Answers: that the knife was not in his, the respondent's, hands, but in the hands of Sephta, and that he does not know how Sephta came by the stab. To show the knife to the respondent and ask him whether this is the same knife with which he, the respondent, stabbed the said Sephta. Answers: yes, that it is the same knife that the boy Sephta had in his hands. Whether, fleeing along the main road of the vineyard, he met the master of the said Sephta, being the burgher Johs. de Villiers Jacobsz. Answers: says yes. 11. that the prisoner and defendant thereupon inflicted several wounds on himself in the lower body. 12. and in this manner was taken prisoner and delivered into the hands of Justice. 13. that the one and the other will further appear from the attached pieces and documents. 14. the Officer Prosecutor, referring himself thereto, will remark concerning the crime itself: 15. that it is twofold, and consists in this: that he, the prisoner and defendant, inflicted a stab upon the aforementioned maid and wounded himself. 16. that both stabs were directed at such a part of the body where they could be fatal. 17. that the instrument used for this purpose is a piece of blade wrapped with a handkerchief and thus fixed into a handle, which is reckoned among the lethal weapons. 18. that notwithstanding that both persons remained without actual fatal consequences from their wounds and have risen again. 19. the Officer Prosecutor, subject to correction, believes he can determine from the cited certain circumstances: 20. that the prisoner and defendant had the intention and conceived with premeditation 21. to also do away with the frequently mentioned maid and to murder himself. 22. so that in this case all characteristics are present which qualify a delictum inchoatum sed non plane consummatum, 23. and even such that it comes closest to manslaughter. — Conf: Carpz. p. 1 R 17. — 24. that this being premised, the Officer Prosecutor will yet briefly examine what punishment the prisoner and defendant will have merited in this regard. 25. whereabout it falls to observe that the criminalists do not agree on this. 26. some wishing to punish the conatus with the same punishment as if the actual deed itself had been committed, 27. and the others and the majority being of the opinion that the same ought to be punished arbitrarily and after consideration of the circumstances. 28. Except in severe and pernicious crimes, where the death penalty also usually takes place. 29. so that no certain rule can be determined herein. 30. vide van Leeuwen de delictis Cap 5. matth: de Crim: Coll. And the Officer Prosecutor therefore believes, under Your Honours' better judgment, following this doctrine, 31. and without having regard for the defendant's own wounding, which on its own would deserve a lesser punishment, and which here must be regarded chiefly as an aggravating circumstance, 32. that the prisoner and defendant, according to the above-cited characteristics and nature of his crime, will be subject to the punishment coming closest to death. 33. and although the prisoner and defendant is not de pleno in confession regarding the mentioned circumstances. — 34. it also being true that he was somewhat intoxicated, 35. and the wounds were not directly fatal, 36. circumstances which, ceteris paribus, could contribute to an excuse. 37. yet, on the contrary, on account of the preparation of such an instrument and the premeditation executed ex post, no doubt can exist concerning the intention. 38. which must have been accompanied by all the more deliberate malice, 39. because the prisoner and defendant does not state the slightest reasons, and none are known either, that could have moved him thereto. 40. And he furthermore attempted to murder himself, 41. which, never having been an option for a sane person, must therefore make the prisoner and defendant all the more punishable, 42. and makes the Officer Prosecutor adhere all the more to the notion 43. that the prisoner and defendant ought justly to be inflicted with the punishments deduced above. Wherefore, and for other reasons and arguments to be further deduced in due time and place if necessary, the Officer Prosecutor, making demand, concluded that by definitive sentence of Your Honours, the prisoner and defendant mentioned in the heading shall be condemned to be taken to the place where one is accustomed to execute criminal sentences, and there, being delivered to the executioner, to be exposed with the rope around the neck under the gallows, thereupon to be tied thereto and severely scourged on the bare back, and thereupon to be branded; that he, the prisoner and defendant, shall then be confined for ever to Robben Eijland, in order to labour there on the public works without pay, being riveted in irons, with condemnation of the same in the costs and expenses of Justice, or to such other penalties and punishments as Your Honours shall find and judge to be proper. Appeared before us, the undersigned commissioners from the Honourable Court of Justice of this government, Nicolaas Schlender of Mentz, on suspended pay, who, at the requisition of the Fiscal pro interim here, declared it to be true: that yesterday, the 31 May of this year, having become intoxicated by two glasses of rum which he had consumed, he saw the slave woman Rachel of the Caab, slave of Signor Oloff Marthini Bergh, with whom he, the declarant, had had a relationship for eleven years, walking out on the street; he, the declarant, followed her, having taken a knife along from the pantry, and was so intoxicated by the drink that he, the declarant, does not know any further what he did, having nevertheless gone out with the intention of reconciling with her over a quarrel that had occurred between them both a few days prior about the beating of their child. Furthermore, the declarant relates that he does not know in what manner he wounded himself, having been as if raving from the drink. Declaring nothing more, the declarant gives as reasons for his knowledge as stated in the text, offering, if required, to always confirm the same. Below was written: that this transpired thus at the Cape of Good Hope on 1 June 1786, before the gentlemen Johannes Marthinus Horak and Johannes Matthias Beesterman, members of the Honourable Court of Justice aforementioned, who signed the minute hereof together with the prisoner and me.

Appeared before us, the undersigned commissioners from the Honorable Worshipful Court of Justice of this government, Rachel of the Cape, who, at the requisition of the pro interim fiscal, relates it to be true: That yesterday, 31 May of this year, in the afternoon, having gone for her mistress to Berange, she was spoken to on the street by Nicolaas Schlender, former assistant master at the Schuur, and asked when she, the relator, would come to his, Schlender's place; the said Schlender having further had an intimate relationship with the relator for eleven years and fathered two children with her. That she, the relator, answered: "I have no time today, but will come tomorrow." That the said Schlender seized her by the neck, whereupon the relator said, "Fie, Schlender, leave that be on the street, what will people say." That he immediately thereupon gave her a stab from behind in her lower back, without the relator having been able to see with what knife or instrument he did this, or where it came from. Furthermore, the relator relates that the said Schlender beat her last Friday, and that she has not been with him since that time. Relating nothing further, the relator gives for reasons of knowledge as in the text, presenting herself to confirm the same more fully if required. What brought him, the defendant, to this murderous intention and deliberate execution of this. Says: Never to have had such in his thoughts. 8. Whether he, the defendant, did not confess to having intended to eliminate the aforesaid slave in such a deceitful and murderous manner. Says: No, not to have been of that intention. 9. And that he, the defendant, formed the intention thereto beforehand and to that end watched for and followed the slave. Says: As before. 10. Whether he, the defendant, after having wounded the slave in the aforesaid manner, did not inflict a deadly stab into his own lower body. Says: No, not to have known that he was wounded. 11. Whether this was not done by him, the defendant, because he believed he had given the slave an actual mortal stab and to free himself from the deserved punishment. Appeared before the Honorable Court of Justice of this government the undersigned Landdrost of Stellenbosch and Drakensteijn, Hendrik Lodewijk Bletterman, acting official Prosecutor in Criminal Cases, on the one part, against Carolus of Madagassar, slave of the burgher Jacobus Louw, Damon of Bougies, slave of the burgher Jacobus Bierman, and also October of Maslijt, slave of the burgher Ian Bierman, prisoners and defendants in the aforementioned case, on the other part. And referring to the annexed interrogatories with the answers given thereto, as well as to the points and arguments exhibited in this Honorable Court by the Prosecutor's demand dated 15 of the past month of June and there extensively detailed as far as the first prisoner and defendant Carolus is concerned; but in the interest of the other two prisoners, of whom the second prisoner and defendant Damon of Bougies only had knowledge of the stolen oxen and profited therefrom, while the last has made himself guilty of nothing other than a mere desertion of his master's service, the Prosecutor, making his demand, concluded that the prisoners and defendants mentioned at the head of this document, by sentence of your Honors, shall be condemned to be taken to the place where criminal sentences are customary to be executed here, and there the first prisoner and defendant named Carolus being delivered to the executioner and bound to a post, to be severely scourged with rods on his bare back, and that the second and third prisoners shall have to attend and watch the same execution, and that furthermore the second prisoner be flogged by the Caffers and the third prisoner punished with rods before the prison house, all three defendants riveted in irons, the first prisoner for the period of 5 years to labor at the Honorable Company's public works on Robben Eylande, and both of the latter defendants returned again to their masters to remain thus for one year in irons; further with condemnation in all the accrued costs and expenses of justice, or to such other penalties and punishments as shall be found appropriate by this Honorable Court. Article 1: in support of which Criminal Claim the Plaintiff ex officio, in accordance with the truth, states this: 2. that the Plaintiff ex officio, having been informed by a letter from the Captain of the aforementioned vessel the Nephtunis from False Bay dated 17 August last, 3. that the prisoner and defendant, 4. who in the previous year 1785 remained behind here from the ship Ridderkerk due to illness, 5. and afterwards was placed in the aforementioned capacity on the ship Neptunis, 6. did not shrink from, 7. after having stolen a silver pocket watch from a certain Danish second mate, 8. and as the same Captain further expresses himself in the said letter, 9. having committed many other thefts besides, 10. deserting from False Bay and willfully abandoning his assigned vessel. 11. The Plaintiff ex officio, immediately upon receipt of the said letter, gave orders to maintain a strict watch at this capital place and to make inquiries in order, if possible, to overtake the prisoner and defendant in time and to bring him to justice before this Honorable Council for his crime, according to the laws and placards of this country. 12. That the prisoner and defendant, however, after a short stay at this capital place, went into the outer districts around the Paarl and Drakenstein, 13. and after having wandered around there and elsewhere for some time, returned hither again, 14. whereupon the prisoner and defendant, having learned on and against Jan Fredrik Gerteler of Dantzig, having been assigned as second lieutenant on the Honorable East India Company's ship the Nepthunis, currently the Lord's prisoner and defendant, in the aforementioned case, on the other side, Appeared before the Honorable Court of Justice of this government the Fiscal pro tempore here, Gabriel Ester, Plaintiff ratione officii in a criminal case on the one side. Article 15: 15. that a certain Imperial ship named Good Intent, which had previously been laden by the English, was lying here ready to sail, 16. first sailed to the ship Jagtrust, 17. and thereafter managed in a very adroit manner to get aboard the said Imperial ship, 18. with the intention of serving there as mate and in that manner escaping from here; 19. but that, a report of this having been received, the prisoner and defendant, scarcely 24 hours after his arrival there, by order of the Honorable Governor, was taken from on board and brought here into custody; 20. while subsequently the Plaintiff ex officio caused the prisoner to be interrogated on such articles 21. as were submitted by him on the court day to the gentlemen commissioners from this Honorable Council and put before the defendant; 22. that the prisoner and defendant during the said interrogation did indeed confess 23. that during the night when the silver watch was missed by the Danish second mate, he had slept in the cabin and even in the bunk of that second mate; 24. that he showed two watches to the Captain Lieutenant and second lieutenant; 25. indeed, on article 11 of his interrogation, that the watch which he, the prisoner, traded to the gunner was the same one that was missed and searched for by that mate; 26. but nevertheless declared thereon at article 8 that he had purchased the one watch from a sailor for 6 rixdollars and the other from a chief carpenter for 30 rixdollars, 27. with the assurance that he had never made himself guilty of this theft; 28. that however much one might on the one hand conclude 29. that from the conduct pursued by the prisoner and defendant, since he immediately took to flight upon the said accusation, 30. joined with the contents of his given answers, 31. no slight suspicion militates against him that the prisoner and defendant is truly guilty of that theft; 32. the Plaintiff ex officio, however, on the other hand, with respectful deference of judgment, is of the opinion 33. that since the act is not in confesso by the defendant, 34. and the speedy departure of the aforementioned ship the Neptunis from False Bay made it completely impossible 35. to obtain complete proof regarding the corpus delicti, 36. as well as to obtain such statements and declarations upon which the prisoner and defendant could be fully convinced and convicted by their Honors, 37. the said accusations could and should therefore be regarded as nothing other than a bare indication 38. and a very minor agravation of his further crime, 39. which consequently will consist in this: 40. that he, the prisoner and defendant, far from acting in conformity with the oath so solemnly taken upon assuming his post, 41. namely that he would not leave the service of the Honorable Company before and until he had properly returned with his vessel, 42. and that he would faithfully serve and discharge all offices and duties that might be imposed upon him by the Honorable Company's ministers in the Indies, 43. on the contrary has seen fit 44. not only willfully to abandon his assigned vessel, 45. but even to enter into the service of a foreign power; 46. wherefore the Plaintiff ex officio will now also have to examine what punishment the prisoner and defendant shall have deserved for this; 47. regarding which it comes principally into consideration 48. that however much one also finds a specific punishment enacted without exception for this crime by the placard issued by this Government on the date 19 October 1745, 49. the same dictates in clear words 50. that those of these garrisons and other servants of the Honorable Company, both stationed here on shore and on the ships and vessels, nobody excepted, who with premeditation and willfulness
