Article 1 And did say that the defendant on Sunday the 14th of the past month 8ber toward noon having arrived home from the Groene Kloof and having inspected his affairs and business at his post, also went to the old dwelling, where, having ordered his slaves to prepare and bring some food for him, the defendant finally went into his dwelling to rest and eat lunch. That while the defendant was doing this, in the meantime several people having entered whom he had sit down, one of the slaves of the defendant, named October, unexpectedly came running inside, and did not shrink from striking the defendant, his master, in the chest, and throwing him to the ground, biting and beating him for so long until, upon cries for help, the present people pulled him off his master. That the defendant thus having been set free, and having first given the boy several blows with the sjambok, finally, with the assistance of one of the aforementioned persons, bound him to a ladder and further beat him on the loins and buttocks alternately and repeatedly. That both places became bloody and severely bruised, and the result thereof was that the boy died in the night following thereupon, as will further appear to Your Noble Honors from the annexed legal depositions and post-mortem certificate, as well as the defendant's own confession. Appeared before the Noble Honorable Lord President and Council of Justice of the Castle of Good Hope, the pro interim Fiscal G: Exter, Officer Demanding, on the one side, Johan Coenraad Snel, soldier stationed at the Honorable Company's stables and serving on Paarden Eiland, defendant, on the other side. Article 15. Wherefore the Officer Demanding, referring thereto, takes the liberty only to observe regarding this case that as certain as it is that the defendant committed a very impermissible act forbidden by the laws, which itself, at least on account of help not being rendered, was the cause of the death of the boy, and in that respect must make the defendant guilty and punishable in every way, so little on the other hand can it be doubted that the punishment of the boy by the defendant occurred in reasonable distress and anger. For although it is strongly to be presumed that the boy was in one way or another aggrieved or displeased by the defendant, which the defendant however cannot well remember, it is nonetheless the greatest crime and according to the law worthy of death, to lay one's hands upon one's master. So that the defendant has failed not so much by the excess and nature of the punishment, but rather through the neglect that, having the boy in his power, he did not turn him over into the hands of Justice. Which must then also be partly attributed to the fact that the defendant, having been somewhat intoxicated, let himself be ruled all the more by his passion. Wherefore the Officer Demanding, subject to correction, deems the deed in concreto to be accounted more as a great fault than a crime, which merits all the more clemency because the defendant in his long service with the Honorable Company has always conducted himself well and was never previously found guilty in any way. Wherefore, and for other reasons to be further deduced in due time if necessary, the Officer Demanding, making demand, concluded that by definitive sentence of Your Noble Honors, the defendant shall be condemned to a fine of 2 hundred rixdollars to be distributed as customary, with all court costs, or to such other punishment as Your Honors shall deem appropriate. With due respect, the undersigned pro interim Fiscal shows that on Monday the 15th of the past month 8ber it was reported to the petitioner that on the previous evening a slave belonging to Coenraad Snel, who is stationed at the Honorable Company's stables and serving as overseer on Paarden Eiland, named October, had died a few hours later from blows inflicted by the aforementioned, his master; and the petitioner, having made the necessary searches and investigation regarding this matter, from the collected depositions and post-mortem certificate, annexed hereto, it will appear to Your Noble Honors that the aforementioned Snel did in fact first give the aforementioned his boy several fierce blows with a sjambok, then had him bound to a ladder and continued with blows, alternating with a sailor, his nephew, until the loins and buttocks of the slave were entirely bloody and bruised, from which he then came to die, although according to the opinion of the chief surgeon he might perhaps have been saved with skilled assistance. That the second appearer, entering immediately thereupon, had likewise perceived the same and, upon seeing the beating, had immediately departed. That after he, appearer, and the said quartermaster had had the midday meal with the master there, named Snel, around two o'clock in the afternoon an enslaved boy had unexpectedly come into the house, who without saying anything grabbed the aforesaid Snel by the legs and threw him to the ground, while the said slave further went to sit upon the mentioned Snel, whom he subsequently grabbed by the ears and held so tightly; That upon the continuous cry for help from the aforesaid Snel, the repeatedly mentioned quartermaster and the appearer pulled that slave off the body of Snel, and a sjambok having immediately been taken, some strokes were then inflicted upon the aforesaid slave with the same; That the mentioned Snel, having thereafter had the aforesaid slave tied to a ladder because of his insolence, had beaten the same on the buttocks with the sjambok, but that he, having become tired, had requested the quartermaster to be willing to relieve him, which by the same was at first refused with the statement that he did not wish to meddle with the Honorable Company's people, but thereafter, when he learned that it turned out to be not a Company's but Snel's own slave, was accepted, so that the said quartermaster had then also given the repeatedly mentioned slave some blows on the buttocks with the sjambok; That subsequently, when the aforesaid slave was untied and still continued giving insolent answers, the repeatedly mentioned Snel, having inflicted some more strokes with the sjambok upon the same, the said slave had thereupon gone out of the house.

7: That the plaintiff subsequently, by sentence rendered by Your Honours on the 5 April of this year, was ordered to act ex officio regarding and against the defendant and the aforementioned van koppen. 30 That to that end the 7:th plaintiff, on the 26 July, requested and obtained a summons in person against the defendant van koppen; 31 furthermore, serving on the appointed day, before making any claim, requested 32 that both the one and the other might be condemned by this Council to be heard on articles before the Commissioners, which being granted to the 7:th plaintiff, was also duly put into execution by him. 33 That the defendant, however, did not let the matter rest with his aforementioned crime, but aggravated the same with a second one, seeing that during the same interrogation he so far forgot himself that he did not hesitate to slander in a far-reaching manner in their office both the Commissioners who had officiated at the re-examination of his statement on the 21. xber 1786 and the sworn clerk before whom he had previously passed the same; 34 as he, the aforementioned, did not scruple to advance brazenly before the Commission that assisted at his interrogation: 35 that the statement, instead of at the office according to the order in the presence of the witnesses, to the contrary, was allegedly signed by him at his house over a glass of wine without an official clerk or witnesses; 36 subsequently, that the same had been revoked by him, the defendant, upon re-examination, but that the Commissioner officiating at that time had not wanted to accept this revocation of his, but had quasi rushed and as it were forced him merely to sign and leave his statement unaltered; 37 finally, after the defendant had been convinced, both by Mr. Smuts, who had attended the previous Commission, and by the sworn clerk, of the malicious and mendacious nature of this assertion, further that the statement had then been read out to him incomprehensibly during the re-examination; 38 subsequently, again, that he, the defendant, had never intended to take the oath upon it; 39 and similar self-contradictory, insincere, and trifling yet at the same time impertinent excuses; 40 all of which Your Honours will be able to observe more closely from the annexed pieces and documents; 41 wherefore the 7:th plaintiff takes the liberty to refer particularly to the circumstances of the defendant's acts therein, 42 and to proceed to the further determination of those crimes into their punishment. 43 Under which the 7:th plaintiff, subject to correction, deems it necessary to establish: 44 that the defendant, noticing that the receipt which the aforementioned van koppen had received from him, the defendant, was missing, and that the same thus also, on account of the long duration of time, did not seem very conscious that the questioned 1000f had revera been handed over by him for further delivery to the defendant, 45 embraced that occasion to commit a forgery which, if his design succeeded, could cause him to profit by 1000f; 46 that the entire action was initiated and carried out according to the defendant's conduct, inducement, and instruction. 47 Yea, that to the support and foundation of that, he additionally attached a quasi-legal statement relevant to the matter and containing all particular other circumstances distinctly within itself, 48 and thus set himself up as a false witness, in order, contrary to all principles of honour and loyalty, as shamelessly as abominably, with deliberate cunning and premeditation, to obscure the truth; 49 yea, in his deliberate malice went so far, 50 that he did not hesitate to accuse both the Commissioners and a sworn official clerk with his own falsity, 51 to sacrifice, were it possible, their public character, so necessary in an orderly society, the mutual trust in notarial instruments which often form the foundation of judicial sentences, to the effects of his evil intentions; consequently, to insult in such an extravagant manner a judicial Commission, the representatives of this illustrious College, and in them both this glorious tribunal and those in whose name law and justice are administered by the same, whereby he, the defendant, made himself guilty of an absolute Crimen Laesae Majestatis; 52 and that solely with the intention, contrary to all impressions of a pure conscience, at the expense of the property and blood of his fellow man, to advance his own gain and greed. 53 And that the defendant, through these most strongly qualifying circumstances, has also in all respects made himself guilty of the Crimen Falsi and subject to its lawful punishment, appears in the

54 However much the defendant now also seems to wish to pretend that he gave no occasion or cause for the action, 55 it will nevertheless fully appear from the response of van koppen and the declaration of the attorney conforming thereto, 56 furthermore no less from the doubtful answers of the defendant and especially from the unequivocal response to number 18, 57 that the defendant began the entire matter and, so to speak, supplied the materials to execute the whole work. 58 And the more so because he, the defendant, was the only person who could promise himself any advantage therefrom, 59 since the defendant furthermore cannot produce the slightest proof that the payment to de waal was made by him. 60 It being thus also quite difficult to understand that the defendant, having given a receipt to van koppen upon receiving the money, 61 would not have sought to provide himself with a proof upon handing over the money to de waal, by which he could legitimately demonstrate this payment. 62 To which is added that the defendant is said to have told van koppen that he had settled the money with de waal, which directly contradicts this, 63 and that de waal is said to have answered van koppen a few months before his death that he remembered nothing of the payment by smit. 64 The defendant contradicts himself among other things also on No. 12, whereby he declares that de waal had said to him, the defendant, that he would also pay the 214 rds. which van koppen owed him, the defendant, and van koppen would remain indebted only to de waal; 65 in which case the 214 rds. could then have been directly deducted from the ƒ 1000 and it would have been unnecessary first to accept it and then to pay it out again. 66 So that it can be inferred in every way that the defendant never paid the ƒ 1000 to de waal, but on the contrary essentially had the intention to enrich himself therewith. 67 And notwithstanding that the defendant now brings in very many exceptions against the declaration executed by him to that end, saying that he had given no false declaration, much less had been intentional thereto, the reasons for the defendant's excuses are nonetheless very childish and far-fetched, since from the connection of the matter, the cunning conduct of the defendant, and the manifold contradictions, the contrary is nonetheless most clearly evident. For what the defendant denies in one place, he admits in the other, or says it may be, I might well have forgotten something, 72 and finally requests the Council, see Extract of the minutes of the 6th of this month, for an excuse on account of his improper conduct, whereby he then himself retracts what he advanced regarding the declaration at his interrogation, and thus not only most clearly proves that his pretext, both with respect to the manner of acting of the Commissioners and the conduct of the sworn Clerk, is fictitious and untrue, but also very naturally demonstrates that he resorted to this in the hope of possibly saving himself from his crime. Which, accompanied by so much cunning and intent, can never manifest an act done out of innocence or in good faith, but rather shows that it was perpetrated deliberately and with evil intent and malice. The minutes of the 5th of this month, in confrontation with both those of the 20 and 21 October 1786 annexed hereto, will furthermore provide the best evidence of the defendant's character, from which it is established that the defendant was even ready to commit perjury. All of which circumstances help to accumulate and aggravate the crime of the defendant, since the defendant has not only made himself guilty of the crime of forgery in the absolute sense, but at the same time has also attempted to insinuate against the Commissioners, and that solely flowing from his committed forgery, partiality, bad faith, and despotism in their sacred official duty regarding the recalling and swearing of declarations. Which will cause the defendant to undergo the above-mentioned punishment all the more justly and all the more equitably, since if one wishes graciously to regard the conduct of the defendant toward the Commissioners merely, instead of a false accusation, as a verbal injury, the defendant has already by that alone merited a corporal punishment; for, says Kersteman, Complete Juridical Dictionary, volume 1, page 203, column 2, among a multitude of other authors: finally, all verbal injuries toward respectable Colleges, Nobles, and other privileged Persons, etc., in the preservation of whose equally good Name the commonwealth is interested, are not atoned for with an honorable and profitable reparation, but punished rather more severely and corporally with banishment, etc. How much more then, Honorable Sirs, if his conduct toward the Commissioners is considered, as it indeed is, as a false accusation inflicted upon their Honors in their office, must the defendant be judged to incur an exemplary punishment.

Art: 82 while furthermore concerning the crimen falsi it was enacted by the Emperor Charles V in the Edict of 30 June 1545 that all forgers, having knowingly and intentionally, with deceit and fraud, committed the crime of forgery to the detriment of another, shall henceforth be punished with the cord, etc. That this enactment was afterwards altered by later legislators and scholars, and in its place an arbitrary punishment was introduced, pursuant to which such criminals, according to the nature and magnitude of the forgery and the accompanying mitigating or aggravating circumstances, were usually subjected to having a hand or fingers chopped off, or being whipped and branded, or banished, as can be seen in Voet book 48 title 10, Huber Hedendaagse Rechtsgeleerdheid book 5 chapter 6, and all the legal scholars who have commented on the matter with sound reasons. Although one, Honorable Sirs, might somewhat remark in favor of the defendant that however premeditated and concocted the offense of the defendant was devised, the same was nevertheless not entirely carried into effect, and one might wish to apply here the doctrine of those moderate doctors of law who occasionally take the will for the deed, but nevertheless never always wish it to be punished as the deed itself, yet the Prosecutor in his official capacity believes with reason that the aggravating circumstances of the offenses of the defendant militate so strongly against him that one could never, with any appearance of reason, embrace such jurisprudence to the benefit of the defendant, especially when one wishes to keep the public welfare in view, the less so because the defendant was by no means deterred from perjury in good time by repentance or remorse, but on account of the discovery of his rogue’s trick by the judge, for which reason, the defendant being fully subjected to the punishment concluded for, he ought all the more to admire the special consideration of Your Honors in his regard. Articles drawn up and submitted to the gentleman commissioners from the Honorable Worshipful Council of Justice, in order that, pursuant to the decree obtained by the Fiscal ad interim G. Exter dated the 1st of this month, the burgher Jacobus Michiel van Koppen may be heard thereon, his answers to be properly recorded in the margin hereof. Appeared before us, the undersigned commissioners from the Honorable Worshipful Council of Justice of this Government, the burgher Jacobus Michiel van Koppen, who gave such answers to the interrogatory articles below as are recorded beside each of them. Article 1. The respondent's name, birthplace, age, and status. Says to be named Jacobus Michiel van Koppen, born in this outer district, aged 42 years, and a burgher here. Article 2. Whether he, the respondent, has not in his lifetime borrowed a principal sum of ƒ1000 from the Councilor and Secretary of Policy, Mr. Bergh. Says Yes. Article 3. Whether the late Captain of the Burgher Guard, the Honorable Jan de Waal, did not intervene as surety for it. Says Yes. Article 4. Whether he, the respondent, has not repaid this principal sum, when, and in what currency. Says Yes, and that he paid it in paper currency to the burgher Jan Smit van Delburg in the year 1783 as he, the respondent, believes, specifically in the month of November. Article 5. Whether he, the respondent, did not hand over the same to the burgher Johannes Smit van Dilburg, in order to turn it over and pay it to the surety Jan de Waal. Says Yes, and that he had paid that money to Jan Smit van Dilburg because he had already been to the house of the said Honorable Jan de Waal several times that day and had not found him at home, and therefore just gave it to the said Smith because he could not stay here any longer, as his livestock was perishing from hunger. Whether it is also known to him, the respondent, whether Smit consequently paid the principal sum to de Waal or not. Says that he cannot say. Article 8. Whether he, the respondent, did not receive a receipt from Smit reading as aforesaid. Says Yes, but that it has slipped his mind due to the length of time. Article 9. Whether he, the respondent, did not at the beginning of the past year 1786 institute an action against the widow de Waal for the restitution of the ƒ1000 or the delivery of the settled bond, for the reason that Smith said that he had handed over that money to the widow's late husband. Says that on the advice of Smith he had engaged an attorney, whom he informed of the matter as Smith had told him the true state of the matter was, and that he had relied on it even more because he thought nothing else than that Smith was treating him honestly, since about three months before the death of the said de Waal he had been to de Waal's to speak about those ƒ1000, and that the said de Waal had answered him: "van Koppen, I remember nothing of that, but come back later, I will speak to Smit about it," with which he, the respondent, had then rested content. Says that Smith van Dilburg had given assurances that he had paid that money to de Waal, and therefore he instituted that action without any evil intent or deceit. Article 16. Whether he, the respondent, had not previously and while de Waal was still alive enquired about the payment and the return of the bond. The burgher Jan Smit of Dilburg having appeared again before the gentlemen Matthiessen and Smuts pursuant to the resolution taken yesterday, there was exhibited by the said clerk exhibited the letter and the receipt, from which, after examination of the same, it appeared most clearly that the aforesaid Smit had not proceeded in good faith, both in giving his declaration and in wishing to perform the oath. Thus the aforesaid gentlemen deemed it proper not to admit the said Smit to the oath, but merely to have his given deposition reconfirmed, and to make a report of this and other matters to the Honorable Respected Council of Justice. Appeared before this Honorable Court of Justice of this government the sworn clerk of the said Council, Ryno Johannes van der Riet, as qualified ex officio to attend to the affairs of the Landdrost of the Colony of Graaff-Reinet, Mr. Maurits Herman Otto Woeke, ratione officii plaintiff in a criminal case on the one side, upon and against the Hottentots Willem and Spogter, prisoner and defendant in the same case on the other side. 1. And the plaintiff ratione officii briefly stated 2. that the prisoner and defendant are those who belong to the conspiracy of the Hottentots Kees and Dragonder, 3. regarding which he, the plaintiff ratione officii, has already exhibited his claim in writing in Your Honorable assembly, 4. and which he takes the liberty to submit herewith, with the prior knowledge of the Honorable Lord President, together with the documents and evidence in originali, 5. thus referring both to the species facti set down by him therein 6. and the thrust of his reasoning substantiated by the authority of the learned doctors of law, 7. furthermore briefly stating here only 8. that it appears very mendacious to him 9. that not the prisoner Willem, but the already executed Hottentot Kees, was allegedly the head of the conspiracy, 10. as both the aforementioned seek to present, 11. but rather that the first prisoner, Willem, is the leader of everything, 12. partly because he is exceptionally well-spoken, and also because he appears to be the most refined in his answers, 13. whereas the Hottentot Kees was very simple-minded and very poorly spoken, 14. and on the other hand, because he, Willem, as all the prisoners unanimously declare, shot first, 15. thus having served as the leader to encourage the others to follow suit; 16. he, as well as the second prisoner, has therefore merited death according to the letter of the law, 17. because both of them, as well as the two first-mentioned executed Hottentots Kees and Dragonder, made use of a weapon, 18. the effect of which could never depend upon their caution, 19. and it is still uncertain which of them fired the fatal shot; 20. that which is indeed declared by the prisoner and defendant to have been the shot of the Hottentot Kees 21. must, however, in this case be regarded merely as an excuse for them. On which and other grounds and means to be further deduced in due time and place, if necessary, the plaintiff ratione officii, making his demand, concluded that both the prisoner and defendant mentioned in the heading of this document shall, by definitive sentence of Your Honors, be taken to the place where it is customary to execute criminal sentences, there delivered to the executioner, the first prisoner, Willem, tied to a cross, the right hand and the head severed, and the head placed on a stake opposite the dead body, furthermore the second prisoner, Spogter, to be punished with the rope at the gallows so that death ensues, subsequently the dead bodies of both prisoners dragged to the outer place of execution, that of the first prisoner placed on a wheel and that of the second prisoner hanged again on the gallows, thus to remain there until consumed by the air and the birds of heaven, with condemnation in the costs and expenses of justice, or to such other ends as Your Honors shall deem proper. Says to be named Willem and a Hottentot, aged about 35 years. 2. With whom the witness last lived in the district of Graaff-Reinet. Says with the burgher Stephanus Venter on his farm called 't Zeekoegat. 3. Whether the witness did not desert from there in the month of November or December of the past year, if so, for what reasons! Says that he was afraid of the Landdrost because it was said that the Landdrost would punish all the herdsmen for letting the livestock be stolen by the Bushmen. 4. Which Hottentot men and women were in service with his aforementioned master at the time the prisoner ran away from him. Says the Hottentots Dragonder, Kees, Spogter, Bossesman, old Flamink, and a party of old Hottentot women and children. 5. How many of the same took flight alongside the prisoner! surrendered to the field sergeant 13 that the plaintiff ex officio, having gathered the necessary inquiries regarding this and that from both the mother of the aforementioned Mouton and from Mouton himself, 14 subsequently had the prisoner and defendant interrogated before the gentlemen commissioners from this Honorable and Esteemed Council upon such interrogatory articles as had been formulated by him for that purpose; 15 whereas the prisoner and defendant, during those same interrogatory articles, attempted to deny everything, 16 under the pretext that he had not drawn the knife, but rather that he had the knife in his hands because he was busy eating, 17 so that it might well be that the wound was caused thereby. 18 Yet the plaintiff ex officio, subject to correction, maintains that the complete denial of the prisoner and defendant cannot stand him in good stead, 19 because the contrary thereof is established by two irreproachable statements, 20 and which statements are, furthermore, confirmed under oath; 21 therefore, the plaintiff ex officio further believes that since the proofs are complete, the prisoner and defendant can be executed without a confession, 22 while the plaintiff ex officio on the other hand also trusts 23 that it will appear sufficiently clear to your Honorable Worshippings 24 that the crime of the prisoner and defendant consists 25 of laying hands on the son of his mistress, 26 and that the plaintiff ex officio will now only need to examine 27 what punishment the prisoner and defendant has thereby deserved, and, subject to correction, ought to be applied to him; 28 and since in such a case the general written laws cannot offer an explanation, 29 but the law which has been prescribed to us in these lands for strict observance comes most into consideration, and according to which one is obliged to regulate oneself, 30 to be found in the placard issued here by the high authority of these lands on the date of 3 September 1754, 31 fully agreeing with the statutory law of Netherlands India to be found under the title of Slaves or Bondspersons, 32 where it is enacted: 33 but if a male or female slave should presume to go so far as to lay hands upon their masters and mistresses, with or without weapons, such persons shall, without mercy, be punished with death. 34 Thus, the plaintiff ex officio also imagines, under respectful correction, 35 that the prisoner and defendant would have deserved an ordinary death penalty, 36 were it not that his advanced years operated somewhat in his favor, 37 and that the manner of conduct which country people are accustomed to employ toward their slaves is more than excessively well known. being, that about one month ago, it happened that he, the deponent, having ordered a certain male slave belonging to his aforementioned mother, named Baatjoe, to go to the garden in order to help the other slaves busy there to dig up potatoes, the same slave Baatjoe, instead of obeying this command, had remained sitting quietly at his ease until the deponent had ordered him, Baatjoe, the same for the second time; that the aforementioned Baatjoe then, after having previously muttered a little under his breath, which however could not be understood by the deponent, upon receiving two blows of a sjambok on his shoulders from the deponent, had immediately produced a knife, and had come running toward the deponent with it, stabbing, who, while retreating backwards and already being wounded in his fingers, was finally relieved by his mother, who pushed the aforementioned Baatjoe back, so that the deponent finally wrenched the knife from his hands; after which they had this Baatjoe tied up by the other slaves, and subsequently sent to the field cornet Jacobus Abraham Burgert. Relating nothing more, the deponent gives as reasons of knowledge as in the text, testifying this to be the pure truth.
