreement was also approved accordingly.
