Having found that Commissioners from the Council of Justice have drawn up and submitted the annual assessment roll, in consideration thereof, it was deemed necessary to write to the Landdrost and Heemraden, as well as the Military Council, of Stellenbosch and Drakenstein, and of Swellendam, to have all signal posts in their districts serving for the general summons or call-up accurately surveyed, and to have anything lacking properly supplied or remedied: and that the signalmen shall be instructed to remain ever vigilant in observing the signals that might be given, in order that each of them may accurately answer according to the established orders. Commissioners from the Council of Justice having submitted a list or roll of the ordinary assessment monies, both for Company servants and citizens, drawn up for this Cape district for this year 1787, together with a petition reading: To the Right Honorable and Noble Gentleman Cornelis Jacob van de Graaff, Governor of the Cape of Good Hope and its dependencies, etc. etc. etc., together with the Honorable Council of Policy. Your Right Honorable and Noble Gentleman and Honorable Gentlemen having, by your secret resolution of 1 March of the past year 1786, requested from Commissioners from the Council of Justice a complete list of all such inhabitants who, having been assessed to pay the ordinary so-called annual poll tax, continue in their customary quotas, Commissioners take the liberty of presenting such a roll to Your Right Honorable and Noble Gentleman and Honorable Gentlemen alongside this: Whereby they also submit a specific list of those persons whose quotas have provisionally been increased or decreased, subject to the honored approval of Your Right Honorable and Noble Gentleman and Honorable Gentlemen, as well as of those who have not yet been taxed before, in such a manner as was believed would place the least burden on each person's circumstances; and leaving the final disposition thereon to Your Right Honorable and Noble Gentleman and Honorable Gentlemen, Commissioners also take this opportunity to most respectfully represent to Your Right Honorable and Noble Gentleman and Honorable Gentlemen that, although the honored disposition of the High Governing Lords Majores makes clear which matters shall in future belong to the department of the Board of Commissioners from the Council of Justice, namely those concerning the management and ordering of burgher affairs and revenues, and which formerly belonged to the office of Burgher Councillors, matters could nevertheless arise causing doubt as to whether they truly belong to the department of the Board of Commissioners from the Council of Justice, presently composed of all the permanent members of said Council, both Company servants and burghers, or whether they should exclusively pertain only to the function of Burgher Councillors. For which reasons, as well as to be able to direct all matters in the required order in the future, Commissioners take the liberty of most respectfully requesting Your Right Honorable and Noble Gentleman and Honorable Gentlemen that it may please you to draw up an Instruction for the said Board, according to which they shall regulate themselves in the management of affairs. Meanwhile, concerning the further proposal and request made in that petition, it being taken into consideration that it must have in mind certain matters regarding which—as not falling within the terms of those over which the High Governing Lords Majores have already made a disposition by letter from the Zeeland Chamber dated 28 July 1785, directing that they shall henceforth belong to the department of Commissioners aforesaid—some doubt exists as to whether they belong to the management of Burgher Councillors alone or to the collective Commissioners, and that so long as one is not specifically informed of what nature or substance such matters are, it is always difficult if not impossible to make a decision thereon that will leave no new obscurities; it was thought best to require from the aforesaid Commissioners a specific specification of the matters regarding which they entertain some doubt and for which such a regulation for guidance and observance is desired, in order subsequently to pay regard thereto and make the necessary provision, either individually or as soon as the occasion allows, upon drafting an Instruction for that Board. The noble directors of the Zeeland Chamber having written that the officers of the de Meuron regiment mentioned alongside must request their discharge, this was presented by the noble Governor to the two Captains still present here, Sandol Roy and Bonstetten. Letter written by the Right Noble and Grandly Respected Gentlemen Directors of the Zeeland Chamber by missive of 29 March of this year to His Honour, concerning the captains of the regiment de Meuron stationed here in garrison: the Chevalier de Sandol Roy, de Bonstetten, La Tourette, Henri le Niefs and Sergeans; as well as that since Captain La Tourette was currently in Europe on furlough, Captain Henri le Neeps was deceased, and Captain Sergeans had already received his discharge from the Regiment, His Honour had, to Captains Sandol Roy and de Bonstetten as the only ones of the five aforementioned currently serving with the said Regiment, in accordance with the intention and instructions of the aforementioned Noble Gentlemen Directors, presented their highest displeasure and had also brought to their attention the reasons why they ought to request their discharge from the said Regiment de Meuron; with the addition that the Governor was left the freedom to subsequently place these captains with the Cape garrison; furthermore, how and in what circumstances, on the grounds set forth in the aforementioned missive, the aforementioned Gentlemen Directors had judged that a court-martial could be granted to these captains to investigate their case; with the further instructions attached thereto on that subject. What was indicated in response by these two officers, and further declared to them by the noble Governor. Whereupon the said Captains indicated to the Governor their painful sorrow over the view that the nature of their conduct had received from the aforementioned Gentlemen Directors; and that, however much they themselves were entirely convinced of the justice of their case and could therefore await and face the outcome of the matter before a court-martial with tranquility, they were nonetheless fully prepared and willing to submit to and obey the arrangement and orders of the Gentlemen Masters, and would by no means hesitate to ask for their discharge from the Regiment accordingly; but that the thought had occurred to them whether, with the obligations under which they were placed to that end, some impressions might arise among the public that must offend the character of an honorable man, and thus might cause unpleasant reproaches and encounters in the corps with which they might subsequently be placed; this consideration had caused a scruple in them regarding the step they had to choose, whether to request their aforementioned discharge or to ask for a court-martial. That the aforementioned Governor had made no objection to declaring to the said two captains that, since it had pleased the Gentlemen Directors, for the end and purpose intended by the Deputies, to order their Captains to request their discharge from the regiment, yet in the reasons that had given occasion thereto their Right Noble and Grandly Respected Honours had found no contradiction to employing their Captains again in the service of the Honourable Company with the garrison here, but on the contrary had granted qualification for it, such a view from the Gentlemen Masters themselves must also notoriously remove all adverse notions that might be forged by others in contradiction thereto; adding that His Honour would therefore also consider himself obliged to grant them his protection against this at all times. Having left them the freedom to address this Council in this regard, they have submitted their considerations by missive as mentioned alongside. That since, notwithstanding this declaration made by the Governor to the said two Captains, the aforementioned difficulty had nonetheless remained with them, His Honour had given them the freedom to further address this Council in this regard. Whereupon, reading a missive addressed to this Council by the said two Captains, it appeared therefrom that the consideration that most people are accustomed to judge by the external appearance of events had raised in them the fear that the public might judge their conduct wrongly, since for a man of honor it was important not to leave anyone with any insulting sentiments against him: that therefore, although they were otherwise fully determined to request their discharge from the aforementioned Regiment in accordance with the order of the Gentlemen Masters, since the latter had nonetheless left them the choice to request a court-martial, they submitted to the aforementioned Governor and to this Council, on account of the delicacy that this difficulty entailed, the judgment whether requesting a court-martial was necessary for them or not. Which point being taken into consideration, it was judged, upon further consideration, that since both the Governor and the Colonel Chief of the Militia in particular, as well as the whole body of this Council in general, bear witness that

by the lord governor has in every respect confirmed that the aforementioned two captains, Jan dolroij and de Bonstetten, have not only conducted themselves in their garrison service altogether obediently and to the full satisfaction of this Government, but also that nothing can be said against their other civic conduct; a testimony of such a nature ought to be furnished to the aforementioned two captains for sufficient security against the perverse and prejudicial notions which ill-intentioned persons might wish or attempt to conceive and inspire concerning them; all the more because this Council completely conforms with the opinion declared by the aforementioned Lord Governor, that as no difficulty exists among the Lords Masters themselves in order to declare their captains re-employed in the said regiment after obtaining discharge, no one here in the garrison could counter or hinder any advance. And it is understood that an extract hereof shall be handed over to the aforementioned captains, both to serve for their information and to make use thereof at such times and occasions as might require it. It having been taken into consideration that the Lord Cashier Gerhardus Hendrik Cruijwagen has for a considerable time already been hindered by a defect of sight from putting, with his own handwriting, the value of each such piece of cardboard onto the stamped cardboard received from the Fatherland and to be introduced into this government pursuant to the resolution taken on that matter on 14 February of this year; so it is approved to appoint and qualify the bookkeeper in the Company’s slaughterhouse, Benjamin Seydler, thereto, whereby the value of each of them, according to the designation of the stamp, must accordingly be added by him in his own handwriting above the stamp on the right side on all the pieces, conformable to the aforementioned resolution. After which, having read the following presented remonstrance of the wage bookkeeper Clement Matthiesen Junior, it is understood to authorize him to allow the wages of such persons as are listed on the roll accompanying the aforementioned remonstrance, who at Batavia transferred with cessation of wages onto the returned chartered private vessels de Jonge Frank, de dapperheid, and de Wynand Luberta, and who, whether admitted to the hospital here through illness or found absent at the departure of those vessels, nevertheless later came forward again, to run again decently from the day of their admission to the hospital or return and subsequent employment in the service of the Honorable Company; and at the same time, by virtue of the reasons appearing in the said remonstrance, the High and Mighty Lords Mayors shall be respectfully requested that this government may receive for its guidance their highest orders and pleasure regarding the premium or gratuity for persons who are assigned to assist the state’s ships or chartered private ships; both whether such persons from return ships who have remained here or have served out their contracted time with the Honorable Company will be able to enjoy the premium promised at their engagement, and what gratuity persons placed in the Indies on such ships and returned here again to the Honorable Company by illness or otherwise, may subsequently demand upon their arrival in Europe. It being furthermore thought best, in order to find the necessary suitable space for accommodating the sick and the expected troops, to authorize the Curator ad lites to rent a warehouse or other serviceable premises from private individuals for the storage of the goods left behind by the servants who pass away in the hospital, and subsequently to charge the rental money to such estates in proportion to what each of them shall amount to. After the firemaster Christiaen Paulsen, upon his request made by petition, was discharged from the said function because he has reached the age of sixty-five years, it was furthermore approved, upon the written petitions also submitted by the cadet Pieter Cornelisse, born in this region, and the steward Hendrik Silvers Stengers, to discharge both of them from the Honorable Company’s service and to grant them burgher freedom on such a footing as it shall please the High and Mighty Lords Mayors further to determine; the first-named on the grounds that he has experienced a defect in his sight which increases more and more, rendering him incapable of profitably applying himself to the military service; and the second, provided that, in view of the shortage of a schoolmaster with the Paarl diaconate and that he has been found capable for this by the church council there according to the submitted certificate, he takes this function in hand at the place designated by the said church council and must remain there.

The bill of exchange granted in the preceding year to the citizen firemaster Lehman having gone missing, he shall be provided with a copy of the receipt of the aforesaid and an extract from the Cash Book. To exercise, without however being allowed to transition to any other profession without further notice and approval of this Government. The citizen firemaster Daniel Fredrik Lehman having subsequently given written notice that he remitted from here in the Company's treasury to the Fatherland in the preceding year 1786 the sum of one thousand three hundred thirty-three ducatons to be received by Geertruyda Meyer, wife of Sea Captain Hendrik Steetsel in Amsterdam, and of which remittance the first and second bills of exchange issued were sent by him by different ships to the Fatherland to the aforementioned Geertruyda Meyer, being in cash counted money, while he has now received news that the aforementioned Geertruyda Meyer received neither of the two bills of exchange, whereby she has thus remained deprived of receiving the aforementioned remitted funds; it is, upon the request made on this matter by the said Lehman, granted to him to receive a copy of the receipt concerning the deposit of the said sum, as well as an extract from the Cash Book regarding this matter; notice of this shall furthermore be given to the Most Noble Lords Majores, with the most humble request that, on account of the missing of the said bill of exchange, the payment of the said 1333 ducatons may take place upon the aforementioned proofs to be delivered to the said Lehman. And notice thereof to be given to the Lords Majores. Permission granted to the second mate of the ship Meerenberg, Andries Noordziek, to remain here for some time. Likewise, on the written request of the second mate on the present hired chartered ship Meerenberg, Hendrik Noordziek, as he is unable due to illness, to be permitted to remain here to recover his health, and subsequently to depart from here again with a later opportunity. furthermore to conduct an accurate inspection of the cargo of the mentioned ship and to examine in what condition that cargo is found to be and whether any damage or spoilage has been caused to it by leakage or otherwise, and finally to take an exact survey, with the assistance of the master of the ship carpenters of the Equipage Yard here, Meynders van Eyck, together with such other ship carpenters as may be required for that purpose, of the condition of the aforementioned ship itself, what repairs were made to it according to the statement of its deceased at Mauritius aforementioned, what damage that vessel has since suffered again, whether the same are of such nature and importance that to carry out the necessary repairs to it, the cargo here will have to be discharged, as well as in what manner the defects to be found thereon best while in the meantime it has been taken into deliberation to employ in case of necessity the chartered ship the Vreede for the transport of the cargo can best be repaired and whether that vessel will thereby be able to be put in a condition to put to sea again with confidence. And it being further taken into consideration that if the condition of the mentioned ship the Paerl should be found to be such that the Company's cargo could not be further transported with the same to the Fatherland, but that another vessel would have to be employed for that purpose, and that the chartered ship the Vreede, which having been sufficient for all required for this government, is now unloaded and lies in readiness to continue its voyage further to Batavia with the little that still remains therein pursuant to the charter party, is the only opportunity of which one could make use to have the Company's important cargo conveyed to the destined place in the aforesaid case, so that if that vessel were to depart from here, no other occasions might very easily present themselves for that purpose, but that cargo would have to remain here for a long time to the great detriment of the Company, without one also having a suitable and competent space at hand for the storage thereof, it was also deemed best to notify the skipper commanding the aforesaid vessel, Thys Ketel, who was expressly summoned to the meeting for that purpose, to remain here with the mentioned ship the Vreede until, after the examination of the aforesaid ship the Paerl has taken place, this government shall have learned whether use will have to be made of the mentioned vessel under his command for the taking in and conveying of the cargo of Request of the burgher Lieutenant Pieter van Breda and remarks made upon it the aforementioned ship the Paerl. Subsequently, the petition presented by the burgher Lieutenant Pieter van Breda having been read and reviewed, It was thereupon taken into consideration that the arrangement decreed by the Resolution of 3 April of this year concerning the use of water for the gardens situated in this Table Valley, and particularly that whereby the stipulation was made for the garden of the mentioned Breda, is found to be based principally solely on the preceding arrangement of the year 1774, without regard appearing to have been paid at that time to how the river water, concerning which it was then thought fit to establish the said stipulation for the garden of the mentioned Lieutenant Breda, has its origin in such a piece of land as was granted in ownership to the previous possessor of that garden, the late former Burgher Councillor Michiel van Breda, adjoining the same garden, in the year 1769, and which grant principally served as compensation and out of consideration for the service which the mentioned Burgher Councillor Breda had shortly before rendered to the Company as well as the Colony, by permitting a very rich and pure water fountain originating in his old land, in order to serve for public use, to be collected and diverted in the same manner as is still the case today, as well as continually maintained and repaired; so that since the mentioned Breda was thereby deprived of the use which he previously could have had of the mentioned fountain water, he being released from the obligation regarding the water mentioned in the aforementioned request. it must also be presumed that at the grant of the aforesaid new land in the year 1769, expressly no condition or exception was made with respect to the water which originates in that new land, so that that water could thus serve to make up for the loss suffered by the possessor of the aforesaid garden through the diversion of the other fountain water. It has therefore been resolved to place an extract of this into the hands of the Commissioners from the Council of Justice, in order to conduct themselves accordingly in the observance concerning the arrangement of the said water. Thereafter having also been resumed a petition submitted by the burghers Johan Michiel Elser, Jan Jacob Meyer and Jacobus Arnoldus van Reenen, the latter as well for himself as standing surety for his partner, the fellow burgher Willem van Reenen, and all in their capacity as contracted butchers of the Honourable Company, which petition read as follows: To the Right Honourable Cornelis Jacob van de Graaff, Governor and Director of Cabo de Goede Hoop and the dependencies thereof, etc. etc., together with the Right Honourable Council of Policy of this government. The undersigned Johan Michiel Elzer, Johan Jacob Meyer, and Jacobus Arnoldus van Rheenen, the latter standing surety for his partner, one of the fellow contracted butchers Willem van Reenen, all contracted butchers in this matter, show with the required respect and due submission in the humblest manner how they, petitioners, as already known, have undertaken for five consecutive years to supply fresh meat, live cattle, ox hides, and so forth to the Honourable Company's passing ships, hospital, slaves, etc.; to which lease the petitioners can only be encouraged by having the freedom to supply, to the exclusion of the private burgher butchery, the required fresh salted meat, live cattle, hides, etc., appertaining to the butcheries, which must constitute the sole source of the petitioners' livelihood, and without which they are never capable of undertaking for the Honourable Company at the mediocre or rather low agreed-upon price, as with heavy loss for the petitioners, which has also taken place for more than eighty years past as an established branch for the contractors, the Honourable Company's butchers. That also since the time the butchering for the Honourable Company was undertaken by the petitioners, few foreign ships have arrived here, whereby they, petitioners, concerning the extra amount of their slaughtered livestock and the surplus fat, suet, and hides, which could not be disposed of to the Honourable Company or indeed to foreign passing ships, have had not the least outlet for them, and have been forced to dry the hides, salt down the suet, and keep it in barrels, which has frequently been exposed to spoilage and has been discarded, to the detriment of the petitioners, all the more because it could also not be disposed of among the inhabitants, and they have been left stuck with these articles. To this has furthermore been added that Your Honours have seen fit to prohibit the export of hard fat, tail-fat, and candles. Furthermore, it should be noted here that the petitioners with the repatriated Honourable Secunde Pieter Hacker, when the price of raw kidney-fat was at twenty Rijksdaalders per 100 pounds, but by the aforesaid prohibition of export the aforesaid tail-fat having actually decreased in prices, made an exception that the petitioners were allowed to melt and supply the kidney-fat that was sent to the Indies by the Honourable Company for 12 Rijksdaalders. Thus the petitioners have suffered notable damage through one thing and another, to which is furthermore added that the livestock since their undertaking has significantly risen in price, which differs about fifty percent higher than the purchase price, taking into account also that one of the petitioners a few weeks ago had a delivery of dried ox hides to a foreign ship lying here in the roads, which, however, at the time of delivery, was prevented and detained by the Fiscal pro interim. Although the Company has always been accommodated with raw hides, both for passing Honourable Company ships and the Honourable Company's [illegible], at the contracted price. That on this point the opinions of the undersigned were divided; while the first signatory, as President, submitted that not only from all ancient times, as evidenced by the so numerous examples available at the Secretariat of Justice, but even in the very recent case of Valentyn of Malapoer, relegated to Robben Island, who, just like the now sentenced Smit, left a wife behind here, it seems to have always been a constant practice, without contradiction from anyone, that the property of those persons who had undergone a corporal punishment, whether of banishment or otherwise, was taken in possession by the undersigned for settlement after proper inventory, and furthermore was placed under the care of their sequestrator in the presence of two members in their meeting. the Court being petitioned that the delinquents should be annotated by the curators and accepted for settlement, and that there mainly had to be taken into consideration the passage in the aforementioned Missive: Regardless of it being in accordance with equity that the Judge who has the disposal over a criminal prisoner also simultaneously possesses the disposal over his seized property, where Their High Mightinesses seemed to declare this their opinion in clear words; That furthermore, according to the sentiment of the president, this custom has been observed without any interruption to the present date, notwithstanding that in the Year 1778 the confiscation of goods was abolished, without it however appearing that by that abolition the courts of justice were deprived of the settlement and administration of the property of their delinquents, and thus from that it seemed to be established that this has remained on the old footing, at least here in this Land no alteration whatsoever in that regard has taken place; in proof whereof the president cited the cases of Jan Hendrik Poiman, of Jan Willem Ruhl, of Hermanus Bos, and Jan Jurgen Mayer, and of Valentyn van dapoer, all of whom have acted after the abolition of confiscation without it appearing, however, that those estates were accepted on grounds of insolvency, as money was still left over from those of Poiman, Ruhl, and Mayer; while the president was furthermore of the opinion that an ancient custom having been changed into a law by length of time could not so easily be altered or entirely abolished, so long as one discovered therein no notable incongruities, which one indeed could not state to reside in this custom: seeing that the settlement of the Estate by a College such as that of the Council of Justice here seemed much more appropriate in the present case than that such an estate were entrusted into the hands of private persons, to which the president further added that a judicial settlement, as it had always taken place here, proved to be much less costly for an estate than if it were administered by private individuals, and therefore was of the opinion that the estate of Smit should unconditionally be accepted by the curators; That against this the majority was of the opinion that, notwithstanding the aforementioned Smit was confined on Robben Island by the aforesaid sentence and in addition declared infamous, one nevertheless could not deprive him of the power to appoint the same private attorneys for the administration of his estate, and that notwithstanding they, the petitioners, for this time rested content with and agreed to the recording done of the said Smit, they nevertheless called very much into question whether that inventorying of property of a joint estate between Smit and his wife, whereby according to their view that community was preserved and the free disposal and administration of their property was taken away from those persons, ought properly to take place, and that on this foundation: 1st. That by the ordinance on the subject of Criminal Justice in the Netherlands of the Year 1570, on the 30th article, it is determined: that after proper inquiry, the delinquent being imprisoned or summoned to appear in person, as the matter shall be disposed and according to the quality of the accused, the goods shall at the same time be annotated, inventoried, and placed into our hands, NB in case of confiscation, whether according to the placarts or otherwise by common law, etc. 2nd. That likewise the subsequent ordinance concerning the General style of proceeding in Criminal matters of that same Year 1570, after having prescribed in some preceding articles when and in which cases a criminal apprehension can and ought to take place, finally clearly declares on article 5: that when the crime or the offence shall be such that under written laws and customs of those places or our aforesaid ordinances confiscation of goods falls or attaches, we order that with the apprehension of persons or decree of apprehension and bodily attachment (which decree shall also have to contain an order of seizure and annotation of goods) the officer and those of the court shall immediately and at the same time carry out the aforesaid annotation and seizure of goods. 3rd. That since from the cited articles of the ordinance it now clearly appeared that the annotation of goods is strictly and clearly determined in such cases in which the crime entails confiscation of goods, without anything in the slightest appearing either in the preceding or in the following articles from which it would follow that in all occurring cases without any exception or limitation the annotation of the delinquent's goods ought to accompany the bodily apprehension; 4th. That also no other law or ordinance, either general or local, was found that prescribes to the Judge whether, upon a bodily apprehension, annotation and seizure of the delinquents' property must absolutely take place; 5th. On which grounds the majority then maintained that the annotation of goods of persons upon whom corporal apprehension had been ordered, without any exception and unconditionally, as in this case of Smit, was solely grounded upon an introduced and accepted custom here in this place, which seemed to be justified by custom without the authority of a law; the more so, since the precedents thereof demonstrated that in some cases the annotation of goods had occurred, and in similar cases again not, as in the case of Carel Buytendag and Daniel Verwey. The majority being thus minded, while the minority had joined the side of the president, the president further declared that in case a resolution were taken according to the sentiment of the majority, the Secretary of Justice in his capacity as Sequester of this government would find himself prejudiced to the highest degree, as it was utterly equitable that he should enjoy those same prerogatives and emoluments that of old were attached to his office and had also been enjoyed unhindered by his predecessors; and maintained further that it had always been customary here that the estates of those who were placed under criminal apprehension and sentenced as such, whether by corporal punishment or banishment, were sold and administered by a Sequester of this Council in the presence of commissioners, to which he referred to the precedents already alleged by him before, giving as reasons for this his obstinate stance: 1) That such a condemned person being civilly dead, can by no means administer his own estate, nor pass a power of attorney to the person by whom he would wish to have his estate administered, as deeming that a power of attorney given by an infamous person was of no value in two respects, and that the wife of such a person, being as yet not separated from her husband, also has no persona standi in judicio, and thus without being properly assisted cannot pass a power of attorney. 2) That by the judicial administrations that take place after a proper inventory, all abuses to be committed are prevented, and thus the condemned person cannot pretend that his estate has been diminished by arbitrary treatment. 3) That the sale of such an estate ought also to be done by the Judge, since from it the fraudulently acquired advantages as well as the costs of all proceedings caused by the crime of the condemned person, whether in a civil or criminal case, must be satisfied with all the interest thereof. 4) That it would tend to the disrespect of the Judge if the estate of a criminally condemned person might be sold by a party at his pleasure; whereas if on the contrary the estate is sold by the Sequester in the presence of commissioners, who moreover must still report on their actions to the full Council of Justice, the wife of such a condemned person can bring no complaints against it with acceptable reasons, being assured that no injury is done to her. 5) That besides that it would be very improper that a party should be favored before the Sequester, such a party's attorney would intrude directly into the office of the Sequester. And finally 6) that before the year 1778, when confiscation was abolished, even in such cases where one did not proceed to confiscation, the estates of the delinquents were nevertheless accepted by the Council of Justice, and when they were not found to be insolvent, the remainder of the monies was restituted to the delinquent or his heirs (as there are a multitude of examples of this), and this then having been continued in the same manner after the abolition of confiscation, the presidential stance was that the abolition of confiscation in no way obstructed the judicial inventorying and administration of the estates of delinquents. All these considerations having still been brought in, the majority nevertheless continued to refer to their made remarks. Wherefore the president, making representations, further proposed how in the year 1762, likewise between the Council of Justice and the Orphan Chamber, a dispute having arisen over the estate of a certain Michiel Zwaar, the same had been referred for decision to the Honorable Esteemed Lord Governor and the Honorable Council of Policy, whereupon that estate was also left to the Council of Justice for administration, without the same nevertheless having been found to be insolvent; and among other things it was resolved thereupon under date of 12 October 1782: "that to prevent all disputes that upon the occurrence of similar cases might again arise, it is understood that whenever henceforth

someone comes to be disposed of who, by committing any criminal offense, has subjected his person to the court, his estate shall then also be administered by the Court of Justice. From which resolution the president not only thought to be able to show that disputes of this nature ought to be decided by the Government; but also to maintain that, it having been thus enacted that the estate of someone who had merely subjected himself to the court, without mention being made of prior incarceration, much less condemnation, must be assumed by the Court of Justice; with so much the more ground the estate of Smit of Dilburg, currently in question, ought to be administered by the petitioners: since among other things there is actually still found therein a sum of one thousand guilders, which he fraudulently appropriated from the late Captain Jan de Waal and from which this latter action against him arose, but nevertheless, in order to follow the customary manner of proceeding in all respects, he submitted for the consideration of the petitioners whether it would not be best to present this matter once again to your Right Honorable Worships for the purpose of a decision, to which the petitioners here unanimously condescended. Reasons for which the petitioners very humbly turn to your Right Honorable Worships, with a no less respectful request that it may please your Honorable Lordships to prescribe to the petitioners how they shall have to behave in the present case of Smit of Dilburg, as well as how to act in the future regarding the estates of such delinquents who, having undergone a corporal punishment or banishment, leave behind a wife here, with or without children; in order that the resolution to be taken hereupon by your Right Honorable and Honorable Worships may henceforth always serve as a certain fixed rule and guideline in the execution of justice. And whereas, during the proceedings instituted on behalf of the Fiscal Office against her aforementioned husband, a provisional sealing of a part of the estate belonging in community of property to the undersigned and her aforementioned husband, including his books and papers, was carried out on behalf of the Honorable and Worshipful Court of Justice, which renders the undersigned unable to make a beginning with bringing the estate to liquidity, unless the aforementioned sealing is lifted and the undersigned is qualified to act in all respects in the place of her aforementioned husband, for the well-being and advantage of the common estate, both in and out of court. Report of the committee concerning the condition of the ship de Paarl, so far as has yet been possible. In order to appoint, both to the satisfaction of the said Johannes Smit and of his said wife, two persons who in the meantime can supervise their common estate. By the Captain at Sea and Equippage Master pro interim Jan Arnout Voltelen, the fellow Captains at Sea Christiaan van Veerden and Francois du Miny, together with the Commander Daniel Haas, concerning the return ship de Paarl, in pursuance of and in response to the commission designated to them by resolution of the 20th of this month and carried out here with the assistance of the master of the shipwrights, it having been reported: That upon examination of the journals of the ship's officers of that vessel, it was found that the hurricane which the said vessel encountered in the southern latitude between the 28 degrees and longitude of 92 degrees, the defects that arose on that occasion to the ship and the loss of rigging inevitably forced the said officers to choose the nearest harbor, which at that time was Port Louis on the island of Mauritius; That notwithstanding the rebuildings and repairs done there and stated in that report, after having left the said harbor again, both the heavy leakage newly discovered on the ship and the continuous storms and contrary winds on the Reef of Anguillas and in the worst season of the year, the supervening scurvy among the crew, scarcity of provisions, and the despondency of the men to be feared therefrom, were concurrent reasons and circumstances by which the said officers found themselves once again compelled to enter the Bay of Rio de la Goa; That upon inspection of the cargo, so far as this could be done from above, several bales of cinnamon etcetera being found to be heavily damaged, it was not possible for them, the commissioners, without unloading the cargo, to give any report of its true condition, damage, or decay; That with regard to the defects which have been discovered on the ship since the rebuildings at Port Louis, on the one hand, from the information of the ship's officers that the ship, rolling 4 to 5 inches, worked in its framework, the stern gave way upon pitching, and also the ends of the wales in some places parted by 5 inches with working, together with the fact that the ship then gave way by an inch on both sides from its stems, that the sheer strake was out of its rabbets and almost all the butts were loose; that while lying at Rio de la Goa, it had also been discovered under the sheathing in the break of the bow that two planks were completely loose; that when rolling, the bolts along the entire starboard and port sides worked in and out by half an inch; that at sea in bad weather, with three ordinary ship's pumps and the royal pump, they had barely been able to keep the ship pumped dry; and that in good weather two pumps always had to be used, indeed even now lying here in the roads, altogether 15 to 16 times 18 to 19 inches of water was pumped out of the ship; And on the other hand, although they, the commissioners, were not able without a complete unloading of the ship to report with respect to all the defects likely still to be found thereon, nor the manner in which the same could best be repaired, nor whether that vessel could thereby be put in a state to put to sea again with complete peace of mind; it must with the greatest probability be concluded by them from the coherence of the above-mentioned information obtained, that even if there were any possibility of these repairs, and that vessel could thus be made fit for the transport of a cargo, the same repairs would nevertheless exceed the present estimable value of the ship, besides the fact that the required timbers for such a rebuild were not at hand, and would then first have to be requisitioned from the Fatherland; and further that even if such timbers were found here, nonetheless with the small number of shipwrights, even though all other work stood still, and regardless of that which should have to be done on the return ships to be expected in case of defect, such a long time will be required for this that the Company in the meantime could long enjoy the benefits of the cargo, besides the apprehension stated by them, the commissioners, that when the upper ship might thereafter be ready, her lower hull might in the meantime have been half eaten away by the worm that occurs here; Further deliberation on using the private ship de Vreede primarily to transfer the cargo of the Paarl into it. against which skipper Thijs Ketel has entered an opposition; and bales, which must have suffered much already during the unloading at Port Louis, might, through the repeated handling and transporting ashore here, not be damaged further and rendered unfit for further shipment, nor that any damage, spoilage, or loss might occur to the linens and other loaded goods; it was made known by the Lord Governor that the skipper of the aforementioned private vessel De Vrede, Thijs Keetel, having been informed by this Council of Government concerning his vessel, had given to understand that he never would nor could tolerate that his said vessel under his command should be used in such a manner as a warehouse for the said cargo, because this would not only, but also otherwise, run contrary to the charter party of that vessel and tend to the disadvantage of its owners, his principals; that he was thus being kept in uncertainty as to what further would ensue hereupon, whether that vessel should have to continue the further voyage to Batavia, or whether the government, to whose orders he was obliged to submit himself, should think fit to make use of the same for the further conveyance of the said cargo to the Fatherland. This having thus been taken into consideration at present, making it necessary to come to a final decision in this matter, it was thereupon considered on the one hand that the frequently mentioned vessel De Paarl, according to the statement of the aforementioned report of the commissioners and following the information which the officers of the same have given, finds itself in such a condition that, even were the possibility discovered upon discharging the goods to repair the hull, the time that would have to elapse therewith would conflict too greatly with the interest of the Company for it to be advisable to keep that cargo here so long, since one has no certainty whether another suitable opportunity for its dispatch will present itself for a long time, and that it must also tend to the disadvantage of the cargo if, in addition to what happened to it at Port Louis, it were first brought ashore once again and afterwards had to be handled again for embarkation; together on the other hand with the fact that, although the charter party of the said vessel De Vrede does not expressly provide that that vessel may also be laden from here on a return voyage, wherefore in such case also no stipulation was made with respect to the freight money, and skipper Thijs Ketel has declared that he does not find himself qualified by his principals, the owners of that vessel, to breach the charter party and to enter into a further convention regarding the freight his obligations and to rebel against the orders of this council; money for the return voyage from here, but it only being required by him, having further declared his obligation to entail submitting to the orders of this government insofar as his vessel should have to be used for a return cargo in the service of the Honorable Company as freighters thereof, and the determination of the freight money then being left to a further agreement between the Company and his said principals. to have all of that which is found in good condition or undamaged, and to which no wetness has come, and thus will be capable of being transported to Europe in that manner, reloaded into the frequently mentioned ship De Vrede, in such a manner that that vessel, thus with this lading, without it being necessary to take the same out again or to restow it once more, will be able to depart for the Fatherland; furthermore, to have the packages, bales, and other goods that might be in bad condition or damaged to such an extent, or have become wet, that in that state they could not be reloaded for the further return voyage, brought ashore and cared for here in such a manner that they likewise will be able to be reshipped, or that one may take such further measures with respect to the same as shall serve the greatest benefit of the Honorable Company. Likewise it was also understood to demand from the officers of the deceased of the mentioned vessel De Paarl a detailed written report and account of all that occurred and was performed by them, both with regard to the ship and to the cargo on its voyage hither from Ceilon, with the addition of the accounts of the expenses incurred and sales made or use made of the spoiled part of the cargo at the island of Mauritius and Rio de la Goa, to the end that, after the mentioned account shall have been sworn to by them before commissioners from the Council of Justice, a copy of the same may be transmitted to the high-ruling Lords Major, or otherwise to take such further resolutions in that regard as circumstances shall come to require. Mr. Jacobus Johannes Le Sueur, as President of the Orphan Chamber, having given to know how now on one and another occasion it had occurred at the mentioned chamber that, upon the transfer of immovable property, such immovable property still remained subject to the encumbrance that had been placed upon it by the previous possessors, without one being able to know for certain whether the successor in the possession thereof had knowledge of this, or, as was most probable, had relied on the trust that care had been taken by the seller and transferor of that property to discharge the same from the mortgage established upon it, with the request that, in order to prevent the troublesome lawsuits which might arise from this to the great detriment of widows and orphans, the necessary provision might be made in this regard; Whereupon, deliberation having been held, it was approved and understood to establish for the future that commissioner members from the Council of Justice before whom the transfers of immovable property must take place shall have to inform the person for whose benefit the transfer occurs what encumbrance on the property being transferred is then still found to be established on account of the persons who come to pass the transfer, and that from the register of debts and bound mortgages kept at the Political Secretariat, opening and notice of this shall have to be given to the same commissioners by the sworn clerk who comes to pass the transfer, so that the recipient of the transfer, having thus properly obtained this notice, will be able to take such measures regarding it as he shall deem advisable. Furthermore, also taken into consideration and examined, being the petition presented by the burgher Cornet Johannes Albertus Laubscher, together with the burghers Adrianus Marthinus Horak and Dirk Johannes van Dyk, containing complaints about the high-handed manner which some burghers and wine farmers of the Wagenmakersvallei were said to have usurped, both in the laying out of a road through the petitioners' places for the transportation of their produce to the Cape, and in the outspanning and grazing of their cattle to the detriment and nuisance of the said petitioners, together with the objections arising therefrom against the petition presented to this Council in that regard by the said wine farmers, and finally requesting that the aforementioned wine farmers may be ordered to adhere to the previous outspan places named in the petition of the present petitioners, it has been resolved thereupon, seeing that the petition presented to this Council by the more aforementioned burghers and wine farmers was, pursuant to the resolution of 9 February of this year, placed into the hands of Commissioners from the Council of Justice and the Landdrost and Heemraden of Stellenbosch and Drakenstein, in order for each to serve with a report and considerations thereon as far as their district is concerned; and that the places of the petitioners mentioned in the currently submitted request are all situated under the Stellenbosch or Drakenstein district; also that their request directly concerns and relates to that of the previous petitioners; To place into the hands of the Landdrost and Heemraden of Stellenbosch for examination and report thereon. therefore also to place a copy of the same and its annexes into the hands of the said Landdrost and Heemraden in order to also take regard of the contents thereof and conduct an investigation, as well as, if still possible, to combine their considerations and report regarding this with what was required of them by the said resolution of 9 February of the current year concerning the petition mentioned therein. Request of Commissioners from the Council of Justice that the dinghies may arrive in the Roggebaai as before, and to fish there as well as near and around the batteries, of which the first part is granted, but the second is rejected for adjacent reasons. Commissioners from the Council of Justice having made a written request that, for the reasons adduced thereto and in view of the representations made to them, the Commissioners, to that end both by the inhabitants who earn a living by conveying to and from on board the ships arriving here in the roads, and by fishing, permission might be granted that the dinghies, as before, might have the liberty to arrive in the Roggebaai and next to the jetty, as well as that one might also, as previously, fish at one's pleasure by day and by evening, both in the Roggebaai and in the other small bays near and around the batteries; And concerning the first part of that request, having considered that the arriving and departing with the dinghy, as well as with other small vessels, into and out of the Roggebaai or otherwise than to and from the jetty, was primarily prohibited and forbidden only on account of desertion, for which much opportunity was taken hereby, but that, when this happens in sight and within reach of the guard of the jetty or of the judicial officers keeping watch there, one can then often prevent desertion with all such vessels, just as on the jetty itself; Wherefore it is also agreed to permit that the dinghies of the inhabitants, besides from and to the jetty, shall also be allowed to depart and arrive between the same jetty and the outlet of the canal coming past the Company's slaughterhouse, provided that they adhere strictly to this regulation. Yet, concerning the second part of the aforesaid request, some reflections having been supplied by the Governor and the Colonel and Chief of the Military Gordon, in view of which it would by no means be advisable to tolerate fishing close under the battery on the west side of this Table Bay, it is judged that this part of the aforementioned request cannot be granted, but that it is best to leave this on the footing currently established. Lastly, on the written request also made by Captain de Maurat, present here, belonging to the Regiment of Luxembourg, in consideration of the long voyage which the cadet and seven incapacitated soldiers of the said Luxembourg Regiment, returning on the return ship de Paerl from Ceylon and still surviving, have spent with that vessel, the dangers endured therewith, the jettisoning and loss of all their goods, so that they find themselves destitute of even the most necessary clothing, and the duties which they had to perform due to the condition of the ship, one could not avoid granting them each three months' wages, to be furnished to them here out of the Company's treasury. Taking into consideration that, due to the location of the powder magazines between the Castle and the Salt River, the most terrible disasters may arise from the lighting of fires near the wagons that are outspanned there at night, it has therefore been deemed good, in order to prevent this, to interdict and forbid that neither the owners of the wagons, nor those who have charge over them, nor also their slaves or others, shall dare, within the distance between the Castle and the lime kilns of the burgher Jacobus Johannes Vos, whether with their wagons outspanning or on other occasions, to light any fires; on pain, upon neglect or disobedience herein, according to the exigency of matters and circumstances of persons, of being corrected either with a monetary fine or arbitrarily punished on the body. What was made known on this matter by the Noble Lord Governor. Not doubting that the Most Honourable and Highly Esteemed Lords Masters will be pleased to regard and accept such a dutiful precaution of His Honour favourably only as having sprung from a principle entirely agreeing with the confidence which they, particularly with regard to the defense of this place, are pleased to place in His Honour. It being at the same time perceived that it would result in a needless burden for the Honourable Company if the said Landdrost of Swellendam were to be granted, solely for the transport thither of the goods which are customarily supplied from here and have always been conveyed by the Company's wagons from the outposts situated both on this side near Swellendam and on the other side of the same residency, according to his request made by letter, the setting up on the Company's account of an ox wagon with its appurtenances alongside a European wagon driver in order to spare such costs; it is understood that the masters of the aforesaid outposts shall each time upon the arrival of the Company's wagons be obliged to ensure that the goods and supplies which must be conveyed for the service of the Swellendam residency obtain proper transport thereby to that place. The request to be allowed to have an increase of orderlies and kaffirs was likewise not agreed to. And after it was also perceived from a list of supplies attached by the often-mentioned Landdrost to his aforesaid letter, that among these was included an increase of the ordinary number of five orderly riders to six and from seven kaffirs to twelve, without the reasons for the alleged necessity thereof having been stated by him, the Landdrost, whereas on the contrary one must assume that at present, since the district of the aforesaid residency, due to the establishment of the magistracy of Graaffe Rijnet, is far less extensive than previously, therefore the ordinary number of orderly riders and kaffirs can much rather than before suffice there now, it has been resolved for the present not to accede to this increase, absent a further apparent absolute necessity; nevertheless, the said Landdrost shall be relieved of the orderly rider reported as incompetent in exchange for another, and the said incompetent orderly rider may in the period falling due make a request to obtain his discharge, or otherwise must await to be dealt with according to the orders of the Honourable Company; while also the three incompetent kaffirs shall be exchanged for other Company slaves or convicts suitable for that service if such are on hand, and the aforesaid residency shall otherwise be provided with the further supplies noted on the said list in proportion to the aforesaid standing number of orderly riders and kaffirs stationed there. By the Lieutenant Colonel Petition of the Lord Lieutenant Colonel de Meuron Ballot in which he claims his monthly pay from the day of his appointment in the Swiss Regiment de Meuron. Against the profanation of Sundays and feast days, by renewal of previous edicts, the accompanying orders shall be published. Since the month of March of the preceding year 1786, when the command over the said regiment was held by his Honour, he had maintained a very exact order and discipline at that regiment to the satisfaction of their Honours, and had acted with all zeal for the common cause; with which the other members of this Council, so far as it concerns them, having likewise conformed, it has been approved to issue a certificate in due form to the more-mentioned Lord Lieutenant Colonel de Meuron Bullot. And whereas not only complaints have arisen, but it has also been directly experienced how many people, with little scruple regarding the ungodly spending of the Lord's day, moreover in manifold illicit ways in contempt of the established edicts and ordinances, profane and desecrate these and other days dedicated to public worship, it has been approved, in order to provide herein, to gather the orders and interdictions set against it, to renew and amplify the same, and consequently to enact anew: That no one among these inhabitants, without distinction and under whatever pretext it might be, shall be allowed on Sundays or other holy days to work publicly or outdoors at any manual or household labor, or to have this done by others, nor especially to have any carpentry, masonry, building, or whatever similar paid labor it might be carried out, on pain of forfeiting, upon discovery thereof, each time a sum of fifty rixdollars, to be divided as customary. Likewise, on the said days no goods of any kind may be carried about for sale along the street by slaves or others, which shall equally be observed concerning foodstuffs for as long as the church service lasts, all this upon forfeiture of that which one shall thus carry about for sale. Just as also no tapster or innkeeper shall presume to set tables or pour any drink on Sabbath or feast days in the morning, nor subsequently as long as the church service lasts, upon a fine of ten rixdollars to be forfeited each time and for each person to whom he, in violation hereof, shall have set a table or tapped or sold any drink. Likewise to forbid that no male or female slave shall presume, at the conclusion of the church service or when the congregation leaves the church after the same, to linger therein or in its portal, on pain of being seized immediately by the officers of justice and subsequently strictly punished. And in order to prevent the bad and wicked deeds and disorders which are committed by the slaves on such days to no small offense and vexation, the provosts and further officers of justice shall be obliged on Sundays and on other feast days to keep continuous watch to immediately apprehend such male or female slaves who might give cause hereto by creating any noise, shouting, or other licentiousness, and especially when they gather in crowds, in order subsequently to be strictly punished according to merit. Further resumption of the representation submitted on the 27th of November last by the Council of Justice here, and the remarks thereon. Subsequently, the representation submitted by the Council of Justice at the session of the 27th of November last, on which the decision had until then been postponed, being brought to the table again and taken into further consideration, it has been observed, regarding the dispute presented therein, that no law is presently extant under the jurisdiction of the Generality or of the Company by virtue of which one can act to deprive someone who possesses the full ownership of his goods, while he is condemned as a criminal, of such ownership and the exercise thereof; but on the contrary, in the present case, one of the principal reasons that caused the confiscation of goods to be abolished and repealed in the colonies of the Generality by edict of the year 1778 must serve as a firm guideline, namely that the wife, children, or closest blood relatives of the delinquent, although innocent themselves, should not share in the punishment inflicted upon such a delinquent. That, as appears sufficiently not only from the criminal ordinance and style of proceeding in criminal cases of the year 1570, but also from a rule and instruction established by the High Indian Government by resolution of the 20th of August 1753 regarding the manner in which proceedings shall be instituted even against qualified servants of the Company who are found to be fugitives or absent, no annotation, seizure, or inventory may take place except when, according to the said ordinance, confiscation of goods attaches to the delinquent's crime, or that, in conformity with the said instruction of their High Honours, the Company has some claim upon such a person; consequently, confiscation of goods now being abolished, the reasons also cease for which the annotation or seizure thereof could or ought to occur in the case and by reason of a crime; much less still that a similar control could extend further and deprive the delinquent of the ability to dispose thereof according to his pleasure, for as long as such a person finds himself capable of doing so, or that he wishes to qualify another, or that someone can be lawfully admitted to intervene for him; and the judge, holding the office of upper guardian, not finding himself otherwise obliged, upon the absolute demise or absence of someone who has made his person subject to the court through any criminal offense and has left or established no disposition or care over his goods himself, to take further [illegible]

terms of the resolution of this Council dated 12 October 1762, or else in the case of notorious insolvency, over the property on behalf of the party entitled thereto, whether to manage the estate and administration themselves or to qualify others for that purpose; That furthermore the alleged grounds and the reasons for which the minority of the said Court of Justice judged it necessary that the joint estate of the said Smit and his wife ought to be judicially sold and administered, do not diminish the harshness which, contrary to law and justice and thus extending further than the sentence of the said Council itself, would be imposed both on the said Smit and on his wife, since it can surely confer no favor upon anyone to force an assurance upon him regarding the administration of his property that it will not be sold, by liquidating or administering his estate against his will and inclination and afterwards delivering the proceeds thereof to him; That the aforesaid resolution of this Council of the year 1762 cited by the minority can by no means be made applicable to the present case, and one must also trust that in the adduced examples of estates that were administered by the Court of Justice, accidental circumstances concurred which, other than on account of a crime, made the custody of the goods necessary in that manner, but that even if such circumstances capable of giving rise thereto had not taken place, one nevertheless ought not to set an example for imitation of an error that might have been committed and that would tend to curtail others in their lawful possession, whereas in all similar cases that have occurred under this government, in which the person was indeed criminally punished, neither attachment nor judicial administration of his goods was executed; That since on that account the said Smit and his wife ought not to be deprived of the lawful and free disposal that belongs to them over the said goods, and the said Smit being able to do so by last will, he can encounter much less difficulty in equally lawfully authorizing either his wife or someone else to manage his estate in his absence, or, this being omitted by him, the wife being able if necessary even to intervene judicially for him, provided she has previously requested and obtained the officium judicis, on which account the Court of Justice also may not cause any injury thereto by an intrusion into their estate contrary to this; And that for all these reasons, it being judged that according to the sentiment of the majority of that body, free disposal over their property shall be left to Johannes Smid and his wife, and in similar cases action must be taken in accordance with this, it is considered that one can very well concur with the sentiment of the majority of the said Court of Justice, and likewise understand that to the aforesaid Smit and his wife present here shall be left the power and authority to employ with respect to their estate and property such lawful measures and dispositions as they shall deem advisable, and that in accordance with this, the said Court of Justice must proceed in the future upon the occurrence of similar cases. Furthermore, having read the petition presented by the military Captain Lieutenant here, Reinhard van Balen, tending to be permitted to depart for the Homeland in order to care for his minor children residing there and to attend to other pressing family matters, and for that purpose to take passage on the Country's warship Princes Louisa or on the chartered private ship De Jonge Jacob, and moreover to obtain a recommendation to the high-ruling Lords Major, so that if, after the transaction of his affairs, he should be inclined to return to these parts, he might be favored by the said Lords Masters with the aforementioned rank in the service of the Honorable Company: it has been approved to permit the said van Balen to depart for the Homeland for the purpose aforesaid with suspension of salary, but since his passage on the Country's warship is entirely impermissible, therefore to allow him to undertake the said voyage on the ship De Jonge Jacob, provided he conforms to the charter party entered into by the Company with the owners of that vessel; the further request made by him shall be favorably presented to the Lords Masters, respectfully requesting them to allow him to return hither in his capacity should the Lords Major be inclined thereto. Just as has also been made known in writing by the Captain of the Ceylon return ship De Paarl currently staying here, that, owing both to desertion and the death of the crew belonging to that vessel, he found himself under the necessity at the Island of Mauritius, for the conveyance of the said ship De Paarl hither, not only to request from the Count of Rechteren, commanding the Country's warship Princes Louisa also lying there at the time, an assistance of twenty-two seafarers, as was indeed obtained by him, but also in addition to take on board three North Americans and a Portuguese, the latter to perform ship service on the way here for his keep; testifying that all these men had performed proper service on his long and very disastrous voyage from the said island hither; that he therefore, leaving the disposition regarding the crew of the Country's ship to this Council, since everything had been agreed with the said Count of Rechteren to hand them over to his Honor again here, requested with respect to the three North Americans and the Portuguese that they might be granted some gratuity in compensation for their suffered hardships and to be able to provide themselves again with proper clothing, the payment of which, however, is left deferred to this Council: it has been approved to have paid to the aforementioned crew of the Country's ship Princes Louisa, for the time that they have served on the vessel De Paarl since 10 April of this year, from the Company's treasury here, the salary which they earn with the Country, and that they shall again be handed over to the said Count of Rechteren; and likewise to cause to be provided to the four remaining men, in consideration of their rendered services and their present want, a gratuity of five months' salary each at 9 guilders per month, and should they be inclined to continue in the Company's service for the Indies, to engage them for that purpose as sailors at the same salary. We therefore charge Mr. Trublet with confidence to make the request to you for an assistance of 600 thousand weight of wheat, or to favor the attempts he will make with private individuals to procure the same quantity.
