That the same Malan, a few days thereafter, having returned home from his journey made in the Camoebo, and subsequently having come to the petitioner, stated that upon his arrival having been informed of the aforementioned case by his wife, that the Valiant Burgher Lieutenant Johannes Brink and the Burgher Cornelis Mostert David 12 were present at the punishment of the aforementioned slave Galant, he, Malan, since the aforementioned case had occurred during his absence, had addressed himself to them, whereupon they had declared that the slave of him, Malan, had received far fewer lashes than that of the aforementioned Valiant Brink, which both the slaves of him, Brink, and those of the aforementioned Malan had absconded together, and that the slave of him, Malan, was in no way excessively castigated and even less mistreated, and that at the same time the said slave Galant had in no way come to die through neglect by his wife, and that both he, Brink, and the same Mostert were prepared to depose to this under oath. That the petitioner, having subsequently further informed himself with the aforementioned Brink and Mostert after this statement thus made by the aforementioned Malan, was assured by them both that the aforementioned Galant, the day after receiving the lashes, worked of his own accord with the other slaves, and four days thereafter even saw the same Galant go out of the river toward the dwelling house without being able to perceive superficially that anything whatsoever ailed that lad, of which the same Brink and Mostert then also provided the petitioner with the declarations annexed hereto under letters C and D, and from which, contrary to what was supposed by the commissioned Heemraden and the surgeon, as if the death of the aforementioned Galant would have been caused by neglect or omission of the necessary remedies, for which the wife of the oft-mentioned Malan ought to have provided, seems must be taken into consideration to her advantage what was established by them in the declarations under offering of oath, that the said slave Galant shortened his life and would have been the cause of his death more through malice and his own neglect than on account of neglect and abandonment committed by the wife of the aforementioned Malan. That the petitioner, there appearing to him from his said inquiries and obtained declarations no sufficient foundation to be able to proceed in the ordinary manner against the aforementioned Malan in his capacity as husband and guardian of his wife or against the same wife assisted by him, Malan, but on the contrary, with respectful reverence, conceiving the punishment inflicted and the subsequent death of the aforementioned Galant to be of such a nature that it can properly be considered to remain outside of any further claim to be made by the petitioner, has consequently also thought it necessary to give the necessary disclosures regarding this matter to your Honors, in order on the one hand to ensure that crimes are not left unpunished and on the other hand, conversely, that the innocent are not punished on a loose foundation. Wherefore the petitioner turns to your Honors with the humble request that your Honors will please have the goodness to declare whether your Honors can share the view to hold this matter outside of any further claim to be made ex officio by the petitioner, or else to provide in this matter in such other manner as your Honors shall find appropriate according to the circumstances of the case. That he, de Villiers, when the aforementioned Fortuyn had been taken prisoner, having asked him why he had stabbed the mentioned Sephta, had been answered by him: I did not stab that boy, but he fell into the knife. That the presenter furthermore, on two successive occasions, had the prisoner Fortuyn examined in the customary manner on articles drawn up for that purpose, the prisoner not only continued to deny the act, but also stubbornly continued to deny having had the knife in his hands, and that, on the contrary, the same Sephta was said to have fallen into the knife. That however much it is on the one hand beyond all dispute that the crime of which the prisoner has 87 been accused is of such a nature that, the same being proven, according to the general laws the ordinary punishment of death ought to be inflicted upon it, and that consequently, the matters being so situated, one would not need to hesitate to compel the prisoner to a further confession by means of sharper examination, yet on the other hand, in the view of the presenter, under correction, it ought to be no less certain that one ought always to make use of the precarious means of torture with the greatest caution, and not well apply it before the evidence that has been brought against a prisoner must be so clear and decisive that one would find no difficulty in making a demand against a prisoner on the basis thereof in ordinary proceedings without the least confession. That Your Honourable Worships, approving the humble view of the presenter and subsequently examining the evidence, he also reasonably trusts that Your Honourable Worships will soon be convinced that a great deal of legality and sufficiency is lacking in the evidence, and one would therefore take recourse rather rashly to the remedy of torture in the present case, for not only is there no other evidence at hand beyond the statement that was given by the aforementioned Sephta other than the declaration of his master, which is based solely on the same statement, but also that one could never attribute any suspicion to the prisoner from which any appearance of sufficient reasons could be deduced for having given him occasion to the act, since the stab was inflicted by the knife of him, Sephta himself, without any sufficient evidence being found whereby one might be enabled to [illegible] according to truth

That, however much it appeared to the undersigned petitioner, on account of the aforesaid defective evidence and other reflections, that one could not very properly apply torture in this case, and on account of the prisoner's constant denial, it is by no means possible to make an extraordinary claim against the prisoner, any more than sufficient grounds could be found to proceed ordinarily against the prisoner, the petitioner nevertheless, under respectful reference, is of the opinion that, apart from the presumed suspicion which in any case results from the narrative, no small difficulty would arise in discharging the prisoner for lack of sufficient proof and setting him entirely at liberty, wherefore the petitioner has deemed it most advisable to bring all this before Your Right Honourable Court, not doubting that Your Right Honours, according to your prudence and enlightened knowledge, will take such disposition as shall be deemed proper according to law. That about a year ago from now the said Kriek received a letter from one Christoffel Viljoen, in which the said Viljoen informed him, Kriek, that his boy Baatjoe had come to stay with him, Viljoen, and had at the same time asked in that letter whether that boy was not for sale, without him, Kriek, notwithstanding all inquiries, having obtained even the slightest report of his boy since that time. Lastly, there was brought to the table the criminal indictment, circulated and read, with the accompanying exhibits, from the Fiscal ad interim, in his official capacity, against Jan Nicolaas Schlender. After deliberation thereon, and having maturely considered everything serving the matter that could move their Honors, the same, administering justice in the name and on behalf of the High and Mighty Lords States General of the United Netherlands, have condemned the prisoner Jan Nicolaas Schlender to be taken to the place where criminal sentences are customary to be executed here, to be delivered there to the executioner, exposed to public mockery under the gallows with the rope around his neck, further tied to a post, severely scourged with rods on his bare back, branded thereafter, and subsequently to be confined to Robben Island, there to labor on the Honorable Company's public works without pay for the term of his life, with condemnation of the prisoner in the costs and expenses of justice. Underneath stood: The undersigned, two currently serving Members from the Board of Commissioners from this Honorable Council of Justice, show with the required respect: How some days ago there came to the undersigned the burgher Jan Visagie, together with the free black Anthonisz, giving to know: That they were living together in a house situated here in the Table Valley in the so-called Schotse Kloof, of which they both were the owners; That besides the shoemaker's trade, which the free black Anthonisz practiced there, they further supported themselves by keeping daily boarders; That these boarders were some soldiers from the Regiment de Meuron stationed here in garrison, who paid monthly for board and drink according to whether they had consumed much or little; That since the dearness of foodstuffs, they not having been in a position to make good the costs to continue giving wine to those boarders with their meals as before, some of the same subsequently laid in their own wine by the half-aam for daily consumption, while others in turn had fetched their own wine in bottles from the general lessee and brought it with them to consume with their meals, and in case any of it happened to be left over, had taken the remainder with them again; That they thus never or at no time had sought to commit any smuggling by dispensing and selling wine by small measure, nor permitted it to be committed by others at their house and with their knowledge, being ready, whenever such should be required, to clear themselves thereof by solemn oath; That on a certain evening, when they both, Visagie and Anthonisz, were not at home, the general wine lessee Jacobus Johannes van den Berg, accompanied by one of the Honorable Company's provost-marshals, the servants of justice, and the Caffres, having come to their house, had not hesitated, notwithstanding that they as owners of the house were not present, in a very exceedingly insolent manner to conduct a search with the provost-marshal and servants of justice, not only in all the rooms of the house down to the most private parts, but even in the chests, bedding, etc., and that under the pretext that wine was being dispensed and sold by retail in secret there at the house; That the lessee Van den Berg, accompanied during that search by shouting, raging, and threats against the members of the household present, having found a cellar case in which there were still some bottles with wine for daily consumption, he, Van den Berg, had that cellar case with bottles of wine carried out of the house by force and taken with him; That finally all the actions of the lessee Van den Berg were committed in the presence of the burghers Hendrik Greyling and Lieder Jonkhof, who at that moment of the execution thereof had been there in the house, and thus had been ear- and eyewitnesses thereof; That he, Visagie, as well as the free black Anthonisz, therefore requested that they, finding themselves convinced of their own innocence, might be maintained against the violence and harassment committed by the lessee. admitted having conducted the search at the house of the complainants on presumption of smuggling, but that he, as the lessee himself, also believed he had the right to do so, adding this expression: that on that account he would not lament for a single moment the fate that was awaiting him because of this, along with yet more other expressions which will here be passed over in silence. From which opinion the Honorable Fiscal pro interim likewise seemed not to be far removed, having testified to having found it to be an accepted custom that the general lessee was permitted, on suspicion of any smuggling, to conduct a search and investigation with the officers of Justice at all times in all such houses where that presumption had fallen. It is very far from the truth, Honorable Sirs, that a Board to which the management of public affairs and the execution of good order is partly also entrusted and committed would aim to try to undermine the prerogatives and privileges granted by the supreme authorities of the Country to the general wine lessee, or that one would wish to grant protection to people who have made themselves guilty of violating the laws; much less still that one would wish to interfere in matters concerning the office of the Fiscal, who as officer of Justice must ever guard against all breach of those laws. On the contrary, Honorable Sirs, that same Board shall always, as until now, exert itself, and it shall be to the particular honor and satisfaction of its members whenever they, in that post in which they are presently placed, can co-operate in the maintenance of good order, solely from the fundamental principle that the good may be protected, the evil punished, and everyone maintained in their proper right. Upon which foundation of right and equity it is, then, that the undersigned also wish to continue to look forward with particular pleasure, in the event that the aforementioned complaining persons, the burgher Jan Visage and free-black Christoffel Anthonisz, upon further investigation can be convicted on good grounds and sufficient evidence of committed smuggling, to their being punished according to the rigor of the laws as an example and deterrent to others. The Honorable Sirs, the presented case in this matter, the conduct of the general lessee and his presumed right thereto, is of such a nature that the undersigned respectfully believe that such can never be approved as equitable and lawful, but that the same on the contrary conflicts with all good order, peace, and security among the good inhabitants; an imaginary right that can never have been the intention of the supreme authorities to grant to a general lessee; a right so arbitrary and unlimited that a general wine lessee would have the freedom, solely on the pretext of suspicion, and thus whenever it entered his mind and pleased him, to harass the worthy burghers and inhabitants with house searches, to commit unpunished violence, to violate the domestic rights that must be dear and sacred to everyone, as has taken place in this case, and which the undersigned have considered it their duty to bring to the knowledge of this Illustrious court, with a very respectful request that, for the maintenance of good order, peace, and security of every inhabitant here, and in order to counter such an arbitrary practice of the lessee, and to prevent it in the future, such a resolution may be taken hereupon by Your Honors as shall be found appropriate according to the nature and circumstances of the case, in accordance with law and equity. Right Honorable Sir and Honorable Gentlemen, Humbly show the very humble servants of Your Right Honorable, the undersigned wife and children of the arrested Burgher Johan Hendrik Jalkas, that their, the petitioners', arrested husband and father had informed and told them that the matter for which he was arrested had occurred as is set down here: Namely, that the petitioners' husband and father, on the date of 2 of this current month of August, performing night watch, first for himself and having also taken on the watch for other people, wishing to farm it out to others after his watch had expired, went for that purpose to the guardhouse standing near the garden of the Burgher Bield. Having arrived there and found it locked, he nevertheless heard someone nearby speaking aloud with one another, and proceeding thither, those speakers had quickly departed, whereupon the petitioners' husband and father, having inspected the ditch around the aforesaid garden, not knowing otherwise than that his capacity also authorized him to do so, and having discovered nothing in that ditch, he had gone up by the wall of the aforesaid garden, and going further and further along the same up to the gate of the aforesaid garden, he had found a bag lying on the wall near the same, which aroused suspicion that some runaway slaves were in that vicinity, in which he was all the more confirmed because the petitioner's husband and father, looking over the aforesaid wall, discovered that someone was hiding along it, which made him resolve to pursue the same and, if possible, to take him prisoner; he took off his watch-coat so as not to be hindered in the pursuit, and furthermore climbed over the aforesaid wall, and going toward the person in hiding, he discovered that another person had been there beside him, both of whom came straight at him, and without a single word being spoken between them, they dealt the petitioners' husband and father a blow to the head with a piece of wood and struck him in such a manner that he immediately fell into a swoon, without knowing what was further done or dealt with him. And this is the incident which people are now attempting to interpret in the worst light, arising more, under correction, from a vindictive mind than from a lawfully proven crime, and for which these proceedings against the petitioners' husband and father were to be held. And although the petitioners have been informed that the laws are very strict and harsh against those who commit such faults, crimes, or offenses with which people also attempt to besmirch the petitioners' husband and father, and that to that end it is enacted that one must and may proceed both by accusation and inquisition, nevertheless the same laws labor more toward the exoneration than the encumbrance of all manner of accused persons, such that the petitioners, under correction, understand that all offenses must appear as clear and clearer than the sun shining at midday, and therefore also say that one must proceed so circumspectly in such matters that if it should not fully appear from everything, it would be better to absolve a criminal than to condemn an innocent person; to which end all prisoners, whether ordinary or extraordinary procedure is intended against them, are permitted to make their defense fully. Which the petitioners trust all the sooner to obtain from the equity of Your Right Honorable, especially since here such an act as that with which people attempt to besmirch the petitioners' husband and father was never committed, nor has he ever been known as such a person, much less that the same can be proven as aforementioned. in order, before disposing thereof, to hear what the pro Interim Fiscal, the Honorable Gabriel Exter, might request regarding the said Jallas; who, consequently having entered, provided with the statement below, accompanied by 5 annexes, served: Right Honorable and Worshipful Lord and Gentlemen. The pro Interim Fiscal G. Exter respectfully shows: That on the night between the 1st and 2nd of this current month of August, the burgher Laurens Bield placed a free slave together with a bondservant of his in his garden called Over Bil to keep watch, as vegetables had been stolen on multiple occasions, in order to discover the thief thereof; and they, having hidden behind the gate, noticed around half past one a person who looked out over the wall of the said garden. That this person, having walked a few paces further and along the wall, thereupon took off his watch-coat and, holding a stick and sack in his hands, did not hesitate to jump over the wall into the garden, where, after standing still a moment and looking around and having approached the aforesaid gate to within a few paces, he was accosted by the aforesaid free boy, who with his companion had jumped up at that moment, and sought only to save himself by fleeing back over the wall, but, being pursued by the said persons and due to a misstep by falling through a hedge, fell into their hands. the acting Honourable Gabriel Exter gave to understand in Council that His Honour, together with and alongside the Secretary of this Council, the Honourable Cornellis van Aerssen, in the absence of the sworn Clerk who had been commissioned together with and alongside him, the Fiscal, pursuant to the resolution of the Honourable Council of Justice, had proceeded to the west corner beach of Baay Fals and had there made a proper inspection of such goods as had been looted from the French private ship La Rozette, which had stranded there, and hidden by certain detained persons. His Honour therefore submitted a pertinent list of those goods, and His Honour further requested to be informed by this Council how and in what manner he should conduct himself therein, all the more so since the discovered goods were already found to be wet and, if taken under sequestration, would be exposed to decay. Whereupon, having deliberated, the following resolution was passed: The Council authorizes the Secretary to hand over all those goods according to the inventory, as well as the goods which were already discovered by the prisoners upon their capture, under proper receipt and notice, to the Agent of His Most Christian Majesty, Mr. Percheron, in order that His Honour may act in that regard as he shall see fit. Thereafter, the Landdrost of Stellenbosch and Drakensteijn, Mr. Hendrik Lodewyk Bletterman, appeared in Council and made known how the person of the burgher Erasmus Smith—who, pursuant to a resolution of the Honourable Council of Justice, had been released from his detention sub poena confessi et convicti and ordered to remain residing in the village or district of Stellenbosch and not to go elsewhere without the prior knowledge of the Landdrost—had not only intended to depart from there, but also daily indulged in drink to an extreme degree; requesting that the Honourable Council would be pleased to determine in this regard whether the aforementioned Smit should not be permitted to take up residence here at the main settlement or elsewhere, or otherwise to decide hereon as Their Honours should see fit. Whereupon, having deliberated, the following disposition was made: The Council persists in its resolution taken on 10 August of this year and accordingly orders that the burgher Erasmus Smit must remain residing on his purchased farm situated near Stellenbosch, in order to prevent all troubles. Therefore, a letter on behalf of the Council shall be written very earnestly to him, Smith, to moderate his drinking in future and to conduct himself properly. Furthermore, the following petition was presented by the wife of the detained Barend Daniel Bouwer: To the Right Honourable Gentlemen Pieter Hacker and Johannes Isaak Rhenius, Presidents, together with the other Honourable Council of Justice of this government. Respectfully shows Hendrik Lodewyk Bletterman, Landdrost of Stellenbosch and Drakenstein: That on Thursday the 14th of the recently passed month of September, the burgher Carel Fredrik Paret, having come to Stellenbosch, then related to the substitute Christiaan Godhelp Rudolphi: That he, Paret, on Monday the 4th aforesaid, in the afternoon, having gone to the Berg River, which runs about one hundred paces from his house, in order to angle with a fishing rod, had met not far from there one of his female slaves named Diana, who had gone with a bucket to fetch water for the household, whom he, Paret, is said to have ordered to scoop the water out of the boat, but that she had refused this and mumbled under her breath, without him, however, having understood it. That he, Paret, having given the same female slave a few slaps for her unwillingness, she had thereupon dealt him a push to the chest, from which he, stumbling, fell into the water. That he, Paret, having become angry and heated about this, picked up a piece of wood the thickness of an arm and dealt her a blow so that she fell to the ground. That, it being discovered by him, Paret, himself that this careless blow had caused her a fracture to the back of the head, that wound was dressed by him, and that evening she came to die of the received wound, without him, Paret, having been able to have the same girl inspected, wherefore he, Paret, had then also had the body buried on the Wednesday following. That the memorialist, in order not to expose the narrative given by him, Paret, to the Substitute Rudolphi to any false interpretation, as well as to prevent him from subsequently retracting his own narrative, had the same Rudolphi inform him, Paret, to execute a formal account thereof at the secretariat, as he then also did, just as the burgher David Beyer, living with him, on the 18th thereafter also executed a declaration concerning this, conforming to the contents of the account provided by the aforementioned Paret, only with this difference, that he, Beyer, having ridden to the field-cornet Jan Blignault junior to summon him to inspect the dead body

Thursday the 2 November 1786. In the forenoon, present the Honorable Worshipful Lords Pieter Hacker and Johannes Isaak Rhenius, Presidents, and all the Members, except Mr. Meyer on business. It was made known amicably by the sworn Clerk of this Council, Sr. Ryno Johannes van der Riet, acting in office for the Landdrost of Swellendam: that in the year 1783, by and on behalf of the said Landdrost, an ex officio lawsuit having been instituted against the Burgher Fredrik Hendrik Coenradi and his wife, it then pleased this Honorable Worshipful Council to allow the maidservant over whom the dispute had arisen to stay provisionally with the first Provost Marshal; but that the same slave woman having in the meantime become pregnant, she was placed by order of the Honorable Worshipful Lord President in the Honorable Company's slave lodge; that furthermore, since the lawsuit has now already lasted three years, and the losing party could be exposed to heavy expenses through a longer stay of the same slave woman with the aforementioned Provost Marshal, where she cannot be maintained, excluding other expenses, for less than a schelling a day; the same sworn Clerk therefore requested that it might please this Council to allow the same slave woman in question to remain in the Honorable Company's Lodge for so long, and to have her perform service alongside the other slaves for her board, until such time as the matter in question shall have been definitively concluded by this Council.
