had gone, in order that—while the well-mentioned Mr. Boesjes would be received that same day—to appoint certain soldiers who were stationed there in the Castle, he, the appearer, had then seen from the house of the aforesaid Stapelberg that great commotion was being made by several slaves against some soldiers at the residence of the burgher Jan Theron, which was why the appearer, wishing to investigate this, had gone over there. That the appearer, having arrived there at the house, had seen that the burgher Hendrik Smit, surrounded by several slaves, was standing at the steps of the stoop, while a person was on the steps with an iron auger, and the wife of Theron, who did not cease raging and scolding both at the aforesaid Smit and at two soldiers who wanted to bring the mentioned Smit to the steps, was standing on the stoop; whereupon the appearer had asked the wife of the aforesaid Theron whether she had also been insulted by the same soldiers, as in that case he would provide her satisfaction, but that notwithstanding she had answered that the soldiers had done no harm, she had nevertheless substantially continued, "I do not want those mangy soldiers on my yard," adding, "that old scoundrel," denoting the repeatedly mentioned Smit, "comes here to cause violence, and on come those mangy soldiers into my yard"; so that when the appearer attempted to represent to the same woman that the Battalion tolerated no mangy people, and that she should refrain from scolding the soldiers any further, the aforesaid Johannes Theron himself, having come home right then, directly asking for his thick stick while shouting, "What is going on here? What are the soldiers doing on my yard!"; that in the meantime the wife of him, Theron, having called out to her husband, "That old scoundrel, that smous, comes here for money when you owe him nothing, and that mangy crowd, the soldiers, come here to cause violence," the same Theron had further added to the aforesaid Smit under several swear words, "Get lost, you rogue, if you come onto my yard again I will beat your arms and legs to pieces," while he, Theron, having then obtained his stout rattan cane, had approached the same soldiers while saying, "I will beat you until you are damned," whereupon Sergeant Adam Franke, who had also arrived there by then, had warned the aforesaid Theron that he should be careful not to strike the same soldiers, and that if the soldiers had insulted him, he, the sergeant, would provide him satisfaction, but that the aforesaid Theron, continuing with raging and scolding, had further added to the sergeant himself, "I do not want that mangy crowd on my yard"; the two aforementioned soldiers, who had already walked a distance with the repeatedly mentioned Smit under the arms, as well as the appearer and the more mentioned sergeant, having then departed from there. the following witness, sergeant Adam Franke, posted here under the Battalion, of competent age, who at the requisition of the interim Fiscal here, the Honorable Gabriel Egter, declared it to be true: that when on last Wednesday, being the 17th of this month of January, the right honorable and strict Commissioner Adriaan Boesses was to be received here, and the appearer had gone to the house of Frans Stapelberg to notify the soldiers found there to present themselves in the Castle for the aforementioned purpose, he, the appearer, had then seen from the house of the aforementioned Stapelberg that great commotion was being made against some soldiers by several slaves at the residence of the Burgher Jan Theron, wherefore the appearer, wishing to inform himself about this, had gone thither. that the appearer, having immediately upon his arrival there seen that the Burgher Hendrik Smit was surrounded by several slaves near the steps of the stoep, and a person who was a quarryman and having an iron crowbar in his hands was standing on the steps, while furthermore the wife of the aforementioned Theron, from the stoep, was making a terrible din against the said Smit and two soldiers who were busy taking the aforementioned Smit by the arms to escort him from the premises, by scolding and raging, he, the appearer, immediately, upon the wife's saying that the soldiers were scabby rascals, had asked whether she had also been insulted by the same soldiers, to which the same housewife of the frequently mentioned Theron, notwithstanding that she also answered that the soldiers had committed no outrages nor insulted her, nevertheless had continued by scolding and calling them scabby people, while at that very moment the aforementioned Theron himself, having come home, and immediately also while passionately scolding and raging having asked for his cane, in order, as he shouted at the top of his voice, to clear that scabby people and that old scoundrel from the premises and to beat them until they (saving your reverence) were damned, the appearer had gone to the aforementioned Theron, and told him to be careful and not to beat the soldiers, because if they had insulted him or anyone else, he, the appearer, would then provide everyone with satisfaction, but that he, Theron, continuing constantly with cursing and scolding, had furthermore added to him, the appearer, I do not want that scabby people on my yard, he, Theron, among other things, in the presence of the appearer, having substantially uttered against the aforementioned Smit: Get going, old scoundrel, if you come on my yard again I will beat your arms and legs to pieces (wherefore he, the appearer, in order not to await any further unpleasantness, had ordered the aforementioned soldiers to go barracks-ward, at the same time telling him, Theron, that he, the appearer, in order to obtain the required satisfaction, would go and complain to his lawful authority about his insolence and abusive language. Sworn Clerk at the Secretariat of Justice of the Castle of Good Hope, in the presence of the hereinafter named witnesses Matthys Sartory of Luxemburg and Johan Daniel Godfried Cordes of Hamburg, both assigned as soldiers under the garrison here and of competent age, who at the requisition of the pro interim Fiscal, the Honorable Gabriel Exter, declared to be the truth: That on Wednesday the 17th of this current month of January, having found themselves in the house of Frans Stapelberg situated up at the so-called Walendorp, where the first appearer resides, they, the appearers, being able from there to recognize very clearly anyone on the porch of the burgher Johannes Theron living not far from there, had seen at the house of the same Theron, namely on the aforementioned porch, that a person was attacked by several slaves and pulled down from the steps; whereupon they, the appearers, being unable to comprehend what could be the cause of this, had decided to go there to inform themselves about this, and if the same slaves had the audacity to attack their master, to rescue from their hands that person whom they recognized as a European, or at least as no slave or black person. That the appearers, having arrived at the place or near the house of the aforementioned Theron, had then seen that the person who was being pulled down the steps by the aforementioned slaves turned out to be the burgher Hendrik Smit, so that the appearers, out of compassion, attempted to rescue him, being an old man, from the same slaves and to take him along; but that as soon as they, the appearers, had asked the wife of the aforementioned Theron, who was standing right near the porch and gave orders to the slaves for this, how she could let an old man be mistreated in such a manner by black boys, the same wife of the oft-mentioned Theron, in a passionate demeanor, had substantially addressed the appearers: You lice, you scurvy-necks, you scurvy rascals, what are you doing here? However, notwithstanding this, the appearers took the same Smit under the arms to escort him towards the Cape; while having progressed not even two paces from the porch with him, the aforementioned Jan Theron, who had been to the Cape, came onto the place himself, shouting, "What is that, I will thrash you with a cane so that you will be damned!" and having approached the appearers, upon the statement of the aforementioned Smit that he had come there to collect his money, had further said to the same Smit, "Yes, wait, old rascal, I will give you money, I will cane you with a rattan so that you, with respect, are damned." That the aforementioned Smit furthermore related to the appearers that, having gone to the house of Theron to receive money that Theron owed him, he, upon his arrival, because the man had not been at home, had addressed his wife for the payment; but that instead of satisfying him, the same wife had immediately flared up at him, called her boys, and had him dragged out of the house and down the steps in this manner. The appearers further declare that when they had arrived at the place of the aforementioned Theron, a certain person who worked in the stone quarries was standing on the steps and repeatedly threatened the aforementioned Smit with an iron crowbar that he had in his hands. Declaring nothing more, the appearers give as reasons for their knowledge as stated in the text, being ready at all times to confirm the foregoing with an oath. Thus passed at the aforementioned Secretariat, in the presence of the clerks Willem Stephanus van Ryneveld and Nicolaas van Es as witnesses, who duly signed the minute hereof along with the appearers and me, the sworn clerk. Report given in the presence of the undersigned commissioners from the Honorable Council of Justice of this government, by the citizen Jan Hendrik Christoffel Smit, of competent age, and at the requisition of the interim Fiscal here, the Honorable Gabriel Eyter, reading as follows: That when the deponent, well three weeks ago now, without being able to determine the precise day or date, went to the dune of the citizen Jan Theron in order to address him regarding the payment of 11 Rixdollars and 7 schellings, which Theron had owed him for some years for the labor wages of a boy and had failed to pay, the deponent, as Theron was not at home at that time, made the reasons for his arrival known to the wife who was present then; but that the wife of the said Theron first answered the deponent, owing you nothing; after which, upon the deponent's statement that it was nevertheless clearly noted in his book, she continued, I shit in your book, at the same time showing the deponent the door, make sure you get out of my house quickly. What person, being attacked in his own house in such a manner, would not defend himself! Can that be called violence? Can the declaration exhibited by the plaintiff now merit any credit since it is completely and utterly beside the truth? Can all those declarations submitted by the Plaintiff prove enough before the court? The circumstances of the case appear in sufficient detail that the deponents in said declarations were Companions of said Smit. - And as it appears, smit with his Companions was aware that the defendant was not at home, and forged a plot together to overwhelm the defendant in the absence of her husband, and to demand payment in such an unheard-of manner of something she did not owe. And stated that the defendant, having been commanded as a tailor of his trade to cut and have made the uniform of the battalion, and having received for that purpose 13 pieces of kersey and accessories, he dared to undertake to sell three pieces thereof and one piece of baftas to the citizen Theunis Mulder, and thus to alienate this property entrusted to him, as appears more fully from his confession made before the honorable commissioners of this respected Council, and from which it will absolutely have to be concluded that the defendant, having alienated the aforementioned goods and used them for his own person with intent and premeditation, will have subjected himself to the crime of the act and the punishment thereof, taking into consideration, however, that the Captain should never have entrusted so much to the defendant, or, as is the custom, should have left an officer with him to have the goods cut out under supervision, and that the defendant was enticed thereto by the opportunity given by the aforementioned Mulder, who himself came to the defendant and addressed him to sell him kersey piece by piece, which could never be left over, and notwithstanding that the defendant's excuse that he had intended to return the goods may merit very little credit, and does not excuse himself, and it is thus certain that the seller in this case remains very guilty, the officer prosecuting considers, however, under correction, that on account of the first-mentioned circumstances the defendant ought to be punished with no less rigor. Appeared before the Right Honourable President and Council of Justice, the Fiscal pro interim Gabriel Exter, official plaintiff in a criminal case on the one side, against the soldier of the Castle Coenraad Ringer, prisoner and defendant in the aforesaid case on the other side, and stated: 2 That, according to Article 7 of the Articles of War dated 22 August 1780, it is statuted that a deserter seeking to escape on foreign ships in time of peace and being apprehended, shall be flogged and branded by the executioner at the place of justice, and riveted in irons for ten years, with forfeiture of wages and bonus; 3 That the prisoner and defendant has made himself entirely subject to this punishment; 5 Whereas, according to his answers given before the Commissioners from this Council, he has voluntarily declared and avowed: That he, the prisoner and defendant, having previously made acquaintance with English sailors, 7 Did go on Sunday the 5th of the past month of August with several of the same, whom he had met on the street, 8 To the inn "De Blauwe Anker", 9 And there having drunk a bottle of wine together, which was paid for by the prisoner and defendant, 10 The prisoner and defendant retired with one of the sailors to the backyard of the said inn, 11 In order to exchange his uniform for a sailor's attire, and thus, being less recognizable, to escape to the English ship; 12 Which would indeed have succeeded, 13 Had the prisoner and defendant not been recognized and arrested in passing by the sergeant on guard on the wharf; 14 From which circumstances it appears to the official plaintiff, under correction, 15 That the prisoner and defendant must be considered as nothing other than a wilful and intentional deserter; 16 And that the excuses brought forward by him, that he was under transport and had been a little drunk, 17 Ought all the less to be taken into consideration, 18 Because the first provides no reason to desert, 19 And the second, in the military, aggravates every offense under the Articles of War; 20 And that the prisoner and defendant should therefore justly be punished according to the content of the law. and that it is therefore more likely that he, the defendant, pursuant to the deposition of his brother-in-law Hollshousen, according to the confession of the wife of Ryneke, will have said upon this: You can indeed kill her, from which an absolute intention can be inferred; however much the Officer Plaintiff now considers himself well able to make the defendant's conduct in general operate through artificial proofs drawn from the aforesaid declarations, along with the concurrent presumptions appearing therewith, as well as through further proof, to the prejudice of the defendant and consequently to the aggravation of the punishment, he will nevertheless rather leave the individual proofs as they are, and, in the conclusion to be taken in this matter, merely hold to the most certain matter, and the crime confessed by the defendant; to effect which, it will serve to examine: Firstly, what proofs are required in law in the present case; and then, in the second place, on what ground justice may be demanded in this matter. According to the doctrine of the translated Carpzovius, Part 2, Chapter 106, numbers 22, 23, 24, the testimony of two witnesses is generally required in law for the proof and conviction of a committed crime; and in section 3 of that same chapter, that the proofs must be as clear as the day shines in the heavens; while in number 14 it is taught that in crimes of difficult proof, such as adultery among others, a presumed and conjectured proof is sufficient along with the confession; yet this being the difference here, because the crime committed by the defendant has been proven by the confession, the Officer Plaintiff therefore also believes that the produced proofs, if not sufficient, at least furnish a primary proof to demand justice according to the tenor of the laws; while the Officer Plaintiff will proceed further to the consideration: 1. to what degree the defendant's misdeed is to be placed according to law; 2. whether for that same crime the completion of the full crime is required, or 3. whether the malicious intent along with other attendant circumstances is necessary thereto. That the crime of adultery is a heinous and grievous misdeed, and therefore merits severe punishment, as well as in its various degrees, is taught by the aforesaid Carpzovius, Chapters 45, 46, 47; item the Dutch Legal Dictionary, under the title Adultery and Dissolution, and its appendix under the title Dissolution of Marriage; by the aforementioned Carpzovius in his 45th Chapter, number 40, as well as by the aforementioned On Crimes and Their Punishments, Book 2, Chapter 13, sections 5 and 9, the execution of that shameful crime being required; and whether such can be established in the present case, the confession indicates most clearly; thus the third point thereby falls away entirely; and as to the circumstances that accompanied the act or almost ensued from it, the accusation of the defendant's wife indicates them, whereby the life of the wife was almost sacrificed to the lustful nature and the evil vices of the defendant; while with respect to the defendant no excuse can be brought forward, except only that which he alleged at the close of his interrogation; and further, in the second place, that if he, the defendant, had remained with the negative, one could not equitably have concluded for any oppressive punishment, since the proofs, according to the aforementioned Dutch Legal Dictionary, are not complete, and much is still wanting of their requirements; yet now that the defendant has completely confessed, the Officer Plaintiff believes, subject to correction, that all those requirements, if not completely, have at least been partly satisfied; and whereas now, according to the letter of the statutory law of the Dutch Indies, which is most strongly prescribed for our observance here under the title of Various Crimes, namely that of adultery in the 35th article, without the least exception, and to which no further or other interpretation can be given, the following is taught: "But adultery being committed with a married woman, both, whether the man be married or not, shall, over and above a fine of one hundred Rixdollars each, for the term of fifty years, the man be confined ad opus publicum or outside the country, and the woman in the house of correction." The Officer Plaintiff therefore believes that all the circumstances of the entire case considered in its connection do not seem to permit that one maintain a fixed limitation in decreeing the punishment concerning the defendant, also because that reason seems to be the most prudent, so as, without inference or consequence from other similar sorts of crimes, to argue to this one.

When one now puts the case in question to the test of this known legal doctrine, one will quickly discover that, concerning the evidence or witnesses in this case, there is a very great difference from those irrefragable depositions which, in the subject case, are required to proceed in matters of adultery; since in the entire trial not a single deposition is to be found wherein it is decisively stated that the petitioner was seen committing unchastity with the aforesaid woman; on the contrary, the proof submitted on the part of the officer consists only in a statement of the wife of the petitioner, which in law is just as reproachable as the statements of those who allege to have heard of the petitioner's commission of the aforesaid fact from the mouth of the petitioner's wife. frankly declared to the commissioners that the allegation of having had carnal conversation with the petitioner is untrue! The petitioner has, as was said hereinbefore, to the commissioners, it is true, confessed that he believed he had mingled with the aforementioned female, but he begs Your Honorable Worships to be pleased to take into consideration that his wife has already for some years suffered from an ailment whereby the cohabitation of marital duties was entirely prevented, which has had that disastrous consequence for the petitioner that he, the petitioner, who is still very young and thus at those years in which one can so hardly resist the instincts of nature peculiar to every mortal, having fallen into the utmost melancholy, took a wrong resort and now and then indulged excessively in drink, on which occasions he, the petitioner, certainly could not conceal his desires for the aforementioned female, set ablaze with fire and flame; that he, the petitioner, having thus believed that in those moments, when he was enchanted by drink, he might well have satisfied his animal passions with the aforementioned female, consequently, in order to proceed in all things without reservation, made the aforementioned confession before the commissioners, which confession he now solemnly testifies was by no means made from a certain consciousness of the act, but solely out of fear and dread, and in the belief of possibly having arrived at that act in his aforementioned drunkenness; yet that the conversation which the petitioner, as aforesaid, believed he had held with the wife of Reyneke being entirely denied by the said wife of Reyneke in her answers, the petitioner can consequently now refer with very good reason to the aforementioned responsive answers, and thus on the foundation of the aforementioned could very easily await the proceedings which the aforementioned Landdrost might prosecute upon and against the petitioner; but since the said extraordinary proceedings have been instituted, and the prosecutions thereof, as commonly causing much public scandal, thus, although the same could bring little prejudice to the petitioner, nevertheless have hateful consequences, and could be detrimental to the petitioner, who lives far inland, in his domestic livelihood, the petitioner has consequently resolved to turn to Your Honorable Worships with the humble request that Your Honorable Worships, considering the unfortunate circumstances in which in which he sees himself accidentally brought, may be pleased to declare the aforementioned matter civil and composable.
