and the unlawful manner of proceeding maintained therein by Colonel de Meuron, the written order of His Honour to that His Honour, as soon as he had been informed of all these unlawful dealings, had inquired thereof from the Captain of the Regiment, being the eldest who was present, and having received from him a confirmed reply, had considered that for that reason he had to suspend the court-martial, all the more because His Honour came to learn that the said Quartermaster Louchain had subsequently given a declaration before commissioners concerning that matter, entirely contrary to what he had deposed in pleno Judicio as mentioned above, so that His Honour, regarding the said suspension of the court-martial, also dispatched the order in writing to Colonel de Meuron through the Major of the Regiment, with the submission of the written document, in the following terms: Having been informed that Colonel de Meuron wishes to proceed to a court-martial to the exclusion of fourteen officers who are under arrest for having made a scruple in a previous session of the court-martial about judging and pronouncing on a proceeding which according to their opinion was not drawn up in proper form regarding the soldier Robert, accused of desertion, who is said to have complained in his declarations of having paid for a second musket, the first having already been paid for although defective, just as the quartermaster Luchain had made depositions concerning this in the full past court-martial and afterwards in private before commissioners appointed subsequently; and as according to my information the depositions are absolutely contradictory, they cannot therefore be admissible in either case, and for that reason were rejected by the majority of the said past court-martial, these gentlemen therefore thought they should suspend their judgment until complete information was obtained; and as these fourteen officers, by order of Colonel de Meuron, are to be excluded from the court-martial; consequently, I order Colonel de Meuron to suspend the court-martial until and the protest against this by the aforementioned Colonel de Meuron until the proceeding is in proper form and perfectly investigated and leaves no further embarrassment to the judges. It was signed: at the Castle at the Cape of Good Hope, the 3rd of January 1786. That also following this, instead of relieving the embarrassment of the judges and admitting the arrested officers to the court-martial as they were obligated and authorized to do, the frequently mentioned Colonel de Meuron had addressed to him, the Governor, a missive and protest which His Honour produced to the assembly and was found to be of the following contents: Governor, Pursuant to the written order you addressed to me yesterday, the court-martial that I had ordered for this morning against the man named Robert, soldier, deserter and thief of the 4th Company of my regiment, was not held. I began by obeying as I must, and that is what I shall always do, but I must then place myself in good standing; this is why, Governor, I respectfully request you to receive my protest. According to the Carolina and what I have seen practiced in the Swiss Regiments in which I have had the honour to serve, I believe I have grounds to maintain that the proceeding is sufficiently prepared; that the subaltern officers who compose the court-martial have failed in their duty by refusing to pronounce against a criminal who was delivered to them for that purpose by sovereign sentence; that they have committed an act of authority infringing upon mine by summoning the quartermaster Luchin before them to depose there, given that the law grants to me alone the power to order investigations and to the Grand Judge that of receiving them according to my orders; that they have committed another act of authority infringing upon that of the Superior Council by disapproving its sovereign sentence. For these reasons, I solemnly protest against whomsoever it may concern regarding the infraction, in my view, committed against the laws of the nation, according to which the tribunals of all Swiss Regiments must be governed. I have the honour to inform you, Governor, that I will send by the first opportunity to the Directors, our Lords and Masters, the proceeding and all the papers relating to this affair, in order that they may take advice upon them from Swiss Regiments and convey the whole to the magistrate of the city of Neuchâtel, from whom I hold the power to administer justice in my regiment, to whom I am responsible, and who alone has the right to pronounce whether I am right or wrong; I will request the Directors to address the replies to you. As the said Robert is convicted of desertion and theft, so that according to my laws and those of the Noble Company he cannot avoid at least the galleys, I leave him in prison until our masters have enabled you to know in what form his ultimate fate is to be pronounced. as also a letter which the Lord Governor thereupon caused to be dispatched to the said Colonel To Monsieur the Colonel Meuron humble and very obedient servant was signed de Meuron. That whereas the well-mentioned Lord Governor had judged the points appearing therein to be of such a nature that they indeed required serious consideration, and therefore having caused this meeting to be convened for that purpose, in the meantime had caused the following missive to be dispatched to the frequently-mentioned Lord Colonel— Sir Your letter which I have just received this morning, serving partly as a reply to the orders that I found myself obliged to send you in writing yesterday evening, contains moreover various reflections on my manner of acting in this case, and furthermore different points of so delicate a matter that I shall assemble tomorrow morning the Council of Policy to present deliberation over that affair to that Board the aforementioned order, as also your above-mentioned letter, in order to make it a serious point of deliberation of this Superior Council, and to be able to make the proposals that I believe necessary, so that the Council can take a resolution on the subject, as it shall judge necessary. And the Members of this Council, fully conforming themselves with the orders given up to now by the Lord Governor, furthermore, after the said Lord Governor was pleased to bring this matter to the business of this meeting, seriously deliberated upon it and in the first place noted: that the declaration made by the Lord Colonel in the aforementioned missive that he will obey the order received by His Honor from the Honorable Valiant Lord Governor for the suspension of the court-martial on the one hand, and on the other hand that which follows at the end of the same missive, that he, the Lord Colonel, will leave the soldier Robert in prison until our Lords Masters shall have enabled him, the Lord Governor, to know in what manner one shall decide on the fate of that soldier, are diametrically opposed to one another, since no intention of the Lord Governor can be elicited from the aforementioned order to cause any delay in the proper administration of justice; but on the contrary that, in order to keep the said administration of justice in order and according to the prescription of the laws, the judges should be fully and properly instructed regarding the excuses brought forward by the accused; that furthermore it has in no way been asserted on the part of the Lord Governor as the Lord Colonel seems to wish to state as if the court-martial had not commenced according to order, but rather that in the progress and the inquiry one did not proceed to the satisfaction of the judges, and the trial thus suffers from prominent defects. That that also the officers have not refused to pass judgment on the criminal, but that, since that same supreme power which commands the trial of criminals to the judge also commands the same judge by the established laws and ordinances to consider the crime well and to pay attention to all circumstances that accompany it, to the end that, should anything appear therein that must serve to mitigate or aggravate the punishment, such is taken into regard upon sentencing; and the said officers, having thus raised difficulties about passing judgment before and until the trial has been properly instructed, have also acted according to the duty that is prescribed to judges by the same ordinance, as the observation of this with relation to the matter of desertion is found noted very specially in the Constitutio Criminalis Carolina Paris edition Anno 1734 on article 108 page 171 in force with the aforementioned Swiss Regiment, reading: in the inquiries that are made against a soldier accused of desertion there are four principal heads to examine 1 the causes of his desertion to know what drove him to this action if he has not received his pay exactly etc. that as regards the right to which the Lord Colonel de Meuron appeals, as if it belongs to him alone to order an inquiry to be made, and to the superior judge to accept it, no one has attempted to take anything away from either of them in that regard, in so far as the inquiry is conducted in every way properly and satisfies the requirements of the law; that with the protestation that the Lord Colonel adds thereto and the attached notification of his intention to transmit to the Lords Superiors the administration of justice and all documents relating to this case, as well as with the detention of the soldier Robert until the disposition of the aforementioned Lords Superiors shall have been received, neither justice would be rendered any service, nor would the intention of our same Lords Masters be answered. and resolved to order the repeatedly mentioned Colonel de Meuron to act therein according to the law and the prescriptions of the statutes. And whereas on the contrary both good order in the aforementioned Regiment and the general welfare are in the highest degree dependent upon criminal justice taking its course and offenses being properly punished, It is therefore resolved to order the said Colonel de Meuron, as he is hereby ordered with the delivery of an extract hereof, without the least further delay, to reconvene the court-martial with the inclusion of the above-mentioned fourteen officers who were excluded therefrom in an illegal manner, for the judgment of the repeatedly mentioned soldier Robert, and thereby to cause the said court-martial to be fully instructed regarding all the points about which it or the dissenting majority desires information, to the end that they, as is proper for all righteous judges, with complete peace of mind, may pronounce a judgment based on law and equity, and by no means depending on an informal and inadmissible manner of proceeding. Offer of Christoph Otto van Kamptz to cede his place to the Honorable Company for Rixdollars 10000; for which sum that place will be purchased and under what conditions. It was declared in the meeting by Christoph Otto van Kamptz that, having considered the offer made to him by the Merchant and Dispenser the Honorable Adriaan van Schoor in the name and on behalf of this Council, to pay him from the Company's treasury a sum of Ten thousand Rixdollars for his place situated behind the slope of the Lion's Head and Table Mountain, he was finally ready and inclined to accept the said offer, and thus to sell and cede the aforementioned place to the Honorable Company; under the condition that the aforementioned sum, together with that which he will realize at the sale of his remaining furniture to be held shortly (estimated to amount to at least a sum of Twenty thousand Cape guilders), shall be accepted for remittance to the Fatherland into the Company's treasury, to be paid to him properly after the conclusion of this year's autumn sale. Requesting at the same time that he might be permitted to reside on the aforementioned place until the end of the coming month of April, and in the meantime to make use of that which it produces, in so far as he needs for his own household; and finally that permission might be granted to him to depart with his wife for the Fatherland on one of the return ships of this year. Permission is granted to the named Van Kamptz to depart for the Netherlands with his wife. Whereupon the purchase of the aforementioned place having been finally concluded with the mentioned Van Kamptz for the said sum of Ten thousand Rixdollars under the aforementioned conditions, it was further granted to him both to reside on the said place until the end of next April, and in that intermediate time to consume its produce for the benefit of his household as far as necessary for that purpose, as well as to depart from here to the Fatherland with his wife, provided they pay the usual transport and board money. For which latter purpose, at the express request of the said Van Kamptz, all possible care will be taken so that this shall take place on one of the ships of our nation returning this year, on which a suitable opportunity for that purpose shall present itself. Resolution to pay off Rixdollars 100000 of the Company's capital negotiated at interest. Taking into consideration on this occasion that through the extensive employment of the monies among the inhabitants, a scarcity of liquid money is found among the capitalists, which brings much hindrance to trade and real estate to the prejudice of the Honorable Company; while on the other hand, because of the unfortunate outcome of the grain harvest, the wheat delivered to the Honorable Company turns out to be a small amount, for the settlement of which no large sum will be required, whereas on the contrary, by the remittance of the inhabitants to Europe, a considerable sum is to be received in the Company's treasury; it is therefore resolved, in order to relieve the Honorable Company as much as possible of the annual interest, that from the capital borrowed for the same, a sum of Rixdollars 100000 shall be paid off to the holders of the certificates by drawing lots in two or three portions, or so much more or less as the bonds designated by lot shall amount to. Receipt of the sent disposition of the Lords Majors concerning the complaints of the Citizens and defense of the Servants, which shall be circulated among the respective Council members for reading. The ship De Zeenimph having arrived safely here on the 3rd of this month, bringing the highly respected communication from the Right Honorable and Highly Esteemed Lords Directors at the Presidial Chamber Zeeland, dated 22 July of the past year, conveying the disposition and further decision taken by the High Commanding Lords Seventeen in an extraordinary meeting regarding the defenses, both of the repatriated Lord Governor van Plettenberg and of the other Company servants here, against the further complaints submitted by Jacobus van Reenen and associates, as well as concerning the condition of this place, it was approved to circulate the said missive among the Lords Members for reading. The Lord Governor subsequently having been pleased to make known that, for the better progress of the Company's ordinary works and the maintenance of the buildings, it was utterly necessary to place the oversight and management thereof Tuesday, 7 February 1786, in the forenoon, all present except Colonel Robbert Jacob Gordon and Lieutenant Theobald. provisionally appointed to the oversight and management of the Company's buildings upon another and better footing. And since the same had hitherto been solely under the Artillery Captain Johannes Fischer, and it was not possible that the oversight of a single person alone could ensure proper progress of that labor at different posts and places, but that what concerned the buildings ought most suitably to be separated therefrom and placed under the direction of the Engineer officers, on His Honor's further proposal made in this regard, there were provisionally appointed to the oversight and management over all that pertains to the buildings: Captain van de Graaff, Captain Engineer Sebastiaan Willem van de Graaff, and Lieutenant Engineer Louis Michiel Thibault, who shall nevertheless remain obligated to continue performing their service as much as possible with the work on the Fortifications. Because of the currently already prevailing shortage of bread among most of the inhabitants at this place, it being judged of the utmost necessity that, in regard to the small stock that one still happens to have on hand, all possible circumspection and precaution be the lay days for the refreshment of the ships are determined put into effect, and that accordingly the quantity of that which one has for general use ought to be shown, it is agreed to qualify the Burgher Councillors, as they are qualified hereby, to have the privileged bread bakers, as well as all such inhabitants who used to trade in wheat or flour, or who are maintained by the Burgher Councillors to possess any quantity of the one or the other for that purpose, state under solemn oath to the best of their knowledge how much wheat, biscuit, or flour they still have remaining. Whereby it has also been approved to order the Equipment Master Justinus van Gennep that, upon the arrival of any ship or ships, whether of our own nation or of foreigners, he immediately inform himself of their required repairs, and therefrom investigate how many lay days the same will ultimately require for that purpose, the ship officers being thereupon to be prevented and warned on behalf of this Government by him, the Equipment Master, that they must count upon it that after the expiration of those required lay days for upon the offer of Mr. Commissioner Percheron to purchase some flour and biscuit from his Honour putting their ships into a state to proceed on their voyage, besides the necessary water and firewood, all further supply of refreshments and provisions of whatever name shall be cut off from them, to the end that the same officers may regulate themselves accordingly and accelerate their departure. And whereas the Governor gave to know that he had inquired of the Commissioner of the Navy of His Most Christian Majesty here, Mr. Percheron, whether he happened to have on hand any flour or biscuit from that which had been purchased by his Honour for the provisioning of the King's passing ships, and that he had received in answer from the same Commissioner that some of it still remained, which his Honour, in view of the aforesaid shortage, was ready and inclined to relinquish again to this Government for the benefit of the Honourable Company or the inhabitants, the Secunde, Mr. Pieter Hacker, is qualified to purchase on the Company's behalf all the aforesaid remaining flour and biscuit from the said Mr. Percheron. The Governor having proposed, and it being taken into consideration by the assembly, whether, on account of the general scarcity of provisions and in particular the lack of bread at this place, on the occasion that the present national frigates of war, the Allarm and Munnikkendam, are due to depart from here for Europe within a few days, and the circumstances between the Republic and the Emperor having visibly changed in nature, the return ships present here, the Hoop and Huysduynen, should also be dispatched, provided this could take place under convoy of both or either of the aforementioned frigates; in that regard, it was considered that it would in every respect tend more to the advantage of the Honorable Company to have the aforementioned two ships proceed on their voyage in such suitable safety than to detain them here any longer, and it was therefore understood that in case the Right Honorable Mr. A. Spengeler, as commander of the aforesaid two national frigates, should be willing to convoy or cause to be convoyed the aforesaid two return ships to the Fatherland, to let those ships also depart with them, and to cause them to be made ready for that purpose by the 20th of this month. To the Right Honourable, Right Strict Sir, Cornelis Jacob van de Graaff, Governor and Director of the Cape of Good Hope and its dependencies, etc., etc., etc. Right Honourable, Right Strict Sir, The undersigned, Johannes Gysbertus van Reenen, burgher and resident here, having been proposed by Your Right Honourable Strictness to undertake a journey over the mountain in order to inquire most accurately among the farmers living there as to what quantity of grain they still have on hand, and how much of it they could spare for the benefit of the Cape population and its environs; and to purchase the grain they can spare to the best advantage of the Honourable Company, in order thereby, if possible, to somewhat prevent or at least alleviate the otherwise dreaded scarcity and the general lack of wheat; as well as to take close inspection of which places in those regions would be most suitable and capable for the cultivation of that indispensable grain, and to encourage the farmers thereto, and to make a report of his findings. That however much the undersigned's domestic circumstances and affairs absolutely require his presence here, the undersigned nevertheless did not wish to refuse to accept the favourable proposal made to him by Your Right Honourable Strictness, all the more because he believes that the Colony's well-being depends in no small measure on the supply of that grain. The undersigned then, being prepared to undertake this journey as soon as possible at his own expense, will take the liberty of submitting for Your Right Honourable Strictness's consideration: That in view of the poor condition in which the undersigned has found himself for a considerable time now, it would be entirely impossible for him to cover such a long distance on horseback; and moreover, that the expedition could not then take place with the dispatch that the Colony's interests demand and which can be effected with an ox wagon. The undersigned then intending to provide himself with an ox wagon with a span of oxen to convey him to the nearest stage from here; and as that journey can be pursued with greater speed if a fresh and unexhausted span of oxen can be spanned in each time; and it would not be difficult for the farmers that each of them where the undersigned arrives should provide him with a span, at least to the nearest approaching places; while those who cannot do so without suffering considerable loss might be compensated in a proper manner. Requesting therefore most humbly that Your Right Honourable Strictness please be so good as to make such arrangements therein as Your Right Honourable Strictness's experienced knowledge shall deem appropriate, and to grant the undersigned an order to be transported by each farmer with all speed from one place to the next. The undersigned further takes the liberty of submitting for Your Right Honourable Strictness's consideration whether it would not serve to expedite that expedition if the two Heemraden of Swellendam granted to him for his assistance could also, by means of an authentic copy of the undersigned's instructions, be authorized to carry out the purchase of grain among the farmers as well and to encourage them to cultivate grain; since, being provided with such instructions, they could make purchases, etc., independently of the undersigned and thus advance the journey with greater speed, the one riding eastward and the other westward so as to fulfill the intention quickly, and fixing a place to confer with each other. Which instructions the undersigned hopes will include an authorization to purchase such a quantity of grain for the Honourable Company at the lowest price as Your Right Honourable Strictness shall deem necessary or as can be obtained; as well as what proposals and promises the undersigned will be able to make to those farmers in the name of Your Right Honourable Strictness for the cultivation of grain, in order to encourage them all the more thereto, everything to be done in consultation with both the Heemraden. And in case the stowage of the ship or vessel might make it necessary to load a portion of the aforesaid quantity of wheat ground into barrels or bags, for such ground wheat or unbolted meal there shall be paid, above the aforesaid price of three Spanish dollars per 100 lb of wheat, six stivers per 100 pounds for milling costs. That the aforesaid Spanish dollars shall be calculated at fifty-four stivers each, and the cost of the entire cargo shall be paid to him in a sum of six thousand Spanish dollars in paper currency or silver coins according to the current value they have here, and for the remainder in bills of exchange drawn on the Honorable Company, payable at six months' sight. Further resumption and decision regarding the disposition of the Lords Majores on the matters concerning this government; their Honorable High Mightinesses will be respectfully thanked for granting the title and rank of senior merchant to the members of this Council, and upon the proposal of the Lord Governor concerning the Lord Secretary de Wet, the ships of the Company sailing out to the Indies that are present here, being caused to allow such to take place; now having taken into further consideration the highly esteemed dispatch of the Right Honorable High Mightinesses, the Directors at the Presidial Chamber of Zeeland, dated 28 July of the past year, containing the disposition and the further resolution of the High Commanding Lords Masters on the matters of this government. With respect to the first main section concerning the Council of Policy, it was understood, on behalf of the members of this Council, Adriaan van Schoor and Mr. Jacobus Johannes le Sueur, who according to the aforesaid disposition have obtained the title and rank of senior merchant, to thank the highly aforementioned Lords Masters most respectfully for this favorable disposition. Whereafter, upon the requisition of the Lord Governor, the fellow member and Secretary of this Council, Oloff Godlieb de Wet, having stepped outside, the well-mentioned Lord Governor proposed to the remaining members: That whereas it appeared from the aforesaid appointment by the Lords Masters how highly the same, having seen fit to grant to each of the members who are not senior merchants the rank and title of that same quality, and also in respect of the former fellow member and secretary, the late Lord Olof Martini Bergh, to dispose in that very same favorable manner, but that it has nevertheless pleased their Honorable High Mightinesses to establish that, upon the first vacancy of the office of Secretary, the person who is promoted to the same shall only be permitted to hold the quality and rank of Merchant, and that also upon such an appointment of another Secretary, the same would no longer be given a vote in the Council of Policy, and that he consequently would solely be Secretary without simultaneously being a Councilor. Which order regarding the office of secretary would now involve a hardship if executed in respect of the aforesaid Lord de Wet, who already long before the receipt of the dispatch, first through the feeble condition of the mentioned Lord Bergh as adjunct, and thereafter through the decease of the same Lord Bergh, effectively upon persuasion of him, the Lord Governor, for the benefit that both the Company and the colony, according to his Honor's view, could derive from his service, charged himself with the secretariat of this Council, of which the dignity of Councilor was at that time still inseparable, and also at that time, because we considered such necessary, was additionally granted to the said Lord de Wet. So that, since it has also pleased the same High Commanding Lords Masters to authorize this Council, in case they might have weighty observations regarding this or that point which their Honorable High Mightinesses have seen fit to decree, which would advise against the execution of the orders set forth in the aforesaid dispatch, to bring the same to the knowledge of their Honorable High Mightinesses before putting that order into execution; And it cannot be understood to agree with the intention of their Honorable High Mightinesses, if that fidelity shown by the repeatedly mentioned Lord de Wet in the discharge of that difficult office were to be answered with his humiliation, as the deprivation of the fellow membership would undeniably inflict upon him, whereas on the contrary it can be expected that their Honorable High Mightinesses, having learned concerning which the Lords Majores will be requested to favor him likewise with the title and rank of senior merchant, which rank and title the said Lord de Wet will provisionally hold that the mentioned Lord de Wet, already before the receipt of their highest dispatch, was appointed as a voting member, will, for the aforesaid reasons, want to let him share, just like the other members, in the mentioned favorable disposition of theirs. The well-mentioned Lord Governor was of the opinion, for the reasons adduced above, that a further proposal regarding this ought to be made to the High Commanding Lords Masters; with which the remaining gentlemen members of the Council having fully agreed, it was resolved to respectfully request the highest mentioned Lords Majores in a separate letter, with presentation of what has been said, that it may please them to favor the aforementioned Lord de Wet, upon the approval of his appointment like the other members, with the rank and title of senior merchant under the salary and emoluments of a Merchant. and further representations shall be made to Their Right Honourable Worships regarding the person of the Lutheran religion, as to whether the aforesaid title and rank could be made between him and the other members of this Council; since on the aforesaid grounds, flattering oneself with nothing other than a favourable disposition from Their Right Honourable Worships, it is thought fit to provisionally allow him to enjoy the title and rank of Senior Merchant. After which the aforementioned Mr. de Wet re-entered, and having been informed of the aforesaid resolution, expressed his gratitude to the meeting for the favourable sentiments regarding him and for this provisional arrangement. However, seeing that Their Right Honourable Worships, with regard to the request made from here on the date of 30 June 1784 concerning persons of the Lutheran religion, have been pleased to take so much regard that, having seen fit, their honours have made the orders concerning the same take effect with respect to both the Council of Justice and the Council of Policy, only allowing, with respect to the lesser colleges, that half of the members thereof may consist of persons of the Lutheran religion, provided nonetheless that, all other things being equal, preference shall always be given in appointments to those of the Reformed denomination, etc.; it was resolved that most respectfully the liberty shall once more be taken to represent to Their Right Honourable Worships that occasions may arise in which subjects are to be preferred above others for any employment to the greatest service of the Honourable Company, or that in a place such as this, where matters are not in great abundance, the choice must necessarily be confined to a single person, wherein on the one hand it would lead either to the prejudice of the Honourable Company or to less favour for Justice, and on the other hand to very great hardship for such a person, that merely the difference in religion, although nothing at all can be said against his other qualifications for the benefit of civil society, should hinder him from obtaining such an office or employment and hinder the Company in the use of a preferred, capable subject for their service; as it moreover is bound to happen that, if the order of Their Right Honourable Worships were to be strictly observed, it would cause much confusion, in that a person of an inferior post and lesser capability would have to be placed in his post and rank above the one under whom he falls to be subordinate. And since such cases can only occur very rarely, as the number of Reformed far surpasses that of the Lutherans, Their Right Honourable Worships shall most humbly be requested that the aforesaid order might be so far restricted and that on single occasions in which, through the complete adherence to the frequently mentioned order, much confusion might otherwise arise, and furthermore, in order not to discourage those of the Lutheran denomination who are of irreproachable conduct and at the same time excel in zeal and fidelity to the interests of the Company, but on the contrary to awaken more and more emulation among the servants, liberty may be left to deviate from it under complete conviction of its necessity. And to the Council of Justice, it then being understood to answer regarding the second main point, concerning the justice department, to the aforesaid disposition of Their Right Honourable Worships, to deliver to the Council of Justice for their guidance an extract of the aforesaid dispatch, in so far as it concerns the same and the function of the Commissioners to be appointed therefrom, and likewise of that which Their Right Honourable Worships have understood and decided regarding the dispute that had arisen between the same Council of Justice and the then interim, and later Independent Fiscal, Mr. Jan Jacob Serrurier; together with a copy of the instruction further established by Their Right Honourable Worships for the Independent Fiscal of this government, and likewise an extract of what Their Right Honourable Worships have seen fit to decide upon the request of Anthonij Krynauw. Appointment of the junior merchant Van Oudshoorn as a member of the Council of Justice with the rank and title of merchant, and of the burgher councillors Smuts and Van Sittert as permanent members of the said Council, to which four more burgher councillors will be chosen, and burgher councillor Bletterman, being of the Lutheran religion, must step down at the end of this year, leaving room for only four Company servants. To complete the determined number, there is appointed today to the said Council from among the Company servants the junior merchant and supervisor of the timber warehouse, William Ferdinand van Rheede van Oudshoorn, and this with the rank and title of merchant added by the highly esteemed Lords Masters for all members of that Council. Likewise, it has been approved on the part of the burghers to allow the currently serving burgher councillors Johannes Smuts and Andries van Sittert to continue as permanent members of the said Council. Whereas by the said Council of Justice, according to the customary procedure, a nomination of eight eligible persons shall immediately be drawn up, so that the Governor may make the selection therefrom of four more burgher councillors as permanent members of that Council. Of which four burgher councillors to be further elected, three shall immediately take their seats as such, and the fourth shall take his seat after fellow burgher councillor Johannes Matthias Bletterman, being of the Lutheran religion, his term [illegible] all commissions both by burgher members and by Company servants shall have to be performed, and the same shall also be observed in the passing of ship notices, transfers, mortgages, and other acts of that nature. And in consideration of the matters that are henceforth to come under the department of the aforesaid commissioners, it has been approved, for their relief, to excuse the members of Justice in the future from the mustering of ships, and expressly to commission for that purpose the junior merchant Pieter Diederik Boonacker and the payroll bookkeeper Clement Matthiessen Junior. Fellow member of the said Council Christoffel Brand, although for the present unable to assist at the board due to the requirements of his office as Postholder in the Bay, shall be understood not to be prejudiced in his rank and seniority in the Council of Justice thereby, but shall enjoy the aforesaid rank and title of merchant according to his seniority. And in consideration of the long years of service of the secretary of the aforesaid Council of Justice, Christiaan Ludolph Neethling, there is granted to him, subject to the favorable approval of the highly esteemed Lords Masters, the rank alongside the junior member of the said judicial board. Decision to have the ship De Zeenimph call at Mauritius to collect the coffee beans there. Furthermore, taking into consideration that the provisions ship Trompenburg, as well as the ship De Zeenimph, which had been laden for this government, will both be ready at about the same time to depart from here for Batavia, and that it would better suit the interests of the Honorable Company to order the latter vessel instead of the former—which by its superior size and prompt arrival in the Indies can serve to better employment for the Company—to call at Isle de France to collect the coffee beans, for which purpose, according to the resolution of the 31st of the past month of January, the said ship Trompenburg had formerly been destined, and which must certainly cause some delay in the voyage; it is therefore approved, since the said ship De Zeenimph will have sufficient space left to take in the aforesaid coffee beans, to have it call at Isle de France for that purpose, and to that end to issue such necessary orders to the captain of the vessel, Johannes Noordhoek, as would have been given to the captain of the ship Trompenburg, with this difference: that instead of the captain accurately weighing the aforesaid coffee beans and taking specific note of their quantity together with the first lieutenant, as the captain of Trompenburg would have had to do, he will now be assisted therein by the junior merchant Paulus de Keyser, assigned to the aforesaid vessel De Zeenimph; and the Governor on Mauritius will be requested to grant the necessary assistance for the loading of the said coffee beans. To the Right Honourable, Noble Lord Cornelis Iacob van de graaff, Governor of the Cape of Good Hope and its dependencies, etc. etc., alongside the Honourable Council of Policy Right Honourable, Noble Lord and Honourable Lords The Landdrost of Stellenbosch and Drakensteyn, Hendrik Lodewyk Bletterman, takes the liberty to represent to your Right Honourable and Honourable Lordships with all due respect: That he, the petitioner, has recently purchased from the citizen Christiaan Krijnauw a certain piece of garden land, being according to the deed of transfer executed to him large one morgen, one hundred fifty-two square rods and twenty ditto feet, but in respect of which land some disputes had already previously arisen between the said Krijnauw and fellow citizen Fredrik Hijneman, as possessor of the adjoining land, on account of a little extra ground which had been walled in and used with the said land, now belonging to the petitioner, yet without anyone's prejudice; these differences have however been decided so far that the petitioner, as appears from the Resolution of the Landdrost and Heemraden whereof he has the honour to annex an extract hereto, could make a request to your Right Honourable and Honourable Lordships in order that in the future all disagreements regarding this would remain cleared out of the way, to be allowed to have a new chart and title deed of the aforesaid land after a proper prior measurement. That he, the petitioner, in consequence thereof, with the prior knowledge of the aforementioned Noble Lord Governor, has also had the same measurement done, according to which the petitioner's said land, as appears from the surveyor's chart also annexed hereto, is now found to be one morgen, three hundred eighty-eight square rods and thirty-six ditto feet. And since your Right Honourable and Honourable Lordships will kindly be able to understand from the aforementioned Extract Resolution that the said new measurement tends to the prejudice of no one; so the petitioner takes the liberty humbly to request your Right Honourable and Honourable Lordships that it may graciously please you to grant him a title deed of the repeatedly mentioned land according to the newly made chart. It was resolved to grant the petitioner's request, and consequently a new title deed will be granted to him for the erf mentioned therein, according to the measurement that has been newly made of the same erf as appears from the submitted chart. Furthermore, unto the farmer Daniel Rossouw the elder, as present possessor of the farm De Rondeling situated in the district of Drakensteyn, adjacent to which farm in the year 1772 a piece of quitrent land to the size of two morgen and 570 square rods was granted, upon his submitted request, the same piece of land was granted to him in quitrent for the term of fifteen years, provided that the quitrent money still running unpaid thereon since the year 1747 shall first be paid into the Company's treasury by the said Rossouw, who has had the use of that land throughout all that time. Subsequently, the Lord Governor made known that in order to prevent in future many instances of disorderly conduct which are constantly committed by the men stationed at the Company's stables, and to maintain better order there, it had become utterly necessary that an overseer be placed over those people and the matters belonging to the stables. And to that end, upon the proposal of the aforementioned Lord Governor, the dragoon Carel Puyver, already functioning there as stable boy, was appointed as overseer of the Company's stables, with a monthly wage of 25 guilders under a new five-year contract. Lastly, it was resolved to place the pay accounts of diverse persons, who request to remit through power of attorney to the Fatherland the monthly wages they have to their credit, into the hands of the Fiscal pro interim for examination. and that the requested supplement of 1860 Rijxdaalders shall be provided to him from the Company's treasury, under the condition that expenses, without including the articles furnished for the warehouses of the Company, although the charter party does not carry an obligation of the Company for this advance, nor was it ever understood to obtain it under this title, but solely by way of service, which he must all the more expect since his expenses are only for the urgent needs of his vessel, and that in default of which he has no other resources than the sale for an equal sum in merchandise from his cargo, to which all ordinances, regulations, and customs of the sea authorize him despite all oppositions whatsoever and without prejudice to whomsoever it may belong. Upon representation of the Interim Fiscal. After which was read a submitted representation of the Interim Fiscal Gabriel Exter, reading as follows. To the Right Honorable, Valiant, and Right Honorable Sir Cornelis Jacob van de Graaff, Governor of the Cape of Good Hope and its dependencies, etc., etc., etc., together with the Honorable Council of Policy of this Government. Right Honorable and Valiant Sir, Honorable Sirs. The undersigned ad Interim Fiscal Gabriel Exter makes known with due respect that Cornelis van Es and Nicolaas Gueri, the first having been stationed as a carpenter on the island of Onrust and the other as a soldier at Batavia in the Honorable Company's service, and having absented themselves from these posts of theirs, furthermore the first-named Cornelis van Es having arrived here with the chartered French private ship Elisabeth Sophie and the last-named Nicolaas Gueri with a similar ship, the Neptune, have reported themselves as such to the undersigned. That the deserter Cornelis van Es has sought to excuse his desertion on the grounds that, having worked on the vessel on which he came over, he allowed himself to be persuaded by promises to cross over on her at her departure, of which he had nevertheless immediately felt great repentance, and he was moved to report himself immediately upon his arrival at the Cape with a request to be employed once again in the Honorable Company's service. Whereupon Nicolaas Gueri, making the same request, declared that he had been sick several times at Batavia and had been very miserable during the entire time of his stay there, thus the proposal of a sailor from the aforesaid ship the Neptune, being his countryman, to go with him, and the fear of certain death, having made him, Gueri, decide to cross over on the aforementioned vessel and to absent himself; but his intention having never been to want to withdraw himself from the Honorable Company's service, he had left that vessel here in order to present himself for that purpose again. That although these excuses appear more like empty pretexts, the trust of these people and the voluntary reports will certainly merit some consideration, and the reflection must take place whether, in sending them back or punishing them according to the tenor of the laws, a deterrence would not be created for others to return out of repentance or to make known their misdeeds and surrender voluntarily, and it would thus be more advisable and profitable for the interest of the Honorable Company to use some leniency in that respect, and furthermore to take these people back into the service of the Honorable Company and to employ them therein. Which indeed has been ordained in the placard of the year 1764 of the High Indian Government concerning those who return out of repentance to their abandoned posts; but no decision existing regarding the present case, the undersigned has considered it his bounden duty to bring this with all respect to the table of Your Right Honorable and Valiant and Honorable Sirs, in order to take such a most favorable decision concerning the above-mentioned persons of Cornelis van Es and Nicolaas Gueri as Your Right Honorable and Valiant and Honorable Sirs shall deem appropriate. to lay before your eyes that, in the quantity of goods that were unloaded and transferred on board the warehouse vessel, the major item belonging to the Company consisted of eleven hundred and seven bags of coffee, of which only eleven hundred bags were returned on board the Neptune, meaning that seven bags are missing; likewise, the major item belonging to the Neptune consisted of forty-three pieces of cordage of various qualities, and two pieces were diverted from it on board the said warehouse vessel, just as with the seven bags of coffee. Whereupon, after deliberation, it was approved to grant as apostil thereon, that since the petitioner, upon his request submitted by resolution of 11 January of this year for the discharging and storing of the goods from his vessel, was granted permission to make use of the ship Het Hof te Spyk mentioned in the aforesaid petition, in so far as that ship, after examination by him, the petitioner, should still be deemed fit for that purpose, provided everything ran for the account of the shipowners and without any risk to the Honorable Company, and that he, the petitioner, moreover had full liberty to take all such precautions as were deemed necessary by him in both the discharging and storing of the goods, therefore the request made by him cannot be granted; nevertheless, copies of the said petition and the accompanying declaration shall be placed in the hands of the provisional Fiscal, to the end that he may conduct an investigation into the theft that was committed as soon as possible, and if anything of what was stolen should yet be recovered, to hand the same over again to the petitioner or to whomever he shall qualify for that purpose upon his departure, for the account of the shipowners. — Furthermore, the boatswain Pieter Langeman, who was placed on discharged pay, having requested by petition to be allowed to repatriate with his wife on one of the return ships of this year, this is consented to, provided that if this comes to happen on one of the Company's own ships, the ordinary passage and board money for his wife shall beforehand be paid into the Company's treasury; but if the opportunity for passage should arise on one of the chartered private ships, he will have to conduct himself in that regard according to the charter party entered into by the Company with the owners of such ship. Also, upon the written request of the Lieutenant of the Company of Burgher Invalids, Jonas Albertus van der Poel, to be discharged from his aforesaid function on account of the severe decrepitude with which he is constantly afflicted, such that he finds himself unable to perform any civic services, the said discharge is hereby granted to him. Then, Mistress Egberta Boeses, widow of the late Merchant and Member and Secretary of this Council, Mr. Oloff Marthini Bergh, as mother and guardian of her minor son, the assistant Adriaan Vincent Bergh, requested by petition that her said son might be permitted, for the purpose of obtaining veniam aetatis, to address the Right Honorable Gentlemen of the High Indian Government at Batavia; and hereupon it was approved to grant the said request to Batavia, and also, according to the further contents of the said petition, to respectfully request Their High Mightinesses that favorable regard may be given to the supplication of the said Adriaan Vincent Bergh to be made for the aforesaid purpose. — It was further approved, for the greatest profit of the Honorable Company, to dispose of by public auctions on Tuesday the 1st of the coming month of April, as well as on such other days as shall be deemed suitable for that purpose, as much of the extraordinary merchandise brought here from the Fatherland as will be at all possible, and likewise to sell at the same time a portion of the timber received with various ships from the Fatherland, for the storage of which against destructive insects no suitable space is at hand, as well as a quantity of the linens received from Batavia. — Lastly, the Governor was pleased to communicate to the assembly that, pursuant to the resolution of this Council of the 23rd of the past month of February, and in compliance with the order of the High Governing Lords Seventeen by missive of the Right Honorable Lord Directors of the Presidial Chamber of Zeeland dated 28 July 1785 written to this government, a nomination of eight persons for Burgher Councillors having been drawn up by the Council of Justice, His Honor, in accordance with the aforesaid order,
